Officials telling fox news that the remains of those 55 u. S. Service members, missing since the korean war, could be transferred to south korea friday morning korea time. That is thursday night eastern time. Of the remains would be set to be flown via u. S. Military aircraft to the airbase in the south. They will be transported in containers handed over at the dmz. The remains will be catalogued, and then they are set next wednesday to be transferred to a center in hawaii for final dna identification and the return home. Of course, will be noted, a major commitment form north Korean Leader at their summit in singapore last month. There are Many Service Members still missing from the war in the north. Since 2005, and the search has been halted. Bill. Bill this is significant. How does this fit into efforts to denuclearize north korea . Bill, it is seen as another confidence Building Measure by north korea toward that ultimate goal of denuclearization. Remember, earlier in this week, analysts said that north korea was dismantling some facilities at a missile test site. It just, south korean president moon said these two events could add new momentum towards denuclearization. This comes also after pompeo going to pyongyang. A lot of pressure. We have talked to the department of justice, hiding information, redacting information that they should not have. Giving us the finger and not giving us the information that we are entitled. Center, they just got tired of the doj to produce documents they think they are entitled to, what was going on inside the election. I think they are laying down a marker, letting them know that congress means business, and hopefully being able to do something to get that done. It would be much easier for everyone to just get the documents, but at some point, congress has to stand up for itself. They have got to do it today because it is a six week long recess. Even if they do not schedule one, Rod Rosenstein is going to be the be the topoftheline for a lot of constituents during this recess. Is trying to do here . They think that republicans are trying to stop or slow down the special counsel. Democrats are using words like panicked when they describe the smooth by their republican colleagues, and the top democrat on the committee added this on twitter. He said these articles of impeachment against Rod Rosenstein were filed in bad faith and show extraordinary lengths to which House Republicans will go to protect the trumpet. I think mike pompeo did a terrific job laying out all of the successes of the Trump Administration in terms of north korea, iran, and russia, in terms of the military weapons we have supplied to ukraine, in terms of the increased contributions by the nato nations for their own defense. You can go through a long list of items where the president has gotten results, and he hasnt gotten credit for it. Bill i think you make an interesting case about the reaction towards russia. But it was pretty clear in that hearing, democrats just do not like this restaurant. Even bob corker, with that line about ready, fire, aim, what did you think about that . That is how he views the policy is. There have been disagreements now going back for a couple of years, and yet, you are right. There were some members of the committee that seem to be there to play for the cameras, rather than to look for information. But i think mike pompeo did a terrific job of laying out what this administration has actually done and then pushing back the invitation for putin to come to the United States until next year. You know, bill, this hasnt come up as a discussion point yet. It pushes it back beyond the elections. That is a message to putin. You mess around with us, and the price that you pay is going to be significant. Bill so you want to mess around in 2016, no pushback. Did it before the midterms, then. It was the right decision to say that he doesnt come until after the elections. I think it was the right decision that the administration made, and the credit goes to them to say look, there is a cost or to an invitation to come here, and there is a price he will pay up if you involve yourself in the elections in 2018. To stay away. That is how you deter actions because threats require decisive actions, and putin needs to realize that there will be significant consequences to any attempt he has to involve himself in the 2018 elections. Bill north korea, the secretary made it clear that they are Still Producing material. What are we to make of that amount and a half after singapore . Well, this is going to be an ongoing process, and we are committed, the Unit Administration is committed to making sure that north korea no longer has Nuclear Weapons. We know that they have them. We have seen them significantly turning down the heat since the president has engaged the leader of north korea and at the singapore summit, so we are heading in the right direction. But they are going to be lots of ups and downs. Kind of like a rodeo, no timeouts, no guarantees. And we have to make sure to keep ever vigilant on this, and we will. Bill are you confident that north korea is pursuing the same name that we are . Come i dont think that you can trust her north korea at all. They are going to do everything that they can to hide their activities. My concern right now is that they are being aided in that effort by china and russia who are helping north korea evade some of the sanctions. Remember, it was a tough sanctions by the United States that brought north korea to the table in the first place. Anything that lessens those, the force