In the city and county department will also embrace this. So thankfully the balboa reservoir project heard us loud and clear from the Community Members and will be a reflection of the desire to retain, attract and nurture the next generation of san franciscans. The project will have two and three bedroom units and other amenities including open space play areas a child care facility and indoor and outdoor common areas for events. Overall i believe the project is thoughtful and includes many of the elements and that the community is able to see if two acre park that will be central to the project and pedestrian walkways and bike lanes connecting the neighborhoods to ocean avenue corridor. Complimentary design to reflect the existing neighborhoods and to promote existing businesses and with the commercial district and we are work on fine details of the neighborhood and Community Stakeholders to improve the project further and to have clarity. And the Transportation Management plans and management of the open space. This will be discussed in the budget and finance on wednesday and with regard to the special use and there is concern about the maximum height for the tallest building and the original parameters set at the maximum height of 65 feet and the possibility of going to 78 feet with additional height allowance from the other rooftop and with the closest to a high school and find out different opinions and highings and sections. And we dont have the exact amendments today as we are still revealing what we will have. And we will have them by the time we go to the full board. With that, colleagues, i want to extend my gratitude to the hundreds of hours comment members have spent to design this project. The staff at the office of economic work force development, the Planning Department and the City Attorneys team for all the work they have put into this. Can you give me a sense of how long this presentation is . I am not in any way trying to truncate or compress, but i just i have to go get some food in the next room. In todays committee you will be hearing two items from the balboa package, the general plan amendment and the map amendment ordinance. Two items will be before the board and the project today is the proposed development of balboa reservoir. The site is owned through the city through the sfpuc and is in front of ocean avenue at the intersection of a number of residential neighborhoods including sunnyside, engleside and City College Main Campus is directly to the east and the balboa park bike station is about a half mile walk. There are a number of bus lines and lite right running nearby. Balboa reservoir site was the first identified through the public land. Policies and past proposition k and the Surplus Property ordinance. The si city to convey and redoppler an understood utilized site with housing that could be heavily affordable. In particular the balboa reservoir project will bring new housing to the site and provide new family of all incomes the opportunity to live in the transit and amenity rich neighborhood. The reservoir is currently 1 spaces and a portion of which is leased to city college as overflow space. It implements keys a peck of the citywide equity approach in a transit richard among longstanding with Great Schools and driving business corridor. And it allows you to go to a neighborhood that is not a community of concern and on a site with no displacement of housing or businesses. And enables the provision of the high level of for a wide range of households. This project is unique in that the package of community benefits, namely the 50 Affordable Housing, originated with the community process. As supervisor yee mentioned in 2015, he and which has held over 50 meetings and has been the key forum for Ongoing Community feedback and have continued to be active during covid. The p. U. C. In 2017 created the development, principles and parameters document attached to the developer r. F. P. The parameters outlined the Key Community priorities for the site and whether it be 15 affordable, that the new housing was geared to families at a ang and that it was created to form a new neighborhood among other topic. They collected the Developer Team, Reservoir Community partners and joint second which you are of Bridge Housing and avalon bay community. The Developer Team has worked in concert to shape the communitys priorities into a successful project. The proposed project builds 1100 new homes across the range of building types both for renters and homeowners. 550 units or 50 will be affordable at a range of incomes. This approach creates broad opportunity for diversity of new residents. The new neighborhoods mixes thoughtfully into the surrounding community and supports children and families with large usable open spaces with play areas and 100 seat Child Care Center a Public Community room, a new connection to city, college, and ocean avenue. To contribute to the nearby open transit improvements. The project key benefit is 550 units of Affordable Housing on site. The housing will be available for households earning between 30 and 120 of a. M. I. Meaning for house holds who work in health care, the service industry, education, public safety, and all of the people that complete a neighborhood. The units are family sized. 150 of the units will be designated for affordable educator housing, among the first in the city. The affordable educator building will have a first preference for city college which will allow the college to attract and retain diverse faculty and staff. The developer is obligated to contribute gap funding for 43 of Affordable Housing and will contribute gap funding to reach 50 affordability. And it is expected that the city funding will be al activated to affordable buildings e, a, and b for low income house holds and the sources of city Gap Financing will be identified and appropriated by the board closer to construction start to make feasible 5050 units and and turn it to the colleagues and to continue the presentation, i turn to my colleague. Good evening, supervisors. One of the concerns that we heard expressed from the new project is how residents would get to the site. The community was concerned with increased traffic congestion, Pedestrian Access and the loss of parking. We have worked with colleagues at m. T. A. , city college and the sponsor to develop a comprehensive response to these concerns. First, with city college, we work to develop a transportation Land Management program and proposed improvements on the north side and to advance the q line quick build project to improve access and the intersection approval to ocean avenue. And lastly we work with the sponsor to contribute about 10 million in train station sustainability fees and mitigation measures and provide a Public Parking garage. Next. We wanted to reiterate the Family Features as outlined by supervisor yee. This product is centered on creating a neighborhood for families and all address the needs of families. The housing there have 30 two bedroom and 10 three bedrooms including town homes and living alleys and indoor space in the multifamily buildings for gathering and birthday parties and initial space in the garage for oversize cargo bikes and bikes with child seats to encourage biking and waub walking to insure these are safe modes of travel. And another was the child care facility at 50 of those 100 feet to be reserved for low income families. As outlined in the c. A. C. Principles and parameters, the design site was intended to insure that the surrounding context and scale of the neighborhoods is respected. The developer is lower and increases in height as the site slopes up to meet the Institutional Uses of city college. Next. Supervisors, before you today, there are planning code and map amendments from p and public zoning to a special use district. And to reck late the height in bulk and open space and the guidelines and documents and to be used for minor and major modifications. And to discuss the detail of the buildings and the open space. Next. Also before you today are the general plan amendment. The amendments to the general plan are in keeping with the existing general plan and update it to reflect the specifics of the project. And note that the project is generally consistent and the balboa park stationary plant calls for a mixed use development. There are changes to introductory text and there are changes to some maps in the general plan. And finally we want to outline the stages of construction. You will see here in purple phase one is anticipated to begin in late 2021 and phase two in yellow is anticipated to begin in 2025. And the project received unanimous approval at the Planning Commission, the m. T. A. And the sfpuc and today the land use and the general plan amendments and on wednesday the Budget Committee is scheduled to hear the Development Agreement and the sfpuc purchase and sale agreement. Mr. Chair, we have an Economic Impact report first. We do. Okay. Lets get the Economic Impact report. Good afternoon, supervisors. Can you hear me . Yes, we can. Okay. Good evening. This is at the Controllers Office for Economic Analysis and the balboa project released on friday. And some of the key details of the project and some of the key items in our report. About 15 points and does not contain any permanent structures right now. And 1,007 parking spaces. And the main goal of the project is the underutilized reports and as supervisor yee mentioned, identified among the first slide slated for the San FranciscoPublic Housing awareness. And despite existing zoning and which is public and most of us are on the project side and existing and except for the small force which is 2. 2 acres on the eastern portion which has 65 height limit. And depending on that block and to go to seven stories. And 1. 8 million square feet. And the majority of the use and about 1. 3 million and to propose 1100 units and for public use and 7500 square foot of neighborhood with retail. And as mentioned and in several spaces. 50 of the units will be affordable and as speakers mention and approximately two acres of a reservoir park. This slide will show you the development o. So my apologies and as i was mentioning as a difference in the Development Capacity at buildout, the total will be 1. 