always want to know. they both have something to say on this. new this morning as well, if you are in north carolina, our hearts go out to you. you're dealing with very ugly weather. apparently check out that funnel cloud. remarkable. look at this damage. overnight some severe storms really wreaking havoc in that area. a mobile home park apparently was completely wiped out. there are families trapped, apparent apparently. we'll get an update. there's an o.j. ban because of fungicide fears. there are shipments that are being stopped, headed in from brazil. the state attorney general in mississippi says some criminals pardoned by yot going governor haley barbour may have to go back to prison this is after a judge issued a temporary injunction that will keep the pardoned prisoners behind bars. the problem, many are already out. >> well, yes. big problem. the attorney general jim hood who is no fan, it seems, of haley barbour has asked for actually a court injunction. the judge has done so. this is all in a response to a move by haley barbour to just let these folks go. sign the pardons and off you go. 199 of them, convicted criminals from somewhat serious to extraordinarily serious. the a.g. absolutely slammed the governor saying he took the law into his own hands. on "ac 360" he compared him to the greedy and corrupt commissioner in "the dukes of hazzard." listen. >> he ran the government in the state like boss hogg. he didn't follow the law. governor barbour didn't follow it. it was clear he had to have that information. he didn't obtain it before he signed the pardons. that's cause a public safety issue. these families are afraid out here. these victims have been through a terrible amount. >> while that is fascinating, we also need to know the a.g. is elected. he's a democrat and was considering at one point running for government. there could be political animosity at play as well as the legal issues they're chewing on in that state. it doesn't matter what politics say when you come to the victims and family members. >> oh, my gosh and the folk that have to walk around with these convicted criminals, the ones that were released. >> one of the pardoned criminals -- excuse me, one of the victims of the -- let me back that up. david gatlin shot two people and martin savage spoke to one of his victims as well as a family that fears they're now sitting ducks for this guy. >> a full and unconditional pardon. >> yes. >> which means -- >> which means he has the same rights you have, the same rights i have. >> including to carry a gun? an ohio landlord apparently is asking a civil rights commission to reconsider its ruling that she discriminated against a black teenager by posting that sign at her pool. the owner is claiming that the sign is historical. but the parents of that girl are saying that landlord, it wasn't about history. they accused her daughter of making the pool cloudy because she used chemicals in her hair. a fascinating debate going on there. >> wow. all right. today is the first day same-sex couples can sign up for domestic partnerships. this is in the city of orlando. they don't offer the full benefits of a civil union or marriage but couples will have, this is important, hospital visitation rights and they're also going to be able to make health care decisions on their partners. u.s. markets closed mixed yesterday. the dow was down by 13 points, the s&p 500 and nasdaq were up just a little bit. >> that was yesterday. what about today? i always like to say what a difference a day can make. christine romans. were you in atlanta yesterday. >> we're all back now. >> we're all home. >> frequent flyer pointing yesterday. i actually missed a lot of the action in the markets yesterday. >> it was -- it was mixed action, quite frankly. today we'll be looking to an unemployment benefits number that comes out at 8:30. that will give us a read of what's happening in the jobs market. for the year mostly we're expecting the unemployment rate to stay in the 8% range. you're kind of settling into this two-speed labor market where people who just lost their jobs are having a better time finding a job and people who have been out of work for six months or longer are still in trouble. as the candidates head south, the second part of the jobs market will be important. half the people in south carolina that are out of a job have been out for six months or longer. we'll get a check of how much people spent in december. and we're watching o.j. today. >> not simpson. he's still in a nevada jail. >> that's history. this is orange juice. the fda halted all imports of orange juice. one in four glasses of orange juice in this country is imported. we must be watching out this morning, orange juice futures. they popped one of the days. they were thinking there would be a ban on imports and that would make it more expensive. watching volatility in the orange juice market. this is because of a fungicide found -- >> i thought it was only brazil. >> they are testing all countries. in some tests it leads to higher risks of liver tumors in animals. they found low levels of this, it was