The defense the indictment reads to influence the 2016 president ial election by identifying and purchasing negative information about him to suppress its publication and to benefit the defendants electoral prospects. Now according to the statement of facts, which accompanies this actual indictment, which they go through through here, 130,000 were paid to Adult Film Star Stormy Daniels 30,000 to a doorman and 150,000 to another woman, which it is clear from the statement of facts is Karen Macdougal. It is an unprecedented chapter in American History. And good afternoon to all. Im erin burnett here in new york, and im wolf blitzer here in washington. The lead up to trumps arrest was truly a remarkable sight to see the former president of the United States, leaving trump tower early this afternoon. His 11 car motorcade arriving at the Manhattan Criminal Court building just around 1. 30. Pm thats where he was arrested. And fingerprinted. Trump was then escorted to the courtroom where he pled not guilty. Shortly after trumps hearing, trumps attorneys slammed the case. Todays unsealing of this indictment shows that the rule of law died in this country because while everyone is not above the law, no ones below it either. And if this mans name was not donald j. Trump there is no scenario. Wed all be here today. Please understand that based on these charges meanwhile, the man at the forefront of trumps truly historic indictment, the manhattan District Attorney, alvin bragg, pushed back on team trumps claims. 34 false statements. Made to cover up other crimes. These are Felony Crimes in new york state. No matter who you are been doing this for 24 years. I dont bring cases prior to a thorough investigation now, having done so the case has been brought a team of reporters standing by jeff zeleny is just outside trump tower in new york. Paris canal is over at the courthouse in new york. Lets start with kara. Keira you were inside the courtroom during the arraignment. Where is this case headed down Campaign Team . Well, this widely anticipated moment, right . Donald trump coming in for this arraignment. Now his attorneys are really starting to put forward their legal argument. They made it very clear that theyre going to fight this case. They dont think that there is a case here, and theres a lot of different areas that they may attack this, so thats going to be the first thing that will see they will start filing motions. The judge has given them several months in order to do that. But were also seeing some other issues that are on the table here. The questions of former president s rhetoric, comments the verbal attacks hes made against the judge and the District Attorneys office. Now the prosecutors have said to the judge that theyre concerned about these statements. These threats and intimidation and theyre asking for a protective order. That is a common practice. But theyre saying that theyre doing because they dont want the former president to make all of these documents they have accumulated through their investigation public either through the media or posting it on social media. Thats one issue that they raised. Another issue that prosecutors raised is whether trumps current legal team can stand as it is tacopina, the attorney whos um sound bite you just played. They said that they believe he might have a conflict of interest. And maybe he should be disqualified from the case. They want the judge to examine that, tacopina said in open court that he never met Stormy Daniels. He never talked to Stormy Daniels, and he never viewed any of Stormy Daniels documents. He said that if there was any disqualification, it should just be if she were to take the stand that he would not be involved in the cross examination. Were starting to see some of these battle lines getting drawn now what . What is next to the formality or the next formal thing will be that there will be a motion schedule. Thats where the defense will lay out a motion to dismiss other motions. They you know, suggested, trump suggests there could be a motion for a change of venue. All of that will be determined now that they have the indictment and see the exact charges. That theyre facing the next Court Appearance in this case is not until december, and then the judge said he will decide those motions. Also up in the air is the trial date prosecutors that they wanted it for january, 2024, trumps lawyer said spring of 2024 was more likely well carry you were one of the few reporters allowed in that courtroom today. Take us inside what happened . In that courtroom. When donald trump when the doors open, and he appeared you could hear a pin drop. It was absolutely silent. He walked very slowly down the long the ill wait between the roads. He was mostly looking forward. He spoke only to the judge. When addressed when he was asked to enter a plea. He said himself that he was not guilty. He also said he understood the potential conflicts and that he was entitled to a conflict free representation. Otherwise he seemed to be a little bit hunched forward. While they were talking. He looked over at the photographers when they were taking the pictures at the start of it, and then he walked slowly out of the courtroom again. Scanning the room to see who was there in attendance. Jeff the former president , hes on his way back to maralago down in florida right now getting ready to make whats being described as a major speech later tonight. What are you hearing from the trump team . Well if we do know that former President Donald Trump had initially planned to make a Brief Comment at the courthouse, he did not do that, but i am told by his advisors. He is not going to hold back this evening when he addresses the nation from maralago, offering a full throated defense of these charges against him. In fact, just a few moments ago his campaign sent out yet another fundraising appeal. Theyve been doing them. Virtually most every hour for the last several days, and he writes this as i fly back home to maralago. Were living through the darkest hours in American History. But he adds, i am in great spirits, so certainly im told by talking to advisers, he will have a defiant tone. Even though you can you can clearly see by the look on his face in the courtroom as carol was just describing their this absolutely took him aback. He was sitting in a legal proceeding. He had no control over what was going on. He was really alone in ways that he has not been for, certainly since hes been president. And even long before that. We also though, got a glimpse from his new Defense Attorney, todd blanche, about his clients defiance. Lets take a listen. Hes frustrated. Hes upset, but ill tell you what hes motivated. And its not going to stop him and its not going to slow him down and its exactly what he expected. And so to that extent, theres no surprise. So his Defense Attorney there said. In fact, the former president is motivated by these charges against him and wolf. We know talking to advisers throughout the day here at trump tower, where the former president spent about 21 hours or so since arriving here yesterday. Hes also thinking about the other legal cases that are looming around him. That case in georgia, a couple of cases in washington in Federal Court as well. So his advisers expect him to sort of wrap all of this together in his speech from maralago this evening, saying that he is the victim of all of this, so there is no doubt that at least for a moment he has frozen his president ial campaign in place is the republican frontrunner without a doubt, but it is also clear that this legal case the courtroom now is a central stop on the campaign trail. But look for tonights speech to not be about the nuances of the law if they should throw these cases out, but about his politics and why he believes he should be the republican nominee, and indeed the next president , he certainly didnt look like he was in great spirits, as his lawyer suggested , are jeff zeleny and in new york. Laura coates, so let me go Down The Line here, ryan, when you got a chance to look at this, you got 12 pages pages here for the actual statement of facts, right . Which, i guess is the talking indictment such that there is one and then youve got the actual six. 18 pages of copy and piece with different dates on Falsifying Business Documents in the first degree. What is there anything here . That surprised you either. This is stronger than i thought or no, this is weaker. Um a lot of it is unsurprising. A lot of it has been reported or is in the federal government documents. The pieces that were surprising to me are some of the evidence that they have, um and the District Attorney said that he got more evidence than the federal government did or that his predecessor, god, and one of them is david pecker. So we all thought Michael Cohen is the centerpiece. David parker seems like a pretty important witness here having direct Conversation Part of this catch and kill scheme and hes there from the start there at this most important meeting of August 15 2002 months after trump announces that hes running for president just set up a catch and catch and kill scheme to suppress stories coming out. For the purpose of the election. Thats what the argument is. Assume thats what he has said before the grand jury. And then there are direct conversations between pecker and trump multiple times, including later on trump, inviting him once hes president for dinner to thank him for all his help during the campaign, thats powerful evidence because that goes to one of the key defenses that trump would have paid this money in any case. Just to suppress a bad story coming out for his family for melania and the like, right . Okay karen. Heres the thing, though, that i still am confused about and that is we know that Michael Cohen himself has said that this catch and kill scheme was in place prior to 2007 when he joined the Trump Organization, which obviously is before trump was a candidate. We also know from the ap in Washington Post reporting that trump team trump, including cohen, pressured in touch magazine. Ah with money to not print the Stormy Daniels story 2011 again. Trump was not a candidate. How do they get around it and make this this was for the election of predicate upon which the Felony Counts are charged. So i think that way they can show that is the timing , in particular the fact that the money and the agreement was right before the election. It was, i think a couple of weeks before daniel specific exactly, and i think i think the conversations that it was about the election also. So that that ryan just talked about, i think really is going to be powerful evidence here. To show that this wasnt for some other purpose. This was clearly about the election. Then of course, as ryan just said that the thank you for helping me win Office Dinner afterward. And i think those