3 million square feet of space. Which is mostly residential. I am not in 1. 3 million square feet and roughly about 400,000 square foot. And next slide please. And i will go with the key economic factors and the proposed development. And from the prices in terms of the city and there will be a modest increase about 30 jobs in labor and child care based on the size of the proposed development. And an increase in the number of subsidized development and modern system household with high housing burden and high income household in the city. And 550 additional affordable units by as much as 3. 8 million for the household to occupy the units. This is roughly 6900 subsidies from the units on an annual basis. Next slide please. These are some of the simulations and propose zoning and the development of the agreement and with that area and go down 5. 4 and from the values and with the size of the development. Yes please . Do you want to go back to the last side where there is a note at the bottom with regard to the overestimate. Yes please. And may be 3. 8 million and what we are estimating and based on the subsidy and the housing bound and modern and the income and with the project and 20 a. M. I. And as we know about 36 of the housing affordable units will be low income unit and 30 of the affordable units will be low income units and will occupy between 50 percent of a. M. I. And the remaining 30 now. And the reason i put that note there was to to consider the subsidy a little bit and every estimate and the upper limit. And to take into account with the a. M. I. And that subsidy may be lower. That was the point that i hope to answer your question. Thank you. Do you have any modelling as to how much lower . At this point i cant comment on that and that involves land and go to all the units and how they will be distributed. I dont have that distribution and i cant estimate that. In terms of the modelling that subsidy wouldnt change the Economic Impact as easily. That is not one of the biggest factors to drive that simulation. With the please advance two slides forward. Result of the random simulation with the employment population and the g. D. P. And the annual change is 556 jobs. And you would expect from the goal of the project. And the population change is 892 people. And that impact is 100 million and housing prices will change 4. 5 . That is what we are around roughly 1. 4 million house and average house. With about 6,000 to put this in perspective. Next slide. I guess that next slide. And this is basically the project has quite a bit of positive impact on the local economy and add parking and jobs and to the local g. D. P. That concludes my presentation. I just want to see you clarify when you say retail space which is a little space. We assume based on maybe i apologize. Based on my understanding of the draft of the Development Agreement, there was 10,000 square feet retail space was mentioned. we wouldnt have any retail. So we could support businesses. We need some clarification on that. yes i mean, that was my understanding, that was part of the. the Economic Impact was minute mouse. Its an economic land use matter ill refer to the district supervisor. In reality that is a handful of spaces at the most. If the instrumentsthe range of instruments before us, mr. President what is your will. it was just for clarification. I didnt think it would have that much impact in terms of economic a sisment. thats not a huge impact. Its a very small space, you know. I do have some suggestions relative to the Development Agreement particularly as it relates to making sure that where this happened in other large scale developments such as this, that we know these exist, the levels of affordability at least not in a downward way. I do believe the developer is willing to stimulate in the Development Agreement that they will not come back and retrade to lower levels of affordability in the case of treasure island, as happened in the case of ship yard as it relates to ownership and mix, that will be coming in the Development Agreement. That is not before this committee. Im also interested in what we cloacolloquially refer to as ust or lose it. Thats not before us today. Five hundred fifty units will be below market rate. It will make a major contribution to addressing the citys Affordable Housing needs. Provides desperately needed child care Housing Needs for low income children. The low income market helps to benefit the project. The site is under use use underd areas. The failure of the bay area governments housing such as this is a major disparity to San Francisco as well as the bay area. hello. Im a d1 resident, parent, and former commuter student to the ocean campus. Depending on my car to be able to work and attend school at night. That said, the reservoir is public land and should be kept publicly owned. The city should see that this land stay in public hands so Nonprofit Developers can build 100 Affordable Housing through a land leap. The way its structured the for Profit Developers get ownership to build anything. They can sell all or portions of the property. Therefore the lands should be sold to the p c to see the land is publicly accountable and guaranteed to serve those most in need in our city in the long term. As this property sits right next to city college one of the most important institutions in the city for achieving equity, we must have a different deal. One that supports students, future students like my son. As we are in a time of awareness of inequalities in our city and country, selling this land to a private developer is not a solution. Neevmennext speaker, please. this is jennifer. There are many positive components of this development. However, Student Access will be broken by the current time line of simultaneous construction. Both developments are planned from 2021 to 2024. This massive amount of simultaneous construction risks sutting up thriskscutting up pae college. Bicycle and Pedestrian Safety havent even been approved. It will be greater than after the City Developments are operational. In combination to cuts Community Lines planning simultaneous with serious reduction of e educatiol opportunity during the pandemic and beyond. The very Diverse Community around the reservoir including my neighborhood is nothing something we can ignore. We must recognize the Economic Impacts. Air quality means fixing, not allowing sig simultaneous construction. An issue that was not addressed in the feir. As we emerge from pandemic, we need to bring large numbers of people back to work. At this critical time put city colleges first in the pipeline. Let city college complete its long awaited construction to complete buildings that have been long awaiting completion for decades. thank you. Next speaker, please. good afternoon supervisors. Im president of the west ward park association. West wood park has submitted its written comments and im sure you all have read them. I want to thank president ethese are not given as a member but as president of West Wood Park. We metaphor four o met for four. The real problem is the Purchase Agreement. The Purchase Agreement was submitted a few days before they met and never submitted to the c a c. The c a c never review logos thied thisPurchase Agreement. West wood park requested a copy of the appraisal to determine how it was possible that the fair market value was only four Million Dollars. We assumed that the valuation was accomplished by one of the three methods of valuation and devoting some value to what the developer was contributing. The developer is not contributing all they thought it would contribute. When it has to, under the law, pay for two hundred twenty units. Its seeking public money not its own money. Therefore, the infrastructure and parks are being paid by the public not by the developer. An the contractual terms are really advantageous to the developer and have to be changed. For the first five years they have no obligation to do anything. The bottom line is, this has to be changed. Our Home Owners Association and we support 100 Affordable Housing. Thats the illusion. Thatthe solution. Thats what s. We submit that this should not be approved. They should look for a better deal for the city. Thank you for your time. thank you for your comments. The committee was in support of housing and homes for the site. Politics killed those homes. Here we are again with the great housing design. Its been a long long time. Building housing is tough in San Francisco. Please help by approving these homes. Back then it was a majority black neighborhood. It resulted in the depopulation of black families. The more barriers and desegregation we create. Theres always a reason to delay. Theres always a request for a better deal. This is a Family Friendly design. As the father of an educator myself and father of two kids in the School District please build these homes. The public parks and Community Center is perfect for kids. No more delays. That was the powers of the developers. Thats the Big Marketing staff. Theyve been very successful in marketing the reservoir project as Affordable Housing. In reality whats really happening is that its actually a privatization exam. Back in 2018 the bos budget and anlist report assumed that the sixty three developer responsibility for affordable units out of the five hundred fifty with the quote funned by developer equity and project revenues. Now this is the assumption, however, it is not true. Eps did a feasibility memo for the developers and it shows that they are expecting to get seventy nine point five million in state grants. Why the cost for the Developers Share of three hundred sixty three affordable units will cost one hundred twelve point five Million Dollars. Essentiallythey are only paying for a small proportion of the affordable units. Once again its privatization exam. Far from the market rate units subsidizing units. Public zoning needs to be retained. The only thing that public zoning needs to be changed to an sud is deprivatization. send it along so developers wont develop it at all or negotiate the deal. The city applies for state grants to cover the cost for infrastructure. 