november 8. welcome to "american morning." first, shocking accusations against herman cain. this morning the washington examiner is raising stories. a fifth woman said he asked to be set up on a dinner date with another woman after a speech he gave. this after accuser number four came forward and didn't hold back. her name is sharon bialek. she's a single mother from chicago who worked for the national res straugs association back in the 1990s. she was laid off and met with herman cain to ask for help finding another position. with glory yad aia allred by he giving a detailed account of a dipper she had with herman cain. >> instead of going to his offices he suddenly reached over, put his hand on my leg, under my skirt, and reached for my genitals. he also grabbed my head and brought it toward his crotch. mr. cain said, you want a job, right? i asked him to stop, which he did. i asked him to take me back to my hotel, which he did, right away. herman cain striking back just hours ago on late night tv. we expect to hear more. mary snow is with us today. >> you know, this comes just days after herman cain said that this story was over. now he said he'll set the record state and it will happen at the sight of a news conference. on jimle kimmel last night he denied the allegations made by sharon bialek, described his reaction to her news conference yesterday with his staff watching him. >> they could see steam coming out of my ears, and the feelings that you have when you know that all of this is totally fabricated, you go from anger, then you get disgusted, you try to control yourself to make sure you watch this thing all the way through it, and i was listening very closely, and when it was all over with, i said, well, i know what we've got to do. i will talk about any and future firestorms. here's the thing people don't know about herman cain. i'm in it to win it and i'm not going to be discouraged. >> now, oen the specific allegations made by bialek, cain's campaign said in a written statement last night that there was no written statement, no complaint filed to support her claims. bialek said she did not file a complaint with the national restaurant association because she wasn't working with them at the time that this alleged encounter happened in july of 1997. she had been let go about a month prior to that. after her news conference she gave her first interview to cnn's piers morgan and why she decided to speak now and the scrutiny she's expected to face. >> i wanted to do this because know that know me know i don't back down from controversy and things, and i felt i needed to do this for the other women that couldn't or wouldn't, and regardless of what happens, and i know there is -- you're right. there's going to be a lot of backlash and i'm going to have to suffer through it and i'm sure i'm going be portrayed as different things. i'm willing to handle it. i'm a tough girl. >> now bialek's claims come one week after it was disclosed that two women received payments from the national restaurant association after they alleged that they were sexually harassed by herman cain in the 1990s when he was head of the nra. one of the attorneys for one of the women said yesterday after bial bialek's nguyen conference that his client's story had similarities. he did not elaborate. but he said that there were similarities that would corroborate her story. >> this is a woman who would come forward and put a name and accusations to a name. >> apparently she reached out to gloria allred last week. she says she does not anticipate filing any type of lawsuit. >> we're going to ask ms. allred and ms. bialek when she appears on "american morning." i'm not going to talk about this anymore. i'm going to talk about it any time it comes up. >> throughout yesterday there were only general denials and not specifics and it started to get a little more specific yesterday, and, of course, we'll hear a lot more from him today. keep it on "american morning" because at 7:40 we're going to be joining by sharon bialek and her attorney gloria allred. conrad murray was found by a jury. >> we the jury find conrad murray guilty of the crime of involuntary manslaughter. >> murray is stone-faced as he heard the verdict. you heard latoya jackson. latoya later calling the decision a victory. let's go to casey wian in los angeles. dr. murray is behind bars. >> reporter: he is behind bars reportedly on suicide watch. yesterday, different reactions from the lawyers on both sides. prosecutors very happy as they say justice was served, also offering their sympathies to michael jackson's family. the defense team saying that dr. conrad murray did not get a fair trial and they're vowing to appeal. let's listen to what both sides had to say. >> i was a little disappointed with the outcome. i can't say that i was surprised. there was a lot of evidence that we wanted to get admitted that we felt was critical for the jury to hear to make an informed decision. >> i just thank the jury and our sympathies go out to the jackson family at this time for the loss that they suffered, not a pop icon, but a son and a brother, and i think that's most important to keep in mind today. >> reporter: now, the reason the defense team says dr. murray in its view did not get a fair trial is the jury early on in the case did not allow a lot of evidence into the trial, specifically michael jackson's past drug use and specifically his financial condition. they do vow to appeal, but in the meantime, they're going to be working on trying to figure out the arguments to persuade this judge to give dr. murray a much lighter sentence. he could get up to four years in state prison. the defense team is expected to ask for probation, perhaps a very short amount of time in county jail. this judge, though, is the same judge who ruled yesterday that dr. conrad murray is a danger to socie society. so they've got a long way to go to try to cover vince this judge that the sentence should be short. >> casey wian in los angeles. thank you. let's bring in cnn analyst paul callan. good morning, paul. >> good morning. >> convicted. sentencing will be on the 28th of november. separate and apart from this issue in california of whether or not they have enough jail space, what's he