Everything by the book. Watch. No doubt in my mind, but that doesnt mean im against review of it. Thats totally fine. So you think the Inspector General will find nothing at appropriate . I dont think so. At least that i know of. But if they do, they do. They should be transparent about it. Im a big believer in the truth. If the truth is there was something concern, lets hear it. I dont know if anything like that. Melissa will get fresh reactions from lawmakers on both side of the island just moments. We will start with chief intelligence correspondent Catherine Herridge, who is live in washington with the latest. Hi, katherine. I want to give you some more details from this information we just got from our senior producer, chad pergram. Its about the timing, and also the contempt resolution. Its off for next week according to the democratic chairman, jerry nadler. He said they are still negotiating a special Counsel Robert Mueller to testify. On the other thing that jumps out is on contempt he is talking about it being later combining contempt with the attorney general, that resolution. Along with the former white House Counsel don mcgahn. In a recent interview with fox, the president said he was not willing to send them again the hill to testify about the special counsel investigation paid me time here in boston this morning, there was an event at the brookings institution. We heard from the counsel, james baker, about the initiating of the investigation and the fisa application for Trump Campaign aid. Which relied on the. Ca, and this former british spy, christopher steele. We heard this morning is that he felt it was important. His words, it would have been malpractice not to pursue it. Heres james baker. We have the federal bureau of investigation, and of the federal bureau of conclusions. So we start investigating, when you have a question, to figure out what the answer is. Many times, most times, when you start out with something, an allegation of some sort and you follow it, it turns out not to be what you thought it was originally. One of the biggest headlines from last nights cnn town hall with with the former fbi director is that he indicated he felt the special counsel investigation was an effort to pool or gather information for a possible prosecution in the future on this issue of obstruction of justice, which was decided not by Robert Mueller but by the attorney general and the Deputy Attorney general. And they said they made that decision based on the evidence for mueller as well as the Legal Framework that was presented by the special counsel. Here is the former fbi director from last night. Weve got lots of evidence of obstruction of justice. We are compiling it for future prosecutors. So why engage in a really long battle over forcing him to give us answers . We will collect this information, preserve it for the future, and not waste the time with that battle. I dont know in hindsight whether that was the right call or not. The president responded on twitter, calling the former fbi director a terrible and a disaster. In the recent fox interview he seemed to go further, suggesting that comey was probably the one, in his words, leading the spying investigation. Heres that exchange. I think it is a terrible job. I would say probably led some kind of an effort. The word spying has been used. He was probably one of the people leading the effort on spying. Thats a very serious charge to make. I know, i know. We will find out whether or not its true. I think it will very well be true, but well find out soon. Whats got my attention is the timing of all this. With former fbi director speaking in a wideranging town hall justifying, if you will, how they handled the investigation into the Trump Campaign. And the surveillance warrant. Then this morning the fbi directors top layer of the time, james baker, laying out what he said was adequate predication for the investigation grant all of this matters because the Inspector Generals report is expected either this month or next, and its not only looking at this issue of alleged fisa abuse its also looking at leaks from senior fair leadership and the attorney general, who recently testified to congress that this is not a criminal leak investigation, suggesting there had been referrals. Melissa Catherine Herridge come a lot that she won. We will get to it. Thank you for your great reporting as always prayed for more, lets bring in republican congressman ben cline. He sat on the house house Judiciary Committee. Thank you for joining us. We are on the very committee where we had thought we might see bob mueller come and testify next week. Now were hearing it wont happen. Why is that . Im not sure and im anxious to find out why. It sounds to me like those who were involved in the steele. Ca and the fisa warrants are running scared and thats why youre seeing them come forward with a lot of public explanation about how they were by the book. I think the attorney generals on the right track. Hes looking into exactly what happened with this steele dossier and why it actually resulted in that fisa warrant. The one are you linking the appearance of bob mueller to the new information that we are getting about the steele dossier, and whether or not who knew what about it before it was presented to the fisa court . You think thats why hes not coming to testify before you next week . No, i do think the democrats are realizing that if mueller is given the opportunity to testify, that our side is going to have just as many questions as their side. And our side is going to be asking about how this came to pass, how the fisa warrants got issued, what evidence