"fox & friends" begins right now. ♪ ♪ >> the 48th and 6th "fox & friends" plaza feeling certainly patriotic this memorial day. the west point band playing "god bless america" there. >> they will be performing all morning long in honor of memorial day. today we're going to be honoring our veterans and troops and those who gave the ultimate sacrifice in the name of freedom. send us your memorial day pictures. we know you've been to parades, you've been having kids hold the flags. there was a festival on our street, streets all blocked off and kids showing their patriotism. >> the unofficial kickoff to summer but today we're honoring the true meaning of memorial day. yesterday on our after the show-show we had the navy band playing. our whole crowd on the plaza was singing "god bless america." it was great. >> that is the best way because you can cover bad voices. >> now i can tkpwelt it -- now i can belt it out. >> in about an hour president obama returns to washington after that surprise visit to troops serving in afghanistan. the president promised them the care they deserved even as the v.a. scandal back here at home continues to grow. we're live in washington with the latest on this. >> reporter: good morning. the president paid tribute to the troops amid a scandal over veterans' health care and also laid the groundwork for an announcement on afghanistan troop levels. president obama slipped into baghram airfield under cover of darkness for a four-hour memorial day visit with the troops. he told the assembly he just happened to be in the neighborhood. but in fact the timing is significant for two reasons. first, because the president is expected to announce this week how many troops would remain in afghanistan once the newly elected president of that country signs an agreement with the u.s. which is expected, the u.s. will probably have 5,000 to 10,000 troops remaining on the ground. the timing also significant because of this, here at home the veterans affairs, the veterans administration is under fire for falsifying appointment lists to coverup delays in care. the president did not address the controversy directly but did say this. >> taking care of our wounded warriors, our veterans, helping our waor waors and veterans isn't just a promise. it's a sacred obligation. >> the president due in washington soon. he goes to arlington national cemetery for the traditional laying of a wreath on the tomb of the unknowns. back to you. >> thanks. steve centani live in washington. you heard the president alluding to taking care of our nation's veterans, that it's a sacred obligation. but this comes amid the v.a. scandal and calls further for secretary shinseki to step down. yesterday we heard from a big voice in all of this, general martin dempsey basically saying it's time for him to go. he needs to be held accountable. harsh words from the joint chief. listen. >> it is outrageous. if the allegations actually are documented and proven -- and i suspect some of them will be -- got to be held accountable. i think eric shinseki made it clear they would be held accountable. >> including him? >> of course. at some point the chief executive, the chairman, whoever it is, has to take responsibility for the entire organization and its performance. >> we have the highest-ranking military official breaking away from the president saying there needs to be some sort of accountability and these scandals not just rocking phoenix, arizona, where we first learned of the alleged secret waiting lists where 40 heroes were left to die but now plaguing half of the states in the united states. not good timing this weekend. >> calling for accountability but not just anybody. also saying if it gets to the highest level, the highest person is eric shinseki and he would be the person ultimately who needs to take responsibility. >> we heard from a number of of persons on the show, high ranking military members and colonel ralph peters said he is not the guy you need to get rid of. he is the guy who will see the v.a. through this phu did id mess -- muddies mess. really congress needs to be held accountable. they hold the purse strings. yesterday we had 14 bills sitting on harry reid's desk right now but they had many years to hold them accountable and they haven't. leave shinseki alone, they say. >> colonel ralph peters said blaming shinseki is like blaming your doctor for cancer. it is something that has been going on for decades. the root of the problem is not shinseki. it is the bureaucracy. >> it is a problem that has been ongoing for 50 years. it is not a new thing. he's been in control of this for four to six years. this is getting to a different point. we're having our military vets especially this weekend saying this is a problem. a lot of local grass roots efforts are saying something has to be done. >> if the administration is not going to do anything about it, been sort of quiet on this, the president didn't address it, he made passing mention of their health yesterday in afghanistan. a lot of talk about if the congress isn't doing anything, the president, where is eric holder, the head of the department of justice? and senator blumenthal saying we need to have a d.o.j. investigation