11 degrees in ms. Sue law. Much more coming up. First this was a hot vote, years in the making. Senate democrats blocking the construction of the Keystone Pipeline by a single vote late last night. Yeas are 59, nays are 41. 60 vote threshold having not been achieved. The bill is not passed. Republicans say they are not however done yet. Good morning. Im bill hemmer in americas newsroom. Martha good morning. Bill did you know it was cold outside . Martha pretty cold in buffalo. Those folks are really suffering. Im martha maccallum. More coming up in a moment. Meantime back to the pipeline story. Huge story last night. It would have transported oil from canada down to the gulf of mexico. Republicans supported that project, they have for years across the board. They thought it would create thousands of jobs. Democrats called it a environmental disaster. The president has been on that page as well. The vote deliver ad huge blow, potentially devastating blow to senator mary landrieu. For jobs, for economic opportunity, for independence, for energy independence, this fight was worth having. Keystone xl is just common sense. It is a shovelready jobs project that would help thousands of americans find work. Bill Leland Vittert live from the white house. Leland what is next . Good morning there . Reporter good morning, bill. So far nothing from the white house on this but president obama can put away his veto pen at least for right now and breathe a sigh of relief. Keystone is very popular with the United States a veto could have been a political problem for him. Vast majority of americans really had a the lot of stake in this, bill. The democrats on the senate floor had been able to keep keystone xl away from any kind of vote. Brought it up very quickly after the midterm elections, either by harry reids design or simply by political luck. The white house was able to get out of this one by just one vote when it failed. Republicans pounced saying it was proof that it was simply politics behind this vote as it came to trying to save Mary Landrieus seat from louisiana. This was a political show vote, i think everybody gets that. Certainly everybody back home does. But for mary to talk about her clout on the campaign trail and that not even be able to get the votes she needed in a political show vote when it was all about her political survival, that is quite frankly pretty stunning. Reporter now landrieu face as very tough Runoff Election here early next month down in louisiana against bill cassidy. The current pole numbers show her not faring very well. Obviously not being able to bring home the bacon from the senate floor, in this case bring home the pipeline to energyrich louisiana will not exactly help much, bill. Bill what about the pipeline itself . Will it have a second life in a Republicancontrolled Senate . Reporter republicans say it will definitely have a second life and they want to pass it. Of course the big question will the republicans be able to, they had 14 democrats flip. That is how they got to the 59 number last night. Whether they will be able to keep enough of those democrats on the side of yes in order to get this passed and bring it to the president s desk, we have to see, but it brings up an increasingly significant political point here in washington and that is for years the democratically controlled senate protected president obama from that pickle of either having to sign a bill he didnt like or veto one that is popular. Come january, he will not have that protection anymore. Bill leland, thank you. Leading our coverage there from the north lawn. Leland vittert there. Martha. Martha you were talking about this. What is next for this bill . One of its cosponsors well weigh in on that. Republican senator from north dakota john hoeven will weigh in later in the show. Bill we have a question for you at home. Will keystone ever be built . What do you think . Yes or nor no. Vetoproof. Send us an email to billhemmer or marthamaccallum. Martha some people think the whole exercise was a joke really. The president was going to veto it anyway. Mary landrieu would hope it would make a difference for her in louisiana. A lot of people look at the whole thing, go, what was the point, right . Bill 14 democrats voting in favor. Will be a mix of numbers come january but you might be at 67 veto proof. Well watch in the new year. Martha yeah. To this story now. Israeli Prime MinisterBenjamin Netanyahu promising a harsh response to yesterdays brutal synagogue attack in jerusalem. Two palestinians attacked worshipers, four rabbis in that synagogue and they did it in a brutal way with meat cleavers and a gun. Five people in the end lost their lives including three americans. Netanyahu is ordering Security Forces to demolish homes of those attackers. Israeli ambassador to the United States says netanyahu will take all necessary steps. I think that the Prime Minister will do what he has to do to restore security in our nations capitol. This is a savage murder in a synagogue in our capital. People went in with meat cleavers and guns into a church in washington, d. C. And started hacking people to death and then you saw people dancing in the streets. What type of action would america take . So the Prime Minister is going to do what he has to do to protect israels citizens. Martha good point. Conor powell live in jerusalem with more on this. Conor, when do we expect this to happen, the homes of these attackers will be held . Reporter netanyahu ordered them to be destroyed yesterday, those two palestinian cousins. Their homes are supposed to be destroyed immediately. Not clear when it will actually happen. It actually hasnt happened just yet. Last night israeli troops destroyed the home after palestinian man responsible for killing a woman and child waiting a train stop a month or so ago. This is the first in a string of these violent individual attacks that weve seen around jerusalem for the last month or so. Really fueled these attacks by the dispute over who is allowed to pray at jerusalems holiest spot. This is controversial punishment to destroy these homes. Has not been used by israel in decade or some there are Security Officials here who are against it. They say it is not effective policy or deterrent against terror attacks but Prime Minister netanyahu and other leaders say this is the best solution right now, martha, for he will dealing with these attacks. Martha boy, what are israeli officials doing to prevent future attacks . There is a concern this could lead to a third inif i todd dow . Reporter weve seen stepped up security across jerusalem. More police are on the streets. There are also checkpoints in a lot of palestinian East Jerusalem areas. Israeli officials also arrested dozens of arabisraelis here in israel in the last few weeks or so . Police told fox news here in jerusalem the bigger issue that these attacks to be individually planned. There isnt some grand campaign that is linking them all together. So theyre really difficult to prevent and even harder to sort of deal with it after the fact. Now Prime Minister netanyahu blamed palestinian of the Mahmoud Abbas for inciting the violence but Security Officials here actually defended abbas. Some said he is helping to prevent some of the violence. A real mixed controversy here because the political leaders here in israel very much want to sort of group all the palestinians together but there are israeli firms who work with the Palestinian AuthoritySecurity Officials who have a decent relationship and are trying to prevent some of these attacks. It is reallys nobodys benefits to see more attacks here, martha. Martha conor, no it is not. Thank you very much. Bill back in this country, allegations of temper tantrums and uncaring march to the bosss goal. That is what led to barack obama rollout last year. That is led to email from woman in charge, marilyn tavenner. She