5 more on average for the low income units and 10 on the moderate income units. It sets up segregation in terms of the development. So the developer can maximize its profits. Pupublic land should stay in public control. This creates a guarantee that the Affordable Housing stays affordable. We shouldnt be privatizing public land for housing developers. If we sell our public landswe need to keep public lands in public control. The open space thats being considered is surely more attractive, safer and Family Friendly than the reservoirs i described earlier. Eve seen the successful thf sucs developer elsewhere. The area near whole foods and in closing we need more housing for people of all backgrounds and incomes. This will help solve that problem. The status quo is an empty reservoir. Please get this done. Even though the Development Process has been going on for way too long, several years, the most important use of this public land has not been consideration. The most important fact in the project question is, i believe, that this is publicly owned property. Were going to have five hundred fifty people paying below market rate and five hundred fifty at market rate is fine. Theres a lot of talk about whatthe developer who owns the land. Lets not lose sight of the fact that more than five hundred low income families will soon have a place to live. The kids who grow up in the units will get to live steps from Public Transit and the ocean. Lets think about the maximum number of people who can oan joy living ienjoyliving in the new. Five hundred low income families who have an amazing opportunity at a new life in San Francisco. Lets focus on how to make it bigger. Instead of have it be five hundred out of a thousand lets have it be a thousand out of two thousand. The price of the land is one of the biggest hurdles to building Affordable Housing. It makes no sense to sell this to a private developer. Any housing bistlethank you. next speaker. When i here people talk about the low price that San Franciscohow much would it cost if we were to develop all of the housing that is proposed instead. I believe the cost would be around five hundred Million Dollars all in. Which i believe we do not have considering we now have a deficit of similar north of one billion dollars. I koant think were going t dono come up with 500 ow 500 billio. Most housing that comes with 30 affordable or above is office space. Make sure the publicly owned seventeen acre becomes a Development Project that responds to the community needs. In 2016 we urged publicly owned land through the development of Affordable Housing. The Public Utilities commission passed up to 100 affordable. A council of Community Housing organizations also developed a proposal to reach 100 affordability. It would set the parameters froi noted on my comment comments hos already out of reach, this project makes these units more expensive. Instead of being priced at sixty and 80 ami. They are eighty and 100 ami respectively. One of our most important public institutionsthere was little recourse for community to address central concerns to maintain Public Ownership at the site. thank you. Next speaker, please. In terms of what is needed to fund affordable units, theres many mechanisms that would help pay for it. This project just like any other project would utilize all the avenues for that. Theres gap funding thats needed. In particular the 33 percent of the units versus the 17 units that the city is going to sup or. Casupport. Can we get an expraings o explaf what that means in terms of gap funding from the developer. sure. I can speak to that a little bit. Youre just asking about the gap funding for the Affordable Housing and the amounts. i think part of it is for people to understand the financial set up for Affordable Housing. They are some of the people who do know how Affordable Housing comes together. which is the nonprofit that is going through the units. bridge and avalon bay are the 50 partners sm th partners. In 2015 when this was put forward by the city. Pe percent funding, the developers ab ligation i obli p funding for 17 percent Affordable Housing. Affordable housing is funded through a meud teud o meult te. as you know we have a number of local sources available for Affordable Housing development which includes our local Housing Trust fund, imfact fees that arimpactfees that are. We havent committed to what source were using. Gap funding closer to 2022. Well bring our loans have to be brought to the board of supervisor approval. We need several layers of funding. If it were at least 100 affordable on the public land it would be easier to follow. The bottom line is the coe is in danger. The things we have said at the meetings slb ignored and dropped. Please look at your original surplus land presentations. You talk about accessing public agencies for land and it isnt a picture of the balboa reservoir. Its a picture of the science building. There was another way to have done this at the beginning. Put the voices were not listened to. They put a lot of information out there and it was just ignored and it just keeps plowing forward. City college is going to get hurt. It really needs to help. The parameters were included in the rfq. They were supposed to be observed. They called for permanently Affordable Housing and perp petd perpetuity. The lapping waw language was tr. Its happened in foster city when the properties became a forrabilitaforrabilitypropertieo waive the height of the western port of the property. That was not vetted by anyone. The alternative road that goes through the campus that the developer and the city want. That was not vetted in the process either. I received information from the Real Estate Division that on november ninth of november 16th the Real Estate Division put out surplus city property. I was told that the Real Estate Division who funded city college did not receive a copy of that written notice. They should have. thank you. There was a study commissioned yiers agyears ago that shows the value the city college provides comes to thirty one million per year. Its scheduled to be a siphons e building. It was meant to be for parking so people can access this. Improvements and construction to renovate city college if nobody is going to be able to get to it. One is the july public lands for public good and defend applian appliance. Both of those letters are carefully argued and presenting a great deal of fact regarding this project and the many reasons why it should be rejected. Ill take what is on the table. This is has been a long process. This is the project that has come out before you. Its not going to please everybody but i think it has a lot of great things going for it. Affordable housing is very expensive to build in the city. Its hard to find the money for fund it. Its a great use of land and subsidize housing to get something for everyone. We know that we have reallywe need to be building more housing. Low Income Housing and this is one examine m o examine m examp. mr. Chair, that concludes the line of Public Comments on this item. okay. With that are there any questions or comments from my colleagues or the sponsor of item number eight . i think supervisor presston might have some comments. i want to make sure i understand some of the comments on the value of the land. Is theis it accurate that the land is being sold for fair market value or less for exchange of Public Benefit for the project. the property ordinances which advise Enterprise Departments to consider high levels of Affordable Housing in their Surplus Property. This was a fair market value appraisal with the thirty three percent affordable residual val autvalvalue was eleven point for Million Dollars. The difference in detail is simply that the actual proposed project is 50 affordable. The difference there is that they will be providing the gap for that 17 percent. The policy background of proposition k and property ordinance does allow for the fair market value to be based on 33 percent. They must get fair market value for their land. i dont want to belayer that. Belabor that. You take into account 33 percent affordable. How would that violate. I dont understand how prop 218 locks in that value. Im trying to understand. Theres nothing about prop 218 that would prevent one from running the same number. You have a lower fair market value with the value for that marketability. Right . yes. Using a Development Approach and the way land is valued under real estate everything is factored into account that has a cost. Affordable housing has a cost that effects the residual land value. whatbecause this is land that the Enterprise Agency and because they have a fie fiduciay duty to the landbased on certain assumptions land value has been diskowne discounted atc good. Right now anybody in the market would have to assume our inclusionary rates. The rate is higher. Residual land value is less. That assumption of 33 percent is consistent and comparable with other projects of this size which is what an appraiser would base a fair market assumption on. Those are the groundings that were established early on in 2015. The 33 percent that would be considered part of the fair market value assumption. i think theres a policy decision, thats one thing. Im not seeing there would be3m required under prop k. The code allows for pu c to sell at less than that. Its explicit the administrative code on costs. It can be cold for less than the fair market value. Im trying to get clarity. I understand theres a policy choice, charge the money, sell the property, or discount that and sell more affordable units. Im not seeing what the legal restriction of 218 would be to do with making that policy choice. ill turn it over to our City Attorney. Ill invite the po c to contribute as well. deputy City Attorney. supervisor preston. Thank you for the question. There are charter and state restrictions that the state get fair market value s. The ordinary administrative codes conveyed for less than fair market value is restricted by that. What wein this project, we determine that 33 percent is a comparable development in the market. Thats the basis for this determination and the a raisal anappraisal. Thats the reason ft and therefore the prays of the e property isthe land doesnt bare the dmishment of th the di. in the court cases, you i assume theres no appraisals done at other assumptions. I would also add, supervisor preston, that we have spent the last four years conducting additional economic feasability analysis to show you the package of Public Benefits in the project. And just the level of Public Benefit, the costs associated with those benefits, that the developer will bear really also further indicates that the 33 is an appropriate value to make the project financially feasib feasible. Supervisor preston thank you. One other clarification question. Just on the parking and i recognize my district is very different than the terrain here. So, you know, we are obviously trying to push down the parking levels as much as possible and some of the stuff that is served better by transit. So i recognize that its apples and oranges. But im just curious to see a thousand parking spots like how much is residents . What is the ratio with the residential units and i understand that some of this is for city college sort of reclaiming some of the parking for city college. Is there a breakdown of that . Sure. Stu, do you want to discuss the parking breakdown . Sure. The site for residential parking is parked at 0. 