electronics at the airport now. all in a new effort to counter possible terror threats to the united states. hi, everyone, hope you had a great holiday weekend. i'm gretchen carlson. welcome to "the real story" for a monday. the department of homeland security is adding the new screenings now. they're trying to find new harder to detect bombs that could put american lives at risk. peter doocy hot on this story live in washington. who's going to notice the changes? you and me? >> travelers leaving in europe, middle east, north africa, on direct flights to the u.s. are going to be asked to prove their electronic devices like cell phones and tablets are working the same as when they rolled off the assembly line. here's why. >> they want to see your phone or laptop power up and that tells them that it's an actual working electronic device, not something that looks like a laptop filled with plastic explosive. >> tsa says, "powerless devices will not be permitted onboard the aircraft. the traveler may also undergo additional screening." remember, the tsa isn't doing these screenings at airports overseas but do have attaches stationed in certain embassies supervising this process. >> some people will say it's about time because they don't feel like other countries have the same security measures as the united states, but what really prompted all these changes? >> gretchen, government officials are saying they want to stay ahead of terrorists instead of reacting to specific new threats, but there is growing concern about hundred, maybe even thousands of people with american and european passes ports fighting alongside al qaeda in syria. those western passports presumably would raise fewer red flags on the way back home. dhs secretary jeh johnson is also worried about the sudden rise of isis in iraq. >> we're concerned any time a terrorist organizations acquires territory, picks up capability, and as i said, the terrorist threat, the potential out there, still remains, and a lot of it centers around aviation security which we continually monitor. >> right now, though, no plans to change any screening for domestic flights. gretchen? >> very interesting. peter doocy, thank you so much. so the war of words heating up now between president obama and speaker of the house john boehner as they battle over the president's extensive use of executive authority. well last week as you recall, president obama told the gop to sue him. speaker boehner now blasting that remark as something beneath the dignity of the president's office. saying he plans to move ahead with the lawsuit later this month. saying, "too often over the past five years, the president has circumvented the american people and their elected representatives through executive action, changing and creating his own laws, and excusing himself from an enforcing statutes he's sworn to uphold. at times even boasting about his willingness to do it as if daring the american people to stop him." well, the white house doubling down today. insisting the president is acting within the law as he handles the immigration crisis along our southern border. >> the law requires that. and, again, this is something that the administration is committed to, is enforcing the law. so the president's well aware of what's happening along the southwest border and that is why you've seen the wide range of steps from the authority the president already has to enforce the law. >> chris is our fox news digital politics editor. all right. a lot to chomp on here, chris. what's your analysis about this suit moving forward? who has more to lose or to gain? speaker of the house boehner or president barack obama? >> well, the stakes are enormous. to say the least. for john boehner, he'd better win because the deal is if he loses, if the courts affirm the president's ability to rewrite laws, and enforce this degree of selective enforcement that we haven't seen before and executive orders of this kind of scope, if that's what happens, the pe the executive branch will be forever enlarge in its power. this house,s congress will be disempowered and boehner won't have much to talk about and the president will be able to do essentially what he wants regardless of what happens in the midterm elections in the next two years. if boehner wins, the president's agenda, essentially to use expanded executive powers to force through an agenda to leave his legacy on issues, especially like immigration and global warming, that he can say that he had a successful presidency. the president's future is at stake very much here. if he loses on this, there's not much left for him to say or do other than for the first time negotiate with republicans on consequential things. >> yeahs it's interesting because in this editorial that the speaker writes, he says, you know, look, people are still asking where are the jobs? the house has passed more than 40 jobs bills that would help, but washington democrats led by the president just ignore them. is that the basis -- i know there's a lot of other issues, we just talked about immigration as well. is this the basis of trying to move forward with this lawsuit? >> the basis is two things. immigration and obamacare. the president has used the -- the democrats talk about the number of executive orders or the number of executive actions. the number is a canard here. it's not important. the scope and consequence, where the president rewrites essentially black-letter law. you must do this by this date. you must not do this by that date. he disregards those