of those sanctions, it is going to make it easier for north korea to try to get around getting rid of their Nuclear Weapons. So i have concerns about what they are doing no jointly, specifically with fuel to north korea. Now, remember, that was legal to do in the obama administration. Made it illegal, and it is those sanctions that brought the discussions to head. Bill okay, last point here, what are your discussions like with your democratic colleagues . What is the level of angst they have towards this white house . It was apparent in those questions yesterday, how aggressive they got, knowing that secretary pompeo was not going to sacrifice the privilege of a private conversation. He was not going to get much ground on that. What did they tell you about how they feel about it . You are right, bill. I think you hit the nail on the head. They are against whatever President Trump is trying to do. Many are still in denial that President Trump was elected president of the United States. They are furious that neil gorsuch is on the Supreme Court. They are furious that cavanaugh has now been nominated for the Supreme Court. Many of them came out against his nomination before he was even named, and you saw that in the press. So on point after point after point that the president does not get the credit he deserves for the actions he is taking come of the success of the administration, because he is a man of action, a man of results, and i think that is what we are going to continue to see. This reporter, in this case, Caitlin Collins, shouted questions and refused to leave after being repeatedly asked her to do so. She was not welcome to participated in the next event. They are not in compliance with three of them. Sandra House Republicans moving forward with plans to impeach Deputy Attorney attorney general Rod Rosenstein. But the house is up against the clock to get a vote on this resolution before going on recess today. The two g. O. P. Lawmakers leading this charge saying the time to act is now. Quite frankly, its either we hold him in contempt or we get the documents, or we impeach him. And of the only thing that we have control over is the ability to bring impeachment straight to the floor. Doing the right thing, it may have been 120 years, but when was the last time you saw the fbi take a disproven document with no validity, take it to a secret court, not tell the courts who paid for it, not tell the guy that the guy who wrote it had been leaking to the pres press. And the last one, Rod Rosenstein signed. Sandra Alan Dershowitz is a harvard law professor and author of the case against impeaching trump, he joins us now. Thank you for your time this morning. First off, can you tell us exactly what this means. Republicans have been warning this would happen for quite some time. Now, they are actually acting on it. What does that mean . It is the most shortsighted, and i have to say stupid thing i have heard in a long time. Here we have a present to the democrats are trying to impeach. If they gained the house of representatives, they will almost certainly do so. And the big issue will be can you impeach a president and anyone else when you dont charge him with specific crimes, just because you disagree with what he has done. And now, you have the republicans making the case for the democrats who want to impeach the president by offering bills of impeachment and not charging crimes. Im going to have to write a new book called the case against impeaching Rod Rosenstein. The same arguments apply. This is so shortsighted. Both sides do this. They use criminal law to go after their enemies, the use impeachment to go after their enemies. The biggest victim is the american public. Impeachment is supposed to be there for serious crimes. Treason, bribery, other high crimes and misdemeanors. If you dont like the way Rod Rosenstein is responding to your subpoena, charge him with contempt of court. Bring him to court, but do not use impeachment. That just helps the democrats who are trying to impeach President Trump. Sandra but to be clear, what they are alleging here is that Rod Rosenstein not only repeatedly failed to produce documents requested by house judiciary government committees, but that he also attempted to conceal surgeon facts. You are saying that there is no case for impeachment there . Of course not. There is no crime. Again, read my book. I lay out all the arguments that they did not want to see anybody impeached unless they committed treason, bribery, or other high crimes. They rejected a proposal that said maladministration or doing the kinds of things that rosenstein is accused of doing. If you dont like what he has been doing, thats where we have contempt powers in the court. Congress can see a contempt citation against Rod Rosensteins giving the power. They are going to say look, the republicans agree. It really will backfire. Sandra well that seems to be the sentiment from adam schiff, ranking democrat. He tweeted this out in response to the latest actions on the part of republicans saying these articles of impeachment were filed in bad faith and show the extraordinary lengths to which House Republicans will go to to protect a trump. History will record these fibers as willing accomplices in the most serious speak out when they seek to impeach President Trump or othey will cite adam schiffs letter, saying see . You are now doing the same thing you accuse us of doing. Look, both sides misuse the impeachment process. That is why i wrote my book. Both sides misuse the criminal justice as one. That is why i wrote this. The