5, so half of the you know, of the parking spots are for half of the units, right . Im sorry, im getting so tired that i cant even do my math anymore. But for the 1,100 units theres 500 parking spots for residential parking. And theres also a Public Parking garage that will be on the site. And that will allow up to 450 spaces. Supervisor preston thank you. And then the last question i had im trying to just understand i understand that its pending ceqa appeal and theres a few other documents referenced. So the Development Agreement, im assuming that is before the budget on thursday. So that hasnt been finalized yet. And then i understand that theres an m. O. U. Maybe the developer can address this. I just want to know what the status of this is, and i know that between city college and the developer i think that its going to be negotiated and i dont know if that is finalized. But neither of those are documents that i think that are before us for approval. Or up for review, right . I dont think that either has been finalized. I will just clarify that, yes, the Development Agreement is going to be heard by the Budget Committee due to the fiscal impact of the gap funding. Alternative to the developer to speak to the m. O. U. [broken audio] so its not a city acti action. Sure. Kiersten, this is joaquin to claim in as well. And we have been working for however long that it has been that we have been selected for the project, 3, 3 1 2 years now. We have made a number of commitments in the d. A. , so with our grant with the city, to fund many of the the things that we have heard that are important to the college, and the parking that you just talked about. We have been working on a parallel track to grean on an an m. O. U. With the college and were waiting for a draft from them. We have been working back and forth with the Prior Administration for a couple years. That effort stalled last year when the administration left. And the board of trustees has picked that up. We are really excited they picked that up and they had a meeting two, three weeks ago to say this is a priority and they need to get it done. They plan to hear something on thursday, we havent yet seen the draft so were excited to see what that is and hopefully were moving that effort forward very quickly as well. Supervisor preston already, so the thought of the m. O. U. And the d. A. Both done by the time that it hits budget, is that the goal . The d. A. Will definitely i mean, the d. A. Is done. And and, you know, the commitment to city college in there are you know, are set and its been negotiated with the city and, you know, as much as we can with the college. Our desire would be i mean, budget is wednesday and the city College Hearing is thursday. I dont, frankly, know what the college is intending to propose on thursday so its hard to say if well be finished. But our process has been to have the city college m. O. U. To be completed in time for for the boards approval. Supervisor preston all right, well, thank you. Those are all of the questions. I just want to say thank you. This is, obviously, has been and, president yee, im sure, an enormous amount of work to move to have this level of neighborhood consultation and this many different parties involved in such a complex development plan. Is largely done, i would like to suggest that there are still some accommodations that could be made between the parties in the d. A. , including but not limited to a representation that there will be no going back in the future on affordability and the reopening of the d. A. Will never go to that issue as well as the involving conversation around timely performance, the quote unquote use it or lose it. So those things are still in play as is the issues with the m. O. U. Of city college are but i do want to thank the Development Team, and the public and particularly president yee and his staff for a long, long haul and were not done yet. And given the pending ceqa appeal, colleagues, if there are no i see supervisor safai, so ill recognize supervisor safai, but then if its acceptable i would like to make a motion to send these items to the full board without recommendation. Given that there is a pending ceqa appeal. Supervisor safai, the floor is yours. President yee and before you do close it up let me of course, mr. President. Thank you, chair. I just wanted to say from the perspective of the neighboring supervisor, this particular project straddles both districts. Its clearly in district 7 and i just want to give a special recognition to president yee for all of his hard work and leadership on this, to jen lowe on his staff. And i know that the president will be thanking his staff but i just want to thank her for her constant communication with our office. Bridge housing and Mission Housing and avalon and the Planning Department of the economic and workforce development, and very importantly the leaders and residents of district 11 that reached out to our office and were involved in the process, many of whom spoke tonight. This is not an easy endeavor and i think that president yee will tell you that district 11 and district 7 have not had family Affordable Housing built on any type of scale. They have a couple of projects in the pipeline but a project of this magnitude and impact is significant. And, again, you know, both to the ballot matter and when we passed the Affordable Housing bond last year with the leadership of president yee and the mayor and many members on this board, including myself and others that were involved in that campaign in fact, all of us, but some of us were more deeply involved than others. That then is going to help to fill the gap and to keep the commitment to building 50 affordable which, by the way, there arent, you know, i have been very fortunate to have a 50 affordable at 116 units. This is 50 affordable of over a thousand units, which is significant. There will be agreements made on local hire and outreach and community. Supervisor peskin talked about some of the amendments thattee asked for, lose it or use it and some of the other things. We worked with president yees office and everyone to ensure that the neighborhood preference radius would have real impact in this part of town. I want to thank supervisor yee for working withous that. Were going to be making that through his support, the budget and finance tomorrow. That will ensure that the communities concerned, those that really need and have the ability to qualify for that will be able to do that in this process. So i just wanted to say thank you to the residents of district 11 and district 7 that have been involved in this process. And i think that this is a this is a project that will have Significant Impact for our part of town. And understand why some people asked the questions they did, but wanting to see 100 affordable, but understanding that that that is a significant, significant Financial Investment on the part of the city to build a thousand units. So 550 units is a Significant Impact for those in need during this housing crisis. So just wanted to thank everyone for coming out today and giving their Public Comment. I want to thank the public for coming out and you can see how passionate people are one way or another. Its been my experience that ive seen this for the last five years where people have tried to articulate what they feel are what would be best for this city or in this cases for city callers and if many cases for people around the neighborhood or a few blocks from there. But to date, you know, i want to make a couple of comments we have for those that arent familiar with city college, sometimes it makes it sound like were taking away some of the education buildings or something from city college as people are saying that they wont have access to it. In fact, all were looking at is the the land that belongs to p. U. C. And always has been part of p. U. C. And theyve been gracious to allow for city college to borrow on that parcel for student parking. Once upon a time student parking was much more needed than it is today, but it is still needed. And even if they build the center there, i dont know when theyd ever do that, but we have remember that city college outside of the slot that were talking about that is going to build over a thousand units of housing, they have 2,000 other parking spaces. So, you know, its not going to hurt parking. And then the developer will add on more that they think that is needed to mitigate some of the impact. And as already mentioned by my colleagues, today in landuse, what were really talking about looking at the general transit amendment and also the rezonings for special use district. Those are the things that weve been looking at today. So i actually didnt go into the Development Agreement that much because i know that were going to be talking about that in two days. And my staff and my