Walk us through how you get your arms around identifying what he thinks he would use. Two things i would do if i were a leader like they are is the first thing i would do is make it clear that those people who are leaking are potentially in trouble and those people who have knowledge of who is leaking and protecting those people are also in trouble. Possibly jail time trouble. Whoever fivestep person voluntarily provided information that helped them out these flakes would get the best and clearest deal from the government in order to limit the impact on their careers. The next thing i would do as i would give the fbi involved because the fbi is brilliant at this and most people do not know that in the course of their investigation if you lied to is the fbi and agent, it is a crime and they could definitely take advantage of that. The next thing i would do is suggest looking at the pattern of leaks. Put together a link of sorts so you can look at where the leaks are coming from, either clusters, or coming from a particular area. I would focus in on that and i would interview the people in the areas because people talk. They bribe. They grow, and they tried to prevent justifications for what they are doing. And i would intercede with that as well. Pete you mentioned kind of amnesty. You admit you involved at one point it will go further. On his interrogated here, but its human sources, people saying i did it once or twice, and dearest to us might be talking. That is the best way to identify. It is certainly one way to identify. When i was at the cia, they ordered a polygraph for everyone whos involved in the enhanced Interrogation Program because someone was leaking to the media about the program. The polygraph session turned out to be incredibly helpful and identified the leakers of a person who is working out the inspector generals office. One of the key people didnt like it and for their own reasons was leaking information to the press. Those kinds of people when they do that to have friends. There is a continue unless you know between getting excited and blurted something out and deliberately undermining the president. These are classified conversations that are taking place between World Leaders that are being subjected to public scrutiny and public information. This is very serious information information. Weve seen that. Weve seen one individual who was a contractor to the n. S. A. Already prosecuted for leaking information. I am certain that general kelly and attorney general Jeff Sessions will continue to find who these leaks are. I hope they prosecute these people. I hope they put them in handcuffs and walk them out the door and make a very clear determination to their colleagues that this will not be tolerated. Theres been certain especially on the nsc that some trump loyalists are being pushed out in favor of even obama holdovers holdovers. Is there a trouble do you have any concern that some trump loyalists have been pushed out of the west wing . Does the president have any concerns about that . I think the president has given general kelly the full authority to staff his white house to the best of his ability ability. And right now general kelly has wide latitude, in my opinion, to bring the people in or ask those people to leave that he thinks are going to serve the president in the appropriate manner. Lets give this guy a little bit of leeway, lets give him an opportunity. Hes been here for a week, hes making decisions, hes changing things in the white house for the better and, you know, we can evaluate his staffing decisions as you move forward but i think right now general kelly has a core competency that is much needed in that white house as the chief of staff. He understands the National Security component of things so lets give him the ability to bring in the people that he thinks are best to serve the president and those that he thinks arent best to serve he should have the full discretion to ask them to move on. Clayton i want to ask your take on something that was on the front page of drudge report last night, New York Times. It says there are a couple of senators, a couple of republicans who are sort of in this deep state right now, this sort of shadow government that are sort of planning a run against the president in 2020. Specifically they name in this piece senators tom cotton, ben sasse whove already been to iowa this year, Governor John Kasich of ohio, hes eyeing an early return to New Hampshire. So republicans could mount the first ever, you know, run against a sitting president in 2020. What do you make of this report . I like to call most of it fake news to be honest with you, because i think it came from the failing New York Times. Heres what i think. I think tom cotton is one of President Trumps best advocates in the u. S. Senate, one of his closest allies. Look, lets go back and look at john kasich. I think donald trump in the primary, i was involved in the race, we beat him by 19 points, not exactly a close rate in New Hampshire. In his home state of ohio, we beat him by 10, 11 points. John didnt support President Trump and if he thinks hes going to run against President Trump ill take the opportunity to volunteer for that race immediately to continue to joy john kasichs career, no question about it. Hes been a