reported by an industry source that there were low levels in shipments. they're testing everything. if a country or company rather has three passes three random batches the fda will say you can resume your imports. they want to double check and make sure that's not coming in. when you're importing so much of your food as we do, different countries have different standards. and the fda can't check everything. i think the fda checks 1% maybe of things that come in. >> wow. do we know how long the halt will last? >> yes, minneapolis. >> i thought it was milwaukee. >> that is brutal. >> it is today it feels like winter has been delayed forever and now it's coming in with quite a vengeance. the snow is moving sideways. the winds gusting 35 miles an hour, creating whiteout conditions at times. we're looking at a huge swath across parts of wisconsin, down through eastern iowa and parts of st. louis where the snow will be heavy at times. by snowfall standards this isn't going to be the worst storm we've ever seen. this will be the most significant storm we've seen all season. it's been a while since you've had to drive in these type of conditions. we have winter weather advisories in effect. the worst of the snowfall will be on the lead side of the lakes. we get the enhancement from the moisture. chicago, 3 to 6 and a few isolated bands. big arctic blast coming in on the backside of this system, ahead of it is very warm and mild. take a look at this video from north carolina. yesterday, north carolina in january, that's damage likely caused by a tornado. there was quite a bit of damage. multiple homes were destroyed as well as buildings and at least three people were life flighted out. very unusual to have that kind of weather in january. but that winter is sweeping it all out of there now. >> serious prayers for those folks, because while we talk about it as a weather story, this is life-ending for so many people. they lose their homes, possessions, photos and in some cases their loved ones. it's pretty serious. >> absolutely. >> jacqui, thank you. appreciate it. 12 minutes past 5:00 on the east, 12 minutes past 2:00 on the west. a mississippi judge issuing a temporary injunction to block the release of those prisoners governed by outgoing governor haley barbour. this story has been dogging us all week. the mississippi governor granted full pardons to almost 200 people, including 14 convicted murders. the state attorney general says the pardons are a, quote, slap in the face to law enforcement. serious opposition denies it is responsible for the death of a french journalist, gilles jacquier. they -- he's the first western journalist to die in the ten-month uprising in syria. nic robertson left the area just before the mortar attack. we have a new study, a warning against transferring more than two embryos for folks going through in vitro fertilization. there's saying there's a health risk not just for the mothers but the babies with be too. typically, three or month emb o embryos will be implanted. we'll talk about that in the next hour. $500,000 bonuses for solyndra executives. that's the company that's bankrupt. remember that? it is 19 minutes past the hour here. and the marine corps is distancing itself this morning from a shocking online video that appears to show some disgusting and perhaps even criminal behavior on the part of marines in a war zone. take a look at it here. it's pretty graphic. the video appears to show four men dressed in marine combat gear urinating on the dead bodies of insurgents. a pen gone official says the pictures make him sick. marine cops are now investigating and now the taliban is responding, condemning the barbaric video in a text to cnn's nick patton walsh. joining us now, retired army brigadier general mark kimmette. have we confirmed the authenticity of that video, do you know? >> i have not heard confirmation of the authenticity. i think it's still being investigated. >> this harkins back to abu ghraib, the scandal back in 2004. that was when the humiliating photos were taken of prisoners naked. and in that instance, 17 soldiers and officers were removed from daughter uty. that was between may 2004 and march 2006. how do you justify this type of behavior or explain, maybe not justify. is it stress, immaturity? what do you think is happening here. >> there's no justification for this type of activity. it's a clear violation of international conventions and our own standards of conduct within the military. i suspect this will be investigated and prosecuted if the evidence leads to individuals conducting it. >> we also understand it could perhaps be a war crime. >> well, again, all of that is covered under the uniform code of military justice. i'm not sure war crime is a technical, legal term but there are clearly provisions within the uniform code of military justice that would account for desecration of bodies on the battlefield. >> let's talk about retaliation here. because this is a big concern. we still have a lot of americans working there. and if we think back to adieu great brita -- abu ghraib and nick burke, the man that was