it's down about 6% in pre-market trading right now and last night, the bank's ceo announced a $2 billion loss in april over some badly hedged bets. in an apology to the boss from the vice president, senior administration officials say joe biden has apologized to president obama for painting him into a corner on the same-sex marriage issue. cnn's jessica yellin broke that story for us. biden came out in support of same-sex marriage on a sunday morning talk show, and that may have forced the president to make his own announcement ahead of schedule. president obama's change of heart on same-sex marriage made history in more ways than one. moments after he made the announcement on abc news his official twitter account posted the tweet, same-sex couples should be able to get married, and that is on its way to becoming the most re-tweeted message of all-time. hacker who actually tracks the president's tweets says it's been shared more than 56,000 times and counting. this is as of yesterday. twitter says president obama's announcement also generated more than 1.6 million reaction tweets. that number peaked at 7,000 tweets per minute yesterday afternoon. and it was starmageddon last night at the estate of george clooney. president obama rubbing elbows with 150 guests each donating 40 grand for the privilege. among them, barbara streisand, her husband and actor toby magui maguire. >> how many of the folks do you think were there for the president and how many were there for george clooney? >> you know what? the president actually said most of them were probably there for george clooney. >> he might be right about that. zoraida, thanks, appreciate it. the family of army sergeant bo bergdahl so frustrated they are revealing potentially a secret deal between the united states and taliban for a prisoner swap, exchanging him for five prisoners held in guantanamo bay. an administration official is telling cnn they were trying to work out a sequence, moving two prisoners to a third qui like qatar and bergdahl would be released and the united states would let three other prisoners go. the negotiations stalled, prompted bergdahl's father so desperate he told the "new york times" the rhetoric is that we don't negotiate with terrorists and therefore what do we do? well you push it hard with everything you have." bergdahl was captured june 30th, 2009 in afghanistan. in one video he claims he was captured after he fell behind on patrol. his message was posted by his captors online in 2009. obviously in a hostage situation. we wanted to play a little clip of what he said. >> well i'm scared. i'm scared i won't be able to go ho home. it is very unnerving to be a prisoner. >> obviously a brutal experience for bergdahl's family and one man who might have insight is michael berg, his son, nicholas, you might remember, was also captured by insurgents back in 2004. nicholas berg ended up being beheaded. mr. berg, i appreciate you joining us this morning. thank you for being with us. you i know in the past -- looks like i've dropped -- there your shot is back. forgive me, we had a little technical difficulty. you advocated for a prisoner exchange in the past after your son was executed and you were blasted for that. now we see this negotiation for a swap of prisoners out of gitmo for bowe bergdahl? do you think it's a good thing, and if you do, why? >> obviously it's a good thing, lives could be saved on both sides. how could anyone lose in that situation? >> the argument as i'm sure you're aware, against would be that if you in a way reward a kidnaper by doing a swap, it encourages more kid napgnapping anybody who agreed not to be an insurgent in terms of release probably would, the minute they're released go back to being an insurgent. do you worry that some of these arguments could have some truth to them? >> well, first of all, i don't think that this is a kidnapping. this is a political action, and the attitude of we don't negotiate with terrorists is what's gotten us into the terrible mess we're in, in afghanistan, and iraq, as we still are in iraq. it's the same kind of attitude that probably prompted the attacks on the twin towers. we don't negotiate. well, if you don't negotiate, you don't use diplomacy, then people fall to violence. so to me, that's, negotiation, diplomacy is what you should do. negotiation, diplomacy is what you must do, and as far as these people in guantanamo who would be released going back to being terrorists again, none of them have been proven to be terrorists. what happened to the united states of america, where you're innocent until proven guilty? these people haven't had trials and it doesn't look like they're going to get any kind of a fair trial, and if they did go back and they did become insurgents, they would be in the same category as americans who wanted to right a wrong and i think the invasion on iraq and afghanistan were wrong and i don't agree with violence. i don't agree with war. but these people are not doing anything any differently than we would do. >> mr. bergdahl said he's become so frustrated with the process, the secret negotiations, potentially with a swap that would involve his son that he just started doing direct negotiations with a person he believes at least has links to the taliban, and he's told them, stop sending videos and messages to the