pro-russian separatists on their own ground. but it's almost as if they're taking baby steps against this pro-russian stronghold. it's a situation quickly spiraling out of control. the ukrainian air force has been flying their helicopter gunships overhead all day in combat air patrols. the ukrainian military is truly making an effort, checkpoints along the highways, armored personnel carriers, men cheging the cars. the question going forward, do the ukrainians have the order to contain the pro-russian separatists or are these guys over here clearly special operations forces being readied to move in against the pro-russian separatists that have taken over a number of buildings and try to retake a number of these cities? the russians are also doubling down on the potential use of force today. the third day this week of military drills by the russians on the ukrainian border. some 40,000 troops they have there just waiting for the go order by president putin of russia, who has said he is willing to use force inside of ukraine, not only to protect russian citizens but also to protect russian interests. the big question, is this latest move by the ukrainian government enough to give him a pretext to invade. over the past 24 to 48 hours, the russians have been rump ramping up the rhetoric calling the use of the ukrainian government to put down the insurgency, quote, a crime. whether or not we'll see russian troops heading over the border is anyone's guess. certainly the next 48 hours will be critical to see how this goes. >> leland, thank you. president obama warning russia it will face more sanctions if moscow invades eastern ukraine. >> if and when we see even greater escalation, perhaps even military incursion by russia into ukraine, we're prepared for the sort of sectorial sanctions. we'll keep the arrows in our quiver. >> our next guest says we need to deal with russia like a schoolyard bully. and the sooner, the better. indiana senator dan coates is among a group of republicans calling for tougher sanctions on russia. and the senator is my guest. a schoolyard bully. what should president obama do? >> he should back up his tough talk with some action. we've been imploring him to impose sanctions. it's been seven weeks, almost two months now since the president has said russia's going to pay a price. what's the signal been to putin? all talk, no action. and whether it's sanctions on their financial, their banking, whether it's economic sanctions, sanctions that really cripple their economy, nothing has been done. what message does this send to putin and to russia, you can do whatever you want to do because the united states is toothless. >> so recently the senate passed a ukraine resolution that was partially sponsored by you. what did that say? >> well, we had 15 things that we suggested to the president he could do if he would take the action. none of them have been undertaken. i issued a second piece of legislation. we're working on a third piece of legislation. but i'm not the president. no senator is the president ultimately. this president has to step up and take the action that is necessary to let russia know that they just don't have a free hand in doing what they're doing. >> what would that recommendation, though, be from you? because some in the senate and the house have said maybe military action or at least supplying military aid to ukraine. where do you fall on that? >> well, listen, i think we do need to support ukraine. but we need an assessment by european command in terms of what do they need and what can we give them and what kind of training would they need to use those? i'm not advocating a military, boots on the ground response by the united states. but there are clearly a number of other things that can really hurt russia in the pocketbook, really go after their banking, their financial, their exports. make them pay a real price. isolate them, reenergize nato. we can get europe to stand up and say, we're going to support nato -- it's back to the future for nato. nato's been, oh, we don't need that anymore, russia's safe, no problem. we need to show support for nato allies and take a strong stand in europe. >> you bring up europe. i know you're a former united states ambassador to germany. you have tight ties to angela merkel. do you plan to meet with her, ask for germany's help in this? >> well, she issued a pretty tough statement today. i'm not surprised. she's one tough lady. she can be very resolute. to date, she's looked at the diplomacy route. that has not worked very well. she's now talking about hard sanctions. she'll be in town in washington next week. i plan to meet with her on thursday, i believe it is. and encourage europe and germany to take a stand with the united states and nato to show some real resolve. >> it looks like we could be on the brink of civil war in ukraine with russia not backing down. senator dan coats, always great to see you. thank you for your time. now to health care. oregon's state-run insurance marketplace is so screwed up, it may now throw in the towel and give control of all website operations to the federal government. something you wouldn't be able to tell, though, from their trippi colorful ads. ♪ >> everything looks okay by the ads, right? not so. the cover oregon board expected to vote today on handing over that control to