on what exactly is unfolding at the v.a. listen. >> i believe that the department of justice has to be involved. i've urged secretary shinseki privately and in fact publicly to request and involve the department of justice. we're talking now about evidence, credible and specific evidence of criminal wrongdoing across the country in more than 30 places. the inspector general of the veterans administration has only 165 investigators, plainly more resources are needed. only the department of justice and the f.b.i. have the resources, the expertise and the authority to do a prompt and effective criminal investigation of the secret waiting lists, potential destruction of documents, falsification of records; in effect, the cooking of books and covering up that may have occurred. >> key word there was "criminal." it's not just somebody being incapable of doing the job, so they should be removed from the job. maybe somebody needs to go to jail for this. >> people died. the department of justice has done lesser investigation on smaller things. people didn't die. 40 individuals we know of that passed away because they were on these secret waiting lists, couldn't get the care they needed. so people died as a result of this. >> we haven't heard directly from holder about any plans. they're monitoring, i'm sure they're waiting for the investigation to go through. we haven't heard anything from him about concrete plans. >> or are they biding their time and hoping this blows over like all the other phony scandals. >> a lot more on this through out the three hours this morning as "fox & friends" chugs along. >> they tried to stop the massacre. elliot rodger's parents were reportedly frantically searching for their son as he hurt and killed students at the university of santa barbara. this morning we're learning about the victims, including the one brutally stabbed at rodger's apartment. >> reporter: i'm standing outside the sorority house where the gunman elliot rodger killed two of his victims. veronica rice and casey cooper just behind me over here. the police late last night releasing details of the three house mates whom rodger stabbed viciously at the apartment complex a few yards away from where we're standing now. it's also emerged that rodger's family frantically drove up the 18-minute journey from woodland hills to isla vista after that saw that video posted on-line by rodgers in which he announced his pending murder spree. they were too late to get here on time. by the time they got here seven people were dead. a.t.f. searched the home of elliot rodger yesterday. his parents were separated. his father was a director on "the hunger games." we understand from one of his neighbors that rodger was aloof. he tried to push away anyone who got close to him. when it appeared on the news that it was elliot rodger who committed the crime, the neighbor said it wasn't a surprise at all. the community in shock today. one final update on the 13 injured, everybody now is off the danger list. >> good news finally there. >> we have other stories making headlines. heather nauert is here. good morning, heather. >> good morning to you. it is a busy morning so let me get to what is going on. a desperate search in colorado taking place for those missing in a massive mudslide. the search is set to resume at sunrise. the mudslide stretching four miles long and as deep as 250 feet. it happened last night in a remote area in the western part of colorado. no homes damaged but three people are missing. wao*epl watch the story as it develops. >> strong winds fueling a massive wildfire in the state of alaska. people living southwest of anchorage are fleeing their homes. so far this fire burned 240 square miles. >> a wildfire near oak creek canyon is 25% contained, 21 square miles burned since last week. >> pope francis beginning the last leg of his tour through the middle east. he is calling tensions between israel and the palestinians increasingly unacceptable. he even went as far to invite the israeli and palestinian president to a meeting at the vatican and they both accepted. earlier this morning the pontiff prayed at the western wall in jerusalem and later today he'll hold mass at the site where the last supper is believed to have taken. your 2014 indy 500 champion, brian hunter ray. >> here comes -- he won't get there. hunter-reay wins the indianapolis 500. >> he is the first american to take on the the checkered flag since 2006. after the race he says the big win is still sinking in. >> a dream has comes true today. i'm a proud american boy, that's for sure. >> that's great. we want to hear more from him live right here on "fox & friends." that's coming up at 7:30. fantastic to see him rockin' the flag like that. >> coming up here on the show amid the v.a. scandal, a new plan will let vets seek private health but will it work? our next guest says he's seen the inefficiency he at the v.a. firsthand. dr. jeffrey woodmire joins us. nice to see you. your history with the v.a. is deep? >> my general surgery residency and vascular surgery fellowship were at the richmond v.a. in richmond, vi spent from july of 1996 to july of 1997, i took care of the vascular surgery patients at that