And the Russia Intelligence Services work very hard to steal our secrets. The reason people spy is to gain advantage over the person being spied on. You want to have knowledge that they dont have or you want to have knowledge that they dont know you have and vice versa. They spy on us and we spy on them. Its one of the oldest occupations in the world. Its not ever going away. Espionage probably represents the greatest threat to Americas National security today than anything else. The Foreign Intelligence Service of russia, they are trying to learn what u. S. Policies are, whats behind them because we have enough Nuclear Weapons to blow them off the planet like they have enough Nuclear Weapons to blow us off the planet. Its hard to bridge the gap but in the 90s we were starting to get there. I agree with what the president said that there is no animosity that cold war days are over. The wall that had fallen in west berlin, east berlin and juplation as it appeared as though the dictatorship in russia was finally ending. The white house clearly wanted to have a reset in our diplomatic military relations with new russia and there was thought that maybe finally this cold war was over. The cold war is over. For the first time in history, an american president has set foot in a democratic russia. And so in june 1992, the state Department Released a memorandum indicating that Russian Diplomats no longer needed to be escorted inside the Main State Department building. I thought someone was pulling my leg. I simply could not believe that that decision had been reached. It ran contrary to what id been doing for 25 years. You do not allow foreign diplomats to walk inside the state department unescorted. They would never let an american diplomat do that. I cant believe for one second the russian resident at the embassy in washington d. C. Was not laughing every night over the nonescort policy. This goes back to state department not being a Counter Intelligence agency. Their purpose is to build bridges for other countries. We were trying to normalize relations with the russians to treat them not like the bad old soviets they were used to. They kept countering intelligence of officers in washington d. C. But dialled back resources and slowly backed off thinking okay, lets see if they do come around. It didnt take us long to learn that the bear was not in hibernation and that the russian Intelligence Service that morphed from the kgb to the sbr had simply not changed their mission or goal. The wall came down. It didnt change anything from a National Security Counter Intelligence standpoint that cat and mouse spy versus spy thing is always there. In the summer of 1998 i was the Deputy Director of the office of Counter Intelligence at the u. S. Department of state. My counter part at the fbis washingtons field office arranged for me to come down and meet with him and another agent. They said robert, this is a catalog of Russian Diplomats coming to visit the state department. Most of them were diplomats had been in the ministry of Foreign Affairs but a fraction of the diplomats were spies, Intelligence Officers serving under diplomatic cover. They are not concerned about diplomatic negotiations. They want to obtain sensitive, classified or restricted information. If a russian Intelligence Officer is inside the state department, he or she is obviously up to no good. Whenever youre dealing with spies, its what you dont know will hurt you. So what can we do to better understand what were seeing . We didnt know what the russians were doing inside, who they were doing it to or how they were doing it but my job was to find out. We would follow them to the outside of the building, and notify roberts team inside the building who was coming in and they would try to follow them inside. When the russians stepped out of the car, we had cameras rolling with High Resolution focused straightly on them looking for anomalies in their clothes, in their hands, in their briefcases, anything at all that might give us an idea of what he or she might have been bringing into the Main State Department building. We saw one after another officer going in, sometimes several at the same time. One day we saw a russian diplomat entering the building, emptyhanded and coming out with a briefcase. We were very concerned at that point. Another incident that gave us a lot of concern, our Surveillance Team spotted a russian diplomat as he walked up to the main entrance of the state department. Now, if you go to the Main State Department building, there is a physical barrier you have to present a certain i. D. Card and the receptionest writes it out for you and you go to a gate guard who stand there is and opens up the gate for you. When the russian diplomat walked inside, we noticed he didnt go to the receptionest but sat down in some easy chairs in the lobby and noise going everywhere, phones everywhere. Ten minutes later, another russian diplomat comes up to the reception desk, gives the receptionest a number to call to an office where the person says oh, yes, were expecting demetri, send him up. Its to the house phone on the table next to where the other russian diplomat is sitting. He picks up the phone and says let dimitri in. Hangs up. She