Also, similar reports Associated Press reports that at least one saudi student was filming events as they unfolded outs building where the shooting took place. Joining us now is former doj attorney who used to have applications, Francie Hicks and fox news legal analyst and author of which hunt, gregg jarrett. Its not what you hoped would happen. What do you expect we can start with you, what do you expect to see today that you did not know in this 400 pages . Well, brian what i hope is that the full fisa application and warrant have been declassified, so we get a look at what was the basis for that warrant in the first place. I think also the Inspector General is likely going to talk very much about the sources and methods that were used to try to prove that the information against the Trump Campaign colluding with russia was factual. That is the steele dossiers allegations that there was a well developed conspiracy that of course solved, we know now it is false it was never true and its going to be very interesting to see what the Inspector General has found about how that allegation in particular made its way into the fisa warrant. Gregg again i know you wrote books on it and study as much as anybody but what do you think is in this now because we did her that this will show there was a reason for the fbi to launch this investigation which cause many by surprise if it indeed holds up. Well i agree that i think much of it will be about the fisa applications to surveil or spy on the Trump Campaign and in particular, the heavy reliance on Christopher Steeles dossier. Why didnt the fbi disclose to the fisa court that this was paid for by the Hillary Clinton campaign and the dnc. Why didnt they provide exculpatory evidence which under law they must do to the court but most of all the extent to which they didnt verify information, and when you file a fisa warrant under the regulations by the fbi, it says, only documented and verified information may be used. They knew it wasnt verified. They had gone to Christopher Steele a few weeks before the fisa warrant offered 50,000 if he could verify the information. He never got paid because he couldnt verify. He was the perveyor of hearsay from sources largely anonymous. Here is the scenario which we should not forget because weve gotten so much information so Christopher Steele gives information to yahoo news, yahoo news publishes the story, yahoo news story is used as evidence, and it was secured as reporting and the source to the news to the material to the evidence. It doesnt work that way. No its not supposed to work that way, brian. Thats the whole point. Whats really shocking to me is that first the fbi represented to the fisa court that Christopher Steele himself was a reliable perveyor of information because that wasnt the point. He was not the originator of that information. That information supposedly came from russian sources and their reliability was not vouched for in the warrant and the second thing thats shocking is that the fisa court, the judge who signed the warrant and the renewals didnt seem to care that that information was not vouched for in its reliability. This suggests to me a massive breakdown of the procedures that were in place when i was there practicing in front of the fisa court and i dont understand it. Gregg before you weigh in, evidently they go heavily into steele in this report in the 400 pages, they said they did a background on him and in the background they find he was honest but he sometimes pursued targets that were a waste of time including to two people familiar with the report, were going to read. So in this, when its done, im wondering well learn more about steele, will we know are we going to get to know if this professor, is this professor was actually working for the fbi that was trying to list additional information, are we going to know about that . I think durham may know more about that so id put that on hold until he concludes his investigation, but you know, Christopher Steele it wasnt disclosed to the court, the full extent of how he had been leak ing and lying and instead the fbi said he was credible even though they had been warned by kathleen cadillac at the state department as well as bruce ohr at the department of justice that there were problems with Christopher Steele and his information. They also didnt tell the court that Christopher Steele had a severe bias against the target, the Trump Campaign. He didnt like donald trump, and all of that is Vital Information that was concealed from the judges. Lastly, to both of you, theres some reports william barr was upset with the final results to a degree although respectful of the research in horowitz and they expect possibly him to include his own paper with this. Francie would that be unusual, do you expect it . Its not unusual for the attorney general to attach a letter or make comments to an Inspector Generals report and remember the Inspector Generals report is necessarily narrow because the only people he can make them are current employees of the department of justice whereas william barr is getting a look through the durham investigation of much broader possible misconduct on the part of other intel agencies outside the fbi. Durham has subpoena power and he could compel people to testify including people