The City Attorneys Office has looked into the contractor and for we are very close to being finished with this contract. Its not really new money per se. Its part of the contingency budget. We were given assurances that moving forward they wouldnt be allowed to bid on projects. The problems and allegations against this contractor doesnt relate to this contract. There was a determination in order to complete the project, basically we had to finish the project. The allocation as it general manager noted doesnt require new money to finish the project but the conclusion was while we understand the allegations and the problems with the contractor. We just had to finish the project but moving forward, the commissioner, we respect and hear your comments and assured the contractor wouldnt be allowed to bid. I believe general manager for five years. I, my understanding is they have been banned for bidding on City Projects for five years. This is you know, i totally understand and share the commissioners concern. This didnt involve this particular project. Am i hearing correctly that we have no alternative or that we have determined because this particular contractor, the issue of concern for the project it was determined it was able to move forward on the project. Commissioner, there are a host of issues im not sure im prepared to fully respond to. Some of them are actually leader in nature and part of the agreement or work that went on through the City Attorneys Office and board of supervisors that allowed them to finish work thats been started. It would put the project in jeopardy and cause us conflict they are legally permitted to finish the peace of work. Ill conclude with a quick statement. Its unrelated to this project and made the determination this contractor cant bid on any project for the next five years. Under that same agreement they are allowed to finish ongoing projects because they understand to unraviolile unravel a project would be detrimental. They are allowed to finish any projects not just with rec. Park but puck lick works. With that, i dont see any other hands up. I concur with commissioner mazzola. We dont want to do business with people that lie and committee and undercut the system. Its that simple. It seems we are in between a rock and hard place between this contract and i share the view of the general manager but we must finish the contract and we wont see this contractor for at least five years. So, this contractor has had many chances to do the right thing and has not. They have been fined by the office and had to pay back pay to the workers. Im not sure if they have gotten that yet and pay a penalty for the wrongdoing. Im not sure if they received the fine either. Id like staff to make sure they made the payments. This contractor continues to misassign craft work in pulmobeing, electrical, sheet metal, everything to a different trade so they can get a lower bid into you guys and committee the workers that should make a higher wage. This is a similar situation to what was discussed earlier. Its not as bad but these people are still cheating. There is a law they continue to break on our park and rec. Jobs. Im not sure why we reward contractors to come in with a low number and get the jobs. They were taken because of the low bidder. They are a low bidder because they are putting in a low rate and cheating the workers against the law. Ill vote again on e not to give them the extra money not to do the change order. Again, let me remind the office of Contract Administration has jurisdiction of the administration of the contracts and wages. I suspect, commissioner that legislation that pasted and agreed to implement moving forward with contracts over a certain threshold to help prevent this in the future. Im not sure if they paid or not but they got a fine levied against them. The chair, i was wondering if we can condition this final payment of the fine and back wages. There are two thing id like to say. Its not uncommon to be fined during the duration of the project. They are given the opportunity to respond to the fine and in most cases. In this particular case this is the first time i heard about this. My understanding is that this will be adjudicated fully. We do owe funds back for this fine. They wont be paid for that money way. They are not paid for it. Its something i can look at. Just to clarify, is this funds that we are awaring as additional allocation under this motion or a general retention that we have for completion. This is separate funds we are allocating that is coming out of our contingency. This is not a request for additional funds. This is funds to address this. If you look at the details of this particular request most of them are coming from dm as a result for the work we are doing for them. So, the funds we are approving is coming from a contingency line item. Not our overall retention. Thats correct. I guess, again, can we actually condition the subpoena of the reallocation of contingency funds to the settlement and payment of back wages. Payment of back wages really troubles me. Commissioner, i certainly take the commissioner at his word. Im not sure of where we are with respect to due processor investigation or adjudication or appeal. I would