writes it in. Off he goes. And where he went, we have no clue. In this case, unfortunately, we did not have access to be able to follow. Doing surveillance of the outside of the state department is easy. Doing surveillance on the inside of the state department very, very difficult. Sometimes it just two of you going down a hallway and its, you know, you can get away with that only so long. Why didnt you get rid of him . Kick him out, arrest him . They violated no laws. They have violated an internal security rule, sure. But if you do that, you let them know youre on to them. Let them do that a second or third time. We thought they could be out right stealing documents. They could be planting bugs, anything like that. Frankly, we didnt know what they were doing. That was a concern. Unfortunately, after six weeks, we were no closer to the answers we were seeking than when we began. All that we confirmed is they were coming to the Main State Department building in numbers and frequencies that simply was inconsistent with diplomatic dialogue. We were unable to go beyond that. When it was done, robert took it up within his chain of command to present it to the higher ups and say we probably have a threat here. In may 1998, the fbi gave me permission to brief thomas, the number three man at the state department and a former u. S. Ambassador to moscow about what we had uncovered. He was shown the photographs, he was shown the spread sheets, we explained to him how we felt the no escort policy was debt mental to the building but unfortunately, there was no proof they were going outside their regular diplomatic duties and responsibilities. What we had was a lot of smoke and no fire. Unfortunately, after that meeting the policy continued the russians would not be escorted within the state department and from our observation, the activity continued. The standard procedure is check with the Intelligence Committee to see whats up. In his case it did not come back he was a clean diplomat, it came back he was very specifically a line o. T. Officer and the predecessor was the line of the embassy and replacing him. Everything matched. Even though we knew he was the spy, the state Department Still accredited g uso v as a diplomat. In he comes. Wasnt he compromised from the moment he got here because you knew who he was . When they come into the United States, they will be followed. We have to establish their pattern. Dip pi typically you dont see a lot in the first months. They assume they are under heavy surveillance. At the time he came to the United States i had way more work than i could handle. I had officers including his predecessor so my assumption is i can focus on other things and when he gets settled, ill dig in my heels and start tracking. It was my luck a Surveillance Team sitting outside of state department were surveilling another target but when they saw a russian diplomatic vehicle pull in to a metered parking space, it got their attention. Why . Because he fed the meter. Diplomats dont care about parking tickets. The Russian Embassy had tens of thousands of dollars in unpaid parking tickets. Russia tops the list of dead beat diplomats and more than 27,000. So there were red flags right away. It was just on a whim that they actually followed him to this park and took a couple happy snaps photos. The pictures showed somebody sitting ochoen a bench with his arm, elbow deep in a bag. The thought was hes just doing area familiarization for future operations. It doesnt really invoke a reaction. Two days later, his car was spotted roughly in the same area that it was parked before. This time the Surveillance Team started taking about a 30minute g uso v was there with the same arm elbow deep in the same bag. I get a call from the team leader ilead leader imploring me to come to their off site to see this video immediately. He believed it definitely indicated there was some kind of technical operation going on. And so the thought was hes doing area familiarization, hes a technical guy. Maybe hes just sweeping the radio spectrum for the area. I believed he was doing something bad but not line ot operations. That was the line at the time. I switched my attention very closely to him. I was out there every day of the week for months and i had an old thomas guide and i was plotting everywhere he parked his car, every time he reparked his car, everywhere he walked and everywhere he paused or sat on foot. He continued to come out continuing to park and remapark and walk around and sit on park benches. The difference, though, there was no more sitting on a bench with his arm elbow deep in the bag. Once he actually parked on to virginia avenue, he would not move his car again. It was like the lightbulb going off. He was trying to get as close to state department as possible. So i started shopping that 30minute video of him asking for help. I said hey, i have a guy on a park bench who looks like hes doing something technical, i think there might be radio frequencies involved and do we have equipment thats portable to just do basically a survey of what radio frequencies are there when hes there and then whats there when hes not there, do the over lay and eliminate the common frequencies and only be left