the feds. oregon's collapse comes as federal health officials investigate other failing state exchanges as well. joining me now is patrick sheehan. great to see you, patrick. i guess you would have said "i told you so". >> yeah. i'm still saying it. going to be nice not to hear that jingle anymore. >> that was good news to some people, maybe more of a nightmare to you. remind viewers why you knew that there were problems from the beginning in oregon. >> well, i was on the legislative oversight committee that got the very filtered and limited information that was coming out of the oregon health authority. i found out that there was other software out there that we could have licensed rather than trying to build our own, which has ended up being a giant mistake. >> but you also were back here on "the real story" a few months ago talking about an fbi investigation into the woman who was running this exchange. and what were the allegations about what was really going on? >> well, it's not just the woman who's running the exchange. it's the exchange itself. there's just a culture of cover-up. it goes all the way up to the governor's office. the fbi is interested in it. i have spoken with them at length and given them a lot of information. they can't confirm or deny anything obviously. but the allegation was that cover oregon used screen shots and dummy content to pass federal gate reviews, required for the money to flow in. which is really just a blank check. they've spent $248 million i think in today's paper, which ironically today's paper i was reading online had ads all over it for sign up for cover oregon. >> that's funny because not one person has been able to sign up online in the entire state. it's my understanding 68,000 or so have signed up using paper applications. you're talking about almost $300 million now that has just gone down the drain. to go on the federal exchange, it's supposedly going to cost taxpayers again maybe $5 million to $6 million. do you see this as a good alternative? >> couldn't get enough of you. >> that's a loaded question. mike, is this a good idea? he's getting his father's endorsement, former president says another bush should be president. >> not much keeps me up at night. but when i have to grab for my bottle of ambien, it's thinking of jeb bush as the republican nominee. >> really? shocking. >> if he is, i'm all in. he'll be better than the alternative. but i think mrs. bush has it right. a lot of americans are saying, enough with bushes in the white house, enough with political dynasties and families that continue it. he's a good man. he's dipping his toe in the waters clearly. but i think americans are ready for a fresh start, a new face. >> alan, are you shocked? gallagher comes back from five or six weeks off and he's shocking me now. are you shocked? >> i'm not shocked. he said he'd vote for any republican. not that the republicans don't listen to me, although well they should, but jeb bush would be their best nominee, i think. he's not a nut job. the fact that he comes from a dynastic family is a downside, as barbara bush says. but he's much more open-minded in so many of the other republicans who could be running. for the party to be inclusive as it needs to be to attract those from other countries -- >> thank you for making it easy for me. an alan colmes endorsement is the biggest red flag of them all. >> this might be one topic that a presidential candidate will have to talk about. going to pot now. retired supreme court justice john paul stevens raising a lot of eyebrows with his comments about legalizing marijuana. listen to this. >> i really think that that's another instance of public opinion has changed. and recognize that the distinction between marijuana and alcoholic beverages is really not much of a distinction. >> mike? >> he was probably high when he said it. i'm sorry. >> oh! >> this is the way you talk about the elderly? >> i hope i have those kind of genes to make it to 94. listen, we do not need one more mind-altering drug legalized in this culture. leave it to liberals. we have sotomayor and her dissent over the michigan case this week. when you get into the heart and mind of a liberal -- >> but does he have a point, though? >> no. >> from a criminal point of view, when you look at the stats, a lot of these arrests and people in prison are from possession of pot. do the police have more opportunity to go out and find murderers? live for us with more on the jills. what else did you learn, trace? >> the five former buffalo jills are suing the buffalo bills football team as well as the company that manages the cheerleaders. their main claim is they should be treated as employees because they have to work at least 20 hours a week. and they make anywhere between $100 a year and $1,000. $800 is far less than the $8 minimum wage. but they say they're also not reimbursed for out-of-pocket expenses like uniforms, hairstyling, makeup, even travel expenses to mandatory events. then there's the jills guide to etiquette glamour and hygiene. quoting here, do not be overly opinionated about anything, do not complain about anything, ever hang out with a whiner? >> well, the bills say they made it very clear these girls are not employees, or women aren't employees. they are volunteers. they have hundreds of girls trying out to be jills every