earlier this week i had the pleasure of talking to a tv legend. he also happens to be the world record holder for most hours on television. that was before regis philbin did this show. we start with a rare clip from his first show. take a look. >> they package things -- they wrap things today like it infuriates me to open anything. >> what do you think when you see that, rege? how many years ago was that? >> i think that was one of my best shows. you know, i started a talk show in 1961 and it ran three years then they brought me up to hollywood to follow steve allen on the "westinghouse" evening show. >> yeah. >> of course, i just wasn't ready for that. on my show in san diego i produced it myself, i flew the people in from los angeles. >> power. >> i put them up at the hotel. i did everything i wanted to do. i got to hollywood, i find out i got a producer, i got a associate producers, i got writers and i wasn't prepared for that. i blew that wonderful opportunity. >> look at you now, how many opportunities you've had since that. >> it took me a long time to accomplish where i'm at now. >> so many co-hosts. >> yes, over the years. so many is right. >> you've had -- what was the first one? >> first one years and years ago was mary hart. >> mary hart with the legs. >> she had legs then, too. >> was she sexually harassed at her job? >> not by me. >> because of those gorgeous legs? >> no, i saw her, i was doing a local show in -- i was going to start a local talk show on television. i was doing the news on kabc in los angeles. i knew the show was coming and they wanted me to have a co-host. so i asked mary hart. she was one of the first. before that it was sarah purcell and cindy garvey here in new york. then anne abernathy. then kathie lee who stayed 15 years. now kelly has been there eight. >> it's been eight years since kelly? >> yeah. >> i used to sit in with you a few times. >> i enjoyed that. >> they never offered me the gig. >> who denied that? >> i had a job already. >> of course you did. >> you know, you're such a character in a certain way in the business. "saturday night live" has captured it. let's look at that. >> my god. >> i love these. >> look who's back! >> i'm back. >> look who's back! i'm back. >> look who's back? >> i'm back! i never felt better. >> oh, come here, rege. mwah. >> very funny. >> you find that flattering when you see that? >> i kind of enjoyed it. i don't know. i thought he was very good. the guy who started this whole thing was dana carvey, though, when he appeared on "saturday night live." i'm out of control! he would say, you know? honest to god, i never said that. >> you scared me. but you do act like that. >> i can't believe you recoiled. >> you really scared me. >> what you go through every morning on that panel of women? i scared you? >> you scared me. there's, you know, i'm on this new show now and i'm all by myself here. it's weird. >> let me ask you something. how does it feel? it's strange to be without four co-hosts, isn't it? >> it does feel different. i don't have people interrupting me. >> how do you think they feel about you getting primetime spot? >> i think they're happy for me. >> you think so? >> you don't think so? >> when are four women happy for another woman getting something they'd love to have? tell me that! >> you're assuming they'd love to have another show. i mean, i have how to work hard. >> they want to sit right here. don't kid yourself. >> sherry shepard has a -- a new sitcom. i'm on the show tomorrow night. >> you're really making the rounds. >> i'm not making the rounds. people invite me. >> how many hours a week do you work? >> four. i'm on four days a week except when we go to sweeps and then -- >> what about the millionaire show? you're on that also. then you're doing guest stints -- >> i'm not on the millionaire show. it went off six years ago. can somebody help me here? >> what do you mean? aren't you back hosting? i saw you recently. >> it was for ten nights. >> all right. >> but thank you for staying in touch. >> do you think you actually saved the network like they say? >> i absolutely did. in the years that millionaire show came on, abc was desperate, more desperate than they are today. that's saying a lot. so, anyway, yes, i went on there and, bang, the show was an enormous hit. >> yes. you did. kathie always said -- or was it kelly? i never get -- it was one of them. >> it was kathie lee. and then kathy -- i mean, and then kelly. >> so now you like kelly the best? >> do i like kelly the best? i love them all. they're all my girls, you know? >> how do you feel about the fact barbara walters is considered a living legend and you're not? >> maybe because she's lived longer than me. whoa! hey, hey. don't ever tell barbara that. >> no, no. she's not watching. >> wait a minute. barbara walters is a true icon if you want to call anybody an icon. no, honest to god, she blazed a lot of trails in this business for women, for people -- >> she's a pioneer. we wanted to get her a stagecoach recently. >> thank you. no, but she's great. i don't consider myself in her league to tell you the truth. >> why not? you're an icon on television also. >> no, i'm not. >> she interviewed fidel castro, you interviewed who? newt gingrich. >> i never interviewed him. >> you don't do that? you don't like politics? >> no, no. >> you don't like politics? >> i really -- as a matter of fact i don't like politics. >> really? >> i really don't. i think -- it's so jaded now and everybody has to follow the party line. >> what about when fdr was in office? >> then i interviewed him. >> let me ask you something. what do you think about leno's show? let's talk show biz for a second. >> well -- >> do you think he made a good move or what? >> the first week he did. ratings went through the roof and that. >> curiosity. >> it's a tough thing, isn't it? to do a variety show with all of the best the networks have got to put up right now. >> yeah. >> he may survive. he will survive this few weeks until people either make up their minds about what they're watching on the other networks and come back to him or maybe they don't. >> why did he give up his desk? the desk, all comedians need notes in front of them. need a desk. >> yeah. >> that was a big mistake. i'm going to call him. >> exactly right. i was almost going to call him and say, jay, don't give up the desk. >> get the desk back. >> the desk is everything. >> exactly. >> he wanted a different look. he wanted to have more of a variety show than what he had. why not do what they were doing before which