with ones that are there only when hes there. And that would be him. I get a call from my Headquarters Program manager saying here is the name and number of a guy, he has what you need. Who is the guy . It was somebody within the Intelligence Community but im not at liberty to say. And after a week, the guy who gave me the equipment, he identified one specific frequency, an unauthorized signal that came on and went off with him coming and going. It appeared to be his rogue frequency. At this point, we need to know where its coming from. If theres a penetration of state department. The stakes are huge. The first day that we got into the state department annex, the Electronics Technician was setting up and i was playing around with the antenna kind of pointing it across the street at the state Department Building while he was tuning and it was connected to a cable. In the middle of that, gusev drives into the area and we see the signal come on. Great, day one were there. We could figure out a lot and so while im messing around with the antenna, the e. T. Electronic technician says stop, what are you pointing at . Top floor of the state department. Where on the top floor . A glass stair wall there. He goes well, that makes sense because the signals pass through glass more easily than concrete. After one day, they came in and said there is no question in our mind there are radio fr frequencies emanating from the wall of the building. Our First Priority was to prove that some kind of audio device was in fact, state department. So a second Electronics Technician went out with another piece of equipment that would then measure the signal strength. We walked in the state department and then pro pro sceo go towards the glass stairwell where it was stronger and as he claimed the stairs, it got stronger and it was screaming because it got louder as it got closer to the signal right near him was the door to the Conference Room, closed the meeting in progress. The signal seemed to be coming from that Conference Room. That Conference Room was located on the seventh floor of the state department. The same floor that obtains the executive office space and the office for the secretary of state mrs. Al bright, any group could reserve the Conference Room in fact, the Conference Room could be used by visiting d dig that tarries, the department of defense. Any number of conversations could happen there from brown bag lunches where random things could be talked about to classified conversations because just down the hall there was a unit that dealt with close fied information if they needed a Conference Room they could go in there. At this point, we had no clue what the russians captured but in that Conference Room, Sensitive Information was discussed on a daily basis. Once we had determined that it was the Conference Room on the seventh floor, we planned to go back in that night to actually find the device. The plan was to enter the state department. We wanted to make sure no staff were in there. The key, the integrity of investigations you just have to make sure that the least amount of people know about it. And we knew people started arriving at the main state building for work maybe around 6 00 so we needed to get what we needed to get done within four hours. In the Conference Room, thats 20 x 40 feet, thats not a lot of time. We started with the carpet and slowly worked our ways up the walls and then everything in that room, it was a total nightmare from a technical perspective because it could be anywhere. They ultimately got around to a portion of the chair rail molding. Chair rail molding sits on the wall so we move your chair back, you dont bang the back of your chair against the wall and scuff it up. We gathered around the chair railing and they ran the equipment over it and this piece of wood had weird kind of signatures that were coming off of it. This specific section of chair rail molding was hidden behind the curtain. This curtain whether you open it or close it, that section of chair rail molding is always covered and in front of the curtain was this massive plant. Being skeptics, we would run the equipment along the railing almost all the way around the room just to see if anything remotely similar popped up and it kept oncoming back to that one piece going no way, this is unique. Its got to be this. It was clear russians had successfully planted a bug inside the state Department Building. Did you take the piece of railing off . Oh, no, we didnt want to disturb it because we didnt know if it had a trip wire on it to go off and let the russians know we found it. Leave it in place because there are options. They had the power to lockdown the entire building in the middle of the day if somebody went in there to do something. And start something priceless. In december of 1999, the decision was made to detain gusev. The moment we decide to take him down, he stopped coming up. That was not a good week. By december the 8th, i was absolutely miserable. I thought we had lost the case. So im talking to one of my ds agents assigned to the fbi command center overviewing the potential arrest. And all of a sudden, he grkss hes off the park. I said, hes off the park . I slammed down the phone. Gusev has just