Which he was impeached. Do you think it was an Impeachable Offense . Well, you say the president s behavior for which he was impeached. I think the president s behavior constituted an Impeachable Offense including all the misrepresentations of law and fact that he made about the the election, about how the defects in the elections that he says could have changed the outcome, about the power of congress to act after the electors had been chosen by the states, the power of the Vice President to affect the outcome that he then told people to go to the capitol and be strong, not withstanding that he said they should go peacefully and patriotically but once the violence started, he could have anticipated violence, he was watching frit the white house, didnt issue statements, certainly didnt go out there and try to stop it and for all of those reasons i think what he did was impeachable. That wasnt what he was charged with. Paul let me ask you specifically about one element of that, the charge of incitement here to to violence. Yeah. Paul we had an oped this week by a prosecutor said it would not have constituted incitement under the criminal law, what about politically . I dont know that theres any difference between the criminal law and politically if youre talking about incitement. That has to do with whipping people at the time, statement to go peacefully and patriotically, maybe to get him off the hook. Understand, this is this is committed to the political branches. This is something the senate will deal with. No court will ever deal with it. Its a question of how many votes support the ayes and the nays. I assume a prosecutor under the biden presidency, he could try to bring a charge, i guess, could they not . He cant be charged after hes in office criminally . He after hes left office . Paul after hes left office, thats what i mean. Right. He can be charged criminally. In fact, the impeachment clause says specifically that theres nothing to prevent charging somebody criminally later on. Paul okay. So the trial in the senate, if there is one, will take place after the president has left office. What do you think of the constitutionality of that . Obviously there are two sides to that. Some people argue that if hes no longer the president he can no longer be impeached. Some of them point to the fact that that the impeachment clause, chief justice presiding over a trial of the president , if hes the expresident , then you dont have a trial. I understand some of those arguments, i think the better view is that he can be tried. There are some precedent for having done it as to i believe a candidate back in 1870s but more to the point. At the time the impeachment clause was put into the constitution, the people who drafted it were very well aware of a case involving the governor general who was impeached by by parliament and and convicted notwithstanding that all of that happened after he left office. So if youre talking about the intent of the framers, it was clear that they knew that you should impeach and try him after he leaves office. Paul okay, lets assume there is, in fact, a trial and the president and his lawyers sue to say its unconstitutional and that goes to the courts. Do you think that the courts would rule on that or would they say this is really a political question to be left to the congress and to the senate and the political branches . Oh, i think its i think clear i mean, clearly its a political question thats to be left to the political branches. This is not something the courts involve themselves in. Paul you just think that its a nonnegotiable issue . Correct. Thats my prediction. Again, we dont have a its Something Like we have a detailed road map, that this happened before. Paul i know. Separate from the legality of all of this, what do you think of the wisdom of impeaching a president going to trial, convicting a president after he has left office . And this could be weeks or months from now depending on when the democrats decide the move. It could, indeed, and i have to warn your viewers, the offices that ive held before dont qualify me anymore than they qualify anymore else to answer that question. There is something to be said for accountability. On the other hand, the charge that was brought of inciting insurrection, again, isnt really the the Impeachable Offense thats involved here, if you will. I think that its long course of behavior thats more significant but that was not the specific charge that was brought. Paul does are you troubled at all by the potential precedent of convicting a president after he leaves office . We could have done that to richard nixon, for example, and nobody decided to do that . Yes, and he negotiated a pardon for himself to avoid that. I think if if we are talking about cases repeating themselves, we have a lot to worry about whether this is precedent. Theres one thing that does concern me more than this as precedent and that is the language that they used in the article of impeachment, referring to an insurrection. That word is to be found in in the 14th amendment which not a lot of people have paid attention to, but it can be used as the basis for barring somebody from the senate, from the house of representatives if they have done anything to support an insurrection and that word was chosen, i think, purposely. In fact, Janes Clyburn referred as late as this morning in an interview on the cavuto program to going the 14th amendment