Now, there is the threat of a trial his fathers Reelection Campaign and we have news on another trial that could up and, well, another president ial campaign. If Fulton County georgia judge has rejected the a fani williss plan to try donald trump and hold his codefendants together on october 23rd. That is like a month away, everyone. Now, there is no trial date set as we are sitting here today for the former president , but it is likely that trump wont actually face a trial, we are thinking maybe next year, which of course that brings us right into the heat of the race for the white house. But, i want to begin with a looming autoworkers strike. This deadline is now less than an hour away. Cnns is in detroit as we speak at the uaw headquarters, what is happening . Were outside uaw headquarters here in detroit and just moments ago you a w president sean feign made the announcement about which three plants the uaw will be targeting in the first wave of their strike. Those three plants are a Scientist Plant in toledo, ohio, a ford plant in wayne, michigan, and a gm plant in missouri. That will represent about 12,700 members will be walking out at midnight if the uaw cannot tom to an agreement with the Big Three Automakers in the next hour. Here is that announcement from sean vein. We have been clear, midnight on the evening of September 14th is a deadline. Uaw family, that deadline is nearly here. Tonight, for the first time in our history, we will strike all three of the big three at once. And we are hearing from fort right away that they received a Counter Proposal at eight pm this evening from the uaw after waiting days for that counter. Forward saying that the uaw only came down slightly in their wage demands, fort of course offered 20 in wage increases over four years, we know the union from the getgo has been asking for 40 in wage increases over four years and ford is saying that uaw made it clear that if they did not agree to the unions Counter Proposal this evening they would head on strike. We are expecting shawn fain, uaw president to be in wayne michigan at that Ford Facility at midnight if this agreement does not come together in the next hour. Laura . Vanessa yurkevich, think you so much. I want to bring in a man who knows a lot about what is going on in these Negotiating Rooms. He is that former uaw president , bob king and joins us now. Bob, thank you for being here. You heard sean sane said that they are going to strike all of the big three, all at once. This is historic, it could be extraordinarily significant as you well know, this is a very big deal. Take me inside the Negotiating Room because you certainly have been there before. What is happening tonight . Well, hopefully the parties are working hard to find an agreement that would be good enough to be ratified by the membership. It is frustrating because, in my view, the Country Companies have made a lot of brinkmanship bargaining, rather than good faith bargaining. They delayed, delight, delayed before giving their proposals to the uaw. There are minimalist proposals to begin with and they would never, ever get ratified by the membership. People have to realize that these are member demands. These are shawns demand, these visit every plant, talking to members, been on facebook live, he is representing the frustration of the membership and i hope that the companies are listening them and give him a better offer than what they have so far. The point you raised is not lost on me. Were talking with the uaw president shawn fain. You have been in that position and the minimalist notions of what is being offered, the delay that hes been very vocal about as well. But you also heard, likely earlier today, the ford ceo talking about farley. He had been blasting that very president , shawn fain, and is claiming that feign is not negotiating in good faith. In fact, here is the Chicago Tribune editorial board. I want to read a quote about what he has to say. Feign is the most belligerent union boss weve seen in a long time. My question to you, bob, do you think that shawn fain has gone too far in his negotiating . Of course, these arent member demands. Not at all you see that bias right away. He is not a uaw boss. The boss it is a membership. He was elected by the membership, airports to the membership, hes got a responsibility to negotiate an agreement that he thinks honestly can get ratified. It is sad to me that the companies are not really responding to what he is expressing it to them on behalf of the membership. So i think that is a really unfair characterization and i think sean, and the rest of the Leadership Team mike booth, richie, are all doing a great job. Richie boyer. Theyre all doing a great job for this membership and presenting their demands, theyre voicing their concerns and frustrations. Clearly the frustrations are being heard. We are 51 minutes away from a potential strike against all the big three all at once, to use his own words. At the end of the day, people do want to work. They want to be able to have, and describe it in terms of what their demands are, the dignity of work that is appreciated financially and in other ways that is comparable to what it ought to be. One guest earlier on our program talked about being elevated beyond not just to the middle class, but beyond the upper poorer is what is felt for so many people thinking about how hard they are working. But i want to understand, given that people want to work, is it advantageous to have someone holding a hardline like this at the very top . Is this what should happen in these negotiations . I think absolutely, given the situation that we are in, given these Companies Make250 Billion Dollars in the last ten years, only because our sacrifices. I was there, we made the sacrifices. To me, it is a tremendous level of