An election is coming. Let me finish the last part of that sentence. He liked to put words into President Trumps mouth when he faked the call tran script. No, what you need to say is, we cant beat him next year. The only thing we need is a 30second commercial saying we impeached him. This is just the opening act. Real statements are expected on thursday when democrats and republican lawmakers put forward the amendments to the articles and vote to approve. Once thats done, the committee will send the articles to the house floor for a full vote expected sometime next week. Meanwhile Senate Majority leader Mitch Mcconnell is manning on not just holding a trial but a vote to acquit the president. A lot to get to. Joining us now, the u. S. At this point is it still sort of incredible to you that the democrats and the republicans can look at the same facts, the same testimony, the same he have. Democrats see an open and shut case. A president who is a National Security threat. Republicans see lunatic democrats who are intent on a political hit job. Im not really surprised at this point. Republicans have pretty consistently shown during the Trump Presidency that they can suspend their critical faculties and become a kuflt trump and repeat whatever trump says. They dont Pay Attention to the facts, they dont Pay Attention to the evidence. They just Pay Attention to whatever trump says. The striking thing to me in listening to debate today in the house Judiciary Committee, the republicans kept saying that the democrats had not made their case. But they did not actually dispute the case that the democrats made. They were not arguing on the merits. They were not really defending donald trump. They were mainly attacking democrats, they were attack the process. They were saying the democrats hate trump, they hate his voters, they want to distract from the great economy, they want to undo the last election. All of these arguments that have nothing to do with the facts out there. Which is that donald trump did attempt to extort ukraine. That he held the military hostage to get ukraine to interfere in the election on his behalf. That basic fact cannot be disputed. It has been proven. So republicans were trying to distract and deflect. On the point of the legal argument, impeachment is whatever congress decides impeachment will be. When you look at the facts, you look at the case from a legal point of view. Has the case been made here . Not just from a legal point of view but a political point of view. I think so. The case is well made. Remember the house is acting like a grand jury. The senate will act like a trial jury. Here theyre putting together the charging document. They clearly put enough he have in to support the charges. A pretty crafty move on their part to fair tow charges down and to use a very clean impeachment article. That is, that theyre taking away the defense of all these technical elements that exist in todays criminal statutes as opposed to what the found hers 400 years ago. It is a good move on their part. And as they move forward, they wont convict him in the senate. At this point, i think the impeachment is pretty clear. There is been one kind of consistency. The ever increasing hyperbole in defense of the president. Heres an example. I came in here. I did not want to get emotional. But, and ive sat through trials that were hard to sit through. But nothing like sitting this week in this committee hearing. Indeed, like jefferson, i tremble that god is just and his justice wont sleep forever. But the abuses, the obstruction of congress have come from congress. Where do you go after you tremble before god . Is there no line republicans wont cross to defend trump . The reality is that donald trump is watching all of this as it unfolds. What you see is an effort by republicans to appear in whatever way possible to not only defend the president but in fact, fight back on behalf of the president. That is the era we live in. We live in an incredibly polarized time in american politics. What you see is it is never enough. There is never enough of a defense. Never enough going to the mat as it were for President Trump. And that is precisely what youve seen play out. I think if anything, views have become even more entrenched among republicans in the house and probably the senate as well. As this entire episode moves over there in a few weeks. I think were having problems there. With republicans, there was talk a couple months ago that as this process went forward, the evidence would be heard. There may be some waivering republicans who might start appearing, with the support he has in the senate. It is quite the opposite. It has become rock hard. In some ways it exposed this entire impeachment process just doesnt work when a party is totally beholden to a president. Thats exactly right. It is reminiscent to what happened in the fall of 2016. When the tape came out with donald trump making very crude comments about grabbing women by their private parts. And this was shocking to republicans. And for 48 hours or something, it looked like republicans might abandon him. He wont back down. And republicans basically climbed back up. I think you see something similar happening in the case of ukraine. There was a gasp and a shock on the part of republicans that trump had been caught so blatantly trying to blackmail a foreign country. And there was a hope that as the evidence was brought forward, that some republicans would actually judge the case impartially and could even be brought forward to agree that donald trump deserved impeachment. It has become clear in the last month or so that this has become an increasingly tribal and partisan affair where republicans have managed to rally their base. Trump has managed to rally his base and to convince republicans to stick with him. So theyre just ignoring the evidence and theyre grand standing for the cameras. And now the only real suspense is, will there be a single republican in either house who will actually abandon trump at this point . We were talking about the relevance for donald trump. What if three do . What if he gets to that 51 plus point . A sim many majority . Trump still stays as president but the democrats have a win. They sort of have a win. The beauty of it is it cuts back on the maneuver. To put forward another one, whether he might put forward a motion to dismiss or an early motion for acquittal. It