demanded the website up and running on time, no matter what. Katie pavlich, foxnews. Com and and town hall. Com and fox news contributor. Good morning. Bill she is number two from centers for medicare and medicaid. She is now retired. What bus the email tell us . Essentially the email was written from Michelle Snyder you mentioned number two at cms for obamacare rollout. She wrote it to todd park, he will be testifying at a hearing today on capitol hill as lawmakers still a year after the first rollout have questions about security. But in terms of the email, Michelle Snyder wrote to todd park, her boss, miss tavenner, in charge of cms at the time basically would move forward with the obamacare launch just multiple requests for delay because the personal information of americans who would possibly be using the obamacare website to sign up for health care would be exposed to hackers and unsecured. Not to mention the website wasnt ready in terms of technology side. It wasnt going to be able to handle all the visitors coming tothe site. Bill they want to know at the hearing whether or not the white house knew of the risk, correct . Right. Bill the risk was to whom . Risk was to the American People. So were talking about multiple agencies that were hired to take a look at the security of this website before it was launched, the obamacare website. Oversight committee in the house also taken a look at this. They came to the conclusion the obamacare website was susceptible to hacking, identity threat and fraud for people going to put in Social Security numbers in personal Health Care Information in order to sign up for the plans. Now that were in second Enrollment Period which happened and started last weekend, lawmakers want to know and make sure the white house is not necessarily launching a second Enrollment Period without making sure loopholes for identity threat and fraud are closed. Bill Katie Pavlich set table on that for us. 11 minutes past the hour. So much news yesterday from the hill leading up to keystone. Well see what happens today as we get underway. Martha new calls for a congressional investigation into obamacares architect, Jonathan Gruber. Bill oreilly says he believes the American Public was clearly duped. Talking points applauds dr. Gruber for telling the truth apart from the stupid stuff. But i also believe he was a active participant in a big con. Martha so does all of this destroy any credibility that the white house has on the Health Care Law . Well talk to karl rove about that coming up earnings also six feet of snow in midnovember. It all came down in just a couple of hours. 100 miles of interstate shut down. People trapped in their cars. City of buffalo gets a beatdown by a massive blizzard and it aint over. Were live with details on the ground in up state new york. Martha president obama could change the social landscape of america with a swipe of his pen but will unilateral action on immigration be legal . Im the president of the United States. Im not emperor of the United States. My job is to execute laws that are passed. Martha we are back. So this morning the acting director of the secret service will testify in front of house judiciary committee. The hearing comes after a string of awful security breaches, one of which you see on the screen now, including that incident when a man jumped white house fence. He got all the way inside of the mansion to the east room, got by one agent. Was eventually tackled by somebody who was not even on duty in that room at the time. It was a mess. Clancy is this gentlemans name. He was tapped to lead the agency after the former director Julia Pierson stepped down last month. Well see what he says at 10 00 a. M. This morning. Bill meantime he is become the face of deception and arrogance for millions of Americans Associated with the passage of obamacare. Now Jonathan Gruber may find himself on capitol hill explaining to lawmakers when he meant when he talked about the stupidity of the american voter. Here is jim jordan, congressman from ohio on that. He need to sit in front of a Congressional Committee and answer the tough questions. Mr. Rattner says he was the man. American people know he was the man. He lied to the American People, using their tax dollars to do so. Of course he need to answer our questions. At the appropriate time we should bring him in. Bill karl rove, former deputy chief of staff and Senior Advisor to president george w. Bush and in studio and fox news contributor. Karl was talking to jordan was talking to sean last night on hannity. How does this change the debate on obamacare. Throws a lot of gasoline on the fire already burning there. Well see a lot more flame smoke and conflagration. If gruber is called to testify before Congress Bill do you think he will be . Absolutely i think he will be. Look, the focus will probably not be on how stupid the American People are, i think it will be more substantive set of inquiries and difficult as such for the administration. Bill give me a question question. The key focal point will be the Administration Made a series of claims to sell the bill that turned out not to be true. Did the administration know at the time when the president said if you like your plan you can keep your plan that was not true . And it wasnt. The Affordable Care act was based on premise that much of the insurance American People have is insufficient and inadequate and would have be dough declared noncompliant under aca and people would lose their coverage. Bill do you do you allege gruber knew that when helping them to draft the bill . My view, yes. Him in front of the cameras, when the president said that did everybody know that was not true . When the president said and administration you can like your doc and keep your doc, when administration said we will not tax anybody making less than 250,000, when the administration said it will not add dime to deficit. This is weird accounting manuever. They take 500 million in cuts out of medicare, which is going broke and losing viability to save medicare . The director of office at hhs, acutarial office said you cant do that but cbo was put in a place where they had to score it and they were deliberately sort of put in that place by jimmying the ruse. Bill couple quick questions, could you say, hey, this is executive privilege . Im advising the white house and president indirectly . Well have, in my opinion the white house is likely to make a claim of executive privilege, at least with regarding what he said in the oval office during that meeting where we know he and several other economists were summoned to the white house. They may make an executive privilege claim about anything that gruber told somebody in the white house saying this was ultimately meant to advise the president. He was meeting with an agent of the president. Therefore he cant testify. Bill that would protect him then, to a degree. First of all it would make people think they had something that they were trying to hide and would make the problem worse. Bill two more questions. Where are you on this debate as to whether or not republicans should allow the obamacare thing, to float out there for a while and wait on the u. S. Supreme court to issue its next ruling, probably next year . I think republicans are unlikely to do that, in part because they want to demonstrate theyre doing things. Second of all, they have a lot of support for doing certain things from democrats. For example, my suspicion is that as you know the Affordable Care act declares that a fulltime worker, somebody works 30 hours or more. This is causing a lot of parttiming america. People who work in restaurant or hospitality industry, 35, 36, 37 hours in tips. Theyre getting 29 hours in tips rather than getting larger number of hours. There is measure sponsored by Susan Collins of maine would raise the definition to be a full work week