like john brennan, james clapper, the intelligence agencies who may have played a key role in people etraiting what i have referred to as a hoax and witch hunt and deceptions to the fisa court. Military officials tell fox news four rockets landed hundreds of yards from u. S. Troops and civilians. Five iraqi soldiers were injured but no americans were hurt. No group has claimed responsibility. Also breaking overnight, there are no survivors left on an island after a volcano erupts in new zealand. Authorities believe less than 50 people were on the island during the explosion. Police are using a helicopter to survey the island and its too dangerous on the ground at least five people are dead. A Church Nativity scene gets political showing the holy family as refugees in cages. A california minister writing on facebook, imagine joseph and mary separated at the border and jesus no older than two years old taken from his mother and placed behind the fences of a Border Patrol detention center. The minister is referring to the trump adminitrations now policy of separating migrant families who enter the u. S. Illegally. And one county could be the first in the nation to stop accepting refugees. Officials in north dakota will vote on those today and this comes months after President Trump signs an executive order giving local governments the right to opt out. Supporters say refugees could put a drain on Public Services like schools and police. And ainsley with a very special guest. Ainsley you grew up in oklahoma how did you realize, when did you realize youre so cute and petite, everyone loves you, you had this grand voice . You know it was so funny because my dad is an engineer and my mom is a homemaker and they were like is it us or is she good . In church i auditioned for a solo and got it and they said, you know, is it us or is she pretty good now and the church stood up and i knew that. Ainsley when did you have your big break and get to the National Level . I have to say it never happened the way it happened during youre a good man, Charlie Brown way back in 1999 when i won tony. Thats when life really changed. Ainsley tell us about this performance we can see on monday its really special because if you like Christmas Music and i dont know anybody who doesnt , its 200 singers behind me and 175 orchestra members and its a wonderful relationship there, and its at the highest level, and some of the best music at the tabernacle. Im very very proud of it and just because we dont exactly believe everything the same, i feel like music is such a unit thing and we move forward with the music and have a blast and id say hi to everybody there because i miss them. Well im a Christian Person and ive never thought that was interesting or different and then i came to new york and started to understand there are a lot of people with a lot of faiths and thats when my respect for that started. Its been an interesting journey being in show business and being a christian. Im an lgbtq activist and sometimes that doesnt always go together, you know . But i just keep trying to say what would jesus do and thats the love of my life. Im not perfect. I mess up a lot but im certainly glad i have my faith. Ainsley we can all relate to that. Griff good morning, steve, just outside less than 30 minutes Judiciary Committee will take another step towards impeaching the president the committee will hear from chief counselors as they present the evidence found in the hearings thus far its going to be a little bit like a courtroom in there today its long and lengthy but youll hear the cases being made for likely surrounding abuse of power, bribery and obstruction of congress. Chairman nadler says they plan to draft those articles this week and could possibly even vote on it and hes confident the evidence is overwhelming. We have a very solid case and i think the case is presented to a jury would be a guilty verdict in 3 minutes flat. Griff the white house was invited to present their side of the case. The outcome of impeachment on the house side, earlier today you spoke to min whip Steve Scalise, here is what he has to say. I think theyre questioning the voters of this country and its an insult of the voters to this country who should be the ones to decide whose president next year when they would rather take that option away. Its not why you impeach a president. Griff steve if they do finish todays evidentiary hearing and vote on it, it would set up a full house vote possibly next week, impeaching the president possibly before christmas. Steve . Not a tough decision because as white House Counsel said two months ago we regard this as an illegitimate engagement and i think jerry nadler makes that very clear when he lies and says that if this were before a jury they would convict in three minutes. He didnt even specify the charges and he knew what they were if they were clear and convincing and digestible to the public, we would already know what were in the articles of impeachment. Why is he playing a game of secret squirrel . Im going to make you wait to see whats in the article of impeachment because they dont know . They have been fishing around, what they may digest and what will fly and you know whats not flying with them . Impeachment. Axios just released polling in pennsylvania, wisconsin