criminalization of political differences, endangering democracy. We have to disarm. We have to stop at weaponizing impeachment, stop weaponizings criminal law. If you dont like what somebody does come a vote against them, bring them to court, but do you do not use criminal law to target your political enemies. It is a serious mistake, and it will backfire. Sandra the question of timing is an important one. Democrats are saying this is a direct attack on the council of investigation. The resolution has no chance of resulting in his removal. But the timing of the house beginning its recess until september 4th. We are looking at that as of tomorrow. So code of vote to be forced to today on no because you need to have hearings. You need to have evidence. You can just create a bill of impeachment and then vote on it. Remember when people have impeached in the past, it has been weeks, sometimes months of hearings. I know, i participated when bill clinton was impeached. I testified against him. You cant adjust vote on the impeachment. That would be an abdication of responsibilities. Now, i dont think there is any realistic chance that it could be voted in the time the romance. I dont think it should ever be voted. It is a big mistake and will backfire against republicans. It will backfire against the democrats if they try to use it against trump. It lets just take impeachment off the table. Sandra we will see where all of this goes. Timing is going to be an issue. The federal judge to impose to this deadline the federal governments work, calling it a remarkable achievement. That is in reference to their efforts to reunite all of the eligible children. Based on the numbers they have seen, it appears that the deadline will be met today. According to the feds, they have already taken place, another 500 reunions have been greenlighted. That is out of 2500 total kids, ages 517, separated from their parents or families at the border. But lawyers for the aclu say the government has essentially manipulated the numbers in their favor. Listen. There are many other people that will ultimately need to be reunified, so when they say theyre going to meet the deadline, it is only for those individuals they have declared to be eligible. More than 900 children are either not eligible or are still pending, falling in that category. And the same federal judge out in california also admonishing the government over that. Praising them, but also saying that this policy will add forethought with regards to keeping track of people, as they were seeing the forethought of that. There are more than 450 cases where the parent has already been deported and at least 130 people who signed papers waving their reunification, so the aclu wanted the names and contacts to all of those individuals, so they can reach out to them to make sure that they fully knew their rights before they were deported and left the United States without their children. Some of those tax cuts are set to expire in a few years. It is working well, lets make the tax cuts permanent. That is what chairman brady and his committee are working on and what we will vote on. Frankly, a lot of those democrats who voted no on to now vote yes because families are seeing money in their pockets. Actually seeing results from their employers. Lets move that end. They have been asking for months, we need to see these papers, and they have stonewalled, according to republicans. I doubt they have the votes to impeach the Deputy Attorney general, but they are trying to make a point, and i think it is a good one. And i know the frustration because i have had it myself. When you do you get documents, they are so heavily redacted that they make no sense. I also understand the point of view of justice. They just cant have information out that would jeopardize someones public safety. Lots of times, they have confidential informants. Heres what im going to suggest. I think that the dash my house friends should sit down and say here are the documents, the subjects that we want. And heres the ones that justice wont give to us. And then send those to the white house, and the president can declassify anything he wants to. He can just give it to one of his lawyers and say come back and tell me what i need to take out of here without making it meaningless, and lets resolve this issue. This is not a routine matter. This is not a case where congress and justice are having a fight over oversight. This has to do with the russia investigation. This has to do with the bias at the fbi and justice, back during the president obama days. And we have got to deal with this. The Justice Department has got to get to the bottom of this. The fbi does. They have been so many allegations flying back and forth as a result, if you look at it from 30,000 feet, bill and sandra, it has undermined the integrity of justice and the fbi. I dont want to see that happen. Sandra are you getting the sense, senator kennedy, that your colleagues are going to force a vote on this . I dont know. I think the house members are serious. I think they are angry, i think they are sincere. If you put it in perspective, sandra, there is always tension between congress and agencies and in that oversight role. That has been going on since moby dick. It has been going on since the founding of the country. But this one is different. To the states need to give the house members what they need. And if justice says we cant hear the documents, then send them to the white house, and the president can declassify whatever he wants to declassify. Bill it is an interesting solution. He