beheaded, perhaps there were folks taking responsibility for it saying this is in retaliation for what happened at abu ghraib. are we concerned about something like that happening? >> i suspect the command on the ground is worried about that. the sad part about this, it doesn't reflect the overwhelming majority of our troops, our soldiers, sailors, airmen and marines who are doing the right thing every day. photos like this, videos like this is just toxic and basically paint an impression of american and coalition efforts over there in a completely different light than the vast majority of actions that we see on a day-to-day basis. >> and what would be the punishment, perhaps, for these marines if this is factual video? >> well, this is a criminal act. so i would expect that you would see, within the uniform code of military justice, charges being brought up against these troops for dereliction of duty and a host of other articles under the uniform code of military justice. there are plenty of providings to handle whatever action the courts want to take on this. >> and i know we have history here where some other people have been investigated, some other soldiers and marines. how long do you think an investigation like this will take before we have answers? >> i was often asked that question in iraq. the answer is the investigation will take as long as necessary to get to the root cause and to get to the facts before it's brought in front of a court. >> all right. mark kimmitt, thank you so much for joining us this morning. we appreciate that. >> sure. we've had pretty good history of prosecutions under that code. and they are no joke. they're just as strong as the u.s. justice system and we've seen it happen. >> you have to wonder what they're thinking, right, to videotape that, post it? if he runs table and does three in a row it could be pretty much over for everybody else. they will get to florida but it may not be as thrilling. in chicago, lenny mccallister is joining us. in washington, d.c., democratist strategy keiki maclean is with s and joining us this morning is shira tupletts. i want to get to newt gingrich with the statement he made about armageddon. >> this is going to be armageddon. they will come in here with everything they've got, every surrogate, every ad, every negative attack. at the same time -- >> okay. so he was speaking with our own piers morgan last night by suggesting that. and lenny, let me start with you. i guess what he's saying is that we are no longer in the land of retail politics. now it is all about spending, spending, spending. and hitting your tv airwaves. is that really the case? >> it really is going to be the case because we know that south carolina has this long track record of selecting the republican nominee, moving forward into the general election. they know that romney probably should not have won iowa but because of the gap that the other front-runners had, he slipped into winning by eight votes. we knew new hampshire was going to go to mitt romney a long time ago. this is the battle ground for newt gingrich and rick santorum. being a son of the south, grnew gingrich needs to win this one. if it's 3-0 for romney going into florida, it could be game, set, match. >> i don't know if we have that song that i used to love until i heard it too many times called "who let the dogs out." that's what i had in my mind until i heard another comment by newt gingrich talking about mitt romney, putting the dog on the roof of the car instead of putting it in the car with them. it sounded like a nasty attempt reaching out for pet lovers who might take issue with doing that. my point is, is that low and shallow when these guys are heading into what i like to call foreclosureville. these states they're headed to, florida, nevada, south carolina, these places are some of the highest states in the country struggling through foreclosures and high unemployment. should we be talking about dogs in kennels or talk about the more serious issues in that he's campaigns. >> it is a low blow to talk about a pet romney had two decades ago and the way he treated this pet. it is a famous story, though, at this point. the unemployment rate is much higher than it is in iowa and new hampshire. i think republican candidates should be talking about that, when they go out in the field. i think this is also indicative of newt's campaign right now. he's fighting to remain relevant. his campaign has not become about running for president as much as it's become about attacking mitt romney. what a whole different world that was from a month ago when he was pledging to remain positive. >> kiki, i want you to weigh in on something entirely different. let's jump from newt to paul. ron paul, everybody says, i don't think it's fair that they say it, that he doesn't have a hope in you know what of becoming president. i started to figure it out by listening to the pundits. he can keep stumping along and actually collecting delegates, especially in states where they're proportional. if he keeps going all way to the convention and, you no he, collecting up delegates along