there's a heated two sides to that debate. >> in the meantime, snow has blanketed part of the east coast and let's get out to rick reichmuth braving the elements. >> i think the lighting guy didn't make it here from the snow and yeah, we had a big snow. ended up with almost a foot in new york city, major snow across such a large swath of the eastern part of the country. airports yesterday all of those flights were closed and we're hearing that people are not going to get flights until wednesday which is a big bummer on vacation and trying to get home for christmas. there will be a white christmas for so many people though. let's take a look at video out at philadelphia where we saw over 22 inches of snow and this became the second highest snowfall total ever from my storm in the philadelphia area. major snow there. a lot of areas seeing over two feet of snow, anywhere from around parts of southern new jersey all the way back through west virginia, that kind of the entire swath for the two feet plus snow, but the storm is still going. if you take a look at the radar map. you can see the snow across much of new england. and it's blowing. this storm is out over sea and it's strengthening, it's bottoming out and the pressure is dropping rapidly winds potentially 70 miles per hour across cape cod. toward new york and new york city, heavy towards boston. as you move in closer, wind we're seeing now in the 30 and 40 mile an hour range and blizzard warnings in effect for long island as well as cape cod, the island coastal areas of massachusetts as well as rhode island and then up just to the south of boston. so, we are not done with this yet. it's going to be about three to five-day forecast today before it pulls away from boston, a little bit of snow that time into maine and then everybody is out there doing the shovelling. back to you inside. >> wow, rick, take a bow because i was all over him he was going to be wrong about the storm. he was biting his of the nation's largest airports to shut down and the storm is to blame for five deaths. wfxt reporter is standing live in bridgewater, massachusetts, braving it out there, thank you so much for being with us this morning. tell us what's happening there in massachusetts. >> oh, good morning, guys. aren't we all having fun yet? i think it's fair to say that we are absolutely in the they can of it out here. it started about ten o'clock last night and it has been dumping down ever since at a rate of two to three inches per hour. we've already accumulated about a foot. i'm going to step aside and show you what the roads are looking like at this hour, it's slow going out there and it looks like many people are heeding those warnings to stay off the roads. the plows have been trying to keep up, but it's been coming down so fast, making it nearly impossible. we do have about 8,000 power ounls here in massachusetts. the cape islands and southern part of the state have been the worst hit and this is the scene. just about everywhere you go this morning, people scraping off their windshields and pulled over to the side of the road trying to wait until some of this snow lets up. we've had that live satellite truck diana, right now. >> and hot coffee in there. thanks. the other story, senators expect today trudge through the snow for a rare sunday session not until one o'clock this afternoon as democrats secured the sites of the 60th vote from ben nelson. the debate is far from over and caroline shively braved it to get to the capital this morning and what can we expect on this sunday morning. >> good morning to you guys. democrats have locked in the last vote they need to overrule any republican objection on the health care bill. harry reid has been back in session this afternoon for a procedural vote this morning and a final vote on christmas eve. in order it get that 60th vote reid had to make a deal with senator ben nelson. that compromise run criticism from pro choice and right to life organizations, but nelson says he's satisfied. >> i believe in my heart of hearts that this, this handles the whole question of funding abortion. of banning of the funding of abortion by federal money either directly or incorrectly. >> well, that's fot the only deal that nelson got. under the bill an extra 30 million people will be covered under insurance. 15 million of those nationwide would get coverage under medicaid, that's the government plan for the poor. medicaid cost the are covered by the states, but nelson's deal means his state of nebraska is exempt from paying that bill. here is one republican's take. >> you've got to compliment ben nelson for playing the price is right. this isn't the louisiana purchase, this is the nebraska windfall. >> now, if the senate bill passes then they have to merge it with the house version, a major sticking point could be abortion. the language in the house bill is much more restrictive on payments. democratic congressman bart stupak is the architect of that version in the house. he says it would allow subsidizing. could be a fight for months. >> thank you, it's a fascinating amendment. as we know there already was one in bart stupak, congressman on the house side and yet, these two are not pleased with each other's amendments. >> not at all. >> not at all. so when they have to meld these in the conference committee it's not going to be pretty because it's amazing that both want the same thing, federal dollars not together indirectly or directly for abortion and yet, they can't agree. >> it's looser in the senate than the house, much, much looser. the question could bart stupak become the next ben nelson? interesting things in taxes and we're wondering how it's going to get paid for the next ten years. over 400 billion dollars in tax increases in a number of ways to cover these costs so there's one particular tax that stood out to us this morning. we have a been talking about that bo tax that's out. but another one is in. >> the botox is out for elective cosmetic surgery and things like botox, rather, now, it's the tanning tax is in. 10% out of pocket tax for you folks that go to tanning salons, but not all tanning salons. the type that aly doesn't do. >> only the ones that have uv rays, not the spray tan. the problem with this, they said the bo-tax was going to hurt working women. >> who is this tax going to hurt, women. it's not like guys-- they said 70% of elective cosmetic surgery is. >> when i go to the tanning salon-- when i walk by the tanning salon i see a lot of guys. when i heard about this i panicked obviously, but i was very reheaved that it's not for spray tan. spray tans are the healthier ones. >> right. >> these right there with the uv rays are what end up causing skin cancer so that's taxed. remind me of cigarettes, it's bad for you, let's tax it and fewer people will do it. >> again, one of those things where it's your decision to do it. >> sure. >> we get nickel and dimed every possible way, a soda tax, a cigarette tax, a uv tax, what's next? >> one thing i don't like about this punishes folks in cold weather states, live in arizona, california, it doesn't affect you at all. you don't go tanning if you live in florida. >> and it's strange, you get a lot of revenue from tanning beds? how much are they going to draw from that? >> deal make him look at home and abroad. >> a fox news strategic analyst, he has no problem making it through the storm. good morning to you lt. colonel. we've got to talk about this because we were led to believe that the president's diplomacy, that his reaching out to foreign leaders around the world would pay off, thus far, it has not. perhaps the telling sign at copenhagen, when he walked into the room, the final negotiation meeting and had no chair at the table. how did this change his standing around the world? >> well, first of all, i've got to tell you, as far as the global warming goes, i had to take a dog sled to get into your d.c. studio, wrestle two polar bears on the way. as far as copenhagen goes, there is no deal. i mean, there's just none. it's not there. it's a myth. there's a communique. there's an agreement to maybe agree sometime in the future if everybody's agreeable about agreeing. it's nonsense. no commitment of anytime to anybody. but we should be furious about and i am, is that our president, at least figuratively got down on his knees and begged, he begged the chinese, he begged the russians, he begged the brazilians because he wanted something to take home. we don't know what promises he got out doors, the spectacle of the united states president, our american president, getting, begging, getting the pie in the face in copenhagen is pretty ugly. i would say this, at the end of the day obama has promised a lot of christmas ponies to a lot of interest groups and struggling to provide mittens to some of them. it's bad for america, whether it's health care or climate change, desperate men don't make good deals. >> ralph, what was the alternative for the president to sit out this global climate summit? you know, when president bush did that, lots of krit i cans descended on him. >> it's how it was handled and obama has a terrible problem in many fields with having raised expectations so