would take a simple verdict to have that. If there were three votes that shifted the power balance a little bit, that might change the nature of it. The evidence that they may want to get into. So i think thats the tight rope they have to walk. This is uncharted territory. Just to bring you back in. Is it a case for the republicans they all hang together or separately . If there is a split in the party in any sort of way, is that it for the republicans as a cohesive force . I think that is the concern the white house has. If you see any Division Within the republican party, any splitting of the ranks. We have seen republicans hang together a hot more. That would be something the white house would have to explain away. I think republicans in the house in march value the idea of all sticking get. When we get to the senate, it might be a different story. The cohesion amongst republicans is something that trump and the white house would very much like to see. Finally, what weve seen is the support out there among general voters is slipping. Everyone thought the opposite would happen. With these opening statements, that support would build but americans are turning off. I dont know if theyre turning off. I think the country is still very much submit. The polls are showing went to 45, 50 of the country supports President Trumps remove. Those are numbers we havent seen since 1974 right before nixon resigned. I think it is fair to say, you have the 12 very compelling witnesses to testify. That perhaps the number will go above 50 and it hasnt. Its maybe even gone down a point or two and i think that goes to the very polarized nature of our political environment. People who watch fox news think that donald trump has been exonerated. They think all the evidence is made up. They think hes completely inning. They dont Pay Attention to the facts and he has a very solid base of support which wont be shaken no matter what a compelling case the democrats are bringing forward. They held a rare evening session that end ad few hours ago but theyll be back for more in the coming hours. After getting input from other committees and considering amendments on thursday, the Judiciary Committee is expected to vote on whether to treatment articles of impeachment to the full house of representatives. Then in the majority of the democrat controlled house votes next week in favor of the articles. The president is impeached. Then the senate would hold a trial. Presided over by the chief justice of the United States. If twothirds or more of the senate votes to convict, the president would be removed from office. Michael moore and michael zeldin. We should report on this. Both sides, republicans and democrats seemed to be agreeing on the, this should be a short trial. If you were doing this, would you want a short trial . There is probably benefit to having a short trial. Especially with the realities in the senate. And you have people campaigning in the senate. They dont want to be sitting there six weeks in a trial. This thing will go on ad nauseam. If write in georgia, i might talk about it. Cut down on the posturing and get to the issues at hand. I think i think likely mcconnell will keep a tight rein on it. It is a lot more to do with politics than it is to do the legal case. Its both. The house managers, the people who will come to the senate and present the evidence like a prosecutor would in a regular criminal trial, they have to make their case. Put on the evidence. Put on live witnesses or put on the recorded witness testimony that we saw. Then the president has to respond to that as a defense attorney might in a trial. Then theres a closing argument. So all that takes time and i think they really need to do this with great seriousness. You dont see this very frequently. Thankfully in our history. And you dont do this, flippantly. So i think there has to be a serious presentation of evidence. A serious substantive defense to those accusations. And then a vote. There has not yet been serious defense allegations. There were none made today in the house Judiciary Committee and i will be very interested to see what the merits of the case are. Either the trial was going to be too short or too long. The impeachment investigation inquiry was behind closed doors. Too out in the open. Whatever the democrats have done, theyve opposed it every step of the way. We have jerried in a her making the case about why this Impeachment Vote had to be held even though an election was just a year away. Here he is. If we do not respond to President Trumps abuses of power, the abuses will continue. We cannot rely on an election to solve our problems when the president threatens the very integrity of that election. To Michael Moore, if you take a look at conservative media after he said that, it is proof. They want to overturn the election result. 63 million americans will be disenfranchised. Thats such a ridiculous argument. Lets say hes impeached and removed, mike pence becomes president. Thats right. There will be no change. These are the people who typically talk about the Founding Fathers and what they intended with the constitution and the constitution here says congress has this power and the duty and requirement to look at this and to look at impeachment. So i think the argument is nonsensical. Th they talk about we should wait until 2020. They really cant do anything to it. The constitution never intended that. They intended the congress to come in and control the executive when he had an out of control executive. Somebody with malfeasance in office. Congress took an oath. It is their oath to come in and defend the constitution. If they believe there are articles of impeachment should be issue, theyll vote on it. And ultimately the senate will make a decision on whether or not that can be proven and whether or not there will be a removal. We all know. And this is not a trial that will try to persuade the senators. This is a trial for the American People to watchful. And for the American People. Also what the founders did not consider, or thought about would be present, Political Parties within congress. When you have the situation that we have now with one party which is sort of, i guess, one of them refusing to realize reality, everything breaks down. Thats right. We are not talking about the merits of the case any longer. We are talking just about process. They are pounding the table over