is 40 hours. That is probably going to pass with a huge number of democrat votes. There are series of other measures like that likely to measure some democratic support. Bill in 20 seconds is this end of surprises first of all . No. There are more, there are more surprises insiders know about like look, when the employer mandate comes into play, well see a lot of medium and small employers drop the coverage because theyre putting out 10 or 11,000 a year in premium support between them and their employee and they can skate and pay 2,000 a person penalty. So when employer mandate comes into full force, that is why the president delayed it so it wouldnt come into force during the 2014 election. There are plenty of surprises on that. Bill more to come. Thank you, karl rove here in new york. You bet. Bill martha . Martha three americans were brutally murdered in a bloody terror attack. President obama strongly condemning this act but was his response enough . Ralph peters coming up on that. Plus take a look at this. Six feet of snow, people six feet in november. The biggest oneday total in u. S. History. And it is not over yet. All i had the equipment. We saw the tractor with the plow, with the push thing and which was handy and snow blower when it works and a son when he is not complaining. Just too much shoveling. I would [ narrator ] mama sherman and the legion of super fans. Wow [ narrator ] on a mission to get richard to his campbells chunky soup. Its new chunky beerncheese with beef and bacon soup. I love it. And mama loves you. Bill lawyers for comedian tracy morgan say he is fighting to recover from a severe brain injury. In a Court Hearing morgans lawyers say it is uncertain if the former saturday night live actor will be the same after being hurt in serious accident. The driver of a walmart truck had been awake for 24 hours when he slammed in the back of morgans limo. That was in june. One of morgans friends was killed in that accident. Morgan is suing walmart for damages. Martha well this is simply a gigantic snowstorm that is happened. It is now being blamed for at least seven deaths across new york, New Hampshire and michigan. The system burying parts of buffalo under more than six feet of snow, historic levels of snow, in just over 24 hours. Record snowfall for that part of the country. And this thing is not over yet. Chief correspondent Jonathan Hunt live on the chilly streets of new york city. Jonathan, a lot more to come of this stuff . Yeah, martha, at least another 36 hours of snow according to the forecasters. So it is still very, very dangerous, particularly up state new york around the buffalo area. We just got details of another death. A 46yearold male apparently buried under some 12 to 15 feet of snow. This is an extraordinary storm as you can see from the pictures. 132 miles of the state throughway shut down. 150 vehicles at least stranded. Rescuers say they havent yet got to them now. I90 shut down from the buffalo to the pennsylvania border. More trouble on the way. Listen here. National Weather Service is predicting another two to three feet of snow in those areas. That will get them to 90, 100 inches of snow. Thats a years worth of snow in four days, three days. After thursday, it alleviates. It will improve after tomorrow night, martha, but then the problem is, temperatures forecast to go up to the mid 40s, even the 50s in the buffalo region. You have at least seven feet of snow sitting there. In those temperatures, the next problem, flooding. Martha . Martha oh, my gosh, awful for then. Really scary stories of people getting stuck in this snow. You talk about a 46yearold man. Reporter that 46yearold man, a confirmed death just a couple of minutes ago at a News Conference, buried as i say under 12 to 15 feet of snow but a lot of people are stuck, and thankfully rescued. Among them Niagra UniversityWomens Basketball team. They were on their way back from pittsburgh last night. They got stuck at 2 00 a. M. They were stuck there until 2 00 a. M. This morning. After 2 00 a. M. , some 26 hours or so on the bus. They all tweeted about it. They did thankfully get rescued. Similar stories youby people rescued by very brave firstresponders in those conditions. As you can hear from these guys, theyre pretty tough up around the buffalo area. Listen here. The roads are really slippery. I just spun out twice. I came from the city and it wasnt so bad downtown but as i got farther and farther out here, it got worse. A lot worse. How do you feel that winter is here 34 days before it is supposed to come . I dont know. Just roll with it. Thats life. Reporter martha, i heard you say to bill at the very top of the show, quote, it is not too bad here. So my question to you is, you want to come out and join me . Martha no problem, no problem, jonathan. Reporter sure. See you in a minute. Martha it is not that bad here. It is really bad up there. I stick with my story, jonathan, thank you very much. Bill save us a spare scarf out there. Not just buffalo. Look at temperatures on the map. Singledigit temperatures with windchills right around zero for so many millions of people. It is midnovember. No one quite expects this one. Martha jonathan is right. Once it starts melting it will be another problem for these folks. Hang in there everybody, up state new york. One of my favorite places. Bill martha is on her way up. Martha i love snow but too early. Bill the president expected to take executive action on immigration maybe by end of this week. There is a rumor out there, which could be a 180 from a year ago when president obama said he had to wait for congress to act on the broken immigration system. So then, 12 months later whats changed . Martha that is really good question. Well take a look at that, plus a year, a day, 13 years in the making, daughter of a brave firefighter who was killed on 9 11. This is a heartwarming story. She followed in her dads footsteps after he died in 9 11. She is now in the firefighting force as well. That story coming up. She has made him very proud. She has made him proud. She made us proud. She talked about making arrangements for her husband to fight for isis in syria. She then offered according to the investigation to help an undercover agent get a friend into syria to try to join that group. Details on that. Martha president obama gearing up to go it alone essentially on immigration. He is expected to take executive action and you expected to do so by the end of this week. This would be a complete 108 when he said a year ago when he said it was not in his power to change the law in this way. This is something i struggled with throughout my press den sift the problem is, im the president of the United States. Im not the the emperor of the United States. My job is to execute laws that are passed and congress right now has not changed what i consider to be a broken immigration system. Martha reporters asking press secretary josh earnest about that apparent change of tone in the News Conference yesterday, listen to this. Does the president still stand by what he said last year, when he said, quote, im not the emperor of the United States, my job is to execute laws that are passed . Is that still operative. Absolutely. Of the since this interview aired the president did direct the attorney general and of Homeland Security to conduct review of law to determine what authority he could do to try to fix the problems that House Republicans refused to address. Martha reason for josh ernest saying some things have changed since all of that. Alan colmes, joins me. Host of alan colmes show. Fox news contributor. Brad blakeman, former assistant deputy to president george w. Bush. Good to have you both here. Alan, do you agree with the president taking this authority, to use really, theyre using prosecutorial discretion is the way that theyre getting around. I wish he would have done it before