single year. other cheerleaders have sued other nfl teams. but a former cheerleader we talked to who's now a current lawyer. she says she does not believe that this will be settled in the courts. listen to her. >> i think it's going to end up on the commissioner's desk. if he decides to go to arbitration, if he approves it and decides it's the time to make changes, it's going to happen there. it's going to be an internal change across the nfl. >> by the way, the jills alumni says these five who are filing this lawsuit are nothing more than malcontents. >> but it's interesting how once there was a lawsuit and now you hear the story from a lot of different squads. trace, thanks so much. following breaking news this hour. a high school junior stabbed to death just as classes began this morning. >> a member of the school staff witnessed the assault. and she, along with other members of the school staff, discovered the victim to have life-threatening injuries. and some democrats are nnow embracing obamacare in their campaign ads. will this new tactic help them keep the senate? >> i was lucky, i beat cancer. but the insurance companies denied me health insurance because of a pre-existing condition. i now have health insurance again because of mark beggage. fox news alert to tell you about now. there's been a fatal stabbing at a high school in connecticut. the attack happened just after 7:00 a.m. this morning as students were arriving for class. the victim, a 16-year-old girl. jonathan hunt joins us live with the latest on this. jonathan, what do we know about how all this went down? >> the jonathan law high school junior prom was due to take place tonight. and just after 7:00 a.m. this morning, 16-year-old marion sanchez was approached by a fellow junior, a 16-year-old male student. according to friends of her, that male student asked her to attend tonight's prom with him. and when she said no, according to one student, he, quote, slashed her across the throat. her injuries were fatal. here's the school superintendent. >> we are obviously devastated by the loss of one of our students, maron sanchez. she was a 16-year-old junior, vibrant, very, very involved in jonathan law high school, an incredible contributor, someone who was loved and respected by both her peers as well as her students. the jonathan law community mourns greatly the loss of maron and our thoughts and prayers go out to her family. >> as you would expect, all school classes have been canceled for the day as has the junior prom that maron sanchez, you see right there, was hoping and looking forward to attending tonight. gretchen? >> this is such a horrible story. i understand that some members, were they students or members of the staff who witnessed this? >> students and staff both witnessed this. and a couple of teachers who were in the area of the school where this attack took place rushed to help maron sanchez. one of them apparently holding her in her lap until first responders actually got there. but it was a horrific scene, as you can imagine. counselors are going to be made available to any students and staff who need them. just a terrible, terrible tragedy on this friday when, as i say, that prom was supposed to take place. >> jonathan, thank you so much. deteriorating situation now in ukraine with pro-russian forces refusing to abide by an agreement reached in geneva. president obama threatening more sanctions against russia. but even the president admitting sanctions may not be enough to keep putin at bay. chief congressional correspondent mike emanuel at the white house for us. the president is in south korea. what is he doing about ukraine? >> it's the middle of the night in seoul now. but the president was working the phones earlier. white house aides say president obama spoke with british prime minister cameron, french president hollande, germans chan chancellor angela merkel and renzi. the president hinted at broader penalties later but more targeted action now. >> what we've been trying to do is that continually raise the cost for russia of their actions while still leaving the possibility of them moving in app different direction. and we'll continue to keep some arrows in our quiver in the event that we see further deer deterioration of the situation over the next several days or weeks. >> one would expect a telephone consultation with allies to continue on this asia trip. >> so the big question, mike, is how are the russians responding? >> not well. sounds like russia's foreign minister is aggravated by secretary of state john kerry's demands of the russians. sergey lavrov a little earlier blamed the united states for problems in ukraine. >> well, it's quite telling that they chose the moment of vice president of the united states visit to announce the resumption of this declaration because the launching happened immediately after john brennan's visit to kiev. so i don't have any reasons not to believe that the americans are running the show. >> meanwhile, ukrainian leaders are saying they believe russia is intent on starting world war iii. gretchen? >> tense moments over there. mike, thank you. a lot of democrats running away from obamacare ahead of the november elections. but in pennsylvania, they're falling all over themselves to embrace the law and their ties to the president. check out this campaign