writes these articles of impeachment were filed in bad faith and show extraordinary lengths to which House Republicans will go to protect a trump. I am just a saying about short of impeachment, if the house wants to do it, that is their prerogative, but the short way home is for them to sit down, read all the documents in the dispute, send them to the present, and say break this type. Once again, he can declassify anything he wants to declassify, and i trust our president not to do something that would jeopardize anybodys public safety. Sandra Alan Dershowitz had a similar sentiment. Take them to court. That is actually going to work against republicans, considering democrats are seeking the same thing for the president. This kind of sets up the fight that we have. Take a look. We are on the moral side of history. If the president cant say hey, i can do anything i want to do, then it is all in the constitution. That is what is at stake right now. There are no bystanders. You are either complicit in the evil, youre either contributing to the law, or you are fighting against it. Sandra your thoughts as you listened to those democrats. They dont have much to argue. I mean, they are down to stalling and reinstalling. When before judge kavanaugh was nominated, i got a call from the white house. He said kennedy, do you have any advice for us . I said sure, just find someone like neil gorsuch. No big deal. And what they did, you know, i said that he was and is illegal rock star. There was judge kavanaugh. And i think the democrats see that. Here is my opinion. We have got to have a justice confirms. The courts reconvening. Now, if the democrats want to spend all the time between now and october 1st arguing over documents that they want, that they are not going to get, they can do that. But there needs to be less time for questions and less time for confirmation. They can use the time however they want. But senator mcconnell has said i believe he means it, we are going to have to vote on this nominee. And i will tell you, i met with the guy. He is not only a superior intellect, he is a good man. Bill Chuck Schumer this week suggested that there are skeletons in his record. If he is a fairminded, like they claim he is, why are republicans his full record from the senate and from the American People . As soon as we come to an agreement, we will begin to move forward. Bill so i look at this as you guys having divorce. I think the question is a senator rand paul. Do you know what he will do with Brett Kavanaughs nomination . Will he vote yes or no . Two points, yes or no, judiciary, now im going to do my job. I am going to ask the judge tough questions. I suspect he can handle it. But we are about to select the most powerful unelected position in the most powerful country in all of human history. This is a big deal. Rand paul, he is a maverick. That is one of the things i like about him. He calls it like he sees it. Do i think he will come around . Yes. But he is asking some tough questions. I think he will be confirmed. And i dont want to prejudge this. I am going to do my job. I want to make sure that judge kavanaugh is what he appears to be. But i think the reason that senator schumer and others are picking this fight over paper, you notice, they do not have much to say about his integrity or his intellect, or his consistent judicial philosophy. They dont have much to say on the merits, so they have to deal with the procedure. I get it. They have to make a good showing for their base, but they are not doing the American People, democrat, liberal, independent, whatever. They are not doing them a service. We need to start the confirmation. Lets put him through, and then we will have a vote. Thats what we ought to do, but that is probably not what will happen. We are going to stall. He said we are going to keep sanctions where they are. That is a good thing. He needs to hold firm on that. And if and until we see real progress. Bill we are in a better place that we were six months ago. I think that the relationship, the dialogue, getting your hostages back, getting the serviceman back. And that he loves his people. Really . As far as the goals are concerned, nothing has changed. Our objective remains. It denuclearization, that they have agreed to. We are engaged in patient diplomacy. But we will not let this drag out to no end. He is defending it well. I think the question is what happens if these negotiations dont result in what the administration wants . Lawmakers do not have much time because if they dont do it within the next few hours, they will have to wait until after the august recess, which begins this afternoon. The five articles of impeachment have accused Rod Rosenstein of intentionally withholding documents and information from congress on the russian investigation. Joining us now, opinion editor at the Washington Times and Fox News Contributor. Charlie, good morning to you. Any word on if this vote is going to take place today, first of all . It certainly seems increasingly unlikely that it will actually happen today. And then of course, even if it does happen, it is still a tall order for this to end up being successful. Of course, even if the house, even if it goes to the committee, and got through the republican control of the house, it would have to on its own require a majority vote. The senate would require a twothirds vote for it to be successful, and i dont think that is likely to happen. But, the point is it is an effort to sort of shine a light on this growing dispute between the house and the department of justice