Jessica, speaking of a tactic, the socalled Nuclear Option might be the issue of a Government Shutdown september 11th, you need a continuing resolution to continue to fund the government. Conventional wisdom says if the government shuts down, it does not bode well for republicans in the house and the president can use that to his advantage. Are democrats hoping at some level that republicans pull that one out and willing to go toe to toe with them . I dont think so. I think in general democrats are hoping that some sort of compromise can be reached that we get the continuing resolution passed and keep the government funded because certainly that was the issue before. It hurts more people than it helps. And hopefully once we get back into session in january, well see some sort of movement and get some work actually done that hasnt been going on in washington for quite some time. Guy, to that point, you spend a lot of time on the hill and a lot of time talking to the Incoming Senate class and those kind of folks. Are you getting a sense there is a desire to Work Together or is there a desire to score more political points than there are making legislative progress . I think the republicans have a very compelling argument to make that they want a mandate. It was an overwhelming red tidal wave for them. One of the issues that was add jude indicated was the immigration issue, was the crisis from summer with unaccompanied minors, a lot of republicans ran on it or ran against the president s potential executive order. There were warnings from Speaker Boehner and leader mcconnell, if president obama took this action, which he himself said he didnt have the authority to do. If he was going to do it, which he now has, that would immediately burn any bridges towards progress and cooperation that republicans were willing to perhaps come to the table with. I want to get jessica to come in and separate this for a second. You have democrats in the house and senate. You have a real thumping, pelosi and reid embattled at this point in their leadership positions. Is there sne chance they are going to run away from the president on this one and say hes a lame duck, two more years, we have to try to win Elections Come 2016, he doesnt, were done and going to start cutting deals with the republicans . Well, you know, it will be interesting to see what happens Going Forward. Sadly we just went through the whole process where there was actually a tax deal worked on with the republican chairman ways and Means Committee and senator reids office and unfortunately this executive action blew up that agreement. It would be something that would be positive for the American People as opposed to what well now have, another one year extension that affects about 55 different tax breaks for everything from Small Businesses to individuals. So you know, that sort of brinksmanship is something that i think Everyone Wants to avoid and it will be interesting to see what happens not only with senator schumer but senator reid and pelosi and other democrats in the house as they try to navigate these waters Going Forward and actually find issues where we can do things that will actually create laws and help people and fund the government and come to some sort of agreement that isnt just on an immigration argument. First of all, tell us about the pushback that you received when you did not respond initially and why are you responding now . Well, initially i was out of the country. I was actually in africa at the time. When all of this occurred. So when i got emails and tweets, people saying i need to respond to ferguson i didnt know if it was a person or a place or what. I then became aware of the unrest that was going on and i since followed the issue. I felt like there did need to be a response, but not the one that people expected because they expect for black pastors, black leaders, to all respond to this in the same way. I dont see it the same way. And felt like it was important to say so. And why do you think your perspective is so different from others . Well, i dont know that i can speak to that, but i know that theres this collection sense among many black people that, you know, we know what really happened there. Theres this idea that we are besieged by the injustice of police and so on and so forth. I dont believe that. The problem i see is that there is this celebration of criminality. Theres this acceptance of criminality and thuggery and thats a problem. This was a young man who engaged in a violent robbery and then engaged the Police Officer in a violent confrontation and lost his life. Im raising seven young black men and what im telling them is why is why you dont behave that way. This was not medgar evers, this was not emmett till. This was a criminal. Yeah. Out of your piece, i found this statement very telling. You said if a few black men being killed by cops requires a national dialogue, what in the world does the overwhelming number of black on black murders require . Yeah. Look at whats happening in chicago. Its just its unspeakable and the numbers are outrageous. People will say, well, of course, most white people are murdered by white people as well. Number one, the murder rate, the sheer number of murders for people a group that make up 12. 