just ask everyone to be mindful of that. This is the first time anybody in the department is hearing about this. As a matter of practice, city wide. Subsequent to that. 295 was adopted that prohibited issuing building purr mitts for structures under 40 feet in height. Unless the Planning Commission finds that the shadow wouldnt have an adverse impact on the use of the park property. The commission aadopted the 1989 memo. There was quantitative criteria that i will detail later for shadows and parks under the jurisdiction. Approximately 7,000 square feet at the ground floor. It would include 23 Parking Spaces and one car share space as well as 51 class one Parking Spaces. Its private and public common space approximately 3,000 square foot roof to have deck. Its achieving a density uponnous through the state bonus program. It will provide nine affordable units onsite in addition to an Affordable Housing fee of 1,040,000. They held a preapplication meeting on november of 2018. More recently they met with several Community Organizes including the lower polk neighbors, the Neighborhood Coalition and discover polk. Letters up support have been received from the first three. Staff received three emails including construction noise, dust, and street access. It will impact the traffic visibility with additional density and overall height. As you can see, the more frequently that occur towards the northwest this is for four separate directions. The farther away from the project site. It expands towards the Northeast Corner. Quantitatively, they generally spend summer through spring there is an average did your asian of two hours an average of 586 care feet it would fall across the south herb area of the tennis court the elevated walkway and portions of the court. Next slide, please. As you can see the project in blue occurs when its covered in existing shadow. It covers portion of the playground towards the corner intersection. The data occurred on november 1h and january 26th. It will gradually peak at 3 45 p. M. It would cover 4,150 square feet. The chart on the right shows the criteria previously mentioned as you can see they are more pronounced in the afternoon during the fall appeared winter. Next slide. In closing id like to reiterate the memo has quantitative and quantitative criteria. The 1989 memo provides guidance parks less than 2 acres in size with 20 existing shading thats the case with this park. There shouldnt be anymore shadows. Qualitatively it includes the time of day of the shadow, time of year, shadow size, shadow duration, shadow location and Public Benefits of the project. Next slide please. Well, let me say my observation is when there is an absence of Community Comment and a little controversy surrounding a project providing housing and units at an affordable rate, we are included, particularly when there is a small instringment on what i understand a park thats 32 shadowed the little shadow it does have is usable space. We are not the End Authority on this. This will go to the Planning Commission on this. Ill try to put that in context without giving strong direction on it. You know, with so must shadow on the park we are taking away usable sunlight in usable spaces. I wish we could invite the Planning Commission if they were so included if there were modifications that would minimize that and serve the purpose of the park. I wanted to point out our air angles. These are the big blue machines our visitors will encounter. The first slide takes them to the front of the zoo. It measures air quality. We are fortunate to be on the coast and ocean. During fire season we must keep visitors safe during that time we were in hazardous conditions. We moved them. In my next slide well move these to the pinguin exhibit. Air quality is not an issue but congestion of visitors. We use circle pods to try to enforce 6 feet social distancing. The air angles are recording the space and otherwise. We discovered which were achieving 86 on adequate social distancing. We moved some of our items and safety ambassadors to achieve 99 effectiveness. In the same token we were using it safety ambassadors to audit face coverings and our audit showed 99 adherent to face coverings. This is well above my zoo callings. The Sacramento Zoo is only getting 60 respect. I thank my staff and the community for this. My next slide will give us highlights from the fall and in october. We try to use this to connect visitors to our. Events were limited. We were able to properly honor our lee measures on world leamer day. We had the mayor come out they were there to see our rescued lemur. We awarded this young man a lifetime membership since hes only 5 he will live beyond most of us. We tried to put it in all databases that he will forever have a lifetime membership and we thank him and his church for his recovery. As we go into winter and holidays, of course, we are aware that we might be more limited in attendance. We just opened the train. I understand if we change to purple we will have to close again. Commissioners this is my fifth year in bringing to you these. The tool we have developed to quantify and measure equity as part of proposition b back in 2016. I like to read the short reference in the charter. This is the department shall develop metrics to establish a baseline of resources and low income neighborhoods and disadvantaged communities. Compare the services and Resources Available as a whole. Thats what we did and continue to do. We will use this tool still based on the data provided by screen 3. 