>> peter: i don't know. i don't know. i don't know. that the answer in washington now whether eric holder or the f.b.i. mueller, i don't know. >> mike: i don't know. >> peter: it's incredible. we were talking about this earlier after all these stories, after congressional testimony by people who were victimized by the irs that no one has gotten to speak to them. it really is. >> alisyn: the i don't know excuse appears to be working. it appears to be effective. you don't get answers but you don't move the investigation forward. if you stone wall, i don't know. you know, i don't know that. >> mike: the goal there is make it all go away. if you don't talk about it, maybe it will all go away. >> peter: we'll get back to you. we'll get back to you with that information. i'll get to that. >> mike: the irs itself, former irs commissioner mark everson there bad leadership of the irs. basically the irs is a mess. this is what he had to say. >> a convergence of really bad mismanagement. you can't take your hand off the rudder. it's a large organization and you have to be looking at all of it. commissioner said i didn't particularly interested in this piece of agency. i stayed away because it is sensitive. >> it's kind of like the secretary of state saying, the jewish people are concerned about israel so i'm not going to go into the mideast you feel can't do that. you have to do the whole agency and it includes the c-4s were generating controversy. it's unfortunate. >> alisyn: he is talking about shulman and another person who sometimes said i don't know didn't know what the tax exempt division was doing in terms of who they were targeting. >> mike: don't you get confused about the scandals. we're up to five of them. >> peter: there is one a day. we still don't know what happened in benghazi. >> alisyn: right. >> peter: you go from one to the next, it's staggering. >> mike: let's go to the third or fourth one, investigation of fox news reporter james rosen. >> alisyn: oakland the department of -- obviously they were treating james rosen as if he were a criminal. you remember that eric holder testified, no, i would never actually prosecute a journalist for doing their job. we're not in the business of going after journalists. then it had to be pointed out the person that signed the search warrant and the paperwork, it said that james rosen was criminal -- drill criminal co-conspirator. they want to know what happened. >> and peter you are a legal guy. he is going to answer eight questions. how does that work? >> i don't know how it works. he gave public testimony the first time around and so this thing, we'll allow you to answer it in this fashion. i don't see how any american believe that is acceptable. >> would that be questions given in is advance? "man of steel" is being called one of the most anticipated movies of the summer. so will it live up to the hype. ? >> is it any good? >> the movie is incredible. hans zimmer is such a genius. i had an honor to talk to the cast of "spider-man." that man, super man, he is incredible. first i sat down with kevin costner and diane lane to ask them, has an actor ever found themselves in a real-life situation and also found themselves in a movie. check this out. >> i had a situation happen the other night. it was interesting. >> she just went back to fourth grade. ooh, ooh, me! >> i have something. i was at a girlfriend's son's concert, and my girlfriend was on an airplane. she missed the concert. it was so sad, but she's just at the airport. and i said, i'll dial her and she can listen to it while she's boarding her flight. i learned that from a movie because i did that in "secretariat." i had someone phone me what i was missing on my phone. i love that. >> what is the one thing you learned about yourself and one thing you learned about yourself as an actor? >> in that i'm willing to really work like an insane person, like the hours are very, very long. and i look back and go, whoa! and it was a nice thing to prove to myself to say that i will work and struggle through all the really hard stuff. and i look up to my brothers for the things they have achieved. one of the marines is there in afghanistan in iraq and the hardships he has put himself, and i wonder if i could do that and would do that. and i don't know if i could do it in the military capacity that he has because i have not try it, i know i can do it with the capacity of the workload and acting being concerned. >> kevin, you only gave this movie a 4.5 rating out of 5. what happened? >> well, here's the deal. the movie itself is a perfect balance of emotion and action. and hans zimmer's music matches perfectly. my biggest problem with this movie is the product placement. product placement has been around for years, but this friday before friday according to advertising age would have already made over $160 million in cross promotion and advertising and product placement alone. and i despise when a film advertises to you blatantly and it takes away from the story, a couple of them in the movie like nikon and nokia distracted me throughout and that really bothered me from giving it a