they had in addition to the steele dossier. Because now we are finding out today that steele met with officials of the department of state and that they had doubts about the veracity of the steele dossier at the very beginning. Melissa i know exactly what you are talking about and they want to pursue that in the second, but i want to nail down the other thing first. Do you think chairman nadler pulled the information because he was afraid of what you guys were all going to ask bob mueller about the fisa warrants . I do. You have to ask the chairman that, but i think that there is a lot more than just the Mueller Report that is going to be talked about when bob mueller testifies. Melissa obviously one of the things you are referring to is this blockbuster story that was in the hill, where the thenDeputy Assistant secretary of state make a temporary memo and shared it, saying that she didnt find steele credible at all, that he had basic facts wrong, including the fact that when she was talking about russia doing hacking and recruiting in the u. S. , he had referred to them doing it out of russias consulate in miami. And she noted there is no conflict there. But the mics of the very basic facts that were checkable, anyone could find on google. They were wrong. She raised a red flag about him. Thats before they swore on october 21st of 2016 in their speech 16 warrant that they determine the source was rideable and they were unaware of any derogatory information pertaining to their informants. That would not be true. She herself said she wrote this memo before that date, saying that he was not credible. Is that one of the things you want to ask about . Absolutely. That is a bombshell. When you have comey talking about how the information in the steele dossier was firm, that they had absolute veracity of all of the information to go before the fisa court, that is proving to be false. What you heard is that the state Department Employee actually notified the fbi of her findings. You have a real conflict there, and that is going to be interesting to pursue. Melissa congressman, we look forward to seeing that. Hopefully itll be televised. Thanks for joining us today, we appreciate it. In the meantime, Vice President mike pence in an interview this morning on fox friends dismissing speaker pelosis claim that we are in the midst of a constitutional crisis over attorney general barrs handling of the Mueller Report. Watch this. The president and i fully support attorney general barrs decision to refuse to testify under the conditions of the Judiciary Committee put forward. I was on the Judiciary Committee for more than a decade. I dont have any memory of a member of the cabinet ever being questioned by committee staff. And i served under republican and democrat president s. This is not a constitutional crisis, this can be resolved. We believe it to the attorney general to work out arrangements, but it is time to dial down the rhetoric on capitol hill. Melissa lets bring a democratic congressman ro khanna of the House Oversight committee. Thank you so much for joining us. One of the things we were also hearing in this breaking news that we just got a short time ago was that the full chamber is not going to consider those contempt charges against attorney general barr next week. Why do you think the timing on that has been delayed . Well, all we want is for bill barr to be transparent. For him to give us access to the report and the underlying witness interviews. The speaker has been very deliberate and cautious, and we want this to be a cooperative process. I think they are giving bill barr every opportunity to cooperate. Melissa i dont know if you heard the congressman before you, he was saying that may be the reason why the brakes are going on some of these proceedings is that the democraf what might be revealed through the republicans questioning as it pertains to the fisa warrant in this investigation investigation began. Thats not true. Jim baker, the general counsel for the fbi, set the record straight today. He said the fisa warrants were not based on the dossier. They were based on the information that papadopoulos had with a foreign ambassador. Thats how we launched a counterintelligence investigation. In the counterintelligence investigation had nothing to do with the president. It was a concern about russian interference in our election. Melissa do you think that angie mccabe lied when he said in sworn testimony that they couldnt have gotten the fisa warrant without the dossier . I dont know, but that is certainly contradicted by the general counsel at the fbi, jim baker. I encourage everyone to read his statement. He said that the fisa warrant was primarily based on the information they received from a foreign ambassador about a concern of russian interference. I would think every american would bond the fbi to act if there was any evidence of foreign interference. Melissa i am sure they would, but they would want to make sure that everything in the underlying warrant was true. In fact, the fbis war on october 21st, as we said before, that they were unaware of any derogatory information about th. They have been determined to be unreliable, but we now know that the Deputy Assistant secretary of state rudy memo saying that steele was not reliable and his information was proven false. And it was incorrect. To the steele dossier and steele himself incredible. What you make of that . Im not going to be defending the dossier and i dont think its relevant. The broader point is that the fisa warrant, according to the general counsel of the fbi, was likely based on other information. If they had the dossier