these are all organizations opposed to the death penalty. but what this case different from others in the past as we approach the 11th hour -- there are hundreds of thousands of people. you saw their signatures on those petitions that were delivered. these are people, a lot of these people may not typically be against the death penalty. these are people who are looking at the case thinking that there are doubts here and that an execution needs to be stopped. there's a lot of people pushing to have his sentence commuted and not have him set free. you don't see a lot of people coming right out and saying this man is innocent. >> speaking of those who do think he should be set free or at least the case looked at, some names might surprise you. the former fbi director william sessions who wrote an op-ed in the newspaper in atlanta yesterday saying, "the evidence in this case consisting almost entirely of conflicting stories, testimonies an statements is inadequate to the task of convincingly establishing either davis' guilt or his innocence." >> sessions is not just a former fbi director. he is a former federal judge, former federal prosecutor, joined by the likes of jimmy carter, the vatican and over 50 members of congress signing a letter that's going to the parole board. >> still there are those who believe he should be on death row and executed in just a few days. the family of the murdered officer is coming out adamantly saying that they have the right man. also the prosecutor, the former savannah prosecutor, the d.a., spencer lawton, a quote from him as well saying that the trial was fair. davis was represented by superbly skilled criminal defense lawyers. he was convicted by a pare jury, seven plaque and five white members. the jury found that davis after shooting another man earlier in the evening murdered a police officer who came to the rescue of a homeless man davis had beaten. >> that's an important point. spencer lawton points out that there is physical evidence in this case. he says the shell casings from that earlier shooting in which davis was convicted -- >> which we don't hear a lot about. >> right. also match the shell casings from the murder of this police officer. so he says there is physical evidence there. this is a case that's not completely void of physical evidence. >> so when you look at the parole board, that's whose hands his future really lies in. what are their options? >> their options are they can commute his sentence to life without parole, life, they can ask for a 90-day stay while they consider this case, or they can just deny clemency and let the execution go on as planned on wednesday. but if you look at the history of this pored, we shouldn't expect any surprises here. in 33 years they've only granted eight cases clemency. only eight. and this is out of 63 cases they've considered. but something really surprised me. out of the cases where they've already gone to an inmate, looked at the case and say no, we're not going to grant clemency which they've already done in davis' case, the number of times they've reversed themselves, gone back on their decision is zero. they've already done this once in his case and it doesn't look -- if it does, they will be making history by going back on their previous decision. >> there was a federal hearing last summer. right? also asking that question is russell moore, dean of the school of theology at southern baptist theological seminary in louisville, kentucky. here is a quote from his article in the baptist press news -- "this is more than an embarrassment. this is more than cruelty. this is a repudiation of the gospel of jesus christ." dean moore joins us now from louisville. thank you for coming on to talk about this. those are some pretty strong words that you wrote there. >> well, it is a grievous thing to hear a christian leader spike in this way when according to the christian scriptures, marriage is a picture of the gospel of jesus christ. this is a repudiation of everything that we are about. a man is to love his wife, the bible says, as christ loves the church. and that includes in weakness, that includes in those times of sickness. so this is horrifying. and this doesn't speak for christians. >> whatever happened to death do we part and for better or for worse? >> well, i think that you'll find that the majority of bible-believing christians are holding fast to those words and holding faithfully to those words. caring for one another and caring for spouses who are harmed and who are injured and who are sick. that's exactly what christianity is about. christianity isn't about power. it is not about loving someone who is useful to you. it's about what jesus has done for us in the gospel which is to love us when we're useless and to love us when we're done for, when we're completely, completely marginalized. that's what the gospel does and that's what a christian marriage is to do. >> when you think about the number of supporters and number of people who believe in pat robertson, what kind of damage could a statement like that do? >> i think it does great damage because i think there are many non-christian friends and neighbors of ours who believe that pat robertson or others who articulate this kind of message of a christianity based on power and usefulness as speaking for jesus when that's not the way that jesus speaks. jesus speaks about loving the weak and the marginalized. he speaks about a gospel that comes after us with the blood that redeems and heals and is faithful to the point that taking up a cross and carrying it. that's what the gospel is about. so i'm afraid if people see this kind of message, they'll assume that that's jesus christ and it's just not. >> i don't want to put you on the spot -- but i will. if you were asked this question, sitting on that couch, and it's advice, what advice would you have given. >> well, that doesn't put me on the spot at all. love your wife and remain faithful to your wife, care for her and meet her needs as you would your own body, as jesus has done for you. all the way to the point of death. >> does it surprise you that -- i would think it would -- that he would suggest the word "divorce"? >> it does surprise me, although i have to say, in recent years reverend robertson and some others have been making increasingly embarrassing and inflammatory statements, although i think this, this goes beyond even anything else i've heard. >> dean russell moore, appreciate your type and your insight there into that story. thank you very much. >> thank you. so why is a passionate award-winning teacher quitting the job that she loves? most any teacher could probably answer that question. up next -- a look at the education crisis. two of the most important are energy security and economic growth. north america actually has one of the largest oil reserves in the world. a large part of that is oil sands. this resource has the ability to create hundreds of thousands of jobs. at our kearl project in canada, we'll be able to produce these oil sands with the same emissions as many other oils and that's a huge