terribly high. and this man, and he's our president, look, i want him it do well and i'm concerned about climate change, by the way, but he went there convinced that at the last moment the obama magic would render everyone else agreeablen the chinese would agree to cut emissions and to verifications. the world doesn't work like that. the charisma's at an end. as far as climate change goes, yeah, a lot has been debunked. i'm settle for being a good steward of the environment. you're not a good stewart of the environment when you're getting down and begging the chinese to do anything. >> thanks, we appreciate your time. >> thanks, reform got an early present when holdout ben nelson from nobody nebraska said he would provide that 60th vote. reached out to several democrat senators for a fair and balanced debate and they all declined. senator, nice to see you this morning. >> clayton, good to see you. i think senator nelson delivered a white elephant gift to the american people. i can't believe he caved. it was less about saving unborn children and about more for nebraska. do you believe he caved or did he get what he wanted not only for himself, but for the state of nebraska. >> he said initially he would not vote for this unless it had language in it as strong as the house language. what he did doesn't help the unborn at all. the people in south carolina can opt out of insurance plans that cover abortions, but their taxes are going to pay for abortions in other states. in some ways what he did was actually worse, but it will use taxpayer money to fund abortions around the country and so that's a big disappointment to those on the pro-life side, but i think it's a disappointment to a lot of americans even those who may be pro-abortion who don't think we should force taxpayers to pay for them. >> well, even planned parenthood angry with some of the language and lib rap groups upset with this. and let me play you a sound bite what senator olympia snow had to say. >> the rushing a process not to get the right policy, but just to get it done by christmas so we can adjourn for three weeks for a bill that's not going to be implemented until four years from now. and so, that's why american people's confidence has been badly shaken. >> i want to get your reaction to that because it appears as if, and if this-- according to "the washington post" this morning, we could see this thing passed in the senate by 7 p.m. on christmas eve. you guys might be there. it's 7 p.m. christmas eve. is this being rushed too quickly? obviously, a lot of people believe that's the case, but do you think that that's going to happen christmas eve you're likely to pass this thing? >> well, a bill like this is normally debated in the senate for six to eight weeks and we just got this thing yesterday. they've been working on it behind closedtors, but clayton, they know if it stays out in the public for several days or weeks, people will know what's in it and they will not support it at all. and as soon as people get away from the christmas distraction and look at this thing in january. there's going to be a lot more opposition. they've kept us here for three straight weekends so democrats didn't have to go home and face their constituents. they don't want people to know what's in this bill and they don't want them to know it's going to raise the cost of their insurance and cut from medicare, it's going to raise taxes and it's not going to help americans get affordable health insurance. it's very frustrating. i feel we're here fighting for our freedom with the last gasp of hope here, hoping one democrat might see the light, but you know, they would like for us to vote on it today and go home, but i think we owe it to the american people to at least try to read the bill before we get them vote on it. >> you know, this compromise was reached on this abortion provision of course and senator barbara boxer, you know is a very strong proponent after woman's right to choose. she was happy with the compromise and i'll quote here. we would not-- this compromise meets that test. do you see any road blocks going forward? >> well, all the people managing the bill are pro-abortion, from the president to spookerspook e eer pelosi, government-run health care will run health care in america. no one should be naive. i appreciate a congressman of integrity like bart stupak who says he want to make sure we didn't break the precedent. he stood his line not trying to get something for his state. he had an honest opinion and he stood his ground. >> aren't democrats happy with this compromise in that now the burden falls to the states. the states then get to decide whether or not they want to provide funding here, it doesn't fall to the federal level, at least that's what democrats are saying. >> this bill is going to create a lot of tension between the states. not only will the people in south carolina have to find abortions in california, you're going to have to states like nebraska who get a waiver on expansion of medicaid, but the people in south carolina and in many other states are going to have to pay for that. so, the unfairness here is really unconstitutional. the constitution says that states cannot be treated differently and they're certainly being treated differently here. so there's a lot of reason to be concerned beyond just the health care issue. the complete absence of any focus on our constitution is worrisome to people all over the country. and a lot of people, and i'm in that group. feel like this government is completely out of control. so, this is more than about health care. i think it's about the future of our country and we're just hoping that somehow one democrat might decide that it's not the right quite an image, rick? >> huh? >> that was not an accurate one either. yeah, a lot of snow, guys, across such a huge swath of the eastern part of the country and we'll be dealing with these travel problems probably until tuesday or wednesday from this. hopefully you're home or have got a lot of patience, it's not easy through the next couple of days, take a look first of all at snowfall totals when we look at the maps. snowfall totals were impressive. use the video first. this is d.c. we saw 16 inches of snow in d.c., they do not deal well with this. reports of all kind of problems across the roadways in d.c. and just outside of d.c., we saw two feet of snow, so that area was really rough, but that was back 24 inches. the biggest snowfall total is winter green, virginia, 30 inches of snow, west virginia 26 inches and two feet plus. we're not done with the storms just yet. here it is continuing to get stronger as it's out to sea. that means the winds are going to increase across cape cod and the islands and towards boston, but where you see the blue, still very heavy snow bands moving through, probably another one to two inches a for at least a couple more hours. cape cod and towards boston. these are winds we're seeing right now towards the mid 40's as you head out across cape cod. windy, blizzard conditions continue. we do have blizzard warnings in effect for long island until 11 a.m. and then that-- those red counties that you see there across massachusetts and rhode island, those all expire at 1 p.m. we'll be done with this by three to four o'clock this afternoon and then, guys, another storm behind this one that's going to start it moving into the pacific northwest today. and the central part of the country dealing with a big storm wednesday and thursday, a lot of people are going to get a fresh batch of snow for your christmas. all right, back to you inside. >> thanks, rick, man, you know, you've got to remember this affects everyone's flights across 6.4 magnitude earthquake strikes off the coast of taiwan injuring at least 14 people. i should say the injuries are not serious and only minor damage. witnesses say the buildings shook. and geologists say earthquakes are frequent to the region, but rarely cause damage. >> calling president obama's climate agreement impressive despite complaints it did not do enough to curb carbon emissions and greenhouse gases and critics point out the measured measure is not legally binding. an investigation underway after a snowball fight in d.c. almost turns deadly. the confusion started when the snowball fight made the rounds on twitter, attracting hundreds of people. a police officer off duty had his s.u.v. nailed by snowballs, he got out and apparently pulled out a gun. >> the mother of all overreactions. >> another police officer responded by drawing a weapon of his own, but then once the men realized they were both cops they put their weapons away and no one was hurt. meanwhile, the search intensifies for an infamous nazi sign stolen from the awes auschwitz's memorial. outrage around the world and german words that translates in english, to work makes you free. that's the auschwitz death camp where more than 1 million people were killed. the dash cam video pictures a dramatic car crash. the driver of the truck was going more than 100 miles per hour when he slammed into another vehicle and rolled across the highway. they tried to pull him over, he wouldn't stop and the drivers in both vehicles were taken to