terrible governor, he was a terrible candidate for president , he has no chance to run whatever. But, look, lets be very, very clear. Donald trump is the leader of the Republican Party, and there are other candidates, u. S. Senators, members of congress who are going around and raising money for the local parties. They came out to california in the 1940s with the whole family. They had 10 siblings. They well, greatgrandpa worked in the shipyard during world war ii pete and then he went to and jack pete marine corps. He went into the marines, and my grandpa also went into the marines. And unfortunately, jack was killed in action nine months later. Abby so you were never able to meet hip. Sergeant cody, tell us how you guys connected. You found this purple heart. How did had a happen and how did you ultimately connect with bernie . 2005 i was with the Oregon National guards state surgeons office, i was invited to a dinner at the time, elderly couple and they handed me the purple heart, and they said can you do something with this . And i said, yeah, i can. So i got online, 2005, i wasnt sure where to look, i let 7th marine yahoo group, i found some contacts, jacks best friend floyd swift who i contacted in seattle, i called him, i sent me pictures of those guys together, talked about christmas 1950 in san francisco, ran out of leads, and then i couldnt find the family, then i moved on a medical sacramento, went down a couple years, Flash Forward to easter, this year, i was on fox news, and i saw purple hearts re reunited so i typed in there i have this soldiers medal, purple heart. So i go to my moms at easter, i get a call from zack, found the family, right here, and im like oh, my gosh, and then she calls me, and purple hearts reunited, sarah set this whole thing up. In this case it was very fellow because i was able to help a fellow veteran complete his mission. Hes been looking over a decade for this family. Now we have the opportunity to honor a marine who lost his life for our country and return it to his family in a special ceremony on monday. Abby how many purple hearts have you found . Were close to 400. Weve all over the country, about 46 states so far. Were a hundred thousand miles traveled. Attorney general Jeff Sessions calling out the media for its role in the leaks plaguing this white house. One of the things we are doing is reviewing policies affecting media subpoenas. Do you think this is incredibly dangerous territory . Why . We do not need to have the rights of the press impeded, period, full stop. The American People deserve to know what our government is doing, why theyre doing it, and frankly, if there are leaks coming out of the white house, thats not the fault of any journalist. Journalists arent putting peoples lives at risk by getting information from the white house. If sessions wants to do something what he needs to do is crack down on where the leaks are coming from. Its not the job of the reporter to worry about if he or she gets a scoop is the attorney general going to crack down on her. Pete but, amy, the question is and what critics will say is that if that that information released to the American Public puts american lives at risk, troops in the field, then it is a responsibility to that journalist to withhold that information. No . Absolutely. And, in fact, most journalistic enterprises have a whole legal team that goes over this, and they have to exercise their judgment. Theres a lot of National Security information that doesnt get into the newspaper or on television because that journalistic you know, that media entity has decided its not in the publics interest and could endanger National Security security. I give you an example of a story that was revealed about an iranian who was participating with our government to give us ussing information about iran and that was revealed in the newspaper and when he was while he was back in iran, and he was arrested. Real lives are at stake when National Security is compromised by being published and its not appropriate. Also id like to add, there is not an absolute right for the press to publish anything they want. That, yes, there is no prior restraint by government, but after the fact government can subpoena and the Supreme Court has weighed in on this, and the press entities can be subpoenaed to reveal that information. Pete jam i will a, youre shaking your head. I actually dont disagree with what amys saying. The truth of the matter is lives are important; lives matter. And journalists have editors. There are backstops in place. I can torture you about telling you about the editorial process. I wont do that now. Clayton however, jam i will a, youre talking about real journalists. Lets be honest. Theyre not the same News Organization what im saying is in the age of having these large media organizations, sure, but now youve got bloggers, goat three people on a staff for websites wikileaks. Clayton for information, wikileaks and others, so youre hold it up to maybe fox news, Washington Post, New York Times, wall street journal, the different world now, is it not . I agree, but thats who sessions is talking about. The resolution targets north koreas export revenues slashing by a third by banning exports like coal, iron and seafood. Plus cuts off other ways the regime makes