and michigan shows the president is way up from before and this begins and probably the democrat s are making donald trump a victim to lots of americans who just want them to join him and get on with the business of the country. He has revived this economy and kept it going, and they have not , why in the world have the democrats spending 15 hours saturday and sunday its been reported trying to figure out what the strategy is for today . Again, if a jury would convict in three minutes, what takes 15 hours . Were they at soup kitchens . In the districts putting wreaths on veterans graves . There telling seniors how they lower their prescription drugs or there covering the potholes, getting the 5g broadband to the kids who dont have in Rural America . No, they were huddled here in the nations capitol on your dime wasting your time on impeachment not doing the business of this country. Well they were rehearsing because its a tv show, and ultimately what they want to do is they want to impeach the president but kellyanne a moment ago you said they are focus grouping and the polls are turning the other way. What is it, is it the fact that the American Public has taken now a look at the transcript and its like well what i read in the transcript is different than what im being told by the democrats. Its that, and it is the fact that we have faith in the people and the democrats apparently dont. We know they can see and hear that of the 15 star witnesses, the democrats put before only one had ever had a conversation with a president let alone about ukraine it appears. Maybe one or two. As they also, if you cant just say to people in 10 seconds or less, we are going to impeach the president and overturn a democratic election because of x , then youve lost them. The other thing is the media and the democrats but i repeat myself, have made a problem from moment one. They jumped on this president s back and they havent let go. They literally have been trying to get him out of Office Rather than get the story or get to the truth from day one and do you know what hes been doing . Marching around with them on his back making this unbelievable economic robust economy hum, reconstruct the military, trying to renegotiate trade deals. We have an education roundtable today. Its this president who said that education is a civil rights issue of our time and if we can dig out of panama canal, put a man on the moon and win two world wars we ought to be able to give each child in this country a quality education. Ive never heard a good answer from the people who stand in the way of kids having better opportunities in the classrooms. They dont have a good answer and youre either for the children or youre against the children when it comes to education. Do you realize what the democrat s are doing too . Do you realize the last two months the last three years . They want america to focus more on the border between ukraine and russia than the border between United States and mexico. Think about that. This president has been trying to get border security, mexico is pouring its drugs over the border into our kids veins and into our communities and yet, the democrats arent focused on that border, between the u. S. And mexico, and how we can improve relations, and keep out the drugs, but they want america to worry about the border between ukraine and russia. This is nonsense and thats another reason that the public is tuned out and cant even understand whats going on. Ainsley i think weve noticed so much corruption and we just all want to get to the bottom of this. We want the voters to be heard. Think about different examples kellyanne for the fisa abuse, that was passed so you could surveil paris and theyre using it to spy on a president ial contenders campaign. Political opponent. And theres evidence they didnt like him and then they want to impeach from day one and they say collusion, racism, now theyre saying this phone call with ukraine yankees president and now do you know what they are saying over the weekend chuck todd is interviewing nadler and they say if he doesnt get impeached now what happens . Now they are trying to say the election in 2020 wont even be legit. But look at whats ready there in the hearing room youre showing on the screen. We cant accept a second term for donald trump. My sole focus is to make sure hes not the president next term that is not the job of the United States congress, ladies and gentlemen. They are your representatives and they should not thumb their nose at the tens of millions of americans who voted for donald trump who will again, who will next time, and more importantly, all americans who he represents whether they voted or voted for him or not, this is not the job of congress. Thats a job of the electorate and i want to say one more thing since you mentioned it ainsley is that youre making my point referencing it which is they have been on his back from day one and if all you hear is racism, sex in, collusion, russia, ukraine, and all you see is for 401 k doing better is that the people in your circle of life have better paying jobs and more job security with Better Benefits you see the veterans respected, the military we built, healthcare, the 28 million americans, ten years after that you see us trying to work on that and we talk a lot about