Man was shot by a africanamerican police officer. The officer thought he was carrying a gun, and his family says it was a book. Reporter Ahmad Kahn Rahami faces multiple charges in new jersey and new york including use of a weapon of destruction and using a bomb in a public space. The video shows rahami rolling what appears to be two bags an hour before the bomb went off. We learned rahami bought bombmaking materials on ebay as early as june. And i excerpt in the journal reading, god willing the sounds of the bombs will be heard in the streets, gunshots to police. The unexploded second Pressure Cooker bomb had fingerprints matching rahami. A video shows rahami laughing while igniting a incendiary device. Bill what about motivation . We are finding out more about this family. His wife is being held or detained after going to pakistan self weeks ago, while she was being detained, coming back from pakistan into the United States. His mother left reportedly before the bombings to turkey. He was born in afghanistan. The 28yearold made at least three trips to afghanistan and a trip to pakistan. Friends say rahamis demeanor changed after the trips. His father said he alerted the f. B. I. In 2013 saying his son turned violent hitting his mother and stabbing his brother. Reporter the f. B. I. Martha there is a report that donald trump used some of his money from his Charitable Foundation to pay for lawsuits which were determined they should be settled by him making donations to different entities. This was an investigation done by the Washington Post that found that the Trump Foundation made payments to charities to settle legal disputes levied against Donald Trumps forprofit businesses. The Washington Post pound the Trump Foundation made a 158,000 payment to a charity and a 100,000 to a military charity to settle fines against the mara lag oh estate for having a flag pole at the height of 80 feet which is double the local ordinance of 40 feet. He was penalized for that and the city settled and said if you write a check for 100,000 to a Veterans Charity which got that money from the foundation, then the lawsuit will go away. A Veterans Charity received 100,000 because of that. Im sure they benefited from it. Reporter the Trump Campaign denies any improper payments were made. Jason miller saying the post reporting is peppered with inaccuracies and admission s from the a biased reporter which is clearly intent on distracting attention away from the corrupt Clinton Foundation. They still have not explained why the payment were made by the Trump Foundation and not clinton. Martha how are the polls looking in North Carolina. Reporter remember this was supposed to be a state that Hillary Clinton was building as a fire wall because of the influx of people in the tech industry. Controversy of the gender bathroom law. State polls tend to track closely with national polls. But whats important is sometimes you can see the beginnings of national changes on the state level and in some cases states have to catch up. We dont get as much polling especially in states like north which i have been saying all along could be a good state for donald trump given its demographic composition. More trouble perhaps for the foundation when Hillary Clinton is really playing a lot of defense on this issue, right . Remember the big picture. Bill clinton was paid 26 million in speaking fees from 2001 to 2013 by groups who were major donors to the Clinton Foundation. This involves a former president getting 260,000 from the fragrance foundation. Then the Clinton Foundation put together to put together a deal for hundreds of farmers to plant lime trees, and the fray greens industry got a cut of the lime deal. Clinton pocketed 260,000 from the industry that got a share of the deal. Hillary clinton has been facing all these questions about that foundation. He was answering questions about how tangled all of these things are and why there is nothing wrong with it. Reporter the foundation is saying if Hillary Clinton is elected president , Hillary Clinton wont be raising money anymore. But notwithstanding that, bill clinton spoke to npr. When questioned about conflicts of interest he tried to pass the buck. When i have been doing this work for as long as we have, you know the people who are the major players. And some of them who call my staff, people were doing double duty. I had an office of the former president and it was natural for people who had been our political allies and friend to call and ask for things. I trusted the state department wouldnt do anything they shouldnt do from a meeting to a favor. Reporter he said in terms of phase going back and forth. Friend getting deals. They are getting ready there this morning. There was violence that erupted there last night. Protesters gathered over the shooting of a black man by police. We saw the family video we played a while ago that said he was carrying a gun. With regard to the officerinvolved shooting. I want to take a minute and acknowledge our Community Partners who are here and our City Council Members, our state officials, our county officials, i want to appreciate them. We are working very collaboratively and im so glad they are here with us this morning. This is a difficult situation for everyone involved. And the city expresses condolences to the family of mr. Scott. I also want to say we express our concerns for the officers who have been injured. There is a lot of information thats still to be sorted out. So im asking four community, im asking people here to please wait until all information is available. In charlotte we have a long history of working together to solve problems thought any and peacefully. And you have the commitment of your elected officials, you have the commitment