likely to get? >> well, think given what judge pastor said yesterday, four years is a light sentence. four years is a maximum. the juk did something very surprising at sentencing. he said slap on the handcuffs and take him away. he's a threat to public safety, it's a violent crime. all the messages were is that there is going to be a severe sentence handed down by the judge. >> is this true? this was highly specific. how does that make him a threat to society? >> i don't think it does. he took a human life, no question to that. frankly the only threat to society would be his ability to prescribe medication. he's been suspended. he has no right to prescribe medication. >> he was doing something he should. have been doing as a doctor anyway. this is a whole different realm. >> well, you know, i think though that you're only something there, because i think judge pastor is sending a message through this case to physicians practicing particularly in california where you hire this doctor and get whatever prescription drug you'd like. there's been so much damage done to people by doctors who are becoming drug dealers and think he was sending a message here, we're not going to tolerate it anymore. this is what's happening. he's going straight into prison. strong message to the court. >> now, his medical license in california is suspended. the medical board has to review it. i'm assuming they'll have to take it away. >> undoubtedly. felony conviction, almost 100% of the time, it's permanently invoked. >> it's a state board. does that mean he can prak 'tis anywhere else? >> no. most of the states have what we call reciprocity. if you're suspended and revoked in one state, you'll be suspended and revoked in another state. he's not going to practice medicine again. >> one of the things ed chernoff, his defense lawyer said yesterday, was that they're going to do everything they can do to try -- right now their main job is to prepare for sentencing and limit the amount of time that murray spends in a jail. but there was an implication in what he said, that they don't want to take up a jail cell in the county. >> oh, yeah. that's going to be the approach here. there are two things going on in california. one is called the california realignment law which basically they're trying to get nonviolent felons out of prison into the state jail system and home confinement, that sort of thing, probation as much as possible. federal court has an order about overcrowding in california because of the financial crisis. so they're going to try to use those two things to limit his jail time. >> can you do that? can you argue in court when you're talking about your sentencing that the state's structure and crowding is the reason -- >> you can under this strange california realignment law. one of the things that's locked at is the nay toufr the crime and whether you should go to prison. prison is where felonies normally are served. if he gets into a jail situation and that jail down the line turns out to be overcrowded, he could be out in not four years but two years. lindsay lohan is a classic example. she's in for 30 days, in and out in two hours. that's classic california sentencing. >> but the judge has made it clear he thinks this man should be in jail. is this overcrowding issue going to be the judge's problem? can he be sure that he goes to jail? he seens to have expressed his view. this is a prison case, a serious case, a threat to society. he's gong do everything possible to make sure conrad murray spens time in prison. it's not a lot of time. >> paul [ femala $100 cream. we were flattered when regenerist beat flabbergasted when we creamed a $500 cream. for about $30 regenerist micro-sculpting cream hydrates better than over 20 of america's most expensive luxury creams. fantastic. phenomenal. regenerist. the right man and the right job may soon be out of a job. italy's prime minister sisilvio making a serious revolt on this american morning. >> welcome back. it's 30 minutes after the hour on tuesday morning. time for this morning's top stories. a single mother from chicago is going public with sexual harassment cases. she claimed cain groped her 14 years ago after she asked for help. she plans to counter her accusations at a news conference later today. legend champ joe frazier has died of liver cancer. smokin' joe was 67 years old. he was the first fighter to beat mohammed ali. it came in the first of their three classic fights. in a statement ali says of his longtime nemesis, the world has lost a great champion. i will always remember joe with respect and admiration. >> dr. conrad murray behind bars. he's been found guilty of involuntary manslaughter of michael jackson. the judge denied bail and ordered murray to stay in jail until the end of his month. faces four years in prison and likely lose his medical licences in three states. he was already suspended in california. they face criminal charges for failing to report alleged sexual abuse. jerry sandusky is charged with assaults eight young boys. cnn's jason carroll is following the developments. he's live at pen state. good morning, jason. >> reporter: good morning to you, al. yesterday penn state released a statement saying joe pateryn nal would not answer any questions about the sex abuse scandal. we'll have to see what happens at the press conference later on today. meanwhile this all coming after two school officials posted bail late yesterday and their attorneys lashed out at the attorney general. two penn state officials charged with perjury were released on $75,000. athletic director timothy curly and senior executive gary schultz. sandusky is accused of sexually accusing eight boys. the attorney general says curly and schultz failed to report one of the incidents of sexual abuse to police and lied to grand jurors. their attorneys say the charges are bogus. >> it is a distraction in this case, the charge of perjury, and it is unconscionable that the attorney general's office would level such a weak case against a man of integrity like mr. cur curley. >> this is disappointing. rather than follow the law the attorney general has fabricated a fiction. >> reporter: the report alleges sandusky used his position as a former coach and founder of an