the way, he gets traction and he can affect the republican platform once he gets there. is that good or is that bad for democrats? >> it depends on who you are if you think it's good or bad. it's interesting because this is the first time republicans have changed the rules and how they accumulate delegates through the process. normally -- historically it's been winner take all. he didn't have to worry about somebody holding a basket against you when you went into the convention. that's going to happen this time. it's also interesting to note, what is that point you're debating? what kind of leverage do they have in you're right, it's at the platform committee. what do they want? >> kiki, think about it for a minute. there are things in ron paul's platform that sound democratic. let's get those soldiers home, et cetera. i'm wondering if that's something the democrats keep worrying about. ron paul keeps collecting democrats and has a lot of say in the republican platform. is that going to bring that republican nominee closer to the center? >> i don't know that it will bring the republican nominee closer to the center. but mitt romney will need to do that in general. in the general -- one of the things that's interesting to watch is the level of intensity romney supporters have compared to the level of intensity ron paul supporters have. >> oh, yeah, it's no contest. >> it's actually interesting to see it begin to fade a little bit on ron paul. we've been watching social media trends and yesterday when you would have thought it became all the more intense going to south carolina, for some of these guys it began to become more neutral and neutral is a bad place, whether people were negative or positive for you. >> lenny and kiki and shira, love talking to you. let's do it again in about an hour or so. y'all come back now, you hear? >> i had, everybody. we got this weird story for you. we know you couldn't get enough of it when the trial was happening in june. that casey anthony case keeps delivering. now depositions that actually existed during the case but were never revealed have been unsealed by a florida judge. and there are all sorts of statements that casey actually made to the two psychiatrists who were analyzing her while she was awaiting trial. they have to figure out if she's competent. they have to go in there and talk to her. at the time they said she was just fine. the stuff they were quoting from her. they say this, you ready? >>y he. >> her father may have molested and killed little caylee and this is what they said she said to them. she believes george took caylee out of the bed, that they shared together, had some count of sexual, some sort of sexual experience with her daughter and in order to cover it up killed her. now, that is a big allegation, because she never suggested that before. never suggested her father killed her daughter before. just that her father may have taken the body of the accidental drowning victim, little caylee and disposed of it. >> is this common to release this? >> you have to fight for it. i think it was "the orlando sentinel" that put in the request to get it released. a lot of media outlets were looking to get it released. it took eight months to do p this you have to fight in court and they won. there's more. these psychiatrists said casey suggested she may have become pregnant with caylee after being drugged and raped at a party. this is what they said, again, casey told them. took two beers, possibligien another drug, woke up passed out, unclothed bottom. don't remember anything at a party, age 18. this is how she said she became pregnant. >> wow. >> yes. >> i mean, it's very serious stuff. at one point casey actually said during the trial, it was a big bombshell, made everybody uneasy, especially her family that her father, george, may at one point may even have been caylee's father. that was ugly. that was her defense attorney bringing that up. >> does this surprise you? >> a little. a little. only because i thought she had done a lot of damage in her defense to her family but this one is just really nasty. in fact let me read this for you. this is what they said again that she told them, casey did indicate that at a point in time she was concerned if george was actually the father of caylee but, of course, that was ruled out by dna. sunny hostin is our legal contributor for "in session." she's also a former prosecutor. she knows a thing or two about the law. >> a little bit. >> you were knee deep in this stuff. were you surprised by the extra allegations. >> i wasn't surprised, actually, because we know these psychiatrists met with her and spoke to her. if there was any place where these bombshells were to be contained it was going to be in these demgspositions. i wasn't surprised at all. >> they came back and said she is fine. >> yes, they did. >> fine is a relative word. >> that's right. she was legally sane, legally competent. >> legally competent. >> fine like we're fine, probably not so much. >> what puzzled me was that she was so blasted cheerful, these are their words, no feelings of guilt, not hopeless, even