breakthrough. that's good for our country's energy security and our economy. today in our cnn series "fix our schools," a sad reality. nearly half of all public schoolteachers quit before their fifth teaching anniversary. one big reason -- low pay, especially when compared to teachers elsewhere in the world. our natasha curry meant one teacher who is leaving the classroom she says regrettably. >> my name is linda. i've been teaching for 13 years. my first year of teaching i got an award called rookie teacher of the year. later on i got teacher of the year again. i've gotten 100% pass rate for the past seven years. >> reporter: by all accounts, linda is one of those high-performing teachers we all want our children to have. >> this was a book that in my first year of teaching the students made. >> reporter: but on a salary of $38,000 a year, which, after taxes, leaves her with $2,400 a month, she says she can no longer stretch her paycheck to cover expenses. >> when you start taking out rent, utilities, car payments, there's nothing left. it's demoralizing to you. >> reporter: after five years without a raise, linda has decided to call it quits. she's going back to school to become a nurse and will earn, on average, about $62,000 a year, $24,000 more than what she makes now. how hard was it to make that decision to leave? >> it's heartbreaking. >> reporter: in the past ten years, average salary for a u.s. teacher has only increased 3.4% in today's dollars. and in some states like florida, the average is actually dropped. for many teachers, summer is no longer about taking breaks but finding extra work to make ends meet. some educators blame stagnating wages for teaching's high turnover rate. every year 14% of u.s. teachers leave the profession. 46% leave before their fifth year on the job. >> when you look at high-achieving countries, their turnover rates are 3% or lower. and so they work very, very hard to not only attract teachers that they suspect are going to be successful, but they work incredibly hard to train them, and then they do whatever it takes to retain them and we don't do that. >> i'm not saying they may not fine an amazing teacher to replace me who also motivates the kids, who also inspires the kids, who also loves the kids. but what if they don't? visit sprintrelay.com. in today's "crime and consequence," the allegations against the fullerton police deepen. the list of alleged victims is growing. if you've been watching this show, you know that we've been closely following the case of kelly thomas. the homeless man in fullerton, california who was allegedly beat ton death by six fullerton police officers. the picture i'm about to show you is graphic but it may give you a true understanding of the brutality involved in kelly thomas' case and what his family attorney says is an example of a pattern or procedure of brutality by fullerton police. take a look. this is kelly thomas before and after his alleged beating on july 5th. witnesses say he was repeatedly beaten, kicked, tasered, and hog tied by six full irton officers. but the allegations against the city's police force go beyond the thomas case. a third alleged victim is now stepping forward. our affiliate ktla is covering the news conference from l.a. david, have you a busy day there but this is just the latest victim to come forward and file a complaint. what do we know about him? >> his name is eddie caniones. one year prior to what happened to kelly thomas, eddie says he's on the streets of fullerton, he's watching someone be cited. all of a sudden he goes up to the officer and starts saying, hey, what's going on. he's watching, he's observing. eddie says all of a sudden the officer turns to him, arrests him, roughs him up and charges him with drunk in public. except there's one big problem -- he had no alcohol in system. did he not go to court, no charges were filed and a personnel complaint was filed against the same officer hampton involved in the kelly thomas death a year later. >> now this incident happened last year and i do want to mention just quickly that we did reach out to the fullerton police department about this very latest complaint. we were told by the didn't that they declined to comment saying they hadn't seen the complaint or allegations. why do you think that he's waited so long to come forward about this? >> well, quite honestly, he says he was a little fearful to come forward. he thought he had done enough by filing that personnel complaint with the fullerton police department. he expected something would be done. but he actually -- here is his connection to kelly thomas. he actually is a witness to what happened to kelly thomas. he was at the bus depot in fullerton that night. so once kelly died an once the news media picked up on what had happened, he finally felt comfortable to come forward and say, wait a minute, here's what i saw happen to kelly and here is what pd happened to me at th hands of that very same officer one year earlier. >> we know they interviewed this man about the beating of kelly thomas. do you know what he says he witnessed? >> we don't know the details of that conversation, but the district attorney is well aware of what happened to eddie. here's what's happening -- of the six fullerton police officer on leave in the death of kelly thomas, five of them are being represented by one attorney -- and officer hampton, the man in question here, has his own attorney. why the city of fullerton decided to get an attorney just for officer hampton is very interesting. >> it sure is. i have one more question. i want to make this connection here. the attorney who's representing kelly thomas' family in this latest tragedy is also representing another man, plus this latest victim. has he told you that if this officer had been possibly taken off the job that maybe these other instances wouldn't have happened, maybe kelly thomas would be alive? after the break. meineke's personal pricing on brakes. i tell you what i can spend. i do my best to make it work. i'm back on the road safely. and i saved you money on brakes. that's personal pricing. the u.s. supreme court has halted the execution of dwayne buck issuing a temporary stay of his sentence while the court reviews his case. buck was convicted in texas where 235 prisoners had been executed during rick perry's 11 years as governor. at a gop debate when perry was asked about those executions, many in the crowd applauded when that number was read. but perry's cowboy gunslinger image is causing headaches within the gop. megan mccain wrote a column in the daily beast today where she expresses a concern of many moderate republicans that rick perry would lose a general election because he is george w. bush 2.0. is that a fair critique? is rick perry george w. bush 2.0? that topic is fair game for today's panel. wayne slater, senior political writer for the "dallas morning news." also joined by cnn contributor will cane, and krnl analyst roland martin. before we get to specific comparisons between the two, is this all just an image his team is trying to sell to the public? is this