route. The 14th amendment cant be used against the president but it can against members of the senate and the house if they are found to have participated and there were people that were suggesting that somehow people in the house took citizens on hours the day before so that they could case the place and figure out how to penetrate and if they choose to press that, that means the president precedence is only the beginning. Paul of course, they have to have evidence and name individuals for that. Of course. She wants to keep republicans on their back feet but the question now as it goes over to the senate is whether democrats really want to engage in a trial of donald trump or whether they want to move onto joe bidens agenda . Its been suggested by mr. Biden himself they could spend half the day on mr. Bidens nomination proposals and half of day on the trial, guess which half of that would be on national television, paul . It would preoccupy the country and the world and i think a lot of people on the senate side on both sides of the aisle are spending some time thinking about whether to do it now or kick that can down the road. Paul jason, lets talk a little bit about the house debate actually and historically rapid impeachment and the ten republicans who voted to impeach, liz cheney being the most notable. Theres a backlash in the house against her. Some back benchers saying that she should be ousted from the leadership. What do you make of her vote . Jason well, i think donald trump should be glad that the Impeachment Vote isnt by secret ballot, paul. There have been republicans that said if it was, there would have been way more than 10, perhaps 50 or 60 that would have voted for impeachment. I understand the concerns of timing and due process but as you were discussing with judge, the process is a political process and frankly theres nothing in the constitution that says you are allowed to commit Impeachable Offenses so long as its in the last few weeks of your term. If you believe that the president committed an Impeachable Offense, you have a duty to impeach and i applaud liz cheney by standing on that principle. She has a lot of credibility. This is not someone who has been a never trumper. When she agreed with his agenda, she supported it. She thought this one was worthwhile. I give her a lot of credit for voting for conscious and i dont think she deserves to be vilified by fellow republicans for it. Paul kim, where do you weigh in on this . Some of the back benchers, jim jordan and others saying she shouldnt be a house leader. I guess my view is if youre going to oust somebody for what they declared in advance a vote of conscious, you probably shouldnt say its a vote of conscious. Kimberley i absolutely agree. I dont think that liz cheney should be purged from the party at the same time i also dont think that any of the members who voted not to impeach, they were also voting their conscious deserve to be vilified either because, you know, the other side of this is this was a historically rushed process, no hearings, no factfinding, there was no opportunity for the president s team to present a defense and i think that that certainly weighed in on a lot of peoples minds as well and including to the language that was actually used in the impeachment charge, incitement insurrection. You can have a lot of debates on what the president s conduct was or whether or not any of that was impeachable but that was classic democratic a step too far and i think a lot of people have big issues with it. Paul dan, the the contradiction here seems to be that the Speaker Pelosi says that the president was a clear and present danger, urgent impeachment needed, but you know what, we may not send it over to the senate, we will do it at our leisure essentially. I mean, does that undermine the credibility of the of the effort and should the senate go ahead. I want you to do you think the senate should have a trial . Daniel i do not think the senate should have a trial for starters, the president doesnt have a legal team yet. The impeachment on the house side as kim just described was somewhat halfbaked. Judgment kasey described other Impeachable Offenses, they didnt bother to spend any time with that and i dont think its in the senates interest and i will take up with the house was unable to do and then fill out fill in the blanks as they are trying to start a new government and a new administration. I think, you know, the president has been vilified for what he did. He has been punished, people can make up their own minds and at this point, i think what the country wants to do is get past this and move on to the rest of the nations business. I think the democrats, you know, theyre going to have to decide what they want to do here and they have to play this hand smartly because i do think that they do risk getting interfering with joe bidens agenda in the near term, you know, there are people confirmed to cabinet positions and spending bills to pass. We all know that and at this sucking up all of the attention, that could interfere with the agenda. They could also be trying to americans public patience in terms of how long they want to drag this out and turn the corner. I think nancy pelosi has her work cut out on when to send articles over and the senate in terms of when to act. Paul all right, kim, i guess the big question is and Mitch Mcconnell was thinking about it is a trial and a possible conviction a