five out of five. skip the 3d, it was not shot in 3-d and it dims the movie. it is a visual and epic masterpiece. clayton, if you are at home watching this, i know you're not there right now, go see it. it is an incredible movie to see on the big screen. i highly recommend it and give it a 4.5 out of 5. >> you download the 3-d lightly on these pictures, who does kevin costner play? >> kevin costner plays clark kent's father, the human father. russell crowe plays his other father. michael shannon, originally played by super man, he's brilliant in the fill. the movie is like "the dark knight" as it becomes a movie that becomes outside of the comic book universe. i recommend it, 4.5 out of 5. >> clayton, we'll appreciate your nerd shout-out. >> happy father's day to my dad. i love you so much. the best dad on the planet. >> oh, so sweet. >> he did a great job. kevin is cool. he's accused of killing soldiers at ft. hood and now nadal hassan is trying to say he was defending the taliban. will the judge allow that defense? and a whistleblower a governor or a trader? mike huckabee says neither. he'll explain at the top of the hour. governor huckabee coming up. ♪ look what mommy is having. mommy's having a french fry. yes she is, yes she is. >> the big question is, is here a hero or a traitor? the truth is, we don't know yet, but i would say that he's neither a here roar or traitor. he's not a hero because he broke the law and environmented an oath he took. that disqualifies him as a hero. also, he didn't go through the proper channels and report this to an inspector general or to people within the government. he went and told a newspaper and leaked it to the world. so that kind of takes away the hero status whether he's a traitor, i'm not sure that's fair to say. if he believes, as an american, that americans' rights were being trampled on and the constitution was being completely ignored, then you have to give some respect to the person for knowing. and he said, my life's over. i'll never see my family again, i'll never go home again, he knew he was taking a huge risk. he didn't expect the ticker-tape parade over this. >> well, i don't appreciate what he did. he was 17 years old when 9/11 happened. now that we know what's being going on, what do you think of the nsa and what they have been doing. >> the question remains, how much information do they need to maintain on american citizens and can they take that level of information on us without anybody seeming to know about it except the people inside the agency? that's the constitutional question that deserves an answer. and the fact that this kind of snooping has been going on, it may not be a big surprise, but i think our government doesn't have just an unabashed right to look at every e-mail, to check all our photos, to be able to store -- they say we don't look at it until we need it. that's like saying i'm going to put a camera in your house, we are going to videotape every moment of everything you do in every room, we are not going to look at it, but if something happens that we think is not kosher, then we are going to look back at that tape. >> then my e-mails are going to be cross-checked with al qaeda. >> here's the thing, if this kid can get his hands on it, who else can get his hands on it? this is a contractor, he's 29 years old. he's not a high level -- >> 29 year old and all that information on a little phone drive here? >> if he can get to it, who else can get to it? and do you realize, think about this, if a person can manipulate this level of information, they can control the entire body politic of the united states. think about it, getting information on every candidate running for, let's say president, and going to them and saying, here's what i'm going to tell the world about it. you can absolutely control the election. >> and you still always have that, but the question becomes in my mind, how far do you go in breaking the law to point out a constitutional violation? really, because the government has violated the constitution, does that give you the right to leak classified information? does that give you the right to flee the hong kong -- really not one of our allies controlled by china, but what is the price that we pay for this and do we define dooef deviancy down and say, he was doing this for the best of the country. b benedict arnold did the same thing. >> that's why you can't give him a plaque in central park in his honor because the guy has not done something wonderful if he violated his oath, but he may have been doing something that he believed was necessary to expose wrongdoing on the part of the government. and i think there's -- it's like nobody has clean hands here. >> but you'll agree that's not a defense to a criminal charge. >> no. i don't think he's even pretending it's an offense to a criminal charge. >> well, congress is supposed to be the oversight on this and obviously didn't have a lot of oversight, only a handful of people in congress knew and some say they didn't know the extent of it. and the other question is, here's what i'm hearing, this is helpful to us to catch a terrorist. well, it