a good thing? >> those are two questions. one is he george bush cubed, not just 2.0. he everything is we thought george bush was, the caricature of bush. he really did grow up on a west texas farm. he really is kind of a west texas boot scooting aggie like another member of this panel, an aggie. that would be row lan. >> woot! woot! >> yeah, right. he's really more conservative than bush, he's more partisan than bush. he is actually politically more savvy than bush. is that a good thing? well, it depends how you see george w. bush. some think it is not. >> is the fact that he could be more conservative be a problem? would that mean little crossover appeal or not? >> no. first let me say, he is not george bush 2.0. he is maybe stylistically george bush 2.0 as wayne suggested. all i heard were style issues from wayne right there. meaning, yeah, he's boots and swagger and twang but the truth is that's going to help. nation likes all that texas stuff -- which you got three texans on the panel. >> a longhorn. >> the nation sees that and sees leadership. that's going to help. as far as the moderate thing, that's a false distinction. the distinction is between smart substantive republicans and i'm not worry that rick perry is too conservative, i'm worried about him threatening to beat up ben bernanke. >> am i shocked a longhorn just spewed that nonsense? first and foremost, to sit here and suggest that the image doesn't matter and people like it, yes, voters do like confident politicians. but also you remember eight years of president george w. bush. a lot of people said they couldn't stand the arrogance of the president. in terms of -- i'll do what i say, but that was a problem. if you're president obama and his campaign team, you love george w. bush 2.0 because that's what the election was all about in 2008 and they will go after -- if rick perry is a nominee, they will sit here around tie him to bush and like it or not, republicans around this country don't even want to campaign with bush. you better pay attention, will, to those independent voters because you may try to criticize megan mccain the cute way you did, but independent voters will remember those years of president bush. >> certainly, george bush was looked at at times as being a bit extreme. if you look at what's going on with rick perry, there are some who would say he could be viewed as too extreme as well calling social security a ponzi scheme, the hpv mandate for the young girls in texas. i could mention a few more. but is that a risk here, wayne? >> it could be a risk. i would never take issue with roland about anything. but, one thing that the perry people believe on the inside -- one thing they strongly believe is that this is a different kind of year and what people early thought was maybe a problem, this guy looks like george w. bush, may not be a problem in this year his political year consultant dave carney thinks. he thinks that republicans especially in the republican primary want someone who will preach red meat rhetoric, someone who is strong and will not back down from a fight because they see the primary process as one in which republicans will pick someone, a strong fighter, to go into the ring against barack obama. and if the economy is bad, and a year from now, then they think that this republican will have a chance to win as roland said, some of those independents. >> when george w. bush ran in 2000 he focused on compassionate conservatism. it was very appealing to republican white female voters in those suburban areas because they were tick off with newt gingrich and his group from 1992 and 1996. perry does not come across as compassionate conservative. and so that again -- i go to independent voters that may very well be a problem for perry. >> well, will, we mentioned this death row case at the very top of this segment, this dwayne buck who was spared really at the last minute. and this was basically because a psychologist had testified that blacks and hispanics were more likely to commit crimes, future crimes, if they were spared, if they were put back on the streets. perry though we know at this recent debate was asked about death row and asked about the number of executions in texas that he has been there for. he says he's never struggled with the notion of innocent people being executed in his state. now we see this guy granted a stay, his case is going to be looked at again. will this come back to bite him, will? >> you know, randi, rick perry has a host of issues that will come back to bite him. regarding that specific case, it was an unfortunate incident in the debate when he had a crowd applause when perry said these things. the point of capital punishment is that it is a tool of justice, not to be relished but to be done with some hesitation and humbleness. but regarding perry around what wayne said earlier, we can't paint perry as this conservative extremist because he's not. what he is is an unreliable politician. his problems lie in things like crony capitalism and an infidelity to true prind conserve tichl. i think we need to continue to distinguish between this extremist and moderate rhetoric. >> the problem is very simple. when john cornyn was the ag they compiled all of these cases and when this particular line of viewpoint in terms of blacks and hispanics being more violent was used, they wasn't back and retried those cases. this was the one case they didn't. now it is clear that this guy actually did it so the issue is not innocence or guilt. it was how this was used in sentencing. if perry was smart, what he should have said was we did the other cases, we'll redo this one out of fairness but it is clear that he actually did this. i think he missed an opportunity to show some compassion but still be strong on death penalty. >> wayne, 20 seconds left on this topic. >> okay. near perry nor his predecessor george w. bush nor his predecessor ann richards could look like they were soft on the death penalty in texas. perry was not about to do this. this was a troubling case, roland is right. the question is is a person being executed because he is black. for a governor of a southern state, southern western state, who chants states rights, that's a problem. >> absolutely. >> wayne, will, roland, another great discussion. thank you so much, guys. appreciate it. how long can you swim without stopping? [ female announcer ] phillips' colon health. imagine this -- going for an hour-long swim, then doing it again and again and again for 59 more hours? that's what endurance swimmer diana nyad attempted to do this summer. we told but her epic bid to become the first person to swim between cuba and florida without a shark cage. she didn't make it, calling it quits after swimming for 29 hours. and enduring countless jellyfish stings, rough saes and an asma attack, on top of that. but her journey has been nothing short of incredible. dr. sanjay gupta has been following diana's story now for over a year and you are joining us now in the studio to tell us a little more about it. how old is she. >> she is 62 now. long distance swimmer in her