>>guest: well, probably not and we should say he not only set that bar in the campaign of 2008 but he is still saying it in e-mail and fundraising e-mails that the president is sending out now, he is saying he doesn't accept money from lobbyists. this is not illegal to accept money from lebanonists under the federal guide lanes the republicans are doing it. and that is part of the reason the president is doing it so he can say he is better than republicans in this case. but, clearly, there is a game going on here and there is in doubt that people who have involved in lobbying are contributing to the president's campaign. >>dave: you brought up the line "better than republicans," that is what the president's spokesman said on friday. >> this president has been the most transparent in terms of disclosure, the most ethical in terms of the money he will accept and the money he will not accept. there is anyone who compares thus far. we hope that there will be. and certainly the republican candidates are not even making an effort and the fact is the president's record is unparalleled. >>dave: so the problem is transparency, right, byron? we have the defender of blackberry. and on the other side is business litigation attorney. good morning to both of you. chip is this a frivolous lawsuit? does it have a chance? >>guest: it is november frivolous lawsuit but for $1.25 no one will get rich as a class action member. outage cases against utilities are very difficult to bring and in this case it is a loss of use. you still could use your blackberry during this time but the difficult part of these class action lawsuits is the consumers do not have contracts with blackberry they have them with their service provider so their beef in the clacks action -- class action lawsuit ought to enagainst the service provider. so they cannot do it whether the lawsuit will get $1.25 back, that is highly unlikely. it will be pennies on the dollar, if we come back a year or two in now to fine out the final result. >>dave: i wonder, because when it first happened i thought, what if i missed a major job interview or business meeting because i did not get e-mails. people live and die with these things. could you have a case for actual real money here? >>guest: well, you could. you could have a variety of different kind of damages and i respectfully disagree with the point made a moment ago. we are talking about real dollars here. there are 2.5 million users in california alone. and the company makes $3.5 million a day. they pay for the service and rely on the service and does not get it this is why class action lawsuits make sense. this is real dollars. they came back and said we will provide you $100 worth of free apps. i have respect for the company but i don't think people want to download a video game. they want to be rely on the device to make stock trades, make the appointments you are talking about and rely upon important communications. the people are business owners when that is broken for a week, they do have a claim. this case will move forward and it will be interesting to see what happens. >>dave: what will happen? >>guest: they are correct. the pension payouts are astronomical. what we are doing here in illinois not only in illinois but nationwide is we trying to implement pension reform. we fed to reform the system or it will collapse. >>alisyn: no wonder cities and states are going bankrupt when there is this sort of discrepancy between what you contribute and what you, then, cash in. how did the system get so broken? >>guest: well, currently the teachers only pay 9 percent into their salaries, their pensions, and nothing for medical. so all we are asking for, for reform, in illinois is to increase the pay out from 9 percent to 19 percent and to pay for what of their medical. we also are asking for all new government employees to not have pensions, to only go into 401(k)'s and social security. >>alisyn: but let me understand the math. because if you increase their contribution to 19 percent how can they still be collecting millions on the back end? >>guest: well, the "fast and furious," program resulted in over 2,000 of our firearms getting into the hands of the drug cartels and resulted in the death of a border patrol agent. and the attorney general testified before the judiciary committee in may and said that he only knew about it for a couple of weeks and now we have documents that show that he had received numerous e-mails and other documents as early as july of 2010 on the very topic. so, if he knew about it and was lying about it to the judiciary committee it calls into question his honesty and if he dent know about it it calls into question his corn tense. either way he needs to go. >>clayton: on the honesty think we will find out in december, when he is unoath and tells the truth, but the other question of the competence, that seems to be what is driving at the love the republican disdain for the attorney general, and he gets the memos last year and whether he reads them or not could have been vital programs to america's interest and if he did not read them, and signed off on them; that incompetence? >>guest: well, i think is. you are the lead legal expert in this country and defender of the law, it is your responsibility to know what is beginning on if your department, and to overseem this and make sure they are carried out to the best interests of the american people. clearly, "fast and furious," was not in the best interests of the american people. >>clayton: the president is supporting the attorney general. >> i picket the inspector general to look how this happened and i have confidence in him and i have complete confidence in the process to figure out who, in fact, was responsible for that decision and how it got made. >>clayton: there is criticism over the defense of the defense of marriage act, he will not defend it. what do you say about that? campaigning to me seems harder than the schedule as president because you can build this downtime. so, the fact that herman cain says i will back off, i have been running too hard, is that valid? >>governor huckabee: he should not say that, someone is not managing the campaign and taking control of the schedule. i have asked my question, why is he in places like tennessee? arkansas? alabama? lovely laces to be, adoring crowds, but if you are running, and win you better be in iowa, new hampshire, south carolina. >>clayton: but the herman cain camp says it shows he