as she sat there behind bars. >> yes. >> given how we saw her during the trial are we surprised at that part? >> i was surprised at that. i thought perhaps we would have gotten a sense of real casey anthony. i don't think any of us really know who the real casey anthony is. we've seen so many different faces, her brother describes someone different, her father describes someone different, her mother describes someone different. her friends have described someone different. now we see these video diaries, also appearing to be someone different. are we seeing multiple personalities? i think the psychiatrists could pull back some of the layers. >> i was riveted by the details of this. at the end of the day, what is the purpose of all of this information? >> well, that, you know, that's actually a really good question. i still don't know if this was information they got when they were assigned by the court to look at her. >> i believe it was. >> or the information after baez and his group wanted to hire them to analyze her. >> i think it was the former, when the court want her to be analyzed by these psychiatrists. >> it's pretty unbiased. >> yes. the reasoning behind it, again, we want to know so much about casey anthony. and no one wants to pay her to tell her story, no news outlet wants to pay her the $750,000 she's looking for. but i think there's so much curiosity out there. when some of these new diaries were released, i sent it out on my facebook page, twitter page, this is new information. i got hundreds of comments immediately. i was surprised that people still are interested in this story. >> that little girl's face. >> it's engrained in your brain. >> it really is. >> you're come back later and talk to us, jose baez, her attorney, was he fired, did he quit? we'll talk to our medical correspondent about that, as well. >> some very bad weather in north carolina. take a peek at this funnel cloud. the picture is from a long way away because anybody close to it had a terrible night. a mobile home park completely torn up. people were trapped, people were injured. we have some aftermath video we'll show you later on show you what happened in north carolina. this story has been all the talk here for a couple days and new developments in mississippi where a judge last night issued a temporary injunction that will keep pardoned imprisoners behind bars at least now for now we understand. many are already out. in response to a move by outgoing mississippi governor haley barbour hundreds were granted pardons, including rapests and killers. state attorney general suggesting they will have to go back to prison. martin savidge is live in jackson, mississippi, specifically, with the details. i would imagine some people are hoping that there are all sorts of loopholes so that these folks can go back to prison. >> morning, zoraida. >> this is the point that the attorney general made. a specific part of the law of the pardon process here in the state of mississippi that says in advance of the pardon being granted, there has to be notice given to the public. that notice has to be given in the publication of the newspaper for 30 days at least in a row in the newspaper. the attorney general is saying many of these cases of these pardons, at least 175 of them, that was not done which means those pardons were granted illegally on the part of former governor haley barbour. that was the point that was made to the judge. that's why the judge issued the temporary injunction. as you say, the cat is already out of the bag, in many respects. that's why right now we are hearing that there are about 21 prisoners that are still in prison that are going to remain there, but the rest are already out and the big concern is for those murderers. the four of them that were released on sunday. right now they're still free, but they are still supposed to report in. >> but a lot of the victims there are worried about retaliation and this was a full pardon that was granted to them, they are allowed to carry guns, though, and to vote? >> right. and this is something that many people may not realize, perhaps, that this is a full pardon. in other words, it's not just that you're let out of prison. but by giving them a full pardon, they are completely restored with all of the rights that any person has. it means their rofrd is essentially wiped clean. that means they can vote, and also means they can go out and buy a gun. they were put in prison in the first place because of murders and homicides that were carried out, and in most cases, carried out because of a use of a gun and victims' family members fear that they may come back and do harm to them. >> martin savidge in jackson, mm. thank you for that. >> so many ways this story can turn legally so the perfect person to speak to is it our legal analyst jeffrey toobin. >> i'm thrilled to have you both here. >> let's chew on this for a bit. >> when we first heard the story we were outraged and nothing that can turn this clock back and now we're starting to dig through the constitution and some of the guidelines for this program and a few other