money to fund its missile program. China and russia approving the sanctions despite resisting in the past. President trump tweeting the United Nations Security Council just voted 15 to 0 to sanction north korea. China and russia voted with us, very big Financial Impact. And United Nations resolution the single largest economic sanction package ever on north korea. Over 1 billion dollars in cost to north korea. The foreign minister of china urging north korea to stop provoking the goodwill of the international community. Well, another Big Development this week was of course the crackdown, the announced crackdown of leaks inside the white house. Attorney general sessions on friday gave a speech about what they were going to do both at the doj and across government and in the west wing. The president also tweeted this, saying, after many years of leaks going on in washington, its great to see the ag taking action for National Security, the tougher, the better. So the president praising his attorney general who he had some different words for a little bit ago. But it looks like they are going to get serious about tightening the leaks. Looks like maybe they are on the same page now. It looked like would he be the next person to leave the administration . This week you had general kelly come out, throw his support behind the attorney general. Now hes taking these tactics because they have gotten to tighten up the ship. Corey lewandowski was on our show earlier saying they need to lock up the leakers if they find them. What we saw this week was attorney general Jeff Sessions has come out and said he will continue to crack down on the leaks. Look these leaks are issues of National Security. These are classified conversations that are taking place between World Leaders that are being subjected to public scrutiny and public information. This is very serious information. I am certain that general kelly and attorney general Jeff Sessions will continue to find who these leaks are. I hope they prosecute these people. They hope they put them in handcuffs and walk them out the door and make a very clear determination to their colleagues that this wont be tolerated. It does feel like a new chapter has begun in the white house. As we mentioned, you have attorney general Jeff Sessions who is toughening up and cracking down and trying to figure out these leakers but also a new chief of staff in general john kelly. Hes gone in there and already made a name for himself. This is coming into fox news. Hes brought along two lieutenants now, a deputy National Security advisor and white house staff secretary rob porter who was a former chief of staff and their job is to make sure that anything that gets in the hands of the president or, you know, on his desk is vetted before he sees it because in the email they say they compare it to an era, as you mentioned clayton earlier, it was easy for people to not only drop unannounced into the oval office but sometimes get bad or dubious information in front of the president. Sometimes Conspiracy Theorys that didnt have any facts behind them, drop these stories on his desk and the president might jump on twitter and tweet about it. So we have heard now these stories general kelly wants that to stop. If that information hits the president s desk, it better be spot on. It goes through the proper channels. A lot of the ire of some of those tweets you saw from the president were about not just what was happening inside the oval office be what was happening across the mall in congress with Senate Republicans unable and unwilling to pass a repeal and replace of obama care which they said they are going to do. We are getting reports now about Senate Majority leader mcconnell he says he would consider a bipartisan effort to continue payments to insurers to avert a costly rattling of Health Insurance market. Hes now saying rather than doing our job of repealing and replacing, rather than going back at it and try to make that happen, i will bail out the Insurance Industries and continue to bail out members of congress who get a sweetheart deal for their own insurance as opposed to to what American People have suffered. This is classic washington. Were going to fund it now. Senator graham is up in arms too. He recently spoke out about this. Were dumber than dirt if we dont try again because if you think you can go home as a republican and say well, we gave it our best shot, you have not. The block grant approach hasnt even been tried. The bottom line here is the republican governors are getting very excited about having a block grant sent back to them to replace obama care to get the money and power out of washington. We have september the 30th. We will have more flexibility under the block grant than people envision. Mcconnell is saying that the window for doing anything is rapidly closing but you have the opinion piece in the wall street journal yesterday saying look, the reverberations on them not doing anything on repeal and replace are already being felt. When you have to fund the government beyond, you know, this window is now closing. So now you have to pass a budget. Now you have to fund the very thing that you dont want to fund. So they are going to have to come to the table. They are going to have to fund obama care. And guess what . If