0. I will note, this data has not been updated since 2017. There it is, thank you, ash. Its a combination of population indicators and Health Indicators as you can see there. This includes a factor for nonlight and social i cant economics. The ten characteristics are equally weighted and accumulative they are ranked, they are compared to other track in the city based on the total accumulation of the ten factors. When we look at that on the map. This is what ashley is holding now. We have disadvantaged as it highest 20 of the characteristics. Next one, ashley. When we put the those to the highest 20 of talks on a map with our parks. This is what it looks like. Begin, this is the highest 20 compared to the city as a whole. The two colors are irrelevant. Its the whole of purplish pink block is the equity zone. The lighter part is a buffer around the track. Once we have them on the map we are able to identify the parks in equity zones and take a look at what is offered there. Okay, next. Will be impossible to see for the camera. Well, there you go the number of parks has not changed for the last few years. Nor has park acreagement the numbers have changed but the percentage is almost identical as its been the last few years. Maintenance, i dont need to go through all of these. I will highlight that despite the conditions of covid19 we have maintained our parks at the highest level ever. This is as evidence spread park evaluations scores continue to go up. Okay, ashley move it up just a scooch. There you go. Our Capital Investment is huge. Part of this is the effect of new developments playing out. We put these to use put the it up a scooch. Yeah, good. The percentage is now double 40 what 40 of all of what we provide is provided at facilities that are in equity zones. We have two new metrics this year this is probably the most requested additions and expansions of the metrics which is access to play areas. 46 of all of them are in equitify zones. When you talk about kids 22 are in equitify sobs collarships this revealed how much and efficient our marketing and outreach and education. If you come in and qualify you get it we see we are hoping to educate those likely to qualify with 69 of our scholarships going to those who livein equity zones the kids in nature went up 1 this year. We had quiet a bit of programming this year. In years past it was closer to 4,000 slots. This year almost 7,000. We have our slightly above proportion of participants. Thats what the charter requires we are far beyond the charter now. I must highlight other things the department is doing. Next slide. We are doing a lot of internal training. I dont want to call it training but learning. We have done equity workshops. We have renamed them race conscious workshops. We have all come to understand there is no such thing is color blindness. To make any progress from where we are we need to understand how we got here and acknowledge where we are. We have had over 400 people that participated in the one way of conscious workshop. This is the commercial lead by our own commissioner mcdonald. We are expanding the concept. The staff has embraced the lbgtq equity for use. We also look at, we have developed a powerful data dash board for all of our Human Resources staffing evaluations and analysis. It allows us to look at age, gender, and race for any slice and dice of the department. You can look at our whole staff in this is the staff compared to the market. One point of interest is, while the labor market is 48 white. 36 of our work force is white creating room for a more diverse staff. We have a lot of work to do to make our staff reflect the public we serve this helps us have the capacity to do that work. Next slide. We have also, you know, activated part of development and coming attractions we have done a lot of great activation including the tech hub i got to last week. They, shea really show it. Get a device and sitin the grass and do your work. There were people working when i was there even though it was pretty cold. It was exciting to see. To access the help menu. Slack. One of our great achievements from the terrible year is we got funding and we were able to implement this is focused on bringing, you know, providing access to recreation to those most disadvantaged, most isolated people in our community. This includes those that livein shelters. Public housing or support of Public Housing through the mayors office. Its free. We bring recreation on sight or hype local down the block kind of thing. We bring a lot of outreach. Okay. Next slide. Its important to acknowledge that the the charter mandate that was written in 2016 does not reference race. I would call our equity work per the charter economic equity, but a lot has changed since 2016 in our commitments and our focus, and theres now an office of Racial Equity embedded in the Human Rights Commission that is focused entirely on supporting the liberation