american people and instead, try to speak directly to the president. do you think that's good advice? would you if you were advising him in any way tell him a similar thing? >> probably. i think with this president, he's fortunate in a way that he's dealing with this president, and not the president that i had to deal with, whose only political statement about that kind of thing was, we don't negotiate with terrorists. from what i know, offers were made by al qaeda for my son, money or prisoner exchange, i don't know what the details were, but they were rejected just on point, just because they were negotiations. so i think that dealing with the president, who seems to be a human being, who is the current president, seems to be a human being, seems to be the kind of person who would react to a father's plea like that. >> mr. bergdahl, we've seen him in videos he directs to his son's captors. i want to play a tiny bit and ask you a question on the other side, sir. >> -- past time for bowe and the others, to come home. to the nation of pakistan, our family we wish to convey our compassionate respect. we have watched the violence of war, earthquake, epic floods, and crop failures devastate your lives, all while our son has been in captivity. >> you, sir, have been in the horrible position as well as trying to figure out what is happening to your son. what kind of advice would you give mr. bergdahl as his family tries to navigate who has got to be an absolutely horrific experience for them? >> keep on trying, to try everything that you possibly can, and especially to take advantage of a resource that he has that i did not have and that was the attention of the media. when my son was missing, i contacted the media. i contacted every television station, every major newspaper that i could think of, and since my son's disappearance wasn't public, no one wanted to have anything to do with it. he's got that resource. if i were him, i would go to the media. i would be on the media as much as i could every day, every minute of every day, letting people in the united states know that we've got a president, we've got politicians that could bring his son home. all they'd have to do is say the right words and do the right thing, and we need to have that kind of pressure on our politicians, because they don't really respond to what we want generally, but i think if enough people tweeted about that, he might get some action. >> michael berg is the father of nicholas berg, who was killed back in 2004, thank you for your time. appreciate it, sir. >> you're welcome. still ahead this morning on "starting point," we'll tell you why mitt romney says he's sorry for an incident that occurred nearly 50 years ago, when he was in high school. he's being accused of bullying when he was a teenager. and masterpiece mystery, and the mob. new clues in the biggest art heist ever, that's the fbi to the home of a mobster. panel heading in to talk about all that and much more this morning, joined by abby huntsman, mark lamont hill and will cain and this is mark's playlist, anthony hamilton featuring david banner "cool." a good way to start the morning. good morning, guys. [ meow ] [ male announcer ] another example of volkswagen quality. that's the power of german engineering. right now lease the 2012 jetta for $159 a month. welcome back, everybody. new developments in the case of history's biggest art heist. 22 years ago, i was a producer in boston when this happened, this was a huge story, 22 years ago, 13 priceless pieces of art went missing or were out and out stolen from a boston museum including one of only 36 rumieres that exist in the world, three rembrandts, one manet and five drawings of edward degas. the heist total up to half a billion dollars. new break led fbi agents to the home of robert gentile, an alleged mobster who lives in connecticut, being held on bond with totally different charges. they found two guns but no art. this morning we're joined by mr. gentile's attorney ryan mcguigen. why are they back searching your clients' home and yard, using beagles, a ferret material to examine things under the ground, i'm not joking, right, beagles, ferret, digging in the backyard? >> no, there weren't any beagles. there wasn't a ferret, but there were two labrador retrievers, ground penetrating radar, about 30 agents and about all the resources that the federal government could utilize to find something. the reason that they were back is that they did not find the paintings in the original search so they filed for a second warrant, looking specifically just for firearms, but really what this warrant included was the ability for them to search the proper surrounding the house so they could dig up the property to look for the stolen art. >> so here is what they found in the original search back in february. four guns, ammo, explosives, including two dynamite sticks, homemade silencers, bullet proof vest, a stun gun, police scanners, $20,000 in cash stuffed in a clock, and a set of brass knuckles. what led to a second search warrant and the artwork stolen more than 20 years ago, what is the connection? >> between those things? absolutely nothing. they weren't looking for those things. i'm sure they would have been happy if they found the art. the reason why my client is facing serious problems in his federal case