the election actually. Would have probably helped democrats and fact he didnt now waited and there is new congress coming in, a particularly new Republican Senate i think i would like to see him give them a chance to see what they come up with. Even though theyre threatening Government Shutdown and impeachment not playing ball with him, let him you know, extend an olive branch to see if you come up with a bill he can live with. Martha interesting you say that alan. We talked about this, it puts a lie to any idea that the president wanted to work with the republicans as he said after the election. He said he got a message. That he knew it was time to work with republicans but this makes quite obvious. If he wanted to do this he would clearly wait until after january to say, threat lets start. They threatened Government Shutdown and impeachment. Martha is that what theyre doing . I would like to see him extend olive brand. There is no talk of impeachment, alan. Really . In any credible form by any credible person. But the president needs to understand in his own words that elections have consequences. The elections were a clear rebuke of this president not only in substance but in style. If the president really wanted to act in food faith, he would wait until january. He would get parties together and would work out an immigration bill. Not an omnibus bill like the disaster that is obamacare. No more 3,000 page bills. Carve it up to the relevant committees. Let the senate have hearings now theyre in the majority and house is well and tackle the problem in each committee, whether it is taxation, whether it is visas, whether it is pathway to citizenship. This should be done methodically and should be done in incremental bills. Martha this is classic case, i think, when you look at details in what the president is expected to propose at least, there is a lot of Common Ground in here. Deporting criminals first. Deporting repeat offenders first. Starting to find some way to, help some of these family members stay here. There is a lot of stuff in here that i think people could find some agreement on, alan. So the president has sort of blasted that open, if he does this executive action. You know republicans may be blasting it open, some of them as well threatening things that youre suggesting, alan. Brad and i are not really disagreeing here. I would love for him to work this congress and extend olive branch. May look at other emperors bush 41 and reagan gave amnesty. Without explosion on the other side, last two or three republican president s did it. Lets let them work with congress. When they shut him down i think they probably do he would have better excuse to use executive power. Alan makes a point, previous president , reagan and bush employed similar tactics to give people what many consider to be amnesty, brad . It is not the proper time to pick up his pen when you have had a National Election that totally was a vindication of the republicans in this case and rebuke of the democrats. There is a new sheriff in town. Mitch mcconnell is majority leader. He deserves the respect of coequal branch of government to have at a comprehensive immigration bill. Both side agree we need it. Martha brad, point right back at your side, john boehner could have done something about this. There was a bill that could have been forced to kind of find some Common Ground as i talked to you about and they didnt do it. They didnt do it because harry reid has 300 bills still operate e waiting on his desk. It was dead on arrival in the senate. There was exercise of futility. The president said he wouldnt sign it. So, look, it takes three now to tango in washington. Take as house, senate and president. If they all act in good faith and goodwill there is likely there will be some Common Ground. Martha had a very good point. Over a couple of years the republicans did have a chance to present a bill both parties could have lived with. They didnt. Whether or not harry reid sat on other bills is the not issue. They never presented an immigration bill both side could have embraced. Americans are so disgusted with congress and with washington at this point, that they would really respect it if both side did come together and you know there were some adults in the room could who put something together on this sounds like it could probably be done. Thank you very much. Thanks for being adults in the room with me today. Brad, alan. Bill nearly 300 brave men and women graduating from the new York Fire Academy including 34yearold josephine smith. She is now joining the fdny 13 years after her father was killed in the attacks on 9 11. Kevin smith rather was one of more thaha 300 new york city firefighters who died that day. There isnt a moment of any day that i havent thought about my father. Probationary firefighter, josephine smith. Josephine one of four women graduating yesterday. Bringing total number of female firefighters in the fdny to 44 which is al alltime high. Cool stuff. Martha happy, excited and sad. She was feeling all those things, trying to keep very stiff upper lip in the big moment in her life. Congratulations to you, josephine. That is a big accomplishment. Wish you well. Nicely done. All right so a medical examiner determining what killed uva student hannah graham. What could that mean for the suspect accused in her killing. Take control of your retirement today martha there are some new details emerging in the death of university of virginia student hannah graham. Authorities for the first time are ruling the cause of her death, quote, homicidal violence. Police are not specifically saying how she was killed. Graham was the subject of a frantic Community Wide search when she disappeared in charlottesville in sent. September. Her body was found in a landfill 12 miles away. The man accused of abducting her, jesse matthew. Not charged in her death. He is being held on separate charges of Sexual Assault and attempted murder in a different case in 2005. Bill israel says it has destroyed the home after palestinian man that helped murder five including three americans. The slaughter with meat cleavers took inside a jersey synagogue. The president condeming the attack quote, in a strongest terms. What about words and tone he used there . Lieutenant colonel ralph peters, fox news strategic analyst on this. Ralph . Here is part of the statement that was partially read yesterday. Watch. We condemn in the strongest terms these attacks. A number of people were wounded and four people were killed including three american citizens. So this is tragedy for both nations, israel and the United States. Our hearts go out to the families who obviously are undergoing enormous grief right now. Bill what do you think of that . Well he did not condemn it in the strongest terms, bill. He, he treated it almost as if a natural disaster. Another part of the statement he seemed to apportion blame equally between israelis and pal steps. He just will not face up to the fact that this is about a religious war waged by one slice of muslims, the radical slice, not all muslims, against civilization, against the west. Lets look at what happened. Shouting allahu akbar , god is great, allah is great, two palestinian radicals stormed into a synagogue with knives, axes, hatchets and guns, purposely into a synagogue. Took on four rabbis. Killed four rabbis. Not just bystanders, four rabbis. People were also injured. A policeman died because of injuries from this. When you go into synagogue and kill rabbis this is not a random act of violence. We have to space up to that. President has to face up to it. All the stuff about jihad is peaceful inner struggle, like saying nas system was about legitimate genetic research. Jihad, always been and is attacking the infidel. Bill go to the why if you could, ralph. Same tone we hear when american is beheaded and posted online. Almost