are those are the timing of this, i think is critical. Alright so the timing is critical. Laura coates. Let me ask you, though, if trump can make the case that he would have done it anyway. But then brad can say, but in this case, part of your motivation was the election even though you would have done it anyway. Is that enough to sustain 34 Felony Counts of Falsifying Business Documents in the case theyre making depending on the strength and what they actually ultimately present. Remember erin right now we do have this very bare bones indictment, which i should add it is not required for a prosecutor to give the entire entirety of their entire argument their entire trial. Thats really what we want to consume as part of the court of Public Opinion, but they have no requirement to give everything has given notice an opportunity to be heard a kind of due process, and theres been a lot said today, erin about the fact that well, this obviously is for the federal government will listen. Theyre talking about a thing called preemption. Which means that listen, the federal government they have their role. There are federal laws and you have state courts and state laws and one has to stay in their lanes. But although the fcc has been very clear over time, the Campaign Contribution world is our own. There are things that they will not preempt in. One of them is a candidates personal Financial Disclosure as one there are other areas in state law that might allude to the fact that look, its about Campaign Finance, but not right under. Er, the wheelhouse of your laws. There have been courts to uphold the ability of the State Prosecutor to do those things. And so i know this is not as serious too many as a january 6th insurrection or the transition of power from one president to another. But as alvin bragg detailed youre still talking about transparency and disclosure and the ability to know how money is being spent for what purpose for the transparent benefit of the electorate that appears to be the lane there in in new york state, and thats where theyre following right now, but i fully admit this is quite the achilles heel. The more youre explaining in politics, the more youre losing, then were trying to explain the nuance of a law in a courtroom. The lesser jury is enticed into convicting will have to overcome quite a bit today. But finally erin think about it in American History. Voters have not been averse to trying to re elect or elect a candidate when there is consensual Sexual Activity involved. I point to president bill clinton, who was reelected even after admitting and lying and under oath. President trump. We knew about the Stormy Daniels accusations prior to millions of people even trying to get elected again so it doesnt have to be a fatal undermining of their candidacy. No and of course, being under indictment is no. It doesnt preclude you from anything. I absolutely not petrie, many others in American History is rife with that indictment in and of itself is not going to do it. Um i will say and this is, i guess a political question. I read through both the indictment and the statement of facts and karen. Ill be honest. I kind of thought i would see something new. And maybe weve been talking about it so much. That was my mistake, but i really didnt is that good or bad . Well i think over the last week or so we have, you know, really distilled this down to Hush Money Payments. I do think its important that we go back to our democracy. And remember that this is information that the voters did not have when they went to the ballot in 2016, we will never, ever know if it would have had a bearing on the outcome of that election. The voters never had the opportunity for themselves to know that information when they went to vote, so i do think we need to remember that connection and yep, its rather unseemly to hear that then the president in the oval office, you know, was having the conversation with Michael Cohen about the payments. You know, thats not what the oval office is for, and unfortunately it follows a pattern. And this obviously, is the political, not the legal resident undermining our democracy. Okay this is true. Now i know, i know only thinking this if you say it, but then i think about things happening in the oval office that shouldnt have their of a sexual nature, jonah and im im thinking, okay. Clinton, jfk and thats just two of many, but i mean all due respect the lawyers, right. I mean, the im thinking about when trump is going to say tonight he wants to say there was no affair. Right he has been. Hes stuck to this and nobody is getting his back on that. Their defense legally is not their defense morally, and i dont know that he wants to be going into months of trial stuff, admitting to an affair or implicitly admitting to an affair while hes trying to run in the iowa caucuses, right, right, and that is, you know, i mean, theres been some extensive reporting in the atlantic, you know tim, alberta about the evangelical sort of turning away from him, but well hit pause on this because we will be back through this special coverage because coming up more on the historic arrest and arraignment of donald trump. Moments ago, donald trump departed new york city on his way back to maralago. He said nothing to reporters before or after his arraignment. He is, of course, expected to give a speech at maralago tonight. But joining me now is john miller, our chief Law Enforcement and intelligence analyst, john we have a new picture that just came in another sketch from the courtroom, and this is of trump sitting there during his arraignment, i will show it here. Obviously, there is no laughing matter. I will point out that trump is obsessed with these sorts of things. And this takes off 30 years and £30 and for him, this is something hes going to be very happy to see. I mean, this is not all day, right . Right. When we hear carol reporting the scowl, the Frustration Um you know here, theres more of a determination at least that what is conveyed through this image, but obviously he now i guess is obligated to be here for these proceedings that could be going on at various times. As for years, so hes going to be a candidate that same time. So how does this work so New York State Law requires that the defendant attend all proceedings. Um whether its a Motion Hearing or of any other kind of hearing even before the trial, but interestingly, the judge read a particular order. Um in court today, which is designed for defendants who may flee. Now hes released on his own recognizance. Its a non bailable charge, anyway. Um, but in this case. I think the application was not that they expect donald trump to flee the country. Um but that they understand there are probably hearings where he cant be there or or wont come back to new york. And they dont want the case to drag on. So that means his attorneys can show up. Make their motions go through the hearings without the defendant without him in the case will keep on going interesting, though, that they would have to use emotion to flee, right, actually get there. Im some sort of some of this minutia can matter so much as were looking at this wolf you know, because all of this, i guess is evidence right . That this is an uncharted territory that we are now all in. Certainly true, erin standby. Got a good panel of our Law Enforcement are political or legal experts here to assess the dramatic developments that have unfolded on this day and elliot let me start with you what stands out to you from this indictment that we have now all red and its entitled the people of the state of new york against donald j. Trump defendant. What stands out is that it doesnt say a lot wolf. Now thats part of thats new york law. It doesnt require prosecutors to lay out with the exact specificity. City every single fact that they intend to prove a trial, but it does leave a lot of openings for the former president and his attorneys to say wait a second. Youre accusing us of quite serious crimes here. What is the evidence you tend intend to produce and you can almost be certain that the defense will move to dismiss the indictment on this basis, or at least asked the judge to clarify what it says thats one number to the particular crime charge here is falsifying Business Records that can be bumped up to a felony. If you use it to conceal a crime, right. Its a misdemeanor against two felony. Its a real easy misdemeanor. You got Business Records, and theyre falsified lock, stock and barrel. Its simple. When you start getting into the felonies and which crime is being concealed here, thats a lot harder to prove, and the kinds of things that trumps attorneys were talking about today might come up in any motion. They they put in to dismiss this case and carry you say this case is a little underwhelming right now. Why well, because, first of all , with respect to the facts that are alleged, theres nothing new in terms of the facts that we have learned through the either the indictment or the accompanying statement of facts, it really all pertains. Back to the conduct that has been known for many, many years, almost seven years now regarding the payment that was made to Stormy Daniels, and so theres nothing new with respect to that. There is nothing beyond the falsification of records charges. So in the days leading up to today, there were you know, some in the public questioning whether or not there were other tax charges that might be or other types of financial fraud that maybe would be charged today, and that doesnt seem to be the case. It really is limited to the falsification of the records related to that one payment and the reimbursements to Michael Cohen that that were accompanying that at the same time, David Chalian trump is clearly facing a new reality. Bility right now. 34 very serious Felony Charges. Were not talking about misdemeanors. Much more serious felonies. He is facing a new reality right now, and obviously, today was historic day. But to exactly the point you just heard from both of our legal experts here that will play immediately into the politics of this that there was nothing new that there was not a new, surprising fact pattern, which means for the last two weeks the way that weve seen donald trump in his allies frame this as a political prosecution. I would very much expect hes going to quadruple down on that tonight when we hear from him in maralago, and there are no additional goods here in these documents that would prevent him from doing something, so its not a crime to pay hush money. It is a misdemeanor and according to New York State Law to fool around with your payroll , etcetera, etcetera, i think what they have to prove is difficult because you have to prove that this was done in service of his Political Campaign and not to protect melania or not to protect his young son, etcetera, etcetera. So what we saw and some of the documents today were uh, conversations they said were captured and audio recordings. Clearly it seems to me with with Michael Cohen and donald trump discussing this, which we had cnn have known about. Uh and, um , and then there was another one that said the defendant directed lawyer a Michael Cohen. To delay Making Payment to women, too as long as possible. He instructed his lawyer that if they could delay the payment until after the election, they could avoid paying altogether because at that point it wouldnt matter if the story became public. So what theyre trying to do is say this was all about the election because of course it would matter to his family and his young son if it became public before the election or after the election, so theyre trying to deconstruct that argument and say thats just not true. You know, its interesting Michael Finnegan that the prosecutors are giving the judge in this particular case. A packet of the threats leveled out by trumps social media posts because there seem to be potentially dangerous. What do you think . Yeah no, i mean, you have a high profile defendant, former president , front runner for the republican candidacy in 2024, whos signaling for death and destruction. And its also rejecting the idea of peaceful protest all things that hes done publicly, and weve seen that his followers have a propensity for to commit acts of violence. We saw it on january 6th, and weve seen it in in the aftermath of january. 