If we find her body as soon he heard Elizabeth Smart voice he cleared at her in this full story has never been told. Picturesque mountain, quiet and affluent neighborhood slept a family. As the sun rose almost Salt Lake City on the morning of june 5, 2002. The sense of serenity the family once enjoyed would soon come to a tragic halt. The phone rang and the sergeant of the homicide squad said there had been a kidnapping of a minor girl and he was calling out the entire homicide squad. Nancy that girl was Elizabeth Smart. The daughter of ed and lois smart and one of six siblings, elizabeth was a shy, well spoken young lady with a talent for the harp. Ed smart made the initial 911 call. His daughter Mary Catherine went to the parents bedroom and woke them up and said someone took elizabeth. Nancy he rushed to the scene, ed smart notified friends and family. It was chaotic. We walked around the house looking for evidence and a point of entry and we discovered a window that was by the kitchen sink and the screen on that window had been cut. Mary catherine said a man had entered the bedroom and she was told not to move into lie there or something bad would happen to her family so Mary Catherine had laid there for we thought three hours before she notified ed and lois that elizabeth had been kidnapped. The back door to the home was unlocked so we surmised someone had taken elizabeth out the back door of the house. Nancy it was clear the search for elizabeth would be a momentous undertaking. The fbi, state investigators all worked as part of a task force. Some cases like this, in a lot of ways, it was remarkable. Nancy time is of the evidence when a child goes missing. The longer it took the less likely elizabeth was alive. We were in our bureau in denver we were told to go to the airport, pack for a couple of days ago. Nancy volunteers and reporters began to descend that afternoon while ed smart prepared to address the public for the first time. Elizabeth, if you are out to there, we are doing everything we possibly can to help you. As mayor of Salt Lake City i thought the buck stopped with me. We are hopeful that through this News Conference we will pick up additional information. A National Manhunt is underway for the kidnapper of 14 yearold Elizabeth Smart. Utah is known for its materialism. Because of that you get a response that is remarkable. Nancy volunteers center opened at the nearby Shriners Hospital for children. There was almost immediately this Great Organization of people willing to volunteer. We dont have enough banners to serve all these truckers. This is my cousin. We are all out here trying to find her. Nancy the media on the ground in Federal Heights quickly spread the word across the country. Mr. Smart, thank you for being with us tonight. As a father of two children this is a parents Worst Nightmare in the countrys prayers are with you tonight. Nancy over the next day volunteers search parties emerged in droves. They had 700 plus search groups, 50 dogs, 158 tvs, 50 pilots who through more than 300 missions on their own dime looking for elizabeth. Nancy in addition to the analyst tips flooding into volunteers Law Enforcement had also been examining their own leads. The natural thing, when you have had a child who disappears, is to start with the family and get a feel for the dynamics in that family. Ed smart was an interesting person. He was a Real Estate Developer of sorts who would buy a lot in a nice area and of house built on it and he would do most of the construction himself or with private contractors. Is it a loving or warm family . Or do they have problems . They called ed smart and his brother tom and and the polygraph tests were done. We are not eliminating every anybody at this point. They did not release the results immediately so we became suspicious. Nancy with the polygraph results still pending Law Enforcement appeared to be coming up empty. We have had a lot of information provided to us regarding people who had been at the scene, at the house, construction people. This is how house and smart designed and build. As the infestation unfolded we learned he had some 40, 50, 60 different contractors that a common and worked on the house. It was obvious that whoever had taken elizabeth had known the bedroom that she was sleeping in. One of those persons was richard receipt. Nancy richard, 48 yearold handyman had done work in the smart home and other homes in the Federal Heights neighborhood. Richard was referred to me by another contractor who had not used him but he seemed to be very competent. Nancy he admitted to possessing stolen items from the family that employed him, including the smarts. He was taken into custody on unrelated charges. What ed did not know was that richard reecy had a fairly extensive criminal history, mostly petty thefts and burglaries in that kind of thi thing. Nancy authorities began to believe reecy had been involved in more than just the disappearance of the smarts valuables. He was insistent it wasnt him it. Nancy two days after reecy was brought into custody the smarts polygraph results released. Ed smarts allograft results came back clean. Tom smarts polygraph came back include inclusive and then david came back clean as well. Nancy all eyes were on richard reecy. We still plead with that person or those people who have elizabeth to please give her up. Looks like they picked the wrong getaway driver. Theyre going to be paying for this for a long time. Nancy so many of us thought she would never be found and if it wasnt him, he mustve known something. They thought it died with him. The case of Elizabeth Smart remains unsolved. Nancy as the brisk winds of autumn cooled the Salt Lake City valley, it brought with it a sense of hopelessness. Mary catherine was looking through a guinness book of world records, of all things, and it hit her. That was the voice of a man who called himself emmanuel. He had interacted with her and her sister for maybe five minutes when he was there doing work on that house with ed. She went and she told her dad, dad i think i know. I think i know who that voice is. Lois offered him a job at the smart home and he showed up during that time and he had gone to look inside