was a big success? >> i know. it's a tough slot. it really is. >> anderson cooper has been sitting in for you. do you think he has your mojo -- >> he wants my job so bad. >> do you think he has your mojo? >> anderson cooper every night dreams about getting my job permanently really. >> really. >> he doesn't want to grow up like the wolf. he wants his own job. >> i think he has grown up like the wolf already. now, what about this halloween show you have coming up? i've heard you're doing -- what costumes are you doing? >> i don't know this year. it's yet to be decided by my producer. gelman. >> oh, gelman. >> he makes all the decisions. >> yeah. >> but it seems to me -- >> doesn't he listen to you? >> we all -- >> isn't he really your bitch instead of you being his bitch? >> i hear kathy griffin say that. how dare her say that about gelman. it was funny. but anyway. i think we started the whole thing about the host getting dressed up for halloween. do you girls? do you do it? >> we're going to get dressed up. >> do you do it every year? >> every year. it ruins my makeup and hair. i despise it. >> i do too. so many changes it drives you crazy. >> yeah. >> we always come up with a pretty good show. you know, i think it's a lot of fun. i just hate going through it. >> well, i mean, one year you came out as a woman and kelly came out as a guy, right? >> exactly. i did that, i think, with kathie lee and then with kelly as well. she does a funny regis, kelly. >> she does. >> oh, yeah. >> before we go -- i have to ask you -- >> where are we going? we done? >> yeah. >> i want to hang around a little while longer. >> now you want to stay? before you were kvetching. i know you don't do politics, but how about pop culture. are you shocked and upset jon and kate gosselin are getting a divorce? >> you know, she was on the show. >> yeah. >> i may have made a big mistake. i want to tell you something, i have a thing against reality shows. >> why? >> i think they are so fake. i think they are all produced before they begin. i think people know where they're going, what they're going to say, what the situation is. these things just don't happen. you know that. you have eight cameras set up. those these guys, the producers tell them, hey, this is -- i thought it was -- i thought it was a setup. the divorce. now i think it's headlines like a divorce, especially with a woman who has eight kids. >> exactly. i don't care for him at all. >> well, i didn't say i loved him either. i'm talking about what reality shows can do. >> i know. maybe -- >> it's rough. >> look, if these shows -- >> you're a very attractive woman. >> thank you, regis. >> honest to god, with this lighting you can go all the way. >> the lighting is fantastic. never a dull moment with regis. back in just a minute with something that's been bugging me. tell me something. has anybody in this country ever heard of a salad? the new food fad sweeping the nation is the donut burger. 1,500 calorie bacon cheeseburger with a glazed butter krispy kreme donut in place of the bun. it looks gross like some kind of giant zit waiting to explode. all that's missing is the whipped cream, maple syrup and pepperoni pizza. the combo platter comes with a side of fries and defibrillator. according to the center for disease control, 65% of americans are obese or overweight. 66% if you count rush limbaugh's head. can i ask a question? exactly how big a burger do we need? we have quarter pounders, half pounders, fat burgers, in-n-out burgers. i'm sorry. nobody needs to eat half a herd for lunch. a bar owner in decatur, georgia, claims to have invented it and named it the luther burger. in honor of luther vandross who by the way, died of a heart attack at age 54. is this the best way to honor him by seeing how quickly they can get luther's fans to join him? heart disease is the number one killer in this country. which makes me wonder -- are the people selling these two tons of fun cooks or killers? that's a little harsh, but think about it. if tobacco companies have to put warning labels on cigarettes, why not do the same thing on donut burgers? hey, tubbo, when you're finally done chewing, feel free to call 911. that should do it. i would love to be mom and dad. we're not going to be husband and wife. >> hey, you talk the talk but you don't walk the walk. >> actions speak louder than words. >> you can't go out with one person after the next while she's home with the children and say, you want to work it out. that's not working it out jon gosselin. >> gee nancy seems a little annoyed there. here to talk about the latest in the jon and kate melodrama and a few other things, comedian kathleen madigan. editor-in-chief of "maxim" magazine. joe levy. comedian and commentator, chuck nice. he's nice. is there any woman in america this guy can get along with, jon gosselin? >> no, had he never seen her program? what did he think she was going to do? >> add stupidity to the list that he would think he would get along with nancy grace. >> completely dumb. every time i see him on tv, he's saying i don't want to be on tv. you know what, that makes you and 300 other million people, jon. quit going. quit showing up. that's where television shows are taped, at tv stations. >> tv studios. exactly. >> right. >> i watch that, i see a woman with blond hair laying into him really giving it to him. i think he must be having a flashback to his marriage. >> yeah. he's used to it. >> he's panicked. >> that's a very good point. >> he was dumbfounded. kate is here. >> we have another sound on tape as they call it around here from that show. let's see this. >> i just love it. why is this always about you? why are we talking about you? she asked you about your children. >> because he's an important part of his children. >> can he even speak without you piping in? i would look to hear -- how does it always get back to you? >> i don't know. i just thought, you know, you need -- >> that's a good place to start. >> does, does -- duh, duh, duh. >> you know, love and hate is so close. maybe nancy really likes him. >> maybe she does. >> maybe, maybe. >> you know, it's really good to see him actually hold his own with a tiger like that. you know? to be able to get in there and fire right back, you know? >> he's on television here. she's in new york on your show. who's in pennsylvania? who's raising these children? like -- >> should change the name of the show to "plus 8." get both of them out. >> just "plus 8." let the kids run the whole thing. >> two of the kids are super annoying. let's get rid of