hospital. >> problems developing even then? >> it was heartbreaking at times to see patients in clinic and 4:00 would roll around and people who had driven maybe many miles for their appointment and we had to say sorry, clinic's closed, because that's the way that hospital -- >> 4 p.m. you guys are out of there, unbelievable. >> not because we didn't want to. that's the way it works. >> the news this weekend, secretary shinseki opening up the roles a little bit and allowing some patients to seek private health care. is this the solution? here is the restaurateur. marty, thanks for getting up. it sounds like a crazy thing -fplgt you're a small business owner, you own a few restaurants, you operate a brewery and now you can't sell your beer in your restaurant. >> exactly right. >> how did this happen. i imagine this is limiting your growth as a small business owner in a big way. >> it is. we found out about this interpretation of the regulation last week on monday, and we've been trying to work through it with state lawmakers. >> what are your options? i assume one, you're going to try to get this law repealed. this is an old prohibition law. what else would you have to do if you can't get that repealed to be able to keep your business growing? >> it is. right now we can sell our beer in our brewery, but we could not sell it at our restaurants that are just across the street maybe 200 feet away. we can sell it to any other restaurant on the feet and sell up to 50,000 kegs to anyone in the state but not to our own restaurant amazingly. >> why is this law on the books in the first place? >> it is an old prohibition-era law. the idea was to keep brewers from having too much power. but that hasn't quite worked out that well because anheuser-busch has 50% of the market. >> you're talking about big brewers like anheuser-busch. now you're a small prueher trying to become a little bit -- a small brewer trying to become a little bit bigger. the difference is extreme. >> one anheuser-busch facility makes 20,000 barrels of beer a day. we'll make 2,000 in a year. >> what are the chances of your being able to change this law? >> i feel good about it. we have a great state legislature right now, very business friendly. i believe they will do what is in the best interest of restaurateurs across the state. the north carolina restaurant lodging association is advocating for change. that represents 11% of our workforce in the state. >> what does this do to even your employees? over in afghanistan. amid that scandal over veterans health care. he also laid the ground work while he was there for an announcement on afghanistan troop level later this week. president obama slipped into bagram air field under cover of darkness for a four hour memorial day visit. he told them he happened to be in the area. the timing is significant for two reasons. first, because the president is expected to announce this week how many troops will remain in afghanistan once the newly-elected president of that country signs an agreement with the u.s. it will probably be around 5 to 10,000 troops on the ground. the timing also significant because here at home, the veterans administration is under fire for falsifying appointment lists at its medical centers to cover up delays in care. the president didn't address the controversy directly, but he did say this. >> we're going to stay strong by taking care of our wounded warrior, our veterans 'cause helping our wounded warriors isn't just a promise, it's an obligation. >> reporter: he hosts a military family's breakfast at the white house, then goes to arlington national cemetery where that traditional laying of the wreath on the tomb of the unknown. back to you in new york. >> steve live for us. thank you very much. as the president goes for his memorial day activities today, that cloud of the v.a. scandal hovering above every move he makes on this memorial day. yesterday some surprising words from the chairman of the joint chiefs of staff, general mark dempsey who has been the first break from the administration to come out swinging really against secretary shinseki, saying he needs to be held accountable and probably needs to go. listen. >> it is outrageous. if the allegations actually are documented and proven. i suspect some of them will be. they got to be held accountable. i think rick shinseki made it clear they will be held accountable. at some point the chief executive, the chairman, whoever it is, has to take responsibility for the entire organization and its performance. >> that's the first person to say shinseki poely is the guy who needs to take responsibility for this if they find the allegations to be true. >> meanwhile, not a single senate democrat who has called fort resignation of secretary shinseki. however, there are just huge chorus that seems to be getting louder and louder and louder from veteran support groups calling for him to step down. yet we also had colonel ralph peters on the show yesterday who said basically that if you are blaming eric shinseki for all the problems in the v.a., it's like blaming your doctor for the cancer that you have. this is the problem that has been systemic for decades and he is the man to fix it and he needs