injustice to members that was left with five different tears. Nobody believes that you should be doing the same job at an assembly line, getting different rates of pay for the same job, for the same corporation, for the same union, and have different rates of pay. That to me is not morally sustainable, it has a tremendous impact on employee morale. Again, shawn is expressing on behalf of the membership what it will take to get an agreement to get ratified. They should be wise enough and experienced enough to understand this and im disappointed with jim farley, honestly, making the comments he did today. Hes got to understand and should understand that sean has got to get an agreement that can get ratified by the membership. They are far away from that right now, in my view. Well, we are 49 minutes away from when they could actually walk right now and it could be debilitating, as you well know, which is part of the leverage that people who are actually keeping the company afloat certainly have right now. I want to bring in steven solely everyone, hes the director of labor policy at Mackinaw Center for public policy. Thank you for being here on what is really a significant moment in history. The idea idea, to quote the words of shawn fain, going against the big three all at once. We havent seen this before, even a summer where you have strike after strike in a variety of different sectors, or even a threat to strike in some significant business sectors of our economy. Stephen, you say that if the uaw gets what they are asking for, though, it is going to hurt them in the long run. Can you explain why you feel that way . Absolutely, i think i will offer a Counter Point to former president king, which is that while the uaw has to have a contract that it can ratify, a stellantis, ford, gm, each need a contract that they can compete with. The terms that are being proposed by the law, if accepted, would put all three of the big three at genuine risk of going out of future in the near future. When you look at that we did hear farley talking about at one point, if you have that significant perez, although he was challenged and rightfully so about the pay raise that people in his own position are in, in Leadership Roles of these big three, but that he said they would go bankrupt. They could not possibly compete, it would take a huge toll, not just to the bottom line but really take the bottom out from underneath them. Is that true, though . For some they might say, hold on, isnt there a price markup on some of these vehicles . Are there ways to account for the elevation of salaries in other areas . Is the ceo, at least farley correct, that there could very well be a bankruptcy in the future if they were to submit and meet these demands . I genuinely think so. So, currently the big three pay 65 dollar an hour in labor costs for workers in the domestic manufacturing industry. A foreign competitors and non unionized environments pay roughly 55, that tesla pays 45. If the aid of these demands are met, thats going to result in labor costs of over 100 an hour. That cost has to be built into electric vehicles that are already expensive, that are sitting on lots longer than traditional internal combustion vehicles, and that just dont seem to be particularly high demand right now. So when you look at that kind of Market Incentive there with demand and supply, i think you unless evs it becomes significantly more profitable for the big three, increased labor cost and diminished sales could very rapidly eat into their very existence. Certainly the union must be aware of such vehicles and the issues in terms of how long they are on the lot, the Market Incentives, the supply and demand have to be met to have a fair market value of not only labor but the cost of goods in this economy. Do you think that the union is negotiating in good faith than . I think they are trying to get the best deal for the membership that they can, and that was a perfectly understandable thing. But when you look at the market and how evs have gone so far in this transition, with the incentives, the mandates that various states are issuing, the money coming in from the federal government that is propping this industry up. Despite all of that, ford is still lost for an half billion dollars on its ev division this year and that is in a year of record profits. As we move away from those internal combustion vehicles and into a purely electric market, if that trend continues that is a huge problem for the big three. Ive got supply, demand, that is it, thats where it goes justin. I want to talk to you about just how long before the u. S. Economy could start to feel the pressure of a strike this significant. Laura, here i really want to try to calm some of the viewers down a little bit. One thing that important recognize is the companys got a big stake here in trying to convince the federal government that this is a big deal. If the federal government does not help solve this problem it will tank the economy. The union has got a big stake in trying to convince everyone that this is a big economic deal because they want ford and gms stockholders to put a lot of pressure on them to solve it. The reality, though, is that this is not a Manufacturing Economy that we live in. The auto sector as a whole is 0. 