now is because he was a convicted felon for a larceny case back in 1996, and because of a federal statute, any felon who is found in possession of weapons faces ten years in prison. but i can assure you, they were looking for art, not guns, because if they were looking for guns, he's already facing potentially 30 years in prison for the three guns that they actually did find so why would they need to go back looking for guns and how did they miss them in the first place? >> right. i think the first, i think the fact that he's facing 30 years in prison, that he's being held without bond, he's a 75-year-old man, the co-conspirator in the underlying case has been released on essentially a promise to appear. he has a non-surety bond so he didn't have to post any money and he's out on the streets. the underlying case doesn't really look like a very serious one, unless of course, they're actually trying to apply pressure on my client to give up information that honestly he just doesn't have. >> so your client has associates who the police suspect are actually involved in the art heist, unless you think that they're really digging up dirt to see if they can find artwork that's been buried in the ground. does your client know anything about the art theft? does he know associates who could reveal information about this? >> he has spoken to the grand jury. he's not a new person of interest to the fbi. they've known about him for years. he's spoken to the fbi about the information that he does have. he's not a suspect in the heist itself. he may have been associated with people that the fbi suspects actually committed the heist. >> does he have information that if he turned it over, he has given all the information? that's the $64,000 question at the end of the day does your client have information if he gave it to the fbi they'd be able to track down half a billion dollars in artwork? >> that's a good question and the answer is this, that if he does have the information, it certainly would be in his interest to give it, because the underlying case, i'm assured, will go away amicably, and he also, that means he'll be able to go home to his wife and his family, and he'll also be given a $5 million reward. now, any person in their right mind would take that deal, would they not? >> i think we're covering this later the fda approving the new drug for obesity, it just seems to me like it's in "the wall street journal" this morning and it seems like another quick fix of how to solve the issue. we talked about how 40% are going to be obese by 2030, 40% of americans and you know you think about 75% of health care costs today has to do with diseases linked to obesity, and this new drug says there's a small risk of cancer and heart valve disease and you think there's never going to be the perfect answer. i think we need to start talking about personal responsibility and not looking at drugs to solve the problem. >> multifactorial. i think approaching it from that and also prevention and i think clearly we have to rethink how people are eating. >> absolutely. >> you see some young teenagers who are obese. >> exactly. >> 30 pounds overweight at 11, 12, 13. >> they shouldn't be taking pills at that age either. >> unless it's extreme circumstance, fine. my wore i have people on the outside will be no longer obese but the inside still be messy. >> you got to approach it from several fronts. mr. hill, what have you got? [ male announcer ] go online to reach every home, every address, every time with every door direct mail. ♪ i want to do a whole compare and contrast between zoraida's playlist, that's shakira "she wolf," with will cain, slower, more southern. it's like my playlist with my husband when we got march rid, my cd collection and his cd collection and never the two shall meet. >> just for the record i like country music. >> i know you do. >> typecasting him all the time. thank you so much. the john edwards corruption trial reaches a crossroads. the defense plans to ask the judge to dismiss all charges claiming prosecutors have not proven their case. the prostitution rested without calling edwards' former mistress rielle hunter to the stand. the defense begins presenting its side monday. no word on whether they plan to call hunter to testify. a u.s. commuter flight had to be diverted when a disoriented passenger tried to open the door while the plane was in the air. the passenger was subdued by a flight attendant. he is in police custody this morning. a $2 billion bombshell from the ceo of morgan chase admitting in a conference call that a trading portfolio call designed to help morgan chase hedge its credit risk lost $2 billion and could lose $1 billion more. >> the new strategy was flawed, complex, poorly reviewed, poorly executed and poorly monitored. the portfolio has proven to be risker, more volatile and less effective an economic hedge than we thought. >> morgan chase's stock is down about 6% in pre-market trading so far this morning. and the drug truvada already approved for treating aids, might soon be approved for preventing the disease, in high-risk patients. an advisory committee recommending the food and drug administration bless truvada as a preventative medication by a 19-3 vote. the fda does not have to abide by the committee's recommendations but it generally does. truvada