I dont see any real evidence he is building an obstruction case. Ive been a critic of that allegation for many years because this first does not fit any recognized definition of obstruction. The president is allowed to criticize this investigation. Thats not obstruction. A classic obstruction case is interfering with the grand jury or more concrete acts. The other intriguing aspect of this is rosenstein. If the Deputy Attorney general was participating in an investigation of obstruction on the comey firing, he would have to recuse himself and he left that to mueller because he would be a key witness. The fact that he hasnt recused himself leaves two possibilities. Either he and mueller are acting dramatically and unethically in this matter way outside the sort of ethical navigational beacons, or mueller has told him i dont really see an obstruction case here. If there is no obstruction, there is no conflict. Steve because rosenstein is muellers boss. So you would think mueller youre suggesting mueller said, said, dont worry about it, were not going down that road . The other alternative is really chilling there. Is no ethical way i can see for mueller to investigate the firing of james comey and continue to report to rosenstein which controls the scope of the investigation.