5 of the population is out of whack and the randomness of it all something has to be said. Now outside the courtroom mubarak supporters celebrated the judges decision. But others, detractors including relatives of those killed by Security Forces held pictures of their loved ones and screamed that mubarak should be executed. The ruling as we have reported comes just a day after deadly protests and demonstrations against current egyptian president , a political ally i should add of mubarak. Ronald reagan lost the presidency twice before he was lexed. Elected. I think rick perry is doing a smart thing, hes bringing experts and donors and activists to texas before he leaves office. Almost half the private sector jobs in america have come out of texas, so hes selling himself. He is selling texas and hes saying if you dont like the national economy, see what i have been doing. The only thing that rose faster than rick perry in the polls in 2012 during the primary was perry falling in the polls. One of the things that led to that was this at the debate. Its three agencies of government when i get that are gone. Commerce, education and the whats the third one there . Lets see. Third one . The third agency of government, i would do away with, the education, the um commerce. And lets see. I cant. The third one i cant. Sorry. Oops. That was a big oops, and something that has stayed with him for a long time. Even folks who have been interviewed down in texas for his party there get together in talks are saying how are we going to count on this guy in the debates . How do you recover from Something Like that . You amp up your game and you do better and youre consistently better. Look at marco rubio. He had a great flub with that water bottle at the state of the union response. Hes gone back to becoming a serious legislator. Hes recovered. If youre consistent and you can show people, look, that was an aberration, i was taking pain medication after back surgery. If you consistently show youre a different people people will buy it. You get a second chance. Well, america is the place of second chances. Its not just rick perry. A lot of folks in the hunt, the hill put out their big three, the tier one, it was rand paul, Chris Christie and brought up Florida Governor former Florida Governor jeb bush. Is jeb bush the 800 pound gorilla in this . A lot of people are saying were not making a choice until jeb says if hes in or not. Absolutely. Jeb bush has an enormous donor base available to him. He has National Name recognition that works both ways and he has a great record as governor of california. But hes rusty. The last time he ran for office was 2002. So if he runs he has to show his campaign skills are honed and ready. And hes not he does not exactly love campaigns as a candidate. How much does this come down to money . We have a large field, is it the money that makes the candidate or will the right candidate find the money . The primaries calendar is compressed this next time. There are fewer debates, fewer free chances to get media. I think you have to have table stakes. If you cant raise 50 million it will be really tough. There are surprises in american life, but if you dont have a real fundraising base, it will be tough. And we will see what happens. Especially when you talk about the tier two candidates, people like marco rubio, scott walker. 50 million is a lot of money. They have been able to show they can raise it. Scott walker and rick perry have been fundraising machines in their respective states. So they can probably go national. And of course theres ted cruz too whos also going to be a phenom. For sure. We are learning more about the process that president obama and his staff went through before issuing an executive order on immigration. The president reportedly asked his advisers including Homeland Security secretary jeh johnson to push the limits of president ial authority and they concluded that the law was on their side. Well, we are learning that the president was working very closely with the Homeland Department secretary johnson to make sure that every ounce of executive power was exerted. Johnson wrote up the orders on the work computer at dhs and remember it was dhs that dealt with the housing and taking care of all those unaccompanied minors who snuck in from Central America. Johnson met this summer with president obama at the white house five times according to a New York Times report. Johnson also told the president at some point that he couldnt stop deportations for 7 million Illegal Immigrants the same way that the comprehensive senate bill would have, but he could protect 5 million. The New York Times report details a few moments that changed the president s calculus from wanting to wait around for congress to pass legislation to just going around the entire legislative branch. One moment was a Tense Exchange with activists in the roosevelt room back in march. They were upset with the rapid rate of deportations. This coming after months of fallout over a controversial video where rice was seen hitting his thenfiancee in an elevator. After weeks of appeals and arbitration, rice is free to sign with another team. Now were learning its because the acting judge didnt buy the lead commissioners claim that the events in the elevator seemed ambiguous. That was a quote. The real question though, why was it overturned and who really messed up . Joining us to discuss it is defense attorney and a criminal defense attorney, former prosecutor and trial attorney. Thank you for joining us. Hi, heather. So this federal judge, Barbara Jones said amongst other things the only thing this was was an abuse of discretion is because goodell failed miserably. So the abuse of discretion i want to talk about that first of all. David, explain what that is. Well, in the initial hearing of course ray rice testified he says thats factually what happened. If you recall, they had the video from outside the elevator when ray rice was simply dragging his wife around. Well, what happened was later on we find out theres more video because tmz made one phone call and got the video inside the elevator. The infamous video where he actually knocked his wife out with a left hook. Well, Roger Goodell said you know something, ray rice didnt testify as to what happened in that initial hearing. So instead of the twogame suspension, were going to give him an indefinite suspension because this video is so horrible we cant let it go with two games and the judge said you know what, i reviewed the transcript of the hearing he said he hit his wife and knocked her out. So you had what you needed in the hearing so increasing the penalty after in which there was no new evidence was simply an abuse of discretion. And the sentence was changed. Abuse of discretion on the part of the nfl, but not talking about abuse or Domestic Violence. And lets take a look at this full screen from his now wife janay rice. She says the video