of charlottemecklenburg, the police, our Business Leaders and Faith Community that this tradition will continue. We have a long history of transpair i and accountability which we remain committed to. We understand with these events everyone has different vow points and perspectives. That make it even for important to treat people with dignity and respect. Please keep in mind our top priority is for the safety of all the people who live here. This an Ongoing Investigation and we are still gathering information. At this time, i would like to turn it over to the chief of police, chief putney who will share more details about this investigation as it stands right now. Thank you, mayor. Morning. This is a difficult time. So im trying to be respectful of all parties involved. Im not going to jeopardize the integrity of the investigation. But i will tell you the facts as we know them today. Those facts are based on witness statements and evidence we found at the scene. Yesterday september 20 at 4 00, we had officers from our Metro Division Crime Reduction unit searching for a suspect who was wanted for outstanding warrants. This occurred at the Village College downs apartments. Our officers observed a subject, mr. Keith lamont scott inside a vehicle at the apartment complex. He exited the vehicle armed with a handgun. The officers observed him get back into that vehicle at which time they approached the vehicle to engage the subject. The officers gave loud, clear verbal commands which were also heard by many of the witnesses. They were instructing the subject once again to get out of the vehicle and drop the weapon. In spite of the verbal command mr. Scott exited his vehicle armed with a handgun as the officers continued to yell at him to drop it. He stepped out, posing a threat to the officers and officer brently vincent subsequently fired his weapon striking the subject. The officers immediately requested medic and began performing cpr. Medical transported the subject from the scene to the hospital where he later succumbed to his injuries. Our investigators recovered the firearm the subject was holding in his hand when he got out of the vehicle it was in close proximity to the subject. As for our department of protocol. Officer vincent is being placed on administrative leave as we investigate this. There is a criminal track and parallel internal investigative track to make sure none of our policies were violated along with none of our laws in the state of North Carolina being violated as part of the investigation. Yesterday evening at 7 00 p. M. The officers encountered protesters who were coming to protest the officerinvolved shooting. About an hour later, they saw we saw the crowd transition from protesters, demonstrators, which is legal, to more aggressive agitators who began to break the law. We had our helicopter to give us eyes from the sky to help us see exactly what was transpiring down on the ground. At about 9 00 p. M. , we had a lot of thage state 8ors begin to Damage Police vehicles and throw rocks, strike our officers. At about 10 54 p. M. I called for our civil knowledge unit to come in to try to deescalate the situation and disperse the rowdy crowd. Later on in the evening, early this morning, about farther to 2 00 this morning, an Additional Group protesters and agitators gathered. They made their way down to interstate i85 and they blocked both lanes north bounds and south bound. They broke into the back of a tractortrailer and started setting items on fire. We gave multiple orders for dispersal to the crowd. When they were unheeded we deployed gas to disperse the crowd. Despite our constant direction the demonstrators pushed through the police line. We did manage to arrest one person so far. But as i said, this investigation is ongoing. As of right now, we have 16 officers who have been injured. We have multiple Police Vehicles that have been damaged. And our officers acting heroically were trying to deescalate the situation as peace any as possible. As always, our officers try to facilitate demonstrations and protests. They protect the rights of our citizenry. But when that behavior becomes violent, aggressive, and destructive, we have to act as we did. And now we have a challenge here in charlotte. People are watching how we respond. How we react. And im optimistic that the results of our action will be positive. Will have positive outcomes. But its time for the voiceless majority to stand up and be heard. Its time to change the narrative. Because i can tell you from the facts that the story is a little bit different as to how its been portrayed so far, especially through social media. So charlotte, the challenge is ours. I think the future can be bright, but the work has to be done by all of us. Thank you. Good morning. We encourage our citizens to Exchange Personal Stories and perspectives to foster healing and growth. As our community continues to respond to this most recent incident. We suggest bringing together houses of faith, community organizations, and organizers. Millennials, local police and many others to insure that we are engage in productive dialogue. We must all continue work we started to make charlotte a community thats honors us all with respect, dignity, and appreciation. In the past as the mayor indicated. We have always found ways to work peace any through our differences and we believe well continue our legacy of solving our problems together its how we do things here in charlottemecklenburg. I have spoken with Many Community and state leaders already. And we are calling for peace, we are calling for calm, we are calling for dialogue. I have also been in touch with the white house. The governor and i spoke this morning. I have been in touch with our state