Its not adding new rooms its enlarging a bedroom suite. Ceqa requires an accurate, stable project. The project description sin accurate and its constantly changed. Rendering the Environmental Review he can tive. Additionally, the project would illegally remove protected dwelling unit where udu on the groundfloor without conditional use authorization. The project sponsor has failed to disclose this. The appellant is open to a compromise but the project sponsor hasnt been willing to make any reasonable modifications. First the law of ceqa. The court held the project description must be quote, accurate, stable and finite. If theres no stable project description or if a project sponsor fails to disclose the full extent of a project its impossible for the environmental impacts to be assessed and ill go ahead and share my screen now with a slide show. Hopefully you can see that. Project sponsor and the Planning Department have used multiple shifting projects descriptions that are inconsistent and contradictory. The first public 311 notice said nothing about the udu and it was rescinded and the second cat action referred to legalization of existing storage rooms. The revised public 311 notice, however, said nothing about legalization. Planning Commission Hearing reports stated the project sponge or is seeking to legalize the udu. Planning staff wrote the new cat ex includes quote, legalization of an unauthorized dwelling. Planning staff announced the project to the Planning Commission and to the public as legalizing quote unauthorized dwelling. And the Commission Decision at the hearing as stated in the discretionary review says they would wrote legalize the unauthorized dwelling. The ceqa cad ak is before you today actually says nothing of the sport and they say theres nothing well leggized. These descriptions are contradictory and theres a no consistent description of this project as required by ceqa. Since its not stabling consistent, it is flawed and must be revoked. They require it to be accurate. After being caught with unpermitted construction on the School Ground other floor where dwelling unit is, they revised the project description and claimed it would legalize a bathroom and storage rooms this is inaccurate. Substantial evidence shows theres an unauthorized dwelling unit there. If you deny todays appeal that unit will be illegally removed by the project without conditional use authorization. How do we know its a unit . Planning code section 317 defines an unauthorized dwelling unit as a room or rooms that have been used as a separate space on the same property. Independent means you can get to the unit without going through another unit and theres no open visual connection. The ground flor space say grouns this. It has a closet, decorative molding and a full bathroom with a bath tube. The window facing the street which is omitted from the floor plan y would you have an unpermitted room with a closet and bathroom and bathtub and storage area. Because its not a storage area, of course, its an unauthorized dwelling unit. In deed, its been described in mls listings as a bedroom on the quote lower level and as a bonus room and bath. We know it was actually used as a separate dwelling unit. Because this space is an unauthorized dwelling unit it can only be removed with conditional use authorization. Project sponsor has not applied for a c. U. But acted if the udu does not exist. When this came to light, dbi issues a notice of violation for the downstairs room being unpermitted and the Planning Department rescinded the first exemption for the project and before you today, the project sponsor is now claiming the groundfloor space as just a bathroom and storage area and this is contradicted by the citys own ceqa documents and there are inconsistent and inaccurate project description zoos it fails to satisfy the rei remembermentidescriptions. Illegg unit . Preserving Affordable Housing to the utmost importance. If this permit is issued based on the fiction that the groundfloor space is storage and not in an you might ask why they care about ceqa. The answer is, she cares about the law it would not extent no the rear yard as its proposed. In deed when she renovated her own she scaled it back so it would not extend beyond the project sponsors rear wall it would be reduced by three feet on the second floor and 511 with a sloped roof to preserve a little bit of life to her home and we remain willing to participate in mediation and if the project and and i will turn this over to my client now to continue. Im meg mcknight i live next door to 740 vermont street. We filed the appeal because the project was removed unauthorized dwelling unit and it was brought live in ear to our primary living, working, eating space which is really important today and the unauthorized dwelling unit as a full bath, bedroom with a closet, a window at the front of the property and adjacent room with hook ups foray pliances and its not connected to the above home. It has historically been used as a unit to neighbors in our immediate area who have been there decades and they talk about it. I also met a woman who lived in the unit. Soon after i moved into my home, the project sponsor introduced me to someone staying there in front of the home. The project sponsor had disclosed in the filings that this unit exists, full and accurate projectory view by the public and the city would have been done. Its never been our intent to stop project we only thought to minimize it and the sponsors have risk use to meet with me and i personally, even once over two years, they would not entertain any reasonable compromise through intermediary. It allowed to proceed the unit would be eliminated and incorporated into the permits space of the Single Family home. Tuesday doesnt matter theyre currently not renting the space. Every existing accessory dwelling unit across our city can help someone who needs and wants to be in San Francisco. The unit will be gone forever. We secretary board to grant the ceqa appeal and require the udu to be the fully permitted or complete the required process eliminating unit. As a record here identifies, there are still issues with the staff us of the unauthorized dwelling unit. Its not stopping progress but rather it seeks to bring the stakeholders together to engage in a productive dialogue to ensure the projects that are approved do truly benefit the Property Owners. As described, the 331 square foot addition to 2,366 square foot house, clearly falls into a class one categoric a exemption and the appellant argues that quote, the project should not have received a categorical exemption because the its incomplete and inaccurate. This argument is centered on how Department Staff has characterized the legalization of four existing rooms on the groundfloor of the residents. Which are throw storage rooms and one full bathroom. Theres been some inconsistency in how the legalization of these rooms has been charter sized and this not germane to the Environmental Review for the project. Under ceqa were concerned about physical changes to the environment. The environment impacts that resolve. No physical changes to the groundfloor rooms have been proposed. I would like to acknowledge the appellant had appeal brief and it did not raise issues among those already a addressed in the appeal response on march 16th. No issues have been raised today. I think its very telling they stated the project blocks significant light. This has been trial quite an interesting presentation by that member of the public who calls from the house to the north and site and while she was supporting the project sponsors right to get what they want, she confirmed the existence of the unauthorized dwelling unit on the floor first. She stated that she said since the 50s. And that is very important, new information confirming the information and arguments in the record and with the ceqa production description. That is, with all due respect, a planning staff, its not correct to say sure, they admit the project description was wrong but it doesnt matter because it wont cause physical impacts and its not how ceqa works. Ceqa requires a stable, accurate project description and we can look to the county and the board of director, airport and there are a lot of cases that make that explicitly clear that is a requirement of ceqa and that requirement has not been met here. You have evidence from neighbors as well and we are correct the project description is wrong and the Planning Department staff has to their credit, admitted that problem. The result of that error is