the hospital with thankfully only minor injuries. >> yeah, crowded and everyone was upset about the stores getting crowded and the decorations months ago as early as halloween. >> as all that shopping and spending taking away from the true meaning. christmas season. one group thinks so and they're trying to do something about it. lauren green reports. >> between thanksgiving and december 25th, shoppers crowd stores, many maxing out credit cards. the season of giving becomes the season of being taken to the cleaner. but a new movement encouraging everyone to live out the true meaning of christmas is rapidly growing, becoming an international phenomenon. with thousands of churches in four continents. it's called the advent conspiracy and the goal is to spend less and give more to help those in need. since 2006. the effort managed to raise millions to build fresh water wells for people living in africa. >> we're not asking you to join this movement out of guilt or disgust or anger, we want you to know that this isn't just about saying no to something. this is about saying yes to something better. >> some weary shoppers laden with packages for their kids see the point. it would be nice to do for others, i miss the true spirit of christmas. happy giving than receiving. >> others aren't sure. i don't think necessarily that's a great idea because kids don't necessarily appreciate a charity. i think what kids can-- the point of christmas is to make your kids feel love and feel appreciated through giving. >> and spending less is not always what's best for the nation's economy. >> consumer spending represents two thirds of our gross domestic products. we are atalking about job and employers who are providing health care for employees. if retailers cut back on operating costs more, we're talking fewer jobs and fewer benefits for workers. >> and they say they donate billions of dollars to charities each other, but as they say it's not about how much you give, but about the quality of gifts this christmas season. >> you know, they make a great point. how are you argue that commercialism hasn't taken over the holiday and diluted the real christmas meaning. you can't argue that it hasn't. >> and some argue, look, that's part of the festivity of it, everyone getting together, holidays, shopping, giving of gifts and playing off of that, it's sort of inevitable, isn't it? >> it is, i would totally agree with you. >> what i can't stand is like, you know, when we have like the president's day sales, we have like mattresses for sale. it's like every holiday now, memorial day. >> i like sales, but when you think friends." people along the east coast are dealing with the first major snowstorm of the season. the storm which spans from the carolinas to new england is blamed for as many as five deaths and left thousands of people without power this morning. governors in several states declared states of emergency and officials are urging people to stay off the roads. forecasters say some areas could see as much as two feet of snow. aly. >> thank you, dave. well, the manhunt is on this morning. for jean felipe la comb.comblac his son is missing. he was taken from a school bus despite pleading with police not to let him. >> police say lacombe duped the judge to get custody of the boy and not seen since. je jean paul lacombe's mother joins us. what you cannot see on that video is that you are in a car about to pick up your son as this unfolding. tell us about the scene. >> i was in my car because a police came, he didn't let me get out of the car so then i saw this policeman, you know, grabbing my kid and my kid was, you know, so scared and the other one was serving me with some papers at the same time, asking me if i was her. and my two kids were crying on the ground. hugging each other. he had custody? >> well, they-- the process in texas he call an ex parte hearing where only one side heard at the time. they filed papers this court. and there was nobody else there to contest the validity or the language in those documents to tell the judge that those documents were not giving the father custody of the child. >> well, i'm sorry to cut you off, we are a running out of time, but is kathy coombs and joseph, the libertarian party of new york. welcome to both of you this morning. >> welcome, thank you. >> caste, let me start with you. what is wrong with banning smoking in public parks? >> what's wrong with it? >> yeah. >> what we're doing, it's creating a tobacco-free area for our youth to play. so, it's really stressing the importance of reducing exposure to secondhand smoke and eliminate cigarette butt litter. >> joseph what do you say to that, kids are playing in the public park. are they for the benefit of everyone? >> i have to say it's spiteful legislation, it's hypocritical, vindictive. by bringing the children into it, they are engauging in a sort of emotional blackmail. a wee touch of secondhand smoke outdoors does not harm anyone, and doesn't harm children. they're bringing the children into it saying don't you care about the children? and the business using the public to enforce the law, that is just encouraging ordinary citizens to harass smokers in public and you know who is going to be hurt by this? you're not going up to a scary looking guy with tattoos and tell him to put out his cigarette. you're going to the little old man whose pipe is smoking and his wife won't let him smoke indoors. >> this is frightening to a lot of people, the idea i would have to go up to someone and tell them they can't smoke here and what if they say what are you going to do about it? if they don't have money for policing efforts in the park, why put the ban in place in the first place? >> well, what we really know to be true is that with secondhand smoke, there's no level of exposure that's safe. in regards to the enforcement issue, it's a peer enforcement, public up the signs and letting the public to know about it, a strong piece similar to any other signage you have, the public is following the policy. >> so the public is following this policy and to cassie's point. there's no level of secondhand smoke that's safe. is there science there? >> there's no science there whatsoever. it's simply the so-called big lie of propaganda, you say it loudly enough and long enough and it's accepted as fact. that's what's going on. the anti-smoking fanatics are clever, first they drive smokers outdoors, driving them out of clubs and bars and so forth and once they're outdoor go after them in the street and encourage people to harass people for smoking. >> cassie shall the final word, about ten seconds. >> we're not encouraging people to harass them who are smoking what. we know to be true is that the surgeon general report states take a bow, rick, you got it right rnt. >> thank you very much, i told you overnight got about a foot. i feel bad about this car, the snowplows are removing the snow. and take a look at the car, completely, not getting out for a while, it doesn't look to me. there you go, i tell you what, a big mess across anywhere from north carolina in towards massachusetts and maine. by the time this is done. blizzard warnings are where you see the counties shaded in red and they're in effect until 11 a.m. across long island, it will 1 p.m. across areas of massachusetts, as well as rhode island and it includes the city of providence. so, things are very windy, the storm is strengthening and as this pulls away from land we are going to be talking about hurricane force winds off shore, on shore, we'll probably see winds maybe up to around 60 to 70 miles an hour before this thing is done. as you move forward and take a look at the radar picture we're seeing this storm affect the area, but the blue bands, as you move in a little closer, in towards the boston area, and towards providence and then out across areas of cape cod on the islands before this moves away. we're still going to do that. video out of new jersey, a lot of times with these storms you get rain across the coastal areas towards new jersey, not the case this time. a major snowstorm, areas of new jersey two feet, 24 inches of snow from this and everybody today is figuring out how do i clean up and how do i get where i want to go? and i tell you the airports are dealing with a big mess and dave and i were talking about this, the f.a.a. going on the airport delays, it may not show a big delay in the airport because they might only have one or two runways going and the airlines canceled all the flights. so the airport doesn't have the big delay, you want to check with your airline if you have a flight and try to reschedule because it's backed up for a number of days here. that's a little tip for the day. guys, send it back to you. >> and a flight out of chicago this morning, eli saying a pilot on american airlines fleet to new york city say the weather is clearing up and good day for flying. >> not three inches an hour ever since and already got about a foot on the ground and let me show you what the roads are looking like at this hour. we've seen clouds going back frequently and they're keeping traffic moving here, which is the good news. but this parking lot has already been plowed three