to stay in place. >> and the former chairman of the joint chiefs of staff, one of the members was on our show yesterday, or two days ago, general casey, who also supports eric shinseki and says he's -- if there is one person that can lead us out of this mess, it is him, he's a decorated war hero. however, if he's been there through all of this, we saw that report back in december. we knew some of these problems existed for many, many years, and seems like nothing had been done. up until this weekend, privatizing, taking some of those people who are on the roll, turning them over to private health care and private hospitals, that was a move we saw this weekend finally from secretary shinseki. >> we know the problem is that deep that it takes maybe a longer period or is it possible that you can't even get out of this problem that we're in and that's why a lot of people are calling for privatization of the v.a. this weekend, yesterday on fox news sunday, derek bennett, with iraq and afghanistan vets of america, he spoke about his concept of this. take a listen what he had to say. >> i think it's going to be extremely helpful, but also a step that could have been put in place years ago. the idea of a public-private partnership in providing veterans or anyone really the access to private health care that is paid for by the government when the capacity isn't there in the v.a. is a no brainer to me. >> why are we surprised that the government that runs the post office badly and runs amtrak badly can't run a health care system, delivering a post-guard from a to b or a passenger from point a to point b is a lot simpler than delivering health care. so we shouldn't be surprised by this. >> i said general casey was the former chairman of the joint chiefs of staff. army chief of staff. my apologies. we had a guest earlier. he served in the v.a., and he said why don't we give our veterans a platinum insurance card. it gives them health care wherever they want. they can take to the private sector, go to private hospitals. they don't have to wait in line. he said when i worked at the veterans affairs hospitals back in 1996 and 1997 when 4:00 p.m. would come around and you had people waiting in waiting rooms to get in, 4:00 p.m., i'm sorry, bureaucracy shut down. you got to go home. we can't see you this afternoon. >> in a for profit business, it's very different. the business owners of any sort, even if it's some type of health care, you want to make sure that you turn a profit so you're going to make sure your customers are happy. these veterans in a sense are not really customers to these hospitals. these doctors are not work for the veterans. they're work for the government. >> have you ever been in a post office where it stayed open late just for you? no. >> let me help you mail that package. >> that door is locked while there is still people in line. >> we have other stories making headlines on this memorial day. the search in colorado for those missing in a massive mud slide. set to resume at sunrise. the mud slide stretches four miles long, two miles wide and as deep as 250 feet. it happened yesterday evening in a remote area in the western part of the state. no homes were damaged. but three people are still missing. they tried to stop the massacre. elliott roger's mom and father said they found their son's manifesto moments before he killed six people and hurt 13 others before taking his own life near the university of california-santa barbara. they frantically tried to find him and stop him, but they were too late. friends of roger's who wanted to remain anonymous, also speaking out. >> every single time we invited him outside, there were plenty of girls and just didn't even make an effort to talk to anybody. he was so closed off. >> three more victims have been identified. all stabbed to death. two were roger's roommates. for the second time in two weeks, a bottle bomb was set off in a movie theater in fairfax county, virginia. the incident happened during a late night screening of the new x men movie. over 300 people were evacuated and luckily no one was injured. last week a similar soda pot bomb what are you experiencing? tell us your story. this is what we heard. >> it's been bad. just getting appointments and scheduled and the waiting time here. he's not getting the care he needs. >> he has no teeth, so he's literally starving to death. >> there have been times i waited two days. >> sometimes it isn't a lack of personnel. it's that the personnel there don't have a sense of urgency? >> absolutely. either you're a number or you are a diagnosis. >> how long have you been waiting? >> two years. >> do you feel like the president cares about this scandal at v.a.? >> negative. >> so the issue is not the care. the issue is the wait time and the barriers to that care? >> yeah, exactly. >> i'm very disappointed. very disappointed. starts at the top and i think it should be replaced. >> buck stops at the president. it comes to the top. if the top doesn't put out the effort, nobody else is going to. >> i've got a nephew that left for boot camp four days ago. what's going to happen when he's 60 or 65 and he can't help himself? who is there for him? >> that was one of the