things and says he knows what's better and this has even come out, and you remember the bowe bergdahl prisoner swap for the five taliban leaders. when that happened, president said, look, i know what the law said that i had to consult with you, but it was -- i didn't want to do it, it wasn't the thing i wanted to do so i didn't. those are the kinds of moves that boehner is trying to block. >> can you imagine the legal teams on both sides of this fence right now? i mean, i'm thinking about watching "house of cards." can you imagine how they're hunkering down, the bhaum teoba and boehner team? what advice they both are get. are they hearing, yeah, we think both of you can win. >> i'm sure that's part of it. the biggest part is the president's legal team has been a big loser in the last, let's say, year, at the supreme court, especially on this question of what the president's powers to say and do are. these include a lot of unanimous decisions from including justices that the president, himself, appointed. he's got a big problem when it comes to making the case for his degree of newly invented executive authority. and boehner has a pretty good case to make, but these stakes are high and we will be watching this closely because there's some nervous politicians in town about this one. >> no doubt. understatement of the century maybe. thanks so much, chris. great to see you. >> you bet. we have new developments out of the mideast today. tensions running high. more rocket attacks in the wake of those deadly kidnappings. first three israeli teens. one a u.s. citizens. then a palestinian teen. well now, hamas is vowing revenge after it claims several of its members died in israeli air strikes. john, we're hearing about new rocket attacks today. what can you tell us? >> reporter: just within the past hour, gretchen, we're hearing that 30 more rockets were fired in southern israel. seems like we're getting these updates now -- i'm getting them on my phone from the ids, israeli defense forces, every 15 to 20 minutes. to give you an idea why this is significant, at this rate, the total barrage just for today could top 100 attacks. since mid-june according to military officials, around 200 rockets have been fired into southern israel, so this situation is getting very tense. having said that, let's show you some video from overnight when dozens of rockets had been fired into southern israel along the israeli/gaza border, causing damage, hitting various locations. no one was hurt or killed, fortunately. but at this point, in terms of some of these latest developments, we're also hearing that 1,500 reservists, military reservists have been called up to add to the military contingent already posted up along the border in the southern part of the country. so, no word about any damages of injuries at this point with this latest barrage of attacks, but, again, things are starting to get tense. gretchen? >> all right. why is the nsa collecting and saving your selfies and pics of your kids though you're not involved in a terrorist organization? a the government has highly personal data from ordinary internet users like you and me. why why? >> a massive crash at daytona. a high-speed version of bumper cars. check it out. plus many parents post pics of their kids on facebook, so do you think this photo is pornographic? why one mom is facing now a possible lifetime ban from facebook after sharing this picture of her daughter. right back. >> somebody had reported it for pornography and nudity and they sent me a notice and there was a button to delete it and i wasn't deleting it because i did not find it was pornographic. ♪searching with devotion ♪for a snack that isn't lame ♪but this... ♪takes my breath away back to "the real story." did you see this massive crash, taking out half the field at the coca cola at daytona yesterday. biffle tapped kasey kahne, setting off that chain reaction. kyle busch doing a barrel roll, coming to a stop upsidedown, thankfully not injured. busch said it felt like a carnival ride. rain pushed the race to sunday. two more weather delays ended the race early giving eric almirola the checkered flag. why does the nsa need your selfie or pictures of your kids? turns out the "washington post" found out the nsa is collecting far more internet data from regular users like you and me than the supposed foreign targets. according to that report, the "washington post" reviewed about 160,000 intercepted e-mails and instant message conversations. roughly nine out of ten users were not direct targets of the surveillance program. many of the files described as useless by analysts. so why are they holding on to private details from ordinary people's lives? of course, the documents provided by ed snowden from 2009 to 2012. joining me now for more, former nsa deputy director, somebody who would know a lot about this. good to see you, mr. leighton. why are they holding on to selfies and pictures of my kids ken the viewers' kids ostensibly? >> gretchen, good to be with you. the real issue here i think is these types of selfies, portr t portraits of a private nature, really shouldn't be held on to unless somebody's a subject of an intelligence investigation or criminal investigation and in 99.9% of those cases that is not the case. in my view, the nsa should not be holding on to these. why are they doing it? they're doing it because they believe that they need to establish an idea of the landscape of the cyber landscape that's out there. so they want to get a feel for what is normal and get