times. it's just coming down so heavy. they're having a hard time keeping up with it. we do have some senators are about to go to the capitol, they'll be about one o'clock this afternoon and i guess they'll sleep in and have breakfast avoiding the snow, all eyes as this debate continues on whether or not this thing will get passed later tonight. now, all eyes, perhaps, on bart stupak. all eyes were on senator ben nelson, now, all eyes can be back on bart stupak, he of course a congressman from michigan who during the house version of this whole debate passed one of those amendments and got all of these democrats on board, one of the very stringent abortion amendments that now could put a wrench in this whole thing for democrats. >> here is what's so strange. ben nelson and bart stupak you think are on the same side. they want restrictions on any federal dollars going to pay for abortion. you think hey, they can work in tandem. no, actually, there was a bit of a war behind the scenes between these two about their amendments. first, let's hear from ben nelson yesterday on this topic. >> i believe in my heart of hearts, that this, this handles the whole question of funding abortion of banning of funding of abortion, either directly or indirectly. >> that seems to make accepts. apparently that's much less restrictive amendment than what bart stupak had in the house. >> yeah, basically in the senate it doesn't ban insurance programs that still do cover abortions. now, as we move forward though this thing has to go back to the house again, but you pointed out the key language. these two want the same things, although the g.o.p. leader in nebraska says this will cost nelson his political career. >> i don't agree with that. >> pro choice groups are angry, a lot like the health care bill, nobody is truly happy. >> nebraska has to be satisfied because he got similar to the mary landrieu deal. remember the 300 million dollar deal called the louisiana purchase, she was a holdout. and ben nelson was a holdout and got millions and millions of dollars, he has to be happy. >> and the anti-abortion candidate, those come over on his side he's an anti-abortion candidate. all of those people have been happy and he needs to stick by his guns and happy he's anti-abortion. the real question, what does back to the house. those 64 democrats that voted for the stupak amendment the first time this was in the house. they all joined him again. this could derail the own tire process. that's the bottom line here. if there is this compromise in place and those 64 democrats decide now what, we're going with the more stringent version of this, stupak thing, this thing is over. >> let's hear from senator tom coburn, more on this abortion issue that's heating up the debate. >> for the first time in the history of the country under this bill, federal tax dollars will be used to pay for abortions. the negotiations, whoever did them, threw unborn babies under the bus. the fact is the policy in this country today under no federal program or federal taxpayer dollars used to pay for abortio abortions, it's been that way for 32 years. that changes with this bill. >> see, this is what's so confusing. if it hasn't been used for 30 years, if federal dollars have not gone towards abortion for 30 years, why, first of all, was there a the hue and cry to allow ben nelson to get his amendments and billions for nebraska and he doesn't want any used towards low income families and moms getting abortion. everybody is on the same page and all using different language and making very strange alliances. bart stupak, was according to this politico article, in ka hoots with the g.o.p. minority leader mitch mcconnell to block the ben nelson amendment. they're on opposite sides of the aisle. >> ultimately you oppose the bill you get rewarded the lesson so far for the three or four who opposed it. more with chris wallace in a bit. >> indeed meanwhile here are your headlines. we start with a fox news alert. dutch police say that teenage sailor laura decker has been missing since friday. she set out to sail around the world solo. where she may be. meanwhile, iraqi government officials are reporting that iranians disputes on oil wells along the iran-iraq border. claiming parts of the oil wells are theirs. iranian troops started seizing parts of the oil field along the border. the foreign ministers of iran and iraq have discussed a misunderstanding between the country's border guards. leaders are expected to meet to work out a bilateral border agreement. a christmas surprise arrives early for awn suspecting california mom. she went to the san jose international airport to welcome troops returning home from afghanistan, but what she did not know was that her daughter was one of the returning soldiers. sergeant amy magnus surprised her mom arriving home a week early from her 12 month tour in afghanistan. as you can see, it was a tearful reunion and it will be a very merry christmas for the family. oh, what a nice note to end on. those (announcer) starts working on contact and at the nerve level. to block pain for hours. new capzasin, takes the pain out of arthritis. >> well, ben nelson of nebraska, they're choser to pushing through the health care bill. chris wallace joins us to break it down. there's so much to talk about. ben nelson gets the abortion language we thought he wants and great deal for the people of nebraska. not everyone is happy this morning, are they? >> no, for instance, he has language which further restricts the availability of abortions and in fact, nebraska can simply opt out. they have the right, any state will have the right on this new public exchanges that are set up for people who don't have private health insurance, that an individual state like nebraska can ban any policy being offered for the public exchange from allowing a woman to get an abortion, even if she wants to pay for herself. that would seem to be restrictive, but a number of right to life groups say it doesn't go far enough. in addition there are a bunch of sweetheart deals in this bill. i know that happens a lot in legislation, but for instance, there's going to be an expansion of medicaid, usually medicaid is picked up part of it by the federal government, part by the state. it just so happens in the state of nebraska, ben nelson's home state, that the expansion of medicaid would be paid for forever just by the federal government so that's a little bit of sweetheart deal for senator nelson. >> yeah, and senator tom coburn when he described this bill, he said, quote, we're not building a managsion this is a starter housement for the american people what is in the starter house, we know there's no public option, the medicare expansion buy in is out. what is in. >> that was democrat of tom harkin of iowa. >> excuse me. what is interesting about that, i noticed that as well, it's not a mansion it's a starter house. the point is you don't usually live your whole life in a starter house you keep going. and republicans who don't like the bill as it now stands worry more over time. once the democrats get in the door that they're going to do more to expand government's role, you know, that obviously there are a lot of people frustrated they didn't get the public option. will they get the public option in two or four years, other ways in which the government could further regulate the insurance industry. some people say in effect, that the federal government is going to turn the private insurance companies into utilities who will be heavily regulated. in this bill, it says that insurance companies have to give at least pay out at least 80% of all the money they take in to either individuals or families in benefits. 80%. so, they're putting a sharp limit on how much these for-profit companies can take as profits. >> yeah, and rarely do you start building a mansion and wind up with a starter house, which is, i guess, more accurate of what happened. and now let's talk about congressman stupak, who is not happy with the language inserted in the senate bill. >> that's right. i mean, it gets very technical, but he, in the house, insisted that there be even more restrictive language than ben nelson had in the senate. and a lot of liberal democrats in the house held their nose because obviously they're pro choice and they didn't like it, but they voted for it because they needed stupak and about the 40 moderate to conservative democrat votes that he represents to get it over the top. they fully expected that it would have a more liberal restriction, you know, less of a restriction on abortion in the senate and that once these two bills got resolved, that they would reconcile that they would be able to get something that they like. well, now with stupak insisting that the senate bill, which is pretty tough, is not tough enough, this is going to be a tough issue, you know, and in fact, there are a bunch of issues where the house bill is to the left of the senate bill and they're going to have to reconcile that there obviously is not a lot of wiggle room in the senate. every senator is king. they need every one of those 60 votes. >> as if there wasn't enough for you to talk about on your vote. you