organization to help troubled youths to befriend young boys so he could sexually assault them. sandusky maintains his innocence. prosecutors say that penn state official reported it it would have stopped sandusky from allegedly finding more victims. the prosecution says the case is not over i don't think it would be beyond the realm of possibility that there are other victims involved here. >> head coach joe paterno is not charged in the case. in 2002 he saw sandusky sexually assault action 10-year-old boy in the shower. he told his immediate supervisor timothy curly. prosecutors say in the eyes of the law, that was enough. >> i wouldn't characterize how i feel about joe paterno and anybody in the case. all the sympathy i have is directed toward the children. >> once celebrated as a hero he was carried off the football field during the ail a moe bowl in 1999. now he's out on $100,000 bail and he's out on bail and faces life in prison if charged on all accounts. sandusky is expected in a court appearance tomorrow. as for paterno, he's a legend, you know that. but there's a growing number of students at penn state calling for his resignation. >> what's a sense of how this is going? it's a side debate and certainly not as important as the boys and the victims and finding out exactly what happened. but the debate surrounding it is what should happen to joe paterno? will that lucrative program protect him or will he resign, be forced out? >> well, you know, when you look at the situation with paterno, you can look at it two ways. when you look at it from the legal aspect of what's going on here, ali, you heard from the attorney general's office, you heard from police. they feel as though legally he did the minimum of what was required. so legally that's why he's not facing any charges. morley there seems to be a question of whether or not he did enough. he knew about this allegation and there are some who are simply saying why didn't someone here call the police, whether it be paterno or these other school officials. why didn't someone reach out to the police? that is why you see a number of students here at the university and, quite frankly, throughout the community, at least on one side of this issue who say it is in fact time for this man to step down. having said there, there are still a number of people who support joe paterno, make no mistake about that. also this morning it appears italian prime minister berlusconi's days could be numbered. as we speak, italy is trying to get its finances under control. it's unclear whether berlusconi can muster enough votes to pass the bill. matthew chance live in italy in rome. matthew, bring us up to date. >> reporter: what you say, within the past few minutes that parliamentary session has apparently gone under way with the italian budget. there have been a dozen or more defections from berlusconi's ruling coalition. it means the prime minister may not be able to have a majority in the parliament. if he can't do that, the pressure is really going to be on him to step down. the newspaper is full of speculation that silvio berlusconi has been. he'll fight to the end. he's been trying to attract these rebel parliamentarians back to his side, but things looking very touch and go for the italian prime minister. before the day's out, we may have perhaps a new italian government or at least some clarity on what silvio berlusconi intends to do. >> matthew chance, live in rome this morning. thank you. mother nature piling on in oklahoma. the sooner state shaken by an earthquake. it centered about 17 miles from the town of shawnee. at the same time, at least one tornado touched down in southwestern oklahoma near the texas border with reports of several more there. the twister damaged some buildings, but no reports of injuries. rob marciano in the extreme weather center for us. they've had quite a few days there. >> not to mention their record breaking heat in the summer and the cold and snow from last winter. here's another shot at that twister. we are in severe storm season. we'll get another round. you get monster twisters like this. my goodness. look at that thing. like a blender and a drill bit scooting across. as you mentioned, no injuriesful we have a threat for severe weather today across this part of texas. this line of storm is moving toward dallas. thunderstorm watches have been allowed to expire. it will get into wisconsin and parts of minnesota. red areas here, including louisiana, parts of arkansas. that's where your severe weather threat is. east of there, we're in for mild weather again. temperatures will be in the 70s in many spots. 72 degrees expected in dallas. all right, briefly what's going on with this thing, which is the astroid that ali mentioned, yes, it going to miss both the moon and the earth. this itwo-dimensional vision. it's going be scooting across the atmosphere at around 6:30 tonight. this is what it looked like yesterday. it's not really that impressive. nothing really worth looking at. you'd have to have a high-powered telescope to see it as well. something of interest. >> at a time in our life is there going to be a big one that hits us like in the means? >> are you hoping for that? >> if you told me there's zero chance then i won't get excited. christine does these stories and says there's an astroid bigger than the moon that's going to be coming by. do i need to draw up a will? i need to know is it going to happen in my lifetime? the kids' lifetime? >> it could be. we can't keep track of all the astroids. >> is there something more important than the little weather pattern? national restaurant association education foundation back in the '90s when cain headed up the organization. she had just been laid off and she went to cain for help in finding a new job. bialek with celebrity lawyer gloria allred gave this account of her encounter she had with cain 14 years ago. >> instead of going into the offices, he suddenly reached over and he put his hand on my leg under my skirt and reached for my genitals. he also grabbed my head and brought it toward his crotch. mr. cain said, you want a job, right? i asked him to stop, and he did. i asked him to take me back to my hotel, which he did, right away. >> herman cain striking back just