7 of the entire u. S. Economy. The unionized sector is half of that. If they shut down the plants, that would definitely inflict some pain, but for most people, if its hard to get the car this month, what are you going to do . Probably wait until the strike is over and by the car than, or maybe buy from a Different Company who is not closed. I think the overall Macro Economic impacts, the impact on your viewers, directly to them, is not going to be that great. What about the fact that this is a targeted strike. Not every single facility is being looked at, but the notion of a targeted strike, for many people, is quite unique in that i grew up in st. Paul minnesota, a few blocks away from a ford Assembly Plant and i remember thinking that this is just one small part of the overall pie of everything thats going on. They are strategic and being targeted here, of particular areas. Does that impact how he should do, this the 10,000 foot view . Absolutely. So, laura, i was talking about the big picture, the whole economy because youve got viewers all over the come tree. Now im coming to you from michigan, its a bigger part of our economy right here. So i feel quite confident that the effects throughout most of the country, on average, are not going to be very large. Of course, the effects on the striking workers, the effects on the Auto Part Manufacturers in the cities, and the effects in particular parts of the economy, particular in the midwest, are going to be more intense. I still think that we dont want to overstate the case, but were going to feel the pain here in the midwest and if youre somewhere else, youre probably enjoying a warmer winter and youre not wearing quite about the strike. That is part of the interesting notion of our National Economy and the leverage and why it is so significant to certain parts of the population. Thats part of what theyre talking about, though, in that they can feel as though they are being disregarded because what is acutely felt and experienced by workers in this industry, as you call it a Non Manufacturing economy, because its not universally experienced for the workers, they feel as though they get the short and of the stick time and time again. But then, the people of the economy lean in. When you talk about prices of cars, of course, and you mentioned buying a car as one example. How much could a strike hike prices for new and used cars . Well, we have actually had a really nice experiment of what happens when it is really hard to get cars, not a nice experiment, it was a miserable one. It was the Covid Mid Pandemic and that shut down a lot of factories throughout the country, and International Trade as well. It caused car prices to spike a lot. Laura, can come back to something that you said because i think it is really important. For a lot of people throughout the economy, as inflation has risen, a lot of them have enjoyed some raise why rises it to catch up a little bit. Thats not been the case for the uaw. Because it is a union sector, they signed a fouryear contract. They signed it way back, four years ago before we had ever heard of covid and before we ever saw the post covid inflation research. So workers throughout a lot of the rest of the economy have actually had a little bit of chance to catch up to some of the worst of the pain of inflation, that has not been true for these folks because they have been on a very long run contract. Interestingly, that last contract had no Cost Of Living clauses in it at all. They have fallen behind more than other workers have, which is why some of the numbers you just showed on your screen might strike some of your viewers as looking pretty big, but thats because those folks really have fallen behind a little more than other workers have. Thats such an important point and im glad that you underscored it because, especially when you talk about the union contracts, the cycle, which you signed them, not being able to contemplate one of the biggest impacts of our economy in modern American History, the covid19 pandemic being one thing, not having that contemplate and now on the back and trying to resolve it is really important. If he is convicted of all of those accounts, the president son could face years in prison for allegedly lying on a form about his Drug Addiction when buying a gun back in 2018. I want to bring in cnn correspondent kara scannell, also cnn legal analyst and prosecutor Elliott Williams, and former federal prosecutor and contributing writer for political im glad youre all with us, i want to begin with you here kara, because help us understand. We remember this plea deal, something that really imploded in the courtroom, but how did we get from that implosion to these serious charges so soon after it all fell apart . Yeah, this plea deal that was initially announced in june was hunter biden would have pled guilty to two Tax Misdemeanor Charges and then avoided prosecution on the Gun Possession Charge if he agreed to meet certain conditions for a period of 24 months. The republicans in the house had to said that that appeared to be a Sweetheart Deal, then when he showed up in court in late july the judge had a lot of questions about it. She had questions about how it was structured and whether it was constitutional, so she told both sides, the government and Hunter Bidens team, to go back and try to work it out. In that time, and that is when then u. S. Attorney david weiss, a Trump Appointee who held over, asked to be elevated to a special counsel and that was when the Prosecution Team said that they could not reach a deal with hunter biden and that they were going to move full steam ahead. That brings us today with this indictment of three Felony Charges and, one of the reasons why this was sped up a bit, also, is because the statute of limitations would run out next month because that was 100 biden bought this gun in 2018 of october and it is when he allegedly made these false statements on the atf form that he was used to purchase the gun, by saying that he was not using or addicted to drugs and that same form is given to the fire arms dealer. Of course, it was also charged with possessing a gun. All of them serious Felony Charges. His lawyer, abby lowell, has come out swinging tonight saying that, essentially, prosecutors are bending to that maga right side of