have senator john mccain on there who i think has an awful lot to say about what happened earlier this week in regard to senator franken and mccain's friend joe lieberman, should be a very interesting show today. huh? >> well, i think so. we've got to talk to him about that and talk to him about sarah palin blacking out his name on her sun advisor. she says that she did that just because she was travelling incognito. look, john mccain is always fascinating and he's really stepped up and become a combative, quite conservative senator and in fact, the point man for the republicans in fighting health care reform. so it's going to be, you know, as they said in the campaign, the mac is back and we've got him. >> looking forward to the show, should ab good one. check your local listings for fox news sunday. thank you, chris, appreciate it. >> you bet, thank you, david. coming up a prominent tea party group is getting behind a movement called listen to this, goo. that's right. the found ser here. the found gooooh to talk about that next. why a hooters restaurant cause as teacher to get in trouble with her school. judge janine pirro rules on this case next. >> >> all right. welcome back to the big show. field trips have always been something that students look forward to. however, one arizona high school teacher underfire for taking her students to a hooters restaurant. >> former westchester district attorney and host janine pirro joins us on the interesting topic, now, janine, okay. so at hooters women wear shorts and low cut t-shirts. >> the food is good. >> it's basically a glorified fast food place and the teacher's argument. a long time teacher, 23 years of tenure, no other place could accommodate those students. >> it sounds valid, but the fact is there are other places to accommodate students. here is a woman who's about to retire and they suspend her. even though teachers that are tenured constitutional rights, 14th amendment. arizona has a history of letting people go and suspend them because the woman did the cheerleading thing on youtube. it's a bit much and by the way. >> a woman not a man. >> well, no, we're not going to be-- >> there's no double standard here. >> there should be. if i'm a teacher and i have a class full of kids. do you want to go to hooters-- >> they weren't little, they were in high school. she's a choir teacher and somebody complained. ridiculous, absolutely ridiculous and i have to tell you, one thanksgiving dinner we canceled dinner reservations and take my kids out and no other places open, and i took my kids to hooters. >> i took my kids there. >> and i took my kids there, yeah. >> to hooters? >> seven target workers have been fired for, get this, buying zhu zhu pets. you know the zhu zhu hamsters, it happened after the seven employees bought the popular toys before a target store near buffalo opened that morning. the workers say they didn't break any rules and have done it plenty of teams before. target says of course the company has certain guidelines in place regarding employee shopping during their shifts, but the point hereof the story is that these things are the hottest toy this christmas. of course we had them here and showed them off in the studio and other people couldn't buy them as a result of the workers buying them first so other people couldn't get them. but they bought them, they paid for them. >> yeah, but they still were kind of hording them. >> got to have some perks. attempts to fly during a winter storm turned into a nightmare for passengers on board an air jamaica flight. passengers were trapped for eight hours on the runway at bwi airport in maryland. the plane was scheduled to take off at 7 a.m. and when the plane tried to taxi on the runway stuck twice because of the snow and ice. after eight hours of digging, the plane got out and it got back to the gate at three in the afternoon. >> yikes. >> coming up in a little while, hopefully we'll be talking to tom, the character up in the hair, and george clooney's character, he never waits in line at airports, and first class, racked up 700,000 miles. over 8 million in his lifetime. and he also says though he never has weather delays. >> a-ha. >> he's late, he's late right now. this could be the day it's broken. >> yes. >> apparently he can affect the air travel, but no luck i guess getting cabs. he doesn't have that same frequent flyer-- >> we'll ask him about this. but the storm wreaking havoc on the northeast. the question this morning, how will it affect some of the box office numbers for the movie avatar. as you might imagine everyone out west is all set they can still go see it, but agents and movie stars hate this kind of stuff. their worst nightmare because movie goers stay home this weekend. >> or don't get to see the big movie. >> or does it continue to drum up a lot of buzz about this film and that people can't get to see it today end up flooding it during the week, go on christmas day and see the other films. we're all cooped up cabin fever and people want to get out of the house. >> you need that big opening weekend number. that's what they count on in the neighborhood of 80 million dollars this weekend and that's what generates a lot of that buzz and gets people out this weekend to see the movie. >> i don't see if there's any-- because it's so snowy that people don't want to go shopping and they'll hole up in a movie theater. maybe it will end up working in the reverse for avatar, because it's a long movie and it's nice to be kind of ensconced in a theater to go. >> and i'm on twitter, number two on twitter, is avatar. and bruno came out and people slammed it the so-called twitter effect and the movie box office dropped off and people were slamming it on social networks. avatar hasn't had that effect. people are praising it, that's a hot trending topic. we'll see how snow helps or hurts it. >> we all liked it. a messy morning along the east coast. as we've told you when we come back, a live report with the latest snowy weather update. >> >> welcome back here. of course, the big story we're watching for you this morning, this massive snowstorm. we're talking about philadelphia weather down there, rick was mentioning second highest ever. >> and that stunned me. >> it stunned me, too, but because it's so close to the water, i mean, look at this. philadelphia snowfall right now, i think, we'll check with rick reichmuth now. this is like denver though, you're used to this kind of stuff. >> this is stuff i'm used to, but, rick, surprised this is a historical type of storm on the northeast, huh? not surprised at all really. we knew this was going to be a major storm. we said there would be records broken. the worst was areas across virginia, cutting up through d.c. and new jersey and two feet plus snowfall totals, but certainly a record breaking storm and you talk about it being closer to the water, clayton, that's one of the reasons generally why we don't see as large a snowfall totals because the water creates a moderating effect and the coastal areas, areas closer to the water usually through a little more rain, but this is a classic nor'easter and so many colder air already in place and that's what made this all of this snow. yesterday, dave, you were figuring, worried why the snow wasn't sticking, there was a lot of dry air in place and you've got to have all of that column of asaturate show the snow can keep going. >> and philadelphia, you're done, d.c., you're done with this, today, the sun will be out so it's going to be cool though, it's not going to melt off right away. i've got to tell you, there's another storm that's going to be coming wednesday, thursday, friday, across the central part of the country and towards the east. probably going to be mostly a rain event across the east. we could be talking about some big time flooding because a lot of the snow is going to melt quickly and might ruin everybody's white christmas we're talking about. >> rick, put up your radar map. a lot of people say what does it mean and does it have to do with the rotation of this things. this thing has been a mess and we have the coastal areas that got snow instead of rain rnths instead of rain. a nor'easter is the storm, at the center of the storm is off shore and the counter clack-wise circulation around an area of pressure brings northeast wind across the shore. that's what is a nor'easter. some are stronger and some are not as strong and the storm is strengthening and the pressure now is down in the 975 range, that's kind of equivalent to a category 2 hurricane. not going to be making landfall anywhere, but helps to see we've got winds that are dangerous, a lot of beach erosion with this and we'll see the beaches battered towards cape cod and upper areas of maine. >> needless to say, check ahead with your flights and we know that in d.c., dulles and reagan were closed until six o'clock this morning, at la guard yeah, over 750 flights were canceled yesterday. you're going to have some flight issues, call ahead, check the website. >> yeah, needless to say, thanks so much, rick out there and coming up here on the show, a prominent teen party show is getting behind the movement called go. the founder is here