way to, in fact, have a divorce between the Republican Party and donald trump, is that the best way if there were a conviction, you would end up with one of the probably be a vote to bar him from seeking office in the future. Is that a way to get past the trump era . Kimberley well, i think its a way to destroy the Republican Party because there would be a furious rejection among a lot of voters. I keep hearing republicans talk about what to do with trump voters as if they just equal 30 of the gop population out there. In fact, after donald trump was elected he consolidated a lot of support around himself. If you look at the polls that are out right now. There was one in the washington post, 85 of republicans do not think he should be impeached or convicted or barred from future office. You know, and Republican Voters would reject any attempts to use impeachment for that purpose. They would prefer to be allowed to have their own voice about who they want to lead the party 4 years from now. Paul would there be, do you think, a potential kim, i want to ask you, a big backlash potentially politically if there is a trial and the president presumably would allow to make to offer his defense. Could it backfire in the sense that it could habilitate the president . Kimberley this is something democrats need to think hard about. Right now they are using this to fitter divide the Republican Party as dan said, keep them on their back, but the more this appears as a partisan exercise, the more it also has the potential to unite the Republican Party again and potentially even around donald trump. Paul well, dan, what do you make out of all of this . Does the Republican Party need to separate itself from donald trump . I certainly it needs to separate himself from the behavior post election where the president simply refuse today acknowledge that he had been defeated and ended up in on capitol hill that has done to smudge his legacy. What about Going Forward . Daniel Going Forward we can sort of divide the questions in two parts. Does the party have a future with or without Donald J Trump himself, the person and other than that, do they have a future with or without what is come to be known as trumpism . And as nikki haley was suggesting, i think a debate, a discussion has to occur inside the Republican Party, just about what the trump legacy consists of, was it simply a cult of personality attached broadly to trumps persona or have to do with the actual policies that he enacted . Going forward, the president the former president himself donald trump probably will try to stay active. The question is how will he do that. You have midterm elections in two years, is donald trump going to go out there and trying to help republicans take control back house of representatives or is he going to run primary challenges against liz cheney and the other nine or so House Republicans trying to defeat them rather than elect republicans. A lot depends out there and a lot depends on the behavior of mr. Trump himself. Paul jason, really quickly, do you think donald trump is financialed as the leader of the Republican Party . Jason personally, i do, paul. I see in evidence that trump has helped other republicans win. Republicans lost the house under his watch and the senate under his watch and he failed to get reelected though i do think that trumpism he has made an imprint on the policy wise in terms of immigration policy, foreign relations, thats here to stay for a while. I dont think that is going anywhere and he has enough followers concerned about those issues to make sure it stays part of the conversation. I know that you have made the case in our internal counsels that these are private platforms and they ought to be able to to do what they want. Explain that. Kyle yeah, i mean, i guess i start from the premise that people generally have the right to do what they want with their own property. So if you own a newspaper or a Printing Press or an internet server, youre not required to disseminate the vile things that jason was talking about, anything that comes over from any Internet Troll and what amazon and apple have both said in the situation is they are focused on a narrow slice of parler stuff, for example, amazon contains example of parler post saying on january 20th we need to start systemically assassinating liberal leaders. Thats pretty ugly stuff and apple ceo recently, just recently said if parler can get get control of that kind of stuff they can come back into the app store. Paul jason, whats your response to that . Jason well, i think kyle is absolutely right that, you know, we need to be protecting private property and i dont want the government going in and generally telling businesses what they can and cant serve, but there are some exceptions to that. I mean, we do have civil rights laws, you know, we dont allow businesses to discriminate against people because of their race in most instances, we have certain ideas in common law, common car years, so, you know, railroads, telephone wiring. We have various services that we actually do try to put some control over especially when theres going to be a lot of market power and there arent going to be very many alternatives for people to go to if they have shut out. I think that kyle is right. We cant just swift i will say, well, you cant do anything that i dont like with your property but we also do need to think about how this new technology is changing our