ad for a democrat running for governor. >> worked with president obama on the affordable care act and getting health coverage to all americans. it was my legislation that said, insurance companies can no longer deny coverage for kids with pre-existing conditions. it's something i'm proud of because it also closed the gap in prescription drug coverage for seniors. >> ellison barber is a writer for "the washington free beacon." ellison, what do you make of this? for months, we've heard about the obamacare debacle and democrats running away from it. now they're running on it, at least in pennsylvania? >> this is a unique situation. the main person running on it is schwartz. this is the primary. it's the democratic primary. the situation with her, she's 31% behind the front-runner in that race, which is tom wolf. their primary is held on may 20th. you see her doing this because she is really far behind and she's running out of time to make up the gains. if she wasn't so far behind, i'm not convinced she would be doing this. >> do you think it's different in the primaries? that's a great point. is it typical for the base -- the democratic base to come out and vote in those primary elections and also, i guess in pennsylvania, just looking at this poll right now, 64% of democrats approve of obamacare. >> right. that's across the board, across the country democrats typically do approve of it. it's the independents and conservative that is don't. and that's the majority of the population. they make up over 50% that are saying, we don't approve of this law. you have some people like schwartz and like the candidate in west virginia who are putting out ads seeming to embrace it. i think they're only doing it because they're people who are losing. but in terms of tom wolf and people who maybe will win, if they do it now, they risk pigeonholing themselves. >> that's interesting analysis. we had another poll um p on ou screen i want to bring back. this is a fox news poll about independents. we know how important they are in every election. if obamacare is the only difference between candidates, you will vote for one who will fight against obamacare, 54% of independents agree with that statement, ellison. so if you're looking at and you're a candidate, wow, right? >> yes, you are. if you're going to potentially win your democratic nomination, you don't really want to fully embrace it. some will run on the, we want to keep it but we want to fix it. that's different than outright embracing it like you're seeing this candidate do in pennsylvania. that's still saying we acknowledge there are problems. i don't think many people are going to say, absolutely, we love this law, everything about it is great. >> you know what else was interesting was in that ad that we showed, the candidate for governor, she talked about the things that almost everyone likes about obamacare, which is that kids can be under their parents' plan until they're 26. there's not a lot of controversy there. and also prescription drug coverage for the elderly, what she didn't bring up were a lot of the controversial points, right? >> right. that's something you see in an ad that mark begich has. it's by a surmg. it's by a super pac. he never once mentioned obamacare or the affordable care act. and he focuses on covering pre-existing conditions. it's an issue that's the least controversial part of the law. they're not running on keeping your doctors or networks. they're focusing on the least controversial aspects for now. >> ellison, thank you so much. time now to check in with shepard smith. >> it's the defense's attorney now in the trial of that homeowner in minnesota who killed two unarmed teenagers who broke into his home. he says it was self-defense. the prosecutors call it murder. they claim he planned the entire thing. a forensics expert says the suspect shot the teens a total of nine times, including one shot that the gunman called a good, clean, finishing shot. we'll get the latest from the courtroom, break down the case with a trial attorney, top of the hour. >> thanks, shep. tiger woods on a double date of sorts. why the golfer and his girlfriend and his ex-wife are all hanging out together. plus, a marine veteran in desperate need of urgent medical care hoping he doesn't end up like other veteran who is died waiting for their appointments at the v.a. one family begging to see a doctor finally got an appointment, a week after the patient died. >> i was screaming, how dare you! do you know my father-in-law is dead? thank you, v.a. ... ... ... ... ... ... ... ... time to check out what america is clicking on today. a wild police chase near oklahoma city. the suspect's getaway vehicle? an rv. they didn't get too far. the police nabbed them after just 30 minutes. a new gallup survey says people living in alaska and montana have the most state pride. the poll showing positive attitudes go hand in hand with cold weather and mountains. i can attest to the cold weather being in minnesota. and tmz snapping a photo of tiger woods sandwiched between ex-wife elin nordegren and lindsey vonn. . a government health care scandal in arizona as we told you about yesterday, dozens of veterans were placed on a secret waiting list and died waiting for an appointment. the department of veterans affairs medical center in phoenix apparently kept two