more interesting parts of that, which is it's not the care itself, which is quite good. it's actually getting access to that care. i'm not able to get in. i've been waiting two years. >> we heard three months, four months, six months, waiting for basic appointments for things that they need and they're life or death situations. we heard it time and time again. cancer, things that they need to be seen for to prevent bad outcomes. >> giving veterans a choice to go see a different doctor, privatizing their health care not only is it going to give them access to more doctors, but possibly create a sense of urgency at the v.a.? >> that's right. a little bit of competition we know when you shine that light, it changes incentives for a lot of people of the we heard that from a lot of folks on the street, said that very thing. they talked about carter options, if they had a choice, oftentimes they might choose the v.a. for specialized care. but if they go to someplace more efficient, they might choose that. >> but at many government agencies, it's 4:00 o'clock, out the door. how does that change? >> you heard a couple gentlemen felt like they were treated like a number. they were treated like the problem. why are you trying to come back and get this care? come back five months from now and be grateful for this. these guys are grateful. they're not victims. they just want the v.a. to work. we didn't pick baltimore 'cause it was a terrible v.a. this is an average facility, not under investigation. yet this is still what we heard, which is another demonstration of how system wide this problem is. >> that was really just a general v.a., just a normal -- >> run of the mill v.a. in baltimore. they issued a statement, hey, we're not under investigation. someone said once i get in there it's great, but i'm waiting five months for an appointment. >> what's the story with getting kicked out? >> they sent the v.a. out there to say this is private property, we got to leave. we said no, this is public sidewalk. we can stand right here. they kept going and the police fettered back inside and we kept doing our thing. >> good to know your constitutional rights. public sidewalk. take a hike. coming up, you don't expect to see this in college, a quiet space for napping? how do you overcome that mentally? >> absolutely. coming down to the wire there, i knew that i was battling a guy that really figured this place out. he knows how to win here. he's a champion and i knew it was going to be tough to hold him off. there was no master plan, though. i just knew that i need to do keep that 28 dhl indy car up front as long as i could whenever i could. i wasn't trying to be second on the last lap to get a draft. i just wanted to be in the lead. it was right down to it. like you said, second closest finish in indy 500 history. just fantastic to be part of it. as an american kid growing up a fan of this sport, the heros, my heros were the legends of the indy 500. and here we are talking about it, looking out over imf at the moment. it's incredible. >> pinch yourself because you are one of those legends now. you say you remember watching this race in diapers as a kid and your son got to do that yesterday. what's that like for you? by the way, for all of those 11 states, this is just for state employment. it's not into the private sector, although for hawaii and rhode island, they have put that in for the private sector. >> a lot of private companies are doing this. target, they are going about this themselves, these changes. and i understand that employers have the right to know what somebody's background is. but this is just the initial stage. we are discriminating too many people based on one reason alone that they have a past criminal record. we are the most incarcerating country in the world. 2.2 million people are in prison. we're not even talking about people who have been to prison. people who have been arrested and have probation, they've never been behind the prison walls. >> so you think that this should be across the board, ban the box? that's what this is called? >> yes. i think that people should be given a fair chance to start. then once an employer looks through their record or through the background check, then they can determine if they like the person, then go through the background check. in the very beginning, there is no reason to discriminate and throw somebody's background or application away. >> david, you disagree on that? >> completely. it's discriminatory against business in this country and discriminatory against employers that they have to have the right to know whether or not you've been convicted of a crime or not. that is a basic due diligence of any employer in this country and i agree. we do have too many convicted criminals, but it shouldn't be incumbent upon the business owners and any employer, whether it's the state or private business, to not know immediately -- >> you do know. >> they don't know. i'm a business owner. they don't know. >> i'm a business owner, too. you're misrepresenting the point. the point is when somebody is doing a background check that, is later. this is just about when you're applying for a job, there is a box that says have you been