didn't get the boston bombers, it didn't get the shoe bomber, the underwear bomber, the times square sbbomber, it didn't stop the -- >> how do we know it didn't stop -- >> here's a question to put this in perspective. when we say we needed to catch terrorism, look, we have never acknowledged that what happened at ft. hood was terrorism for gosh sakes. >> you're absolutely right. the bigger question this spins out is where is the president in all of this? we don't hear him or see him on this. we don't hear him or see him on syria. we have statements out of the white house, not from the president. we are not hearing the president about irs. really, we are not hearing the president obviously on benghazi. the question was asked the other day, where is the commander in chief? >> i can tell you, he's on travelocity getting ready for barack and michelle's awesome adventure to cost taxpayers $100 million. he's planning this big trip. we have some really meltdown crises going on and we can spend $100 million to look at cheat as and tigers? >> forget this for a minute, why hasn't there been a press conference or an address when we are now getting involved in syria? and when the americans have no idea how to feel about the nsa surveillance, isn't it incumbent on the president to share his feelings on these things? >> for someone who gives speeches on all the things he wants to push, it's amazing how he won't talk about syria. i don't think he has an answer for that. what are we going to do there, who are we helping? we are helping the rebels, who are they? the al qaeda-funded people that could be as bad as what assad is doing, assad is horrible. >> the chemical weapons are there, what are we going food. >> now the question is, they are used against the rebels. if we arm the rebels and the rebels take over, do we have the same wonderful friend that we have in egypt when we got the muslim brotherhood? >> out of the white house they said at the beginning, this is an outrageous comment, that it was immoral or unethical, but it is potentially criminal conduct. >> it is criminal conduct. when you release information as they did for the national organization for marriage and their donors, you don't just release it, you release it to their opposition organization and they publish it and print it and use it against the national organization for marriage. that's criminal, that's a felony, and there's no way that this shouldn't rise to the level of a thorough serious investigation. >> i got in trouble with my parents when growing up, if you just don't talk about it, it may go away. hey, who is on the show? >> no. >> i'll show you my spirit stick. >> i'm getting to the headlines now to tell you about this important story, a suspected killer back in new york this morning to face charges for gunning down a restaurant owner 26 years ago. he was just flown in from miami. he was tracked down by the victim's daughter, actress jocelyn martinez, who spent $250 and did a simple online search to find his address. she then turned it over to the police who then arrested santos. he reportedly has confessed to the murder. well, the sister of the 17-year-old boy accused of killing a soccer referee apologizing for his action. >> we want to tell the portillo family how awful we feel and how we can't imagine how much your father is missed. >> portillo punched the referee and he went into a coma and later died a week later. the judge will decide if he'll be tried as a juvenile or adult. if convicted as an adult, he could spend five years behind bars. well, this guy is really paying the price. he was just sentenced to three years behind bars after refusing to pay his $70 restaurant bill. this is the second time this year he did not pay his bill after he ate at a restaurant. he reportedly told staff he had no money and waited for police to arrest him. police say he had multiple theft convictions which favored into his sentencing. and a photo of a bride and groom. kneeling in a moment of prayer in virginia last summer. now it's gone viral. they said this only lasted a couple seconds, but it is nothing she will never forget as a photographer. and the couple, bri and josh, say it was important for them to take a minute and count their blessings before their big day. and they did it without josh seeing the wedding dress before bri walked down the aisle, of course. >> that was a nice moment. i'm glad she captured it. >> it is almost norman rockwell-ish. the idea of a monster truck jam sounds like a male event, but think again. some of the trucks are fueled by girl power. and rick is there with the proof. rick? >> yeah, there are a lot of guys in this sport and they are great drivers. you'll see a ton of great guys out here this week. there are three of us females at metlife stadium this weekend. and we are going to be pairing it up along with the guys. >> reporter: okay, how did you get into this? i mean, i would not look at you and generally think you're going to be a monster jam truck driver. tell me honestly, how did you get in this? >> my background is racing, rock crawling, i've been four wheeling forever, i've