a feel for what it abnormal and they also want to be able to track people who are potential terrorists. they want to be able to track people who are potential adversaries of the united states. >> yeah. >> that's basically why they're doing this. >> this is a very controversial topic. i think people kind of understand this sort of vacuum-like approach to corralling in all this information, but for goodness sake, once they see the picture of my kid at the beach, obviously they discard it, but they're not. >> they should be discarding it. you know, these kinds of pictures of people at the beach, and people in other private moments, are totally irrelevant from an intelligence collection perspective. so what really needs to happen is there need to be some really strict guidelines that need to be put back into place when it comes to collection of this type. as i grew up through this system, it was very clear that certain things were not to be collected. among them, data from u.s. persons unless you had a warrant. that's the kind of -- >> i want to read you their response. i want to get your impression. this was their response to the "washington post" article. "it's hard with over 1 billion people using facebook we have to put in set a place of universal guidelines that respects the views of a wide range of people. these are to ensure facebook remains a safe, secure environment for everyone on facebook." you and i have seen worse things on facebook than this, right? >> there's definitely worse things. if you're under the age of 30, what people post on a saturday night going out on a night of drinking, it's pretty raunchy. that's pretty harmless, cute. i think somebody's overreacting and had that out for this person. >> all right. let's talk about another photo that generated a tremendous amount of controversy. several photos, actually. this was of a young girl who hunted and went over and posted photos of herself with some endangered species. what to you make of that? here's the photo. let's keep in mind she got all the right permits to do this. she was over in africa. she was with a rcheetah. this inspired people to write pretty terrible things on facebook then her pictures were taken down. right or wrong? >> the problem was people were condoning violence against this girl. if you're pro hunting, you're really into it. same thing about protecting animals. you have two people clashing heads over something. when you have, you know, people on the left, you know, the more animal lovers are threatening violence. i've seen posts, a couple stories out recently of all the pro-animal people saying, you know, we should kill her. there was a couple incidents with that. i think facebook got rid of it on that level. they just have a zero tolerance policy about violence. >> zero tolerance on both sides. >> here's their statement on the ban hunting photos. well, it was a busy week for the irs facing a federal judge over why congress wasn't told they lost two years of e-mails from lois lerner and six other officials. meantime, irs chief -- hand over whatever e-mails they might have left. and the chair of the investigating committee says justice department needs to take action against her refusal to answer questions on the targeting of conservative groups. listen. >> until the justice department actually does a criminal investigation, hopefully with a special prosecutor, the american people aren't going to believe for a moment that, in fact, nobody's at fault here. this was just an accident, some rogue people in cincinnati as lois lerner and the president would have had you believe. >> former political adviser to frank lautenberg and fox news contributor and david abella is the president of go pack. all right. this story is not going to go away, julie, as much as i believe that the administration -- kind of simmer out. what's going to happen when these e-mails come from john kos conan? >> i said months ago they needed a new prosecutor and happy to hear darrell issa is willing to reli relink wish the grandstanding. if they're concerned about geing to the bottom of this, give lois lerner mimmunity. see what she turns up. may be the buck stops with her, may be nobody else was implicated. >> david, it's interesting why that has not happened, why they haven't given her immunity. >> if we had a justice department that wouldn't pick and choose which laws they would enforce and actually investigate, that would be a great idea. this is why this issue is relevant to people because every day you can spend hours trying to decide what e-mails to keep and how long you have to keep them and what we find is the irs doesn't follow those very same rules. and if people get more and more frustrated by the fact that they're following laws that the irs is creating but not following, it only increases the amount of distrust mthat americans have in their government. >> the irs did say their computer crashed. it sounds convenient -- >> in 2014, there are plenty of people who believe that there are backups out there somewhere. >> there are. but, you know, she was supposed to by law, they're supposed to physically print out manually every single e-mail which i guess nobody really does. but that's really the law. can you imagine printing out -- >> wait a minute. you're saying that like it's no big deal. the fact of the matter is if you or i are audited, darn tooting sure we have to present those e-mails. >> i'm simply suggesting there's trael really no evidence despite the fact it's suspicious and i agree with you on that, she