them too. and down to this six. >> come on. >> no, they're really annoying. >> here's what he said, jon gosselin. when we told the kids we were going to get divorced, the 5-year-olds said, they all speak at the same time, i guess, and they said, what's for lunch? they all said. >> see, even they knew it was coming. >> his point being they don't really care that the parents are getting divorced. you buy that? >> i don't. >> i just think they want to make sure they're going to be fed. they're worried about their parents' income. is there going to be food? these are basic questions. >> i don't think they realize these people are their parents anymore. they think it's the key grip. >> there's a key grip they call dad. >> i think they'd miss the camera crew. wouldn't you if you were those kids? >> those people are nice to them. service lady has hershey's kisses. you're going to like those people if you're a kid. >> why doesn't the crew adopt those kids and dump the gosselins? that's an idea. >> that would be great. "the crew plus 6 minus the two annoying ones." >> speaking of the not bright groups, let's move on to levi johnston. he's going to pose for "playgirl" online. is alaska ready for this? is sarah palin's group -- >> is the internet ready for this? is the question. >> every gay man in america is ready for it. i tell you, they are excited. >> did you see those photos of him topless in "gq?" shirtless, holding the baby. >> he's been going to the gym for six months. manning up. >> he's working out. >> may need more than six months. >> yeah. >> when you saw him in the pistachio commercial, he had a beer gut. >> he's young. >> he's been throwing them back. i don't know if he can bounce back that quickly. >> he's young. he'll work it out. he's a kid. you know? >> i say go for it, make the money now. two months from now no one's going to know his name. so if someone is willing -- >> if that were only true. >> no. >> he'll be gone. >> they're not over sarah but he'll be gone. >> i'm not eating any of those pistachios if i ever lay eyes on that spread. that's all i'm saying. >> do you think he knows -- >> it's not like he has a career plan that he might ruin by being naked. >> that's true. >> that is so true. >> oh my god i was going to run for president but i took naked pictures of myself. >> what about the apex technical school? can he go there? >> a career in refrigeration? >> something like that, you know? >> good idea. >> something where he has a tool belt. >> does he realize playgirl is basically a magazine for gay guys? do you think he knows that? >> no. no there are only two gay people in alaska. they haven't told him. >> why don't we put him in "maxim"? i tell you, you know what i don't think he's going to look that good in a bikini. i don't think he's going to do the waxing that's necessary. i question his commitment. >> that's where you're wrong. i say keep the mystique. go for the bikini. don't do the nude thing. go for the bikini. >> i think if you told him we'll give you $100 if you let us wax you, he'd be like, all right, dude. that's all it would cost. 100 bucks. >> i think he'd give you change. >> he'd be on the first bus to brazil, he thinks you get there by bus. anyway. you know who else is getting if you could get there by bus. you know who else is getting naked? serena williams. she's doing a magazine cover also. >> espn. the body issue. one of a bunch of athletes have that posed in some sort of state of undress. >> i've seen enough naked men. there's no reason to see serena without her clothes on. she's not really naked, is she? >> she looks great -- >> is she really naked? >> she's covering the boobs and covering mrs. happy. she's, like, you know, in a position. she looks very good, actually. >> really, it's not too much? >> i tell you another one. oh, we have to break. been . there will be people who will not watch the show because it's about him. you know? there will be people who say, i'm not watching that. >> i don't think anybody is going to care. nobody watched t.o.'s reality show. >> whose? >> see? see? >> let's move on a little to another story we covered this week. everybody covered this one, according to a friend, an alleged letterman extortionist, joe halderman is a hell of a guy. they say he's very good, very nice. he was live with this chick, what's her name? stephanie. >> yeah, this is a -- >> he only wanted $2 million. it's letterman. he could have asked for $50 million. maybe he is a nice guy. >> people have been talking all week, is it sexual harassment? i felt it was a bit wrong. i thought it was a little bit wrong. >> did letterman come on to you? >> he never had me on his show, so i don't care what he says. what i say and i don't expect to be on after the way i carried on all week long. >> i was on there six times and never got hit on. that's depressing. >> he likes girls that work there i think because those are the girls he meets. he meets these girls. he doesn't go out. he has a lair up at the top of the building and that's it. >> now we understand why he doesn't go out. there's no need to go out. the party's at work. >> i know. it's weird, isn't it? >> it's a little odd. i never thought it was a sexual harassment. what i came to this week, i said it a couple times already, i'm bored with myself, but if i was on that staff and i was not the one getting hit on, i would feel, like, hey, she's getting a little bit of an advancement and what about me? >> let me tell you, i would feel the exact same way. >> she's in all the sketches and you're running getting coffee. >> exactly. i was talking to a comedian about the fact if you were on "catch a rising star" or "improv" in the old days you guys were comics, somebody else was getting the 10:00 primo spots where you want to hone your craft and that person is not as funny as you are and getting the spot because you were sleeping with the owner, that's how i would feel with letterman. >> don't believe anything you hear from the comics about me and the clubs i work at. okay? i understand that's a rumor. i think i'm funny and i think i deserve those spots. >> yes, you do. >> you're also running on, what do the other women know? did they even know? >> they knew. you always know. >> is there anybody who really thinks this is okay? he's the boss. he's signing the paycheck. >> that's right. >> you know, is this -- >> it's david letterman. >> i hadn't thought of it that way and it does make -- you should have sex with women that -- >> if you're that funny, you should do whatever you want. thanks for my panel