arrested or convicted of a crime? and they're saying take that away so that the employer can look at the entire record or the entire background of somebody as a whole and then go through the background check. >> who is the government to tell business owners or an employer when they can do a background check on a potential employee of that company or that government or that employer? it has everything to do with knowing right away. you can't tell an employer not to be able to have a box on an application on whether or not someone has a conviction or not it's ridiculous. >> this was very easy. i just had to wind it up and go and you went. let us know what you think. this is an interesting debate. is this something people should be able to not have to disclose right away or is it something that private business needs? >> it's an important story for the marine corps and america in general. 15,000 marines and army soldiers surrounded and cut off. 120,000 chinese soldiers, 20 to 40 degrees below zero. they didn't give up. it's the american fighting spirit. they stuck together, they fought their way out. it was one road in and one road out. in doing so, they rescued 98,000 civilian refugees. a remarkable feat of the american fighting man. >> and antoine, you talk about this being a lost battle, something really forgotten, i had never heard of this battle. what was it like for them to have you bringing their story to light for the first time? >> well, i know for us it was a huge honor because in the marine corps, these men are legends. this battle was taught to every single marine who goes through boot camp or ocs. it's very well-known in the marine corps. and for them, i think that it was just recognition long overdue. our very first time we showed the film in public was a theater 400 people you and thought the yankees had just won the world series. the entire place went crazy at the end and honored these guys in a way that was long overdue. >> i'm a history major, and i had never heard of this battle, sad to say. why is this taught at the marine corps? >> we do have some troubles today. look at the weather maps. here is your temperatures as you wake up. really warm. a big warm-up across eastern two-thirds of the country for today. but take a look at what happens across the northeast. we'll still see showers across parts of new england throughout the day, showers around parts of the ohio valley. overall, a much warmer day across much of the northeast. today is really the nicest day of this three-day weekend. to the southeast, we'll put the day in motion. more rain across parts of texas and oklahoma. it's beneficial rain, but it will come with severe weather, so be very careful. make sure you're prepped for that. we'll see a few showers across parts of georgia, carolinas and down to florida, into the northern plains, we will also have a few showers. spotty afternoon showers. day heats up, it's that time of year. across parts of the west, things are look a little better. pacific northwest getting some rain. but deserts and the four corners looking a little better. >> so not terrible. >> not terrible. not great. >> all right. on this memorial day, people across the country are taking time to remember our -- and honor our heros. steve centanni is live with what's happening at the capitol. good morning, steve. >> good morning. the president just arriving back here at the white house after that surprise visit to afghanistan where he paid tribute to the troops amid that scandal over the veterans health care situation and he laid the ground work for an announcement later this week on troop levels in afghanistan of u.s. forces. so the president slipped into bagram air base under cover of darkness for a four-hour memorial day visit with the troops. he told them he happened to be in the neighborhood. actually the timing is significant for two reasons. first, because the president will announce this week, or is expected to announce how many troops might remain in afghanistan if we sign an agreement with the new afghan president once his name is announced officially. the u.s. will probably have five to 10,000 troops on the ground there at that time. the timing also significant because here at home, the veterans administration under fire for falsifying those appointment records to cover up delays in care. the president didn't address that controversy directly, but said that taking care of our wounded warriors is a sacred obligation. and today the president will go to arlington cemetery to lay the wreath at the tomb of the unknowns. he'll also have a breakfast for military families and that memorial day parade begins at 2:00 p.m. this afternoon here in washington, d.c the grand marshall will be lieutenant richard e. cole, who is 98 years old, world war ii veteran. back to you. >> wonderful. thanks, live for us at the white house this morning. speaking of world war ii, it was one of the greatest sea weapons during world war ii. it's hard to believe the uss north carolina was september to the scrap yard -- sent to the scrap yard. >> anna went back to her home state to help out. >> i can't wait for everybody to see. it's unbelievable. $240 million the economic impact from this