prevents the aids virus from replicating the body. the catholic church is investigating the girl scouts. bishops are concerned the scouts are promoting abortion and contraception. the girl scouts have been criticized for some materials that feature links to groups like oxfam and the sierra club, critics say those groups promote access to contraception. the girl scouts have changed some of the material as well and spooneded to the bishop's concerns. the catholic church could ban scouts from holding meetings in its churches. catholic girls make up a quarter of the nation's 3 million girl scouts. back to you. >> thank you. mitt romney responding after his former high school classmates accused him of bullying a vulnerable student as it was first reported in "the washington post." romney's former classmates say he was part of a group of students who targeted a boy many thought was gay. they accused romney of cutting clumps of the boy's hair off. one of the classmates, phillip maxwell, told abc news "it is a haunting memory, i think it was for everyone who spoke up about it, because when you see somebody who is simply different taken down in in a way and is terrified and you see that look in their eye, you never forget it." mitt romney was asked about that on fox news yesterday and said this. >> first of all, i had no idea what that individual's sexual orientation might be. going back to the 1960s, that wasn't something we all discussed or considered. >> the romney campaign put forward two classmates who countered those accounts. john french wrote "mitt never had a malicious bone in his body, trying to imply or characterize him as a bully is absurd." kerry healey is a romney campaign adviser, former lieutenant governor as well. nice to see you.. thank you for talking with us. >> good to see you, soledad. >> in "the washington post," they talked to several people who recall with great detail and what sounds like a tremendous sense of guilt about that attack on this kid. it's a hack job, it was vicious. you see the look in the eye, you never forget it, phillip maxwell. to this day it troubles me, thomas boouford, he was easy pickens, matthew friedman. people might wonder governor romney says he does not even recall the event today when others seem to remember it so clearly. how is that possible? >> we have to take governor romney at his word about this. obviously our memories of the past are very different. i just spent a week sitting in the hospital with my 86-year-old mother talking a lot about the 1960s and 19 0s and we remembered very different things and the same things differently so i think we have to take him at his word. what everyone wants to know, the real question here is mitt romney a bully and the answer is no. mitt romney is absolutely, as his other friend from high school said, he does not have a vicious bone in his body. if the american people want any evidence of this, all they have to do is go back and think about the 20 different debates that they got to watch him in during the course of this primary season, where he was being attacked from every side, and his response was always professional, calm, civil, in fact he even intervened on behalf to try to help governor perry when he was stumbling. so i think his impulses are very kind impulses, and there should be no debate about whether or not governor romney is a bully. >> one area i'll correct you the governor is of course not an 86-year-old grandmother recalling the '60s and the '70s. the newspaper goes on to tell a pretty harrowing story later the attackers runs into the victim, whose name is john lauder, i believe, and sees him in a bar and says, lauber paused and responded it was horrible. he went on to explain how frightened he was during the incident, acknowledged it was something i've thought about a lot since then. do you think governor romney actually owes a bigger apology or needs to say something more about this or is "i don't remember" and "if i did something bad i'm sorry" enough? >> i think he'son gond that already. he said he'd done some stupid things in high school and we all have. anyone watching this today would feel a little bit uncomfortable about having their high school years completely dissected and taken apart in this manner. it was 48 years ago, so the question of how much one remembers i think is very valid, so the main question for the american people is, is this a character trait that they should have any concern about? i've known governor romney for the last ten years and i can tell you that he is unfailingly kind. he's deeply concerned about what goes on in other people's lives. he's been terribly moved by the stories that he's hearing out on the trail about the economic impact of the downturn across america, the unemployment, and so i have to say that what people really want to hear about is, does he care, and i can tell you that he cares deeply. it's a deeply compassionate person and that bully something not something that he has ever knowingly engaged in. >> kerry, this is will cain. soledad just asked you if the governor should say more on this topic. i'm quite confused as to why he would say anything on this topic. kerry you said the real question, is governor romney a bully. i don't know, is that the question? is that the news value of this story of something that happened as you said 