for joining me. that was a lot of fun. thank you for watching. good night, everybody. us breaking news tonight. a million-dollar mansion. a tv deal. personal stylist. a fleet of luxury cars of beautiful people, eight beautiful children. they had it all. but tonight, allegations of daddy siphoning the last drop of the family's money to sport all his girlfriends and lavish lifestyle, siphoning to the tune of $250,000. allegations of illegal wiretapping, phone tap, bank account and computer surveillance by daddy, a known computer specialist. charges of drug use, x-rated sleep overs with a bartender. daddy allegedly hired to babysit in the home with the children asleep upstairs and that is the tip of the iceberg. didn't we all know it would end in court? "jon & kate plus 8," is daddy headed to the big house? for years, jon, you had your children on tv, on a reality show, but suddenly when it's no longer "jon & kate plus 8," it's "kate plus 8," you suddenly have a problem with it and you want it all to come to an end and i don't believe that. >> regardless of the timing, i'm their father and i will do what's best for my children. >> you got your lawyer here? afraid to answer questions? whatever. what's important is the children and not these two self-absorbed husband and wife who argue constantly in front of their children. >> exactly. that's why they're coming off -- >> that's why show is going to stop. >> why don't you stop arguing and work on your marriage? wouldn't that be a better idea? >> exactly. >> if i could get kate to mediate and talk, we could do that. >> you've been to therapy together once and have not been back. but you want to go back with kate, right? >> i would love to go to mediation. i would love to be mom and dad. we're not going to be husband and wife. >> hey, you talk the walk but you don't walk the walk. you can't go out with one 22-year-old after the next while she's at home with the children and say you want to work it out. that's not working it out, jon gosselin. >> in night of all the allegations and everything that's gone on in the past week, alone, should the kids be in therapy? >> not so much as they need to go to therapy as jon and kate need to go into therapy and learn to quit arguing and set a good example for the children. >> how do you feel? do you feel like your kids need therapy? are you seeing any problems? >> well, i'm not a professional, but the hardest thing i ever did was tell them we were getting a divorce. >> i'm saying get the babies therapy because you never know. the effects of this could be far-reaching. and, you know -- >> you don't know until you're an adult and sometimes that's too late. >> exactly. >> and that's what happened to me. i'm learning -- i mean, my father, his father. i'm learning to break the pattern. good evening, i'm nancy grace. i want to thank you for being with us. $250,000, gone. allegations of illegal wiretapping, hacking into bank accounts, hacking into cell phones. claims of x-rated sleep overs with eight children asleep upstairs. "jon & kate plus 8," it had to end, in court. >> we're in the middle of a divorce. why should we televise it? it's not helping. >> you're in the middle of a divorce because of you. and frankly -- >> wrong. wrong. wrong. kate approached me -- >> i've never seen two more self-absorbed people in my life. you have eight children hanging in the balance while you and kate -- >> sorry for talking over you. but in october she said -- >> no, you're not. you put your children on television for years, but now suddenly you stick a sign on the house that says you can't film here anymore? is it because it used to be "jon & kate plus 8" but now it's "kate plus 8" and you're not making anymore money? >> absolutely not. i will always make money, and i'm not doing it for the money. >> he took $230,000 of the $231,000 that we have liquid. and i have a stack of bills in my purse i can't drop in the mail. >> she's making claims that she can't back up. if she said i took $230,000, where's the bank statement to prove it? >> you can't have it both ways. you can't make all this money, put your kids on tv, and then now when she's making the money say uh-uh, uh-uh. it doesn't work like that. >> it's not about the money. it's about getting my kids off tv. >> the kids have over the weekend -- i told them we're not filming at this point. and actually, times eight, there was wailing and sobbing. they love our crew. they love the interaction. they love the events. and there is nothing harmful about it. >> i'm not the bad guy here. i'm the one trying to protect my children. that's called being a parent. i'm protecting my children. >> not according to the legal documents i have here in my hands. we are taking your calls. it all seemed too good to be true. the reality show "jon & kate plus 8." and in reality, it's not. it's not as good as it seems. not even close to it. now allegations of drug use, allegations of x-rated sleep overs in the home with the children upstairs. claims that jon gosselin has hacked into his wife's checking account, her cell phone, her computer. remember, he was, before he quit work, an information technologist for the state of pennsylvania, a computer wiz. straight out to chris jacobs, correspondent with "the insider." but now there are claims that he has siphoned nearly $250,000 off the family account? >> you know, nancy, that is the story right now. the truth has yet to come out, however. there's three sides to this story, as in most situations. there's kate's side. she says that jon took $230,000 out of a joint account. jon claims he only took $22,000 out. he's only been able to produce one withdrawal slip showing that transaction. because of his inability to access the internet, we have not yet seen the bank statements. so we don't yet know what the truth is. >> wait a minute. wait a minute. chris jacobs, "insider." did you just say his inability to access his account? did you say that? >> well, what he told us here -- yes, he did, nancy. he told us here at "the insider" that he does not have the access to the online account that kate was supposed to give him, he was going to wait until he got home to new york. he arrived today. we still have not had any statements sent to us here at "the insider." >> so he arrived today, but still no clarification? i thought at an earlier stage, jane velez-mitchell, joining us is hln's host of "issues" and author of "i want." jane, didn't he admit earlier to taking about $100,000? >> well, you know, this is a he even i can do that. don't tell me that an