you have government shutdown, how is that going to reverberate for the halls of congress . We now how that plays out on republicans. Now it is on you. Look at members of congress on the republican side, it is almost like you have people representing all different parts of the party. Thats why it is so difficult to get everyone on the same page and agree to something. You have the rand pauls. You have the ted cruzes. You have the john mccains. How they come together, whether it is healthcare, tax reform, how we move forward, i dont know, it is going to be tough. Were told mcconnell is a master legislator. He was supposed to bring the republicans together. Every faction has said repeal obama care. Every faction has said lets lower rates and simplify the tax code. Those are two core pillars who it means to be a republican today. If the republicans cant do it, im with the guy from virginia, sign me up for class action suit. I want my money back. I was sold on a bill of goods. This is whether or not like guys like mcconnell and ryan can lead a caucus. Yet they havent. It took the democrats a year and a half. Why not have another go at it. You can do it inside the caucus if you put your heads down and make it happen. Democrats took 18 months to do it. Exactly. They never asked for one republican voice on that debate. So bringing more voices to the table may be good. The challenges, you have the democrats on the other side that arent helping at all. I mean its resist, resist. It is russia, russia. And howard dean of all people he spoke to another network and he says the whiny left does not want to win. They just want to be pure. Heres what he says. If they go downswing purely, then thats fine if they go down swinging purity, thats fine. He was a leading president ial candidate on the front cover of Time Magazine. Yes, he has progressive ideas, but they are also rooted in pragmatic ideas as well. His point is when you have this sort of esoteric left, thats weighing the party down. This whiny left is the problem right now. My dad was a governor. We have huckabee on all the time. Whether or not they are republican or democrat, when you are governor of a state, you have to pass a budget. You have to figure out healthcare for the constituents in your state. The job that you have is very different than being on capitol hill and in congress when it seems like they can get away with everything. It also seems like the problem is a little bit different on the right. Remember when everyone criticized the Freedom Caucus and rand paul because they are always against things, they want the pure outcome. They actually came to the table and voted on the measure. The problem on the republican side are moderates, susan collins, they look more like democrats than they do republicans. A bit of a different problem on the left. Thats a swipe at Bernie Sanders and his people and, you know, they are basically trying to go at folks like harris and booker who they see maybe more moderate. They are not moderate either. You say right now across the pond the same thing is happening with brexit. Very much so. If you think back, the Political Revolution of 2016 with brexit and with trump was people voting for change. Real fundamental change. And here we are, you know, in the middle of the following year, and that change isnt happening. We have seen frustrations from the judiciary. We would expect the liberal media. We would expect opposition parties to try and frustrate brexit. But what i think is so frustrating on both sides of the pond is there are people who masquerade as conservatives in order to get themselves elected and are now, you know, damaging the attempt for us to get a clean brexit. Stopping the president getting his agenda through congress. And i think theres something very fundamental at stake here. It is peoples faith and belief in the whole democratic process. Yeah, you are right. Over here we call them republicans and democrats. Theres a story on the front page of the newspaper, the president called the failing New York Times this morning talking about 2020 opponents to the president from republican senators, but add someone like susan collins, moderates inside the senate they are spending as much time or more resisting this president s efforts as he leads their own party. I think there must be now growing real genuine anger amongst millions of people who turned out to vote trump. In many cases people who hadnt voted republican before or perhaps never voted in their lives. They engage with the process. Theyve got a president that is Holding Faith with them, wants to carry out the agenda. Its trumps own side that is stopping these things from happening. I would have thought what needs to happen and the Republican Party here and the conservative party back at home is when it comes to candidate selections there ought to be a weeding out of those people who are not playing for the same team. With brexit, the vote happened but what happens after that really matters. Just like election day here, whether the agenda moves forward. Whats the most important aspect to make sure things move forward . I think the most important thing is how the people feel. The people who voted for brexit, a year on if we had that referendum again, we would get a bigger majority in favor of it. People