But that has now prompted to citizens, one of whom is running for state office and has a republican to file a lawsuit challenging Governor Newsom stayathome the mandate. Six california counties are also urging the governor to allow them to ease restrictions. But in Orange County in Southern California considered reinforcing tougher restrictions because of the governors criticism over crowds at Newport Beach . Watch. I want like every other pennsylvania to get back as life as much as and as soon as we can but i want to keep pennsylvania safe. We all want that. So we are working as quickly as we can because of the dates in may that we will start to process. Shannon markham i know your clients want to see action before that. The businesses are essential and there has been an arbitrary process for pennsylvania deciding who gives waivers and who doesnt to stay open. What are your odds or hopes that you will actually be successful at the highest court in the country . Well, we just heard Justice Samuel alito has ordered the governor of pennsylvania, his attorneys to respond to our application to stay with enforcement of the business order and given them until monday at 12 00 noon so that is a good sign that Justice Samuel alito is taking our application into consideration. We are hopeful it is very difficult to succeed at the United States Supreme Court through a petition which is what we filed, but we are hopeful this is a good sign in the right direction. Its me when you know, at least they are taking it seriously and they did not deny it out right so john, they have taken to the Supreme Court. They lost there and tried to cross over into federal. What do you think of the challenges they will face in winning this case . I have a lot of sympathies for these case. Im a native of the commonwealth the great commonwealth of pennsylvania. I know a lot of relatives and friends back home suffering under the lockdown. Now that we bent the curve down, more and more of these lockdowns will look increasingly rational but you put your finger on it, shannon. It will be tough to win a case like this. He has Pennsylvania State law issues and the Supreme Court also has not struck down a law for being arbitrary and capricious like this for 80 years except for one case which is the gay marriage case. So i think it might be a little too early for these kinds of cases to persuade people at the Supreme Court. Also, you want to see conflicting opinions from other parts of the country which would cause the court to step in and resolve something for the nation as a whole. We dont really have that quite yet. Shannon yeah, this is a new world that we are in right now with covid19. We see these cases pop up all over the place where i cant go to church, cant run my business and this is cup crushing my freedoms as american. There are lawsuits out in california and there is one that says the governor is denying permits for people to be able to protest. That lawsuit says by the ability to hold these protests due to its nature cant be delayed until after the pandemic without losing the purpose. But then violate the fundamental rights protected by the u. S. And california constitution and goes through to outline all of the rights they believe are being infringed upon. I would like to get a comment from both of you. John come i will start with you because it is not your home state but now where you live. How do you think this goes in california . The governor saying according to one of the plaintiffs, she was told she couldnt get a permit because the governor does not want people protesting. You are right californias my adopted state but i try not to admit that when im back home in pennsylvania. California, this is the much better way to challenge these lockdowns, not with arbitrary and capricious generally but i have a constitutional right under the bill of rights, the freedom of speech. Its not that the government doesnt have some right to regulate the time and manner of the speech, but if it protest me you can accommodate the governors need by keeping distant or staying in our cars when protesting and still have the right to speak freely. Shannon you are talking about businesses that want to open but protesting, shut down, churches shut down, how far do you think these legal claims may end up going . It turns out there is an enormous reservoir of people eager to get back to work who understand risk, you know want to be safe for themselves and their relatives and their neighbors but want to be prudent. The fact is we know a lot about this virus. We know how this virus is transmitted to. We know about who actually dies and get sick from covid19 predominantly the elderly and other people with chronic, cardiovascular conditions. So what about the young . What about kids . Kids dont generally seem to get sick and many cases, they are not even getting infected. Lets let kindergartens, secondgrade students go back to school where it is appropriate and where they are not living with elderly or at risk individuals. Lets let young people get back to work. We start to see states do this. Today we heard from california where they are actually thinking about opening the next school year early to make up for lost time. I think that is one of the things that could actually pave the way for reopening of the economy more broadly. It went all right, very quickly because i want to hear from both of you. Yes or no will we be able to meet in the middle somewhere because this will be a binary twist, either save peoples lives or save the economy. And then we will hear from you, doctor. Absolutely that is the point of the argument. It is not a matter of lockdowns or let it rip. There are a lot of prudent steps to reopen the Economy Today that a lot of states have been overly cautious about doing. And that is, what is great about what dr. There needs to be investigations done and they seem to have no interest in looking at it. It makes it look like all of their outrage in 2018 over Brett Kavanaugh, that was political posturing. That is their assessment. To exonerate himself with Public Opinion with radical transparency. The media insisting on this always make it look like they and biden have something to hide. There were people that didnt wait and said that they had different feelings about due process. So there was mainstream outlets that listen to this. There are outlets looking into this and that its a good thing we should continue to see that, but it is concerning because we have people like the Biden Campaign reaching out to those outlets and one case getting them to change the story. In that case, taking out some of the details about how there has been other concerns about inappropriate touching by biden obviously if a different nature. But taking that out of the story. So that is a real concern, but i think also, it marks different how this is being treated particularly by the democratic politicians. Again, they said the even the fbi is chasing this down. They were not happy to have the New York Times and the Washington Post look at it in 2018. They wanted to see the entire force of the government breathing down the neck of the end judge kavanaugh to find out what was going on. With much less evidence than we see now. What is the real impact . Sure. It has been unbelievable. The stories of Small Businesses that we have been able to help has been truly amazing. It has been delis, restaurants, auto mechanics. Every facet of our community. And people have come back to this. We told someone today that we will get them ppp funding and they broke down in tears. It not only helps the small Business Owners but it helps the employees. That is what its all about. The paycheck protection for us has been fullcourt press to work with the entire team around the clock to help their communities get muchneeded funding right now. Shannon and there was a lag for a little bit because the funding ran out but the new funding started up again this week. And reports, the bankers told them unwanted the system known as c tran would not allow to enter loan application needed for Small Businesses to access the program. You all sound like you have done a huge amount of these transactions. What is the secret . Are you having the same chrome pool . We want to help these folks but we cannot get into the system. Sure. I think theres secret has been hard work. We pull our teams together immediately when we sold this from congress. Our executive team and our entire organization for the whole team, we sat down and we said, we will work 24 hours a day to ensure that the businesses and employees will get access for this funding. So that has been our secret. We actually had a good working relationship with the sba. They have been a great partner to us. We have worked hard, trained and trained others. And we are very proud of her team who have stepped up during this time. They have given up all the, weekends and have gone far and beyond because its about helping Small Businesses. They are struggling right now. This is a very difficult time for so many of them. Our team has gone above and beyond to ensure that these funds are in the community. If we can stay up one more hour one or two or three more loans that we can get a proof of the Small Businesses because they truly need them. Of course, any program will have some challenges, but i think for us we will be able to overcome these challenges, working hard and persistent and always keep our community in mind.