to explain what go is all about. >> well, one of the largest tea party groups in the nation, the tax day tea party has gotten behind a grass roots group. named goooh. to return the control over the government to the people. tim, good morning. >> good morning. >> goooh stands for get out of our house g-o-o-o-h. what's your mission statement? >> not at all. we started this back in 2007. i think the tea party groups and there's thousands of them across the country are one group that's getting behind what we're doing, but there's the abigail adams project. the fair tax organization, there's the tennessee liberty alliance and liberty alliances around the country. and there are many, many groups in america that are fed up with what's going on and goooh is a nonpartisan way to rally together and we can send true citizen representatives to washington without special interest money and without career politicians. >> you say you want to sever all ties between our elected representatives and special interest money. that sound like an admirable goal. how are you going to do that? >> well, so i think one of the beauties of goooh is that we do not want or need money at this point in time. i've been blessed all my life to work at the right place and my wife and i are funding it system. until we get to 500,000 members. once we get to 500,000 members we'll ask each of the participants to make a $100 donation and should raise us somewhere between 25 and 50 million dollars, almost overnight and at that point, we'll begin marketing and advertising and we think we'll grow this group from 500,000 participants to 5 million and then ultimately 50 million patriots. the sentiment across all of america, these politicians have to go, they do not represent us, amassing these 12 trillion dollar deficits and now we're talking about buying a 2 1/2 trillion dollar starter house. we don't have that money and everybody in america knows that. >> you know, you say that you want to replace the 535 career politicians. with everyday americans just like you and me. what if you and i don't know about legislative or constitutional procedures? >> clayton: plus, the 30th anniversary of the christmas classic... >> ♪ ♪ grandma got run over by the reindeer...♪ >> clayton: grandma got run over by the reindeer, we'll have it played this morning, live. and fox an friends will never bore us with alisyn, clayton and dave for us! >> announcer: it's time for "fox & friends." >> alisyn: that is my favorite of the season! >> clayton: welcome to the big show, dave -- we have domino's pizza over here. >> dave: we do, they changed the recipe after, you know, 50 years in the business, we'll have -- >> announcer: yes! >> dave: and we'll have a taste test to see if they can tell the two apart. >> alisyn: the new or the old recipe. >> clayton: and it will be a big pizza weekend, people are locked up, because they can't leave. >> dave: but can the pizza men leave. >> clayton: we had difficulty getting to work this morning and we had to pick alisyn up in the cab and i stopped on her street and i looked, is that her, and looked down the snowy fog and mist and a hobbling figure walking along -- >> alisyn: earlier he said waddling, i believe. but i had a furry haiti and big, long coat and he said i looked like sasquatch. >> clayton: and dave walked to work. >> dave: i toughed it out. tell us about the story coming up out of chicago. illinois. >> clayton: that's right, city seizing a cemetery to be rube u run way, imminent domain, perhaps, coming up. >> alisyn: our top story this is winter storm, out to rick reichmuth for a look at how it will affect you today. >> rick: everybody has been affected already, today is the cleanup and people back to the airports to try to get on the flights, so many people, who had flights yesterday, their flights were rescheduled for wednesday or tuesday. major problems and when you look at the airport delays right now, they are not looking bad. because they only have one runway open or maybe two. and, very few flights going in and out and might say 15 minutes away, but there is a limit amount of flights and storm, snowfall totals with our maps, very significant tote tells, wintergreen, virginia, the highest at 30 inches. a lot of areas, over 24 inches, in fact we're up to 7 states, that have snowfall totals in the states at over 24 inches. and, it is probably going to go higher. look at the radar picture, and we are still seeing some of the snowfall across the areas of northeast. and we'll continue to see it, here you go, across parts of long island towards southern new england and winds around the 60 mile-an-hour range in some case, very rough. video0th out of southern areas of new jersey and we saw over 24 inches in some spots and people having fun and if you are already home and get the week before christmas and it is a beautiful thing and if you are not home and trying to get there. it is a miserable thing and of course, school is not going on this week, so, kids will not get a school day out of this. everybody trying to do shopping, you want to do that on monday and tuesday and wednesday. thursday, rain moves in across parts of the northeast and we're talking, going to talk about a big snowstorm, i think, in and across part of the central plains and by christmas day in and around the great lakes, a lot more weather and the pattern doesn't look like it will change at all. much more, coming on, back to you. >> dave: thank you so much. how much is the subtle point, schoolkids don't get a snow day. >> clayton: they are already off. >> dave: such a bummer... >> clayton: a lot of travel nightmares for people who have to work and don't have off school, up to massachusetts, wfxt reporter diana rocco, live on route 24, i hope you are by a guardrail. what does it looks like, diana? >> reporter: we are safe, trust me. it has been a beautiful morning but it is wet, windy and cold and we have been out here all morning and if you believe it or not it actually let up a little bit in the last hour, that is how bad it was as we were getting through the thick of things here. look at the road way, they seem pretty clear, at this hour. the plows have been doing a good job keeping up with the amount of snow. it has been fast and furious and started 10:00 last night and it has been coming down, ever since. so, hopefully we are through the thick of it here, but, a lot of drivers, stranded on the side of the road as we make our way down here this morning, a lot of people pulled over and cleaning the cars off, trying to keep up with just how fast it is coming down. again, it is cold, it is wet, windy. and, everyone is advised to stay home, of course, the snow does look a lot better, from inside your house, so, we'll continue to update you out here and for all the folks at home, stay where you are at today. back to you guys in new york. >> alisyn: thanks. >> dave: we'll stay inside, thanks, diana. route 24 there and i-95, i know between new york and boston and not a good place to be this morning, between connecticut, on down to new york, stay they've roads. >> clayton: and i checked with the bus dispatchers on the phone and they said, looks like they are back up and rung. >> alisyn: are you calling dispatchers yourself? walkie-talkie, a cb? >> clayton: on the last segment i was on with a dispatcher and i said, hey, buck what is going on and he said it looks back in philly, but buses are back up and running. there you go! >> alisyn: in washington, d.c., this weekend is a pivotal one. yesterday, the senate secured the 60th vote, they will allow the health care reform bill to go forward, and today they'll gather again at 1:00 p.m., and, because -- to secure the decisive vote from senator ben nelson. caroline shivley joins us with the latest on all of this. >> reporter: hey there, alisyn, a huge development, finally getting nelson and took serious compromising and today senate majority leader harry reid has been back in session, 1:00 this afternoon, with the next key procedural vote set for 1:00 a.m. and a final vote likely on christmas eve. now, in order to get the 60th vote as you said, reid had to make a deal with senator nelson that separates taxpayer money from private insurance premiums that pay for abortion coverage and that has drawn criticism from pro-life and fro choice organization but that with other compromises was enough. >> you have to take the process and try and improve it and that is what i have attempted to do, both constructively and productively improve the legislation to the point where i can support it. >> alisyn: the nelson deal also secures tens of millions of dollars for the home state of nebraska for medicaid and republicans say it means other states will have to put... the bill and mitch mcconnell called the bill a legislative train wreck of historic proportion. >> if they were proud of this bill they wouldn't be jamming it through the middle of the night on the last weekend before christmas. >> reporter: if the senate passes the bill which we believe they will they have to merge it with the house version which includes democratic congressman bart stupak's more restrictive language of abortion funding and calls the senate version unacceptable