not no harm no foul. We dont know it there are environmental impacts because the environmental impacts of the project have not yet been evaluated. They evaluated a different inaccurate proteasome jet and it discrimination must be revoked now and that the planning tempt can review the inaudible that is being proposed. Even if they say well we lost out the unauthorized dwelling unit from the description, it wont be part of the project. Thats not right either. At a number of times they also said that it is in the project and legalization of the unit is in the project so they still have that problem with the stable accurate description of the project not being met. And it matters. Because if this project is approved, the last weve heard from them is Planning Commission is its legal icing it as storage and were using it as a nationally affordable unit. This is not views and and yes, we have raised these arguments multiple timemultiple times ande succeed. It was rescinded by the Planning Department because the project sponsor misrepresent sented thee of the project. So, again, i want to come back to the proposal as a compromise and we hope that you will preserve this unit and the compromise is, two feet at the second flor and one foot shy of the third. The three foot reduction on the second floor and 511 on the third floor. Thank you very much for your consideration. Supervisor walton. On september 20th, 2018, the Planning Department issued a ceqa cad gore i ca categorical n determination identified the approval action for the project as either one, the issuance of a Building Permit or two, the discretionary review hearing before the Planning Commission if it was requested and the review was requested by the appellant. On february 14th, 2019, the Planning Commission held this discretionary hearing and approved the project at and to move it forward as proposed. On september 5th, 2019, the Planning Department then reissued a ceqa categorical exemption for the proposed project. The approval action for the project was either one, a planning Commission Hearing, two, a discretionary review hearing, if the d. R. Is requested before the schedule planning Commission Hearing. A discretionary review because requested by the appellant and on january 9th, 2020 the Planning Commission held the second reviewing. The Planning Department has now whether this ceqa exemption is valid. They have meetings with the representatives of the project sponsor, the appellant and with the Planning Department throughout this process. The project sponsor and appellant have had multiple disagreements through this process which have failed to be resolved. The one thing i do want to note is that the units that have been mentioned is not involved in this proposed goals. I would always hope that this would be solved at the neighborhood level amongst neighbors and this is not possible in this case. I take the concerns of all of my constituents to try to come up with a resolution to make everyone 457 and i apologize that at this time, that is not something that we are going to be able to do. Our role as a board of supervisors today, however, is only surrounding ceqa. And after conversations with all parties, it is my position that while there may still be disagreements, between the sponsor and the appellant. There is no ceqa and additionally after two discretionary, to move the project forward. I encourage my colleagues to support item 34 and affirm the thank you. Thank you supervisor walton. I dont see supervisor preston . Thank you president yee, i just tried to great some clarification to make sure i understand here. For the Planning Department, will this project eliminate i dwelling unit or not. Someone from the Planning Department and. Id like to respond through the chair and id like to call my colleague. Good even members of the board, planning staff and mr. We cannot find any verifiable evidence of that criteria in our udu screening and it does involve thats not provided by realtors or the Property Owner we count find evidence to verify that. So at 24 point, the project will not remove an unauthorized unit. Is it premised on there not being approximate it was yes theres a dwelling union exit this would remove it, would that render as the a pe appellant contends, would that render the categorical exemption window that make that based on a false characterization. We would not have accurately described the project description but since theres no change being proposed, we added some language and this is the source of the confusion. We sadded some language about legalization of those four rooms which was miss con truced and mischaracterized as a removal of a unit. The legalization is in response to a complaint that was called into the department of Building Inspections and who in checking their records, and visiting the site, identified that the permits were not pulled for the construction of the room. The only legalization happening is getting the permit retroactively and getting it inspects and the way they would have initially. Does that make sense . Supervisor preston, ill add too that if the proposal did remove an unauthorized unit, he is correct the proper procedure possible a conditional use authorization and is not something that we can do administratively. So, in this case, the determination its not an unauthorized unit, you know, doesnt change this procedure but if it was an unauthorized unit the removal would trigger completely different process. Right, why is that unclear and maybe this is a question for the project sponsor. Is there access from the main unit to this area that is claimed to be an independently accessible dwelling unit . This is a garage space and there are two storage rooms and a bathroom constructed in this home many years ago. During the prior to the discretionary hearing someone called building inspection to say theres an illegal unit in there and theyre trying to remove it and this is when removing udu was raised. What is in that space, its unpermitted bathroom so what we are doing now is legalizing that bathroom and were not doing anything physically to it. We added it we modified the plan per Planning Guidance to include the bathroom that had been to get a permit for it. Its a violation satisfies issueissued for anunpermitted be space. What were doing now is were getting it permitted. Physically not touching it or doing anything to that space. Were not removing it or doing anything to it. It will stay the same. This is in your presentation t. You said whether it was or wasnt used as a dwelling unit and i guess im asking directly what was this used as a dwelling unit previously. Project sponsor. Because of the notice of vile race filed from a complaint from a neighbor, we had to bring that area of code and we agreed to do so along with what the Planning Department recommended. Theres no plan inaudible for any of those rooms. We want to keep it as is and just get the permit and get it according to planning says we have to get it. Thank you. I can show new the plan the building plan actually redevelops its more than just a bathroom at issue its a separate dwelling unit with no access and ill try to share this screen now. So, hopefully you can see this on the left side this is the groundfloor. This is in the front behind the bay window is a bedroom with a closet. Theres nothing showing. This is where the illegal kitchen and most importantly, theres no connection between this downstairs unit and the main floor lawful dwelling unit. Thats the criteria in planning code 317 that matters. Even if this person sometimes went upstairs, there is no connection between the unauthorized dwelling unit and the main unit. There are also is a window so you have exposure here and you had a third party neighbor confirm this was an unauthorized dwelling unit. I dont see anybody else on the roster. What ill do is im just going to consider this public hearing held and now is filed. As previously discussed, we will take up a consideration with the categorical exemption and determination and which involves whether the determination from further vinyl review was appropriate. The Charter Amendment will establish a Sheriff DepartmentOversight Board of several members who show training and orientation on custody stowed yall Law Enforcement and constitutional and policing and procedures. This body will appoint and expect the general and the Sheriff Department to evaluate the work of the Sheriff Department and compile and recommend Law Enforcement, custodial and hear public input regarding the Sheriff Department operations and jail