late 20s. broke some world records. did things no human being has ever done. then basically for 30 years didn't swim. then it was like an unrequited love. that's how i best describe it, she never gave up on this dream and decided to do the swim from florida to cuba again. it is hard to eat, it is hard to drink and the elements, including sharks which is a question i had for her. take a listen to what she specifically had to say about that. one of the biggest concerns -- sharks. >> these are great waters for sharkses. >> reporter: luke temple is the team's lead sharp diver. he knows how dangerous these waters can be. >> these particular waters we'd be looking for oceanic black tips, hammerheads, tiger sharks, caribbean race sharks. this animal has evolved to dominate this ocean. they have a sixth sense. they can feel the electricity in the water. they know that we're there. >> reporter: and that's why in 1978, diana swam in a shark cage. today she just uses this. >> sharks are tremendously sensitive to this. this is actually in the kayak. >> reporter: it is called a shark shield. off the coast of the bahamas, tipple shows us how it works. it's a shark beating frenzy at this block of chum. until tipple approaches and turns on the shark shield that hangs right above it. >> that's frightening. >> you're going to have to watch the documentary to see what happens. >> such a tease! but a very good one. listen, you mention malnutrition and dehydration. what was this journey like for her? she couldn't eat? >> she has to do it in a very specific way. she literally just has her bathing suit, bathing cap and goggles. in a wet suit. she can't touch the side of the boat. she swims to the side of the boat and treads water and people feed her. as far as fluids go, it is a sim already thing. they create these special concoctions of fluids she's determined are going to be the best for her, not make her stomach too upset. throw it out on a line in a poush in the water, she'll grab the poush as she's swimming, go on her back and drink. but she's losing so much fluid and so many calories, experts i talk to say it is impossible to keep up so she just tries to do the best that she can. doing a swim like this, she'll lose anywhere from 25 to 30 pounds during that time. >> oh, my. we mentioned the jellyfish stinks, she was dehydrated. what really caused thoher to st? >> most likely, she started to developing shoulder pain and i think the shoulder was bothering her. she had had shoulder pain in the other shoulder previously. they did everything, they put ice on it. they gave her various medications. she thinks that one of the medications they gave her actually caused a little bit of an allergic reaction and she started having asthma and she just simply could not coordinate her breathing. one thing i'll point out, all this happened pretty early on in the swim but she still went 59 miles, still swam 29 hours despite that. it was really remarkable near the end there. it was all mental fortitude at that point. >> she seems to have such incredible energy to be around. >> she's soin spiring. when i'm digging deep like when i'm training myself and i need something to focus on, it is diana. she gave me tons of tips. >> any that you can use? [ male announcer ] if you can't afford your medication, astrazeneca may be able to help. let's talkpolticks with candy crowley. lots to talk about. let's start with this endorsement for jon hantzman. >> jon huntsman got an endorsement from former philadelphia governor tom ridge, who also served as homeland security secretary. in many ways, this is not a surprising endorsement. huntsman and the former pennsylvania governor ridge both came from the same wing of the republican party. they're more moderate. this has been basically a big part of huntsman's failure to get real traction in this primary race. perhaps it will help huntsman to have ridge's endorsement in the new hampshire primary, by the way, huntsman feels he'll win the new mexico primary. we're talking a long way from now, but huntsman thcontinues t be on the bottom rung. but tom ridge a bell respected man on foreign and domestic policy former governor of pen endorsement jon huntsman. >> another big story, the president getting some defense on his poll numbers from a friend. >> yes. david axelrod, top adviser is reading the same newspaper stories the rest of us are and listening to the same commentary on tv saying that democrats are afraid that they're looking at a one-term president. in a memo to sunday's show producers, which i think is interesting, axelrod said, listen, despite what you hear in elite commentary, which is the democrats' way of what republicans calm the mainstream media, the president's support among base voters and in key demographic groups has stayed strong. he cites 81% democratic voters saying they still support the president, but you and i know it it's the independent voters that sway elections. right now the president has a lot of work to do to catch up and even break even with independent voters who have left him in droves. axelrod objects, also saying, listen, the poll numbers for republicans are very low as well on capitol hill, also true, but they are running in their districts not nationwide and these are nationwide polls. and he also notes that there is no republican to put up and compare against president obama at this point because the primary season is under way. so also a fair point. what the obama campaign expects is that, come september, people will be able to see two very different visions of america and they are counting that the american people who are now angry with the president he about the economy will take a look at what republicans have to offer and reject that. >> candy crowley, nice to see you. candy, thank you. we are now five days and five hours away from the scheduled execution of a man who many people think is innocent, or at least was wrongly convicted. troy davis has spent 20 years on georgia's death row for the killing of a savannah police officer in 1989. at trial, the state relied heavily on the claims of nine witnesses, seven of whom have since recounted or contradicted their testimony. yesterday boxs loads of petitions were dropped off at the board of pardons and parole. the board is due to meet monday. the boxes contain 616,000 signatures and today many of the people will take part in what's being called an international day of solidarity. rallies, marches, teach-ins and other events are planned across the country and abroad. some of the bigger u.s. events will stake place in san francisco, seattle, san diego, ann arbor, chicago, austin and atlanta. still, the man who sent troy davis to prison is as sure now that davis was guilty. this is the man who was murdered, a husband and father of two when he was killed while trying to help a homeless man being attacked. in the years since, the formerer savannah d.a. has said very little on camera about troy davis' campaign for clemency. but in 2008, he said this. >> i'm just disappointed that so many people have led believe that nobody has paid attention to