office have been working on putting in more amendments that, of course, it wouldnt be right now, wed introduce those amendments on on wednesday. And a few of those things have been alluded to. Supervisor peskin has been championing this use it or dont lose it, and i totally agree and well recommend that amendment. I work with the supervisor safai in understanding that this city college is really part of district 7, that there are a lot of people around both of our districts that can benefit from it, from having sort of a neighborhood preference. So were going to put in that amendment. And then we also i know that i mentioned that the new developers were 50 of the new property for the city to control. When it comes to park inclusioniffity and housing affordability, a whole bunch of other things. So well be introducing that amendment that the Developers Already agreed to. And the other thing that weve been talking about, i didnt want that to get lost in the discussion, is the we felt that it was important to put language in there, for the use it or lose it, that the affordability piece that were talking about, that some people felt we might lose it in 50 years or whatever. We will put language in there that will make it in perpetuity. So i just wanted to respond to some of the Public Comments that were made and they were made in good faith because they might have not known that we were pushing for these amendments. And, again, i didnt want to mention too much to take up too much of the land use of the committees time because i know that were going to talk about it on wednesday. It will house Motorcycle Police and department of Forensic Services division. Both sfpd groups are in two buildings that need to be vacated. They will join the new 183 million facility in late 2021. Elements of the cfi and the Traffic Company are housed at the hall of justice, which has been determined to be seismically unfit. It is slated for demolition. In addition to that the Forensic Services crime lab is also slated for demolition. It was time and made sense to put these elements currently spread in different parts of the city together into a new facility. The project is located in the bayview area, in the area near estes creek. When San Francisco was first formed and the streetcars were built back it was part of the bay. We had to move the building as close to the edge as possible on bedrock and solid elements piles down to make sure it was secure. It will be approximately 100,000 square feet, that includes 8,000 square feet for Traffic Company parking garage. The reason we needed too new building, this is inadequate for the current staffing needs and also our motor department. The officers need more room, secured parking. So the csi unit location is at the hall of justice, and the Crime Laboratory is located at building 60 sixty old Hunters Point shipyard. Not colocated doesnt allow for easy exchange of information to occur. Traffic division was started in 1909. They were motor officers. They used sidecars. Officers who road by themselves without the sidecar were called solo. That is a common term for the motorcycle officers. We have 45 officers assigned to the motorcycles. All parking at the new facility will be in one location. The current locker room with shared with other officers. It is not assigned to just traffic companies. There are two showers downstairs and up. Both are gym and shop weres are old. It needs constant maintenance. Forensic services provides five major types of testing. We develop fingerprints on substances and comparisons. There are firearms identification to deal with projectiles, bullets or cartridge casings from shootings. Dna is looking at a whole an rare of evidence from array of evidence from dna to Sexual Assault to homicide. We are also in the business of doing breath allyzer analysis for dui cases. We are resurrecting the gunshot Residue Testing to look for the presence of gunshot residue. Lifespan is 50 years. It has been raised up high enough that if the bay starts to rise that building will operate. The facility is versus sustainable. If the lead gold highest. The lighting is led. Gives them good lights and reduces energy use way down. Water throughout the project we have low water use facilities. Gardens outside, same thing, low water use for that. Other things we have are green roofs on the project. We have studies to make sure we have maximum daylight to bring it into the building. The new facility will not be open to the public. There will be a lobby. There will be a deconstruction motorcycle and have parts around. The dna labs will have a vestibule before you go to the space you are making sure the air is clean, people are coming in and you are not contaminating anything in the labs. Test firing in the building you are generating lead and chemicals. We want to quickly remove that from the individuals who are working in that environment and ensure what we put in the air is not toxic. There are scrubbers in the air to ensure any air coming out is also at the cleanest standards. You will see that kind of at the site. It has three buildings on the site. One is for the motorcycle parking, Main Building and back behind is a smaller building for evidence vehicles. There is a crime, crime scene. They are put into the secure facility that locks the cars down while they are examined. They could be vehicles involved in the shooting. There might be projectiles lodged in the vehicle, cartridge casings inside the vehicle, it could be a vehicle where a aggravated sexual occurred and there might be biological evidence, fingerprints, recovered merchandise from a potential robbery or other things. The greatest challenge on the project is meeting the scope requirements of the project given the superheated Construction Market we have been facing. I am proud to say we are delivering a project where we are on budget. The front plaza on the corner will be inviting to the public. Something that gives back to the public. The building sits off the edge. It helps it be protected. What we are looking for is an updated knowledg building, with facilities to meet our units needs. Working with the San FranciscoPolice Department is an honor and privilege. I am looking forward to seeing their faces as the Police Officers move to the new facility. It is a welcome change, a new surrounding that is free from all of the challenges that we face with being remote, and then the ability to offer new expanded services to the city and Police Department investigations unit. I cant wait until fall of 2021 when the building is finally ready to go and be occupied and the people can get into the facility to serve them and serve the community. Is our United States constitution requires every ten years that america counts every human being in the United States, which is incredibly important for many reasons. Its important for preliminary representation because if Political Representation because if we under count california, we get less representatives in congress. Its important for San Francisco because if we dont have all of the people in our city, if we dont have all of the folks in california, california and San Francisco stand to lose billions of dollars in funding. Its really important to the city of San Francisco that the federal government gets the count right, so weve created count sf to motivate all sf count to motivate all citizens to participate in the census. For the immigrant community, a lot of people arent sure whether they should take part, whether this is something for u. S. Citizens or whether its something for anybody whos in the yUnited States, and it is something for everybody. Census counts the entire population. Weve given out 2 million to over 30 communitybased organizations to help people do the census in the communities where they live and work. Weve also partnered with the Public Libraries here in the city and also the Public Schools to make sure there are informational materials to make sure the folks do the census at those sites, as well, and weve initiated a campaign to motivate the citizens and make sure they participate in census 2020. Because of the language issues that many Chinese Community and families experience, there is a lot of mistrust in the federal government and whether their private information will be kept private and confidential. So its really important that communities like bayviewHunters Point participate because in the past, theyve been under counted, so what that means is that funding that should have gone to these communities, it wasnt enough. Were going to help educate people in the tenderloin, the multicultural residents of the tenderloin. You know, any one of our given blocks, theres 35 different languages spoken, so we are the original u. N. Of San Francisco. So its our job is to educate people and be able to familiarize themselves on doing this census. You go online and do the census. Its available in 13 languages, and you dont need anything. Its based on household. You put in your address and answer nine simple questions. How many people are in your household, do you rent, and your information. Your name, your age, your race, your gender. Everybody is 2,000 in funding for our child care, housing, food stamps, and medical care. All of the residents in the city and county of San Francisco need to be counted in census 2020. If youre not counted, then your community is underrepresented and will be underserved. Tos today im going to provide an update on the covid19 pandemic in San Francisco looking at health ind kaytors and other data. Unfortunately, we are experiencing a surge in covid19 infections that is affecting our communitys health and our reopening plans. As a result, we are forced to continue to pause our reopening plans until conditions improve. We are, we have been, and we continue to be in a period of uncertainty, and i want to acknowledge that is a really hard place to be. We all need to continue to do what we know works. We can flatten the curve and we can do it again, but if we do not, the consequences could be dire. In terms of where we stand today, both locally, regionally, and nationally, in San Francisco we have 4,696 cases diagnosed of covid19 and sadly, 50 deaths. In the bay area region, approximately 37,500 cases and 667 deaths. Across the state, 346,000 cases and over 7,000 deaths, and across the nation, cases and deaths continue to rise. 3. 