claims her computer crashed. that's what happened. unfortunately you can't prove otherwise. before we say she's guilty of something, let's assume, take her at her word, give her immunity. see what she comes up with. >> why won't the irs let people from the outside come in and figure out exactly how the systems crashed? >> it's a great question and it has to raise additional concerns of today it's lois lerner and her e-mails. what's to say tomorrow it's not health care records and all of a sudden the irs says you didn't pay your taxes on not having health insurance and have to pay back penalties and prove to the irs you've, in fact, actually had health insurance, you're not susceptible to the penalties and the interests and you've got to get legal counsel, got to get financial resource to defend yourself against an irs that can't even keep e-mails? we're now going to have them administering the health care system? >> you and i are 100% on the same page. this is the organization that puts the fear of god into every single american. we're terrified of being audited. the way this was conducted was not right. to say this is a vast left-wing conspiracy that darrell issa and others are saying, there's no evidence -- >> we don't know that. >> we don't believe lois lerner did this by herself. she wasn't sitting at her computer -- minus chuck grassley. >> doesn't that bring it full circle as to why, why everything is so suspicious and why we don't have all the answers yet? i hope at some point we do get them, but it must be a fox news alert because you two agreed and normally you don't. great to see you. the dictionary lists several meanings for transparency, but the obama administration came up with its own definition. they're advising local police to keep us all in the dark about secret surveillance technology to track and even tap into their cell phones all without a warrant. shannon live for us in washington. shannon, how does this work? >> it's called a cell site stimulater or sting ray and sends signals to cell phones tricking them into thinking they're communicating with a cell phone tower. from there it can send information about the source about exactly where the phone is located and other personal information. ginger mccaul and another privacy expert i spoke to had this to say. >> the fbi has been instructing local law enforcement not to disclose some of their methods including the use of these sting ray devices. that really shouldn't be happening. the obama administration has promised to be the most transparent administration in history. >> and she went on to say that there is evidence she has that federal agencies including the fbi are specifically instructing local law enforcement entities to hide the fact that they're using this technology and they're questioning how that squares with the administration's promises regarding transparency. gretchen? >> all right. so this is the biggest question out there, but what are the biggest concerns? there seems to be a lot. >> yeah. let's start with this. the technology is not targeted. meaning it scoops up all kinds of data on innocent bystanders who aren't suspected of doing anything at all. second, what happens to all that information that law enforcement is collecting? here's what ginger mccall says about that. >> we heard from her before, so i will skip ahead to the rest of this information. the fact is, you know, she tells us that of course the nsa has this large place that we know about out in utah where they're collecting information and she says there's no way of knowing what happens to all this information. she says the government likes to keep information, not tell you about it and use it when it becomes valuable to them. we've reached out for comment to find out what the feds have to say. gretchen? >> all right. wro we've heard this before, because we both have on the same color today, when i've been looking at the monitor of you, people say we look alike, right? >> since i've joined fox people have been saying that asking if we are sisters. i would be honored. >> when i keep looking down at the monitor i'm doing a double take, whoa, we do kind of look alike. >> i think so, too. >> tweet us, facebook us, let us know if you agree with that. have a great week. >> you, too. dozens of nigerian girls who had been kidnapped by the terror group boko haram have now escaped. that's the good news. more than 200 abducted schoolgirls are still missing. greg, what do we know about the girls who managed to escape? >> reporter: gretchen, the first thing to remind our viewers, these are not the girls who were kidnapped back in april, that crime, of course, got the world's attention. but these girls and women, local officials say something like 60 of them, were kidnapped in the very same area of northeastern nigeria by the very same dangerous group, that islamist outlet, boko haram group. they managed to get away on their own late last week. one account says they fled when their militant captors were busy fighting. boko haram has been stepping up attacks on christian villages in that area of nigeria as well as being involved in a whole lot of clashes with government force there in the past couple of months and those ugly kidnappings, gretchen. >> all right. how's the hunt, greg, been going for the original girls? >> reporter: late today we heard from a spokesperson for the nigerian government. they are claiming they're following a number of leads in the case, but there really are no sign that the nigerian government is any closer to