and allows the federal government to subsidize insurance policies with abortion coverage. dave, alisyn and clayton, back to you. >> clayton: thanks and, we should mention on the sunday morning talk shows, david axelrod, white house advisor said the overhaul will pass congress. he is confident of that. all of congress. not just out of the senate. >> dave: which implies all the conservative democrats in the house will be okay with the language, that was in the senate big in regard to abortion, clearly, senator stupak -- congressman stupak is not happy with it. that is a long way to go. >> alisyn: and unless they have a crystal ball. >> clayton: or rahm emanuel making all the phone calls going on behind closed doors. >> dave: plus the house bill has a public option and the senate bill doesn't. >> alisyn: what is in and out and what is out is the bow tax, the nickname, the tax on elective coz expect surgery and dave said it would hurt women more than men and women -- cosmetic surgery and more women than men have it, but now there is a tan tax in. >> dave: which will hurt women. i guess 90% of women. >> clayton: perhaps and a lot of guys get this. and it is that type of tanning, the uv-style beds and we all know, as everyone tells us, absolutely terrible for you. it will not, however, affect the spray-on tanning. >> alisyn: i mean, that's good... >> clayton: calming it the luxury taxlu -- they call it a luxury taxes and $400 billion of taxes, go over the ten-year time period and $400 billion in taxes, this is just one of them. >> dave: who comes up with this stuff. good news is you have until july 2010, you have the winter to get in all the tanning you want to do, and, it starts the summer off with a tan and it punishes us in cold weather states, if you live in arizona, california, florida you will not go to the tanning beds and it is not just women, women in cold weather states, this is bizarre. >> alisyn: i find it hard to believe, by taxing indoor tanning they'll be able to raise $400 billion? in taxes? >> dave: doesn't seem like it will add up. >> alisyn: i don't think so, they have to come up with another idea -- oh, wait, they have, tax the rich people as well, and obviously they'll take, you know, try and cuts out of medicaid, medicare and stave money there. >> clayton: here's something else they added into the health care proposal, we in new york city are used to this now, and if you have been here and visited you know this, go tow a starbucks or mcdonald's you see the calorie count per item on the menu. now, if congress has its way you'll be familiar with all of the nutritional information at all of the fast-food restaurants across all of the united states not just here in manhattan and talk into a mcdonald and we ses call calorie count of big mac, large fry and coke, 1530 calories. >> dave: and you talked about this a lot and you go in there and don't leave the restaurant but you alter your order, the coffee has 600 calories! i have to scale down. >> alisyn: i thought the... i that scone was a good choice. it doesn't deliver that much pleasure and the muffin or the chocolate muffin is so gooey and delicious and the scone is like saw dust. >> clayton: that is 500 calories. >> alisyn: that is 500 calories, i do not need that scone today. >> clayton: what do you think about this, fascinating congress pushing it through, is it a responsibility to help you try and lose weight. it has an effect and when i walk in there, i'm not getting there. >> dave: i'm sure the chain restaurants are not happy with that. let us know at foxnews.com. >> alisyn: almost two weeks since utah mother susan powell went missing. and now, police want copies of her husband's television interviews. investigators say they are selecting and analyzing all of the evidence they can get their hands on and meanwhile a friend of josh powell, her husband, who you see there, has come forward in support of him. the friend says he never saw any signs of domestic violence and police are calling josh powell a person of interest after he failed to cooperate with detectives, she was last seen december 7th and josh said he was camping with his sons in sub freezing temperatures on the day that she disappeared. a warning of a possible terror attack in london. scotland yard now saying there is potential of a mumbai-type terror attack there in london. they say it could target the london business district, in a shooting and hostage-taking raid involving gunmen and improvised explosive devices. 174 people were killed in the mumbai attacks, a little more than a year ago. after months of denials, iran acknowledges at least three people detained during the country's post election protests were beaten to death. by their jailers. the surprise announcement confirms the opposition's most devastating claims against iran's most powerful military force, the revolutionary guard and 100 protesters were brought to trial since the election and the government accuses them of being part of a plot to overthrow the government. workers moved to save an apartment building from slipping into a cliff in california and they are using cranes to reinforce the crumbling coastline by adding rocks and a large chunk of cliff thursday fell into the woegs, forcing 18 people to evacuate their building and they hope to fix it by christmas and those are your headlines. >> dave: coming up on the show, the democrats are gearing up with the new strategy for 2010. guess who they plan to take a shot at? (announcer) starts working on contact and at the nerve level. to block pain for hours. new capzasin, takes the pain out of arthritis. >> alisyn: an army christmas gift for lawmakers looking to push through health care reform. >> you've got to compliment ben nelson for playing the price is right. he negotiated a medicaid agreement for nebraska that puts the federal government on the hook forever, not just six years, not for ten years. it isn't a louisiana purchase. this is the nebraska windfall. >> alisyn: richard burr may have hit the proverbial nail on the head, senator nelson enacting a one for all or all for nebraska mentality. >> julie: we are joined by fox news political analyst and "new york post" analyst kirsten powers and ralph reed from the faith and freedom coalition and thanks for joining us on with the big nor'easter and the corn husband ker kick back and this is a permanent exemption from the expansion of medicaid. and did democrats give away too much to senator nelson? >> no, i think, that the overarching goal is a big gollegolleal and it will be federal funding for medicaid in his state and if you are a democrat you will not have a problem with that and it depends on where you are coming from. you know, i personally wouldn't oppose having medicaid funding at the federal level. so, more medicaid funding. and, i think that they needed to do this, and he was the last holdout on the health care bill, to block off a filibuster and something they needed to do to get the overarching goal done. >> alisyn: he held the democrats hostage for the provision he wanted for stricter regulation on federal funding for abortion yet it doesn't go as far that's stupak amendment goes in the house, so, many people, this morning, are disappointed with the outcome. >> well, alisyn, there is a reason why they say there are two things you never want to see made, sausage and legislation. and, this is going to be exhibit a in the the history books. for legislative sausage that harry reid is serving up and nobody wants to eat. look, moveon.org is against the bill and howard dean has come out against the bill. the u.s. catholic bishops came out against the bill, national right to life and planned parenthood. in my entire career i never saw that broad a spectrum of groups and that is called consensus, i think, and it will deflate the base of the democratic party, because they threw the public option under the bus. and that is undoubtedly going to come out in conference. and, bart stupak has 67 democrats and he says he will not vote for it. i don't think this is done yet and i think it stinks to high heaven and ben nelson, playing the role of statesman looks like instead he was playing let's make a deal in a smoke filled room and the voters of america will reject this at the polls in 2010. >> alisyn: we're sorry, we have had so much snow coverage we have to end the segment. thanks for coming in and telling us about what happened in senate -- the senate yesterday. thank you. >> dave: coming up the man behind the story of the film, "up in the air", the real-life example of who george clooney was playing, you have to hear the... where you live? let's go out to rick reichmuth, how is it looking around the country. >> rick: it is winding up, really, the rest of it will be parts of long island and across southern areas of new england and i have to show you, i feel bad for this guy, the plows come and the shovels come and shovel up the sidewalks and there you go and that is what is left of it. look at philadelphia, we have pictures coming out of there. 