48 years ago? i don't understand what we're supposed to do here, look back into history at various candidates' high school years and draw a larger lesson about what kind of people these guys are? this seems like a dangerous slippery slope and i'm quite confused why you guys are even talking about it, why you're entertaining this issue. >> i couldn't agree with you more. i think the purpose for us to be out here talking about this today is to simply draw attention back to the real issues in this campaign, to talk about the economy, to talk about that yes, he is deeply concerned about the plight of the american people, that there are 23 million people still unemployed, that unemployment has been over 8% for 29 consecutive months now. 5 million people have stopped looking for work. those are really the things we should be talking about, not something that happened 48 years ago. >> yeah, kerry t also seems the american people care about the rights of gay people and part of what might make the story resonate with people, with we an entire week where the country made progress on gay rights, and at the same time a story comes out that shows that perhaps governor romney at some point in his life was abusive to a gay person. don't you think the governor has some responsibility to address that issue from the perspective of protecting the humanity and the safety of gay and lesbian people? >> i think that he has addressed that issue to the extent that he said he had no idea that this individual might be gay, and governor romney has an excellent record in terms of employing gay individuals in his administration, making sure that they are treated with respect, so i don't think that he has any record to be concerned about in this record. >> kerry healey is a romney campaign adviser. thanks for talking with us. >> good to see you, soledad. still ahead on "starting point," bristol palin rips into president obama for taking his daughter's advice on the same-sex marriage issue, what she said that fired up everybody on twitter. >> and j. lo tweeted back, j. wow. >> voices of authority. plus he's not only a shot blocker on court but defender of fatherhood as well, nba star and father of three eton thomas will stop by our studios. you're watching "starting point." president obama making history this week when we announced his support for gay marriage, mentioned two young advisers who helped him in his evolution. listen. >> malia and sasha have friends whose parents are same-sex couples. there have been times michelle and i have been sitting around the dinner table and talking about their friends and their parents, and malia and sasha, it wouldn't dawn on them somehow their friend's parents would be treated differently. it doesn't make sense to them and frankly, that's the kind of thing that prompts a change of perspective. >> so after taking his own daughters' words to heart the president under fire from another political daughter, bristol palin, the daughter of former alaska governor sarah palin wrote "it would have been nice if the president would have been an actual leader and helped shape their thoughts instead of merely reflecting what many teenagers think after one too many episodes of glee." she goes on to say "in general, kids do better growing up in a mother/father home. ideally, fathers help shape their kids' world view." so? >> yes. i took my private jet back here because george clooney always wants me to sit next to him at whatever dinner is he holding for whomever. >> don't we all wish? >> one day we talk sudan and next day we're having dinner. no. of course not. thank you, zoraida. there's new pressure this morning for the democratic national convention to get out of charlotte after north carolina voters passed an anti-gay marriage amendment, an online petition on change.org calls on democrats to "in protest the democratic national convention committee should move its convention to a state that upholds values of liberty and treats all citizens equally." it's not silencing critics. 29,000 people have signed the petition. i spoke with the mayor of charlotte, anthony fox. roughly 30,000 people have signed that petition. are you concerned about the success of your convention? >> well, look, the democratic party has already said the convention is staying in charlotte and frankly if we had a referendum on every single issue that people disagree, we wouldn't have a convention. charlotte is a great place for the convention. it's in a state that had to reinvent itself over many, many years. it's in a state that continues to be a place where we continue to make strong investments in infrastructure and those are two big issues, education and infrastructure. the president talks about that a lot. i think over time north carolina will continue to evolve with this issue and many others. >> the folks from occupy wall street when they were doing protests at the bank of america meetings say it was a test run for the convention. what's the security going to be like? what are plans and are you concerned about those kinds of protests within the bigger called for boycott? >> well, you know, there will always be demonstration activity associated with either political convention. our law enforcement agencies are working closely with federal law enforcement agencies to ensure that the public is protected and