6th in several, um incidents with individuals supporting trump, who attacked federal Law Enforcement, um in many cases, armed alright, everybody stand by. Uh i think the indictment in one sense was as predicted it was a indictment containing counts around Felony Counts around false Business Records. Elevated by the object of the Misdemeanor Crimes to affect the voting laws, either state or federal. What i did find different and where i differ from some of your excellent panelists that were just on is i found that the document actually quite detailed. I mean, it is a speaking indictment, and it has quite a bit of detail about the history and laid out the facts underlying then the various counts that are listed, so i thought that the indictment provided more detail than then perhaps others expected. Okay. So then youre referring here to the 12 Page Statement of facts right, which accompanied the actual charges themselves and in in this, you know, we read this week. I was referring to the i was referring to the indictment itself. To the indictment itself. Okay so can you explain there then . Because the description that weve seen sort of has been , but it was bare bones right that it just lists the date and that the Voucher Number of the check and, you know, false century of Business Records. So can you explain what you did find in here . That was more detailed than you expected. Well, i think at least the indictment i think i read was the counselor always fairly bare bones, but its the Preparatory Leg preparatory language that is used before the counts that out that outlines the scheme that the prosecution is making public to educate the public, presumably on the background of the facts that relate then to the substantive counts. Alright. So in in that section as this goes through alvin bragg lays out those. So what did you find there . That was new or that that surprised you these details here. Well im not really surprised. I think it was an indictment. That was not bare bones. Im just saying, in contrast to some of the comments in your prior panelists bones indictments before and they can be very bare bones. This is not a bare bones indictment. All right. So let me try to understand maybe a different way. If i ask this, alvin bragg said he got additional evidence in this case, and he said that in the Press Conference, so from reading the indictment, and you obviously were very familiar with all the evidence in the case that was available until you left the d a s office. So from what you read in the indictment, are you clear on what the new evidence that alvin bragg obtained was no, i cant. I cant erin go through Paragraph Line by line and say what was new and what was within our, uh, within our knowledge, first and foremost, i have to be mindful of, uh, confidence is that go around the process when we were looking at this matter, uh, this was in the grand jury context of the things i simply cant relate. But what i can say by way of background is we began our investigation in roughly 2017. At the same time, we learned that the federal prosecutors in the Southern District of york were looking at mr trump as well and i was asked by the Southern District to stand our stand our efforts down because they said they got this in hand and i because i believe the Southern District is an Excellent Office with great prosecutors. I was prepared to defer to them. I was surprised, therefore, in 2018 when Michael Cohen pled guilty that the Southern District never went anywhere with that case, and it stopped. In the meantime, we had been focusing on an Economic Crimes investigation, and i can say that because hmm. That mr trump sued me and the office attaching our Grand Jury Subpoena in Federal Court, and so we were onto a what i would say is a different Economic Crimes investigation and were then moving forward on on a broader investigation. Alright so when alvin bragg was asked the question at a presser at the press, and he just was just asked, and it said that the question included the premise that your predecessor declined to charge now. In his answer to the question. Bragg did not challenge that premise. So i just want to give you a chance to clear the record here. Youre saying you stood down because the Southern District of new york asked you to. Is that the same thing as saying that . I mean, did you specifically declined to bring charges because you didnt think they were merited or not . At the time. I dont think we ever. Uh i im sure im sure Attorney Bragg has has new facts that he gathered during his investigation. Um so really, erin, i think ive explained it. There was a federal investigation which i deferred to, and by the time that went nowhere. We then had already picked up an Economic Crimes investigation. Which had to take place during covid and in furtherance of which we had to go to the Supreme Court twice and get a ruling by the Supreme Court in 2020 that the president and Trump Organization had to turn over all its financial records to us, which ultimately then led to an indictment of The Corporation of the cfo of The Corporation, which ultimately was convicted after trial. The 1. 6 million fine for a lot of work that we did. Yes. Yeah but but just to be clear youre saying you think he got new information . So do i read into that . That you didnt have enough and that he must have gotten gotten more and wouldnt you know i wouldnt read aaron into anything too much. You know we are. We did a very thorough investigation. We obviously had to work within a system of Doing Prosecutions that were being conducted by two offices. We ultimately spent a great deal of time stab, reestablishing principles of law that the Supreme Court reiterated in their in their decision and went on to build the financial crimes invest against the Trump Organization, which is the alter ego of the president. One final question to you. So i if i may, and this case is seems interviews to get to a felony right is based upon the premise that the president of the United States did this because he wanted to be elected, right . And he suppressed this information because he wanted to be elected. We do know as a matter of fact from not just with Michael Cohen has said, but historical record about even involving some of the individuals in this case, where stories were given to magazines and then shook, suppressed squelched. Um when trump was not a candidate, so are you confident that this clears the hurdle that his motive was really to do this so that he could get elected when he was doing it prior to being a candidate for election . Well i dont think erin. Its my job to make that judgment call from from the outside. That was District Attorneys brags job, and i think hes obviously said what hes going to do. But if i can, id like to make just two quick points before we go stepping back number one. Today was a peaceful day. The federal government, the fbi, the nypd Secret Service, and court officers, notwithstanding fears of violence and extreme behavior. It was an orderly proceeding and that i think speaks well of judge marshawn and of new york city to be able to hand this proceeding. Going forward. I think we should all be very pleased and grateful. Second uh , outside of the legal work. Whats going on in court . Theres obviously politics that are driving opinions across america. This is interestingly a little bit like what happened with bill clinton but on the other parties when he was investigated by ken starr for five years. Ultimately the president , then president , uh, surrendered his law license in order to resolve the investigation. All the democrats were outraged that the republicans were going after bill clinton all the all the republicans felt that it was absolutely appropriate to look into bill clintons sexual dalliance is so lets put the politics lets lets lets let the politics we handled by the politicians and lets just make sure that we keep our eye on having the Legal Proceedings orderly and supported by by all of us. Um it will allow all republicans to sort of galvanize against this prosecution, and it will fortify the trump allies to continue to strike away at alvin bragg as their political strategy here. So you think the romney statement is going to have an impact and his fellow republicans . I mean, i dont think any position is going to be moved for it. I think it just demonstrates. How this indictment, this statement of facts has not altered the Republican Party from its fortifying around donald trump. And just before 1 30 eastern time this afternoon, the former president was officially taken into the custody of police at the Manhattan Criminal Court in downtown new york. Trump now formally facing 34 Felony Counts of falsifying Business Records, pleading not guilty wolf to every single one of them. Its certainly a watershed moment in American History right now, the first time an ex president has ever been charged with a crime right now, were awaiting trumps arrival at his home in florida is scheduled to land just a few moments from now. We expect him to make remarks this evening. And wolf as we await that we are covering the indictment from every angle tonight, paula reid is standing by for us at the Manhattan Criminal Court house, where the Historic Events unfolded. Christian homes is at the former president s maralago estate where those events are coming up, of course, just about an hour or two and lets begin with