conditions. This body will receive, review and investigate complaints against Sheriff Department employees of assaults and any debt. This body will investigate the deaths of all individuals and custody of the San FranciscoSheriff Department. The body will also develop and recommend to the sheriff the use of force policy and comprehensive internal review process for all use of force and critical incidents. Quarterly reports will be submitted to the sheriff and the Sheriff DepartmentOversight Board, reports will include a anybody and types of complaints filed, training analysis and the outcome of each complaints. Lets get this important oversight of the Sheriff Department on the ballot as the Charter Amendment in november and i just again want to thank all of you for your support and your work on this and this is a culmination of over a year of folks woking together to come up with the best policy for independent is over sight and investigations of Sheriff Departments misconduct. They reached out to support this effort and work hard to bling us to this point. I would also like to thank chief scott for his engagement communities are calling on us to change our course. And we must be unwavering in our commitment to ensure accountability and transparency and this would require the Police Department to submit the thorough assessment of a staffing and workload to the Police Commission. The commission make recommendations based on the findings of the report to the mayor and the board of supervisors. Second, it would remove a requirement that sets the minimum Police Staffing and it gives the city freedom to make policy decision to reimagine and improve Public Safety services. Its important to spend a moment reviewing the history of minimum staffing level so that so that we are all clear about where the number comes from and 25 years ago, voters approved what we at the time opposition d and instead of minimum staffing requirements of 1,971 of dutysworn Police Officers. This number we continue to rely on today was never at any point, based on the department workload. The number actually first appeared as part of the Settlement Agreement for a discrimination classaction lawsuit in the department of justice required that city increase warn staffing to 1,971 and maintain that level of staffing for three years. To allow for more affordable promotional opportunities within the department for women, black, latin x and apa staff. This staffing level reflected the total number of authorized positions in the department at the time of 1979. That staffing i also want to be clear that when we talk about Police Staffing levels, we all talk about just a number, that is far from the sole focus of or purpose of the regular low assessing staffing and the department. For example, staffing decisions impact which neighborhoods have more officers than others and how quickly police are able to respond to emergency calls and in different neighborhoods. Staffing decisions impact how well Police Officers no and staffing impacts how accessibility Police Services are to immigrant communities. And Community Members with limited english proficiency. To create a thoughtful process for determining Police Staffing levels, that can actually prioritize the needs of our communities, we need to remove the handcuffs that the mandatory minimum staffing requirement has placed on san franciscans and also on our budgets. I wanted to say some quick words about item number 22. Unlike many parts of San Francisco, our district does not have or has not had any family Affordable Housing built in the history of this district. We have one small tiny housing authority, a 10unit building. But this would be the first family Affordable Housing built in the history of district 11 in the heart of the excelsior. There is an old funeral home at least 75 million, a result of the issuance of these bonds, a result of the hard work that we put in with the community. Bridge housing, the neighbors. And many, many people involved in this project over the last id say five years, but the 3 1 2 years that i have been in office. I want to particularly thank mayor breed for coming in last year during the budget process and chair sandy fewer for supporting that effort and colleagues for supporting that effort, for putting 30 million of our citys money into this general fund money which was then switched out, originally going to be one pool of eraf and it was switched to a bond, Affordable Housing bond money this last november. But that particular gap allowed us then to move aggressively and save a couple years on this projects development. We have a few projects in the pipeline. One private development of 50 affordable that many of you supported that will actually be the first. But this would be the first 100 family Affordable Housing. So i just wanted to call it out at 4840. To thank the mayor for her strong commitment to district 11 and thank you to all of the colleagues that supported that allocation last year. And that is what allows us to do what were doing today and move so aggressively where we will begin this fall in prepping this site for a groundbreaking and moving forward with the development of this site. So thank you, colleagues and thank you for your support. Supervisor peskin thank you, supervisor safai. I see that president yee is back, but while i still have the chair for just a hot second, i would just like the Mayors Office of housing to ed few us on the Revenue Bonds as they relate to 12044 mason and 777 broadway and 15251529 grant avenue in the Northeast Corner of the city that i happen to represent. And with that i hand the gavel back to president yee. President yee miss chan, are you there . Yes, yes, supervisor peskin could you elaborate, you want me to address the effect of this project . Supervisor peskin so, miss chan, as you know, and as the new head of the Mayors Office of housing and Community Development knows, i want to use these opportunities for this unit of government to explain to this board, but more importantly, the people of San Francisco who watch this what these instruments are, how they work, what the indebtedness means, what these projects mean. Like, for instance, 777 broadway has been an Affordable Housing project for most of my adult life. So if you could actually explain this. I mean, we wrote these up every time they come to us, but we never used this as an Educational Opportunity to explain not only to those of us who voted on them, but to members of the public precisely what these instruments are and why we do this. Sure. So these are three and for items 20 to 22, these are existing Affordable Housing projects, including the three sites that you named in that item. And theyre applying to the state California Debt Limit Allocation Committee for an award of tax exempt bonds which are used to finance the construction of these sites. San francisco is the issuer of the bonds. Were not within these items were not asking for the board to approve any city dollars for the funding of these sites. But we are asking the board to approve of the projects being able to apply to the state for this tax exempt bond financing that is required in the federal requirements of the bond the bonds program. So the board and the Budget Committee have seen many proje projects see disapproval because most Affordable Housing projects are financed with tax credits and tax exempt bonds. And the 4 tax program and the tax exempt Bond Financing Program is the primary means by which we fund the projects. Largely because they have been for the most part noncompetitive, but we are seeing with such a high demand for Affordable Housing across the state, we are seeing that the bonds are have started to become competitive this year. So just in summary, again, this is one financing tool for funding Affordable Housing, but it is a very critical one and its just as part of the requirement for accessing, we do need the board to provide approval for the project to seek the awards from the committee. I hope that answers your question. Supervisor peskin see just so were clear through the president to miss chan, this is not the creation of any new housing . This is in essence a refinancing . That is correct. Which would allow the project to do rehabilitation work. The project to do rehabilitation work. Supervisor peskin and relative to item 21, whats that rehabilitation work consist of at 7777 broadway, 15251529 grant, 1204 mason . So as you will see in the file that there is a project description which describes the rehabilitation work which includes those exterior work building