potential loopholes other than the publication requirement. >> the mississippi constitution is quite clear about this requirement that the pardons are only valid if the person applying for the pardon has posted this notice within 30 -- 30 or more days before the application. you don't have to be a lawyer, you just take a look at the mississippi constitution. >> and the newspaper. >> you have to put it in the newspaper. >> we'll see how many of these people did actually do that. >> if they did that and they did put the notice in the newspaper, they can check that off the paper. what about the notes to the families? that's in there, too. that has to happen. the governor has to notify those families or, once again, it's a violation. >> that, i don't think, is in the constitution. that may be in a law. for those of us who are not from mississippi, we don't realize, this is a quite a long-running story there. barber earlier in his term did constitutional pardons mississippi amended its laws to include this family, the victim notification. that's a law. that's not in the constitution. whether that is enough to inval validate the pardon is more of a specific question. >> in those four quases where they're still releases. they weren't halted from their release. do we know if they met any of this criteria that we're talking about, particularly the one that it has to be published? >> we do not know. in fact, what the judge's temporary restraining order said, well, i'm going to hold a hearing january 23rd and that's when we'll find out about the notices. that's in part why he didn't order those four who were released rearrested because he says, i don't know whether they publish the notice or not, but i want to find out by january 23rd. in the meantime, the judge says these released murders have to report to the authorities every day at least once between now and january 23rd when the hearing takes place. >> what about the other little thing, they're cherry picking everything they can. you have to have served the minimum amount of time in prison. minimum part of your sentence before you qualify for these things. are we certain those qualifications were met? >> no, for many we're not sure. clearly, though, people who didn't serve prison sentences can be pardoned. i mean, that's been true forever. one of the famous pardon stories. >> marc rich. >> marc rich was a fugitive. bill clinton pardoned him. george steinbrenner pleaded guilty to campaign financial violations and later pardoned by ronald reagan, he, obviously, was never in prison. in mississippi, again, you don't have to have served time to get a pardon. >> we can talk to you about hours about this. >> it will just be the mississippi pardon hour. >> mini court tv right here and i love that you harkin back to the reagan days not because you're old, just because you're smart. jeffrey toobin, thank you. >> i was alive in those days. >> you were 10. every morning we give you an early start to your day by alerting to news that is happening and stories that will be tonight. a judge in aruba may declare natalee holloway dead. van der sloot was the last person seen with her. also making news, police and family members searching for this virginia college student who vanished during a visit during new year's eve celebration. apparently he caught the bus to new york december 26th but the last time anyone heard word from him was in a text december 30th. same-sex couples will be lining up in orlando today, why? [whispering] big dreams. welcome back. we're getting some reaction now, international reaction to that awful video that surfaced of u.s. marines apparently urinating on the corpses of dead insurgents. the international, the isaf the international security -- i can't remember what that acronym stands for releasing a statement right now denouncing this and suggesting that this is absolutely unacceptable, really not surprising. but if you look at your picture. this is a still picture from the video of combat marines apparently snipers because our barbara starr from the pentagon tells us that their gear that they're wearing on their heldmehelmets and their rifles telling the job that they do, showing inexcusable behavior. nick peyton walsh is live in afghanistan. also the afghan government reacting to this. what are they saying? >> the pentagon, they still have ka cave caveats. the presidential pal palace pretty straight forward saying to us earlier on the government of afghanistan is deeply disturbed that shows american soldiers desecrating bodies of three afghans. this act is simply inhuman. we expressly ask the u.s. government to investigate the video and apply the most severe punishment to anyone found guilty in this crime. really stinging environment there from the palace at a time when many are seeing perhaps damage in u.s. afghan government relations. this not going to help at all and also make afghans feel more comfortable by having troops around. >> one thing here in america where this is one story among many in our newscast today, but where you are in afghanistan, is it the story? >> it's beginning to get people's attention. we