leaders, county leaders, school boards, other local leaders and i want to thank all of them for being part of the collaboration that would help our community move forward in a peaceful manner. Im confident in charlottes Strong Police and Community Relations. There are so many good noak this community who have been work so hard to keep that dialogue productive and keep that dialogue open. Well continue toll support that process. I want to emphasize also well continue to be thorough and transparent in releasing Accurate Information as soon as it is available. We want to dispel any misinformation that may be circulating. Again, we are a collaborative community. We are a community that knows that we rise or fall together. As part of the criminal investigation, we are still going through all of the footage from both body worn and dash. Until if the investigation is complete its part of the investigation and cant can released at this point. I have not seen all of the video. I have seen some of the video. There are a lot of officers who respond, and we havent had the opportunity to get through all of that video at this point. [inaudible] is there something you can provide today that might ease that concern Going Forward. I wish there were an opportunity to show property sheets to show exactly. I can tell you a weapon was seized. A handgun. I can also tell you we did not find a book that has been made reference to. I can just tell you what i know based on what we goo they are through the scientific process of going through the evidence. We did finds a weapon, and the weapon was there and the witnessed corroborated it beyond just the officers. [inaudible] as i said its part of the investigative process. You know the law as well as i do. Right now we cant release it. It would have a negative impact on the integrity of the case and thats something we are not going to do. [inaudible] i cant speak to the discipline because of personnel laws. He came on in 2014. He was plainclothes with a vest carrier that we wear that has the big logo of police and cpd on the front and back. We had four officers there in full uniform when we engaged the subject at the scene. [inaudible] the law is pretty specific, especially around evidence for an investigation. And i cannot release that. And your other part of your question was, okay question, sir. The transparency comes in with our current legislation. When an aggrieved party believes they have an aggrieved they can have access. But during an investigation that supercedes Everything Else in that investigation. Was the officer himself wearing a body camera . No, officer vincent was note wearing a body camera as i recall. Just uniform officers who were there for the takedown were. Yes, sir. [inaudible] the videos i reviewed, i cannot see in totality everything that occurred. I do not know exactly the time frame, by the was a matter of seconds it was in pretty quick succession. That it all unfolded. [inaudible] i absolutely do. We are following every lead we have. Our intent is to bring everybody to justice who violated the law, yes, sir. My plans are to have our people ready, we are. My plans are to be staffed appropriately, well be. Hopefully well have peaceful protests and do things the charlotte way. He did have a weapon when he exit the vehicle. Im not aware of whether it was loaded. This is early in the investigation. And i get briefed every day. I havent had an indepth briefing yet. Yes, sir, he did. No, sir. They saw the what he point second time he exited the vehicle. [inaudible] that i do not know definitively. Thats part of the statements that we still have yet to get. But at this point i dont know he definitively pointed the weapon specifically toward an officer. Yes, sir. [inaudible] would an officer be justified to fire even if the gun was not pointed very good question. The totality of the situation is what carries the day. If im making gestures or turning my body in a certain way to look aggressive and give you the understanding an imminent threat is very, very likely and im armed, all of those things in conjunction with one another can still give you that perceived threat under North Carolina law. [inaudible] im happy hes okay its a tragic event. My heart goes out to the scott family for the loss. [inaudible] i do not, sir. Those are details we are yet to uncover. This is a very first day that we are really getting to delve into a lot of those issues and we dont have all the facts as this point. [inaudible] absolutely. And i also want to thank many members of the i council who are here with me, including mayor protem, our City Council Members in the district, and in their areas are reaching out to their faith leaders. I spoke to several ministers this morning. I have spoken to the naacp leadership. And we want their assistance and want their help as we continue to have dialogue. Again, i think the local community, the Charlotte Community, has a mechanism in place for that constructive dialogue. We all see this as a tragedy. We all want to work toward a Peaceful Community. We know we have work to do. And our concern is that some of that and takes may come from folks who arent living in charlotte. And we want to again call on our local leaders to make sure our local community has that message, that we want to resolve this peacefully and Work Together. We see a better outcome, and we have confidence in the good folks here in charlotte who care about that positive outcome. [inaudible] those are all in process. We heard from a lot of groups planning something. They cant determined where or when. They will be in contact with their constituents trying to help us get correct information out and continue a dialogue we know is absolutely needed. [inaudible] where are the officers