lights and improvements, including life safety improvements, as well as common area improvements and unit specific specific unit improvements. Colleagues, so items 39 to 41 as set forth compromise a package of legislation that seeks to rezone the area around Market Street and van ness at that intersection known as the hub. My office, along with supervisors haney and ronen, have worked closely with the central citys coalition to bring to the board the amended legislation thats before us today. And the legislation limits the zoning changes for the hub to three sites that have gone through an Extensive Community process. Mainly, the project sites at 30 van ness, 10 south van ness and 98 franklin. The result of which has been a considerable package of Public Benefits. With full support from the community, we if we pass this, it would essentially be fast tracking the necessary changes for these three sites in phase one, something that is also strongly urged and supported by our labor allies. At the same time wed also be taking the time we need before moving forward with the rezoning of the rest of the area. We are pausing the remainder for really a specific purpose, which is as discussed extensively in committee, is to allow a thorough race and Equity Analysis on what the effects will be, particularly on communities of color of the complete hub plan. The process to scope this analysis is already underway and it is our intention to allow no more than six months for the completion of this process. Its important for stakeholders on all sides and that nothing in the full plan has been rejected at this point. Rather, by duplicating the relevant files as we did at committee, we have effectively kept the broader discussion in committee while moving forward with the projects that are in the process of entitlement and have offered to the Community SignificantPublic Benefits that i will not detail here today, but are extensive. I do want to note one thing that is widely covered in the media that i think that is really very significant. And that is that as part of the Community Benefits package, the developer of the 10 south van ness has agreed to allocate their Affordable Housing obligation to a land dedication for the purpose of creating 100 permanently Affordable Housing. And among the sites being considered is 1979 Mission Street. Known as the monster in the mission. And we are really excited by the possibility that the monster in the mission may yet become what activists have called the marvel in the mission. What supervisor ronens office has worked so hard to ensure, along with so Many Community activists. So i want to be clear that the city approvals dont require the developer to acquire and develop that specific site, but, nrms, nonetheless, we know that todays approval is a crucial step in the efforts to secure a 100 affordable site. And if this were to come to fruition at 1979 mission it would really be an incredible win and a testament to the power of organizing for the Mission District and for the housing Justice Movement at large. And in particular for a neighborhood that has suffered the displacement of more than 8,000 latinos over the past decade. To lay the groundwork for 100 Affordable Housing project envisioned and articulated at the marvel in the mission would really be a milestone to this city. So i think overall the package before us today represents a sensible balance, one that effectively green lights some 1,644 units of new housing, a significant apportion of which is affordable, and much of that deeply affordable. While really listening to the demands of the community to elevate and to Center Important considerations of race and equity before moving forward with the remaining parcels. I want to note as my colleague, supervisor peskin, said in committee yesterday that really the significance of of what we see as a paradigm shift here in how we as a city pursue and approve major developments. We need to bring in Community Groups in the process and make sure that as benefits are conferred to building this city, that we do that with the support of Community Members. In particular, communities of color. And i just want to recognize how throughout this process that the community has led this package that we see before us today. I want to thank the central citys coalition, in particular john and angelica and la i. R. S. , and david woo, and tess wellborn and astasia, and many others who worked so hard on this as part of the coalition and helped our office to move forward with this balanced approach at this time. And i also want to recognize and thank the district nine office, abbey of the district 6 office, my colleague supervisors haney and supervisor ronen and kyle smeeley of my office for all of their work to bring this package forward. So, colleagues, i urge your supports for items 39 to 41 today. Thank you. President yee thank you, supervisor ronen . And to supervisor haney, for all of your work on this as well as your staff and the amazing amy in my office who has been working very hard on this. I want to add my voice of support for what my colleagues have already expressed or what supervisor preston already expressed today. This amended package of legislation is a win for San Francisco and truly signals a change in how we plan the development in our city. So with our vote today were taking the practical step of green lighting three Major Projects that are ready to proceed following the intensive Community Input and with the Community Benefits. At the same time, we are passing a framework for the remainder of the hub with approvals of future projects to be phased in following an Equity Analysis already underway. We cannot continue to plan for the future of San Francisco without an honest assessment of the reallife impacts of communities of color and lowincome and lowwage workers and Small Businesses. Once we have that information, we cannot put that report on a shelf and the impacts cannot be mitigated or theres overriding mitigations that force us to overlook the damage. In june, there was a powerful resolution acknowledging the harms to the communities of color due to historical and presentday planning and zoning policies and committed to a bold and forwardthinking strategies to advance racial and social equity in San Francisco. We must once and for all not only study but absorb and integrate and utilize the information so that development enhances economic opportunities, protects and expands Affordable Housing and preserves cultural districts. This hub will be our first test. Thank you so much, colleagues, and i hope that you will all support today. President yee sprrv supervir haney. Supervisor haney there we go. You know, i just wanted to echo the comments of my colleagues, supervisors preston and ronen. The hub, of course, kind of sets at the intersection of the three of our districts. Much of it falling into my district, including i think two of these projects. And i just really want to appreciate the collaborative approach that weve taken with our three offices and our respective staffs, abbey in my office and kyle and amy and their hard work and all of the Community Advocates and residents and the project sponsors. Its really important that we are able to move forward these three Key Development sites immediately and they will add many hundreds of units of housing, including many units of Affordable Housing. And also as supervisor preston said, theres incredible urgency around one of them that we hope that will lead to the development of a 1979 mission as 100 Affordable Housing, which would be a huge victory for not only the mission but for our entire city. So i want to thank again my colleagues and the staff from planning and all of the Community Members and the central city coalition. We had a lot more work to do. And i think that once we receive the results of the race and social equity study we will be able to ensure that the next steps of this provide most Equitable Development plan possible for this growing part of our city that, this hub area plan will really determine the future of. And so thanks again, supervisor preston, for this for your leadership and supervisor and chair peskin as well that contributed extensively in committee and supervisor safai. Thank you. Theres a lack of Public Schools in that area and im wondering if that has been on your radar because that Large Development area, as you know, is not residential before. So i think that supervisor haney knows full well that there is really a lack of Elementary Schools, middle and high schools in that area. So