left the embassy compound. I said, i cant believe it. So i run out of my office. Get everyone set. And nobody is there. We really had to scramble to get people on station. Frantically on phone calls and radios, out of the starbucks, drop your coffee. Everyones got to go now. The adrenaline went through the ceiling. Im literately at my office window, and there comes gusev. The fbi had two cars parked one behind the other in virginia avenue. One car contained camera and surveillance gear and the other an fbi agent in the car. So when they said hes right down the block, the fbi car pulled out. Lo and behold, a beautiful parking shot for gusev to pull his car in. What a coincidence. And im watching all of this. He did exactly what we had expected. He parked his car right behind a van that we had that had video camera rolling with a guy in the back. And my secretary said, robert, youre going to have a heart attack here. I really was. He gets out of the car. Feeds the meter and takes off for his twohour walk. At that point, the breakin team goes into the Conference Room and started reading the scripted, classified information. After 20 minutes, the Justice Department representative on the team says weve got enough. We have espionage. And all of a sudden, the fbi guys jump out on virginia avenue. Jimmy the lock, jump in the malibusky and off they go. And then we confronted gusev on the street. When surrounded by the fbi, gusev said, what is this all about . He immediately did what we thought he was going to do. He insisted he was not going anywhere. Hes a diplomat. It was an outrage. And finally one of the agents on my squad mumbled, cuff him. Take him down to the Washington Field office to continue with this conversation. When we brought him in to our building, they take his belt off, his shoes off, all of his pocket litter and put it through a metal detector. Then hes brought into the Interview Room with me and the two russianspeaking agents. And all of his stuff is kind of dumped in the middle of the table. He slowly tucked his shirt in, put his belt on and put his wallet away and collected his spare change. And what began to materialize the middle of the table was a smaller and smaller pile until finally what was left was a pill. A white pill. Everybody at the table paused. We all looked at the middle of the table and we all looked at him, and hes doing the same thing, looking up and looking sideways. Im sure we all had the same thought. Its a poison pill. Its a cyanide pill. In case he got caught. And hes getting the vibe from the room and he looks up and he says in russian, ive been sick. Oh, that explain yes you havent come out in a week and he gets translated and he goes, ah, ah, and it was a huge intention. Certainly, we wanted to know everything he knew. As a good Intelligence Officer, he did not say a thing. A russian diplomat was caught at his listening post in washington right outside the u. S. State department. U. S. Officials tell nbc news the secret listening device was hidden on the state departments seventh floor. The same floor where the secretary of state and her top deputies worked. Because hes assigned to the Russian Embassy, he has diplomatic immunity and will be sent home without having to answer any questions. We had him thrown out of the country, persona nongrata. You are not welcome. This is a perfect replica of the actual device that was nailed into the wall in the Conference Room at state department. We took it off the wall in the Conference Room on december 8th when he was interdicted on the street. For the time, the bug was very advanced. This is the receiver. And thats the transmitter. The signal would come into this. Turn on the device and then all the content would be beamed back out to his car to a much larger receiver. The batteries had a shelf life in tandem operation to go anywhere between eight and 12 years. And the audio from this thing was phenomenal. In a pin hole opening behind a curtain, behind a plant, youd think it would be muffled. It was crystal clear. Never in the history of counterintelligence have we ever got a listening device and all the receiving equipment we had captured bugs in the past numerous times. Not the whole system. And for the countermeasures people at the nsa and the cia, this is gold. This case is actually active today. And there is a debate in the community that the russians did it all by themselves or that the russians had a friendly hand assist them. Is it possible that a state Department Employee helped them . Absolutely. Just because no one has been arrested as having been an accomplice or a coconspirator does not mean that we dont have information that may or may not be used in the not so distant future. Shortly after the case, the nonescort policy for russians was rescinded. To do what the russian Intelligence Service had done was unheard of. A huge success for their service. And then for us to come along and do what we did, again, a huge success for our service. So are there losers . Are there winners . Its hard to say. It was spies versus spies. I mean, normally these things involve one person against another person. This was, on our side, dozens of people against dozens of people. Its really unprecedented in its scope.