finding these girls. it is believed that the boko haram group headed by the abu bakr fellow we've seen in propaganda videos are still holding most of the 200-plus school schoolchildren. analysts think they've broken up the large group into smaller groups and dispersed them, maybe brought some of them outside of nigeria making any rescue attempt harder. the worldwide bring our girls back campaign is bringing pressure to the government. the government knowing where the girls are but not going after them because of the risks. they're also saying they won't negotiate with the terrorists. the terrorists want some of their own held by the government to be handed back. apparently the u.s. involved, too, to some degree. there are drone aircraft supplying intelligence to nigeria and indirectly may be giving a little pr advice to nigeria. the government reportedly hiring a washington, d.c., public relations firm. maybe they can help find the girls as well. back to you. >> we hope so. greg, thank you. it's time to check in with shepard smith, reporting live from the fox news deck. >> hi, gretchen. thanks. better charge your phones and laptops before you head to some airports. the feds are telling passenger, some of them, flying into the united states, in you can't power up your phone or laptop or whatever it is, you have to leave it behind. this is happening after reports that terrorists are work on new explosives that could slip back some airport security. we'll talk with a former deputy director of the transportation security administration about what this means for all of us passengers and what it says about the intelligence on this brand new threat. that's next. top of the hour on "shepard smith reporting." see you then. >> thank you. they're off. the annual running of the bulls with man versus beast. who came out on top on day one? >> reporter: hi, gretchen. cobb county authorities have taken out an additional 16 search warrants in the case, specifically they want to look at the father's iphone, external drives and cd-roms for information on the family's student loans, car loans, credit card debts and insurance policy the parents apparently had taken out on the toddler. investigators are looking for more information on web searches that justin ross harris allegedly made regarding fatalities and cars in the days leading up to death of his own son. police also want medical records, photographs and other information that might shed light on 22-month-old cooper harris' overall health and development in an apparent effort to investigate the father's claims that the toddler had no health or developmental issues. justin ross harris reportedly told investigators he forgot to drop his son off at daycare on june 18th and didn't realize he'd left him in the suv until he was on his way home from work late that afternoon. but police say security camera video shows harris returning to his vehicle in the middle l of the work day to drop off light bulbs he purchased during the break, so investigators secured a warrant to search the family's home and see whether their supply of light bulbs was actually in need of replenishment on that day. investigators will be examining harris' online correspondence to glean any insight into family dynamics that may have been going on at the time. investigators say that harris told them that he was happily married, but investigators say that they found evidence that harris was engaged in what they describe as inappropriate sexual communications with other women. gretchen? >> you know, that's what the police are going to be looking at. motive. the other thing we were just talking about was the texting that was going on. the sexting actually that was going on. six different women were being sexted or texted to by the father during that seven hours little cooper was out there. the other thing, the surveillance video. we, the father went out there, opened up the car, apparently looking for something. didn't even notice the child wasn't moving, wasn't doing anything. and then you bring in the mother. the mother when she was asked about this said to the husband, apparently according to what i've been able to glean, did you say too much? >> right. >> in other words, not oh my gosh, what have you done to our poor child, what happened with cooper? did you say too much? >> there's a whole bunch allegedly about the mother and the way in which she emotionally reacted. i want to be clear that oftentimes people in these types of situations react differently. >> could be in shock. >> could be in shock. in fact, that's what she said when her own mother apparently was like, why are you not crying? how does she factor into the whole case now? what do police want to know about her? >> what i would do if i were prosecuting this case, looking at this case, i would bring her in. she does not have spousal privilege. people say, you can't testify against your husband. there's no spousal privilege when you're talking about domestic abuse or death of a child. i'd bring her in. you said, did you say too much? didn't react in a way most normal people we think would react. you better talk to us now about what your husband did or what we think he may have done and try to work one against the other. >> apparently she had also done searches on her computer as well about kids in car seats in the heat. >> what she's saying is that was her biggest fear. it's a very strange thing to be looking at that, both of them, both parents looking at that. >> real quickly, what about circumstantial evidence?