haven't seen the protests you have seen previously from other instance in which u.s. troops have been accused of misconduct, but getting traction in the political sphere. people talking about it in the opinion-forming circles. the taliban coming out saying, same language the presidential palace used, calling it an inhuman act that reveals the real face of u.s. and nato troops here to the world. people beginning to voice their fury and disgust here and this could generate into something much worse at a time, really, when u.s. troops are looking to leave and not try to convince afghans, again, they're here for good. >> real quickly here, the uniform code suggests that that is just down right illegal and that could be serious problems for those actual marines. can you just quickly tell me if they've been able to find them. if they're in country with you or a much bigger project. >> i mean, this is the early stage of their investigation. off the record, you hear u.s. officials saying they have a good idea where this is, they are pretty sure it's afghanis n afghanistan. at the end of the day, yes, these men are being looked for as we speak. there is a suggestion in the statement just released they may have left the country, but, still, early stages is still on the u.s. side. >> way to scramble for us, nic, thank you very much for that. let's bring in mark kimmitt, he joins us, again, from washington. the concern here, general, is that the folks, or the americans that are on the ground there now and whether or not this is going to affect them because back in 2004 insurgents actually took responsibility for the beheading of nick burg and they said that was in retaliation for what happened in abu ghraib. do you think, perhaps, that the americans there are in trouble? >> i don't think they're in trouble. i think that there probably will be an increase of violence attributed to this and used as an excuse, but i find it interesting that the taliban who have been perpetrators of some of the most heinous crimes against civilians would become so so sanctimonious on this issue. it is inexcusable. it doesn't reflect the standards of the u.s. military and it's wrong, but, nonetheless, i think it's important to keep this in context. >> when we talked about what happened in abu ghraib and the pictures that were taken of some of the prisoners there. there were punishment. 17 soldiers and officers removed from duty between may of 2004 and march of 2006, certainly there is some training that happens with these marines and soldiers. could you -- is everybody that gets that kind of training and everybody that understands the consequen consequences? >> listen, we don't necessarily are to get into the military to have this kind of training. we are trained from day one as si citizens that you don't treat other citizens this way. the military does specifically train the troops on what's proper conduct on the battlefield and what's improper conduct and there's just no justification for this activity. >> the desecration of the body by troops could be considered a warm crime. what can you tell us about that? >> yes, you did. >> lenny, i want to start with you here. gingrich has been releasing ads against romney. tv ads for slamming romney for changing his mind on abortion and airing clips of a documentary about bain capital and now we have a web ad that shows romney's verbal gafs. let's look and then we'll talk. >> you love the dog, where he was comfortable. five kids inside the car and he liked it better in his kennel than he would have liked it inside. >> who let the dogs out? >> were you squinting? that was a little tough to read there, lenny. anyway, can romney survive the onslot? >> he can survive the onslot, but, what we're looking at are these polls where he's not as far ahead in the lead as he probably would like going into next weekend. santorum's right on his heels and gingrich is within striking distance and now the tables are being turned. superpac money coming after romney and why folks didn't like romney in 2008. reminding him when he didn't run for re-election in massachusetts. the superpac ads are effective reminding folks of these negative things and the debates coming up before the 21st. gingrich and santorum doing an eloquent job of hammering home these points. this is the litmus test for mitt romney. let's forget about iowa and new hampshire. if he doesn't get out of south carolina, his campaign is going to be on rocky road all over again. >> i want to stay here with this onslot of the negativity. so, shera, let's talk to you about that. south carolina is known as a place where the glove s come of. robo calls that mccain fathered a child out of web lock and christmas cards allegedly sent by mitt romney with controversial quotes from the book of mormon. what else is coming and how is this going to affect the vote there? how do south carolinians feel about all this negative campaigning? >> i think in general when there's live negative campaigning it tends to suppress turnout and voters are not enthusiastic and that's the general information about politics. south carolina