these recantations. it it's just not the case. on what ground are the recantations more believable than the testimony in court? none. none. >> my next guest would disagree. you'll recognize mr. barry shekt for his much work on the innocence project. barry, nice to see you. what would it take, in your view, for justice to be done in the davis case? >> well, the board of pardon and parole it it seems to me, very obviously, has to just give him clemency. life in prison. because, you know, what you have to recognize now is that a federal court said -- united states supreme court sent this case back for a special hearing, which they hadn't done in 32 years. a federal judge reviewed the evidence and said, look, this is by no means an iron-clad case, but i can't say based on what has been presented to me that he's actually innocent, meaning at least clear and convincing evidence of innocence. but that's a lot different than saying is there a reasonable doubt? is there a prepond rens of the evidence, which is the burden of proof in a civil case supporting his innocence. i think there is at least that. you've got to recognize that most of the eyewitness withess case recanted their testimony. there was ballistics evidence that that has now been demonstrated that was unreliable that was a key element to the case. when you look at the eyewitness procedures here, they're ridiculous. >> right. i know you feel so strongly. >> they'd never been done today. >> you're actually sending a letter to the board of parole. is that correct? what will it say? >> we sent a letter and we're pointing out to them that this it coming monday, on september 19th, there's going to be the release of a report, a field study on eyewitness identification procedure that's was done at a number of police departments that demonstrates how certain it techniques can be used which recently were recognized by the new jersey supreme court and they're going to change the way courts all across the country deal with this that could have prevented the mistake in this case. look, the police officers here took all of the witnesses back to the scene and did a reenactment and they all talked to each other. every scientist will tell you that's insane. that is going to promote suggestion. the police walked around with a single photo and were showing it it to people. you could not, by today's standards, do anything worse in terms of creating a mistaken eyewitness case. and not ohm that, most of them reca recanted. >> you know better than i do, but it certainly seems like it's pretty hard to overturn a death row conviction ny anywhere and to get new evidence heard. is it harder in georgia as far as you know? >> oh, definitely. in george they have this insane rule that the courts will not even review the recantation of a witness unless you can demonstrate it's quote unquote the purest fabrication. in other words, by their definition you have to be able to show that the witness was actually in jail in another jurisdiction or not even in the place where they say they made the observations. whereas here you had all of these witnesses coming forward, recanting, and some witnesses who said that red coles, the person that really fingered troy davis and everybody believes is really the perpetrating, had confessed to more than one person that he really committed the crime. so bottom line -- the board of pardon and parole simply has to say there's a reasonable doubt here, there's evidence -- a preponderance of the evidence frankly supports the position this is a mistake. it's not nuf enough to reverse his conviction on the grounds of actual innocence but more than enough that the jury would not give him the death penalty. the board of pardon and parole, really, the whole world is watching. we simply cannot execute troy davis when there's a risk of executing an innocent that's so clear. >> barry scheck, appreciate your expertise. you've been through a lot of these. appreciate your time. it thank you. >> thank you so much, randi. a death row inmate in texas who was scheduled to be executed last night got a last-second reprieve. the highest court in the land stopped the lethal injection of dwun buck. he was convicted in 1995 of killing two people, one of them in front of her own daughter. now testimony from a psychologist told buck's jury that black or hispanic defendants were more likely to commit future crimes. buck will stay on death row while the supreme court reviews the appeal. police in london have charged a bank trader with fraud a day after his arrest in connection with about $2 billion at ubs. you see the man in question in a photo taken from his facebook page. the profile was taken down shortly after the news of his arrest broke. he was expected to appear in court today to answer the charges of fraud and false accounting. so far ubs is not commenting ong the arrest. action on the football field. fights and shootings in the stands. is the nfl on the losing end when it comes to security? we'll tackle that question after this quick break. has pro football become too violent? there's been a lot of talk about the issue. new rules are in effect about injuries to players. some say the real violence is in the stands, not on the field. last sunday at a jets/cowboys game got into a fight and zapped a guy with an illegal taser. and a huge brawl erupt at a 49ers/raiders preseason game last month. in two other incidents at that game a fan was knocked unconscious in a stadium bathroom and after the game two men were shot and wounded. the nfl says it's in control of things. a league spokesman says, quote, we will continue to be vigilant in protecting our fans. aol fan house clom nist writes, david whitely, says nfl security is broken, calls on the league to stop wasting their time with pity patty pat-downs or get serious about security. i i'd prefer the latter. joining me is will alec frasier, the president of turn irproperties and the man responsibility for all of the security here. so i guess you are the guy to ask about this. i mean, is the security that seems to be taking place there enough? at stadiums? >> i think the nfl does a good job of seriously taking the issues that they have and doing a commonsense reaction to them. this is one or two events, particularly with a taser, to do a kneejerk reaction as sometimes happens in other security areas is not the right thoing do. they do have good security, but you have to understand you sort of have to balance the threat as we perceive it with a commonsense approach to what we can do about it. pat-down searches, do we need to go to metal detect rz? do you use the wands? generally it's the wands and the metdal detectors that are more effective. pat-downs aren't. but it gives the sense to people that something is being done and a lot of times it happens where somebody is bringing something that is illegal but they're doing it by mistake. then we can get into the alcohol. >> some people, you know, i put out something on twitter about this, and i got tweets saying security just seems like it's just for show at a lot of these games. when they look in