like you want a double shot of espresso to slide across the table. Who is speaking up for us as a country . Who is speaking up for america on this . That is absolutely the case. Past a certain point, bill, we cant get inside of obamas mind. He seems to be a prisoner of the bill ayres reverend Wright School of International Relations which christians are bad, unless theyre from radical sects, jews are always bad and muslims from the third world are always good. And it is just not that way. Obama seems to have trouble, even after six years, coming to grips with the reality of a threat facing us. Bill, this is a vast, complex, International Religious fanatical struggle against western civilization. And we saw, already, in libya that declared itself part of the caliphate. The caliphate is spreading beyond iraq and beyond syria. Without getting hysterical about it, this is a grave and serious threat our president , he wants to take a tweezers to it. When you need a sledgehammer. Bill he talked about lowering tensions. Listen, we may be on the verge of a third intifada here. Words may be right, but sometimes you want a little more heart there, ralph. We dont have it. Ive got to run. Colonel ralph peters in washington with us today. Thank you. Martha . Martha turns out obamacare is less popular than ever before according to some new poles. More and more is uncovered now about Jonathan Gruber and the deception used to get that law over the finish line. Bill also a teenager fighting for her right to keep the words, under god, in the pledge of allegiance. The battle playing out right now in court. Heres some news you may find surprising. Were for an open internet for all. Were for creating more innovation and competition. Were for Net Neutrality protection. Now, heres some news you may find even more surprising. Were comcast. Bill think it is cold where you live . The kremlin giving a chilly reception to our new ambassador in russia. President Vladmir Putin welcoming the ambassador, that is a little grin, martha . Would you say that is a slight smile . Martha little bit, putinstyle smile. Bill teft used to be at am ambassador in ukraine. Putin says he wants to Work Together as long as we keep out of everything that is domestic affair including kiev. Martha High School Student is fighting to keep the words, under god, in the pledge of allegiance. Samantha jones is her name. She is in court today. Locked in a battle with group who sued to cut the words out of the pledge in new jersey. Claims saying under god discriminates against the atheist children in the class. Lauren green is in freehold, new jersey as hearing gets underway. Good morning, lauren. Good morning, martha. Samantha jones, 18 years old, saying pledge of allegiance since preschooler. When atheist family brought a lawsuit against the School District to take out the phrase, under bod she and her family decided to fight back and mounting a counter suit. Theyre in court behind me. Phrase one nation under god sumses up history and values that make our country grit. It acknowledges that our rights dont come from the government but higher power. Legal action against the School District was filed by the American Humanist Association on behalf of anonymous student. It says that the words, under god, in the pledge of allegiance are vie of the separation of church and state. Even though the student is not forced to say words under god or stand during the pledge the humanist association contends no student should be made to feel ostracized. Removing the under god or changing the patriotic exercise to something more inclusive would not infringe on anyones rights. Your religious freedom involves your right to believe and pray as you wish but it doesnt the right to have the state sponsor something that take aside on a religious question. New jersey requires students recite the pledge of allegiance each day. The School District find itself caught in the middle. We think this is fight between the state and state legislature who passed a law were simply following. Our primary concern more than the pledge of allegiance we can be sued for simply falling a state mandate. Reporter samantha and her family are not alone in this lawsuit. American legion and knights of columbus are joining in, martha. Martha what happened in court this morning, lauren. Reporter as you mentioned there are a lot more lawyers representing the pledge of allegiance to defend the phrase, under god. David rubin for the School District said this is establishment clause masquerading as qualpro tech case which he is saying this is a test case american humanists are seeing to change the law for entire state, 590 School Districts in the state of new jersey. Martha . Martha well see how it goes, lauren. Thank you. Moments away, the secret Service Front and center, moments away from a hearing on several security lapses that could have put the president s life in danger. Well hear from the med of the agency in matter of minutes. Martha buffalo, new york, buried in six feet of snow, january, february, style it is up there. We have a whole lot more snow coming on the way and some of it is very dangerous. Well be right back. Martha we are back. Now moments away from a big hearing on capitol hill. He will get some grilling that may have put the president in danger. How is he able to jump the white house fence regardless of the dogs and secret service, walking to the executive mansion, finally tackled. It is a crazy storys we will hear about that as we welcome you to a brand new hour of americas newsroom. I am martha mccallum. And i am bill hemmer. He is in the hot seat today. Thei stated to apologize for the Agency Failures but that may not be enough for the lawmakers who want answers today. Martha mike emanuel joins us from capitol hill. What do we expect to hear . We expect to hear he has been searching for the cause of a high profile security failures. He will tell lawmakers he has spoken to rankandfile officers on the ground at the white house and officers around the country. He has heard their concerns and now a is the time to act on the. He will try to talk about these issues where a lot of people are concerned secret Service Officers feel more comfortable talking to people outside the agency rather than talking to the hierarchy chain of command. He will talk about what he is set up for officers feeling comfortable to anonymously express their concerns, martha. Martha shocking when you look at the number of instances that have happened here, mike. One was september 19, the fence jumping incident. He will say that is simply inexcusable. He will talk about security enhancements that have been made. And then september 16 incident in atlanta where the president was in an elevator. He will talk about the Due Diligence by the team and existing policies about contractors with weapons being in close proximity to the president have been reinforced and reemphasized and we will sit lawmakers have to say about what his response to these recent lapse is. Billmartha mike, thank you. You can see every getting ready to start. We will let you know what happens in there. Bill an a known terrorist reled from gitmo back in action. Now he says the major recruit taking over as the chief in the region. Spanning afghanistan, iran, pakistan. What else are we learning about the movements today . Thank you and good more in. When the detainee was released in 2005 under president bush, the 33yearold afghan with long sinning ties to terrorist networks in afghan and pakistan was too old and sick to get back into the fight and his intelligence maxed out by interrogators. Now he has declared allegiance to the leader of isis asking recruiters for the network. He speaks to his time at guantanamo, he had a vision in 2000 to about it. His i got a vision the huge closeddoor above which the play to the time of 10 minutes until 12 00. I assumed it would be