of black, indigenous, and colored people in San Francisco. Theres a website there, and i encourage you all to go visit it. They issued a framework, kind of a template, the end of june for every department to follow to submit a Racial Equity action plan, and those are due back to the office of Racial Equity at the end of december, which means we will be bringing ours to you at next months commission meeting. Theyre going to give us a grade, a report card, and then, that equity that Racial Equity plan is to be updated annually. So we can look forward to that kind of focus on Racial Equity, and that concludes my presentation. Im happy to answer questions. I really appreciated this last presentation about equity and recwity. Im concerned about the greenbelt at 2100 market street. This is the castromarket metro muni station. In there are two parks slated for demolition being pushed by senator scott wiener, and he has used a rec and park state grant of 1 million to continue with this demolition of our precious greenbelt, an lgbtq cultural site. Im concerned that this site that was designed in 1973 and completed in 1976 provides access to nature, it is a route to a playground as well as a dog park within the five minutes that you just addressed. And in 2018, i personally submitted, along with Property Owners and renters adjoining this site at 2300 market street, two applications to mohamed nuru as well as s. F. Parks alliance. Ive collected over 1700 signatures supporting this initiative to support the nations first lgbtq Veterans Grove which was approved by city hall in 2012 and the lgbtq veterans who served in our military. And the Second Street park application is called harveys garden, a watershed garden. Currently, public works manages that space, but it is basically an ongoing garbage dump, and honestly, last the last 6. 5 weeks, ive been calling and calling and sending in 311 requests to cleanup garbage and graffiti. Its really terrible. We want to encourage people to come to the castro during this pandemic thank you. I just wanted to share a little news with which we can all feel proud, this model for which well worked to build which weve worked to build, and a lot of credit goes to taylor showing how we can use state equity to shape zones is actually being adopted citywide by the Capital Cities Capital Planning committee. This model has been in effect in rec and park, and different departments have defined equity in their neighborhood and equity zones slightly differently, and this is just the data capturing piece of it. This is just a small piece of our programatic commitment to equity, but im proud to note how our model is now being used citywide, and ill taylor deserves a lot of credit for that. Thank you. Ul see a a little bit more about this in our Strategic Plan, and i think but more specifically, i think that this is an important element to talk about in the in the context of our commitment to equity specifically, so i just really wanted to acknowledge it and say point absorbed, and were going to well do that in the future. Taylor emerson from the finance and Administration Division here to talk about the update to our Strategic Plan. Because there are no changes to the goals and plans, this does not have to be an action plan, but we need to report to you the changes over the last year, the status of our performance indicators, and wed like to give you a sneak peek of the report as its shaping up for the next next five years. The Strategic Plan and the overall planning process required by the charter changes in 2016 have been a huge boom in focus and alignment, and i would also say workforce connection because we just share a vision and a language and values around our work that has, i know, helped me and my colleagues. Next slide. The best laid plans have turned inside out and upside down in approximate the last year, and this is kind of what my report is going to look like, the chart on the right. We also brought some unexpected positive surprises, including what has essentially become expanded park space in a number of locations due to slow streets and closed streets, including twin peaks, areas of Golden Gate Park, the photo on the right, and, of course, the great highway, great walkway, great play area along the beach. In Golden Gate Park alone, weve seen more than a 600 increase in people who are, you know, biking or walking or everything in between scooters, escooters, skateboards, skating. By having the road closed to traffic, not only is there more space and open space for playing, there is just more opportunity because its safe from traffic to play. So there has been some excitement internally and externally around these new park areas and new opportunities. Next slide. The first thing the charter asked me to do is to report on our achievement of Key Performance indicators. The the the proxies weve set forth for are we moving toward our vision, are we moving toward our Mission Statement . And while it was on a, you know, slow but steady upward tick in the first few years, a newspaper of the metrics do have, you know, a component that is about quantity, how many people are registered in that. So it has fallen in fy 20 and will be an asterisk like so many others in