the purse it takes them two seconds. i know i don't have anything in there, but what do you think? >> i don't think it's for show. i think you have to have security where you're looking at things that are coming in and is a pat-down really effective? not totally. if people want things in, they can. if there are things that are ined advertent, you can do that. you have to slow the processes down, look people in their eyes. you'll see the nervousness. the security in the nfl you'll see coming up is not so much at the entryways. it's how fast can you react to an event going on in the stands? being aware of it. so if a security group can get to an incident like this, where the people are arguing back and forth, you know something -- they've been drinking. you know something is going to happen. it would be interesting if the security knew about that ahead of time and was sort of watching the situation. so bringing in things like tweets or a three-digit number to call or somebody the guy three rows back or somebody says, this isn't good, i'm going to call security. >> how would they manage to pull off if they had to put in metal detectors or wands? she shot herself as he struggled to stop her. but it was a much different story he told on the night of her death two years ago. >> reporter: three more times in the same 911 call, he admitted he shot her. >> reporter: later in the call, ward said the shooting was an accident, but there was never any emotion in his voice. in court, a very are different picture from his attorney. >> this entire incident happened in the blichk nk of an eye. had her death was an unexpected and tragic accident. no crime was committed by bob ward on the night of september the 21st 2009. >> reporter: but from the prosecution -- >> ladies and gentlemen, this case is about the fact that it was bob ward that shot her almost dead between the eyes. >> reporter: police say his story changed during his police interrogation. >> reporter: his demeanor also changed as time went on, and his bizarre behavior has made defending him more of a challenge. the emotionless man on the phone became the jokester as captured on jail video, here doing a striptease of sorts. >> reporter: what makes this video even stranger is who is visiting him. the woman talking to him, his dead wife's sister. the woman in the background, bob and diane ward's daughter. >> reporter: the three in this video all thought it was a hoot that the plumbing wasn't working in the cell. >> such a lifestyle change for you, i can only imagine. i know you're missing a bidet the. >> let me turn the water on. see this? sooner or later, you'll know our name. sun life financial. deadly battles, drug violence, we've brought you numerous stories about the illegal immigration story but what'ses it really like along the u.s./mexico border, especially where the unforgiving desert stretches for miles and miles. well, now you can get a look in the comfort of 6 an air conditioning boat. here's rafael romo. >> reporter: judy mcintyre wants to see the harsh immigration problems herself. she traveled to arizona specifically for that purpose. >> such a complicated issue. and there's so many sides to it, and people need to come together and work together. >> reporter: experiencing the realities of the u.s./mexico border up close is now as simple as buying an $89 ticket. the tucson, arizona, office of gray line tour sz offering a trip to the border called "border crisis," fact and fiction. >> as we get closer to nogalas -- by the way, the mountains are part of the santa cruz mountains -- >> reporter: the operator bills the trip as a fact-finding mission. tourists are taken for a walk in the unforgiving arizona desert. since last october, 130 migrants have died trying to cross the border. >> i wouldn't make it miles. it's just so desolate. i'm not from airsz ayers originally so i was just looking at the branches with the thorns that -- i thought, what would happen if you were trying to get through a thorny -- it would just tear your clothes and skin. >> reporter: the tour also includes a get-together withers border. >> the border is secure in areas where it it was easiest to secure the areas. the places that are really difficult to secure are the places that remain wide open, and those are the places that most of our ranches are located on. >> reporter: tourists also hear from those who advocate easier access of migrant labor to the united states. >> we need to facilitate trade between the two countries. we need to facilitate the two crossing between both and we need to make sure that we have human life interests, whether it be the people working at the border or the people trying to cross it, that we're not causing more deaths in the desert. >> reporter: in the end, tourists are left to draw their own conclusions. the tour company claims it's intended to be apolitical and aimed to educate tourists the realities of living on the border and issues of life and death that play out every day in that part of the country. rafael romo, cnn atlanta. >> the tour operator says so far about 100 people have taken the trip to the border with mexico and he expects the the number to increase when the temperatures cool down. stunned by the poor health and lack of fresh foods in her east harlem neighborhood where diabetes-related amputations and deaths are ham pant. this week's cnn hero is bringing nutrition to the street. >> i grew up in low-income areas. i experienced homeless alsonesses and poverty. it taught me to redefine myself and not to let your past determine your future. when i moved to new york to school, i was loifing in east harlem. there's very few places to buy fruits and vegetables and healthy foods. most diabetic and obese of all the neighborhoods in manhattan, people were super malnourished. i saw the connection between poverty and obesity, and it just seemed unjust. i had to do something about it. my nais is gina keetly and i'm giving nourishment to people who are literally dying for it. change is possible. if you want somebody to try a tomato, you give them one. >> i love raw carrots. >> it it's an inspiration. they have to feel it, touch it, taste it. because people will not change unless something in them changes. we go places other people won't go. we give out produce, we're doing classes. you really can eat healthy on a low budget. >> what are these? the united states. that was the message from palestinian authority president mahmoud abbas. in a bid to ease israeli concerns, abbas says the palestinian leadership does not seek to isolate the jewish nation. his comments come just before next week's general assembly meeting in new york. joining us from the u.n., our richard hodge. richard, what do we make of this statement today? >> well, you know, the united nations building is on 42nd street here in manhattan. if you go bewest, you hit broadway. we're having a preview run of this palestinian bid for statehood. certainly the middle east is a much more serious matter. there's been so much confusion and questioning on how the palestinians would proceed. the speech in ra mall