safe but also that people who want to express their views have an opportunity to do that. i feel very confident that we'll strike that balance in the right way. >> the state tourism website visit north carolina has become a hot bed of angry comments. i was reading some of them. it was crazy. i know clay aiken from your state weighed in as well. he said i don't want people talking bad about north carolina. you can be as mad as you want but you have to remember that 30 states did that before we did it. you can kiss my foot if you want to talk bad about my state. do you think that message, that kiss my foot message is getting out to folks? >> you know, i don't know about kiss my foot but i do think that the fact that there have been 30 other states that have taken this measure and including now north carolina draws attention to this issue and frankly i think that north carolina still has many, many positive attribut attributes. i would point out that charlotte and the county in which it sits defeated the referendum by 54% to 44% margin. >> will you continue to point that out as people are calling for a boycott? >> if necessary. again, i think that it is important to have this convention and to have it be successful and to have a full and fair debate on the issues of conscience that have been raised by this amendment and many other issues that affect our country. the most important thing is that north carolina and charlotte are a good backdrop for the president to launch into his fall campaign. >> what do you think that will mean for the election? you have a president who says he supports gay marriage and north carolina is an important swing state. how does it end up in the election? >> it's interesting. polling was done prior to the recent election that showed that 55% of north carolinians believe there should be some form of recognition for same-sex couples and so the public in north carolina is split on that. i think that when we get into the fall, people will care more about the job plans of both candidates a lot more about what the candidates are going to do to improve the health of our country. >> anthony foxx is the mayor of charlotte, north carolina. nice to see you. appreciate you being with us. >> great seeing you. thank you, soledad. >> still ahead on "starting point" this morning, before we get that i have a second. what do you think? [ crowd cheering ] high schools in six states enrolled in the national math and science initiative... ...which helped students and teachers get better results in ap courses. together, they raised ap test scores 138%. just imagine our potential... ...if the other states joined them. let's raise our scores. let's invest in our teachers and inspire our students. let's solve this. welcome back, everybody. secret sheriff's click in l.a. with a surprising tradition facing serious scrutiny this morning. internal affairs for the l.a. county sheriff's department is investigating a group of officers within the elite gang unit known as jump out boys and they are identified by matching tattoos which apparently were modified to celebrate invol involvement in a shooting. officers would add smoke over the barrel of a gun, which is held by a skeleton with a bandan bandanna. the two playing cards, an ace and eight an illusion to dead man's hand in poker. joining me this morning is a reporter who uncovered this story. thank you for being with us. walk me through the latest in this investigation. >> well, when we first broke the story several weeks ago, all investigators knew was that a brochure was discovered in a patrol car basically laying out the creed for the jump out boys. most disturbingly the idea that shootings which are supposed to be seen as events of last resort were treated like badges of honor. at that time the sheriff's department was telling us, look, we don't know of any known members. this may simply be a fantasy. it may be a hoax. now this week one deputy has come forward as a member and has apparently named according to our sources about six other deputies who are also part of the click. >> so walk me through how this click operated. >> well, the point of clicks like this one and many others that have existed in the l.a. county sheriff's department and historically in law enforcement agencies across the nation is that they work in secret. only members are supposed to know how they work. in fact, a lot of my sources who have come across similar types of clicks during their careers have been shocked that this one laid out its creed on paper. >> honestly doesn't seem like a really smart thing to do for secret society to create a brochure that's accidentally left in a police car. a lot of this focuses on the tattoo that the members seem to have and then modify every time there's a shooting. can you describe the tattoo for me in more detail and how that worked? >> so the tattoo looks a lot like the tattoo associated with a group of officers who composed the lapd's rampart scandal several years back. you have the skull with glowing red eyes. you have the supposed dead man's hand, which is a poker term. and you've got the revolver that the skull is holding and pointing at the viewer. now, what's most disturbing about this suspected tattoo is that upon being involved in a shooting, members would have the tattoo modified to have smoke coming out of