is unscripted. we don't want the washington folks, he is unscripted. >>governor huckabee: that is an enduring quality. i like it, as well. but, as endearing as it is you have to get open the track to get the delegates in order to get the nomination. >>dave: maybe you should never say i will keep lobbyists out of my administration because it is impossible to do in washington, dc but obama made that promise in 2008. for lobbyists. "new york times" turns up a report that shows technically he is not dealing with lobbyists only because the people that are lobbyists aren't registered as such. is that living up to the promise or another loophole? >>guest: great hypocrisy. what he campaigned to be was an outsider maintaining distance from the traditional power structures that existed. this guy is more connected than at&t in terms of his absolutely being tied in to the lobbying and to the traditional political money community. >>alisyn: isn't that a washington rob? can any president say i will not have lobbyists around? >>governor huckabee: you can pass the fair tax. the reason the tax code is 67,000 pages and millions of roads 35,000 progress stepped lobbyists in addition to the tens of thousands that do not register are there for a primary purpose: 85 percent of their work is to manipulate the tax code for their client so they can get a break for something in their business. the simplifying, which is why herman cain's 9-9-9 plan is a good idea, his better plan is the fair tax, eliminates all of these things, you have a simple thing, you buy something, you pay the tax, and lobbyists can not affect it. >>dave: obama's promise led lobbyists to not register, so, everything has changed. governor huckabee will stick around. >>alisyn: we will talk to you about this. muslim students have closen to attend a catholic school and thousand there is a lawsuit saying the christian symbols violate the students' right. do they have a right to sue? attack. >> alisyn: thank you. meanwhile other headlines, an accused serial killer known as the grim sleeper, six more murders, total of 16. dna linked londy francis to ten murders last year and all of the women's whose bodies were found in the streets of los angeles. some of the new victims were reportedly identified in a stash of photos found in franklin's home and prosecutors say they will not be seeking charges in the new cases and they say the case against franklin is strong enough already and they don't want to delay the trial. bank of america, reportedly backing off on the plan to charge customers $5 a month for using the debit cards. after a backlash. the bank will likely allow them to side step the fees as long as they comply with other conditions like aplaying for a bank of america additional snow in this case, down across this area, the central appalachians and we've already seen up to 10 inches of snowfall, might be another three or four inches in some spots and move forward in parts of upstate new york and pennsylvania and the hudson river valley dealing with potentially up to an about a foot of snow and new york city, three to five inches. and the area inland. tree damage and power outage because of the leaves on the trees. one last area in parts of new england, the bulls eye and talking about a foot of snow, boston, three to five inches as well. dave, back to tax except status. 501 (c)(3). >> should they be allowed to demonstrate on the public's dime? >> let's ask the political editor for town hall. hey, guy. >> how are you. >> alisyn: owe for the occupy wall street had some in their coffers and filed for 5013 c. chi charitable organizations and may the not attempt to influence legislation and should they get 501 (c)(3). >> i think it's clear they're not for profit in many senses of that phrase so i think in some sense they are certainly eligible, i guess you could say and for them to actually campaign, you just read the definition, they have to have specific goals, specific candidates and so far, from what i've seen, they absolutely do not have that, so, look, i don't have a problem with them being tax exempt. i just feel bad, frankly for the few people on that poor finance committee who have to try to corral this mess and make sense testify and try to actually comply with tax law, which is hard enough, when you're not surrounded by anarchy, which these people are and not subject to what i call the democracy and twinkle up, twinkle down or whatever they're doing. if i agree with them. in line with them politically, which i'm not. i don't think i would give them a time because i just don't see how this money is going to be spent in a responsible way by anyone. >> okay. welsh the deal is, if you give to them under 501 (c)(3) you can write it off and to be clear the irs says you cannot get involved with any campaign activity and may have reversed that, you're not allowing to campaign for any candidates or be involved in campaigning. how about the the double standard aspects of this. we found out that occupied protesters, they're basically squatting and some have been charged with what they didn't call a protest or rally, whatever it is, they're charged one group for doing it for free. is there a double standard? >> of course there is. to clarify the previous point, the reason i'd being okay with this, they're not campaigning for anyone specifically. >> got it. >> even the folks are saying they don't like president obama very much. so if they cross in that territory, you have to look at it again, but the double standard, i think, is really glaring, and for people like me, it's really, really frustrating. you have a situation in the richmond tea party, they held three rallies in a public park in richmond over the course of three years, they applied for permits, they paid for the permits, and they cleaned up after themselves and they went home, now, the same occupy wall street folks are in the same parts and occupying, scotting is the word you used, absolutely accurate and now for weeks and months on end. they're not following any of the rules. i mean, it's crazy that the tea party, and law abiding citizens actually are being punished and are, you know, losing funds, because they're playing by the rules, and i think it's great, what the richmond tea party is doing, they're sending an e-voice to the city saying he we want our money back and they should get the money back, why should one group be treated differently than the other. >> alisyn: we shall we what richmond has to say
