Different things to each of them. I said to my daughter, you know, dont drink a drink that you didnt pour. Dont drink out of a red cup. And i said to my son, dont ever do anything that steals a womens dig any nomens dig anni womens dig any nty or sense of safety. My dad never said anything like that to me. People are now saying that to boys. It is not a hunt. It is not a game. These are people and they have feelings and the things that you do to them, whether you intended to do it or not have long residence. They may be hurt by this for many, many years, and thats not okay. Certainly having much different discussions now with our kids and maybe than we would have had a month and a half ago. No question about that. The senate saw and the country saw a certain version of Brett Kavanaugh when he testified under oath on thursday. His o i wonder if you could talk to his temperament that you saw in college and if its consistent with what we saw last week. You know, i was worried about this. I mentioned in the first thing that ronin wrote. I said that he was belligerent, and i had this conversation in my head when people say justify that. Tell me something he did that was belligerent. I had heard stories of violence, not against women at that time, but i hadnt seen anything. How do you characterize the fact that you know somebody when they get past a certain point in drinking becomes violent and belligerent. I think what we saw on tv in front of the senate is an illustration of that. That is what blig raelligerent like. I appreciate you coming and telling your story to us on new day. It is an important discussion to have and we value your input here. Thank you. Thank you for having me. Just a note, of course, judge Brett Kavanaugh denies this happen. He denies jaime roches version and says jaime has an axe to grind. I know poppy and jim sciutto want to talk to you about it. If there is a Silver Lining to all of this drama and c controver controversy, it is the conversations that were having with our own children and how important those are to start early. John, what struck me, as you talked to him there, his own willingness to acknowledge the limits of his knowledge. He claimed to have memories of things, but in the places where you couldnt fill in the spaces. He said, listen, i cant fill in those spaces there. He was doing his best to give a thoughtful account. I have to say, it strikes me. I asked him does he have a specific memory himself of Brett Kavanaugh not remembering something the next day after drinking, and he said yes. He said he remembers vaguely sitting around a room and talking about things that didnt happen in the drinking. Jaime roche and Brett Kavanaugh cant both be telling the truth here. This is not something that the fbi looked into. There are questions. There will be questions raised about whether or not they should. And for people who may not have seen the full interview 20 minutes that you just did with him, what stood out to you the most . What is the most important thing you think the American People learned from hearing from him . I think saying Brett Kavanaugh lied under oath. That is a serious claim to make. Serious and new and specific. He says he specifically lied about his memory loss while drinking. Brett kavanaugh then specifically lied about some of the terms he testified to to the u. S. Senate. I think that has the most lasting significance. And then i think why he chose to come forward and perhaps and i want to give alysn credit for this does he worry he came forward too late. And his answer was yes. Many witnesses in his view are scared to come forward because they are concerned about being attacked in public, as many witnesses have in this case. And they have. Further more, they havent been asked to come forward. The fbi, as we know, is not casting a very wide net. It was very interesting to hear jaime roche say there is other people at yale that would have information. And the letter signed by more than 1,000 law professors speaking to the temperament he displayed under oath and what jaime roche saw and how that all related. You will have a busy two hours here. Theyre starting to read these documents. Then well hand it over to you. Were joined by a cnn legal analyst and josh campbell. Josh, if i could begin with you. Lets get to that issue. This is a background check. There has been a lot of back and forth here about what belongs in a background check and in this investigation that the fbi has now contacted. Would the fbi normally be interested if a nominee like Brett Kavanaugh presents a certain account of the way they drank and so on . Even many years ago. And others who were there with them say the opposite . It would, but as i watched the interview, i couldnt help but think it is illuminating, it is compelling, it is utterly inconsequential because as we speak right now senators are reading the final report that was handed over from the fbi. That gets to your question, what is in that report. It doesnt include all this information. In a criminal investigation there are no limits. In this case, the Background Investigation, theyre set by the parameters of the white house. All these allegations coming forward, it doesnt appear that the white house or senate care enough about whats being said to incorporate that into the investigation. To your point about fbi investigations having limits versus background checks being limited in scope by the white house, lets cue up if we can the white house spokesperson this morning, his answer to that question. Lets play it. The senate has set a scope on what they are interested in. They have already investigated this matter through their own senate process. They wanted interviews of additional individuals. Any Background Investigation has to have some form of limiting scope. And this time it is always