you, though, paula here in new york, so going through this indictment and the statement of facts that came with it, paula what did we learn new whats interesting, erin is there were too many new details in this indictment and basically rehashes things that we already know. Now. The story centers on the payment made to Adult Film Star Stormy Daniels that 130,000 Hush Money Payments, but it zooms out to also include other payments that were made to suppress unfavorable stories in the weeks leading up to the 2016 election. That includes 150,000 payment made to playboy model Karen Mcdougal about an alleged affair with the president , as well as 30,000 paid to a doorman who alleged that then candidate had fathered a child out of wedlock. Prosecutors are looking at this pattern of efforts to try to suppress unfavorable stories to help its they alleged. Candidate trumps electoral prospects, and that they argue, is what elevates this beyond just falsifying Business Records to something that impacted the 2016 election. But erin, its still just charged as falsifying Business Records, and usually, that is a charge that is part of a larger crime. But thats not the way they have constructed this case , and that is somewhat surprising. Now the District Attorney was pressed on why hes bringing these charges now or if he is new evidence. He did suggest that there is new evidence theyve uncovered, but that is not revealed in this indictment right now, right and to be clear as you say, if they usually Falsifying Business Documents as part of a broader set of charges. Obviously all 34 of these are that specific charge at the felony level. They say that theyre going to be calling for they want to call at least paula Stormy Daniels as a witness. Now weve heard plenty from Stormy Daniels. But what do they think she would be able to say, specifically to help brags case now . She could be a really helpful witness. That was the whole case is not going to hinge on her testimony, but she could help prosecutors laid down the facts about how exactly this how many payment came to be who reached out to ami, the publisher of the national enquirer, and why did they reach out in the weeks leading up to the 2016 election . Was she doing this to hurt his chances of being elected . Was she doing this because she felt that her story would be more valuable at that time period. Who reached out to her. How is the Money Exchange . Did you ever ask how it would be paid back . She could really be helpful not only for talking about how the payments were constructed, who made them but also about this timing this argument prosecutors are trying to make that all of this was done to help him become president of the United States. Alright paula, thank you very much at the Manhattan Criminal Court, and i want to go to Christian Homes now because shes in palm beach, florida. Where the former president will be arriving soon, and we expect to hear him address publicly in a crowded room and to anyone who will listen to his response to this arrangement. So what are you hearing . He will say tonight, kristen. Just to let you know we have just gotten Donald Trumps First Response to this arraignment posted on truth social appears posted it when they took off for West Palm Beach, but that it just went up , says just lifted for palm beach, florida will be delivering remarks tonight at maralago at 8 15. The hearing was shocking to many and then in that they had no surprises and therefore no case. Virtually every legal pundit has said there is no case here. There was nothing that was done illegally , and it seems that he is linking to several videos of indents talking about this case on conservative media. We expect to hear more of that tonight every indication that we have gotten from his team, every source that i have talked to indicates that they want to make this political. They want to make this about 2024. Were hearing them linked alvin bragg to joe biden talking about election interference, saying that this is because he is an opponent or will be an opponent. Arrival to joe biden. We dont have any indication that that is going to stop at this time, and in fact, while he was in his arraignment, they blasted out a Fundraising Email in which they had actually manufactured a mug shot, put it onto t shirts and sent it out to raise money, so that gives you any indication of where their minds are rotten. Thats exactly where we think they are now. He is with some of his top political advisers, of course, as we saw him leaving and entering that courtroom, jason miller boris epstein, both of them were in the courtroom with him. They were also on the plane with him. Now hes also with his campaign heads. Chris loss, evita, suzy wiles and notice how i am not mentioning members of his legal team that goes to give you some kind of pause as to what exactly this is going to look like an errand lot. Watching the room behind me start to fill up and we are looking at trumps super fans talking about bikers for Trump Members that are here. Maralago members mike lindell is here. It feels very much like a seated rally at this point, just in terms of the guest list. And of course, as we know, when trump has that kind of energy, he tends to go off on rants. I am told that advisors have asked him bag him urged him to stay on message. They dont want him harming his case in any way, but i think its very clear as of now that this is going to be a very political speech. Aggrieved and angry. All right. Thank you very much. Kristen live from maralago. Wolf obviously were going to be seeing which which version of trump we get tonight suspect well get the traditional trump version. Thats just my suspicion. Lets get some analysis right now. Our legal and political experts are here with me right now and let me start with you, elliot. Lets talk a little bit about the illegal conspiracy that the prosecutors are now alleging that trump was engaged in what stands out to you in this new indictment, so the indictment identifies falsification of Business Records right that become a felony, and its just a misdemeanor to Falsify Business becomes a felony if used to conceal or commit another crime. Now in the Press Conference after the diamond and diamond was issued notice, it doesnt say this in the indictment, alvin bragg, the d a walks through a few different crimes, he identifies that perhaps conspiracy to violate election crime or Campaign Finance caps might be the crime. We dont quite know what that is now, he said at the Press Conference, so we shall see how this all plays out. There was a back and forth with the District Attorney, the former District Attorney in the last hour of the program and said that you know, its actually quite a detailed document. The document itself is not that detailed. He submitted a statement of facts with that that had some details in it. But theres still some questions i see carries, nodding. I think she agrees with me on this as well. Theres still more details that could be filled in here. How do you judge the strengths and potential weaknesses of this case . You know, part of what elliot is describing is that normally when were talking about cases, we talk about how prosecutors speak through their indictments. They speak through their charging documents. And what was interesting today was to see that very Little Information just the crime. Issue was in the indictment a little bit more of the contextual facts were in the statement of facts, but then it was really the d a. S Press Conference where he talked about this other potential ancillary violation of criminal law, which is still very vague, and i think that will be one area that presents really an opportunity for the former president s Defense Attorneys in their motions. Practice which this really this has such a Long Way To Go now. This case before it is resolved, and theres going to be a lot of motions filed. That can potentially get at some of these issues of what still is unclear about the prosecutors theory of the case. Thats one of things thats so interesting. We have such a Long Way To Go. I think were trying to sort of make predictions about how this is going to play politically. For donald trump. Looks like the next hearing is going to be like in december, maybe a trial in january, maybe a trial in the spring. Thats what Donald Trumps lawyers seem to prefer. So much is going to happen between now and then. Obviously you know, theyre gonna file motions to dismiss as well, but i do think there is sort of a lane of the groundwork that a president can be indicted. Right there are other cases that were going to hear other investigations that are going on around january, 6th around the documents case as well in georgia. I think one of the themes that were going to hear from republicans and donald trump about all of these cases is that somehow all these cases end up helping donald trump right and somehow theyre all political. But i think in some ways we should really take that as spin in some ways. Sort of with a grain of salt, because that is what donald trump has been saying throughout his time in public, like throughout his presidency, that all of these scrutiny the impeachment would help him and that it was all sort of a political witch hunt. And i think you know you heard from the voter in pennsylvania, for instance. This is one of the reasons why voters turned against him because of all of other scrutiny and all of the sense that he was doing something in different instances that he shouldnt be doing well, and you have to wonder how this is going to play in the long term. Given whats coming down the pike here whether its going to be an indictment coming out of the Georgia Grand Jury what the special counsel jack smith is going to do and because this case is first and weve talked about this will this affect the Public Opinion about whats coming down the road. Or will the public say look, you know, maybe the Stormy Daniels thing was seven years ago. And but this other stuff, um about an insurrection or about trying to fix an election thats really serious. Alvin bragg today in his Press Conference, said this was about democracy because his point was that donald trump was the one who effectively was trying to fix an election. By not by hiding this information from the public, and thats why he said it was effectively you know, a campaign donation. No just one thing i would add. You know these infirmities and these questions that were raising have talked about throughout the program. None of them are fatal to the case, and something lawyers and prosecutors have to do is look at potential weaknesses, and these are just areas that trumps attorneys might have for attacking something that might be in the indictment sort of an argument in favor of a more vague indictment, which new york law allows you to do is that every word of prosecutor puts on that page is subject