fy 20. One thing that has not changed, a metric that i always like to point out, this curve did go up. Our gardeners and custodians have been out working, and it shows in the park scores, and were, you know, really proud of this. I remember when i first started, denny kern told me the score could not go up unless we got more people, and its just turned out that we can work harder and more efficient and focused, and the squares have continued to go up, so were proud of that particular metric. Taylor, if i could interrupt for a second just in time to sort of thank the commission, as well, because of your investment. Yes. And focus on things like deferred maintenance. Yes. Both through the annual allocation of 50 of the open space reserve that goes to different maintenance and through your approval of our annual budget, which includes dedicated funds in prior years as much as 15 million for specific demands. And that, combined with our incredible hard working staff, both gardeners and custodians and our structural maintenance staff, our spaces have really been there for san franciscans in the last seven months, and theyve held up beautifully. Okay. Next slide. So as all the initiatives in the last Strategic Plan, the charter requires me to report how many have been commenced or completed, and while in past years, we approached the 70 line, this year, we are reporting 31 that meet that, that standard. Theyre fairly evenly spread across the strategies, and, you know, we had these plans are intended to be fiveyear plans, so i feel like were on track despite a lower than expected performance for the first year. Okay. Next . Just some quick highlights of what we were able to accomplish . We did host the p. G. A. Tournament, and late is definitely better than never, and in this case, it was a great event . One of the initiatives was to establish a visitor a temporary visitor popup center in Golden Gate Park, which has really proven to be kind of a gathering spot. I mean that in the safest way, with an anchor for visitors, and its great fun to shop in, also. Internally, you may not know, but we have a rec park intranet with Resources Available to staff, and up until this year, it was a pretty neglected area. It was kind of messy and hard to find what you needed, and a culmination of staff from across the agency, but particularly my colleagues in finance and admin and i. T. Have a new intranet, and it is fantastic. Its just got all the forms and tools and resources for staff. Its really great, and thats where you link to our p. D. U. , also, which is our learning portal. So again, its been and i think the timing has been perfect to have this much deeper, broader form of communicating with our disbursed and diverse staff, which are even more disbursed this year. The intranet has been an important tool to use. Okay. Next . In the pending column, these are some things we did not get to or did not get to do like we had planned . Of course, the biggest heart break of this year for the recreation and Parks Department was all the fun we had planned for tgp150 that did not happen. We did our best, and intertwined is just the latest invitation to celebrate in the park, but a lot of the big day on april 4 was lost, and theres some sadness around that still. We have, you know, anything related to schools was hush word but i having most of the spring, including all of the great programming we had planned and staffed up to do at herons head center, so were sad to have lost those opportunities, but its also ready when school comes back someday for this onsite outdoor Science Education opportunities. In the the higher team strategy, we have not yet developed the new park evaluation software. You know, this is an example of Staff Resources just evaporated. The controller got very busy, working on our staff Central Command for covid. All of our resources have been redirected, which means we have been redirected and will continue in a state of not doing park evaluations. Thats something that we look forward it is a pending accomplishment. We did do this, but its just uncertain, as so much else. Okay. Next . I also need to report on the equityrelated initiatives, which are a subset of the whole group, so there are 24 equity relates initiatives . Four of these were completed, and 17 are pending. Next slide. Couple of quick highlights about equity whether or not they were in the plan or not . You know, we converted, transformed a number of sites into popup food pantries that are still operating . Testing sites, i think thats a picture of garfields, so these have been serving disadvantaged residents, although not in a way as envisioned by the Strategic Plan. Next slide. Bayview united continues to be a force, and i always love pictures of growth, so im glad to see that one. I just want to notice that one, too that had to adapt and change based on Health Officer rules. Yeah. We were on a long hiatus, and now, we have some afterschool play. Yeah. Obviously, that picture is precovid because that kid is not wearing a mask while playing tennis. And then, the last item is community hubs, which have been a vital stopgap measure for students not getting into classrooms and getting handson support. And i think just a