battleship it's had on the state of north carolina over four years. it's hard to believe there was even a smidgen of a problem getting the funding need to do keep it from the jan yard. watch this. ♪ ♪ >> the first of all the 15 battle ships built for world war ii was the battleship north carolina. she was cutting edge technology, the greatest sea weapon on the planet when she was commissioned in 1941. >> she has seen over 300,000 miles, destroyed 200 enemy aircraft carrier and sank an enemy troop ship. today she still serves a patriotic purpose, inspiring young americans to serve. >> over the year we'll have over 40,000 school children visit the battleship north carolina. >> the uss north carolina has secured state funding to keep the memorial open to tourists on the cape fear river and out of the scrap yard. >> the battleship north carolina could be disposed of and cut up and made into razor blades, but the message and the economic contribution are very important to the citizens of our state. >> the half million dollars allocated by governor mccrory will go toward major repairs, like fixing the watertight body of the ship for the hull. >> 40,000-tons, 99 million pounds of steel goes through the water. >> and as always, typical boat repairs are in the works, too. >> if i may take 30 seconds, i want to tell you how much i appreciated the seconds you did on the chosen reservoir. when i was secretary of the navy, i was able to name combatants and i named one of them, the chosen, because of the significance of that battle to marines. as i was listening to it, it struck me, one of the things that has made that battle so important to the marine corps is that they not only fought their way out, they brought their wounded and their dead out with them. just had to say that. with respect to the book, i wanted to go back and write about growing up inside the military during the post-world war ii period, the cold war period, and then my own journey into the naval academy and finally into vietnam as an infantry marine and talk about the family side, what it was like for my mother to be 24-year-old woman with four children and having my father constantly deployed off to the berlin air lift and other place places. we all at a certain point in our life want to look back and ask ourselves how did we become who we are? and the example that was set to me by my family during that period and then the challenges that we faced getting ready to go to vietnam are a major part of everything i do today. >> it's amazing how long a career you had, but also the career of your father and the family in the military. your father, there is something you say in the book which i found really powerful and stayed with you for the rest of your life. when your father was graduating and you stood there. >> that's a great moment. >> unbelievable moment in the book. you say -- what did he say to you? i think it's interesting because he's serving those -- he's giving us our freedom, right? but he has this awareness about how great america is when he says this to you. >> and it took him 26 years of night school to get through college. he was so inspired, he broke out of the line and walked across the gymnasium floor at university of omaha. he was stationed there, and stuck the diploma in my face and said you can get anything you want in this country and don't you ever forget it. >> wow. to think that these brave men and women who are serving around the world and giving us our freedom, he had that awareness at that time. >> we have a family with a strong military tradition. my father was the only crew military person. we served in one capacity or another, probably since every war since the revolution. my son, i'm very proud of him, left college and enlisted in the marine corps and served in some of the worst fighting as lance corporal. it's very much a part of our family. >> so having that be so much a part of your family, the stories over the past couple of weeks and the past couple of months at the veteran affairs department have to resonate with you in a way that we might not even understand. we want to play some sound this morning from general martin dempsey, the chairman of the joint chiefs. he had this to say about the secretary shinseki. take a listen. >> it is outrageous if the allegations actually are documented and proven. i suspect some of them will be. they got to be held accountable. i think that rick shinseki made it very clear they will be held accountable. and then -- at some point, the chief executive, the chairman, whoever it is has to take responsibility for the entire organization and its performance. >> what do you think will happen here, senator? >> i've been working on veterans issues all my adult life. i was the first vietnam veteran to serve as a full committee council on the house committee after i left the marine corps and went to law school. i was on the veterans committee when i was in the senate. proud of the fact we wrote out of my office, the post-9-11 g.i. bill. and it's troubling to me, very troubling to me as a leadership question, even more than a policy question. when i arrived in the senate, there was a 600,000-case backlog of people waiting for their claims to be