i.t. specialist. an information tech who worked on computers for the state of pennsylvania, who is allegedly made claims that he has hacked into his wife's checking acounty, her cell phone, her text messages, her e-mails and he can't tell us his last withdrawal? >> well, look she's saying he took $230,000 in the account. his point of view is that she has more than a dozen checking accounts. this is what he's claimed and at one point he was heard screaming, where's the $2 million. i'm wonnering why they have a joint checking a count when they are in the process of getting a divorce. how crazy is that? >> clark, what can you tell mebility the latest claims that are hitting the news standing tomorrow in the "enchoirer" that he allegedly has hacked into his wife's hacked into his wife's accounts and bragged about it to the bartender-turned- -- >> according to these claims he, in fact hacked into kate's cell phones, kate's transactions including her credit card and computer and even now that kate was allegedly having an affair. of course, these are unfounded claims but this is what jon told stephanie santoro. the cocktail waitress also saying that jon one night, just casually mentioned insiding can according to this report, this stuff is not good. my good stuff is in new york. she said, jon what do you mean. and she realized he was referring to marijuana, nancy. let's unleash the lawyers. we have jennifer and bradford cohen and renee. renee, what's he looking at the it can be proved by police, and they can do it if it happened, that he's been hacking into his wife's checking a count her cell phone, her text messages her e-mails. what's he looking at? >> i can tell you in georgia that's a criminal offense. you can't check your husbands voice mail. you cannot check his text messaging. nothing like that. but what he's also looking at nancy, is a contempt charge. because of the arbitration he had to get consent before he took anything out of that joint checking account. >> now hold on. would it make any difference, bradford cohen, if you hack into your wife's account? they're not did vortsed yet. >> there's two things that make make a difference. you don't know who pays the phone bills. if this is a family plan. i don't know if the phone is in his name so he was just hacking her phone snoois it's in her name. >> if it's in her name it doesn't make a difference whatsoever that it's his wife. in terms that he's hacking into her phone system or hacking into the computer. if it's a shared computer that's a different issue. >> they are not living in the same home. have you been -- put cohen up, have you been living in a cave? he's living in his bachelor pad in new york. >> currently you're correct. but i'm talking about when he originally hacked into it. he said he found -- >> as i was saying, he's allegedly telling his girlfriend, last i looked, two plus two is still four. he got the girlfriend, after they split. so he's not in the home anymore. all right? does that help? no. it doesn't help. we still don't know when he actually did it. he may have been been talking about something he did in the past. jennifer, do you want to weigh in. >> i think what he's doing is wrong and i think it will come to bite him in the end. what he's trying to do is manipulate the situation. people going through a divorce normally show the ugliest part of them and he's showing a pattern and practice of using information and manipulating information to his best interest. >> well, on the other hand, we have to consider the source in was one person's word. was it just pillow talk by bartender turned babysitter? jennifer is an tory? >> kate and i have always been there for our kids. we know what's best for them. please, people stop interfering in our lives. we know what's best. for years, jon, you had your children on tv, on a reality show, but suddenly when it's no longer "jon & kate plus 8" you it's "kate plus 8" you suddenly have a problem with it. i don't believe it. >> regardless of the timing, i'm their father and i will do what's best for my children. >> oh, you got your lawyer here, afraid to answer questions? whatever. what's important is the children. and not these two self-absorbed husband and wife who argue constantly in front of their children. >> exactly. that's why they're coming off -- >> that's why the show is coming to a stop. >> why don't you stop arguing and work on your marriage? wouldn't that be a good idea and go back to a happy family? >> if i could get kate to mediate and talk, we could do that. >> we are taking your calls live. to stephanie in indiana. hi, stephanie. >> caller: hi, nancy. thanks for taking my call. >> thank you for calling in, dear, what's your question? >> caller: as a mother, one of my views of jon gosselin, he says he has his children's best interest at heart, but the damage he's doing to his sons by showing him all these women that he's with, he's teaching them that women are trash and he's teaching his daughters it's okay for the men to treat them like trash. >> to dr. jeff gardere. psychologist, author of "love prescription" and many, many other books. what about it? >> your caller is right. what we see in these sorts of divorces, people become so angry, we see the worst behaviors come out and they don't think about the kids. they act out to the point if the kids are around, they become collateral damage. >> you're seeing shots of jon gosselin partying all over the country with one of his girlfriends. hailey glassman. what do we know about her, chris jacobs? chris joining us from "the insider." >> we don't know much more than she's 22 years old. she the girlfriend of jon gosselin who he jumped into a relationship with soon after becoming separated from kate. >> what's her age? oh, hold on. hold on. chris, i don't know if you missed this one, but here's her mugshot. that's a little detail you might have missed. >> we unfortunately have only seen the worst of hailey. jon claimed to me in an interview i did for "the insider" yesterday, he is in love with haley and he does plan to stay with her for the rest of his life. >> chris. chris, chris, chris. >> make of that what you want. >> he said that of kate, too. i don't care about that. what i care about is what's happening in court. the custody battle that is brewing and allegations of siphoning $250,000 plus hacking into bank accounts, text messages, cell phones. those are crimes. and if they're true -- >> yes. >> -- he's headed to jail. all right? if they're true. >> this situation has more twists and turns than the hedge maze at the