hours ago on late-night television. we'll hear more from him later today. mary snow has more for us this morning. she joins us now. good morning. >> good morning. this afternoon in phoenix, arizona, herman cain says he'll set the record straight about accusations made by sharon bialek and her attorney gloria allred. in his words, this isn't an ounce of truth in the allegations against him. he spoke live on the "jimmy kimmel" show. >> you asked me earlier and you said did my wife watch that press conference today. she did. you know what she said to me when i called her. she said the things that that woman describes, she said, that doesn't even sound like you and i've known you for 45 years. my own wife said i wouldn't do anything as silly as what that lady was talked about because she does know me. i've been married for 43 years to the same woman and i'm proud of it. >> well, cain's campaign came out with a statement addressing bialek's accusations saying there's no record and no complaint filed to support her accusations. sharon bialek says she didn't file a complaint with the national restaurant association because she no longer worked for them when this alleged incident occurred. she had been fired by the nra a month earlier. so why come forward after 14 years. bialek said she came forward to represent other women who had felt violated by herman cain but couldn't come forward. she appeared on piers morgan last night. >> to be honest with you i haven't watched any of the media. i know in the next two days is when everything is going to hit the fan, so to speak, and e-mail prepared for it. you know, again, i'm a strong woman. i can get through this, and this, too, shall pass. i don't like what's going to happen because i'm sure they're going to try to depict me in all kinds of ways, but that's the media for you. >> now, bialek's claims come one week after it was disclosed the national restaurant foundation. now, an attorney for one of the women who has chosen not to come forward, he came out yesterday to say that there are similarities to his client's story after hearing what sharon bialek had to say, but he didn't elaborate. >> the story isn't over because now herman cain after saying he's not going to respond to anonymous, that he didn't know what he was responding to, really, now he has a face, specific allegations and accusations, he will responding in a news conference. >> yeah. and this is a big contrast to just a few days ago when he said he was getting back on message, end of story. last night on "jimmy kimmel" he said, yes, i will address this firestorm and any future firestorms coming up. >> apparently that stay on message didn't go over well in any circles. they said, this sjt going to do. you're going to have to come up with something better particularly for a guy who was sort of a media darling. to all of a sudden a certain guy who didn't want to answer questions and giving reporters instructions how to ask questions. it didn't work for him. >> it will be an interesting news conference. if he goes through it and say, this isn't true and cheer, calling the verdict a victory. let's go to casey wian. good morning, casey. >> reporter: it was clear that this case is far from other. prosecutors, of course, were very happy with the verdict, offering their sympathies to the jackson family, but the defense team claiming that conrad murray did not get a fair trial and voling to appeal. let's listen to what both sides had to say after that verdict. >> i was a little disappointed with the outcome. i can't say i was surprised. there was a lot of evidence that we wanted to get admitted that we felt was critical for the jury to hear to make an informed decision. >> i just thank the jury, and our sympathies go out to the jackson family at this tomb for the loss that they have suffered. not a pop icon, but a son and a brother. and think that's most important to keep in mind today. >> reporter: now, the basis for the defense's claim that dr. murraydy not get a fair trial happened early in the case, and that is the judge did not allow a lot of evidence of michael jackson's previous drug use, testimony from some of his other doctors and evidence of his financial condition. the judge early on ruling that that case was not going to be about michael jackson but specifically about the actions of dr. conrad murray. now, sentencing in this case is scheduled for later this month. november 29th. prosecutors are expected to ask for the full four-year maximum in state penitentiary. the defense is expected to say dr. murray is expected to receive probation, perhaps a short amount of time in the county jail at the moment. they've got a long road ahead of them because clearly the judge ruled yesterday or said yesterday that dr. murray is a threat to the public and that's why he sent him to jail right away, ali. >> didn't even wait. we heard latoya jackson and her scream or her cheer in the courtroom. she later said it was a victory. how is the rest of the jackson family taking the verdict? >> very, very happy, very, very relieved. they emerged that -- many of these family members throughout the case were in the courtroom watching it first-hand and they emerged after the verdict yesterday to a throng, hundreds of adoring fans. here's what they had to sayaff ward. >> michael loves everybody out here. i love him. we all love him. he was in that courtroom and that's why victory was served. >> justice was served, >> it was really quite amazing. sandusky -- it was sandusky's idea. he came over to her house and before he came, she told police. she had called police immediately when her son came home. so two police officers were hiding in her daughter's bedroom as sandusky came over. she said, if you could even imagine, her heart was pounding. she could barely heard anything. but he said -- admitted he had taken a naked shower with her son, admitted there was some kind of contact whabld he said to her, he asked her for forgiveness. he admitted he probably wouldn't get it and them he said i wish i were dead. >> and police heard this conversation. >> police heard this conversation. the district attorney was told about the so-called confession but no charges were ever brought. there's kind of like a sub plot to this