as one footnote in a larger application, that wasnt the basis for why the judge gave the warrant. And it wasnt to target the president. The warrant wants to make sure we didnt have our integrity compromised. That to me is the most relevant point. Melissa congressman, im wondering is were sitting here and waiting for the Mueller Report for a long time, if you wait until the report comes out and we will all know and things will be resolved, thats not the case, it seems. Because we are still tracking down pieces of it. I wonder if we would go through the same things with the ig report, which is sort of the next big investigation that we are gearing up for. Is it going to be the same thing, where the report comes out and we just want to be investigate and relitigate that one as well . Hopefully bill barr has learned his lesson he wont try to summarize that report. He will let the report speaks for itself and have the Inspector General testify in front of congress. Bob mueller has articulated ten different counts of misconduct by the president , our view is he should come before congress, testify, let the American Public make a judgment. No one is rushing to do anything, but we want to hear from mueller and mcgahn. I would hope that when the ig report is done, that bill barr wont characterize it. To be when we all want to hear from mueller, so you will have to ask the committee why they arent calling him next week. Would love to know more about that. Thank you for coming on we, appreciate your time. Fox news alert now, the u. S. And china back at the bargaining table earlier today after President Trump hiked tariffs. Beijing threatening to retaliate. The president has been on a tear on twitter, defending his decision, tweeting, tariffs will make our country much stronger, not weaker. Just sit back and watch. In the meantime, china should not renegotiate deals with the u. S. At the last minute. This is not the Obama Administration or the administration of sleepy joe, who let china get away with murder. Chief west respondent john roberts adds more from the north lawn. John good afternoon to paired with the present is talking about is going into last weekend. It looks like we were about on the 7yard line, according to larry kudlow, in terms of a deal with china. And then china decided it wanted to reverse itself on some of the core issues. The Core Principles that it had already agreed to. Including Binding Legal language of enforcement. Intellectual property, and some other ideas. In the president said, what . What is this all about . Talks began this morning a little bit after 9 30. They went on for two hours before breaking up. The Treasury Steven Mnuchin and Bob Lighthizer you see there, between the west wing entrance, coming over to report to the president on what went on this morning. They would not say much. Steven mnuchin with a quick comment saying they were constructed discussions between both parties. Thats all we are going to say, thank you. His counterpart, the vice premier, said that the talks went well. He is over at his hotel having lunch right now. Going into todays talks, there was no indication there would be any kind of resolution to them. Sources telling fox news last night that they sat down across from Bob Lighthizer and siva minasian and said there would be nothing more they could do. That it would be to President Trump and president xi to put a decision across. Hes also reacting to the president raising tariffs on 200 billion in chinese goods from 10 to 25 . Listen here. [speaking chinese] translator of course, china believes raising tariffs is not a solution to the problem. But harmful to china. United states, and to the whole world. The way out should be to solve it in a manner that we can come to the only result of cooperation. The president come on the other hand, thinking the tariffs are very good for the united states, bring in a lot more money. Money he says will be used to buy u. S. Agricultural goods and ship them overseas to needy countries. The president tweeting, tariffs will bring in far more wealth to our country and even the phenomenal deal of the traditional kind. Also much easier and quicker to do. Our farmers will do better, faster. And starving nations cannot be held. Waivers on some products will be granted or go to new source. Some Companies Often pass along the cost to consumers, and retaliatory tariffs on the part of the chinese can harm american producers. But the president s supporters say he needs to send a very strong message to china that the status quo will not be tolerated. Here is senator wicker. Listen. Go also, it seems to me that the chinese must understand at this point how determined President Trump is to hold their feet to the fire and actually get a deal that works for us. The president also fitting there may be more sanctions in chinas future. Melissa, its interesting to see where we are today compared to a week ago. A week ago larry kudlow thought we were so close to a deal. Again, he said 7yard line. I dont know where we are right now. Maybe we are on the 40 or the 50. Or maybe we are back in the opposing end zone. Melissa he also said that you can fumble on the 5yard line, and nothing happens. Its worth noting on the business channel we talked to some farmers who had already found a new source for their products going forward. They were planting in the next year for a different source. People and making adjustments. Its hard. Thank you so much, great reporting. John roberts. Matt finn has the latest from chicago. Matt . Melissa, today judge leroy martin was set in with her to us on the special prosecutor to lay fresh eyes on the Jussie