the unfairness that they see in the process. Of course, if the process was stretched out a long period of time, they were complaining about the length of it. If it is too short, they will complain about the shortness of it. So when you have no defense on the merits, thats what you do. You just pound the table. Thats what were seeing here. Hopefully, the senate will be more sober in their deliberations, and will get to the bottom of the backs that were presented in the house. And the American People will get to make a decision about whether this conduct in their own mind was high crime and misdemeanor was wrong and should be sanctioned irrespective of what the vote is in the senate. Is it possible that mcconnell could get out of holding a trial at all . Could they walk away from all this, have a simple vote and move on . Doesnt seem to be. As Michael Moore said, there is a blank slate here. But it seems to me there has to be by the language of the constitution, a trial in the senate. And they have their own rules about what that trial shall consist of. I dont think they can just have a motion to dismiss the articles of impeachment, vote to dismiss those articles and call it a day. I think they have to have a trial. And i think that they run Political Risk if they dont. I want to you put your democrat hat on. Nancy pelosi came kicking and screaming to this moment of impeachment. And she did it not just when the facts were punching her in the face. It was obvious this was happening. Did they wait too long in getting to this point . They seem to be waiting for the politics to resolve themselves rather than the right thing to do. There may have been a little delay. I understand why she did it. Part of it is momentum and perception and i think some of the momentum got lost. And there were some things strategically they may have missed. Im not sure that i would have put my law professors up instead of fact witnesses. Youre talking about a murder case. You put up the people to talk about the murder. You dont put up the doctor to say who are not it was an accident. I understand. She has a big caucus to control and she has to make sure that theyre moving forward in a way thats representative of the caucus and is respectful of those different views. Inspector general Michael Horwitz is standing by. The fbi was justified in launching the probe. He told the extended Judiciary Committee on wednesday the report does not indicate anyone linked to the investigation. The report found the fbi made 17 errors, all omissions when applying for Court Approval to wiretap a Trump Campaign adviser. Although we did not find documentary or testimonial evidence of intentional misconduct, we also did not receive satisfactory explanations for any of the errors or omissions we identified. We found, and as we outlined here, are deeply concerned that so many basic and fundamental errors were made by three separate hand picked investigative teams on one of the most sensitive fbi investigations. Joining us now, political commentator mo kelly from Stanford University and again michael zeldin. And since youre just joining us, ill bring you in for the first question. What is more important here . That the fbi was cleared of any political bias in the origins of the russia investigation . Or there is the 17 problems, possibly Serious Problems in the way they bebl getting the warrants for wiretaps. I dont know if it is either or. I think you can be encouraged that it was found there was a legal predicate. And you can be discouraged in the management of the investigation that there were serious procedural problems. The people who support the president will take that and run with it as you see attorney general william barr. And the people who do not like the president , do not spore the president , will find theyve been validated in their own way. Moving forward, it is still troubling that were not exactly sure how the fbi made a role in the larger examination of our justice system. Michael, just staying with the history of the wiretaps and the investigation for the fisa examinations. How serious were these breaches . Their they were serious breaches. Lets be clear. That there have been historically documented cases, case after case of missteps like this in the fisa process. And this fisa court needs to be reformed. The best thing that can possibly happen out of this whole horowitz investigation is that they meaningly look at the fisa application process and the court that reviews these things in secret. There have been efforts for a long time to perform this process and were seeing again the abuse of the fisa court, because no Defense Attorneys are allowed in there. So these are serious mistakes for sure but they are not unique. We have a situation with the attorney general who essentially is questioning his own independent Inspector General and his findings and very publicly questioning those findings. And the accusation against attorney general barr is he is acting as a Communications Spokesperson for the United States. Well, the attorney general has been very forward leaning on this. No question about it. What he has tried to do is to articulate the president s position on this. And some would say, look, thats not appropriate for him to do. The reality is, given his track record, given where hes been on a number of issues, this being just one of them. It should not surprise us that he would emphasize the lapses in the fisa process that were uncovered by the Inspector Generals report as opposed to the other finding, which a lot of people would consider the major finding. That there was no overt political motivation for the start of the investigation. So this i think has become par for the course for attorney general barr which is why his detractors have consistently criticized him for the degree to which he has defended the president. Forward leaning. Has the attorney general been forward leaning . I would say he has a balance problem and he is leaning all the way to the right. Like him or loathe him, i thought he was supposed to be representing the United States. Hes supposed to be the highest Legal Executive in the land. Instead, at every turn, at every opportunity, at every moment, he has bucked his own Justice Department to be an advocate specifically openly, brazenly, nakedly for this president. And theres no other reason other than for partisan right leaning reasons. And as someone who