la today by the palestinian leader has gone some bit toward clarifying the situation, though it does leave maneuvering room. the palestinian leader stating that he will lead an effort for statehood at the united nations when he comes here next week. >> translator: our decision which we have told to everybody is we are going to the united nations security council the minute i address my speech at the general assembly, i will hand the request to the united nations secretary-general so he would take this request to the president of the security council. our choice is the security council. as for the other options, we have not taken any decision yet. any other option we haven't taken any decision. we will come back and reconsider them. >> reporter: abbas saying, though, people should not have any preconceived notions. he's not coming back for full independence for the palestinian people. as he mentioned, there are still options o s on the table. >> how does u.n. membership work, richard? what needs to happen? >> reporter: the palestinian leader, as he indicated, is going to deliver a letter of application to the u.n. secretary-general who will quickly get rid of this hot potato and send it to the secure council. it is the security council which must first approve anyone for membership before are the general assembly considers it. the u.s., though, a permanent member of the security council says it plans to veto a palestinian statehood bid, stating that it is not the time that the negotiations for an overall p peace for middle east is more important. the other options that the palestinian leader talked about, some complex arrangements in the general assembly but nothing gets the palestinians the title of full u.n. membership. >> richard roth at the u.n., thank you so much. coming out of the fuller ton, california, police department, they're under fire again for alleged brutality. more troubling allegations, another alleged victim is stepping forward. we'll take you live to los angeles in just 90 seconds. don't go anywhere. these photos n smoo . of more al agaigss of police brutality in fullerton, california, the list of alleged victims now growing. a third person has just gone public with troubling details in a press conference that wrapped up just moments ago. if you've been watching this show, you know that we've been closely following the case of kelly toxs, the homeless man who was allegedly beaten to death by six fullerton police officers. this latest alleged victim came forward to file a federal complaint against the fullerton police chief and one officer possibly involved in other beatings including the one of thomas. this is the press conference that took place just a short time ago, the third alleged victim claims that he was brutally beaten and falsely arrested last year, but what's even more stunning, we're told this victim also witnessed kelly thomas' alleged beating in july. i want to warn you the picture i'm going to show you here is graphic, but it may give you an understanding of the brutality involved in thomas' case and what his family attorney says is an example of a pattern or procedure of brutality by fullerton police. take a look with me. this is kelly thomas before and after his alleged beating on july 5th. barely recognizable there. witnesses say he was repeatedly beaten, kicked, tasered and hog-tied by six officers. but the allegations go beyond this case. let's go to david bedno. he is covering this for us. this new federal complaint was filed against the police chief, the city of fullerton and one specific officer. what exactly are the allegations? >> the allegations here are against officer kenton hampton, said to be one of the six involved in the thomas death. we just heard from a man by the name of eddie, in june 2010 he said he was watching officer kenton hampton arrest someone. he said he was about 20 feet away, at which point the officer he said started walking toward him. eddie said he he tends to be afraid of police because his father wand shot and killed by police in a confrontation. he says to officer hampton, you're getting too close to me. at that point, according to eddie, he is handcuffed, sent to jail and charged with drunken public. his blood alcohol level was zero. the district attorney didn't charge him and now he becomes another voice in the cry against this fullerton police officer, kenton hampton. >> let me point out for our viewers we reached out to fullerton police about this latest complaint. they declined to comment. i know that ron thomas, kelly's father, was also at this press conference. let's listen to something that he said there and i'll get right back to you. >> but if they had done something at that time, this man would not have been beating my son to death. i hold them personally responsible because they had personal knowledge. they had complete knowledge of this man and his behavior. >> david, we said that there were possibly as many as six officers involved here. do you know about their representation? are they it all being represent ared by the same lawyer? >> no. that's what's interesting. five of them are being represented by one attorney but officer kenton hampton, the one officer singled out in three different incidents, has his own attorney. and the city has asked one attorney to simply represent him. also, randi, i want to point out at the news conference not only mr. are kin yoens, or mr. thomas, but also the man in july 2010 was videoing officer hampton arresting someone at which point the video clearly shows officer hampton turned to him, slaps the camera out of his hand, the camera falls to the ground, someone else picks it up and that's awhen the video shows the officer roughing up mr. mann. but again a jury found him not guilty. >> sounds like the pressure is building to hold someone accountable here. >> yes. indeed. we are looking that as early as monday -- >> as early as monday? >> as early as monday we're hearing the orange county coroner will release that autopsy report, finally giving us a cause of death, sending it over to the district attorney and maybe as early as next week, the next two weeks, we could find out whether or not these officers will be charged in the death of kelly thomas. >> and the police chief, just want to make sure i'm correct on this, has extended his paid medical leave, is that correct? >> yes. >> do we know why that is? >> very he interesting. he went out on medical leave saying he had high blood pressure are. that is according to sources within the city government. he's been off 30 days but recently he came back on and says he needs another 30-day extension. he has up to a year but according to my sources within city government they want their own attorney hired by the city to come in and evaluate the chief because they want to see if high blood pressure is exactly what needs to keep him at home. >> david, great reporting. graet glad we had you had. thanks so of. we're going to continue this conversation with the attorney who represents kelly thomas' family and this latest alleged victim. we'll get the very latest from