4 million cases and nearly 137,000 deaths. The virus is not only still out there, it is out there more than ever before. It continues to spread locally in our community and throughout the bay area region. We are working with researchers who are seeing the reproductive rate of the virus continue to claim above 1. Right now we estimate that that number is now approximately 1. 3. That means that each person who is infected with covid19 is passing the virus on, transmitting the virus on on average to more than one person. It is key that we get that reproductive number to 1 or lower. It is key for us to move forward. Now, 1. 3 doesnt seem that different from 1, that far from 1, but if we do not do better, we are looking at major problems by late august and september with an average peak an average peak of 900 hospitalized patients by early october. And just to put this in some frame of reference on the last surge in april, we peaked at 94 cases. This average scenario of 900 cases is nearly 10 times worse and it is certainly not the worst Case Scenario that we have by that time. Models show that we could have thousands of hospitalized cases by then. Todays tracker show that there are 92 covid positive patients in San Francisco hospitals. That includes 76 San Francisco residents and 16 transfers. Lets look at the Health Indicators we are using to monitor our covid19 response in the city. These are available on the San Francisco data tracker, and you can reach them from our departments website. They are scored by color. Green, yellow, orange, and red to make it easier to see at a glance where we stand and theres detailed Data Available for people who want to dig a little deeper. Right now the indicators show that we have reason to be concerned. Our cases per 100,000 and the case rate has increased to 7. 7. That is in the red zone. Our goal is to keep the case rate around 1. 8. We are red. In terms of our Hospital System, the rate of covid19 infections which really represents the slope of that curve that we work sod hard and successfully early on to flatten, that rate is now increasing at a 33 rate. That is red. That is cause for grave concern. Our goal is to keep that curve increasing by less than 10 . Our other hospital indicators are thankfully still green. Black is our capacity to take care of people across the nine Hospital Systems in the city. Right now we have 27 of the acute care beds available and 28 of the intensive care units available. With regard to testing, our testing indicator is green. We are coveraging 2,950 test day across the city. With our that is far exceeding our goal of 1800 tests. Certainly as we are seeing across the region, across the state and nationally, our testing system is experiencing delays in access and getting results both within our city system and with private providers. Our numbers are high at 20,950 in the green range. With regard to Contact Tracing, we are at level yellow reaching 85 of cases and 85 of contacts. We expect that that indicator to turn orange this week due to delayed test results reporting and our increases in cases. The Contact Tracing team is working hard to catch up and will continue to expand staffing of that program. In terms of our personal protective equipment or ppe, we are on level orange with 78 of the Health Department having a 30day supply of ppe. Im sorry, let me rephrase that. Across the Health Department, we have our ppe supply is 78 . Our goal is 100 . We are experiencing some issues in terms of obtaining ppe likely due to the increased National Demand for ppe supplies. San francisco and the challenges across california the virus is spreading at Dangerous Levels and this week the state announced a roll back with additional restrictions for counties on the states watch list. Approximately 30 counties are on the monitoring list as of today including several in the bay area. We know the bay area region is an interdependent region where they live, work, and play across and covid19 knows no county lines. If any county in the region is in trouble, we are all in trouble. That is why a regional approach has been key ever since this pandemic started, and we continue to be in touch with the hub area officers sharing data and solutions to keep all the communities as safe as possible. And it is certainly possible if our conditions do not improve, a roll back may be necessary in San Francisco in other parts of the bay area as well. Whether thats a roll back through local action or through state determined access rules will continue to be watched. But this is a tool to control the situation and we have always known that this is the possibility given the unprecedented situation in the uncertain situation we continue to face. No one wants to be in the situation were in. And as we look at the rise in cases, many of them are because the people have started to gather with friends and family and others to socialize. And i realize how hard these months have been for us and the sacrifice that all of us have made. These visits are really hard to resist but the truth is that they are spreading to covid. The birthday parties and visits with parents or grandparents, cousins, the barbecues, they are contributing to a delay or rollback in reopening of businesses or even the first day of school. Another key behavior that we all need to do is cover our faces indoors and outdoors when people are around you who are not part of your immediate household. This is critical. Research shows that masking significantly lowers the rate of transmission and 80 of people wear them. Adherence to facial coverings and masking is so key. One cannot tell by looking at someone if someone has covid19. We know that people are asymptomatic at some stage of their disease and they can transmit it when they are asymptomatic and being safe and wearing facial coverings and social distancing and using good hygiene is key to our success. And the simple act of wearing a mask will slow the spread of the virus and lead to lifting shelter in place restrictions. For those who are wearing masks, we are truly saving lives and those who are not taking precautions, you are not helping. The situation is becoming more serious every day. Please wear a mask and do not gather. Stay 6 feet apart. And wash your hands. These basic acts will make a huge difference if we do this together. We have flattened and we even crushed the curve before and that curve is now escalating and we all need to do better. And until then, our real thing is on pause. And until then, our reopening is on pause. We are not able to open up personal services, indoor museums, aquariums, outdoor swimming pools, Indoor Dining, outdoor bars without food, real estate open houses, and other activities that encourage people to gather and make it harder to wear a mask and social distance. And while it is hard to slow down the reopening and that we all want so badly and the price we pay for moving too quickly is very high. Remember, this virus has no timeline. That is why it is up to us and now is the time despite very curious numbers that i reported to you in terms of our hospitalization. We have a window to make a difference. We can still drive that number to one or lower that reproductive number by the interventions i just went through. We have a window to do this and it will make a huge difference in our hospitalization rates and the number of lives saved. We have shown that we can join together to make a difference, and we need to do it again. Truly, the power is in our hands. And even in the Uncertain Times we know for certainty what are the right steps that we need to take. We can have a thriving city with the healthy population and a renewed economy if we work together. Can we please explain the role schools could play in the state of covid19 infection rate . The School District announced that students will be Distance Learning when School Resumes august 17. Theres been a lot of talk on federal and local level about local kids getting back on campus. What will it take to get San Francisco kids back. One thing it will take is for us to be confident to reopen schools safely for the buildings to reopen, and certainly we are going to need to see a decrease in that reproductive rate and continue to follow the data and science to ensure that the support systems are in place and that people are able to physically distance and that the most vulnerable are protected in the settings and emphasizes the need to have the safety protocols in place and followed using the best evidence we have in terms of transmission. So we will make the decision about whether it is safe to reopen the physical spaces depending on where we stand with the virus and where with our surge in the city when the time comes. Thank you, doctor. Next question, the governor issued new order this is week to try to wrestle the california surge back under control. The order includes statewide closures of bars, Indoor Dining and other activity but those werent happening in San Francisco anyway. What places or events are currently the main source of infection and how are you in addressing the sources . We think it is a combination of factors and increasing the number of cases in the city. And there is clearly increased activity in terms of social gatherings that people are having and we really need to insure that people are taking the precautions and not making those and not having those birthday parties and barbecues moving forward as much as possible. And focussing on the prevention, education, and neighborhood by neighborhood and street by street and going to be so critical. And we are reinforcing the work with Community Partners to insure Community Champions that people have the resources and the knowledge they need to be safer. The other key components of this are that we continue to see infections among essential workers and we think that may be do to certain work place conditions that safety precautions are not being followed. We will be looking at that and enforcing and increasing our oversight and enforcement required