end of the movie "the shining." we just don't know where the out is. what we do know is that jon made one withdrawal for $22,000. whether there were others we do not know. and it kind of surprises me that there hasn't been a financial forensic investigation yet, that we don't have these bank statements which purportedly would show what the truth is. those have not been produced by either side. >> well, do we know that? it may not be time to produce them. very quickly, to marc klaas, president and founder of klaaskids foundation. i want to talk about custody, marc klaas. and we have seen, you and i both, in situations like this, it escalate. escalate rapidly. we know that the girlfriend, hailey glassman, has this arrest record. we know that there are allegations of him having x-rated sleep overs in the home with the bartender-turned baby-sitter while the children are there. now these allegations of siphoning $250,000. how could that or would that affect custody? >> well, i'm certainly no family lawyer or lawyer of any kind, but what i can tell you, nancy, is the abysmal behavior on the part of both of these parents, and particularly jon, is re-victimizing these children on a regular basis. they're subject to peer pressure. they're subject to finding out about this stuff as it's been documented in memoriam. and at some point they're going to realize their father is out there blithering on about millions of dollars, their mother saying that he's stealing the money, and the whole world's watching this thing absolutely aghast. i feel terribly for these little kids because -- >> i do too. >> -- certainly they are caught in the cross hairs of some very bad behavior. >> we're coming down on jon gosselin. but prior to this i've never seen two more self-absorbed people in my life. in every shot the children are just looking up to them clambering for attention and they're not getting it. to candy in illinois. hi, candy. >> caller: hi, nancy. thanks for taking my call. >> thank you for calling. what's your question, dear? >> caller: i have a question about if jon's putting a halt to this show and that means no income, does he now have to come up with money of his own for like alimony, child support -- >> you mean like -- candy, are you suggesting that he work? what about it, jane velez-mitchell? >> according to this report, one of the women says he's planning to ask for alimony. so it would appear that he might want to be supported by kate if she has the money, if she's able to continue the show. then, again, he's trying to stop the show, so if he stops the show entirely he could run out of his source of income. >> it's not about the money. it's about getting my kids off tv. i feel that my kids -- >> why was it okay when you did it? >> because i wasn't -- i feel now empowered. >> you're broke? >> no, i'm not broke. i'm not broke at all. >> i can see that. you've got on two diamond earrings. you're obviously not broke. >> actually they're czs, but i'm not going to go into that. >> don't care. d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d assistants there. they play with the kids. we all get along and play together. and it's like a family environment. that's how we worked together. it's comfortable for the kids to film. that way there's no animosity. i mean, that's the way it is. >> you put your children on television for years, but now suddenly you stick a sign on the house that says you can't film here anymore? is it because it used to be "jon & kate plus 8" but now it's "kate plus 8" and you're not making anymore money? >> absolutely not. i will always make money, and i'm not doing it for the money. i'm doing it to restore family values. i'm -- >> say what? >> i'm doing it to restore family values. i want to -- >> do you think by dating hailey glassman when your divorce is not settled that you're restoring family values? and look, hey, i'm not all about family values. i'm just saying that you can't have it both ways. you can't make all this money putting your kids on tv and then now when she's making the money say uh-uh, uh-uh. >> i know that personally, for myself and the kids, this has been a good experience. it continues to be a good experience. >> will you demand that that money be redeposited in the account? >> i have to in order to keep my kids where they live and to put food on their table. i need that money to provide for them. you have to understand my position here. we were in a position after our sextuplets were born that we could not pay our bills. we did the show to provide a better life for them. never did i think i would be back in the same position, worried about providing for them. >> that was kate gosselin on nbc's "today show." restore family values? what's he going to do with all that money, chris jacobs? go buy another ed hardy t-shirt? how much do those things run? couple hundred bucks for a t-shirt? >> whatever it is, they're charging too much, nancy. again, i mean, we have to put the word "alleged" in front of everything that has to do with this situation. the truth is that third side of this story. and the longer it goes on -- >> why do you keep saying there's a third side of the story? what do you mean by that? there's her side and the third side. what's the third side? >> the truth is the third side, nancy. >> well put. >> the truth is the third side. >> well put, chris jacobs. back to you, clark goldband. we were supposed to be in court today. what was to be heard? unfortunately, the judge's wife, extremely ill with cancer. what about it? what was set on the menu for today? >> that's right, nancy. all eyes on a montgomery county, pennsylvania, courtroom, where these charges kate gosselin has brought forward, saying jon has took $230,000. she wants that money repaid within 24 hours. also, what she wants is 60 days of receipts for every dime jon gosselin has spent. she also wants jon gosselin to turn in his mercedes and bmw in -- >> wait, wait, wait. he's got a mercedes and a bmw? >> yes. >> okay. go ahead. >> she wants him to turn in the bmw and mercedes in lieu of this money. if some of the money has already been spent, and it very well may now that this hearing has been tabled till next week, kate gosselin -- >> you're right. $200,000 will go pretty fast with that kind of spending if he's got a whole week without any court controls. to john lucich, former criminal investigator and president of high-tech crime network. he says he actually told "the insider" that he could not get access to his bank account. okay? my mother, who is in her 70s, knows how to