to being challenged or picked apart or being even a basis for dismissing the Invite Indictment down the road, so theres an argument for just putting that the minimum thats legally relevant out there. Get your case, get it to trial and then see what happens. Interesting david that the main point is the prosecutors are making in this indictment is that what trump was doing was trying to hide damaging information from American Voters before the 2016 president ial election, and theyre alleging that was illegal, but but he calls the prosecution itself election interference, but actually what is being alleged years that he was trying to interfere with the 2016 election through this Hush Money Payments scheme. Wolf can i just ask . Our legal experts have one quick question. Is there a way to assess how likely a dismissal outright would be by what you see here. I wouldnt try to predict it yet. I mean, the way that i think about it is unlike in many of the other cases that weve discussed over the years that at the former president has been involved in where he, for example, on executive privilege, where he makes really just not credible arguments, and he keeps failing in Federal Court time after time after time. The way that i look at this one. David is that i think there are credible arguments his Defense Attorneys can make, so im not willing to predict the outcome of those, but i do think that they will have some credible basis upon which to make arguments to the only one that i think is probably a pretty clear loser is a motion to change the venue of the trial and get it out of manhattan. Theyve sort of grumbled a little bit that he cant get a fair trial anywhere in manhattan. Number one. Judges really dont like granting those motions because they presume that jurors can be instructed to follow the law and listen to the facts and number two. This judge also has already handled trump trial in the form. I believe it was alan weisbergs trial, the former cfo of the Trump Organization. It can happen here , and its really hard. Thats why trump said he hates me because he handled Trump Organization case thats right very quickly if hes convicted of these 34 Felony Counts, he could wind up going to jail, right. These are serious charges that have been brought its 34 counts of the same federal are Felony Counts. Thats whats significant and so the potential penalty is jail time anywhere from one to a few years for each count. So so thats why we saw the seriousness and the gravity of i think the expression because he is facing serious charges where potentially. And i think were very, very long way against the potential conviction because that means that weve you make it through motions practice you actually get to a trial and even though his Defense Lawyers are saying right now that theyre never that hes pleading not guilty, and there never would be a plea. You never know as we get down farther in the process, whether or not he would end up producing two misdemeanors because the conduct thats described the falsifying of the records without the other ancillary criminal violation are misdemeanors. Can i just say politically . One thing thats really important here . If you as you look back at this, and some context is what was going on at that time during the during the Political Campaign, not only were you close to the you know the end of the political but but, um you had the access Hollywood Tape. And the access Hollywood Tape, according to the statement of facts here, um was october 7th 2016. David will probably remember that date just like that. And then october, 10th was when they effectively negotiated the deal and said were gonna you know were gonna do these. These payments should be paid 130,000. For the rights , etcetera, etcetera. So i think that, um you know, you have to kind of think of the frame of mind that the defendant was in at that time. And you know that anything that could be revealed having had that access Hollywood Tape out there . Which everyone at that time myself included, so it would affect the election. Of course, it didnt. Um he was he was really worried. Now how you prove that in a court of law is to have people say as they apparently do, he told me. He told me that maybe wait till after the election to pay the money. Maybe thats where david pecker comes in, right . Because hes the one who is doing these Kitchen Kill Deals had done them before in 2015 for other reasons , and so hes doing it now where theyre different conversations around the Stormy Daniels, one that had to do with the election quick. The complicated thing, though, in that is that its all hearsay. What youre talking about here, some of those would get in. Some of them may not. Our senior justice correspondent evan perez is joining us here in washington. Evan this is an historic first. But will it be the last all all signs wolf are that the Justice Department investigation is accelerating, and theyre reaching a point soon, where theyll have to make a decision as to whether to bring charges or this is something obviously that the federal prosecutors have have often considered right. Which is the idea that will they be the first to bring charges against the former president of the new york District Attorney already took care of that. Now jack smith and his his his team of prosecutors are you can tell from some of the activity weve seen in court are working to try to make a decision on on bringing charges and whether to bring charges and one sign of that wolf is weve seen is that weve seen witnesses who had gone before and been interviewed by the fbi now being brought before the grand jury, so its very likely was that, at least for the maralago investigation. The investigation into whether the former president was Wilfully Obstructing and willfully keeping National Security information. That investigation appears to be in a different timeline from the second investigation. The Justice Department which is whether the former president was committed a crime in his efforts to remain in office, so we expect wolf that well before the new york case is resolved. Well before even he is next to appear in court. That the Justice Department will have said something on the maralago investigation. Thats how quickly things are moving. In that case. Potentially there are three other three other criminal investigations of trump underway right now well see how that unfolds. Evan perez, thank you very, very much, aaron back to you all right, wolf and joining us now is lanny davis, attorney from Michael Cohen. So lanny, youve had a chance to go through the indictment. 12 pages 16 pages. Sorry. Statement of fact, 12 pages. Did you see anything new in there today that you didnt know . No. In fact, i, um its kind of expected that there would be less than people would want to read and there are two kinds of indictments or even civil complaints. One is very, very long in a lot of narrative. I tend to write those kinds of complaints, but some prosecutors put a bare minimum number of charges and information. So in this case, they certainly outlined the overall evidence that i think is the structure of the Felony Charges. But i think well just have to wait and see. I can only tell you as i said before, aaron, i predicted to you that when this case goes to trial it is far more detailed and has much more substantiation documents, emails, timelines. Telephone calls and another witness in the form of mr becker , who was involved in both transactions that Karen Macdougal transaction and the one so i think the case when it gets to a jury will be a strong case. But it will ultimately be 12 people, not the American People, listening to speeches or politicians or even as panelists , 12 people in that room will decide whether donald trump is guilty. All right now you did say, as you said now, but last week when you and i spoke, you were predicting a lot of people would be surprised at the level of evidence to back up this case now im sure you still stand by that. Its just we were presented with that today. Right . D a brag today says he did receive new evidence, but hes not telling us what it is. Hes saying its going to come out during the trial. That trial could be up to a year away. Are you disappointed . He didnt include it . Because yes, it will be a jury. But between now and then it is the court of Public Opinion that will influence and every american will become aware of right so he could have put this new evidence out there. Are you disappointed he didnt know because im wear two hats far be it from me to preach about. The court of Public Opinion and using television to shape even in a legal matter. And you know my history so sure, i believe in that, but i also know that this is about 12 people that whatever anybody says any pundit or any politician, its going to boil down to the 12 people and what i said to you and i predict i will be right and i was amazed over all the hours i spent with the prosecutors with mr cohen is the level of corroboration in documents and other witnesses. That will be presented to the jury. In this case, what is unclear to me and left unsaid is the legal theory that escalates the appears to be undisputed, um , Fraudulent Bookkeeping that as at the misdemeanor level, the escalation to the felony level, well just have to wait and let the lawyers thats the do they do they prove the election . The election motivation, right . Thats a big question, and we did. We didnt get more information on that today. We did get judge marshawn Warning Councils on both sides about there. Im not going to issue a gag order. But then he went on to say, quote. Id encourage the councils on both sides. Please speak to your witnesses. Can i speak side would do you think he was talking about Michael Cohen . Well, i think he might even be talking about me. So id like to speak to that. I think everybody has to show restraint now in talking to the media, because now its before a jury up to this point. Ive been defending Michael Cohens credibility. Hes my client. Hes my friend and i believe in his credibility, and i believe that when he stood up on it was very important day in front of chairman cummings, February 27 2019 Tens Of Millions of people, he said. I lied. I am ashamed of what the dirty deeds i did for donald trump. Now im ready to do this for my country and for my family, and since then he has substantiated everything thing, he said before congressional committees, the grand jury, no Fifth Amendment and the documents that we looked at over weeks and weeks with these prosecutors. Fortified us that they substantiate in Detail Everything that michaels ever said. Right but youre saying you believe the judge is talking to you as well . Well i think i have to. What was your reaction congressman seeing the former president . Under arrest in court today in new york, and learning of these 34 Felony Counts. I