knows how the Justice Department should be working, the role of the attorney general in all this. How do you see it . Let me just respond to that last observation. I dont believe necessarily that attorney general barr in this case is shilling for the president. I think these are his personally held beliefs. That there was inadequate probable cause to start. Cross fire hurricane, the initial inquiry about the russian meddling with the campaign and the collusion, and i think he thinks there was improper, in the page identifiesa warrants. That that, he should not have aired these views publicly as he did. He defends himself by saying, he doesnt want to leave the record sort of misleading to the american public. Thats not the process. The process is if he has an observation to make about the Inspector Generals report, he administration it in writing to the Inspector General and they discuss it. Make it is incorporated in the report. What did he here in coming forward, even worse, durham, the guy he hand picked to do this followon investigation, is not acceptable. It is outside the normal processes. Thats the mistake that hes made. And to finish off with you. Weve seen this dispute between the fbi director. The it is like spying. He believes he spied on the Trump Campaign. Christopher wray says we dont use that term. And essentially, puts write a on notice that hes about to be fired like comey. This is a tough one for chris wray who i think is commenting in the way he should be. And frankly, observing what he observed about the fbis conduct during this investigation. And i think chris wray is telling it like it is. It is a difficult position to put yourself in knowing the president wants absolute loyalty regardless of position. He wants someone to defend him regardless of the circumstances. Thats not what chris wray is doing. Whether it will cost him his job, i think a lot of people think it will. Okay. More dirth, more delay. More paralysis for the country. Now from berlin, i want to you watch part of a report from matthew explaining why this election is upending the way politics has made out for generations. Whats happening in this constituency is also taking place across the country. Brexit, disillusionment with politics and politicians. Turning Traditional Party loyalties upside down. Making this british general election particularly tough to fight. And hard to pick. I guess one of the major things is that brexit is not split along party lines. More along the lines of proann immigration. That is what is causing dillies. You can argue these changes have been afloat, where the blair government blurred the lines and the ownership of the right and the left. And particularly as you point out, around questions of immigration and security and so on. And you can argue here that what hes been trying to do. Go back to higher taxation, a fairer society, a redistribution of wealth and a greater government role. It is a way of going back to those particular positions. When it comes the brexit, what has been so complicated is it has not divided up neatly along party line. This is a system that privileges the two party system. You have within the conservative party different views on brexit that some kind of consensus, that it is within the labor party that there are these significant issues around petitioning to march constituencies and want to heave the European Union versus an overwhelming majority that want to remain in it. This election is about a choice. Tomorrow the people all across the u. K. Will go to vote and they have a choice. They can elected a government that they can trust. They can electricity a government that will eliminate Child Poverty across britain. They can elect a government that will end the cruelty and injustice of universal credit. They can elect a government that will give hope to the next generation by investing properly in education for the future. All across the u. K. And they can elect a government that will deal with the great issues on the world stage. Interesting that because of brexit, and they dont really have sort of an understandable position on brexit. A clear position on brexit. Those traditional supporters are heading toward the tories in some ways in deep labor territory. And weve seen some of these traditional labor voters go for different far right parties. Different right wing parties and so on. What this election will show, this is of course another opportunity for the british people to weigh in on this. Two years after teresa mays gross miscalculation where she lost the party majority. We will find out later today and tomorrow is whether jeremy corbins cal chags to be ambiguous around brexit and to appeal to those labor members that want to leave the European Union was itself a gross miscalculation or whether it will be rewarded at the ballot box. The issues around britain, that the likelihood is that these voters will not go toward him. The one party that has been talking about this has been Boris Johnson. What were hearing about the rescue operations for those who survived. Some of the details are pretty remarkable. It really is heroic for those who are regular citizens, tour guides, helicopter pilots who took it upon themselves to rescue as many as they could. Two kind of cases that really stand out. One was there was a second tour boat on the island just before the eruption. They had steamed off. Had that tour boat waited 15 seconds longer, there would have been double the number of people on the island and nobody in the vicinity to help rescue survivors. Because this tour boat was a safe distance away when the eruption happened, instead of sailing back to shore, they turned around and pulled 23 people out of the water and passengers who had maybe limited training as first responders, were treating these burn victims. Pouring cold water on them. Trying to keep them awake and alive to get them to shore. A 90minute trip back to shore. And then you had helicopter pilots who conduct this tours from here. Despite the dangerous conditions to 90 back to the island with that huge ash plume and the eruption still happening, they chose to lands inside the crater, ignoring the warnings from authorities and they rescued 12 people who were still alive but very seriously injured. Youre talking about people with burns, with their skin falling off. People who were hit at very high speed with rocks that were shot out from the volcano.