access her bank account on the computer. i know how to do it. and he, the i.t. expert, the computer wiz, cannot get access to his bank account? b.s. now, telling me that makes me suspicious. >> oh, there's no doubt about it. in fact, what may have occurred -- and again, there's a lot we don't know about. maybe she changed the password and he couldn't get in, which led him to hack into that. now, if he's an account holder on that and he has authorization to get into that account and use that account, then it's not actually hacking. and as far as all the other allegations against this guy, where they're saying that he may have violated wiretap laws, all the things they talked about are stored communications. those communications are not in transit. e-mail, voicemail messages, all stored communications and none of those actually violate the wiretap. there may be some issues if he violated the security on those accounts where he didn't have access to, and that is hacking at the federal level and state levels and punishable -- >> you know, john lucich, i'm not exactly sure what you just said, but after practicing law since 1984, and yes, i will date myself, i know that it is a crime -- i don't need to go look it up in the code annotated. it is a violation of the law to hack into somebody else's e-mail account, to hack into their cell phone account, who they've been calling, who they've been texting -- >> if that's what he did. you can get access to that e-mail without going into that account. it's all on that hard drive, and if someone imaged that hard drive and if he's a technologist and knew how to get access to those files, he could easily recover that without accessing it. >> can you break it down, lucich? can you break it down? you don't need to throw around all the fancy computer talk with me. are you trying to say that if he's sitting at the home computer and he's got access to it there and he doesn't have to hack in, it's not a violation, but if he is remote and he's using somebody's pass codes or otherwise getting in surreptitiously that that is a violation of the law? >> absolutely. it's a violation of the law. >> okay. got it. out to the lines, chantel, pennsylvania. hi, dear. uh-oh. marilyn, missouri. go ahead, marilyn. >> caller: yeah. everybody's talking about it's jon and kate's money. it seems to me like it's the kids' money. why ain't they putting it in an account and have a guardian take care of it? >> marilyn, truer words were never spoken. if she's telling the truth, to you, jennifer smetters, renee rockwell, bradford cohen. she said that they started this whole venture of the reality tv show to better their children, to let them all go to college. for pete's sake, they've got eight of them. renee rockwell, why isn't there a guardian taking care of the children's finances? >> there will be now, nancy. and what a recipe for -- >> well, that's a day late and a dollar short. >> i know that. but what a recipe for disaster when you have $230,000 and people that are in a joint account and people that are at each other's throat. i think that they were bound, somebody was bound to grab that money. >> you know what? we don't know all the facts yet, cohen, but you tell me, ed hardy t-shirts, mercedes, bmw, sprees to las vegas, a bachelor pad in new york. uh-huh. that is not fitting together with a guy who wants to restore family values. and all you people that think, oh, kate was a witch, she was evil, she was mean, that's not what this is about. this is not miss congeniality or mr. personality contest. this is about an alleged crime. >> oh, yeah. listen, everyone agrees, i don't think anyone is an angel in this. certainly he looks worse than she does at this point. but who knows what's going to come out? the behavior that he's, you know, doing at this point obviously is not the behavior he wants his kids to see -- >> i'm asking about a guardian. and everybody, you're seeing pictures of jon and kate's children from tlcdiscovery.com. repeat, bradford. >> i believe there's probably trusts that were set up for these kids. i don't think that $230,000, from what i've read, was attributable to the kids' income. i believe that the kids have separate accounts, is what kate said originally, that they had separate accounts. now, i don't know for sure because we don't know -- we haven't verified that fact. >> got it. >> but usually in situations like this there are separate trusts set up for minors. >> to smetters, jennifer smetters, why has the court not set up a guardian for the children's finances so exactly this type of thing couldn't happen? >> well, you know what? sometimes the courts actually expect that the litigants are going to have some integrity and follow the court orders. that didn't happen here. they're going to see a guardian appointed now. and also probably a guardian for the children to see what their best interests -- to make sure their best interests are being met. >> to stephanie in louisiana. hi, stephanie. >> caller: hi, nancy. i love your show, by the way. >> thank you. >> caller: but i was just wondering why everybody's coming down so hard on jon and nobody's saying anything about kate? >> okay. stephanie. what do you have to say? >> caller: well, i mean, talking about how he has these cars. but if you look at her, she's got two vans. she lives in a $1.2 million house. and everything she gets is free. nobody's saying -- >> but remember. remember, stephanie, that's the home where the children live. >> caller: correct. >> when it's her visitation, she's there. when it's his visitation -- >> caller: but she goes on vacation. >> as i was saying, when it's his visitation, he lives in the home. it's kind of a little bit of a wacky situation. >> caller: it is. but she's always taking vacations, and she's got all these nannies for these kids. she's not even with them. >> everybody, we are taking your calls live. but quickly to tonight's safety tip. atms on every corner. and so are crooks. common sense goes a long way. never use atms in the backs or sides of buildings. find one in a very busy common area. prepare your deposit slips and envelopes ahead of time. with those drive-up atms keep the car running and the door locked. never, never, never write down your pin number on your card. i know it sounds obvious, but thieves steal thousands, hundreds of thousands of dollars every year that way. and don't flash the cash when you remove it from the atm. don't count it there in public where it can be snatched. it's an invitation to be robbed. wait until you're in a secure place. for