mean, look, honestly, wolf. I thought it was a tragedy. I thought it was a joke. Even in this indictment, which a lot of people have had to read now, because its not very long. They dont even site the actual felony charge. Theyre saying that something to do with the 2016 elections and he was trying to subvert the elections and some new crazy scheme. Theyre citing, uh, bookkeeping in the state of new york as the layup into these these these felonies Felony Charges, but they actually dont cite the charge. So what are you supposed to do with that . I mean, its clear that alvin bragg was on a mission to indict donald trump. And so thats how we got to where we are. But you say 34 felonies. But what are we actually talking about . What are the actual charges . The indictment explained. Speak to it. The prosecutors argue in this indictment that trumps goal was to hide damaging information. Thats a direct quote, damaging information from American Voters just ahead of the 2016 election. Doesnt that concern you . Um time out, at what point is trying to either let me heres a better question for you. Wolf Hillary Clinton spent a Million Dollars on affect dossier, citing that he was a russian plant. We all know that to be true. So its okay to spend a Million Dollars of Campaign Cash to create a phony dossier to secrete through the media to tilt the 2022 2016 elections. So he piles that into this indictment, which, frankly, doesnt even really site what hes talking about, except the 2016 elections, and were supposed to sit here and take this seriously. No this is politics, and its gross politics. This is a type of thing that the American People dont want to see. Look you can have disagreements between republicans and democrats. I have strong opinions of my own. But to say that youre going to shoot home sold some shoehorn some phony situation into a felony indictment or 34 felony and site mints that is a stretch that is a kangaroo court. Well thats what the prosecutors are alleging, and well see what happens when there is a trial at the end of this year or early next, the judge today warned both sides congressman against inciting violence after prosecutors argued that trump made direct threats through a social media posts. Does the former president need to speak carefully at maralago tonight . Look, i think if i were in his shoes, i would be very clear about how this is a political persecution of himself being the leading candidate for the presidency of the United States. I would speak to that. And then the thing that i would also do is make sure people understand that we have to get our country back to law and order and actually, following the not the law, not creating the law just to suit our own interests. Thats where he should stay and then talk about his record when he was president of the United States and how that is a far superior record. Then that of joe biden, which everybody basically knows. How worried are you about these other criminal investigations that are underway right now, whether in georgia or or in florida. Look the one thing i am concerned about is where you have prosecutors. Now who want to, you know, get their 15 minutes. We try to come up with some novel legal theories about trying to raise indictments. Im very concerned about that. But if you want to speak to the stuff going on in georgia, the stuff going on in d. C where theyre still trying to blame what happened on january. 6th squarely at donald trump is if he ordered people into the capital the facts dictate that never happened. He ordered nobody. He organized nothing. Those are the fact patterns. We looked at that in the oversight committee, frankly , before nancy pelosi shut down the oversight committee, but well move on from that. Im not as concerned about what they actually might legally come up with. Im much more concerned that theyre going to do with alvin bragg has done in manhattan. Its atrocious. All right. Oh, this unsealed indictment hasnt quieted the republican critics. Has even brought out some new ones. Tell us what the reaction has been. What are you hearing . Thats right. We havent heard a lot of the similar reaction that we heard in the aftermath of the leak of this indictment over the last several days, people like speaker mccarthy, saying that alvin bragg would be quote held accountable, vowing that he would they would use the power of their House Majority to investigate. Alvin brags actions here. Other republicans also falling in line, but in a notable reaction from one very prominent trump critic would in the Republican Party, mitt romney, someone who voted for two trump impeachment, someone who says that donald trump should not be elected president again. He came out and he criticized alvin bragg in the aftermath of the unsealing of this indictment, he said in his statement. I believe President Trumps character and conduct make him unfit for office. Even so, i believe the new york prosecutor has stretched to reach felony criminal charges in order to fit a political agenda. He goes on to say wolf. The prosecutors overreach sets a dangerous precedent for criminalizing political opponents and damages the public faith in our justice system. Now not all republicans have been vocal. In fact, Senate Republican leader Mitch Mcconnell has not commented since the news broke on thursday that donald trump has been indicted and in the aftermath of this is the actual details coming out. He still has not commented. Neither has the number two Senate Republican john thune. Both of them have been silent, but both of them are view. Donald trump much differently than Kevin Mccarthy. Does Kevin Mccarthy aligns himself with donald trump because he credits him for winning the speakership on the 15th ballot. Mcconnell and thune are eager to move past the trump era and are staying away from the details of this endowment right now and if some democrats are weighing in, but not many in the top democratic rags, our ranks are embracing this yet. Chuck schumer, the Senate Majority leader, did issue a statement before the trade. This was unsealed, saying that this investigation is case really should be devoid of outside. Influence but he has stayed away from weighing in on the mirrors of this case, as has the top democratic leader, hakeem jeffries. Up to this point and Wolf Congress is on recess this week and next week for the easter holiday. So that is one reason why there are not many members who are weighing in some of the most vocal ones are siding with donald trump, but some other ones who might be more critical. Staying quiet for now. Well, for now, keywords are no thanks very much, aaron, and were showing our viewers live pictures of trumps plane landing in West Palm Beach to Palm Beach International airport. Once he gets off that plane, he and the motorcade will go to maralago will be speaking there later tonight, all right, and its sort of a long day for him, and i guess thats sort of two hour break on the plane. Was that a pause that you know insights or refreshes or calms . We will see, of course. When he gets to maralago. Now the arraignment transcript has just come out. So my understanding here ryan goodman, karin agness follow are are here. Attorneys 32 pages. You both have had a chance to sort of skim through some of it. What has stood out to you so far. Ryan one of the most important parts, i think is actually to see the judges exact words. When he talks about whether or not he would impose a gag order, which would basically prohibit parties. Potentially President Trump from being able to speak about the case on social media and the like, and he says, im not anywhere close to that. Im not going to issue anything thats even close to a gag order today, but he does say at the same time if he were to ever consider it as you and i have actually talked about in prior shows. Not only is their First Amendment concerns on the other side of the equation, but that it applies quicker, doubly to mr trump. And that his First Amendment rights would be critically important because hes running for president. So thats one piece which is significant, by the way, very thoughtful of him. I mean, this is a judge who, by the way, among other things that trump has said so far is that this judge hates him. Get him and the judges responses you are afforded double consideration because youre running. I just sort of bend over backwards to try to not impose the gag order. First amendment times, two times two karen would send that to you so far. So i was looking at the protective order question that was also discussed after the arraignment. I think the arraignment on the charges took place very quickly. It was in the beginning, and we were all wondering, sitting here whats taking them so long and what really was started taking shape in there is a request from the prosecutor to put a protective order on the material that soon going to be turned over to the trump team, and i think what they really want is to interest would be text data emails. Whatever this is, your evidence is the evidence. Since this is the grand jury witnesses, the witness statements, the police statements, literally all the evidence but all the every single thing in the trial the discovery laws require you to turn over your entire file to the defense within 45 days, and so what the prosecution asked for in this case as a protective order, which is sometimes done not always done. And when the request is that mr trump and his team should not be able to use these materials for any reason except to prepare for their defense at trial. That number two no copies should ever be given out that you should only be able to look at them in the Attorneys Office in the presence of an attorney and number three. You cannot give these materials to a third party or post on social media. And what was interesting was the prosecutor who asked for this protective order on the record, said its because of the fact that mr trump has been threatening witnesses and trying to try this case in the court of Public Opinion, and he said we are we are the were working out a way that the defense and the prosecutor will consent to the limits of the protective order, and it looked like they were coming to an agreement. But then afterwards, Donald Trumps lawyer said, but we just got this indictment and this prosecutor filed a statement of fact. Ah thats not fair for us to not be able to respond. Also we have Michael Cohen, who has written two books, has a podcast and talks about this case. Every single day. Every got youve got a former, um assistant d a. So i thought that was very interesting. Interesting point and honestly, and theres merit in that. I mean, that is fair. We do hear from one side all the time, however, to it wasnt just lanny davis, he said to both the defense and the prosecution, talk to your witnesses, and i think he was largely talking to Michael Cohen. Hes gotta stop