always been in the dirt. a couple years ago i ran into the founder and driver of grave digger. >> he's kind of like the grandfather or godfather of monster jam trucks. yeah, so is this different than what you grew up -- because you are legitimately a car girl, is this different -- you do crazy stuff that seems to us really dangerous. does it feel that way to you? >> we have so much safety equipment that i feel very secure and safe, but i did grow up driving go-carts and was always interested in cars and vehicles and in the garage with my dad. and this is very similar, actually, to being in an extreme rock crawler. sometimes all you see is sky when jumping over something, so it feels like a natural transition. >> reporter: are you competitive? because you guys are doing this for money and for competition and for pride, are you competitive? do you want to beat these. >> it is probably more for pride than anything. of course i would like to, but the main goal is to make sure everybody has a great time. you can be 6 or 60 and will still find something to enjoy when you come out to monster jam. that's my entire goal. we have a party in the pits that is today, 1:30 to 5:00. people can come out for music and food. you get to meet every single driver. it's really fun. >> reporter: that's the cool part of this. anybody that comes out here asks for you to sign autographs and to meet you personally. thank you, nicole. good luck to you today. guys, we'll send it back to you. >> why doesn't nicole's car look as scary as the other guy's car? >> happy father's day tomorrow. >> tell us about heart disease. >> when you see your father lying on the couch, you may think, i won't have any of those problems, but you better get your dad to the doctor because you could be next. heart disease, we are talking high blood pressure and high cholesterol, if your dad has heart disease before the age of 55, your chances are three to four times you're going to get it. you better get checked. very high number, i suggest people get their cholesterol checked, get their cholesterol down if necessary. watch your blood pressure. if your dad has those problems, you may get those problems. >> prostate cancer, is that hereditary? >> yes. it is strictly general etic but two to three more times are people influenced by a first-hand relative having it like your father. be checked for colon cancer if it runs if your family. >> how about drinking problems, alcoholism, is that passed on? >> i don't know whether that's passed on genetically, but it is two to four times you'll get it if your dad is a big drinker. you have to start thinking about that first. maybe you should be careful how much you drink at a young age in college if your father has a drinking problem. >> this is only applying to sons or does it apply to daughters? >> daughters as well, although in modeling heart disease sons especially model their father's behavior. and the same thing is true with obesity if your dad has the beer belly, you're much more likely to get it. a study from harvard in 2007 shows that we sons model our father's weight more than daughters even do. >> and it used to be that beer belly was a harmless thing, but it has implications, doesn't it? >> it has inflammatory risk factors to increase hear heart disease. if your dad has it, you can get it. get out there, get on the elliptical or the bike, get on the treadmill or just walk in the morning. >> do we have any idea how much of this is genetic versus lifestyle? maybe if your father has a sedentary lifestyle you also have a sedentary life style? >> in this case we are talking two-thirds of americans being overweight. that's mostly lifestyle, much more than genetics. >> depression is a big problem for so many people, men and women alike. if your father is depressed, what are your chances? >> very high, 25% in first-hand relatives. if it is a daughter or son, if your father is depressed, you may get depressed. if your father has bipolar disorder, you could be depressed. high chance for that. watch out for it. it could be something to do something about earlier on. you may need to be in therapy or be aware of it. by the way, on father's day, i want to wish a great happy father's day to everyone's dad out there and my father doing much better. and to peter james johnson, who we lost this year. happy father's day. >> your father is an incredible guy. and you know who is a great father? >> well, we were at the egglington grand. basically we waited for two stoplights at the either end of the street and got the entire bridal party to start running towards the camera. tony and danielle snapped away until they had one we could use. >> it's great. >> apparently somebody loves the color pink. >> oh, i do. yes, thank you very much. >> and you did your wedding reception like it was a movie. you made your own movie. >> we did. >> we had a movie trailer that we made, yeah. >> yeah. >> just to be clear, so you guys really were running down the street with your real wedding party. that part wasn't fake. you really were in the middle of the street. and then how do you explain the monsters behind you?