primary, that's the kind of thing that we'll see on primary night and turnouts won't be as strong as it was four years ago or eight years ago. south carolina is a tough state to run. it is a pivotal test for romney because he has not been hit very hard yet. he got away unscathed in iowa and hasn't been anyone really attacking him. he hasn't really passed that test yet. this state is going to serve as that test. >> kiki, let's talk about that test because there are some really negative ads about romney and bain capital, how do you think that is going to play out there in south carolina? >> it's a real problem. when you see what happened to the outsourcing of jobs and the closing of industry in south carolina over the last couple of decades and what kind of profile that builds for mitt romney, this isn't a problem just in a primary. if he is the anointed nominee of the republican nominee, this is the soft underbelly of his candidacy in a general election. it's that profile. this is what hurt him when he ran for ted dkennedy. i happened to watch that race up close. that combined with what shera raises, the sense of apathy. new voters aren't lining up to get involved because of him. what we see is apathy. the negative attacks on him is really apathy and it builds on this continuing sense of apathy for him. i was in new hampshire, while he had a big night, no crowds in the streets, signs in the yard. there was a huge lack of energy. we see it in the polling and we see it in social media when my team looks at that online. we were talking about that for the last week. an interesting view of the window of what's going on. just this apathetic sense of, well, maybe him. >> lenny, shera and kiki, thank you for joining us this morning. he is officially now a convicted killer and a nasty one at that. joran van der sloot saying i did it to peruvian young woman, but what does that have to do with natalee holloway? it doesn't really sound like you do, especially if you know what happened to mrs. flores in that room. it was a horrible, horrible murder. van der sloot was the prime suspect in holloway's disappearance, as well. arrested a few times, but never charged. last night natalee holloway's father spoke to hln's nancy grace. >> it kind of surprised me that the defense attorney used our case in the death of his father to try to reduce his sentence in the flores' family case. the judge was able to stop it and not allow him to present that information. you know, he created all this, if he has any stress, created all this stress himself. >> not exactly sure what van der sloot was smiling about in that peruvian court because this family has been devastated by all of this, not to mention flores family in peru. when we talk about natalee, something could be happening today. particularly poignant for her family. a judge in alabama could declare natalee holloway officially dead. i know that sounds odd, but there are some reasons for it. our sunny hostin cnn legal analyst and "in session." i get chills when i talk about this because what the holloway family has gone through, the holloway family for seven years has no answers. >> he's the prime suspect and has always been. he was the last person seen with her. he claims he left her drunk on a beach and body never found and that is probably every parents' nightmare. >> i actually sort of thought a p profunthry thing but you have to fight for this and dave holloway kind of did. he put in the application to have natalee declared dead in alabama. >> her mother fought that and she has now come to peace with it and comes to terms with it and contesting this hearing that will happen today, on thursday. one of the reasons is they have this sort of scholarship money that they want to used that was earmarked for natalee and they want to use it for one of their other children and health insurance issues, as well. of course, we're talking about almost seven years of natalee holloway, you know, body never having been found and it's very difficult for the family, but, perhaps today they will get a little bit of closure. >> whatever that's worth. closure. >> i know, but, it's tough, it's constantly being talked about, especially now, as joran sits there and pleads guilty. watching this, the first time i saw him and are i'm watching him and i think somehow maybe the family feels like, okay, he admitted some guilt in something and maybe they could feel, yeah, he's guilty of this one, as well. maybe he never said it, but perhaps he's guilty. >> i'm not sure. we also know he's facing some charges here in the u.s. because he defrauded natalee holloway's mother -- >> allegedly. >> allegedly. >> have to say that. >> perhaps he'll meet that sort of justice here in the united states. but he's looking at almost 30 years. >> so, i'm glad that you said that. 30 years. a lot of people in the u.s. would say that was an aggravated killing. ugly and violent. let's say he served a solid part of that 30 years. can you keep these fraud charges alive in the u.s. so that if he does actually end up out in peru, oh, i don't know, in 20 or 30 years they can extradite him?