want this change to happen. It is interesting, isnt it . We have been talking with brexit about having a point style immigration system, just the same debate thats happening here in america. You know, people want these things to happen. But its our Political Class on both left and right that are stopping it. And i have to say, that if people dont get what they wanted and they start to lose faith in the whole democratic process, that is bad for our whole society. You are right, the elites and the Political Class, they control the media as well which is creating this impression that everyone is running away from President Trump, but if you are on the ground like you saw in brexit, it is actually the opposite when they try to block what they voted for, they get more frustrated. I think thats right. I have to say all the attempts to try and paint the Trump Campaign as somehow being run and influenced by the russians, you know, it may entertain the liberal elite living in washington, but actually out there in real america, it just makes support for trump Even Stronger because they can see this is actually an attempt to effectively frame the president. If you win a race, you kind of get locked in to the playoffs, and then from there, its all about bonus points. We have got three wins which is worth 15 bonus points. Basically saying look, im open to bipartisan workshop. Now we couldnt do it ourselves. Im ready to bring in democrats. They have got to do that. They need to be open to bipartisan conversations and hearings in order to get this done. I think the window is closing really quickly. I think the senate is still trying. They are at work. Didnt take the month of august off. They are trying to come up with something to get a bill out of the senate. But its tough because youve got very divisive situations going on where one big group of the senate does not want to expand or slow the growth rather of medicaid. And so thats really the problem. The American People, they are seeing okay so now were voting a bailout. Of course the democrats are going to vote for a bailout of obama care. They dont want it to fail. The president said maybe we let it fail or get rid of the doublestandard for members of congress. Isnt there a virtue of holding the line and say we will let it fail or do what we said we would do . Look at the conversation going on the democrat side. They are basically positioning all of this. It is the republicans fault. We all know that obama care has been imploding and theres absolutely no choice. Insurance companies are leaving in droves. Leaving absolutely no choice. And forcing premiums even higher. We know that. We know the problems with obama care, but because of this wrangling in the last three months the democrats are saying all this uncertainty is causing obama care to fail and it is the republican faults. Because of these talking points the republicans are getting bullied again. How often do we see the republicans getting bullied . Every day. Why cant they stand up once and make a counterargument . The same with tax reform where you have bannon coming out and saying lets raise the highest rate to 44. 6 . Let me be clear, you dont cut taxes on everybody including the highest earners then you are not for cutting taxes because the rich pay all the taxes. Thats what im talking about with senator hatch today because orrin hatch has been working on a tax plan and hes going to tell us specifically where the Common Ground is and where the divisiveness is. Where is the Common Ground . The Common Ground number one they want to simplify it. You have heard a lot about it. They want to put it on a postcard. They want to simplify it. Get out of the thousands and thousands of pages of tax code. They do want to cut corporate taxes most people. The fight will be on the deductions, what deductions stay, what deductions go. At this point, it sounds like the only deductions that stay are the mortgage deduction and the charitable deduction. Then the fight is over the corporate rate. President trump is at 15 . Paul ryan is more like 20 . I think were going to come at it 22 . And then of course theres the idea of individual rates. How much will our viewers see their tax bill go down . We know that its going down for most americans. How much . We will talk about that. That is a big question. Also north korea is huge right now. You have nikki haley on. Yeah. Thats a great guest. These new sanctions have been agreed to including russia and china. Thats a big deal. What you can ask her is that going to really change . Dont tell her what she should ask her. [laughter] youre a much better interviewer than i am. No, i want your advice always abby. Im impressed they were able to wrangle in china and russia to go along sanctions against north korea. It will cut their exports bay third. They make 3 billion dollars on exports exports things like core and iron ore. And seafood. Who knew. One question i want to ask them a lot of speculation change with the personnel change at the white house will tillerson be there for the longterm and will she replace tillerson if not . Republicans calling the transactions slush funds because the recipients were not victims in any of the cases. Mark cuban taking a jab at the nfl by insisting if kaepernick were in the nba he would have