about their slow walking all of this information. Of course, when they do finally turn over documents, the complaint is that so much of it is redacted unnecessarily redacted in many cases, we are finding. That it has come to a real head. I think certainly, there hasnt been a lot of progress in the last couple of weeks. You saw him declined to get on board with the articles of impeachment. He feels like it is Getting Better. But there is a real constitutional issue here. And that is that congress is demanding documents from the department of justice, it shouldnt require the white house to get involved. It is answerable to congress. And as they should be forced to hand these documents over. It should be a pretty clearcut issue. One of the things that you heard diane finds say, dismissing this as a partisan fight. This is republicans in Congress Demanding a republican administration, a Republican Department of justice to hand over documentation. And for those of us who have been worried for the past couple of decades and to congress relinquishing more and more power to the executive branch, this is a wonderful development, and i do think it is interesting. It is republicans on both sides. It is not like republicans in the house going after eric holder and the previous administration. This is republicans in Congress Demanding that the department of justice hand over documentation, and insisting that in fact, the department of justice is answerable to the people. And that is a very positive development. Sandra when you hear them spearheading this effort, they are frustrated. And that is very clear. But Alan Dershowitz, looking at the politics of this, he says this is not a good idea for republicans to do this. Watch. It is the most shortsighted, and i have to say stupid thing i have heard in a long time. Here, you have a president , who the democrats are trying to impeach, when, if they gained the house of representatives, they will almost certainly do so. The big issue is can you impeach a president or anyone else when you dont charge him with specific crimes . Just because you disagree with what he has done. And now you have republicans making the case for the democrats who want to impeach the president. Sandra final thought to you, charlie. I do think that there is a case for things having been done wrong. Chief among them is the use of the socalled steel dossier for the pfizer warrant. That is a serious issue. It has to be explored. Yes, we have 7,000 remains that are missing. We think about 5,000 in north korea. And the reason it has taken some time is not to be challenges from slowing the process down. It is just going to the forensics. This is a battlefield. On the battlefield are americans, North Koreans, south koreans, and chinese. And what they have is bones to deal with. So it is a challenge for them, and it is going to be a challenge for us, but it is a step in the right direction. Sandra mike pompeo, im sure you watched every minute of that testimony, he had a big job to do. And his goals, when it comes to north korea. How did he do . I thought it was a subtle performance. I think he is one of the real stars of this administration. The relationship that he has, the respect that he enjoys. Clearly, they were gunning for him. What actually took place between putin and the present, to be sure, and he was not going to reveal that. Nor did they actually expect them to do that. But i really believe that when it comes to north korea, the administration has made adjustments. We have to have patience diplomacy. And i think that they likely have an expectation, and they could get the denuclearization thing done if north korea is truly committed to it. About two years before, at least at the end of this administration, before the next administration. Given the asian culture, given North Koreans pattern of behavior, it is just going to take longer to do. They move slower than we do, dealing with anything. Not just north korea, but other countries as well. The decision process will take time, and i think that is why it is kind of lowering the expectations. About this will take longer than what we thought. Without having to say that. Sandra it is interesting. You could tell that he took caution and care not to oversell what we have seen happen since that summer. But here we are, almost approaching august. Looking back at that summit, is it fair to say that that was a big success . I thought the summit was a success because it committed kim jong un in a public way to denuclearization. He signed a communique doing that. That had never happened before. They have said yes in meetings. Yes, we will not to produce Nuclear Weapons, and then they did it. Now he is on the world stage. I have always thought that there is Something Different happening with this young leader, going to be in power for 40 years. I think that he looks out the world a little bit differently than his father and grandfather did. I dont know if we will get to denuclearization, but we are in a process. Moving slowly, but in the right direction. Sandra they are beginning to dismantle this factory, do you believe them . Yes, i do believe them. I think if that was not happening, we would know that by now from the administration. So yeah, that is a step in the right direction. The other thing that was interesting, i heard the administration say it. He talked about weapons of mass destruction, not just Nuclear Weapons. We have always believed that they have chemical and biological weapons. He got questions on that. Does that include chemical and biological . They said absolutely.