the barrel. that hasn't been absolutely confirmed yet but that's what investigators are working on right now and this would be most disturbing to sheriff's supervisors because shootings even shootings that are well within policy, even shootings that are necessary are expected to be perceived as somber events. events you don't celebrate in this fashion. >> this is will cain. for viewers that may not remember, the rampart division was a division of the l.a. sheriff's department that was involved in bad shootings. are there connections between the scandal and personnel with management involved in this one? >> that was an lapd scandal and not a sheriff's scandal and in that case what we saw was in addition to these hallmarks that we discussed before, we also saw evidence planning, bad shootings, you know, the kind of police work that led to false imprisonment and that kind of thing. we haven't seen that kind of misconduct in this case yet. that's simply because what's known right now is very little. investigators don't know one way or another and we don't know one way or another whether further misconduct was involved with this group's behavior. >> robert is a staff reporter for "the l.a. times." nice to talk to you. thanks for the update. appreciate it. still ahead on "starting point," get real. unzip code. talking about people getting naked. and yet the postal workers are unhappy with their route. they have to deliver to the neighborhood nudist. they don't want to see all that. >> i would think they would be happy about that. >> depends on who is at the door. >> are you purposely saying naked? >> my daughter says naked. is that wrong? >> naked. >> when i talk to 6 year olds, they say naked. >> the guy with texas correct g ing anunsation. >> coming up, we'll all get naked. >> you can follow us on our mobile device. go to cnn.com/live. the playlist, jay z. no. well, all right. thanks. okay, here we go. whoa! no one said "cheese." progressive mobile -- insurance has never been easier. get a free quote today. ♪ >> that's queen "don't stop me now." we should start every show with queen honestly. let's turn to california now. their efforts to ban a form of psychotherapy that claims it can make gay teenagers straight. it's now in the state senate. supporters say the treatments don't work and they could cause harm. conservative religious groups say that ban would interfere with parents' rights. a state senator wrote the bill. and one says it didn't change his sexual orientation, he's now married to his same-sex partner. nice to see both of you. senator, let me start with you if i can. the ban would prohibit the therapy for minors and adults would have to sign a waiver saying that it is likely ineffectual and it could be dangerous. why do you think this is necessary? >> because the entire medical community has come out and rejected gay conversion therapy as an authorized practice. that's because being a homosexual is not a mental disease or illness that requires a cure or fix for the same reason being a heterosexual is not a mental disease or illness. american psychiatric association has stated it is unprofessional conduct for a therapist to engage in this kind of repa repairitive therapy. >> if a way could this make it worse? if you look at the number of churches now that offer this therapy, which is lay people or clergy, gone from 2002 with 115 to 2012, 263. it's kind of growing wildly there. do you worry that you shift it away from being able to be monitored? >> i would caution anyone who wants to seek therapy that they go through a licensed therapist. the reason that this bill doesn't affect religious institutions is because of the first amendment to the constitution so we're completely silent on the religious issues in this bill. >> i want to ask gabriel a question if i can. you went through this therapy when you were a teenager. tell me how you got to that therapy. >> it's not just that therapy can cause harm, it does cause harm. a study commissioned between 2007 and 2009 shows that because it encourages kids to see hoko sexuality as a pathology, it runs a risk of making them be suicidal and i was in therapy for 3 1/2 years from the time i was 14 until i graduated from high school and it indeed lowered my self-esteem, made me think of suicide and made me depressed. >> what do they do in therapy? what is the therapy? >> starting in the 1970s when the american psychiatric association declassified homosexuality as a mental illness, there stopped being therapy changed. it used to be the case that gay people were given nausea inducing drugs and electric shock therapy but now i would say it's more benign but it's still harmful. now it mostly involves talk therapy in which patients are encouraged to see their sexual attractions as a result of family trauma, of failure to connect with their fathers. >> the other side of the argument is that i think a lot of parents feel it's important that their children have a place to go. a lot of church communities feel that they need to have certain services in place where people can go when they first wake into their sexual orientation. do you feel there are services that are healthy and that can be helpful that you experienced or do you think that doesn't exist? >> you mean if you are asking about the therapy i would say the answer is no. luckily the