democracy and maybe we think some of our legal formulas in light of that. Paul you know, kyle, the common carrier Point Richard epstein, the lawyer made that argument on paper, it was impressive power, apple, amazon anding into and. Do they have any obligations under the law to be able to provide . Kyle i dont think they do, its not that there was alternatives. There was another social network called gab and it came back. Its running its own servers, but the trouble with the common carrier idea is i think who it takes down. Apple, the app store does not allow pornography and at least to me it seems like those those are difficult calls, you know, instagram doesnt have nudity, censorship, i dont know. Thats a choice that instagram has made and i see the point jason is making about the panic in this extraordinary moment that we are in, but im also worried about the panic on the other side. Conservatives spent years arguing against Net Neutrality from the Obama Administration saying we shouldnt treat the internet like a utility and i think thats pretty good advice. Paul yeah, jason, last word here. What about that point about this maybe just inviting the government to to get too involved . Jason i think theres definitely a risk to that. I think some people both the left and the right have some bad ideas. I would say that i dont think anyone has the exact right answer. Weve had our politics upended by this technology the way it was changed by radio and even by the Printing Press and i think we are going to need to work to some sort of compromise that feels legitimate to people and doesnt feel like they are arbitrary and having liberties taken away. Doctor its really multi multifactorial, you have consent forms, vaccine card, keeping them there for 15 minutes and repeating the process weeks later and its hard for hospitals to do this because they have to get staff and the staff might be taking care of Covid Patients and the same true with nursing home. 1a, people that were getting vocnated, not something that was rolled out quickly because there werent resources put into it and we were not doing mass vaccination, it was one by one in nature, even myself, its a lot of paperwork i had to do to get vaccinated. I met with a group of medical Association Members this week and they were pointing out that West Virginia instead of just relying on pharmacies like big pharmacy chains, local pharmacists were were dealing with the people that they know firsthand, the people who come to them all of the time and theyve had a big help, big assist in getting those people to come in and get vaccinated. That could be pursued nationwide. Doctor it was put in position where they dont have the walgreens and cvs on every Street Corner and they worked with pharmacy chains and ready to go as soon as they had the vaccine and its worked well well. West virginia has been a standout when it comes to vaccines. If you look at measle shot rates, so theres a lot to learn about West Virginia as an example but not every place can replicate that and each state is having unique difficulties and see whats happening, really, the whole thing has to change if we are going to put the pandemic behind us. Paul the other question to what extent the bottlenecks are political and bureaucratic, what i mean nobody is trying deliberately to hold the delivery of shots. What i mean, well, you have to do this category of employee, this category of workers, this category of worker which are fairly arbitrary instead of just maybe going from by age, you know, 75 and above first, and 65 and above and wherever you want to cut it off next. Is that ladder a smarter strategy . I think its an interesting strategy. We put effort trying to get priority works right but when you implement in hospital or Community Setting its hard to understand. Does this person really fall into phase 1a or phase 1b and that creates delays and gets hospitals nervous about vaccinating the wrong person especially when we have governors, for example, saying they were going to fine people if they were vaccinating somebody outside of group. So i do think a more simpler streamline approach trying to keep the spirit of the priority groups in mind is going to be something that gets us closer to immunity faster. So if you look at the breakdown the bill, theres about 70 billion in it for vaccines and vaccine distribution, you could potentially argue that that might be helpful if it actually does result in ending the pandemic earlier, but Everything Else in there, what you just went through is not going to help the economy, its not a stimulus and a lot of it is going to be directed to people who, in fact, are in full employment and working, not getting to people that really do need it. Paul and dan, what about the the big spending proposal here. I mean, is this is this just his first bid . I mean, whats whats the driver here . And i guess the question the bigger question, does the economy really need it, he calls it a once in generation crisis, does the economy need this . Daniel well, thats one of the big questions. In the remarks joe biden was making it sounds like we are simultaneously in the middle of a Great Depression and extraordinary pandemic. We are in the middle of a pandemic, people have been hurt. We are not in the middle of a depression, much of the economy is doing well. Its resaving and this is one of the elements here that i think, political elements thats worth remarking on.