i would hope that you are working very closely with planning. I have mentioned it many, many times to planning when they are briefing me on this plan that theres a lack of educational public Educational Opportunities there. So i just wanted to make sure that as we are building a whole new community there that we are not forgetting the importance of Public Education and the accessibility to schools in that area. Colleagues, today im introducing the nogovernment rackets or fraudulent or transaction act known as the no grasp act which will close several loophole necessary the citys contracting process and increase oversight over how contracting is conducted. Ongoing local and federal investigations have made clear that we need more accountability from city departments. The no grab act will be a step forward to safeguard taxpayer dollars. This proposal will amend the administrative code and close the loopholes that former direct workers used to have contracts to recipients without solicitation, documentation, evaluation or oversight. It creates a new strict set of rules governing the use of prequalified contracting pools, and as needed professional Services Contracts which give Department Heads broad discretion to direct certain kinds of contracts to specific individuals. And which has been ripe for abuse. According to a recent report from the city auditor, the former director of public works used these contracting tools to issue over 150 contracts totaling over 250 million over the last three years. This represents over 90 of the contracts public works issued, 90 . The no grab act will set forth minimum standards for all city departments that seek to use these types of contracting tools. It will require departments to solicit bids publicly, evaluate these bids using fair and objective criteria, retain all related documentation, and provide copies to the office of Contract Administration and the controller for oversight and review. By making these necessary changes, the no grab act will bring our contracting procedures in line with nationally recognized best practices and it will eliminate opportunities for abuse. San franciscans should not have to wonder whether their taxes are being used for corrupt purposes. And as elected officials, our primary responsibility is to be careful stewards of our resources and, of course, the public trust. The no graft act will move us closer to restoring that trust. I would like to thank the city auditor mark delrosa and the attorneys for their help drafting this legislation. And i look forward to seeing it pass in the future. First, along with supervisors peskin and haney, i wish to introduce a resolution in support of sb797. This resolution would allow for a dedicated funding stream for caltrain. In its prime precovid19, it carried 60,000 people a day for weekday commutes, up and down San Francisco, the peninsula and the silicon valley. Every year San Francisco county and mateo county and Santa Clara County has millions to fund the rail system with no dedicated Funding Source across the country. This resolution allows a tax on the ballot for november to commit to changes in the governance structure so theres shared accountability and sharedditioshareddecisionmakingd to ensure 100 million a year for caltrain operations. You may have seen media reports and social media discussions highlighting the fact that there are concerns from San Francisco and Santa Clara County about the fact that the sanmateo Transit Agency has been the main for caltrain for years. And that the c. E. O. Is also the c. E. O. Of caltrain by default. We, supervisors peskin, haney, and i, have been working hard to keep San Francisco and caltrains best interest at the forefront. We are excited to introduce this resolution that would provide for a dedicated Funding Source and make sure that the voters and residents of San Francisco have a voice in the management of resources and leadership for the railroad. After all, San Francisco and Santa Clara County will provide close to 80 of the revenue generated for caltrain from this proposed tax. I want to thank our colleagues and leaders and Santa Clara County, especially supervisors cindy chavez, and san jose mayor locardo, and mr. Fernandez, and Assembly Members and the City Council Member deb davis. Also Assembly Members david chu and senator scott wiener, our very own mayor london breed, and c. T. A. Director chang, who has been working tirelessly on this in the past few days. I am ashamed that the caltrain staff are actually spending our funds from the taxpayers of San Francisco and funds from the taxpayers of santa clara, running a Political Campaign rather than coming to the table and having a discussion that we all want to have about shared governance and the future of a promising railroad that has and can continue to decongest the highway 101 corridor and be environmentally sound. I do not believe in the 20 years that i have been an off again on again member of supervisors, that i have ever experienced a regional disagreement that has risen to this magnitude. I want to say to our counterparts in San Mateo County that we really want to work with them. This is not a power play by the city and county of San Francisco or Santa Clara County. This is really about having real representation as we go to our voters relative to taxation. But i really want to salute supervisor and commissioner walton for staying the course, for really trying to, pun intended, to get this railroad back on the track. We are not we are not out of the woods, but i think that we are moving forward and supervisor chavez and mayor locardo are moving forward with something that hopefully our counterparts in San Mateo County will embrace. And let me be clear the notion that this railroad is about to be bankrupt is a manufactured notion. And even if that were true, and it is not true, let us be clear 80 of the tax base that we are being asked to bring to our voters comes from Santa Clara County and San Francisco county. Precovid precovid, this railroad actually delivered less people than the jay in our city. Lets be clear, this railroad ran 92 runs a day. Today it runs 70. It used to deliver approximately 63,000 people. Today it delivers about 3,500 people. And our sfmta have made command decisions to eliminate temporarily maybe for many years maybe forever 40 bus lines. The demands that are being brought to us by caltrain are not equitable as a matter of race, as a matter of income, or as a matter of geography. Lets get this right. To our friends in San Mateo County, this is an opportunity. Please understand that we want to work with you. To supervisor walton, thank you for your leadership. As you know we have been working very hard, day in and day out, including nights and weekends, as a unit. And what we have here i think is something that will obviously be beneficial to our voters here in San Francisco as well as to caltrain. And a dedicated Revenue Source is important, but we also have to make sure that our voters have the opportunity to be able to be responsible for the decisionmaking and that is something that is important. They have to have a voice at the table. With that said, i have my first in memoriam. And today im proud to honor the memory of Christopher Alexander wyatt. Chris was born in lufkin, texas, in 1981 and moved with his family to San Francisco when he was 10 years old. A big part of the district 10 community, chris graduated from George Washington high school and took his first job as a laborer and a proud member of the labor union, local 261. Later in life, he became a member of the teamsters and worked as a truck driver until his illness made it challenging for him to continue to drive. Chris was a devoted father and husband, who loved spending time with his family, especially outdoors under the sun, and the day and the stars at night. He was very adventerrous an advd liked fast cars. Meeting and seeing new things and people gave him so much joy. His quiet demeanor and generous spirit was one of a kind. He was courageous, determined, supportive, loving, and dependable. And he will always be remembered by those who hold him dear. Chris is survived by his wife, hattie, and his three sons, and his daughter heavenly. Our prayers are with chris family and we lost a precious soul all too early. The second in memoriam and this is on behalf of the entire board of supervisors, via president yee, and i want to thank president yee for honoring congressman john lewis at the beginning of our meeting. I stand in honor of one of our countrys most influential leaders and