in these matters set by the white house, but we deferred to the senates requests. You are shaking your head. He chose intentionally to say the senate set the scope. Right. And as i listen to that, you know, hes half right. Yes, the fbi takes its direction from the white house. But when he said every Background Investigation has to be limited in scope, that is not true. In fact, we want the opposite if you are the American People, if you are the senate, if you are the white house appointing someone, you want to know everything about this person. Are they suitable for office . You dont have to set a limiting scope, as he says. Yeah. And the scope could have been the week that they had. I mean, that is a limit in scope. They could have said and at times they said this is what is happening. You have a week. Go look into it and whatever you do in that week is fair game and then give us a report. Please stay with us because we have more to discuss. Lets go to the hill first because whether judge Brett Kavanaugh gets a lifetime seat and keep in mind, the swing seat on the highest court in the land or if he goes back to his already powerful position, the nations second highest court. All of this will be decided today, and these are the senators that will likely decide. Three republicans, two democrats. As we speak, Brett Kavanaughs supplemental fbi background check initiated less than a week ago is in the hands of the Senate Judiciary committee. Members taking turns to look at the single printed copy. Thats right. Just one printed copy of a series of witness interviews and that would specify that is nine witnesses. Not nearly as Many Democrats and Brett Kavanaughs accusers as they had wanted. Exactly. Before the new fbi report arrived, it came at 2 30 in the morning. You see what happened around 10 p. M. Last night. Mitch mcconnell set in motion a procedural vote for tomorrow, a very important procedural vote, a final vote on Brett Kavanaughs nomination on saturday. He is keeping his promise that this critical lifetime appointment to the Supreme Court will be decided this week. Lets go to the hill. Manu raju is there. Right now Democratic Senators are going behind closed doors in a secure location in the capital to get briefed about the contents of this fbi investigation. This came after republican staff on the Senate Judiciary committee spent the hour 8 00 a. M. To 9 00 hour just looking at it themselves, getting briefed and reading the contents of that one hard copy report. Now, after the republican staff read the contents, they will then brief the republican senators when they have a chance to get briefed about this in the 10 00 a. M. Hour. And that is expected to be the full Senate Republican conference. So that means the three key senators that we have been talking about for days, jeff flake, Lisa Murkowski, Susan Collins who could determine whether or not Brett Kavanaugh gets that seat on the Supreme Court for life, they are expected to get that briefing at 10 00. It could spread up until noon. Within that time frame, expect democratic snavenators to come , brief the press. You will expect them to express significant concerns about what they view as a probe that has not been done adequately. Im sure they will see things in there they dont like. Republicans already saying there is nothing that corroborates the allegations made against him. Expect today to be all for the narrative being pushed by each side. One on the democratic side, completely opposite on the republican side. But the focus on those key senators. How do they view this investigation, and they want more answers and are they going to be prepared to vote yes or no come tomorrow. I want to ask you your help in clearing up a question here. There is some confusion here and some came out last night. On this question of whether there was any indication, any concerns about Brett Kavanaughs drinking habits raised in the previous background checks. Right. You are aware the Judiciary Committee tweeted out there was not a whiff of this. That was contradicted by several Democratic Senators. I heard one on the air, senator coonz, although he did not sign his name to this, reference something in previous background checks within the limit of saying, listen, i cant talk about it fully because this is private, confidential, et cetera. Can you clear up the facts . It is very uncertain what exactly the democrats are eluding to there. Some of you are hearing very late in this process. And because they are bound by the confidentiality of the Background Investigation, they are not providing more details. So republicans already are pushing back on this. We dont know how jeff flake, Lisa Murkowski or Susan Collins view that, if they are aware of whatever democrats are referring to here. But asking those three key senators about this issue, about drinking and whether or not he essentially investigating. Jeff flake in particular hold water on that aspect of Brett Kavanaughs life. How will that impact the vote is uncertain. We will try to clear it up as best we can. The Administration Says that it is now fully confident that senators will approve Brett Kavanaughs nomination. Officials telling cnn they believe the latest interviews show no corroboration of the allegations against the Supreme Court picks, specifically allegations of Sexual Assault. Abbie phillip has the latest now. The white house expressing so much confidence this morning about the Brett Kavanaugh nomination saying that they believe that whatever is in this fbi report is not going to stand in his way and also that the president , while he has not read the full report, has been briefed on it this morning. But we asked cnn asked this morning to tell us whether the white house felt they had the votes because ultimately thats what matters here. And here is what he had to say. We