the republican process the party. Abbe lowell was on erin burnett earlier tonight and says that even the nature of the charges foot were filed earlier today were very unusual. This office has never brought a charge like this against anybody. When they are bringing this charge, it is either because somebody has had the gun in the commission of a crime, they have bought multiple guns, they are a purchase or for somebody else, or they are a felon in possession. None of that is true about hunter biden. Now, lowell says that they will fight this in court, he does think that their earlier deal is still valid and hes going to question the constitutionality of the charges. Laura . When you see in court again . That hasnt been decided yet. Were waiting to see when that was going to hit the docket. Usually the person who is charged comes in at some negotiated time to have an arraignment where he will be asked what his plea is. Hell enter his plea, which we expect to be not guilty, and then the question of bail. In this case there is not expected to be any, they have requested to detain him, so hell be released. This will be working towards trial, which will fall during his fathers president ial campaign, laura. So important, lets get to the panel as well on this point. Thank you kara. Elliott, im glad you guys are both here because the big question so many people are asking, number one is, everyone keeps saying that this is a theres never been a case like this, you dont charge this out right. Maybe its an add on, but not for a user. Is it strange that these are standalone charges . Not that it does not violated the letter of law if you do this, but is it strange that this is a standalone . I would say its strange in so far that it is not often charged, but there are any number of crimes in the federal code that are still on lawful conduct. You can still be prosecuted for the conduct, its just the Justice Department doesnt charge a very commonly. The bigger question related to that is that there has been a legal cloud over the particular statute hes charged with in the fifth circuit down in texas, they have already issued a decision calling into question even the ability to bring this charged in the first place. That is going to come up again, i would be shocked if the judge threw it out, at least the Possession Charge there and we can talk about that a little bit more. That case youre talking about, for everyones sake, is really about what is the criteria for disarming force someone. Whats the criteria for deciding who is able to have their Second Amendment right . Is it enough that you have engaged in prior behavior thats nonviolent, but drug related . Is that what the framers were talking about . Or is it a matter of, as a government, they can put all sorts of around your right to actually possess. But there is the question that abbe lowell is talking about, and thats the question of it being that this charge, these three violate plea agreements. And that we saw it all implode in that courtroom. We didnt watch because it wasnt like a georgia and actually televised cameras, and judiciary put cameras in the courtroom, but if you are thinking about it being a violates the constitution or that agreement, is he right . I agree with elliott, the fact that there is an unusual Charging Theory does not necessarily make it invalid. I do think that the constitutional issue is going to be litigated, its gonna be a live one. But, in terms of the other potential defenses that he might be able to bring out, this is going to be a hard charge to defend against, some sort of constitutional defense because hes essentially admitted it already in the course of this book. So, i think this is going to be somewhat of an unusual Uphill Battle For Under Biden and, you know, it is also not the end of this story because prosecutors have said they intended to bring additional charges against him. The tax charges. As for the agreement, whether or not that isnt still in effect, that is abbe lowell point, its an argument they intend to advance. I think thats another one that devin uphill battle was. The agreement was not fully executed by the court, the judge had serious concerns about it, including constitutional concerns, she is presiding over this case. I find it very hard to believe that shes going to say, oh, this agreement that i had all these problems with that you signed, but i never signed, its going to somehow bind me. There is one issue on that, though. I want you to jump in here, but i want to be clear. When we talk about the constitutional issues the judge raised, it was not that she thought, she didnt seem to think that it was a Sweetheart Deal in the way the Talking Points go. Shes talking about how they essentially wanted her to be a part of a contractual agreement to a Fact Finding Mission to figure out whether he had actually complied with the terms of it. I know that we are talking about this, but that is so important really underscore that the judge was not somehow thinking that the political aspect, it was more so that this is not only what i do, you guys know what you are doing here . It turns out there is a problem. But, the point you are going to make . What i was going to say is, i Counter Point is lets all three of us take off our Prosecutor Hat for a second and put on Defense Attorney hats. I actually think that they have some defenses here legally, to. Particularly, just the fact that if what he did was admit to something in the books that, yeah, i smoked rock for a lot of my life, i dont know if thats enough to get you a conviction for that brute possession of facts. What he could say in court, and this is just as the Defense Attorney, how one could defend him, what you could say is that he has acknowledged his Substance Abuse in the past but no one can acknowledge