one of my own personal heroes. Congressman john lewis. So many of the rights and freedoms that black people across the country experience today are because of john lewis work and passion. And for this unquestionably john lewis will forever be remembered as an icon, a visionary, and a legend in the fight for Racial Justice. His story starts with his Humble Beginnings in troy, alabama, where he was one of 10 children born to sharecroppers. From a very young age by virtue of his skin color, he was forced to face and confront the deepseeded issues of racism and inequality in america. He studied at segregated Public Schools in alabama. He saw how racism continued to play out in his Community Despite legislation change. And whenever he fought back to challenge these oppressive systems, he was met with resistance, violence, and pure bar barritbarbarity at times. Despite this, he kept standing and inspired by Martin Luther king jr. And nonviolent demonstrations from a young age, he fought hard for the principles of Racial Justice and equality, while passionately advocating for nonviolence. In nashville, tennessee, he led sitin demonstrations at segregated lunch counters. He participated in freedom rides across the south, sitting in seats that were meant to be for white customers. He organized drives for Voter Registration and with each of these struggles as his influence grew, so did his recognition. Between 1963 and 1966, he served as chairman of the student nonviolent coordinated committee, known as snvk. And he led a number of student events. Soon after the entire country recognized him as the powerful and influential icon that he truly was. In 1963, he was dubbed as one of the big six leaders of the civil rights movement. Joining a number of other powerful leaders such as martinn luther king jr. , and james farmer, a. Philip randolph, boyd wilkins and whitney young. He was the youngest speaker at the 1963 march on washington. Which he also coorganized. He led the historic march in selma, alabama, in 1965 with Jose Williams on the edmund petis bridge, fighting for voting rights. He was associate director of the Field Foundation and the director of the Voter Education project. President jimmy carter appointed him to direct 150,000 volunteers with action. He was elected to the Atlanta City Council in 1981, which was followed by his election to congress in 1986. And, finally, his position as u. S. Representative of georgias fifth congressional district. He was awarded the medal of freedom, the lincoln medal, the golden plate award, among many others for his commitment to Public Service and for fighting for different communities. However, more than having undeniable charisma and passion, congressman lewis instilled hope and inspiration to millions of people around this country. His spirit continues to live on in the institutions that he was a part of, the communities that he touched, and the people that he served. One of my greatest moments is when the members of the community brought congressman lewis to San Francisco, and i had a moment to personally meet him and thank him for all of his work and his fight in allowing me to be in a position where i can do something similar. I would like to close by reading one of his most remarkable sayings. You must be prepared if you believe in something. If you believe in something, you have to go for it. As individuals, we may not live to see the end. And though john lewis did not live to see the end, we must ensure that generations that come do have that opportunity. We must ensure that his image of a just and free america is fulfilled. As a city committed to serving our communities, San Francisco promises to continue to honor his legacy. Seeing the world with his optimism and hope and moving through the world with his passion and grit. Fighting in the world for his vision for a just and completely free and equitable america. Which would restructure the infrastructure and Economic Development bank as a publicly owned state depository bank. This restructure has moving funds from the pulled money investment account to the i bank fund and to allow increased lending and credit offers to credit unions, local governments and Small Businesses harmed by the economic recession. I have been working on the issue of public banking for over three years now. And though as a result of the resession we may not be able to make such progress as i hope before leaving office, but i have not given up hope. This moment requires us more than ever to rethink outside of the box, outside of the box in terms of financial models that serve us and serve the public. This moment is forcing us to look at the transformation system and to make sure that the public good is a priority and make sure that our most vulnerable residents get their needs met. Large banks are not meeting that threshold so its imperative to move this work forward to a supportive system of public banking. Im appreciative of our state representatives for leading at the state level, and i hope, colleagues, that you can all support this resolution. The rest i submit. Clerk thank you. Supervisor haney. Supervisor haney thank you, madam clerk. I have a few items. First, today along with supervisor walton and hillary ronen, we are introducing the right to safely protest act. This was the announced intent around this for a few weeks ago, and it took a few weeks to figure out details with the City Attorney. This legislation is long overdue and necessary, especially in light of what we have seen happening in the streets in response to massive and widespread use of dangerous impact weapons, chemical sprays and military equipment to disburse peaceful protests. Law enforcement officers across the United States have deployed military equipment and crowd control weapons such as chemical agents, rubber bullets and extended impact weapons and energy projectiles. While these weapons are referred to as nonlethal or less than lethal alternatives to the use a firearm, research and investigations have shown that crowd control weapons often cause severe injury and in some cases death. A recent aclu study entitled lethal in disguise showed that there were incidents between 1990 and 2015, 1,025 people injured from impact projectiles. 53 individuals died and 294 suffered permanent disabilities. Of the injuries, 70 were considered severe. The aclu study relies on medical literature that indicates that kinetic impact projectiles cause injury and disability and death. The Police Departmenta use of force is governed by the general order 5. 01, and the use of force policy, which was overhauled in 2016. And generally allows the use of certain weapons. In july 2020, the Police Commission amended the portions of the use of force policy but they did not address the use of many of the weapons that we will address here. But the general order 8. 03 and 8. 10 specifically addressed the Police Officers conduct and investigations during lawful assemblies but they do not regulate the use of weapons or militarygrade equipment during lawful assemblies. Currently the city law does not specifically address the Police Departments use of certain weapons and militarygrade equipment during lawful assemblies and in other circumstances. So the right to protest safely and to protect re residents from inhumane tactics, to prohibit the Police Departments from using deploying and lawning or firing the weapons and the kinetic impact projectiles and chemical agents and disorientation devices during a Lawful Assembly protected by the First Amendment or in response to a violation of a curfew or a verbal threat direct ad an officer or noncompliance with a directive. We saw in our city and we than we will continue to see our residents step out to demonstrate and to assert their First Amendment rights. They need to be able to do so peacefully and they need to be sure that they are not going to be injured or worse when they are doing nothing more than asserting their own rights and speaking out. Military weapons, chemical sprays, rubber bullets and pepper balls and flexible baton rounds have no place in our citys demonstrations. We know that even across the bay in oakland that many residents, including some san franciscans, were injured by tear gas and other types of projectile weapons. Even though San Francisco has been a leader in many ways around how we have put forward limitations on use of force in department general orders, they do not go far enough and they are not clear enough when it comes to banning the use of these sorts of weapons for crowd control. This legislation is absolutely