dont necessarily know yet. Obviously the senators have just begun to review this information. But we feel very confident that we will have the votes. And the white house is also lamenting the effect of all of this, not just on Brett Kavanaughs reputation, but on the Supreme Court which they believe he will be on fairly shortly. The president this morning also injecting some partisan politics in there saying that he believes the voters are with him. He says the harsh and unfair treatment of judge Brett Kavanaugh is having an upward impact on voters. The people get it far better than the politicians. This great life cannot be ruined by despicable democrats and totally uncorroborated allegations. Thats going to become important for the red state democrats in the undecided column. The white house says they are in close contact with those undecided senators trying to get this over the finish line likely by this morning. All right. Thanks for the update from the white house. Jennifer, i also want to point people to what i brought up at the beginning of the show. That is apart from the allegations of Sexual Assault, the allegation of sex sual assault, more than 1,000 law professiors have signed this letter. Judge Brett Kavanaugh displayed a lack of judicial temperament that would be disqualifying for any court and certainly for elevation to the highest court of this land. Do you agree from a legal end from what you saw and is that germane to this . I do agree. We have never seen a Supreme Court nominee behave that way. It is contrary to how you want a judge to behave. And the way he was speaking about the partisan politics that he thought was attacking him means to me he really cant be fair in the most political cases that go to the Supreme Court, especially things like gerrymandering, where you have a Political Party on one side. The problem is do the senators care . I feel like senators will be saying we should have picked a different guy. I wish we could back it up and pick someone else. We cant. So are we just going to stick with him . And im worried the answer will be yes. The fbi did not interview the two key witnesses, Brett Kavanaugh and his accuser blasey ford. Is that what they say is, listen, they already gave their testimony. Thats enough. Is that protocol . It is either what you said there, that they thought maybe there is enough on the record testimony thats been taken in front of the senate that they have a body of information they could draw from and use to interview other witnesses and ask questions about or it is something else. This is the part thats troubling, that there is this one week deadline thats been imposed on this investigation. Obviously, we talked about these parameters. We have been reporting our sources that are familiar with the investigation. One of them actually described the process saying that just because the fbi hasnt interviewed dr. Ford yet doesnt mean they wouldnt want to interview her at some point. In fact, a key witness you might want to save to the end. The problem is, times up. Even if they wanted to, it doesnt appear that either they were allowed to or that it would fit within this narrow one week window prescribed by the white house. This is takes place all over the country. We are talking about these undecided senators. I spoke to elizabeth kennedy. She has family in maine constituents of Susan Collins. You talked about earlier the impact of Susan Collins vote will have on her legacy. I know a group of survivors came down all the way from maine to d. C. Yesterday for a scheduled visit with senator collins, and she did not make that visit with those constituents. If shes not representing the constituents and their survivors of maine, it goes down to what is the legacy. Is it going to be a shameful one that does not represent the constituents of maine and honor oez voices or it will be one that impacts the survivors in a positive way and sends a clear message for generations to come. Theyre sad. Theyre angry and they want to take action. This will be a day of action with a rally outside of the Supreme Court and also outside the capital steps. You heard the other day President Trump saying this is a difficult time, a scarey time for young men in america. How does that make you feel . I think its deeply problematic and concerning because its sending a message that its not just about believing survivors. It is about the fact that we dont care about their experiences. That includes men. It is not just women. Survivors touch every gender identity. And so its important to remember that. And its important to remind us that we need to value those voices. Great. So this is the group were heading. We just passed baltimore, arriving in washington soon for what they are calling a day of action. Thanks very much. This morning, we continue to watch closely for reaction to several key senators to this fbi report. They have said theyre waiting to read the latest fbi interviews on Brett Kavanaugh before deciding how they are going to vote. As democrats also are getting a first look at this report, remember the full senate will see it before they make their nominations. Nice to have you this morning, senator. Thank you for joining us. Thank you. Lets begin with the facts. We know the fbi had extensive conversations with nine people. Okay . Nine. Nowhere near the full list of those who were turned over to them recommended to them by democrats and republicans that they should talk to. We know that ford and Brett Kavanaugh did not speak to the fbi. They did not interview them. In your view, is this a fulsome and credible investigation . It is obviously a cover up. The Trump White Houseworking with the Republican Leadership in the senate have deliberately circumscribed this so that only a small handful of people will be questioned. If any leads are