that either at the time he visits the firearm or the time that he filled out the form that he was high or smoking or addicted at that time. Its just how a Defense Attorney would plant that seed of doubt in juries head that i think it is plausible, it is not outside the realm of possibility. But he, he said, i was addicted to drugs at some point in my life so absolute. Sure. Every criminal defense and can be stood up on the basis of fighting every element. The government has a burden of proof on every single element, including elements of seemingly simple crimes. So you can try to take a stab at any one of those elements, including as elliott described them. But it will be hard. Cases like this are hard for people defend against, a drug user being charged in this way is very unusual, abbe lowell is right. But the more common fact pattern the or felony possession case, these cases play out all the time. There could be some strange bedfellows ahead in terms of the Gun Rights Advocates and those who are talking about this very case. Thank you both very much, stick around everyone. Let me begin with you hear michael on this very important point. First of all, the president Cannot Pardon for state level charges. We know there are two cases or he is indicted, obviously in new york and georgia. But the idea that he might be able to, or is considering to pardon himself is really wild, wild west territory. What do you make of the possibility of that being constitutional . Well, im glad to be with both of you. I dont think it is a settled question about whether a president can selfpardon. There is an old 1974 opinion from the office of Legal Counsel at the Department Of Justice that said, in fact, the president could not do that. But it is uncharted waters. So im not sure that the legal scholars are certain of his ability to do it as he seems to be here. You are right, it would have no effect whatsoever on the state charges that he faces. The truth is, he may not need it if in fact we were to get elected he could simply direct that the case is being dismissed, or the prosecution to be terminated at some period in time. So, you know, its a lot of talk and i guess the question remains as well whether or not he even has the constitution within himself to acknowledge that he did something wrong to where he might need a pardon, that might be his biggest obstacle next. We talked to Kristen Walker about this very point and michael is totally right. The idea that he would be able to if he wins the presidency, he says that he will try to direct the doj on a number of things, including trying to indicts political rivals, which is part of it. Lets focus on georgia for a second because it is one of the cases were, if he is convicted, there is no pardon power available. Georgia, tonight, they already have a case there. 18 defendants drawn. They are going to have only two trials, only two defendants going on trial. What do you make of what the lawyers are thinking tonight knowing that theyre going to have advanced notice and Everything Else . Look, you get a window into the logistics of getting a case to trial, laura. And it was never going to be the case that they are going to try all 19 people in five weeks, that wouldve been ludicrous, totally absurd. So i think that all of the other 17 attorneys are watching how this plays out, how does the judge rule, what space does he give to the prosecutors to argue their case and so on . Those rulings are going to potentially have an impact on what happens for the rest, but this is a sort of a mess brewing when you have this many defendants that much law, that many witnesses. We are going to see a lot more confusion, i think, as this gets closer and closer. Put your defense cap on, michael, as well because every prosecutor has to contemplate, as elliott has done as well, what the defense and other side is gonna be thinking about. Trying to have a chess move, you move this direction, ill do this. Theyve already expressed interest to talking to grand jurors and the judge was open to that if they could vet the questions in advance. Think like a Defense Attorney right now as to what benefit those interviews and those questions could actually provide in your defense . Well, i do think, and you know from cnn that the names of the grand jurors are public and that is out there. The defense has another benefit and that is that they will likely get all the transcripts from the special grand jury proceedings, something that we dont to see in georgia very often because we dont use a special purpose grand jury. So they will get reams of information if they get those transcripts and they will have sworn testimony that they can then rely on. If i was going to talk to the grand jury, the body that actually indicted the case, i might be interested in what particular pieces of information they found the most compelling. Remember, they saw only a slice, only a very little bit of the case. You know, the presentation to this grand jury, the criminal grand jury, it was small compared to the eight months of testimony that went on for the special purpose grand jury. If you still want to know what pieces did you find compelling, why did you find it compelling . Where the questions that you had at the end of the day . The judge is not going to allow them to get in the grand jury deliberations, but getting some feedback is almost like having a focus group or a mock jury. If youre preparing for trial, itll get the benefit of the before they have their vote. By the way, thats exactly what prosecutors are doing. They have access to a kind of focus group and asking those very questions. Grandeur is this elves can actually ask questions, so ill be curious to see what questions they may have had and, if i read the Defense Counsel i would be trying to pick that all apart.