necessary. And it will protect our residents. Thank you again to supervisors ronen and walton for cosponsoring. Im also introducing a hearing on vacancies in the citys Supportive Housing stock. For six months, beginning last september through february, i cochaired monthly meet iings wh over 25 Homeless Service and Housing Providers with the mayor and the department of homelessness to identify some of the most egregious gaps in the homelessness response system. The issue that came up nearly every month was vacancy in Supportive Housing and how we are effectively helping people to move through the system and into housing. Commitments were made to have a vacancy rate of less than 3 and improving the referral process and timeline, including get ployment of a new tracking system for vacancies and creating one central housing application. However, throughout the meetings and in the many months since, the department has still not produced a total number of units that continue to sit vacant and the changes to the process have not been transparent. Moving people into Supportive Housing is critical and while i know that the department of homelessness recognize this is priority and has been working to address it, its critical that we bring this issue to public light. And that we get updates and how we can support and help. I was very happy to also to see the announcement today from the mayor and the department of homelessness around the 6,000 housing placements. And what we want to make sure is that to the extent that th exten make vacant Units Available quickly and get them inside, we should take advantage of that, especially during this pandemic. The last thing they want to share is just, again, to appreciate the work of supervisor walton and supervisor peskin and your partnership on bringing forward this resolution today on the caltrain measure. You know, its absolutely critical and essential that we fund caltrain, that we secure a dedicated Revenue Source. Residents of my district rely very heavily on caltrain to get to and from work. They absolutely want to see this measure on the ballot, as do i. And i think that its a time that we dont retreat from regional rail, but we double down. All over the world were seeing the growth of rail. Were seeing support for trains. And i think that its crucial that this body stands up and offers the opportunity for our residents to support caltrain and regional rail. We are seeing an opportunity for huge expansion. I have in my district a Sales Force Transit Center which is right now the worlds most expensive bus station. And we want to bring trains to the transit center. We want to have the downtown extension. We have a huge amount that weve already invested into this system. And as we invest, we should also do it in a smart way that ensures adequate and inclusive accountable governance and so i believe that the comp myself that we have in comp myself that we have in front of us is the right one and, again, i think sfsta and our delegation and especially supervisors walton and peskin. I believe that this proposal is one that the other counties and the other bodies that need to vote on this should should vote on this identical version. And we should all move Forward Together and get caltrain funded and supported and put this in front of voters. It is needed. And the governance changes are critical and the funding is absolutely essential and im blaglad that well have a commie of the whole and discuss it further and discuss it with the public next week. We are introducing this request for legislation to raise minimum Health Care Standards for more than 9,000 workers that are servicing San Francisco international airport. The healthy airport ordinance will guarantee the assurance to families who are unable to afford individual or family plans offered by their employers. The healthy airport ordinance will amend the 2001 Health Care Accountability ordinance to require that San Francisco airport employers provide Service Employees and their Families Health insurance that meets minimum standards under the Affordable Care act. At no cost to the employee. And regardless if the employee lives in San Francisco or works onsite at the airport or pays into a reimbursement account for employees. Now politicians often talk about how we do this method, but this pandemic has made that connection very, very real and very, very clear. When one of us gets sick, all of us are at risk. This is especially true at San Francisco airport where workers are on the front lines every day, risking their health to allow the Airport Passengers to travel in and out of the bay area safely. Yet thousands of airport workers are uninsured or underinsured, depriving workers of access to the health care they need to protect themselves, their families, and all of us from contracting covid19. For far too many airport workers, employer provides the Health Insurance is so expensive that even basic coverage is out of reach. Those covered by employer provided plans, the high price of copays and deductibles mean that workers forego the necessary or Urgent Medical needs because they cannot afford to take on thousands of medical debt. And far too many cannot afford family coverage and leaving spouses and kids and other family members without insurance. This state of affairs is shameful. It is also dangerous for workers and passengers alike. We know that the pandemic is hitting communities of color with particular brutality here in San Francisco in the broader bay area and across the country. S. F. O. Workers overwhelmingly are people of color, do essential jobs that put them into close contact with travelers and residents that are required to work in enclosed space where is it can be difficult to maintain social distancing and other safety protocols. They work with security checkpoints, attend to guests in wheelchairs, prepare inflight food and beverage, clean the terminal and airplane cabins and more. The pandemic puts these workers and the guests they serve at significant risk. As of july 20th, at least 76 workers at s. F. O. Have tested positive for covid19, more than two dozen were forced to selfquarantine without pay after their workers became infected. As we rebuild our economy and welcome visitors back to San Francisco and the bay area for the health of our workforce and our economy and all san franciscans, we need every airport worker to access to quality Health Insurance and we cannot afford to wait. I thank supervisor walton and the thousands of underinsured s. F. O. Workers who put their lives on the line every day to their job. Including the cabin cleaners, luggage handlers and janitors and Security Officers and wheelchair attendants. And the rental car staff, teamsters 2785, Truck Drivers and the local catering workers. Colleagues, i hope that we will have your support as we bring this legislation forward in the coming weeks and i believe that supervisor walton also has remarks to share. Clerk supervisor walton. And so this healthy airport ordinance is going to make sure that, one, that they have the access to Affordable Health care for not only themselves but also for their families. And i just want to again to say that my heart goes out to all of our essential and frontline workers that are out there every day continuously going to work and continuing to be exposed, continuing to have to earn a living while their families and communities are also exposed. And so the least we can do is to make sure that they have the health care that they need as theyre on the frontlines being exposed on a daytoday basis. So im happy and proud to support this ordinance and cosponsor this ordinance with supervisor mandelman and looking forward to providing this health care through the ordinance and working with everyone to get this done here at the board of supervisors. The resolution that im introducing urges the United States congress to pass the real economic supports that acknowledges the unique restaurant assistance needed to survive act. That is known as the restaurants act, yes, it is an acronym, someone should maybe get a prize for that. Across the country, independent restaurants employ 11 million workers and San Francisco restaurants employ 60,000 people. Thousands of restaurants in San Francisco have been forced to close or operate at limited capacity due to our Public Health orders and the Golden Gate Restaurant Association estimates without federal relief that 50 to 60 of San Francisco restaurants may not be able to survive financially beyond november. The restaurants act establish a 120 billion