the trump pence districts the 31 members including the 21 freshman. Id like to talk about the incumbent in the jerry nadler district. He seems like a very worried person. It turns out he has two primary opponents. How in the world is jerry nadler not left in office for the leftist taking the Democratic Party . Here is a nice chart to look up for yourselves but i love the plot. It shows how left people are, representatives are. Jerry nadler is all the way over here folks. All the way here, 100 with planned parenthood. So youre doing this to save their own political jobs . Well the person running against it is screaming impeachment impeachment impeachment impeachment impeachment and she raised over half a Million Dollars as of early october so hes worried too and should just get on and say that and say im worried im the next senior democrat whose done absolutely nothing for the people, in the decades ive been here, to fall. Kellyanne, hes been fighting with donald trump since you were in college, so its been a while, predates everything. Real quick. Is Rudy Giuliani representing the president in the ukraine and is the president going to use that material to bolster his case or is he acting on his own because matt gates says its weird that hes over there. What do you think . Well rudy is one of the president s personal attorneys, and i think that was particularly true during the Mueller Investigation since that was an executive Branch Department of justice investigation. That is long gone. I would say that mayor guiliani got the upper hand there, not director mueller and we saw director mueller testify and we all read the report. I see the democrats are now trying to dog earpieces of that and put it in their articles of impeachment in the secret sauce, so i dont know what rudy is doing in the ukraine and also i know what i read, but i also know that i have no idea what hes going to produce so thats a hypothetical i can not stress. And hes rooting out corruption, because this is always about corruption. The president ran on Anti Corruption and we want him to make good on that promise. Okay before you go, your reaction, the ig report is going to come out later today and the president has referred to this as the biggest scandal in the history of our country. You have less than 30 seconds whats your prediction . Well let mr. Horowitz under under oath on wednesday about his report coming out about 1 00 p. M. And what we do know thats been reported so far is that the people like bruce ohr who was working at the doj failed to tell his superiors he had met with steele and that his wife worked for fusion gps and they were not honest about who was paying for the dossier, the fix was in it, it was hillarys campaign and the dnc. Ive never met carter page, i dont think President Trump has. They did a bad thing and i think that the chips will fall where they may. We do, good morning bill, im sandra smith, we are moments away from the start of the house Judiciary Committees Second Public impeachment hearing, as anticipation builds for the release of the dojs long awaited ig report. Back on capitol hill, lawyers from both sides will be laying out their cases for and against President Trumps impeachment. Daniel goldman is representing democrats and steve castor will make the case for republicans. Meanwhile down the street at the Justice Department there is one big question brewing did the fbi abuse their power while investigating the 2016 Trump Campaign. We have Fox Team Coverage for you this morning anchors brett behr and Chris Wallace in washington and Martha Mccallum in new york city. Former assistant attorney andy mccarthy, and ken starr live in dallas and ken we will begin with you. How does todays hearing advance the democrats case . Well they are going through a process of say well look at the report that we have submitted. Doesnt that report prove to a fairminded person that the president abused his power . We can toss around terms, bribery and extortion but i think that the theme will be abusing power by virtue of his legal and putting president zeli nski on the spot pressuring him to here is the key. Interfere in the political process and the United States so there is a certain echo of russian collusion but this time its wide open and here is the fundamental problem. There is simply not a buyinto this narrative where the facts are being presented in the least favorable way to the president , all inferences drawn against him as well as what i would view as a miss interpretation of the facts. You can criticize the president , fair enough but to impeach the president for this, i think, is likely not going to final point, move the ball in terms of securing republican support. If there is no republican support at this stage, then this sets the stage for the most partisan impeachment in the history of president ial impeachment. Its not a good thing and frankly not a good thing for Speaker Pelosi who launched all of this. Ken starr stand by. Andy mccarthy in new york. How do republicans handle themselves at this hearing. What is their target with these lawyers . Well i think the way that ken has outlined and framed the morning session for us is probably exactly where republicans go, because were at the point of presenting this as abuse of power, precisely because theyve been