talking because the integrity of you asked lanny about that. And he sort of said he thought he might have been talking about him and that he would be more careful. He seemed to be, but whats interesting here is and, you know, remember that if we look at trumps behavior, for example, in the maralago documents case we know about that, because trump leaked it. Trump is the one otherwise we would never know. We would not have known about the investigation. We would not have known because the fbi certainly thats their protocol to not discuss it publicly. So its interesting to hear that, you know, while they may be talking about Michael Cohens behavior, trumps own behavior kind, and there is a pattern of him using the information in the public, not just in this case, but in other cases, i did think that was interesting, as ryan points out that that a judge who trump has slammed repeatedly took the calm considered thing of saying not only am i not gonna respond im not going to do a gag order. Youre running for president , and thats very important. And im gonna do everything i can to not do a gag order because you should have that right to free speech very considered, and hopefully giving people some sort of confidence in the system. People were paying attention probably have confidence in the system. You remember, i said donald trump issued a email today where hes raising money where he fabricated a mug shot of himself right. So like goes towards his state of mind in which he said while we are living through the darkest hours of American History, i can say that, at least for this moment right now, im in great spirit. All after he pleaded not guilty in the new york courtroom to 34 counts related to Hush Money Payments before the 2016 election. All of them were Felony Counts. We are all seeing supporters now that some of them lining the roads where trump will be driving by waiting for the motorcade to pass. And once he is back at maralago trump is expected to take a brief break commenced freak publicly for the First Time Since todays historic meeting that room that big ballroom in maralago also filled with Trump Supporters. One of the things that you noted, is that in addition to being a former u. S president , he is also a candidate for 2024. A lot of what theyre doing is looking at this through the lens of a 2024 candidate and linking it to being political. That is, in part why you have seen them linking alvin bragg. To democrats to joe biden, in particular saying that this is quote unquote. Election interference and we dont expect that to stop. The one interesting thing we will be watching for is how republicans change their messaging at all. After today, as we have noted there all of these this commentary this big defense of the former president comes without anyone having actually seen those charges. Well now they have seen them. But if its any indication on social media on conservative talk shows those republicans are going to stand by and we have seen several of his allies out there. It was so quiet just to the kind of historic moment that was really settling in on everyone, including it seemed the former president , he walked very slowly down the center aisle, scanning the aisles that were filled with reporters. But taking this walk very slowly added to kind of the weight of the moment and the anticipation in the room, you know, then he was at the defense table. It was actually off to a pretty quick start. Once the agreement began, the judge asked him how he pled to those 34 counts of falsifying Business Records in the first degree felony, and trump said it himself, not guilty, you know, then they went on to deal with some other legal issues that prosecution also raising some of these questions about trumps rhetoric, the threats, verbal attacks that hes made against the judge and against the District Attorney alvin bragg, trumps lawyer, saying that hes been frustrated because the das witnesses, including Michael Cohen has been on television in print stories. Talking about the case. They said that trump felt like he couldnt say anything. The judge said that the frustration did not justify these tweets. He asked everyone, both the prosecution witnesses and the former president to dial down their rhetoric to not say anything that could be viewed as inciting violence. Or civil unrest. Interestingly trump was flanked by his legal team, including his new attorney, todd blanche, who was added just yesterday to this legal team, but he had no family members in the courtroom. The only other associate was another attorney, although hes not working on this case, boris epstein, but someone who has worked with trump and his close adviser, otherwise, he was flanked by the Secret Service to as he exited the courtroom, and it was only after he left that we were all allowed to leave the building wolf all right. Tacopina continued to say they were just they expected that they would see underlying evidence here that they didnt and he does not think it will ever get to trial. I think its going to trial. You think it was his current trajectory . I mean, he might want to say that, but it is a kind of a solid, falsifying Business Records. Case so it looks like other cases like it doesnt look like the other charges that might be coming against trump. But just comparing apples to apples. It looks like other ways in which the d a s office does charge somebody for falsifying Business Records, which in this instance is calling the hush money reimbursements to Michael Cohen Legal Services and illegal retainer that doesnt exist or didnt exist. So thats one part of it. And then theres been a lot of conversation about they need to tie it to a second crime to make it a felony. That is where i think there will be trouble, which is just fine. And they did. They went to felony route. Theyre trying to go that extra step to say that it was done in the furtherance of winning the election. Thats right. And then there is a bit of a surprise today and there hasnt received as much attention which is that paragraph two of the indictment last sentence says these words. The participants also took steps that mischaracterized for tax purposes, the true nature of the payments made in furtherance of the scheme that are that state tax crimes. That is a stronger case because its insulated from a bunch of the legal challenges, of which there are strong legal challenges to be made to the election. Law crimes, alright, but that would be a felony that makes it a felony because you got to write. So theres two okay, which is significant now. Karen trump just moments ago called into a prayer call of sorts. This is what it was. Anyway. He commented on it on the case is the first thing that weve heard him say, since he was there. And he said, not guilty, so lets hit it into the line, he said. Were going to a fake, uh, investigation. Thats what it is by radical left. People that i believe actually have to hate our country. But were winning. We had a great day today, actually, because it turned out to be a sham. So karen put aside the politics for a moment of what he said when they said, turned out to be a sham. He is referring right again putting aside the politics to the fact that we didnt get more information from brad more underlying information, but braga said that it is there and it will come out. Yeah. Look, i think its important. Hes trying to politicize this prosecution against bragg, calling it calling them radical left extremists, etcetera, and you have to remember that alvin bragg was handed three separate cases involving donald trump to our investigations. One was one was an indictment. And alvin bragg when he took office a few weeks into his term, one of those investigations that was started under servants was handed to him and presented as if it was ready to go. And alvin bragg. If this was political could have just said oh, great. Lets go. Im going to bring this case. But he said, hold on. I reviewed this case. I want more evidence because im going to follow the facts where they lead, he said. So he and he decided to continue to investigate these cases while he prosecuted one of them. So theres nothing about today that that strikes me as political and calling this a sham. Theres nothing about this. I think that seemed like a sham. I mean, he was handed a statement of facts that gives the information its a lot more than just the Stormy Daniels Hush Money Payments. Its clearly talks about the payments to Karen Mcdougal and payments. To a doorman as an overall way of trying to influence the election. So i think we did get a little bit more today because it was unclear if this was just going to be about Stormy Daniels or a broader, include Karen Macdougal and obviously a doorman that had also been part of the catch and kill scheme. You know, margaret 11 thing about this is when you talk about the law and the politics, you know mitt romneys statement i thought was interesting, he says. I dont think that im not quoting him, but im close to it. Trump is unfit to serve, but this was political. And this is this is a problem. And that was mitt romney, who was, you know, voted to impeach and that there, youre starting to see some of the lines being drawn here. Even within the gop. I think romney rather than saying it was explicitly political, said that the District Attorney or that alvin bragg stretched this beyond the scope of maybe the discretion that another District Attorney might have had. As there are other republicans have been honest, aaron said, as republicans who do not support donald trump, who do not want him to be the standard bearer of the Republican Party, wished this had been. Um frankly, i just frankly, a much more robust slam dunk case against the former president , if youre going to take the step of indicting a former president of United States of a raining on television. Former president , United States you would hope that it was something that just sensibly was easier to explain to the public that is, is as simple as 11,780 votes in georgia or stale, stealing documents from the white house and not giving them back and then obstructing. I mean, there are other cases that are more cut and dry. What i continue to wonder as we are here in this moment, and this was relevant because it was the first but it may just be the first and against the backdrop of these other cases, all of our analysis about how flimsy this cases compared to that case may become moot. Right the fact is, this is a man there is a fact pattern here. This is a man who has thwarted the law who has polarized the country and is diminishing our system of rule of law and realizes a series of procedures and laws that we agree upon is going to beat the system. He needs to beat the system from within the system rather than rallying people against it. And monetary you. Obviously you know him. Alvin bragg. Um and you know what youre feeling