established after 12 years. U. S. Officials do not deny the detainee has taken on recruitment role, but they question how effective he can be because he is operating a territory for the alliance in competition with isis run deep. Bill why does this matter . Military intelligence and defense officials with i told 30 detainees are now in syria. Really the first high profile publicly identified himself as isis. Some say the speed at which a third of the detainees returned to the battlefield is more evidence because rock stars and the jihadist world. They remain connected to the global jihad. What it is a propaganda fight or they can be reintegrated, they could still consider themselves part of the game in the u. S. The declaration as a member and his allegiance is more evidence the group is at least able to place followers outside of the region to take on roles such as recruitment. Bill out of washington with us today. Martha we have told you about the extreme winter weather. It is pounding upstate new york. State of emergency brought in after buffalo got hammered with a years worth of snow in the course of just three days in november. Already blamed at least seven deaths across three states, five in the buffalo area alone. There in a world of hurt near whiteout conditions on the buffalo region with 150 cars stranded and 132 miles of highway and fairly shut down. The storm has dumped 6 feet of snow on buffalo with another one to 2 feet expected to come by thursday. Help is on the way be at earlier today i asked Governor Cuomo to play the National Guard cleanup in our area. I have just received confirmation from the National Guard being deployed. He is also sending vital resources from the department of transportation and freeway authority from other parts of new york state. They handle this stuff very well, but this is a really difficult situation. Meteorologist maria molina just outside of buffalo. What is it like where you are, maria . Maria temperatures are very difficult. Lake effect snow, more than 6 feet recorded in some areas and potentially a record amount of snowfall picked up in 24 hours across the entire United States, south buffalo. Our hotel is in new york just to the south of the downtown buffalo area. We are stranded out here in new york. Many other people stranded as well. Trucks have been part out here. Just to the north out here about 40 inches of snow picked up. This area hit hard by significant lin lake effect snow storm. The Truck Drivers dont think they can get home heading into today even though the sun is out. Conditions have improved, there are too many abandoned cars on the highways and part of it is still closed, martha. Martha and things could get worse, we are learning. That is right. As we head into its night and tomorrow, another one or 2 feet of snow locally possibly even higher occurring. More of the same we saw over the last several days possible thunder and lightning, wind gust over 40 Miles Per Hour. It is very cold and parts of western new york. The threat of hypothermia but people stuck in their vehicles and people who have had to walk to their homes because they cannot get through the roadway. Very big concern for people in western new york and again we mention more snow, more off of the lakes. Martha very tough situation for those folks. Thank you very much. Marthabill this team got stuck, stranded. Two members tweeting pictures of the 24 hours ordeal. In one photo they can be seen huddled together Holding Hands and bowing their heads. They had very little to drink. Another busted them back to campus. Later this hour we will talk to the coach. Kendra was the leader with the team when this all went down. Martha that is a whole new Job Description for the coach. New york is not the only place getting slammed with harsh winter weather. Check out this highway in wisconsin. That is not good. Slamming into a Police Cruiser while the trooper was on the side of the road. Thankfully nobody was hurt. This should serve as a warning to anybody that they should just slow down. Go even slower than you think you should be going. Bill Severe Weather he says, send them to us at foxnews. Co foxnews. Com you report. We talk a lot about buffalo. Folks are freezing out there. Get ready. Martha when it is winter, they drop everything. It caught a lot of people off guard. Bill you mentioned the folks in buffalo. They can usually deal with this. Martha you know the long fight over the Keystone Pipeline has been going on it seems forever, right . That ended last night with one vote shy of passing. Republicans set to take control. What is going to happen with it now . Bill good question. Now cars with faulty airbags going nationwide. Facing millions of vehicles, we will tell you which ones. Martha now america listens to what the architect of obamacare is saying. The Health Care Law is now less popular than ever. A huge political advantage. Basically calling the stupidity of the american voter, but that was really critical to the success. Im over the hill. My body doesnt work the way it used to. Past my prime . Im a victim of a slowing metabolism . I dont think so. Great grains protein blend. Protein from Natural Ingredients like seeds and nuts. It helps support a healthy metabolism. Great grains protein blend. Bill we have a massive four alarm fire. Extreme cold and strong wind. They prevented the firefighters from putting out the flames for long time. 25 Miles Per Hour sustained for hours on end. A food market suffering heavy damage. The market was closed at the time, luckily. Nobody was injured. The market has been in business going back to 1919. Martha open enrollment is underway for obamacare. And the law is less popular than ever. No wonder w were learning the white house is kne kneedeep in deception to get the law passed. With the help of Jonathan Gruber. Now, this is a gallup poll. 37 approval number for obamacare. 56 disapprove. The number keeps creeping higher and higher on the disapproval side and no doubt Jonathan Gruber comments cannot be helping it. Especially if what the lie was about, you can give away free stuff and save money by giving away free stuff if in fact not only his government paying more money but individuals are paying money and seeing premiums go up and disruption in coverage. The presiden president himself o admitted he had deceived keeping what you like in terms of your insurance with your doctor. Bill republicans will be in control of capitol hill come january. This one congresswoman who wants to pick it apart piece by piece. Will the white house have to defend this build differently and it will gets tougher in light of what we have on tape now. Their credibility is pretty much at Room Temperature now. There is not a lot of credibility. But it wont be what House Republicans do or dont do, matter how mad or not mad they are. The law itself contains many ticking time bombs that democrats delayed so that they could get reelected to keep the senate. Then we will see in the months to come as the business goes into effect and employers dump insurance altogether or shifting peoples hours, laying people off. Individual mandate come into effect. New premium spikes. Those things will cause trouble for the law. Martha so much of this law has not even been felt yet. 37 of people like it. It is really important to understand this because as chris pointed out, none of this has even been felt yet. In 2015 you will get the individual mandate penalty. 2015 employer mandate will go into effect. They postpone that for political reasons. 2016 insurance runs out, the things that Health Insurance companies so you dont have to pay too much if they had to cover things when people got really sick. 2017 noncompliant plan extensions. 