groping for something some crime to be the peg for this impeachment effort whether it was Campaign Finance or extortion, quid pro quo, bribery evidently, they went with bribery for a while and when we heard the constitutional law professors last week they seem to have settled on abuse of power which is obviously a very capacious label and exactly the sort of thing the framers were concerned about when they considered making mal administration the standard for impeachment and then changed over to high crimes and misdemeanors the change that was made precisely because they were worried that a vague standard would sweep in too much trivial misconduct, so i think they will be hoenig in on that and in terms of abuse of power i think they may try to turn the tables on the democrats particularly in the Intelligence Committee where theres a big hubub and a justifiable one about the way that chairman adam schiff ran this investigation, including a very controversial acquisition of phone records that i must say as a long time federal prosecutor, you would not have gotten away with this in a federal criminal investigation. Well republicans have been red hot on that all weekend well see how it comes up, that directly ties devon nunes to apparent conversations with someone along the line that was connected to reporters and Rudy Giuliani. Well sandra, i think this is all but forward, and it does seem like nancy pelosi, the speaker of the house would not have gone forward with this effort to draw up the articles of impeachment, if she did not believe that she had the votes in her caucus to move this forward. Basically today is about democrats saying that this is why President Trump should be impeached. Republicans saying this is why he shouldnt be impeached but the bottom line is that the end of the day, donald tru will likely be the third president , in u. S. History, impeached by the house of representatives. That is a historic moment no matter how you look at it. Now the ability to sell that as ken mentioned, the judge mentioned, selling it to republicans to switch their votes thats what weve been talking about all along, more interesting paps is the 31 democrats in trump districts from 2016 who have a very tough vote and swing state polls which we talked about last week, now theres been a couple of other swing state polls that show that this is even more upside down as far as democrats selling this, to the American Public. Just a little bit of color were getting from washington, chris now. Chad burke our capitol hill producer, is sending out a note on what to expect from the hearing this morning expect a little more parliament after it rangling than usual. Your expectations as we a wait this now, chris. I have to say sandra, i have to apologize to the house Judiciary Committee because when they held their hearing last week a lot of us were saying, including me, that we expected this to be something of a circus in the beginning and that there was going to be a lot of that and in fact, there really wasnt there were a couple objections brought up by members of republican members, and there was also some question how adept ly jerry nadler would be able to handle it and he handled very adeptly, every time they made a motion he would say lets table it which means they will throw it in the trash and then theres a vote of the 41 members and they all vote according to party line democrats to throw it in the trash and republicans would move on. One of the interesting things about today is whose not going to be there, because what youre going to hear is the Intelligence Committee report, the democratic report about as someone was saying this is exactly why donald trump needs to be impeached from the democratic point of view is going to be delivered by their very able lawyer, Daniel Goldman , who participated in a lot of the examination of witnesses before the house Intel Committee, there were a lot of republicans and i can tell you some people of the white house who were desperately hoping that the person who was going to represent and explain what the Intelligence Committee found was going to be the chairman adam schiff, and a lot of republicans were licking their chops at the prospect of being able to cross examine schiff. I think the white house might have sent a lawyer if they were going to be crossexamining schiff but its just his lawyer, Daniel Goldman, so the white house has decided no it isnt worth our time, and i suspect you wont see nearly the fireworks you were if it were adam schiff in the witness chair instead of Daniel Goldman. You can never rule anything out as weve seen in the weeks leading up to this and martha fox is told that much of todays hearing will function like opening arguments in a trial both sides laying out their cases and here we go another important week in washington, and the timing of all of it as we head towards christmas, martha, and when nancy pelosi might actually take this up for a vote. You wonder when jerry nadler s interview yesterday, he said they could get a conviction in three minutes flat if this was in a regular courtroom. I thought theres probably a lot of americans that wish it would happen to this point because i think its kind of a rip the band aid off moment where people feel that they know essentially how this is going to play