resolved. when i left, there was a 900,000 case backlog. you got to put your leaders on your problems. that's the one thing that they teach in the marine corps over and over again. if you have a problem, put your good leaders on the problem and fix the problem. >> speaking of good relationship, the rumors are flying. you got a new memoir out. will it be presidential candidate mr. webb? >> well, this is not a political memoir. but i gave myself an entire year where i did no interviews and no op eds and no sorts of things and i'm really glad to be stepping back into the debate. there are so many issues facing our country. >> leaving the door open. will it be webb for president? ♪ for my pain, i want my aleve. ♪ [ male announcer ] look for the easy-open red arthritis cap. welcome back. 51 minutes past the hour. he's been on the story from the very beginning since the news of the va scandal first broke and now helping get answers for our nation's heros. fox news legal analyst peter johnson, jr. joins us now. nice to see you. >> good to see you. the scandal of mistreatment of our nation's veterans at v.a. medical centers multiplies by the day. 26 sites are being investigated across the country. our viewers have been stepping forward and sharing personal stories of mistreatment. today on memorial day, "fox & friends" is getting answers to the scandal at the v.a. joining us is the chairman of the house veterans affairs committee, representative jeff miller. good morning congressman miller. >> good morning, peter. how are you on this memorial day? >> thank you for marking memorial day with us today. thank you for your service on this important issue. you've said over the weekend now that this is only the tip of the iceberg, that what we've been hearing is kind of like kindergarten compared to what we might hear in the future. is there any hope for our veterans going forward? what is your prescription for america on this memorial day? >> i think the first thing we need to do is not scare veterans away from the department of veterans affairs. but the secretary himself has got to take ownership of this issue out here. we have been trying to tell him for months, in fact, over a year now, that his people are not telling him the truth. they've got to come clean and quit protecting the system and the bureaucrats in the system and start protecting and serving the veterans that are out there. >> in terms of serving the veterans out there, americans are looking for the tip of the spear. they're looking for someone to take on their cause. in this box next to me addressed to you is about 1500, 1600 e-mails september by viewers. mostly veterans and their families. they've displayed and demonstrate a history of disrespect and dysfunction at the v.a. veterans are tired. veterans are sick and tired of it. what can be done going forward to ensure that our veterans do not die waiting for care in america? >> first of all, understand i'm sick and tired of it, too. we have a department of veterans affairs that when we send a subpoena to them, they don't answer the subpoena. when we send thousands of questions to them in our oversight responsibility, they don't respond to our questions. they decide to tell us what people they're going to send to testify at our hearing when we, in fact, ask for other witnesses. i would tell the veterans out there, go to your member of congress. if you want to send them to me, the chairman of the house committee on veterans affairs, let us look at what is going on out there because our responsibility and oversight is to make sure that the v.a. is number one, spending the money appropriately. and number two, that they are serving the veterans and not the bureaucrats. >> let me ask you this question knowing full well that you tonight run the v.a. now you're responsible for oversight, overview and trying to get it fixed. people are sick and tired of excuses being made for v.a. secretary shinseki. even now the head of the joint chiefs of staff says he might have to go. how long will congress continue to stand up for v.a. secretary shinseki, even when you say they haven't responded to subpoenas, and i have this evidence here about 15 or 1600 people, dozens of whom may have died because of the v.a.'s imcompetence and disrespect for our veterans? how long do we have to tolerate this, congressman? >> number one, we shouldn't have ever had to tolerate it in the first place. secretary shinseki is the head of the department. he knows that his people have not been serving him well, but this is much bigger, peter, than just the secretary of the v.a. we've received hundreds and hundreds of e-mails from individuals, too, that told us their story. the v.a. wants to focus on one very small area of phoenix and the fact that so far the inspector general says that there have been no deaths that have been attributed to the delays. but they don't want to talk about the fact that in columbia, south carolina, augusta, georgia, they already know that nine veterans died while waiting for colonscopies. >> they don't want to talk about the truth. they only want to obfuscate and that's the way va has operated -- >> i agree. time is over. our time is almost ended. will you do me a favor?
