This is the hospital right behind me that karlesha was brought to after she was rescued yesterday. Weve learned a little bit more how this came down. Law enforcement in virginia tells me that they knew of this man because of some very serious charges, an outstanding warrant including attempted capital murder. They also knew that he had gotten his car from a dealership and because of the credit risk he was, they had put a gps monitor on him. That gps monitor led to where they were found, they were found in the back seat together, fbi, atf and u. S. Marshal surveiled the car, they didnt approach it, because they didnt want a hostage situation but when he walked out of the car, they apprehended him, her family says they are overjoyed. Carlesha freeland has been rescued. Philadelphia woman kidnapped on sunday now find alive. Carlesha Freeland Gaither was rescued in jessup, maryland, wednesday, after authorities identified the vehicle used in her abduction and tracked it down. When the subject exited the vehicle, he was apprehended when miss freeland was recovered. Once she had the time to process what happened we took her to the hospital. Reporter Police Identified her kidnaper at 37yearold Devlin Barnes, currently being held on attempted capital murder charges in another case. All of our prayers were answered when we were able to locate her in a safe condition and able to place this male under arrest. Reporter barnes uncle speaking out saying he is not surprised. My Expansive Knowledge of him, theres a thing about women or females. Its just hard for me to accept the viciousness of it. Im not necessarily surprised. Reporter the 22yearold nurse was abducted sunday night in philadelphia, just blocks away from her home. This disturbing video captures her kidnapping from beginning to end. The suspect parks his car and waits. And approaches her, as she walks across this intersection. She tries to walk away, when the man grabs her and aggressively drags her down the length of this block. She struggles to break free and yells for help, but he violently pushes her into his vehicle. The next morning, Surveillance Video captures a man dressed much like the kidnaper using carleshas atm card at a bank in maryland, hes also spotted inside this Convenience Store shortly after. Investigators do not have a motive, but say there is no indication she knew her abductor. I want to have a lengthy discussion about the legal aspects of this case, lets bring in paul callan, our legal analyst to talk about this and jean as well. Jean said whats going to happen next. When you look at why this man was out on the street, you really have to wonder, go back to 2005. Hes arrested for hiding in his estranged wifes closet, allegedly attacking her, raping her, et cetera, but he wasnt charged with rape. He was charged with aggravated assault, simple assault, false imprisonment, criminal trespassing and also wanted for an october incident with a 16yearold girl in virginia for attempted murder, attempted rape, inflicting thirddegree chemical burns. How is this man still out . There are going to be some judges who have to answer that question and prosecutors in other jurisdictions. Prosecutors live in fear of cases like this, where you look at a case locally and it looks like its a family situation, its not that serious, and it turns out to be someone apparently like this person, and we have to say hesril presum presumed innocent and have to try. How would he stay out on the street . The 2005 incident was looked as a domestic incident, not taken seriously enough. Hes capable of engaging in this conduct. You see this video, this is the sort of thing that sends a shiver down the spine of every woman who looks at it. Stranger comes up to you on the street and throws you into a car and abducts you, its one of the most terrifying videos you can view. Jean, i know this is really in the early stages but im wondering if the Defense Attorneys have even been assigned or hired yet by the suspect and if so, given these surveillance images, do you have any sense of what a defense argument might be . Reporter hes probably getting a lawyer right now in anticipation of this 1 00 hearing and of course in a case like this, when you have video surveillance, it becomes exhibit a for prosecutors. I think possibly they will have to try to negotiate something because the charges are adding up here, but i want to give you a little more information about this virginia case, poppy. When they realized he had allegedly, until youre convicted, abducked a young go i recall as she was walking along the street and ultimately setting her on fire they got an arrest warrant in virginia, they surveiled his home in october of this year in virginia and his mothers home and another relatives home. They believe he fled the jurisdiction october 2th or 30th. That would have been last week, and where did he go . Law enforcement says he must have gone to philadelphia. That brings up the important point, jean, of what you mentioned, both state charges and federal charges. To you, paul callan. Which do they address first . Are these addressed at the same time and which comes with more severe penalties