Smollett criminal case. Also to investigate why kim foxxs Office Dropped the charges against the actor. But then it was pointed out that judge leroy martin has a son that works in kim foxxs office. Today, a very reluctant judge martin agreed to pass this case on to another judge. Judge martin insists that this is not a recusal. Even denied the motion for a recusal. He basically framed this as a case transfer, because he says hes afraid to set a dangerous precedent of recusing himself because of a family relation. He says it happens all the time, and the wheels of justice would stop if a himself every time it was a Family Connection in a case. He says he realizes in the smollett case theres a tremendous amount of Public Interest and agrees the court should exercise discretion. This all began when former appellate Justice Sheila Obrien basically said not so fast to kim foxx, and submitted a petition requesting an outside special prosecutor to investigate why foxx dropped the 16 felony charges. Justice obrien submitted a few questions to kim foxx regarding her motives. Some of those questions, what was your motive when he said he recuse yourself from the Jussie Smollett case but Still Community with her your staff about customer what was the motive when he received a document frof your assistance who told you the lot of illinois was that you rel prosecutor, and you did not comply with that law . Shanahan issued a statement that he was quote honored to be chosen to lead the pentagon. The forming boeing executive took over acting secretary following the dietz resignation of james mattis after a series of policy differences with the president. Melissa we are now learning that north korea fired three short range Ballistic Missiles yesterday. The regimes second such test in a matter of days as tensions continue to escalate between washington and pyongyang. Senior Foreign Affairs correspondent greg palkot is live with more on this. Greg . Hi, melissa. The good news if you can put it that way new short missiles are short ranged. Bad news they are new as theyre nasty. Analysts have had a chance to look at new imagery today of these missiles. They say theyre solid fuel. Ready to fire at a moments notice. They are mobile. They can be moved around and hidden. They fly close to the ground so they can evade any antimissile systems. As well as being potentially nuclear tipped. And yes while the missiles launched three according to the pentagon yesterday. Two according to experts last saturday do not go against kim jong uns commitment to President Trump not to test long range missiles. The pentagon also is now saying that they are ballistic so they are in violation of a u. N. Ban. According to experts what they really represent is a threat to south korea on the korean peninsula. Positioned near the dmz according to one analyst they can hit seoul in a minute. South koreas and americans soldiers and civilians could be exposed. Clearly he wants to sandy message. President trumps envoy continues his meetings in seoul today meeting with the south Korean Foreign minister. South korean president moon now says these launches are a provocation and that is why he wants to meet with kim again to try to get u. S. And north korea talks going again as well. One last note, melissa, these missiles, again, with analysts looking at the imagery today, these missiles bear a striking resemblance to the current short range missile being marketed around the world by russia mr. Proof direct delivery but modeling. Thank you. Melissa greg palkot, thank you. New developments on trade negotiations with the worlds two biggest economies. The Trump Administration says u. S. Trade talks with china are done for the day and calling the discussions, quote productive. In the meantime, two integral members taking part in negotiations treasury secretary receive mnuchin and Robert Lighthizer now back at the white house. This comes after the president said there is no need to rush talks as new tariffs of 25 on 200 billion worth of chinese goods kicked in. Chinas Commerce Ministry is vowing to retaliate. Brian brenberg joins us now. He is the executive Vice President and chair of business and finance at Kings College in new york city. You know, its interesting. So once again they come together and we havent gotten a deal and it goes on. And i have noticed over on fox business as we talk to more and more people, more and Large Companies doing business with china they have already implemented their china work around. They have already moved things to india and looked at different ways to source i wonder if there is a big fundamental change in our relationship turning away from china here . Whether its big and fundamental we will see how long these tariffs last. You are absolutely right. The companies arent signatures back saying oh, no, there is tariffs so were just going to have to that i catake that they are thig where are we going to sell our products and source products. If price goes up, they will go elsewhere. Thats why the president feels confident about taking such a hard line with these tariffs because he knows the u. S. Economy is very strong, which Means Companies can adapt which means the effect on u. S. Consumers and businesses will be blunted a little bit compared to chinese businesses. Which cant hedge as well and are really feeling the pain. Melissa it really shows how markets work in a lot of ways. You listen to reporters and they talk about oh, this backpack and this lunch pail is going to cost moms this. More now as a result. No, they are not. You know, people have a brain and they go where their money is treated best and buy it