today id told them to be vigilant. Be professional. And do the job they have been trained to do and they are committed to doing. I told them, uphold their oath. [inaudible] the extent that the officers the extent of injuries vary, but they are all minor enough they will be released. Thats about as detailed than i can tell you. One was much more severe than the rest of them though. How many officers were out there . I do not have those numbers yet. We were pulling from a lot of different regions. But well have to review our cad and see if we can get that number nailed down for you. [inaudible] we have enhanced our staffing, and thats about as detailed as i want to be around those strategic decisions. [inaudible] strategically well be prepared for what we see. Conversations are ongoing tore any and all resources we might need to bring to bear. But we are hoping for the best and preparing for the worst. Thats the best answer i can give you. [inaudible] did anyone talk [inaudible] is a mentioned earlier, i have been in touch with the white house. There are people across the country watching whats going on, and it is early in our information gathering. We are not ruling anything out in terms of resources we may need. But at this point, its too early to give a definitive about the department of justice, about involvement of other resources. But we are going to gather facts. And be as transparent and thorough as we are in charlotte and as we have been in the past and well continue that conversation. Thank you all have much. Bill 2minute press conference. Scott was told to drop his weapon and thanked did not happen. Protesters came in the streets at 7 00. They went deep into the night. 16 Police Officers injured. Well see what happens later tonight when it gets dark. But as the chief said, quote we have a challenge end quote. Martha attorney general Loretta Lynch also spoke on this. 0 innocent people were injured. I have full confidence in the u. S. Attorneys office in the Southern District of new york led will succeed in bringing the defendant to justice. I also snow the u. S. Attorneys office in the district of new jersey will also hold this defendant accountable for his deplorable actions in that district as well. These filings reflect the justice departments unwavering determination to finding, capturing and prosecuting all of those who commit or attempt to commit acts of terror against our nation. I want to take a moment and thank my colleagues in the National Security division of the department of justice. The u. S. Attorneys offices, the f. B. I. , atf and other parts of the department for their tireless efforts the past selfdays. But athlete me also commend our local Law Enforcement partners and First Responders for their vital contributions to this Ongoing Investigation. And let me applaud the citizens who played such a crucial role by alerting Law Enforcement when they discovered unexploded bombs. And let me offer my prayers for the swift and full recovery for all the Law Enforcement officers and officers who were harmed by the defendants actions. The chief of police said scott was armed with a gun. There is a lot to watch in charlotte. A rough, rough night on the streets there, and many officers still recovering from their injuries as we were just told. Hour two of americas newsroom. Bill at least a dozen officers injured. A demonstration turning violent. Riot police launching tear gas as that crowd got out of control by broking through a police line. They looted stores, they went after officers. The chief of police talked about the incidents that first set off the violence. Mr. Scott exit his vehicle armed with a handgun as the officers continued to yell at him to drop it. He stepped out, posing a threat to the officers and officer brently vincent subsequently fired his weapon striking the subject. Martha the chief said there were several witnesses who can speak to it. Jonathan serrie is live in North Carolina for us today. Whats read action to this . This whole community is in shock. There are also calls for calm and dialogue to replace the violence that oh curbed here overnight. Take a look at this walmart where they barricaded the entrances and exits. In other parts of Charlotte Police used tear gas to disperse the crowds. At one point demonstrators went on interstate 85 and could be seen looting the backs of trailers on trucks. Reporter as you heard on that earlier sound bite, they released the name of the officer involved in the shooting. Officer Brentley Vincent who is africanamerican as was the man who was shot apparently by this officer. The officer has been placed on administrative leave which is standard for this type of officersinvolved shooting. Police were searching for a suspect with outstanding warrants, and thats where they spotted 43yearold keith lamont scott. Mr. Scott was not suspect they were looking for. The cops say he ignored their instructions, he was armed. During the Police Response to the protests, we have scanner traffic where you can hear the intensity of what was going on. Take a listen. We are outnumbered. Everybody listen up. We are going to give a dispersement order. We have about 100 people coming up. Get a squad here asap. Reporter you can hear a long and intense evening for charlottemecklenburg police. The mayor is calling on the community for calm. Federal charges have been filed against the man accused of planting bombs in new york city and new jersey. Catherine herridge picks up the story from there. What are the feds saying about his alleged motivation so far . The Court Documents show evidence of significant premeditation. He was buying bomb parts on ebay as early as june and two days before the attack there is cell phone video of what appears to be a trial