out and they expect two to four articles of impeachment to be laid out, whether or not bribery is one of them which is one of the strongest arguments for impeachment, its something that adam schiff gave a little bit of like to. He said over the weekend, you know, i always felt as a prosecutor that you have to go with what you feel most solid in terms of the charges that you can bring which kind of opens the door to the factual see these sort of charges abuses of power and perhaps we want to listen for whether or not obstruction of justice and that opens the door to bringing in the mueller part of this equation sandra. I do believe your microphone is a bit off there, martha well get that fixed and bring you back in otherwise the hearing room is filling up, on capitol hill in washington as we begin another. On a monday well get the battery charger fired up. Sand by for that, back to ken starr, two major events here as we watch them unfold. Ken, it appears that the biggest question for democrats, if you watched jerry nadler over the weekend he would not say how many articles they would write up. Theres clearly an internal debate on behalf of democrats on whether or not they keep on the ukraine transcript or broaden it to include the mueller matter. What is your view on that and how they ultimately decide that with an election looming in ten months or so. The job of the democrats now given this unfortunate task they have taken on is to build the most impressive case, so how do we do that . Lets throw in the kitchen sink is one approach. Lets draw from all of the many things that we have quarrels with and throw that into some omnibus kind of article. The first president ial impeachment in 1968 had 13 articles, and that was rather ridiculous. When the nixon impeachment came along it was reduced to three and so forth so i think there is this widowing process, but this is the key. Will this persuade, especially will this persuade out in Middle America where people will say, when they read this article, when you read the articles of impeachment, of richard nixon, you say he has to go. And theyre not that long, right its got to be accessible and so forth, so i think they have their hands full to try to do that which they must do which is persuade. This is now the job of gentle or perhaps not so gentle persuasion and given the record that they have before them especially the ukraine record, i think they are in trouble. They are in deep trouble when you look at the entirety of the record and i like to come back to final point, curt voelker, United States en view to ukraine , reading his testimony, one of the three amigos, is so exculpatory of the president in terms of any kind of crime or frankly any abuse of power. Ken starr thank you for that , andy mccarthy, were going to watch this hearing and somewhere around the noon hour, there will be headlines that start dripping out of the department of justice. What are you led to believe this Inspector Generals report will conclude about the campaign in 2016, andy . Well, i believe, bill, that youre going to get a cataloging of pretty significant investigative irregularities. What we heard last week was that there might be a dispute between bill barr, the attorney general and mike horowitz, the Inspector General about one of the main conclusions which was the freddie indication of the investigation. And i must say once i looked into the original story about that, it seemed to me that it was perhaps much to do about nothing or about very little. The Justice Department issued a gushing report or a gushing statement by their press spokes man about horowitzs work and what a credit it was to the department, and it seems to me that if there is a dispute, its probably a matter of emphasis about two things that happen to be true. On the one hand, would the fbi in terms of opening any investigation, they have to have a fairly low threshold for suspicion before its proper for them to investigation, and i think to the extent that were hearing that horowitz may find that there was enough here to predicate an investigation, that may well be right. The other issue though is we have a norm in this country that we try to insulate our politics particularly electorate politics from the incumbent administrations use or ability to influence investigations or influence elections with the vast investigative powers that the Justice Department has, and i think where barr is probably coming from is that when you have this kind of investigation, where youre abusing a Political Campaign of potentially being in an espionage conspiracy with a hostile foreign power you have to have a higher threshold of suspicion before you allow the governments investigative power s potentially to influence the investigation. Just going back to some of the notes from our interview with bill barr back in may and what he says, andy is that the focus is on the Counter Intelligence activities during the election 2016, handl ed at a very senior level and then talked about the misconception that nobody has looked at the entire landscape in the russia investigation in 2016, and the fact that when he took the job, he started asking a lot of questions and they franklydid not hang together the proper explanations have not been given so andy, stand by on that and ken starr as well.