developed that the fbi is not allowed to follow them in order to determine the truth of what happened. And whether were talking about debby ramirez, were talking about james roche, were talking about many other people that came forward to say they are willing to give information. The fbi, the white house and the Senate Leadership are just turning a deaf ear. That is quite an accusation to say this is a cover up by the white house. I would say in response to the question of the white house limiting the scope, we were told the senate has to put boundaries on this and has to put limits on this. To that you say . I say theyre making a mockery of the constitutional requirement that the senate provide its advice and consent. They are limiting how many people can be interviewed in the wake of the Brett Kavanaugh testimony. Theyre not even interviewing Brett Kavanaugh or dr. Ford. And then theyre handing us a document this morning that 100 members of the senate must read. They have only made one copy of it for the United States senate and then scheduled a vote tomorrow on this issue. This is making a mockery of the constitutional responsibility of the senate, the Trump White House has orchestrated it, the Republican Leadership has about to it. But the American People are not being served by allowing senators to read and understand what the body of knowledge is about this man. Let me ask you this question because what we know and we dont know everything about of course whats in this report because we havent read it ourselves but we believe that the fbi at least reached out to potential witnesses to the alleged Sexual Assault. It is the white houses reading and i suppose we take that with a grain of salt, but still none of those witnesses corroborated fords account. If it is true that the limited number of witnesses to that did not corroborate the account, does that, in your view, present enough doubt or questions about that account to move on . No, not at all. The veracity of judge Brett Kavanaugh at the hearing is clearly something that is questionable given the dubious answers that he gave to the Democratic Senators about the information back from when he was younger. Thats not to say that a young person isnt capable of making mistakes. But you should not be telling lies about it to the United States senate in your confirmation hearing. And his temperament before the senate during that hearing, that also clearly in my opinion disqualified him. When hes talking about everything that goes around comes around, making references back to the clintons when were just trying to get to the source of the truth of who he is, what his background is and what his temperament is, clearly he got disqualified. And the reason it is so important is that donald trump promised the American People that he was going to name a justice who would repeal roe v. Wade, who would repeal the Affordable Care act and the preexisting condition coverage that every american is entitled to. So the consequences of having a cover up, not having all of the information be made available to the senators could lead to someone who is serving on the Supreme Court who in fact does not have either the credibility or the temperament, but is nothing more than a political appointee to effectuate the political agenda of donald trump. The Washington Post reporting this morning that the white house significantly curtailed the scope here of whom the fbi could and should talk to about this and that it should be focussed on the alleged Sexual Assault or the drinking and behavior in college and high school for judge Brett Kavanaugh. The white house says, look, the senate puts a scope on these things and these are the appropriate things. Will the swing votes, those five key swing votes for the senates see this report as sufficient . I think more likely than not. The history of many of the republican critics of the president is they bark a lot dont bite. No one will be surprised if that is the outcome. What happened is not only democrats but the vast majority of voters who have been skeptal of Brett Kavanaugh and yesterday in a poll 52 said he should not be confirmed. I think it will continue to pressure for democrats to reopen these issues, at least in an investigator matter if they take the house in november. There clearly is a opposed view that Brett Kavanaugh has been treated unfairly here, that these allegations they say are uncorrobora uncorroborated. I want to read a column. Conservative columnist but frequent critic of President Trump. He writes im grateful because trump has not backed down in the face of dangerous standard settings. Grateful because feit has its us in life and never more so than the face of sly moral bullying. The argument here is that democrats pushed uncorroborated allegations with political motivations. Hold that thought because we now have the announcement from the department of justice. Violations of several u. S. Criminal laws from malicious cyber activities against the United States and its allies. I am joined by the u. S. Attorney for the Western District of pennsylvania, scott brady. The fbis Deputy Assistant director for cyber and director general of the Royal Canadian mountain police, mark flynn. The dutch minister of defense and the United Kingdoms National security adviser held a joint press conference. The joint u. K. dutch intelligence operation led to four russian gru officers being caught red handed while they attempted to breach the Cyber Security of the organization for the prohibition of chemical weapons. This gru target, a laboratory in switzerland. That was their next target analyzing the deadly russian nerve agent recovered in the u. K. , as well as other chemical agents used in syria against innocent civilians. The prime ministers issued a joint statement condemning the russian behavior. Our