23.2 inches. is what their total ended up being and it ends up as the second biggest snowfall they've ever seen in philadelphia. quite a doozy. and look at the maps, right now, you can see some of the snowfall totals across the big cities and film daily, you are breaking up a record, 23.2 and baltimore 20.5 and wilmington, delaware, 17 inches and d.c., 16 inches and new york city, central park, officially, 10.9. so, it is pretty much almost done, will be done by around 3:00 this afternoon. exiting the eastern seaboard and we'll turn or sights on the next storm and everybody loves the idea of a white christmas and a lot of people will have it but there will be a big storm across the central part of the country for wednesday and thursday and on christmas day, a rain storm across the east coast which could cause flooding concerns, as well. but, the travel problems we have now are going to be with us again this week because of the storm that will be in the middle part of the country and you have to fight to get home but it will be hard for some people. >> alisyn: rick, thanks so much. >> clayton: unbelievable. >> alisyn: let's turn to politics, congressman grace son, he has an out spoken member of congress, that is the understatement, he said so many inflammatory things, saying the republican health care plan wants to you die quickly and he's back in the news. >> dave: he's asking eric holder to investigate someone, because they made a web site, called "my congressman is nuts.com. and, congressman grayson wants the attorney general, yes, eric holder to investigate this woman, by the name of angie langley and wants her put in jail, for five years. why? >> clayton: why? i'll read the quote. he says that she has deliberately masqueraded as a stitch went of mine in order to create the false appearance that she speaks for constituents who don't support me and chose a name for her committee that is utterly tasteless and juvenile. >> dave: his complaint is that she doesn't actually live in this is district and his web site is called congressman with guts.com and he says she's misrepresenting the district. >> alisyn: he's complaining about somebody being tasteless? after dying die quickly? what are his standards, i ask you! but, look, he has established himself as being a lightning rod, as being able to say anything and it is -- you wouldn't know of him otherwise, necessarily and it may be working, if this is ultimately his agenda. in the meantime, your headlines at this hour: health care, white house advisor david axelrod said this morning health care overhaul, will pass congress. he spoke moments ago on a sunday morning talk show. listen: >> well, i think we're going to get it done, i think people understand that this is a historic crossroads, david, 7 presidents have tried, and -- to pass a comprehensive health insurance reform, 7 presidents have failed. we have been talking about it for 100 years and we're on the doorstep of getting it done and it will be a great victory for the american people. >> alisyn: democrats got assurances from nebraska senator ben nelson that he is on board, giving them the crucial 60th vote for the bill to pass. meanwhile, an investigation is underway after a snow ball fight in d.c., almost turned deadly. the confusion all started when talk of a huge snowmobile fight made the rounds on twitter attracting hundreds of people and that is when a detective who was off duty, had his suv nailed by snowballs and he got out and apparently pulled a gun as you saw there, another police officer responded by drawing his weapon. and once they realized they were both police officer, they put their weapons away and no one was hurt. and meanwhile, california police are testing a new way to interact with the public. with mounted cameras, officers turn on the cameras every time they talk to someone and download the recording and officials came up with the idea after citizens groups criticized the department for using too much force during arrest and the san jose police department is this first in the nation to try out the new devices. one of the jonas brothers ties the knot. i'm sorry, ladies! kevin jonas, married his fiancee, danielle at a friend's estate this weekend, 400 guests, braved the snow, and attended the event. inside, this castle, there... both of kevin's brothers and bandmates, joe and nick served as best men and the couple met in '07 while they were vacationing in the bahamasbah e bahamas and you have to find another one. >> dave: we have a blindfold for you. >> alisyn: good. >> dave: domino's pizza turns 50 years old in 2010 and along with that they are changing their classic recipe, as of december 27th, crust, sauce and cheese will no longer be the same. we have our hands on some of the new recipe and we are going to -- stop it, clayton, that is harassment, taste test to tell you how the new recipe measures up. we have a guest from domino's pizza. tell us briefly how you changed the recipe, crust, sauce, and cheese. >> well, what we have done with the crust, we have a robust crust with a little bit of a red pepper kick to it. >> alisyn: i like that. >> and mozarella has a hint of provolone. >> alisyn: great addition. >> and garlic seasoned crust with a rich buttery taste. >> alisyn: now we'll taste both and tell you which is old and which is new. >> dave: i'm blindfolding ali as we speak. >> alisyn: will you blindfold, dave. >> clayton: i might grab part of you, if you don't give me pizza. >> alisyn: hand me pizza, please. >> dave: let's get to it now and give them a taste of the old and the new. >> clayton: all right, so... >> dave: stop feeling around. >> alisyn: don't tell us which is which. >> dave: that's the idea. >> clayton: that is the whole point. >> alisyn: i'm putting a fine point on it. >> clayton: i have a slice, all right. >> dave: and alisyn, a slice here and take a bite. >> alisyn: it really is... >> clayton: i hope you don't mind... >> dave: it is like wine and take in the flavor and let it kwirl around a little bit. >> dave: now we'll deliver a second piece of pizza. to you both. clayton, there is yours... and ali, here's your piece of pizza. and we should have a palate cleanser, sorbet in between and you have tried two pieces of taez. >> clayton: i'll say the first one is new. >> dave: the first one is new. okay. >> clayton: the first one is the new recipe. >> alisyn: i think the first one was new but this is hotter. >> clayton: going back to the first one the crust? >> when you bury someone you call it their final resting place, don't you and unfortunately in this case it's not working out that way and look at where the cemetery is located it is right up against o'hare airport and the city of chicago could have made plans to restructure things but figured it would be easier just to get rid of the cemetery, and, build a runway where that is. >> clayton: and i hate calling it imminent domain and it sounds fans if aciful but it is a land and grabbing the land from you and me, to make it of the public benefit, what the law was intended to do, initially, have a public benefit. well, it seems to me a cemetery is a public benefit, already, and how is another runway at o'hare more beneficial? >> you are absolutely right. it is a government land grab. and that is exactly what it is. the government is coming in and saying we don't care that it is a cemetery and a church cemetery, a place people consider holy ground. we want to put a new runway here and don't want to do the engineering necessary to put it somewhere else on the huge expanse that is o'hare and too bad, so sad, we'll dig up your dead loved ones and move them somewhere else and there is nothing you can do about it the courts say the city has the power. >> clayton: another interesting thing is they say they'll move the 900 known graves, that are there at the cemetery, and they'll pay and take care of some of the fees, whatever, a reasonable amount of fees to take care of the transfer. we don't know what these reas reasonable fees are, what is a reasonable fee, will the court decide that. >> what is reasonable to a family member that lives out of state and doesn't know it is going on and maybe doesn't visit the grave that often and come back in a year to try to visit their grandmother or great-grandmother they'll find a big piece of concrete where their loved one was buried and how do you compensate them, you can't. >> clayton: a i can only imagine the person trying to do genealogy and track down where their loved ones may or may not have been buried and have no idea the plan went through and finally get information about where their father may or may not be buried and they go there and an airport is in their way. >> and who will they contact, at that point, to try and figure out what happened to that grave, to find out where the remains were buried and i doubt they'll have an office at o'hare where loved ones can track down their relatives. >> chris: unbelievable. i can't believe it is happening and that is one i've few cases we have been following at fox, cisco, we appreciate you following the story, and check out more at your web site, which is right there on the screen, and we appreciate you following the story for us, in chicago. thanks so much. >> thank you. >> clayton: coming up, a winters storm blanketing part of the northeast, and how is it affecting travellers this morning?