through the windows of the interior of the house and he noticed elizabeth and Mary Catherine. That led to a Police Interview with Mary Catherine and police turned to ed and sa said, we want you to keep this quiet for now. They encouraged the family to remain quiet. There was confusion over emmanuel because while we know he had a religious belief and fantasies about himself. Nancy Salt Lake CityPolice Department believes any public mention of emmanuel might cause him to flee. Had been a biased by the police to hold back and then i see them saying publicly its not even a close second to richard reecy and this is after he died. Nancy in an effort to advance pursuit with emmanuel ed smart took matters into his own hands. Ed worked with a Police Sketch artist to come up with a sketch. We were somewhat hesitant at the time to put that sketch out and we wanted to be sure that if we released information and asked for the Publics Health information would be accurate. They could not do it anymore so ed and david and tom called a News Conference. Very clean dressed person. He told the smart family my name is emmanuel and that was it. It was a shotgun approach to getting that information and one of those landed on his sister who came forward and said that is my brother. Then john walsh entered the picture and had a very good working relationship and ed was devised along by the police, dont go out and dont go on americas wanted. Nancy on february 15, 12 days after the name immanuel hit the airways, ed smart did just that. Brian David Mitchell was suddenly a household name. Now it was a matter of figuring out where he went. I met with ed and his brother tom one night in a restaurant. I said give me everything you heard about legible. So they did not wrote down on a card these nine things they discovered about mitchell, including he was known to camp in the foothills near the smart home. Mary catherine said it wasnt richard reecy and so i typed out this memorandum. Our police chief was reading through and even after all this he said the police said they were sure it was richard reecy. I said it wasnt and you guys need to find mitchell. Nancy mitchells sister reported to the police that her brother was homeless known to have religious delusions and would be traveling with his wi wife. As luck would have it he had been arrested for shoplifting in september 2002 and from that shoplifting arrest security people had taken a polaroid photo of him. When i got there several uniforms and City Police Officers were there and they had detained three people. I knew immediately it was brian David Mitchell and i arrested him because he had not taken care of that shoplifting warrant for his arrest and that young girl was taken away and removed from them by the sandy City Police Officers who was wearing this big and dark glasses but i asked her if she was Elizabeth Smart and she said no and gave me some other name. It was 25 minutes until the officer said i know you are Elizabeth Smart. He held up the picture right next to her and said this is you. Finally, she said [inaudible] and he said i will take that as a yes. Wanda jumped in my face and then they were servants of jesus christ and i was going to hell or Something Like that. She was being arrested for being a disorderly person on the spot. Nancy wanda was brian David Mitchells wife and and holding elizabeth captive for the past nine months. She denied being Elizabeth Smart. That is the hold they had on her. It would be unrealistic, given everything she had seen brian David Mitchell accomplish and his ability to manipulate anyone, anyone, that one hour later they might be back on the road with the police in their rearview mirror. Nancy elizabeth was finally on her way to freedom. Finally, they put her into the back of a police car. They took mitchell and wanda and put them in separate police cars and drove them to the sandy Police Station. I called ed smart and said meet me at the sandy city Police Department. Come right now but dont stop. An Interview Room was provided and elizabeth went in and sat down and i sat down with her and i said take off that wig in those dark glasses. I said we been looking for you for nine months. Were glad to see you and glad we have you back. Nancy ed smart arrived at the sandy Police Station minutes after speaking with detective parks. We walked through the corridors of the Police Department and he said to her, elizabeth, is that really you. She said yes, dad, its me. Bizarre new details coming out in the Elizabeth Smart investigation. Nine knots after her disappearance 15 yearold Elizabeth Smart has been reunited with her family. I got a phone call from another Police Source of mine and he cryptically said they found her, she is alive. I said you are kidding. Of course, he wasnt. They found her, shes alive . Oh my gosh. Elizabeth described that he took her out the back door and up the hill into the campsite. You got a lot of tall grasses and bushes that are in that area that make it very easy to conceal yourself. Elizabeth hiked a steep 3 miles through the wilderness behind her home toward mitchell and wandas campsite. She was tied to a tree with a cable and mitchell and wanda apparently performed some kind of ritual, as if mitchell and elizabeth were going to be married. Proceeded to wait for her. Wanda watched this man sexually assault her. She was just as much as a monster. Nancy mitchell often brought wanda and elizabeth into Salt Lake City. Mitchell is incredibly brazen but he would go to parties and people were drinking and here she was right in front of them. An october the weather starts to get cold in salt lake and he begins to become unlivable at the camp so brian decided they should go somewhere warm for the winter. They took a Greyhound Bus to san diego. He would pan handle for money and he actually got drunk and broke into a church and got arrested and thrown into jail for three days. Nobody is putting this together paid communications were so bad between Police Departments. He was gone for almost a week. There no food and no water. Nancy mitchell returned but elizabeth knew she would not survive if he disappeared again. Elizabeth is a very savvy person and she knows all this