him in just a moment. keep it here. ♪ ♪ ♪ that should do it. enjoy your new shower. [ door opens, closes ] the allegations against the fullerton police are widening, the list of alleged victims growing. the troubling allegations extend beyond kelly thomas, a homeless man who was allegedly beaten to death by six fullerton police officers. a third person has just gone public with details and a press are conference that wrapped up just a short time ago. the attorney who p represents kelly thomas' family and the latest alleged victim to come forward joins us now from los angeles. the allegations in this complaint are very similar to your other client. what are you trying to establish with this new federal complaint? >> well, what we're establishing is that there's a rogue cop on the force. this gentleman has a fierce temper, and at the slightest incident he will grab you, throw cuffs on you, slam you against the wall, put you in jail, file false charges and then laugh at you. and this is none other than the same police officer that was the instigator in beating kelly thomas to death on july 5th of this year. >> your client, eddie kinyoens, actually spoke at that press conference. let me play a bit of that. >> he threw handcuffs on me and he slammed my head up against a wall and applied pressure to my head allowing my head to hurt even more. >> garo, why are come out now? why did he wait? this happened about, what, a year ago. >> eddie really not has waited. what happened to eddie happened in june, june 27th of last year. he immediately went forward and filed a personnel complaint and filed it with the fullerton police department. they filed it received on july 1st. they've had more than a year. they have taken no action against this rogue cop, this cop with a fierce temper. instead, they've completely ignored it. had they done something about eddie's complaint, then ben mann would not have been brutalized by the same cop. and if they would have done something about that kmraintd, kelly thomas would be alive now. as a matter of fact, the coincidence here is that eddie was on a bus the same night as kelly thomas was being beaten by six fullerton police officers and the lead instigator was the same kenton hampton. eddie was on a bus after he had just placed his bicycle on it and he was standing there when he saw the police activity. he was only about 50, 75 feet away where he clearly identified kenton hampton as the officer who jumped that the foray and began punching him in the face. >> it's an interesting kweks saying he was violently beaten and then he witnessed this beating death of killy thomas. has he spoken to the d.a.? and can you share anything with us that he told them in the thomas case? >> absolutely. as a matter of fact, the d.a. investigating officer who does investigations for this case by the name of sam barry approached mr. quinnenez and took a full statement from him. he has not been hiding and he is a bit shy and afraid of retaliation that might be visited upon him. but otherwise he does not want this kind of incident to be repeated p. >> does his story match what the other witnesses have said happened? >> it matches very well what other witnesses have said, the fact that he saw kelly being tased, he saw kelly being beaten about the face with repeated punches in the face, being kneed, being struck when he's offering no resistance at all. >> so if there is indeed this pattern of abuse, you say, this officer that you mentioned may have been involved in all of these cases, and maybe there is a pattern of abuse of people on the street there in fullerton, what needs to happen here to prevent another case just like these? >> well, the police department needs to take these personnel complaints seriously. this pattern and practice of ignoring the complaints has to stop. they've got to look at the bad cops, the cops that are causing this type of brutality to be visited upon orange county residents an they've got to do some kind of sensitivity training. if that doesn't help, fire them, get them off the force. there are plenty of good cops out there, plenty of good people that are qualified to be cops, and the few bad cops are giving all the good cops a bad name and tarnishing their badges. that should not be p happening and we want this to stop. there's going to be an event just tomorrow in fullerton as a memorial for kelly thomas, and hopefully people will show p up for that. it will be at the it farmer's market starting at 2:00. we expect to have thousands of people there. there will be bands there. and this is all to remember what happened to kelly and to stop this type of brutality in orange county. >> when will we know for sure, garo, what really happened to kelly thomas? what's the very latest on the coroner's report? >> well, i think the record s from the medical center are very clear what happened to kelly thomas. he was assaulted, struck over the head with fists, he suffered brain death and then he died. now, the coroner i'm sure will agree with those findings, and when they do i hope that the d.a. will file charges against these officers. and that should be happening in the next ten days, at least from what the reports are coming from the department that they will be making a decision in about the next ten days. >> and what do you make of the fact that michael sellers, the police chief, has extended his medical leave? >> i know. he's meditating. >> no, he's not. he's dead, man. >> yeah. we'll get the blood circulating and everything. >> come on. this way, this way. there we go. come on. move those feet, bernie. that's it, boy. >> well, maybe two guys from denver took a page out of that screen pray. the denver post says prosecutors have charged robert young and mark ruben stin for taking their pal jeffrey jarrett out on the town. only problem, jarrett was dead. that didn't stop them for taking him to mexican food, a round of drinks and a strip club. the two guys haven't been charged in jarrett's death, says the paper, but they will have to answer to charges of criminal impersonation and abusing a corpse. investigators are still trying to figure out how jarrett died. but here's the real kicker. not only did they drive his body around all night, they used his bank card to help pay for their fun. according to the paper, jarrett had invited one of the suspects, supposedly a friend down on his luck, along with a buddy to stay with him at colorado state university for a few months when his so-called friend robert young found him unresponsive at home, instead of calling 911, the denver post says he and the other guy loaded him into the car and drove to a bar, left him in the back seat and proceeded to have drinks on their dead friend's tab. you cannot make this stuff up. hours later after a night on the town, the friends reportedly flagged down a police officer at 4:00 a.m. and told him that jarrett might be dead. for that weekend in denver, robert young and mark rubenson, it is time for you to "face the music." ♪ something is wrong with the world today ♪ ♪ i don't know what it is ♪ something's wrong with our eyes ♪