2018 the cadillac tax, kind of a fancy car start hitting employers as well because if your plan is too good, the employer has to pay extra for it as well. The biggest one on the horizon for this was United StatesSupreme Court is getting ready to hear a case that could totally blow this law part, shredded. So the question is not if they will be changing the law. Saying we will fix what is wrong, we will fix it. All that talk has gone away. Now it sounds like nancy pelosi and others talking about protecting obamacare. Thatll be really hard if the Supreme Court throws big provisions and other things that are unpopular. A real fight between the president and other members of the party of what you do with this law that is so unpopular past by the administration. Martha while all that is going on, people are getting their bills, going to the doctor, trying to get an appointment. Having to fill out 500 forms and they are left in a very precarious, difficult, confusing situation, which really doesnt seem fair. It always sounds good in theory with a bunch of eggheads or consultants. You say stuff will happen to people, but the other side it will all get better. Unified theory of politics. On the other side it will be better for everybody and it is fine. That is well and good until he gets to the moment you have to start inflicting the pain on individuals to get to where you are going, that becomes unpopular very fast. Martha unfortunately people are stupid enough or dumb enough to not know. Thank you, we will see you soon. You bet. Bill are the problems piling up for bill cosby . So far not much from bill cosby. We will have details on that. Martha and al sharpton owes the government whole lot of money. Could you get away with this . When we come back. First impressions are important. Youve got to make every second count. Banking designed for the way you live your life. So you can welcome your family home. For the first time. Chase. So you can. Bill a massive airbag recall getting worse. The vehicle that would explode potential airbags. This live in washington. What is making airbags so dangerous . The insulators built up after an accident are rupturing on the drivers side. Sometimes sending metal fragments into the car. The way they work, a sensor first determines how bad a crash is and then and igniter sends a Chemical Reaction sending gas into the cushion. Somewhere in that process supposed to take 20 to 30 milliseconds, something is going very wrong. It only occur in places with high humidity wedding which would make the propellant, but now 8 million cars, mostly model years through 2008 in the United States from very big brands are affected. Here they are. Chrysler, ford, gm, monster, subaru, toyota all have some vehicles under this recall. Bill how many people have been killed to they believed by this . Worldwide, five so far. It is being driven because a driver in california was killed and then a driver in North Carolina was injured but the national Highway Transportation Safety Administration deputy administrator says one can be an anomaly, two becomes a trend and we feel the need to act. Also this on a conference call. To this point, we are aware of six different airbag ruptures involving driverside airbags. In airbag inflators executive same or potentially similalar in design. Four of those ruptures are in florida. Theyre having trouble keeping up with the demands of the airbag inflators that dont explode. The company says theyre adding two new production lines to replace the parts. Bill p reduce in washington on that. Martha stuck on a bus for more than 24 hours. Yesterdays record snowstorm in buffalo, new york, had been stuck in the middle of nowhere. We will speak to about what that was like. Bill Senate Democrats blocking a bill by a single vote. The sponsor of that bill live next. On the agenda in the next congress and a very confident senator hogans bill will succeed and we can get it down to the president. [ male announcer ] some come here to build something smarter. Some come here to build something stronger. Others come to build something faster. Something safer. Something greener. Something the whole world can share. People come to boeing to do many different things. But its always about the very thing we do best. Bill question from washington. The latest bill failed by a single vote. After six years with the pipeline ever be built which mark my guest now from the hill. Thank you for your time. Good to be with you. Bill will the pipeline ever be built . It will be. It is what energy, does about jobs, it is what economic growth, it is about National Security by having Energy Security this country and the American People overwhelmingly support it. We will win this on the merits. Bill here is josh earnest. Listen. The president believes this is submission be determined through the states department. As you rightly point out, there are some apiece of legislation in this congress where the president s Senior Advisors have recommended this. He made thatcomment before the vote last night. Theres a bit of a backandforth as to whether or not the president said the word veto. Do you believe will or will it . I think he will. Were going to pass this bill. He will veto it. Actions speak louder than words did you dont hold a project for six years if you supported. Clearly he is trying to defeat it, delay it. That is why he wrote a bill approved the project congressional. Bill does it die there . No. Over 60 votes needed. If he vetoes it i think we can combine it with other legislation if we need to. If not we welcome my other Energy Legislation or maybe an appropriations measure to make sure we have the 67 votes we need to be vetoproof. Bill immigration, there are rumors will make announcements this week. What will republicans do as a result . First off we really hope he doesnt act unilaterally to go around congress. They made it clear he wants to work on a stepbystep approach starting with Border Security to address the immigration issue. There is a clear opportunity for the president to work with the congress. Said that overwhelmingly that is what he needs to do, we hope that is what he does do. If he acts unilaterally, that is a real problem but obviously we will try to take steps to counteract that. Bill can you confirm republicans are working on two parts of this bill . One would be Border Security and the other granting visas for highly skilled workers. Seems to have some momentum. Would you say that is in the works . It is because the American People have been clear on that. They want the border secure and they recognize it in the highly skilled areas those people can help create jobs and help our economy. That is the point i am making, lets find the Common Ground and Work Together based on what the American People want. Bill the game of compromise, if you did that and the president ask you for the amnesty, would you do that deal . No. The American People do not support amnesty. We have to take a stepbystep approach that starts with Border Security, and start getting into how we make these other reforms. The American People are not in favor of amnesty. Bill now to obamacare. Im not quite sure what the house is going to do. What do you believe a Republicanled Congress should do with regard to the Health Care Law beginning in the new year, do you believe you sit back and wait to see what the Court Decides . This Supreme Court game is a big deal and likely could rule in a way that will make it very difficult for obamacare to continue without that subsidy. I think that is going to change the equation. That is going to be something that will be difficult to do, but we will take a stepbystep approach to offer more competition and more choice. Bill do you do that before the Supreme Court issued a statement . I believe we will start on that right away. Things like more competition across state lines, repealing the mandate going from 30 hours to a 40 hours work week. Bill thank you for your time, appreciate you coming back here. Thanks, bill p it martha republican governors getting it