elsewhere. Same thing with the farmers. We had a s soybean farmer on after the bell a couple days ago on fox business. Yes, he got killed this year and so distressed about it. Next year he already researched a bean that sells well in a different market. Thats what they will do. People in money and businesses dont wait for washington because washington is really slow. No. They dont. They want to make money and want to grow their business. Look, i wrote about this for u. S. A. Today. We have such a Strong Economy relative to china. And thats because people here have the ability to adapt. They are not stupid. They are not sitting around they can make due with whats going on and they care about it. I think they have the president s back because they view this as a moral issue. We are talking abou theft of property in china. When you know thats what were fighting against, even consumers or businesses that are affected here will say, you know what . Its right for us to push back on this. We can deal with it. Melissa its interesting you bring up the moral argument. If you try to pull back for a second and look at this, you know from, a larger a higher level, you see that for years we have accepted cheap goods that we wanted in exchange for turning a blind eye to theft of intellectual property. And really our companies being treated very poorly over there because we selfishly wanted a bunch of cheap stuff. And its going to be hard to turn around years of what was basically laziness. We allowed china again and again to say we will change the policy here. We are not going to do that. What they wont do is the communist regime wont put their credibility behind change in law. And thats what happened here on friday. Thats when we got the message from china. You know what . We are not going to change the law. Regulations. And the President Trumps credit he said no. If we are going to do. This i want the best thing youve got, which means a legal change. And he just sent them packing back home now say going to fix that and then come back and we will talk. Melissa im so glad to have you here. Real quick you know when you negotiate a deal and deal point is done and resolved and the other side comes back and retrades it, thats such a big deal. I have been trying, you dont do that in negotiation. Sucker punch. Fix that and well talk. Melissa new development in the texas 4yearold disappearance maliyah davis. Police now say they have located the car from which her stepfather said she was abducted last week in houston. The car was found unlocked and undamaged in a parking lot just outside the city. Casey stegall is following the story from dallas. Casey . Hi, melissa, good to see you. A sad development here still leaving more questions really than answers. Four days after the disappearance Houston Police named him a person of interest in the case yesterday that nissan ultima recovered in texas. Not far from where the family lives. Intense search underway trying to locate this little girl. Heavy rains have been hampering the search efforts down there. We have uncovered some information that we have reported according to some documents we have obtained from child protective services. He roomed with Facebook Mark zuckerberg at harvard writing in a blistering oped mark influence staggering far beyond that anywhere else in the private sector or the government. He controls three Core Communications platforms that billions of people use every day. He sets the rules for how to distinguish violence and incendiary speech from the merely offensive. And he can choose to shut down a competitor by acquiring, blocking, or copying it. The company hitting back in a statement, quote facebook accepts that with success comes accountability. But you dont enforce accountability by calling for the breakup of a successful american company. Accountability of Tech Companies can only be achieved through the painstaking introduction of new rules for the internet and that is exactly what Mark Zuckerberg has called for. Indeed, is he meeting government leaders this week to further that work. Andrew is a constitutional law attorney and a former federal prosecutor. You know, what do you think of this argument . Its pretty compelling. Mark zuckerberg, he controls the al gore recidivis algorithmr millions of people who use these platforms and get news and information and he has the ability alone 60 of the voting shares to decide what they see. From a legal way perspective if you dont like it, dont use it if thats an option, its not an anti trust or monopoly type violation. What we have here is something that i see far more as a political type of message that in the law. Antitrust. These companies that are so big that they have to break them up. We are not in that companies can still pivot. They can create a new social media platform. Some sort of product that facebook isnt providing them. And that hasnt happened yet. But, it is something that is very capable. Melissa although his response is yes a lot of people have gotten off facebook they are on instagram which facebook went out and bought. They have the power through their money and deep pockets to go out and just gobble up whoever comes along and threatens them and thats the argument. Heres what chris hughes has to say along those lines about what he thinks the solution is. I will ask you to watch and you can explain on the other side. I think that ultimately its up to government to solve this. Ironically this is the one problem Mark Zuckerberg cannot solve. Its up to government to come in and break up the company. Melissa males thats what he said government solution never the solution but is a solution