story. the district attorney is missing. he's been missing for seven years and was declared dead over the summer so we can't ask him why he decided not to pursue the case. >> that's such a bizarre angle to the story. but you've spoken to two of these mothers who have children who are obviously overwrought that this has happened and one of the other strange parts about all of this is joe paterno is having a press conference and the university says he's not going to talk about this. maybe he'll give a statement. is there anything else people want to know from joe paterno with what's going on with this football program and this university and how did this not -- how did the university not bring this up to police right away? >> i mean i think there's a lot of questions people have for joe paterno. the problem is that joe paterno says what he wants to say. even his handlers would tell you they can prep him all they want, but when he gets out there, he's going to say what he wants to say. that's how joe has always been. so what he says today, i think, you know, is minute to minute, and we'll find out, but obviously people have a lot of questions for him. you know, fans are just incredibly hurt by this. that's the feeling everywhere. even the diehard bleed blue a - and-white fans. they feel let down. >> sara, there's the more reality of this whole thing and the legality of this whole thing and when you say that victim number one, who isn't the first alleged victim, the first one to be believed, why didn't anyone at penn state believe parents and boys who were saying that they were in these very -- at the very least inappropriate, at the worst criminal situations with a coach there? >> i mean we don't know. we don't know why they weren't believed. the paperwork is saled. it's part of a criminal investigation. we can't get ahold of it. we can only know what the mother has told us in 1998 and what the testimony was regarding the 2002 case, but i do thing it's probably a combination of a little bit of loyalty and a little bit of -- you've got to remember that in 1998 and in 2002, jerry sandusky was second only to joe paterno. he was huge. he was a big deal on the field and off the field because of his charity work and so i think a lot of people probably had a hard time getting their heads around the idea that he could be doing something so horrible. >> all right. sara, thank you so much. the crime roert from "the pate trot news." people in oklahoma can't catch a break these days. rob marciano is in the weather center. an earthquake and then a tornado? if you did, you're not alone. millions of people across the globe couldn't log on because of a software crash that crashed a lot of route eroute. be beyond the realm of possibility that there are other victims that exist here. >> grand jury investigation identifying eight boys sexually assaulted by a former penn state football coach. attorney general says there could be more on this "american morning." and good morning to you. time for our top stories. it's 30 minutes past the hour. italy is trying to get a better handle on its staggering 2.6 thl drrs debt. right now parliament is debating a budget which it's expected to vote on in about two years. it's still unclear whether italian prime minister silvio berlusconi can muster up enough support from his own to pass the bill. and before there was rome there was athens and at any moment we could learn who will replace prime minister george papandreou. he announced he would step down on sunday to make way for a unity government. the biggest task will be to implement the bailout package. mohammed ali says the world has lost a great champion. he's talking about his fellow heavy weight legend, smokin' joe frazier who died last night after a battle with liver cancer. frazier was 67. the two will be forever linked for their three classic links in the 1970s. frazier was the first man to beat ali winning the first of those bouts referred to as the fight of the century. dr. conrad murray behind bars on suicide watch. he's been found guilty of involuntary manslaughter in the death of michael jackson. faces four years in prison and will likely lose his medical license in three states. >> shortly joe paterno will hold his press conference. a former assistant coach charged with sexually assaulting at least eight young boys. cnn's jason carroll following developments on the ground at state's penn state college. good morning to you. >> reporter: good morning to you, ali. joe paterno would not answer questions about the sex abuse scandal but everyone who knows him knows he's his own man. we'll have to see what happens aet the press conference. meanwhile two officials who posted bail, the minute they came out of court, their attorneys came out as well and directed their anger at the attorney general. two penn state officials were released on jachlt timothy curley and gary schultz resigned in the wake of a sexual abuse scandal involving jerry sandusky. he's accused of sexually abusing eight boys. the attorneys say the charges are bogus. >> it is a distraction in this case, the charge of perjury. and it is unconscionable that the attorney general's office would level such a weak case against a man of integrity like mr. curley. >> this is disappointing because rather than follow the law, the attorney general's fabricated a fiction. >> reporter: the attorney general stands by the accusations laid out in a 23-page grand jury report. sandusky was a founder of a youth. they say had they reported the allegations to police, which is required under pennsylvania law, it would have stopped sandusky from allegedly finding more victims. eight boys are described in the report, but prosecutors say their investigation is not over. >> i don't think it would be beyond the raeealm of possibili that there are other victims that exist here. >> reporter: head football coach joe paterno is not charged in the case. in 2002 a grad student saw sandusky sexually assaulting a 10-year-old boy in the shower at the university. he told paterno and he in turn told his immediate supervisor, timothy curley. the prosecutor says in the eyes of the law that would be enough. >> i wouldn't characterize how i feel about joe paterno or others in the case. all the sympathy