more information on how to stay safe go to homesafetycouncil.org. to be the subject of two 911 >> where is she at right now? >> we're coming up like to the rest area exit lake mary boulevard. so somebody on lake mary boulevard can probably get on. >> is someone else in the vehicle with her? >> yeah. i don't know. these people are scaring me. i don't get scared easy. >> is the passengers a white, black or hispanic. >> white. >> female or male. >> i think female. i'm not sure. >> and what are they doing now? >> just driving. i don't know i'm trying not to look at them. >> and what kind of car are you in? to be the subject of two 911 calls in just a spate of months is not a good thing for girlfriend-turned-stepmother misty croslin. she was at home alone the night a little girl, 5-year-old haleigh cummings goes missing out of her own bed according to croslin. and now she's accused of a road rage incident that left courtney ballinger allegedly in fear of her own life. does it ever end with this bunch? courtney ballinger, you're a pharmaceutical sales rep, you have to travel from doctor to doctor, hospital to hospital, you can't get away from being on the road. i would assume as a lady living by herself making a living that this is one of your fears, that there would be some type of incident on the road. >> absolutely. i've done this for over a year now, driving every single day, all day. and i've never come in contact with someone so aggressive and so relentless on, you know, just nonstop. i mean, i've never come across someone so aggressive. >> how long do you believe that they pursued you? >> about 30 minutes. i would say it was about 30 minutes. i ignored it for the first ten minutes. which doesn't seem very long. i mean, it was a very stressful ten minutes. when they reached down and started flailing something around, they wanted me to think that they had a weapon. they wanted to scare me. that's when i called the police. >> out to the lines. cathy in florida. hi, cathy. >> caller: hi, nancy. i just want to say my mother and i love your show, your beautiful children, and our prayers are with your mother. i have a question about the storm door. if misty got up and seen the storm door open, held open by a block, was the inside door held open also, or -- i just don't understand that part. >> to rosy in the control room. see if you can pull up that video of marlaina in the home showing us that door. marlaina schiavo, while we wait for that, explain. >> the answer to that is, no, she wouldn't have seen it immediately because the inside door closed automatically. the only theory that we have, and it's only a theory, is maybe the inside door was propped open with some laundry on the floor maybe holding it open. so that's where we are with that. >> you're seeing the inside of the home. there's the video of marlaina's tour of the home. just keep that rolling, because in a moment we'll see marlaina walk to that back door. that was allegedly propped open. cher in illinois. hi, cher. there's the door. go ahead, chir. >> caller: hi, nancy. love your show. >> thank you for calling in. >> caller: praying for your mom. >> thank you. >> caller: got a question regarding misty. with her flunking two polygraphs and a voice stress test and everything else that's been reported about her, she would have to be considered a person of interest. why do they keep letting her leave town? >> let's go to the lawyers. john burris, san francisco. raymond giudice, atlanta. john burris, just as a person of interest, they can't make you stay put. >> absolutely not. person of interest, as you know, is free to go. they might think you're involved but they don't have sufficient evidence to tie you into it. so they're free to go wherever they would like to go and no law can stop them. they need to go to a different level to have probable cause to arrest them. in order to justify keeping them in a location, but otherwise they're free to go wherever they like to go. >> you're right. and raymond giudice, she has not been named a person of interest and i think there are reasons for that. either they don't have the evidence, or once you're named a person of interest, that could invoke your constitutional rights. >> that's right. additionally i do think that they're allowing her -- this type of behavior and hopefully something else to lead them to, i hate to use that phrase, the smoking gun, the crucial piece of evidence to solve this crime. >> to dr. michael bell. back to haleigh, herself. if the child is still alive, we know she has intense asthma and turner syndrome. if she is alive, what obstacles is she facing? >> well, i think the biggest problem would be her asthma. if she has a serious asthma condition, she's going to need medication. asthma is going to prevent you from breathing normally and that could be a very serious condition. everyone, very quickly, still taking your calls. i want to tell you about a group of boy scouts, and a mormon missionary student who allegedly commit murder on a defenseless woman asleep in her own bed. a mother and attacked the 11-year-old little girl. take a listen. >> prosecutors say christopher >> prosecutors say christopher gribble was armed with a knife and steven spader had a machete. authorities say william marks and quinn glover were also armed when they entered 4 tro road in mont vernon. kimberly cates and her 11-year-old daughter were sleeping inside. gribble and spader face three charges including first-degree murder. both suspects hit kimberly cates and her daughter with the weapon. kimberly cates died in her bed while the 11-year-old suffered serious injuries. marks and glover are not charged with murder but are with burglary, conspiracy to commit burglary, and armed robbery. >> to maria cramer, crime reporter with "the boston globe." i understand daddy had gone out of town? >> yes. he was away on business. and kimberly case and her 11 year old daughter were at home alone when the attackers came in at 4:30 in the morning on sunday. >> what went wrong maria? boy scouts missionary students? >> two of the young men charged were boy skoutsz together. basically, they fell apart what we're told by family and friends, or friends and neighbors that chris began to you know, dabble in knives and steve spader was bipolar and not taking his medication and around his sophomore year in high school people noticed a change. he was dressing differently and acting did havely. not the friendly funny kid he used to be. >> we'll be right back with maria from the "boston globe" taking your calls.