a job. He told the Washington Post im glad the nba doesnt have a politician litmus test for our players i like to think we encourage our players to exercise their constitutional rights. Kaepernick protested the National Anthem all season long. One restaurant just added a hand added a man tax. The cafe posting these rules which also say women get priority seating. The man tax is reportedly enforced for only one week every month with the money being donated to womens services. Why dont the women pay their women employees 18 more. Or the same was asked of some senators like warren who pay their women staffers less. Theres a lot of hypocrisy on this issue. Why are men paying more . Exactly. A lot of have been sending in your comments about this. If a restaurant ever charged my husband a man tax, we wouldnt pay the tax and we would walk out. In an exclusive interview Deputy Attorney general Rod Rosenstein reacting to reports of a grand jury being impanelled. Here to weigh in Harvard Law School professor, lifelong democrat, Alan Dershowitz. Always good to have you with us. Thank you. You heard it there from the Deputy Attorney general when it comes to this investigation and mueller it is not a fishing expedition. What do you make of that . Well, the Justice Department rules and regulations are very broad. Remember that the special prosecutor who started investigating bill clinton about white water ended up accusing him based on a private relationship with monica lewinsky. I dont think that President Trump or his administration should take much solace in the claim by rosenstein that this is not a fishing expedition. I do think that they are looking to catch moby dick the big whale and thats what the special counsel will be after. Donald trump or anybody as high up in the administration as possible. If he doesnt get somebody, he will be regarded as a failure who spent a lot of money investigating and came up with nothing. So i think there is much of an incentive to try to come up with something serious. You are saying the white house should be concerned. How do you think this grand jury being empanelled, how does that change things . The fact it is empanelled in the District Of Columbia, already had a grand jury empanelled in virginia. One of the reasons they moved this to the District Of Columbia is thats a completely democratic district and it has an ethnic and racial composition that would be somewhat less favorable to donald trump. And any experienced lawyer understands that both prosecutors and Defense Attorneys look at factors like ethnicity, race, political affiliation when they decide what venue is best for their case. So that theres nothing surprising about that. But it does i think give a slight advantage to the prosecutor if there were an indictment if they had to pick a jury, either in virginia or the District Of Columbia, they would have an advantage in picking one in the District Of Columbia. Speaking of ethnicity you made these comments after it was announced about this reported about the grand jury, and Maxine Waters as you know has a lot to say about everyone and everything and she targeted you most recently this past week on msnbc and reacted to some comments you made. Heres what she said. You know all of those black people are there and they dont like trump. And so hes not going to get a fair trial. And so they should take it out of that jurisdiction. It shouldnt be there to begin with. I dont like that. And im surprised that Alan Dershowitz is talking like that. And we will not stand for it. We will push back against that because that is absolutely racist. Obviously there shes talking about the people that make up this grand jury in washington, d. C. How do you respond to that . Well, she doesnt know what shes talking about. First of all, i wasnt talking about the grand jury. I was talking about the jury. Grand jury doesnt matter. It doesnt matter where the grand jury is. But if there were to be an indictment, it would matter greatly where the trial was. Look, Maxine Waters should know better and does know better. She knows that every experienced lawyer, white, black, asian, latino, knows that when youre selecting a jury, factors like ethnicity, race, political affiliation matter. If i had said that race didnt matter, she would have called me a racist. She throws around the term so loosely and so inappropriately, and it weakens her credibility just by calling everybody a racist by calling me a racist, when she calls real racists racists, nobody is going to believe her. Would she have called Johnnie Cochran a racist when he obviously understood that the racial composition of the jury in the o. J. Simpson case mattered a great deal . Race matters. She ought to know that and being ashamed of herself. Being black doesnt give you a license to call people racist. She ought to understand that every criminal defense lawyer knows that race matters, ethnicity matters, political affiliation matters. Were not talking about computers here. Were talking about real jurors making real decisions and jurors make decisions based on their Life Experience and race and ethnicity is part of everyones Life Experience. Maxine waters more than anyone ought to know that. She tossed it around and targeted me for no good reason. She ought to be ashamed of herself.