i have is for the children. >> reporter: sandusky, once celebrated as a hero was carried all the football field after the alamo bowl. he now is facing life in prison if convicted on all counts. and sandusky is expected in court tomorrow. that court appearance, though, might get postponed. as for paterno, once again, he is his own man, that press conference scheduled for noon. once again, even though penn state officials say he's not going to be answering questions about the sex abuse scandal, there are going to be a number of people attending the conference who are going to ask the questions anyway. >> we've seen lately not a lot of success where people are not going to answer questions about scandal scandals. if they mishandled this, they're going to have another problem on their hands. i think that will build up a lot of furor around it. >> if joe paterno is having a press conference, there's nothing else they want to hear about. >> he often brags about the clean program that he runs. if he doesn't answer these questions he will appear hypocritical, right? >> reporter: absolutely. you have to remember this is the man who's been the face, the foundation of penn state football for generations. and when something like this happens and for him to hold a press conference and not say something when he's been the face, the voice for so many years, quite frankly, in the eyes of many people, it's going to look hypocriticahypocritical >> all right, jason, we'll stay on top of it with you. we'll be following the press conference very closely. where do we get in the world where we hold press conferences and don't answer questions that are asked. when did that happen? >> i expected it and i still knew i had to come forward. my biggest fan is my son and the night before i was about to do this i called him and he was with his dad and i said, nick, what do you think i should do? he heard me speaking to gloria and i said, what do you think i should do? he's 13, he said, mom, you need to do right thing. i think you need to tell on him. that confirmed it for me. if my son is saying it, i want tabe the role model for him and other kids growing up. this is not appropriate behavior. it starts when it is about their age. >> supporters of herman cain saying you're not telling the truth and you're coming forward for financial reasons because you have bankruptcy in your past. have you? are you coming forward for the money? >> i have had bankruptcy, and it was after the death of my mother to help my father pay for medical bills and a custody battle and, like millions of other people out there, you know, i'm struggling. and i could have actually sold my story, but i didn't because i want to -- my whole objective is to tell the truth and also help other people out there who may have been in similar situations. initially i went into this hoping every hope of hopes that herman would just step forward. that was my primary goal. step forward, admit it and move forward. >> a lot of people are wondering why you chose gloria as your attorney. >> well, one of the people who will vouch for me said gloria's the best and you have to go to her and she will walk you through this and she has. i couldn't have done this without her and, you know, we support different parties, i'm a republican and, so, i think that right there, if anyone says what gloria is doing this for just totally, that theory is -- >> we'll pose that question to you, gloria. cain supporters say you're a celebrity attorney to represent women to make men look bad. they say you donated thousands of dollars to the obama campaign and this is your opportunity to make herman cain look bad. >> well, actually, carol, i've been a women right's attorney for 36 years and we have $100 million for women who have majority of who have been victims of sexual abuse by men and we're proud of our record for empowering women and that's what we do in our law firm. having said that, let me say that i speak out in support of my clients and in support of women and whether those men are democrat, republican, libertarian or no party at all. i criticize anthony weiner recently in new york with another client who said he should resign the next day and he did. he had engaged in inappropriate text messaging with her. i criticized president clinton over the monica lewinsky issue when he lied to the american people and lied under oath and he was a democrat and i was a democrat. i was an elected hillary delegate to the democratic convention. to me it doesn't matter the party of the man. all of that is to deflect mr. cain, it's a deflection by him because he doesn't want to deal with the sexual harassment issue. he needs to admit in specific detail what he has done. who are we to believe? these four women who have independently alleged sexual harassment and two of them who have filed allegations of sexual harassment and entered into settleme settlements with their employer and the national restaurant association. these four women and i know she doesn't know any of them, neither do i, or the one man, herman cain, who has the motive to deny because he wants to be president of the united states. i think the public can make that decision. >> one more question just about money issues. how are you paying? a lot of people wonder how you're paying. >> i was very up front and said i couldn't afford this and she said, sharon, i could be glad to take your case pro bono and that means she would do it out of her courtesy. >> pro bony o is for the public good. >> you know that herman cain appeared on a late night show. >> i saw it. >> you saw it, you watched it. we'll allow our audience to watch it and then we'll discuss on the other side. >> they could see steam coming out of my ears and the feelings that you have when you know that all of this is totally fabricated, you go from anger, then you go, you get disgusted. you try to control yourself to make sure you watch this way all the through and i was listening very closely and when it was all over with i said, i know what i have to do because there's not an ounce of truth in all these accusations and my team is putting this stuff together. that's why i'm willing to do a press conference tomorrow to set the record straight. >> so, sharon, essentially