revitalization fund for nonpublicly traded independent restaurants with 20 or fewer locations. And provides grants, not loans, for the losses of the same period from last year, to operating expenses not covered by p. P. E. , and prioritize the minority and womenowned businesses for help. Its introduced in both the house of representatives and the senate with bipartisan support and restaurants across country need passage to have a fighting chance at weathering the impacts of the covid19 pandemic. Maria was born and raised in indianapolis. She described her move west as her journey to truly find and connect with her mexican self. She said when she arrived here, she was finally home. Maria was on department of public staff for more than 20 years. She was most well known for her conceptualship of the whole person care model. Her work has been used by dr. Nigusse bland and many others. Her long time friend, ol olga talamante, described meeting maria in 2004. Her organization had just received a grant for young latinas, particularly around sex education. Maria was working in d. P. H. And said i can help you with that. In addition to her work at the chicana latina foundation, maria previously served on the board as director of the Mission Cultural center and was instrumental in making cultural equity an integral part and criteria for the San Francisco arts commission, funding, and resources. In 2018, she learned that teachers at Mission Education center, a transitional Elementary School for newcomer Spanish Speaking immigrants were spending their own money for christmas presents. Maria kicked off a regalitos, a fund raising drive, making sure that each children received a pair of shoes, a gift card for their parents, and a gift list especially for them. She wanted to be sure that children knew that there were people fighting for them, that they were not alone. Maria was a fierce and giving friend, a mentor and a guide, always serving for a purpose, always a voice for those most underrepresented. She insisted that those being served had to be centered in the development of solutions. She was so raidian, so full of laughter radiant, so full of laughter and joy. She will be sorely missed. Maria, may you rest in peace. Before i talk about my second introduction, id like to pass the mic to supervisor shamann walton, who also had some words on behalf of maria. Clerk supervisor walton . Most people in San Francisco regardless of their employment or [inaudible] supervisor ronen many families do not have reliable Internet Connection or technological devices to have access to consistent learning opportunities. Now, what was he doing . He was a nice looking young man, very polite, and well dressed, even, but confused mentally, and he was about to enter this device that was left by a contractor somebody elses contractor that had big signs on all side that said honey bucket. So he thought he was going to use it for the intended purpose. Down comes my neighbor from the fourth floor, shouting thats private property, and im going to lock it, etc. I came along just in time for the question, and i said hes not going to call the police because hes already done that twice, making a false Police Report, and a false Police Report is a crime. I asked my neighbor if he was aware of the curin ordinance. I read a report that more than half of these People Killed by police could probably be people with mental disabilities. Now that im married to a man from india, i feel the dread that it could happen again, and the early stages genocide have been happening over a number of years, including erasing indian history, burning muslims arrive just on the rumor that they ate beef, destroying Christian Churches and even shops selling valentines day. Its happening to the muslims from western china and the population of myanmar. Im very excited to be the first person to speak in support of the resolution to promote medical and Scientific Collaboration between San Francisco and cuba, number 200773. There are many of us who have been waiting to be able to speak. I hope many of us will be able to share why we think this is such an important resolution for you to pass unanimously. Last july, i visited cubas center for bioengineering in havana, and we learned then from the director of the center about cubas impressive Biotechnology Program beginning in the 1980s. We heard about many of the unique medications and treatments that the center has developed, including medications which prevents diabetic amputations and the many antiviral medications. We also learned about the rigorous classes used for enrolling people in Clinical Trials in cuba. Little did we imagine that eight months later, one of those medications, the interferon alpha 2b would become a frontline drug in the fight against covid19, used successfully in china and requested by countries around the world. This country, the u. S. Blockade against cuba, prevents this medication from being imported and others, affecting communities hardest hid by the virus. My name is bruce agman, and for identification services, im a resident of mission bay, and i have served on a variety of transportation advocacy advisory working groups or committees. Im speaking in support of the resolution placing the eight cents sales tax on the November Ballot to provide a stable Funding Source for caltrain and agree with representatives of santa clara and San Francisco counties that conditions addressing government and oversight must be incorporated. Although there is a joint powers board providing oversight to caltrain, it has a unique structure. Im sure at time of conception, this was considered an optimal framework. However, over time, participating members have identified oversite and best practices that will provide more effective oversight. There are tough times ahead. Prior to the pandemic, the funds were stretched to the limit. With focus on oversight and guest best practices now, they will hold the agency now that optimally meets the need of the contributing counties. This resolution addressed the core needs of caltrains operating in the immediate future and to substantially expand service as needed. I urge san mateo to embrace the measure, pass the measure, and get it on the 2020 ballot. Our of our counties should Work Together to make sure that the resolution on the ballot is sound, and by voting yes, is beneficial to all constituents, whether someone likes caltrain or not. The minutes, i think, inadequately expressed the concerns we had. It said we expressed concerns regarding essential services and not now being provided by the public library. It sounded like there was concern about what was provided. We were concerned with whats not provided, and we went onto say that we believe there is a need for and no plans for full restoration of not just services, library services. And id appreciate if you would add those few words to make the summary of our comment more accurate and more representative. For your information, the library has a 160 million budget and doesnt even have Curbside Service yet. It has no plans for full restoration of the library, and we also commented last time on the fact that, for example, there are no specific plans at all for noncirculating materials, such as newspapers and magazines, which i think are essential for public citizenship and understanding of whats going on, particularly these days. We also commented about very unhappy librarians expressing their concerns with regards to their dangerous assignments as disaster workers. We also talked about problems of city college, closure of fort mason, the new elimination of the older adult program, which we think is age discrimination. I really hear what it means to be bringing on genocide across indias most vulnerable communities. The government is bent on created islamophobic policies thats going to create the largest Homeless Population in the world. Legislation is going to bring on an Important Convention thats going to be international condemnation, and San Francisco will not support the indian governments persecution of muslims. The u. N. Has already said that the c. A. A. Is fundamentally discriminatory, and the u. S. Commission on interreligious freedom, it is recommending that the u. S. Government should consider sanctions. This resolution will be an assurance to the entire bay area south Asian Community that you all will continue to welcome the most vulnerable. There are so many survivors of genocide who live in the bay area. This is vital to know that San Francisco is a sanctuary see for all city for all south asian americans.