sets of books to hide a giant backlog. it looked good on paper but the results were deadly. >> we don't actually know what the people on the list died of because we never got a chance to see them or examine them. >> talk about not trusting the government to deal with your health care. david served in the u.s. marines. now he finds himself stuck in this intolerable situation with a heart condition and he needs surgery. he's my guest. david, thank you for coming on "the real story" today. >> good afternoon, gretchen. thank you. >> you served your country. you were in the marine corps from 1991 to 1997. you've been on disability because of knees and shoulder injuries. but now you have a serious heart condition. what's wrong with your heart? >> yes, ma'am. it's basically every now and then, my upper half of my heart beats faster than the lower half of my heart. >> what happens when you go into one of those sort of episodes? >> when i have the episodes, i basically have to have medical treatment. denozine is the only thing that gets the heart back into regular ticking order. >> you first started having this a couple of years ago. they thought you were having panic attacks. you went to the v.a. in phoenix in february and you were having a major attack. what happened? >> i arrived at the phoenix v.a. at 11:04 a.m. checked into the emergency room there and it wasn't until 12:22 that i was seen by the first nurse. they checked my vitals, noticed there was a problem. hooked me up immediately to an ekg and 20 or 30 people started running and found a bed quick. >> you need this surgery, it's called oblation. that puts your heart back into the right rhythm. when is that going to happen for you at this hospital? >> after the february 4th hospitalization with the v.a. here at phoenix, that's when we had an appointment set up. that appointment was for april 7th. and april 7th, i was able to finally speak to a cardiologist. at that time, that's when we went to the outsourcing method. i have an appointment on april 30th to try to set up a time for the surgery. >> so you're not going to have this surgery at the v.a. in phoenix? >> the only place, according to the doctors there at the v.a., is either at the tucson v.a. hospital or it's outsourced locally here. so they elected to do the outsourcing here in phoenix. >> in the meantime, as you've waited to have this problem taken care of, you can't really work full time, right? >> it's been difficult. i just had another episode this wednesday of this week. i was raced from work at 222 beats a minute of heart rate. on the way to the hospital, they did the medication and i stabilized from there. the doctor at the hospital tried for an hour and a half, two hours to contact any doctor at the v.a. center and just had ringing phone calls. so eventually i had to leave -- i couldn't afford the hospitalization stay there at that hospital. so i had to leave against medical advice. >> david, what do you make of this report now that's coming out over the last few days that there's this secret waiting list and that as many as 40 veterans have died? >> plenty. the issue raised here by fox news' reporting boils down to this, whether the pentagon's reliance on russian hardware for space launches is undermining washington's use of sanctions. to deliver heavy payloads into space, satellites with classified missions, the u.s. air force employs the atlas v system. the contract was awarded to a joint venture between lockheed martin and boeing to purchase engines. but the engines that ula uses in the atlas v system are manufactured by a kremlin controlled entity called npo. the engines are rd-180. powered in part by liquid oxygen and fetch 15 to $20 million apiece, the russian space sector is overseen by the deputy prime minister of the russian federal racing and a long-time putin ally and one of the officials name in the sanctions announced on march 17th. >> there's an impetus for ula to go out and purchase as many russian engines as possible before future sanctions go into place. this may not be in the best interests of u.s. diplomacy. >> a spokesperson for ula told fox news, ula maintains a two to three year supply of rd-180 engines in the united states to minimize potential disruption, the supply chain has never experienced a supply disruption in the 15 years of imports and russia has taken no action to restrict sales or exports of the rd-180. we asked the state depth whether u.s. diplomacy on the ukraine is being undermindded. >> the individual you're refer to was a sanctioned as an individual, not a company. we have a range of authorities and flexibility with the executive order. >> today the ceo of space x, a commercial firm that launches satellites for nasa and the private sector, announces he is filing a protest in the court of federal claims over the air force contract with ula, crueltying no-bid terms and it's hard to imagine that some way the deputy prime minister is not benefiting personally from the taxpayer dollars being sent to the kremlin. >> james, thank you so much. never before seen images of two u.s. ships sunk by german forces during world war ii. coming up. with diabetes, it's tough to keep life balanced. i don't always have time to eat like i should. that's why i like glucerna shakes. they have slowly digestible carbs to help minimize blood sugar spikes.