to this. Well, its certainly not the solution here. What we have a big company that obviously has messages that are troubling to some. The issue of that idea of free speech and who monitors it, sure, we can have some important government regulation that ensures that facebook is taking important steps to secure things like the safety and security of privacy information. In fact, they have been hit with huge fines and i am sure they will be hit with huge fines in the future if they dont remedy those issues. To say that the government needs to come in and regulate speech thats troubling. Melissa let me ask you, back to your other argument thats compelling the idea there is a choice involved to the consumer then by desks its not a monopoly that needs to be broken up. What about that argument that when other platforms have come along to threaten them that they have bought them and have copied them and shut them down. As they get bigger and bigger they continue to have the money and clout to do that . How does that change things if at all . Well, thats the idea that they are forced to sell these other companies. I mean, we have twitter that is a very fierce competitor to facebook but its a different platform there could be other platforms that havent yet come out that promote a different type of message, something that consumers will latch on to. We have facebook has replaced myspace because it was a different platform. This was a different message. Instagram even though it was bought up is different than how facebook presents. Really something that in the future could be different just with some sort of innovation. Compare that to at t that got broken up in the 1970s because if you wanted a phone in your home you had to subscribe to at t. Thats totally different than the social media market right now that just has a product that frank solid superior to other products that have come out. Melissa you mentioned instagram. People said i dont use facebook anymore i use instagram not realize facebook owns instagram. They did gobble up that competitor. I will give you the last word. That is an example. We still have things like twitter and open market for a new product to come in. The truth is instagram didnt have to sell to facebook. They chose to. And so when another Company Comes along and offers a superior product. Its only if facebook is stifling that ability for other companies to come in a superior product that we run into real antitrust issues. Melissa andrew cherasky thank you for your inside. Advice for achieving success and being smart with your money. See you at 2 00. Melissa could progressive fire brand alexandria ocasiocortez help Bernie Sanders win the democratic president ial demonstration. The two selfproclaimed democratic socialists appeared together yesterday and cap credit card Interest Rates at 15 . The freshman congresswoman says she is still a ways off for endorsing anyone in 20206789 lets bring in our power panel antwon c. Wright. Former Senior Advisor to the Hillary Clinton campaign and Noelle Nikpour former congressional candidate in florida. Thank you both for joining us. Thank you. Antwon, she has a lot of influence. She has influence because you all in the media give her more influence than she really has. The thing about endorsements, they bring some of your friends but bring all of your enemies. Endorsements cut two ways in some cases. I still think regardless of whether she supports mr. Sanders or not senator from ver vermont. He still has the same math problem most dominant block in our party africanamerican voters when he comes to South Carolina which will decide who our newspaper knee will be he will have the same problem he had in 2016 particularly with biden, harris and booker in the race. Melissa due to the media, she is an interesting, fascinating story so she does get a lot of stories. She does have a big social media following. When she spoke before and it was on cnn and they put it online had it more views than, you know, anyone who had been some tremendous stat where people were just watching her speak on their own. There were no reporters involved in that there is something going on with her. Well, yeah. She has a little bit of a celebrity appeal. Remember when kristi key again married to john legend invited her to come by a party that she was having and she was in Glamour Magazine she has been featured a lot. The thing of it is with Bernie Sanders her policies pretty much align with them. Being seen together. Being sitting there together working on something together actually the optics whether or not she endorses him or not the optics, you know and you really like aoc and see her sitting with bernie working on a piece of legislation that could be enough. You dont have tone doors somebody. Just the optics of that. But, but, but, she was also having coffee with Elizabeth Warren a few weeks ago and the media and everyone fell out of their chair. Wasnt working on a piece of legislation. One would argue she has oa lot in common with quite a few people seeking our partys nomination. York its transferable. They both are serving in congress and have similar ideas. Take it for what it is. At the end of the day her endorsement doesnt heal Bernie Sanders africanamerican problem in the democratic primary. It helps with millennials and helps with women as well, too. But there are a lot of factors that will indicate and dictate what happens in our primary. I think that may be a small one. Melissa it gives us a lot to watch. There you go. Thanks to both of you. Well be right back. Limu emu and doug. What do all these people have in common, limu . [ guttural grunt ] exactly.