coordination, a successful coordination by the city and county, which is a point of pride by me, which doesnt always happen, so the community has been great. Next slide. Oh, and this slide, the general managers comments kind of stole the thunder on this, but all three of these all five projects that opened this year are all in equity zones. Theyre so fantastic. Theres the growth playground in mclaren park, which i havent been to, but i am looking forward to going. All right. Thats the first part of the Strategic Plan, and this is our next five year look, and we have a plan, and were going to follow that road and, you know, continuing to adapt and be resilient is sustained. Next slide. You know, were able to open the wheel . I dont know how long its going to stay open. When i made this presentation, we were still in orange, so the last two days have brought dramatic change, so we are adapting, and we are finding ways to still celebrate, as i said, given the current condition. Next slide, for aspiring play, i like this picture because it looks so uncomfortable to do yoga on a Basketball Court, but look at that. Theres a number of people that are in that class. Zumba has taken over a Basketball Court at delores and mission, and we are proving our strength and resilience. The next slide just shows, you know, course, in the coming five years, a huge part is going to be implementing the projects included in the health and recovery bond, 239 million, the highest bond ever, including projects in india basin and buchanan mall i mean, a number of exciting projects. Inspire stewardship, you know, typically means, you know, taking care of our parks but has come to mean taking care of the people and each other in our parks, and the signage allowed. This is going to be a real project, continue to be in the coming year, and indefinite future, i guess. All right. Next slide. This is us. I love this. This is us, and were all maintaining, you know, implementing the Health Orders and maintaining safety for themselves and our visitors, and this is our work. This is this is our work right here. Id also note that in the lower lefthand corner, theres a handsome gentleman faithfully keeping his attention. Yep, we were rapt on that call. So that concludes my presentation. There are just a few new initiatives, mostly around the bond and some things that are involved around the team in this Strategic Plan, but a lot of it just keep on keeping on with our amazing adaptation and resill yen resilience. President yee of the 26 neighborhoods we have in west portal, its probably the most unique in terms of a small little town. You can walk around here, and it feels different from the rest of San Francisco. People know each other. They shop here, they drink wine here. What makes it different is not only the people that live here, but the businesses, and without all these establishments, you wouldnt know one neighborhood from the other. El toreador is a unique restaurant. Its my favorite restaurant in San Francisco, but when you look around, theres nowhere else that youll see decorations like this, and it makes you feel like youre in a different world, which is very symbolic of west portal itself. Well, the restaurant has been here since 1957, so were going on 63 years in the neighborhood. My family came into it in 1987, with me coming in in 1988. My husband was a designer, and he knew a lot about art, and he loved color, so thats what inspired him to do the decorati decorations. The few times we went to mexico, we tried to get as many things as we can, and wed bring it in. Even though we dont have no space, we try to make more space for everything else. President yee juan of the reasons we came up with the legacy business concept, man eel businesses were closing down for a variety of reasons. It was a reaction to trying to keep our older businesses continuing in the city, and i think weve had some success, and i think this restaurant itself is probably proof that it works. Having the legacy business experience has helped us a lot, too because it makes it good for us because we have been in business so long and stayed here so long. We get to know people by name, and they bring their children, so we get to know them, also. Its a great experience to get to know them. Supervisor yee comes to eat at the restaurant, so hes a wonderful customer, and hes very loyal to us. President yee my favorite dish is the chile rellenos. I almost never from the same things. My owners son comes out, you want the same thing again . Well, we are known for our mole, and we do three different types of mole. In the beginning, i wasnt too familiar with the whole legacy program, but San Francisco, being committed to preserve a lot of the oldtime businesses, its important to preserve a lot of the old time flavor of these neighborhoods, and in that capacity, it was great to be recognized by the city and county of San Francisco. Ive been here 40 years, and i hope it will be another 40 welcome to the San Francisco Historic Preservation remote hearing wednesday, november 18, 2020. On february 25, 2020 the mayor declared a local emergency related to covid19. On may 29, 2020 the Historic Preservation commission was authorized to conduct hearing remotely.