indictment charges some of the russian operatives along our colleagues in moscow as part of a conspiracy to hack individuals in the United States, canada and europe to obtain information or access that was exploited for the benefit of the russian government. More specifically, this indictment alleges a conspiracy to use computer hacking to obtain nonpublic personal Health Information about athletes and others in the files of antidoping agencies and sporting federations in multiple countries and to release that stolen information selectively and sometimes misleadingly. All of this was done to undermine those organizations efforts to ensure the integrity of the olympic and other games. Other targets of this conspiracy were the chemical Weapons Laboratory and a Nuclear Power company here in america. Three of the seven departments charged in this case were previously charged in the indictment brought by the office of special council. So you have been listening there to the department of justice announcing new criminal charges against seven russian nationals, specifically members of russias military Intelligence Unit for a conspiracy to hack individuals in the u. S. , including health care information. They have not identified those individuals. They mentioned, other public figures. This happening as the dutch are announcing similar charges as well. So russian efforts to interfere in this country continue. Again, yep. And aggressively. Lets go back to our panel now. We have been talking about the Brett Kavanaugh confirmation. Back to the question i had teed up to you before, republicans, many conservatives, even critics of trump here see that Brett Kavanaugh has been treated unfairly in this to a political end. I want to ask you about that. The criticism i think stems from the reality that the me too movement has given rise to a counter movement. And what i hear Brett Stevens saying, if i understand it right, is that the count eer movement is making its voice known. But we should be clear we have to distinguish between whether or not bretts whether or not judge Brett Kavanaugh can be proved to have engaged in criminal conduct in the past. Surely that is not what the question is before us in its entirety. The question is whether or not he should be elevated to the court. If the standard is if we cant prove you are a criminal, you get to go to the Supreme Court, were all in a lot of trouble. So deborah ramirez, someone who has levelled accusations against Brett Kavanaugh who says he exposed himself to her while they were at yale provided a list of 20 people the fbi should talk to about that, she tells the new yorker, and i quote, remember the fbi talked to her, i am very alarmed first that i was denied an fbi investigation for five days and then when one was granted it was given on a short time line. The people key to corroborating my story have not been contacted. I feel like i am being silenced. Her lawyers, we have learned that a letter complaining about that to the fbi. How will senators weigh Something Like this. Right. The letter is scathing. And i think what were seeing already today and well probably see over the next 48 hours is unprecedented. In the interview this morning and the statement from another yale class mate, we will see almost a crowd sourced alternative investigation of Brett Kavanaugh with people coming forward with accounts that the fbi did not pursue under the elements imposed by the white house and Senate Republicans. Now, whether that is enough, you know, we are down to really the question of what jeff flake, Susan Collins and Lisa Murkowski consider a legitimate investigation and consider enough to justify their vote. But i think in the next 48 hours we are going to see something unprecedented and really marker of how the social media age is changing all of the way we interact and one likely to reinforce the depth. In the polling yesterday, a significant plurality said they believe blasey ford over Brett Kavanaugh. If the president says, yes, there is evidence of republican intensity increasing around this fight in terms of the election, but there is no doubt that if you look at kind of the suburban areas that are deciding control of the house, it is 64 of in that poll yesterday people that live in the suburbs said if there is still doubt, not even prove, doubt, after this investigation, he should not be confirmed. Republicans have to realize whatever this means for the senate it is greatly compounding their risk to move forward on these additional allegations. When we look at north dakota. Thats the senate. Thats the senate. Of course. Im just saying if you look at the support there, theyre looking thanks very much, as always. They show how close these two ships came, within 45 yards of the bow of the u. S. Decatur. China claims a lot s. W. A. T. Of the sea. The u. S. Rejects their claims. China claims jurisdiction over. Thats why you have c confrontations like the one we saw on sunday and perhaps more to come if the u. S. Navy goes forward with their plan for more freedom of navigations operations on the sea and in the ski. Vice president pence will talk about that and allegations of chinese election meddling. I want to read you another excerpt from the speech. This is an extraordinary statement. The Vice President attributing this to an intelligence official saying what the russians are doing pales in comparison. China is trying to meddle in local elections, trying to sew divide within the United States amongst the Trump Administration and local officials, trying to turn trump voters against the administration by targeting tariffs specifically in red states. It is extraordinary, not to mention whats going on with trade. Not getting any better any time soon, guys. Sounds like just the beginning of this one. Thank you so much. You worked in china.