is to his decision to do this to go first, even given what he knew would be a perception among many right maybe partisan. In some cases, perception, among many that this was not the way the first thing to go. Largely a partisan consideration that people have been making with respect to, you know, saying that this is attenuated, i think, look, we should not be raising the bar. For prosecution simply because he is a former president of the United States. I think if i had committed these crimes or if someone else at this onset had committed these crimes, you know, we wouldnt be second guessing. I think, alvin in the way that you are running for congress that anybody would have no offense, but im saying Congress Versus former president anybody would have cared enough to look and pursue these crimes. You really believe that . I do. I do. I think if the if the evidence had been elicited in some way that the evidence was in the possession of a prosecuting authority. That plenty of people would have been prosecuted for this crime. Look to your point. Ive known alvin for over a decade now, and ive made the point that karen made earlier for a number of days now, which is that . If alvin bragg were engaging in political persecution. He would have done the same thing in an easier case , frankly, that someone like Mark Pomerantz and carry done resigned over. I mean, Mark Pomerantz famously wrote a book arguably unethically. So tell, tell all about how you know trying to get trump. If he had been the d a. Then then he would have prosecuted donald trump for personal and Business Financial dealings. So that is consistent with alvin did in that case is consistent with what i know about him, which is he is someone who follows the facts. And then applies the law. And he does not care about Public Opinion. I think thats what we want more Different Countries of a broader conversation about though, if were going to keep saying that about people, maybe we shouldnt elect them affiliated with Political Parties to these positions. Uh now whats interesting here is trying to use, you know, to get this to a felony account, you say oh, we were doing it in furtherance of winning an election. Ah but whats interesting here from what youre reporting is that bragg has tried Something Like this before. So i mean, what hes done here is he is paired up one very standard set of laws with one very unique partner in this idea that the partner well in terms of the muscle left right, the one that the one that says its not just falsifying Business Records, but its for the purposes of influence in an election. Um and theres a state statute that goes with that. These havent been together before, in a similar case in new york state. Um so people are talking about, you know, motion papers. Theyre coming. This is going to get dismissed. This is never gonna work. Practiced, did a case where they used a state. New york state, not federal Terrorism Law for a crime that occurred in two other countries for a defendant who had never been to new york county, too, it manhattan. And everybody said that case is going to fail. It started under it started like this and investigation, underside advance and it was completely unique defendant was convicted on all charges and sentenced to 18 years about the week before last so what im saying here is, um, just because it hasnt been done before. Theres no amount of spin that you can put on it to say that this was a great day, but tonight he will be back in that comfort zone of solidifying that support where he has such a unique, strong bond with his core supporters and going on the attack. I think not just on this prosecution. I think youre gonna hear him go on the attack on all the other investigations that are out there. The Fulton County won the two avenues of the special counsel investigation. Federally here. I think hes going to try to lump it all together as this is a political set of prosecutions, potential prosecutions, and its not as he says that the rallies theyre not just coming at me. Theyre coming for you and im standing in their way. Thats his ability to fortify that base near the way in. What are you gonna be listening for his remarks tonight . I think the thing about donald trump is he isnt what he used to be right. Hes almost like a feeding athlete. Hes kind of lost a step in his fastball isnt what it used to be much of what weve you know, hes going to say tonight. I think david lays it out pretty nicely. Weve heard before. Weve heard his taxes. Also well see what he says tonight, but i imagine it will be sort of Donald Trumps greatest hits about grievance and people going after him and him being sort of the only person who can stand for the folks in that audience in the republican primary voters, and i do think it will be sort of a call to arms for other republicans right to say, you know, this is a witch hunt, and youve got to stand by me and listen so far, republicans, even his potential opponents like ron desantis. These are essentially, you know, backing him and holding his hand through this whole thing. Its interesting. Uh, elliot. Youve been going through the transcript of the actual arraignment in new york earlier today. What stands out to you, and its interesting as we talk about all the politics. Theres this Court Proceeding today that was in many respects quite mundane and not unlike the kinds of criminal hearings you hear about all the time, so number one, they really went into just some of the basics of setting dates. When are the motions do . How long do you need to get your papers together . And they set that date for august, but to legal points that i think were significant number one. On the judge does give a light warning to the former president about the social media says that i cant because of your role as a as a political candidate and a free speaker in society. I cant silence you now. But sort of watch it. And he sort of puts that out there and then to he. Also they gently asked trumps attorneys for whats called a bill of particulars to clarify the indictment a little bit. They hint that they think you know what . You know, theres some debate about, um, whether uh um , you know, marrying the offenses in the way that was done in this indictment. Can get , um get passed a motion to dismiss. Some people believe it can, um others others dont believe it can and this is people on both sides of the political spectrum. I think i think the real challenge here is and i have a lot of respect for savons. I knew his father thought he was, you know, one of the Greater Public service that weve ever had. Um but i also think for servants to complement this indictment is a little bit like the beach boys song be true to your school. I mean, it was his. It was his office. So i wouldnt expect him to say much else. On the other hand, it it is. It is, um, it is a case now its going to be played out in court. There will be motions and somebody mentioned the bill of particulars earlier. I think based on uh, cant enter the indictment that develop particulars. Would ordinarily be quite likely here because there are many gaps to fill up and i do think that there will be motions to dismiss motions for bill of particulars. I think there are also be, um you know, a lot of emotions based on you know, can you really marry the statues in the way they are, and i thought that the most interesting thing for me at the hearing today if i might was the fact that the judge said, you know, Have A Nice Day. Ill see you in december. Um because that suggests that suggests that this case is not going to move at the speed that the public had expected and hoped for. Um so and then i guess the you know the other issue is you know i have is, uh you know, there is a there is a f 35 missile armed weapons being piloted by jack smith with Merrick Garland as his wingman in d. C thats going to get off the ground soon in the maralago obstruction case there will that will make this look like you know a water pistol. Ah fired earlier. Its just nobody is going to go to jail in the in in the new york case. The consequences to trump or not going to be significant, and its going to cost new yorkers Tens Of Millions of dollars. A s office do their job today is going to look like nothing compared to the more significant crimes that this president is alleged to have committed, right . And you know what . I talked about it, cobb, his foreign lawyers into the f 35 down in washington at the doj, but you know if you get obstruction of official proceeding, and if you get, you know documents and if you get georgia, you get all of those things. I guess, ryan. I mean, i know its impossible to timeline. Everything but will we get anything brought to a final conclusion, guilty or innocent in a court of law before the election . Maybe not. Maybe this case could wrap up late 2024. But and thats the bragg case case, which is first on the on the conveyor belt, and but i do think that we will get indictments in all likelihood in these other jurisdictions, and they might be something that is not as bare bones as this one that really tell a story so that the public will already have a sense of just how robust this cases and i do think that the conversation on those evenings are going to be quite different than the conversation tonight. But karen it when we talk about this case, this would probably be the fastest at least that we understand it and still going to take us possibly into next spring. You know you were laying this out as weve been talking that thats not delay or anybody slow slowing it. Its just thats the way the wheels of justice turn. Yeah, thats about the right pace here in new york and state court. It takes about a year give or take, and in a case like this, they made they had an along along adjourned date into well into december. But that was because many things are going to be happening. What they call off calendar there just not going to be a Court Appearance, but there will be deadlines for the defense to file motions for the prosecutor to respond, and then the judge will have to make a decision and but theyre pushing for the spring for this case too late winter early spring for this to be clear for everybody, thats you know, well into the primaries, you know pretty much done when you would know who the nominee would be. I mean 60 or more as far as i understand it from john millers reporting against people involved in all of this already threats of violence against them. So what do you expect him to do tonight . I think he probably will stay on message and avoid any attacks on the judge or the d. A. If he is smart, because if he were to not do that, i think that a gag order might be put in place. Obviously the judge has not gone forward with one as of now due to him being a president ial candidate, but obviously if he starts to do the attacks again, which i dont know if hell be able to resist.