together for the start of their annual conference. John roberts is there life. What is the mood heading into this . Good morning. The weather here is awfully horrible, but celebratory mood take advantage of Republicancontrolled Congress but in january they will hold the governorship across the country and a chance for possible contenders in the governors area to come forward and position themselves in 2016. Scott walker, bobby jindal, martinez. I spoke with harry, he said he is going to decide in the middle of next spring if he is going to run, and said he was humbled by what happened to him during his 20112012 run. Point of the errors i made was thinking i would run for the governorship three times and what could be harder than that. There is something. It is called standing up not only front of the United States, but the world. He told me he was talked into it. He now wants to be presse presid will push for that. Martha what about bobby jindal . What does he say about his thinking . He is putting a lot of thought into it. If he does run, the theme will be restoring the American Dream based on his experience of immigrants. He believes republicans have a responsibility now that the American People have given a mandate for the elections. Now it is time for us to do something. We cannot just be the antiobama party. Now theyre looking for us to show we have earned the right to govern. Show that our policies work. They told me they thought americans would be better with the former governor as president as opposed to a legislator, which is its way bet hillary clinton, ted cruz and rand paul b be at their already jockeying for position here. Martha thank you very much. Bill it is going to be very interesting. Martha john kerrys thoughts were interesting as well. We will see if that makes a difference for him. Bill iconic comedian career coming to an ugly and . New allegations of bill cosby now accused of Sexual Assault by five different women. Our panel will look at the case next. Martha a recordbreaking billboard lighting up new york city. Martha this story is getting a lot of attention. Another woman accusing bill cosby of Sexual Assault. The comedians lawyer dismissed the claims that the scandal is hurting him professionally. Netflix has cancelled their plan to premiere his new comedy schedule on the day after thinking. Good morning to both of you. We mentioned the netflix deal. Lets get to the professional side and then we will get to the legal side. Nbc has a big series in the works supposed to air this fall but so far they seem to be sticking by that. I think theyre waiting to see what happens but this is kind of a disaster for him because the fact netflix is a streaming service, the argument only stands to go and find it. Not like they are airing it on tv at a certain time. People are really having reservations of working with ill cosby. They now have make a decision whether or not to go forward and i dont think they will because how do you ask families to come in and watch the show with bill cosby as a gentle grandfather when his image has been tarnished. Martha there was a settlement reached years ago in some of these cases so legally where does this stand . The woman who signed the agreement got undisclosed amount of money asked for 150,000. She will sign a confidentiality agreement, so she will not talk about it. The prosecutor came out today and said at the time i wanted to charge bill cosby they did not have enough evidence. That is the problem with these alleged cases going forward. So you dont have, forensics or a he said, she said. Martha what do you say but the evidence that has been presented in these cases . You have to take their word. What is good for prosecutor is the animal remains the same. Different places, different times, but a glass of wine, Something Like a date rate kind of thing. Those allegations if these women do not know each other and the allegations remain the same, that is good for prosecutors. But the standard in law is beyond a reasonable doubt. Usually jurors like some sort of forensic evidence. Martha professionally how much does it damage bill cosby . We all grew up watching on tv, listening to the records years ago, so funny, such a talented man in so many ways. Professionally should he be answering these claims and talking to his public . Legally he may not want to talk but the public want to hear from him. If he sees what is going on on twitter, people are very mad and upset about this. Even though legally it might not make sense for him, professionally he will need to explain these allegations. The lawyers will lock him in a padded room because why anything he says can and will be used against him in a court of law. They will take it and play those for the jury. The lawyers are right to counsel him for his career i want to hear from him but professionally, legally he should not talk. Martha what about the fact a lot of these women said and then the next time i went out with him, i am thinking what do you mean the next time . It is a legitimate question. The argument is he is a rich and famous guy. Maybe he didnt even what had happened. They did not want to think what had happened had happened but realized years later. It is a tough case with more and more allegations coming out. Is there any forensic evidence . That is the problem. Martha bill. Bill new yorks newest tourist attraction is hard to miss. The Worlds Largest billboard in the middle of times square the size of a football field. Takes up an entire city block. As you would guess it is getting attention. It is everything that makes this country great. It is amazing. It is so big. I wish i had this in my house. Bill watching a football game. Google is the first to use massive advertising on that space. 2. 5 million per month. I saw this the other day. If there are no graphics on this billboard it is one of the ugliest things you will see. I was like look at the size of that. Martha they wanted something bigger, bigger is better. Bill that is billboard mvp at martha maybe that would be our fault. Bill what is going on . Jon the billboard supersized, right . Two stories were following awaiting word from the white house on a lightly indicative or drawn immigration, and the Affordable Care act the second open enrollment being overshadowed by the comments of one of the architects be at and in case you hadnt noticed, it is called outside. Bill we are all in. We told you about the niagara Womens Basketball team stranded on the team bus for 24 hours. The members tweeting pictures as you see here. State troopers able to rescue them. The head coach of the team on board, good morning to you. Im good, thank you. Bill it has been mourning for you for a long time, hasnt it . You were hit home from a game in pittsburgh, when did the hard stuff really start . It really took us by surprise as we came home. It hit fast, the roads backed up and all the sudden we were stopped and would never started moving again. At first we just thought it was the weather. We deal with whether in our travels, something w were used to. We were not prepared to go outside. We did not have any jackets. We certainly were not prepared to do that. That was my biggest concern as they rescued us that we were not prepared to be outside. So we huddled together, once we knew we were save it was actually fun. Bill you turned it into a positive at that point . Did you have heat . We were really fortunate, we had electricity, it is very important for our comfort level. So that was really positive. Bill as long as they could tweet and instagram, they were okay. You got it. Bill your parents and two children were on board as well. How were they . I think my father was probably the most agitated. Bill he were playing snow in bottles, right . We were. That was an adventure. Just making sure we were staying positive and we were there. We were safe. Bill you made in memory.