religious dogma and she use that against mitchell saying she had a revelation. She said to mitchell, ive been praying and i really think we need to go back to utah. Sure enough he says, yep. The lord wants us to go back to utah. He forcibly entered ed smart home and took his daughter. I asked brian and said, brian, you are using gods name. Do you thank you are jesus christ . It was one of the strangest interrogations i have ever been a part of. The charges we have filed today, account one aggravated burglary with first degree felony. Count three alleges a crime of aggravated sexual assault. It seemed like an easy case to bring but then the lawyers get involved and the Justice System which grinds very slowly. Nancy in january of 2004 wanda barzee was deemed incompetent to stand trial and committed to utah state psychiatric hospital. Early on we knew there would be a competency issue in the case. Nancy that September BrianDavid Mitchell pled not guilty. The defense expert her interview him came to the opinion that he was competent to accept a plea. Plea negotiations proceeded along but then broke down. Shortly after they broke down that examiner changed her opinion to say that he was now incompetent to stand trial. Physically when you are deciding whether someone is competent or incompetent, its a battle between two psychiatrists or psychologists that have interviewed the individual. In 2005 he is institutionalized in the utah state hospital. Mitchell, who had been otherwise composed in court up to that point, began singing and saying to the point that he had to be removed from the courtroom. It was looking like brian David Mitchell might never be brought to justice. I was appointed by president bush to be the u. S. Attorney here in utah. We knew that she had been taken across state lines and that change things because then we could bring a federal case. We sought out doctor michael and his forensic panel. We decided that we would do something that im not sure has been tried before. That was we werent just going to pit one expert against another, we were going to call witnesses, people that were with him during events that we thought showed that he was more manipulating than he was incompetent. We wonder if the professionals there are getting the whole story. What would be people say if they were given the opportunity to share their experiences . Nancy the doctor compiled a list of concrete samples demonstrating mitchells brazen manipulation. The hospital was staffed by number of people who, where themselves, very religious but they notice contradictions in how he would preach a certain way of practice and will not follow his own guidelines. He peered off and came up with a religion where he could follow the rules and all yeah, bring back polygamy that prioritizes girls who are ages ten14 years old. We came to learn he had been arrested in san diego. For the first time in 22 years i got drunk that night. You see how composed and focused now emotionally remarkable he was and how persuasive he communicated. How much he advanced his own legal interests was enormously important. Could he have been manipulative . Absolutely, but the question was was their delusion behind that such that he did not understand the reality going on around him and i said thats absolutely true. We met for an in person and he entered the room with his eyes closed, sat down at the table, never opened his eyes. Shortly after the interview started he began singing loudly. He took the tape recording of Elizabeth Smart interview and just pressed play. He moved his chair right up close to the tv, opened his eyes and was leering at her. That pretty much showed lust trumps religion. We then put multiple witnesses up, friends and family, individuals that interacted with him. Nancy the most compelling witness was about to testify. We got to ask elizabeth what was she observing and brian David Mitchell at the time. What was his behavior . Did you observe manipulation . And in what way . We concluded overwhelmingly that he was gaming the system and manipulating it. That is what eventually we would successfully prove. Nancy wanda barzee competency was restored through forced medication. The court has to ask itself if there are measures that can be taken that can then render the person incompetent and with wanda barzee there was a more transparent path. Nancy in november 2009 barzee pled guilty to federal charges of kidnapping and transportation of a minor across state lines for sexual purposes. That february she also pled guilty to state charges of aggravated kidnapping. She could have gotten a life sentence but todays plea garden bargain gets her only 15 years. It means she will likely testify against mitchell. Nancy she was sentenced to a concurrent federal and state prison term. Elizabeth smart father told fox 13 he told mitchell will be convicted and is grateful the case is going to trial. Eight years after she had been kidnapped. Nancy now a 23 yearold woman, elizabeth, returned from a mission trip to have her day in court. He succeeded in taking me up to this camp, threaten me, tethered me to the tree like an animal and at that point i felt like it did not even matter. I felt like because what he had done to me that i was marked and that i wasnt clean or pure and wasnt worth saving. She testified innnnn find your keys. Find your getupandgo. I believe she is a danger and a threat to any Vulnerable Person in our community. She takes care of another resident across the street. She seems like a good neighbor. Wanda now lives in the Salt Lake City suburb just six and a half miles from the federal neighborhood where Elizabeth Smart was violently ripped from the bed 18 years ago. The historical significance of the Elizabeth Smart case will continue to guide investigations for years to come. This is an incident that touches everybody who has a beating heart. A criminal Justice System has areas that malfunction and it is not a perfect system. Elizabeth case taught us that we can never give up. She stood up for herself in court. She confronted her kidnap her and then she went on to become a wife, mother, and author and she launched a foundation. This in the history book, this will be a story of hope.