precautions and the Health Orders that have been established and we will also be looking at the existing businesses and looking back at the data and potentially what is on the table for that. And i will also add that we have known since the beginning of the pandemic that crowded conditions that promote the spread of the virus and really again working with Community Members and multigenerational households to ensure and getting people tested and taking precautions to protect themselves as well as their family members. Thank you, doctor. Is the country considering the Outdoor Dining and reverting to takeout only as a way to reduce gatherings . Are there plans to cite businesses for Health Order Violations in your counties . We are taking one thing that is clear from the data is indoor activities are riskier than Outdoor Activities overall. We know that the virus spreads more easily and more quickly in indoors than outdoors. And we are taking a look to determine whether this increase in cases is driven by some of the Outdoor Dining and Outdoor Dining and we think this is more due to the noninsurance of some of the businesses rather than rather than the risk thats taken and the relatively smaller risk that is there and if the proper precautions are taken. And outdoors and dining and drinkings and not adhering to the masking and social distancing rules and is at a higher risk. And looking at increase in enforcement and in businesses and institutions and focussing on individual enforcement and enforcement of individuals but really looking at the potential enforcement of institutions and businesses that are not complying and doing the enforcement and the institution and right and Small Businesses are not able to necessarily comply at baseline and what can they do to improve their compliance and support and workers to be more safe during the challenging time. Thank you. Next question, doctor, are you ordering residents to stop gathering outside with masks if groups are keeping to under 10 or 12 people . So at this time we are encouraging people to minimize gatherings as much as possible, to wear a mask if you are in close contact with others and to socially distance whenever possible and certainly if people do better in these small groups that they gather outside is much, much safer. So those are the key components to this right now. And we know theres a lot of need to improve that appearance to the facial coverings of the social distancing. I think we know and we have seen particularly when people know each other and good friend or family members but not members of the immediate household, it is ward to wear a mask and keep socially distant. We want to hug people and we want to engage. We dont want to think a loved one who is not a part of the immediate household or good friend may be infected with covid19 which is why we really need to get the messages out and support the communities most affected by covid19 to drop this reproductive rate below 1. Thank you. Next question. How will the Current Situation effect decision to reopen indoor pools for summer camp . So we have put a pause on any additional and include outdoor pools at this time. Thank you. Next question, and what surge sites are ready to be set up and the Hospital System reaches capacity and when will that be done . Right now we have Hospital Capacity per indicators and again you can go to our website and see that capacity across the nine Hospital Systems and we are in the process as we have been a number of weeks preparing for a greater surge and i want to be clear here. We all need to do our part so that we dont get to that point. We have seen when this virus overwhelms Health Care Systems such as in new york city as it is now doing in arizona, florida, and the southern part of this state the outcomes are poor. Theyre much poorer while we have had 50 people die in San Francisco of covid19 and that is too many and one death is too many and our death rate is significantly and bend the curve here again and not overwhelming the Health Care Systems to move forward. So we are working across the city to strengthen our enforcement capacity, and that will be a culmination across different cities and Department Agencies including the Health Department and the City Attorney. I do really want to thank my chiefofstaff who came up with a catchy phrase, c. U. , conditional use. Commissioner mandelman had a report in march the meaning through this legislation and i think weve all experienced this, arose out of mine and other offices work to help Small Businesses through the permitting offices and where weve all repeatedly encountered frustrations as applications would get lost on the desks of staff at Planning Department or more often repeatedly be transferred from one planner to another. We also reeyes th rerealize thee storefront conditional uses to be treated in much the same manner as conditional uses for extremely large developments which were aimed at regulating things like off Street Parking consistent and curb cuts consistent with longstanding policies of the city. The poster child in my district for this legislation is inaudible which took some 340 days after submitting an application, which should have been streamlined and as i said earlier super mandelmans report really showed all of the deficiencies. The fundamental premise of this legislation is that rather than the first way, which is everything is subject to inaudible longtimeconsuming conditional use or second wave which is everything is principally permitted as a matter of right. What this legislation does is finds the third way. It gets rid of the conditional use process but still allows healthy, Meaningful Community input and dialogue and is we really dug into the Planning Departments Community Business priority Processing Program which they had some cute name for, which i cant remember, which the Commission Adopted by resolution in 2030 and it was well intended but has been less than perfectly implemented as demonstrated by accounting and more recently, tractortrailer big apple. And under this legislation, those projects who have been automatically eligible for a hearing on the consent calender of the Planning Commission within 90 days, not 365 days. And there is still a staff report that would have to address whether the project meets the criteria of conditions and that is necessary and desirable but theres no reason that Small Business owners, particularly during this pandemic, should be hiring lawyers and permit expediters to make their case. Lastly, this legislation, would slash the fees in half which is, i think, commonsense during this pandemic and i commend this legislation to you and with the support of the Small Business commission and i also will, in a minute, invite supervisor ronens office through a binard to address the committee and i want to thank supervisor ronen for being my first cosponsor on this effort. But most importantly, i want to thank a whole series of communitybased organizations and individuals. Betty lilly, with the china Town Merchants Association and the north Beach Business Association that voted unanimously to support this legislation and the Golden Gate Restaurant Association and the San Francisco chamber of commerce with that i would like to call on this. So i just want to take two minutes, first to express supervisor ronens strong support for the legislation, which shes signed to as cosponsor. This legislation, for most neighborhoods is a reasonable and effective way to remove unnecessary burdens and costly delays for Small Businesses that are able to take the lead to get started during this time of so much uncertainty. But second in the main reason i wanted to speak is to thank supervisor peskin and especially legislative aid lee hephner for working with our office and the calle24 district on amendments that chair peskin is going to introduce today or has always speculated to the members. The calle 24 was added to the planning code in recognition of the need to protect the historyy and culture of the latino cultural district in the heart of the mission. Calle is not a destination but home to newcomers and long time families, artists, mom and pop stores and its been hit by overwhelming displays and now the brunt of the covid19 crisis. The cu process has been used by calle to ensure Community Input and to proactively and effectively engage with merchants to the corridor. Were happy to continue working with planning and the cultural district to refine how the c. U. Process works on 24th street but for now we really appreciate its being exempted from the new rules. And, i do believe the originations of the 1986 neighborhood commercial district legislation long for even my time was the notion neighborhood selfdetermination. So, i completely welcome those amendments, which i have in deed circulated to my colleagues and will go through shortly but before i do that, on behalf of the Planning Department, i believe we have mr. Supervisors, on may 28th, the Planning Commission considered this ordinance after some deliberations the Planning Commission voted 4 3 to recommend the ordinance with modifications and the modifications include in lieu of essentially codifying the priority Processing Program or going by the cute name of cb3p we should permit at the first story use that contributes to retail vitality for a period of three years and other measurs limiting them. That concludes my remarks and im available for questions, thank you. Supervisor peskin so, colleagues, do you have any questions from mr. Sanchez . No, sir. Supervisor peskin seeing no questions, and this does not happen very often anymore because the legislative and the executive branches are actually working much closer in collaboration than has historically happened. Many, many years ago, my colleagues, supervisor jake introduced proposition d and amendment to the charter that split the appointment on the Planning Commission to the board of the exercises supervisors ano mayor. As mr. Sanchez just said, this was a 43 vote at the Planning Commission. Three from the appointees of the peoples house, the board of supervisors, who actually agreed with the legislation without amendment for to the executive branch that