mr. cain is calling you a liar. >> for the very first part of what he said, anger, frustration, that's exactly how i feel. scratch the end, though, because, you know what i want to say to herman is, if not for yourself, okay, to come forward and admit this, what is his wife going through? you know, that's who i feel for the most in this whole thing. >> he mentioned his wife. he said his wife doesn't believe you either and he's supportive of him. >> well, i hope that's the case. but i have to believe she's going through her own personal turmoil. if not for himself, for the women that he's done this to, just for gloria, that's his wife, too, he should. >> just a final thought about, you know, a lot of people say, oh, you didn't file any charges, you did tell two people. your former boyfriend and your mentor. i know you have sworn affidavits from them. but you didn't file any official charges anywhere and didn't really talk about it in the interim much and many people wondering, why not? if you felt so strongly about this, why didn't you come out about this before? >> well, a couple reasons. one is that, you know, the statute, before initially i didn't come out because i was embarrassed. i mean, who wants to talk about kind of ironing these things out in public. i was embarrassed. second of all, i wasn't employed by the restaurant association, so i didn't know that i had any kind of recourse from that. >> all those years ago, was it easy to talk about sexual harassment? >> no, that's the other thing, too. it's a shame, too, because here we are today, you know, going through, having the same difficulties and it's amazing that we, as women, still are fighting these things and are embarrassed to talk about these things as we were back then. >> that's why i'm so proud of sharon. she's come forward and willing to speak out the unwarranted attacks against her. she's a real hero and i hope she does inspire other women to have the courage to speak out against sexual harassment. i would say to herman cain, sexual harassment is not a joke, if you go on late-night television and make jokes about it, it interferes with women's right to equal opportunity employment. so, stop making jokes. women have a right to be free of sexual harassment and that's why sharon is standing up to fight back. >> we'll see what herman cain says later this afternoon in arizona. thank you, both, for coming in this morning. we really appreciate it. top stories coming your way, next. ♪ [ cellphone rings ] cut! she said he remembered her from the foundation, but she said he looked uncomfortable. >> we'll see what happens. we'll watch it closely along with you, mary. thank you. it appears italian prime minister silvio berlusconi's days could be numbered. even the losest political ally saying it's time for berlusconi to go. italy trying to get its finances under control. the italian parliament is proposing a chance. could berlusconi muster enough votes to get this bill? you know, that's who i feel for the most in this whole thing. >> he mentioned his wife. he said his wife doesn't believe you either and she's supportive of him and -- >> i hope that's the case. but i have to believe she's going through her own personal turmoil. >> cain has called a news conference for this afternoon. last night on jimmy kimmel show, he plans to take bialek's allegations head on and there is not an ounce of truth to any of her accusations. dr. conrad murray is found guilty of involuntary manslaughter in michael jackson's death. murray was taken from the courtroom in handcuffs. he will stay in jail until his sentencing at the end of the month. we're joined by paul callan. is he a danger to society? they put him in jail until that sentenci sentencing, is he a danger? >> he has been convicted of a homicide. this is a form of murder, he didn't take a gun and shoot somebody but through grossly negligent conduct, it is a homicide. >> a man is dead. >> a threat to society. i didn't get that because the only way this doctor can hurt somebody is by prescribing medication and he doesn't have the right to do that. he's not holding up people with a gun. i think that was an inaccurate statement at this point. >> does he have grounds for appeal? >> the judge has wide discretion in terms of setting bail and not setting bail between conviction and time of sentencing. he based it on something else, as well. he might flee the jurisdiction. if you worry somebody is going to flee, you can put them in jail until sentencing time. >> he is facing four years in jail. how likely is it he will serve all four years? >> given what judge said yesterday, he is definitely looking at being sentenced to four years, but in california, they have all kind of things going. they have won this realignment program, they call it. if you commit a nonviolent crime instead of going to state prison, you go to jail. when you go to jail because of overcrowding there is a federal court order that orders some of the jails emptied out early. which is why you see lindsay lohan going in for a 30-day sentence and serving two hours. if the doctor gets four years, he will probably serve less than two and a half, if he serves that. >> that have to look at revoking his license in california, do you think that is likely to happen and can he get a license somewhere else? >> dead certainty he'll lose it in california. he's convicted of a serious felony relating to the practice of medicine. virtually every state in the united states will recognize that judgment and not let him practice there. >> when asked if she was shocked by the verdict conrad murray's own defense attorney said, no. this verdict did not shock his own defense team. >> that is sort of an honest statement by an attorney. an attorney always says, we should have won the case and, well, of course, he did say, which attorneys always say, we'll prevail on appeal. >> does she have grounds for appeal? >> there are grounds, but i don't think they're good grounds. they'll go to the appellate court and say the court blocked them from calling doctors that had prescribed medication to michael jackson in the past and they wanted to bring in about evidence of his drug addiction and a lot of other things. >> more on michael jackson than conrad murray. >> the