didnt make me rethink our relationship, but i did want more of an explanation from him. I asked him why he left me on the floor like that, i asked him how he felt when he saw i was unconscious. He said he was in shock. I asked him what happened when he got out of the elevator. He said he was terrified because security was there. I asked him how he felt seeing me like that. He said he was thinking, what did i just do . I didnt watch the video again. So david, your response to that, and how the judge is able to split these two issues . Well, ill defer to my cocounsel here . Yes. Im dealing with two davids here. What happens is the judge splits the decision very easily. One is an issue with Domestic Violence. And i thought something that was very, very interesting in what the judge had written in the opinion specifically that it was clear that the league was not taking seriously the issue with Domestic Violence. That is a wholly and completely separate and different thing than what david just originally stated. We have rules of law, we have standards, we have hearings and we make decisions based on the facts of laws. Just because as the commissioner noted that people in the court of Public Opinion were disappointed about that decision does not from a legal standpoint bring us to the place where we reconsider the decision. That would be an anathema to what wed consider as far as due process is concerned. Two separate things are going on here. The judge is saying you should take Domestic Violence more seriously and i think the commissioner was between a rock and a hard place here. He was trying to address this more seriously and he did a very good job of doing that, but when the public outcry was there. Hes concerned of the wellbeing of the nfl and made a decision at that point that he immediated to go back at roar he needed ke was ack at ray rice. Made. I want to get both of your responses to this though. What about the outcry from the public and has this become something thats being led by that, these decisions that are being made . David . Well, both Roger Goodell and ray rice are frankly in a world of hurt. Roger goodell because hes lost all credibility because it comes off as though hes done this in a way to save his rear end as a sort of pr move. The second sentence of the basically indefinite suspension and now ray rice, now hes free to sign with a new team. But the reality is from a Public Relations standpoint, any team that signs him at least this year would be doing themselves a tremendous disservice. I cant even imagine without a longterm Domestic Violence counseling class and a favorable report from the psychologist, psychiatrist hed be accepted back into the nfl. But look to next year hell probably be signed by a new team. Yes, in addition to what david said, because i agree with completely, like in every other area of the law, we have codified policies about Domestic Violence. Treatment. And attempts to be able to determine what the punishments will be. But we need to do Something Else thats different here. And in our society, we are getting more and more to the point where the rule of law is being abandoned for the rule of Public Opinion. I find this to be very dangerous in this case and many other cases and i would just ask as a former prosecutor, a person whos in court trying cases all the time, can we at least start getting recordings of the things so we dont have to go into the he said, she said, what was testified to or not testified to . I dont understand what the ambivalence about having a full and complete record and set of facts so we can judge the things appropriately. Very, very good point. Televised. The Political Team has stayed intact. The Political Team needs a rest, i have to tell you. If youre going to try to be managing 24 hours a day, seven days a week inside the white house you continue do it for six years. We have seen hagel and Hillary Clinton and leon panetta and bob gates all really saying, you know, this Political Team is too powerful. Theyre not letting the other voices get to the president so that we can have some sort of well, to your point, none of the folks really paint a rosy picture of working inside the administration and now we have john kerry, obviously a lot of criticism and to your point, so what does the president do . He has the option of continuing along the course now. Is there a chance he goes outside of the box and picks somebody who has enough standing to take on the Political Team as you said, or does he stay inside the box and what are the pit falls if you will of doing that . You know, actually, i dont think it matters. Unless he changes the inside Political Team which is really too insular and keeping out the debate. I mean, what the theme of all of these outsiders by the way, were people who very much supported barack obama, these people are saying, we cant get to him to offer differing advice. He doesnt want to hear differing advice or hes hiring people who dont want to give the president differing advice. Thats a problem. So whoever the white house whether its Valerie Jarrett or joe biden or barack obama himself, whoever decides who the next secretary of defense is i dont think it matters unless you shake up the Political Team inside the white house. You cannot have a team that is that insular. You know, the National Security advisers role is to settle differences between pentagon and the state department. Right now, we have the white house and National Security agencies at odds. Its not even an interagency fight, but the white house and all the others. When you have the white house versus everybody else, obviously the white house wins that fight. But you have so much sniping, so much politicking that goes on between these agencies. What does that mean frankly for whats important . Which is the National Security of the United States . Well, let me tell you, i spent eight years at the state department and i spoke over the last couple of days with a Senior State DepartmentCareer Foreign Service officer who told me unequivocally that the state department is a mess, our form policy is a mess.