if he is indeed found guilty . I suspect the federal case might be the one that will take precedence. Federal authorities have the machinery to investigate and put together the case. Crossing state lines here. Yes, federal law applies. Anywhere from 20 years to life, could you even get the Death Penalty in certain federal kidnapping cases and the fbi putting the case together and circling back to your question, what would be the defense in the case since the evidence looks so strong with the video im looking at it saying an insanity defense is probably the only way this guy will go. He probably suffers from severe Mental Illness of some sort and i cant see how hes going to beat the charge otherwise given the videotape. It wasnt the end of the world for republicans that they lost the president ial election. Its not the end of, for democrats, end of the world for democrats that we lost the midterms but i think what the clintons did, particularly Hillary Clinton will suit her well Going Forward, because she was willing to go to tough places, places where the odds were against her, and i think democrats in particular will appreciate that, and i think shell reap the dividends of that. I want to talk about that in just a moment and in terms of the electorate that did come out and actually vote and who didnt, but before i do, s. E. , i want to get your reaction to these numbers. You look at some of the exit polls from tuesday, 34 of people say they would vote for Hillary Clinton in 2016, no matter who else was in the race. Yes. What do you make of those numbers . Brad is right to the extent that i think if jesus were campaigning for some of these Democratic Candidates they sill would have had a tough time. Yep. But i think what those numbers speak to and you know, her record on the campaign trail speaks to is the fact that so much has changed in Hillary Clintons Democratic Party since the last time she held elected office. Back in 2006, you could be a democrat who opposed gay marriage, a democrat who voted for the iraq war, a democrat who cozied up to wall street. Back then she used to hype her husbands record on welfare reform and lowering abortion rates. These are just not things that democrats can talk about now. So when she goes to a rally for Martha Coakley in boston, she looks like an ease liz beth warren wannabe. Im not an anachronism in her party. She has to do contortions over the next two years to get there in time for 2016. That might not be convincing enough by that time, though. Brad, i want your response to s. E. , but also please. Lets talk about who came out and voted. This is a nonpresident ial year. Lot of people have been saying look, you didnt have as many minori minority voters out, young voters out for their base. Do you think that that is a leg up for you guys in 2016 . Well of course i do. Look, this say problem that democrats have to solve. We have got to figure out how we take president ial year voters that come out in big numbers, younger voters, minority voters, and make sure they understand the stakes in the Midterm Election. Sometimes i think a party doesnt, a partys base doesnt always understand the sakes in Midterm Election when they hold the white house, and weve got to do a better job than that. I disagree totally with s. E. On where Hillary Clinton is. The party has changed. Look, the Republican Party has changed. Look at what the tea partys grip is on the Republican Party so maybe it would be accurate to say that both parties have moved to the edges but Hillary Clinton, 83 of people in the exit polls, democrats in the exit polls say theyd like to see Hillary Clinton run for president or support her running for president. Ive acknowledged this as well, the party for someone like jeb bush has changed a lot since the last time he held elected office, too. Yep. Youre absolutely right. But where hillary is concerned is, she had an easier time of it this time because of what you just said, the people who turned out were older and whiter. When the people who are turning out for democrats are younger in minorities, then she really doesnt speak to where the Democratic Party is on a number of issues. So shes got a lot of work to do in 2016. I think were getting a little ahead of ourselves. She hasnt announced yet. Okay. At some point in time, we are going to be much more significantly driven to mobile pay and it is going to be a diminimus level of cash being used as a currency, over time. What i would say is that we will be at the middle of many of these conversations Going Forward in which starbucks will have a significant role to play. What does that mean . It means that starbucks as a Coffee Company will be able to leverage the equity of our brand and our mobile payment platform to participate in how people are going to pay for goods and services both inside our stores and possibly outside. Commissioner Roger Goodell suspended rice for two games for hitting his fiancee but then changed that to an indefinite suspension. Cnns andy scholes joins me now. The big question with goodell is what did he know and when did he know it regarding the tape of ray rice striking his then fiancee in the elevator.