judge said, i'll give you some of that, but only around the time of the death. you can't go back five years and re-create his entire train wreck of a life. it was a train wreck because of drug problems and lawsuits and so forth. >> a lot was m of the jury who lost family members of drug abuse and i guess we know how that played. they were very upset at the behavior of the doctor. >> it was kind of interesting because there were four to six of the jurors, i can't remember the precise number who had substance abuse problems. a lot of people with substance abuse problems think personal responsibility is the whole thing. in other words, michael jackson would have been responsible for his own faith but they find the doctor acted improperly. the defense's defense that he was trying to help a drug addict. if you help a drug addict, you put him in the hospital and put them in a proper rehabilitation problem and not propofol in your bedroom for a $150 fee. >> obviously, michael jackson was going doctor shopping. will the outcome of this case slow down that practice by many, especially in california, by many people? >> i think it will, carol. one of the interesting things about judge pastor's statement yesterday, he was being very, very tough about this issue of the abuse of prescription medication. it is a national use. i think he was sending a message to doctors, particularly in california. don't let a celebrity buy your services and you can't turn doctors into drug dealers. doctors will be more careful now when they prescribe. >> we had another report this morning that the number two thing that kids are taking are prescription pain killers. first pot and then prescription pain killers. the doctor shopping goes all the way through society. sends an interesting message. paul, thanks. coming up next, she is an environmental cruseder, best selling novelist, erin brockovich. here she is live. 38 minutes after the hour. >> well, i have a fabulous, you know, writer with me, c.j. lions, but i don't know, 2:00, 3:00, 4:00 in the morning my mind turns on and get busy. >> it's interesting where you get your ideas. >> it is. you know, it is, i don't want to say easy. but i get tens of thousands of e-mails a month from 124 countries and territories. and i can see issues that are going on out there because people are bringing them to me. i'm like a depository of this informati information. so, it doesn't take a lot for my imagination to go, you know, to a place where i felt i needed to write a book and how can i get information out. so, i see the stories all day long. >> the main character in this book -- >> you love her. >> i adore her. i wish i could be her. >> you almost are her, though. >> she gets away with things you and i can't do. i really do enjoy that about her. >> how would you describe this book? she's sort of like exactly like you. >> she is. you know, the book is a cause novel and the reason i did fiction is the news and everything can be so daunting and then we just sort of turn off a deaf ear and we'll look at people in our real lives and i can't be that person. but a.j. is this fiction and you read about her and the story based on real things that are happening. you close the book and think, you know what, i can do this, too. that's what i'm hopeful to. >> care about environmental issues, right? >> huge issues. they absolutely are. there are this disconnect still that we don't understand in the environment. everything that we do, you look at these major companies that make our economy run, it comes from the environment. the environment sustains everything we are. from business to economy to our health. so, for me, it's a very big issue. >> let's talk about environmental issues as it applies to the presidential election. some of the republican candidates, for example, don't believe in global warming. when you hear them say things like that, what goes through your mind? >> well, you know, everyone has an opinion. this is the problem with politics. everyone has an opinion and we just get stuck and we end up doing nothing. but i think you just kind of have to observe that there are changes happening around you and respect them and take preventative measures or otherwise we'll have issues. water contamination issues that are coming and you just can't make a broad blanket statement. i think, again, you need to make observations, work -- >> so is global warming real? >> well, i believe it's real. i don't know, it's right in front of us. so, when we're seeing more storms or a change in a weather pattern, i don't know what it is that you want to ignore about that. it's there. and, so, we need to address it and deal with it. and i think, again, prevention is something that is very, very important. >> the environmental protection agency, lots of criticism against that particular governmental development and some suggested that it should be just done away with. >> you don't want to throw the baby out with the bath water, so to say. listen, i'm out there every single day in communities and dealing with environmental issues and there are some problems with the agencies. they're overstaffed, overburdened and underfunded. a lot of times their hands are tied and i think that there definitely needs to be some changes, but you can't just throw regulation away, period. because somebody, i, again, do this every day. i see how we are not handling waste properly. we cannot just keep dumping it into rivers and the water, which is what we're doing. there needs to be some regules but i think that something is going to have to change because, you know what, it's not working. >> your very first case, the one that made you famous that was portrayed in the movie, that's not even resolved yet, right? >> they never cleaned up the contamination and here it is, oh, my gosh, 20 years, i don't even want to say that, since i was first out there, 10, 11 years since the film came out and i get a phone call from the same woman, roberta walker. pg&e came back to her house five miles away and they never cleaned it up and now we're dealing with hundreds of more homes and thousands of more people. see, this is where the problem is. somewhere the state dropped the ball and agency is supposed to have oversight. where is our follow through?