actually wanted to go with the two choices. One of the two choices. The choice of everything is principally permitted but, i think weve done a pretty good job of parsing this and weve done that by making sure that those kinds of uses, adult entertainment, tobacco use, a number of other uses that are traditionally very controversial and impactful to neighborhoods, are not set into the context of this legislation. Quite frankly, there were a number of things that went before the Planning Commission relative to peer relief that Planning Department staff did not comment on and with all due respect to mr. Sanchez, actually the department, and mr. Star, there are a number of things that were put forward relative to the types of uses that they could have recommended to the commission. Instead, we ended up with as, mr. Sanchez represented by a 54 vote but three came from the board appointees and the fourth from the executive branch. With that, why dont we open this up to Public Comments, unless there are any questions from my colleagues. I just had a quick question, chair peskin, maybe for you, im just curious of the exempted uses in the legislation that you mentioned from the ones that are likely to be more controversial and requires some input. Does that track the what is already exempted under the existing Planning Program or are these new classes of exemptions . Yes. So, the answer to supervisor preston is that does track what the i forget the fancy term they use, the cp3p or 3pp or whatever it is, whatever the fancy term was, jess, that tracks and fundamentally, what we are doing is co cot a and were bringing the time down to the neighbor groups so desire and if that does not happen, the fees are refunded in whole to the applicant. In a time when Small Businesses are facing numerous challenges due to covid19, and the recession our economy is entering into, legislation to streamline and cut these in half to incentivize Small Businesses is critical. San francisco is a community of many small villages. It include streets to irvine avenue to grant avenue our Small Businesses are the life blood of San Francisco. Next speaker, please. Caller good afternoon, supervisors. My name is robert and i live in district 5. I support this legislation but i would appreciate some amendments. I see 24 theres language that still would allow neighborhood groups to appeal or to lengthen the approval time from three months to five months and according to the budget and legislative annalist office, the average wait time for a Planning Commission hearing is around 10 months. So effectively in the worse case, it would cut the approval time in half. Five months is still pretty pathetic for approval time. Were still requiring Small Businesses to spend tens of thousands of dollars on the rent while they wait for a hearing. [please stand by] its interesting that the speaker addressed that because there are very few instances where an establishment of an organization that has been recognized by the Planning Department, has objected to see this kind. I do believe what this legislation is aimed at is giving businesses to get with the neighborhood, to have that dialogue and give them modicum leverage but it has been used very few times. Remember, at the end of the day, any of this can be brought to the board of supervisors. Its really good when neighbors and businesses work it out of the front end. I appreciate those comments. The cost and time for going through conditional use and other entitlements affects businesses in several ways. In addition to the time and cost when businesses enter leases and it also prevents businesses moving forward on projects. We had number of projects in my neighborhood that did not move forward because businesses did not have resources to go into commitment. I appreciate this legislation. I fully support it. Encourage the board of supervisors to pass it as soon as possible. For years we advocated that conditional use permit and permit process should be streamlined. This only applies to long established neighborhood association. The law does not state that. It says association d11 and d4, [indiscernible] its been previously used for giving associations leverage to force us start up businesses to pay rent and i will try to i wish they take that provision out. Theres no vetting here. Contrary to what supervisor peskin said, anybody can be a Neighborhood Organization. I can be a Neighborhood Organization if i register myself with a department. Let me say, Neighborhood Organization has to actually be in continuous Good Standing for a number of years and apply to the Planning Department in order to receive that coveted status. There are fewer and fewer of them overtime. I do want to say to supervisor preston who asked a question that i did not answer entirely correctly because my staff said couple of things which is that number one, the way the Planning Department has done this both informally in 2013 and formally five years ago in 2015, required individuals or applicants to apply for either the expedited permit or go through the traditional process. It was very rare that Planning Department said youre in the wrong bucket, you should go to the expedited situation. This actually requires automatic screening of all applications to make sure that you qualify. Also, we actually expanded the eligibility to provide priority processing for uses that were not a part of the Planning Departments regimen of the last eight years. I wanted to put that on the record. With that pursuant to the request from supervisor ronens office and colleagues you are in receipt of this. I will go through it. Some of these are minor technical insertions on page 1, line 21. The insertion of the file number page 23 insertion of the date it went through the Planning Commission and resolution number that is repeated with file number and the plannings Commission Resolution number on page 2. Then there is the language with regard that you see on page 3 which speaks to the fact that this is a community that is all laid out at on page 3 and one line on page 4. One of my Top Priorities during my time as supervisor of district one has been to bring more Affordable Housing to the west side and thats why i wanted to author this initiative. Im proud to say that thanks to the passage of prop e and the prop a Affordable Housing bond in 2019. We have a 100 affordable senior Housing Project moving forward in district one. Im so grateful for partnering with my office to deliver 100 new permanently Affordable Homes to seniors in my district. This project alone has made my offices work on prop e worthwhile. It is not the only project that seeing the benefits of this passage. The educator Housing Project has benefited from the zoning and streamlining provisions of prop e. Tndc is in Due Diligence phase for another potential site. Were excited about this project. Ordinance before you today will expand these Affordable Housing opportunities even further by establishment baseline height of 50 feet for 100 Affordable Housing projects and educator Housing Projects. And reducing the minimum lot threshold from 10,000 square feet to 8000 square feet. Removing the minimum threshold for vacant lots in surface level parking lots. My office work for the Affordable Housing developers and financing experts to develop both their original proposal and this amendment based on practical real world experiences. Theres no reason Community Groups or neighbors living in multiMillion Dollar houses should be able to put a break on people who are most needy guess housing. I think it will be great if we could have 100 Affordable Housing sites zoned across the city, especially on the west side where we unfortunately have not seen enough 100 Affordable Housing development. Planning commission did discuss the 8000 square feet versus 3000 square feet limit. I want to hear one concrete argument for why not to keep it why not to bring it down to as many parcels as we can down to the 3000 limit . Otherwise, i think this is really good legislation. San francisco should push to them toward the ceiling. I think its really important for us to understand that theres a lot of overcrowding, especially in my district. Which is district nine. This has been stated. This is extremely important streamline 100 Affordable Housing development. This is important on the west side which hasnt received its fair share of investments in Affordable Housing. Really excited to see this impact of property and starting to play out on the west side with low income senior Affordable Housing project that supervisor fewer mentioned. For the educator Housing Project, in the outer sunset, prop e is really going to allow 134 teachers and educators to move into their new Affordable Homes up to a year sooner than they would have without prop e. Finally in district four, we identified over 50 potential Development SitesAffordable Housing. Those will be smaller sites and many of them are in that range of 8000 to 10,000 square feet. These amendments that were considering today will benefit and streamline 100 Affordable Housing development in my district. Supervisor peskin before i go back to the primary author of this legislation, i do want to say in the almost 20 years that ive been on and off the board of supervisors, some of the supervisors were moderate and some of them were progressives. All opposed additional density on the west side. Those supervisors like myself and supervisor preston who come from the east side of the city, have lived with density for over 100 years in not all of us are as old as i am. The entire electorate and their elected representatives on the west side of San Francisco has profoundly changed in the last decade. When i first try to pass legislation, a set of progressives and moderate supervisors rallied together and killed that legislation. It later on became the law of our little land. The notion that this kind of legislation would be forwarded by westside supervisor embraced by another west side supervisor from the richmond and sunset respectively, means that we are turning a page in San Francisco. I welcome it and embrace it and was glad to be part of that. I want to thank my chief of staff who worked on this.