vast majority of psychiatrists and psychologist practice gay affirmative therapy and encourage kids as well as adults to see their sexual attractions as just a natural variation of human sexuality. >> this is will cain. here's my question for you. as you said, the various psychiatry associations have said the therapy doesn't work and we shouldn't do it. what you guys are talking about doing that may be a better question for the congressman here, you are looking to make it illegal. doesn't that place you into that psychiatric room and into that psychiatrist counseling session with each client and you're going to have to parse conversation going on between psychiatrists and their clients and their patients to find out exactly what's going on every one of these situations. >> i don't think that's -- >> government steps in and bans dangerous things from children so we don't let parents consent to have their children smoke or to have their children drink alcohol. and for the same reason, i believe we should ban it for children under 18. >> you do that by putting age limits on sales. how do you implement this? do you place a government official inside the counseling offices? how do you keep what amount to conversations from taking place? >> so we have a strict definition in the bill and it people go through this therapy as a child and get harmed, they can sue the therapist. >> gabriel, you were going to add to that. >> look at the controversy over the woman who sent her child to a tanning salon. it's very similar. this therapy is really harmful and it's like giving your child the contents of a medicine cabinet. vulnerable kids the contents of a medicine cabinet. it's one thing for adults to be able to have freedom to pursue it if they wish. it's another thing entirely to take vulnerable children and well intended parents like my own and send them to this harmful therapy. >> i think there's an argument that people would say about the slippery slope, right, that ultimately at what point does it stop? does the government interfere saying to parents you cannot choose this for your child whether they are wrong headed about it or really thinking what they believe as you say rightfully about their intentions. at what point does that stop? at what point does the government not interfere in what they can tell a parent to do for their kids? some of the criticism has centered on that. >> i would say that that line is -- there's actually a very definitive line and that there's not really a controversy in the medical and psychiatric communities about whether the therapy is harmful. it's widely thought and widely been shown to be harmful. i would say that the line stops when you have established evidence that this therapy is harmful. sir, do you have a quick final word before i run out of time? with all of the money and resources that we have in this country, what are we doing wrong? >> there is not a lot of women that are covered health insurance. one out of five women in this country do not have health coverage and if they don't have health coverage and they're pregnant, it's a pre-existing condition and that shuts a lot of women out of health care and it is so critical for so many women because even when you don't have a chronic health condition, something can arise during a period of time where you are carrying a child. it's important that every woman has that care and that's something that should come with our reform actually here. >> i've read that this really became your baby so to speak forgive the pun. you had your own complication which is your daughter, grace, was born and this became a film as well. can you talk about that? what happened? >> i had a great pregnancy and delivery actually with grace eight years ago. afterwards, which is when a lot of complications arise, i started to hemorrhage. and i wasn't expecting it. i wasn't a case that would have been monitored. just having had the experience, i wanted to understand why did that happen to me and in trying to understand that is when i came across the global at statistics which is hundreds of thousands of women die every year. >> you created the film "no woman cry" a great film that came out a couple years ago now and it has the story of four countries and how they treat maternal health. i want to run a clip of it if we can. >> janet's labor is not progressing and threat of death for both baby and mother is palpable. with no money to pay for food or transport, the nurses ask us to help. >> you say that so many of these 90% of these deaths are preventible. how? >> well, access is the critical piece. even in africa where the mortality rates are highest. services are free in tanzania but women can't access those services because of the cost of transportation, the fact that where they are in village settings is not linked to a clinic which is not linked to a referral hospital that can actually help a woman out in the event she does need that emergency care. really making sure that there is health workers out in the village that are linked back to the health system and that the health system is looking after her in some capacity. >> the cause is obviously a worthy one. i want to ask you one more time about implementation. when i wake up on sunday morning and i have nothing for my wife and nothing for my mother i say this is for a cause?