run. The f. B. I. We are learning when a handwritten journal with writings about leading al qaeda figures who laid the ground work for homegrown terrorism. He talked about the teaching of Anwar Alawlaki. New reporting from the post claiming donald trump used hundreds of thousands of dollars from his personal Charity Foundation to settle lawsuits that came in against his businesses. The post says that donald trump may have violated laws that ban nonprofit leaders from using Charity Money to benefit themselves or businesses. Here is how kemy conway responded to that. You will notice the journalist says may have or the authorities may look into it. This a lot of conditional language there. In the one case, mr. Trump was being find on a daily basis by either the county or city of palm beach, florida because he dired want to raise the American Flag at about 80 feet, way past what the limit was. So he was penalized for that and the city settled and said if you write a check for 100,000 to a Veterans Charity which got that money from the foundation, then the lawsuit will go away. Martha what do you make of all this, steve . I think kellyanne didnt answer the question directly and the Trump Campaign has had a difficult time trying to push back on the reporting more broadly about the Trump Foundation in general. But on this specific case you had a lot of sound and fury from the Trump Campaign asserting this Washington Post reporter made errors, there were omissions. But they havent been able toll cite a specific single example. That includes Kellyanne Conway and mike pence. His reporting over the course of this campaign has been solid. Martha it seemed in my reading of it, the decision was to do a settlement in these issues. One of them had to do with a guy who hit a hole in one, and it wasnt close enough. So they said well do a donation. The donation to a Charitable Organization came from the foundation. It seems like that doesnt line up. The i. R. S. Doesnt allow something called selfdeal where you use as you explain, use Foundation Money to settle business or personal debt. Martha is it still a business debt when the settlement is its going to take a different form its going to be a charitable donation. Its not. In this case add cord together post reporting trump himself hadnt been funding the campaign from 2009 on. I admire the judge greatly but ive been a military lawyer for 33 years, and there is no constitutional right for an american citizen to join enemy forces and commit war against your own nation. That is not what i think. There are two cases right on point. Curran is a 1942 decision where an american citizen joined the nazi forces who landed on long island. They were saboteurs helped by american citizen. That american citizen was captured and tried by military commission and sentenced by our military. Supreme court said if you join enemy forces then you can be treated as an enemy combatant. In tour hamdi versus rumsfeld captured american citizen in afghanistan working with the taliban. Here is what the court said in 2004. Bear with me a second. If the citizen decides to associate himself with enemy engaged in Armed Conflict with the United States, there is no bar holding them as enemy combattant. Ive been doing this 3years. To any american citizen out there, if youre thinking of joining al qaeda, isil, any radical Islamic Group to commit jihad, you can be killed on the battlefield, like anwar alaki, and if youre captured you can be held as enemy combatant this administration wont do that because this administration is fighting a crime. We should be fighting a war. Martha i understood what you said. It makes me happy. It was complicated. Makes me happy. Martha but it seems to me that the link that youre making that perhaps the judge did not make is that he is part of this foreign enemy force . You have to be. Martha how do you prove that the . Number one, here is the way it works. If there is evidence to suggest that the person in he question may be an enemy combatant you can hold them for 30 days. After 30day period, you have to take them to federal judge and prove by preponderance of the evidence, more likely than than not, the person qualifies under very narrow statute of enemy combatant. It is on the books. I wrote the law. To become an enemy combatant is a very narrow definition. A government has to prove to the federal judge youre an enemy combatant. If youre an enemy combatant they can hold you indefinitely, gather intelligence and keep you off the battlefield and find out what you know about the next potential attack that is the law of war and fighting a crime. Martha very compelling and it is the law. Martha it is the law. Nobody thinks that is what is going to happen in this case. It aint going to happen. This is the weakest, most ineffective administration it fighting radical islam. Donald trump is right. Hard to fight something if you dont define what it is. These people are turning a war into a crime and another 9 11 is coming because of that incompetence. Martha i hope youre wrong about that. I do too. Martha i want to ask about this saudi arabia vote where both houses these people who had been wronged, families robbed of their loved ones they believe saudi arabia should have the right to sue the country. He endorsed ted cruz. But the next day when he made the endorsement, i thought it was more of an endorsement for me because he started talking about how great donald trump is. Then he said im voting for ted cruz. Get back to donald trump. The guy is unbelievable. Ted cruz didnt know whether or not he was endorsed. I thought it was one of the great i liked him regardless, i liked him a lot but he said something after that first fifteen or 20 minutes after i left and donald, may we pray .
