Each and every one of these people that came up here and explained why they want this, to have this type of protection, they are also crying out because it is their source of income in order to support themselves. This proposal, to displace them, is an example of gentrification. Gentrification is a word that is used to discriminate against people based on geographical locations. You are doing it to them, and even though their skin color is not black, it is the same type of treatment that black people had to suffer in the Western Addition of fillmore. For example, gentrification in washington is taking place, there is an attorney that has the same type of philosophy as me and suing washington, d. C. For the gentrification and displacement of tenants for hightech people that is displacing lower income bracket people. This is a derivative of this kind of demonstration that im putting before you. Cant get you on discrimination based on race, but you are violation their due process and equal protection under the law. It is not equal protection under a law by allowing a hightech company to come in come and stop negotiating the contract on continuing them to survive and support themselves by letting a hightech company like twitter come in and displace them. Youve got numerous Small Businesses that went out of business and have been displaced and boarded up. Then you turn around i want to find the owner of the Apartment Building complex because the tenant cannot afford to pay rent there. Youre doing the same thing all over again. So, this measure, that man is proposing needs to be in effect and should have been in effect when jennifer took place in the fillmore. Next speaker, please. Im speaking on behalf, i am nina miller on foztwo two attorney and i represent Todd Crittenden from whom youve heard earlier and his brother dave, i been a long longtime attorney. Im representing them and their brother scott who owns a building. We have heard a lot here today about the hardships of a Small Business. There are two people here who know that very well. Dave and todd have worked very, very hard since the 1960s to keep their Small Business alive in San Francisco. They are really looking to move that to the upper floor, that they lost during the downturn in the 1990s. Their hearts, i know, go out to everyone who is working to support a Small Business. I have submitted a letter on friday, i have never done this before. I want to make sure i get it correctly, i will submit another copy today outlining our concern and i will submit this to the clerk of the board when its available. The zoning control, one of our concerns is that the zoning control before you today we dont believe that this is properly drafted interim zoning control resolution or that the subject matter of this qualifies for the interim base. The impact on public health, safety, general welfare, i think its important to look at those in terms of the business that is trying to move in there is also the issue of the fact that they do have the recorded lease with micro biz to move into the upper floor, and this would presumably prevent that from happening. Thank you, counselor. Next speaker, please. Good afternoon, supervisors. My name is jim vargas. I was born and raised in San Francisco. I think we definitely need to find a way to save mezzanine. Its been an incredible place for artists musicians, to continue to do their work. Losing mezzanine is going to mean a lot to the city. It is one of the only major independent venues of that size capacity. It also gives us an opportunity for a lot of the younger acts coming up to the city to perform there. To play with her their idols and get them on bigger bills. We need to save mezzanine for many different reasons, but to keep the spirit of San Francisco ally. Thank you very much. No other members of the public for this item. Let me close Public Comment to make a few comments before handing it over to supervisor 15 has sponsored this measure. I want to start with the fact that i introduced a similar piece of legislation, actually much more narrowly tailored as it related to the punchline which i believe is going to result in the outcome that it was intended to result in. This is a much broader Geographic Scope piece of legislation. While much of the testimony has been about one particular venue, this actually covers a wide swath of territory in district six, primarily district six, that is full of available, latenight institutions that are part of the fabric of the city, as many people have testified to. As to the contentions by the property owner, i am advised that this is entirely within the powers of the board of supervisors, somebody who authored a very similar piece of legislation to protect another entertainment venue. I intend to vote for it i want to thank supervisor haney for bringing it forward. Supervisor haney thank you terry peskin. I want to thank every who came out today, and spoke. I want to think, i shouldve said this earlier, folks from the entertainment commission, president of the entertainment commission, is here who has been, and has been working with all of us to try to make sure that the support and protect nightlife citywide. I want to thank everybody from mezzanine who came out today. I think what you spoke to demonstrated why it is so important that we do this. Why it is so important that we not only protect mezzanine itself, but venues like mezzanine. Who have been impacted by this legislation and have reached out and said how excited they are about this. We know that, if we do not do this, the forces that you spoke of will continue to displace venues and change San Francisco in ways that will be very hard to come back from. A venue like mezzanine is not easily replaced. I think we have seen a number of venues over the last few years that we have been unable to replace, they never can find a home in San Francisco. This is something that we take our responsibility to do, very seriously. This is within our powers to say it is because when the interest to have certain types of zoning uses, to have a higher level of specificity or discretion when certain types of things are happening. Particularly when we have seen an area in like soma where nightlife has been critical and essential and we see those venues disappearing. That is where we have to interview intervene for public interest. That is what were doing doing here. You have my commitment to do whatever i can to support and protect these venues, and also that we look for longerterm, more public solutions. It will be a temporary solution and we also need longterm solutions. I want to thank everyone that came out. I also want to recognize and think the cretin brothers and the representatives that are here, as well. I hope the conversations will continue. Item number five is an ordinance to amend the planning at administrative codes to allow north of market Affordable Housing fee is to be deposited in the citywide Affordable Housing fund instead of the north market housing fund. We are requesting this change because we are currently depositing all impact fees into this fund, including other geographically restricted fees. You account for them separately . We will account for them separately. This is an accounting change that the comptroller recommended we change. We are expecting the fees to come. We would not be changing the use of the fees which would be for stabilizing and preserving Affordable Housing in the specialties district. You said everything this supervisor would like to hear. I just also want to share that the Planning Commission heard this item on june 13, during the hearing the commission did recommend approval of the ordinance with a modification to index the fee to reflect todays economy. The proposed fee increase is to change the fee from 5 per square foot up to 25. 41 per square foot. I wanted to reiterate that this cleanup is to make the collection of the north market fees consistent with the collection of other Affordable Housing fees. Each and every time that you come up here, before the mic on the board coming you claim that it is 100 Affordable Housing. Each and every time, its time to put in an application, the lowest income requirement is higher than the income bracket hey you campaign and claim that you want to help. For example, this demonstration that i put before you and its right across the street from Saint Anthonys church. It says Affordable Housing, making it affordable for at least 39,000 per year. The ami scale here shows anybody that is making 39,000 a year, is 35 of the medium. That means everybodys income that is below that bracket, which is a group that is not only homeless, has disabilities in San Francisco, is 28,200 people that is in this income bracket that is not included in the socalled Affordable Housing opportunity. It is disgusting. Hundred nonprofit developer who is putting together 87 unit Apartment Building complex for a mere 64,000 54 million. 144 unit Apartment Building, look at me, please is 144 unit 456 million. Item number 7, 190598 ordinance amending the public works code to modify the requirements for obtaining personal Wireless Service facility site permits; and affirming the appropriate findings. Good afternoon. My name is deborah im here on behalf of public works to give you a presentation related to personal wireless facilities. To expedite [inaudible] the purpose of the code amendments relates to current, state and federal laws to give them the rights to [inaudible] read foz permits much be issued and allow the city to establish objective Design Standards. The permitting process takes 90180 days and does not include objective design criteria. More specificity on the ruling is shown in this light, as you can see the order establishes a 60 day shot clock for existing facilities and a 60 day shot clock for facilities. The purpose of the amendment first and foremost are to comply with the fcc order. Over the last number of months the city departments including the department of technology, planning, public works have been meeting to develop effective and compliant approach to incorporate the fcc order into current processes. The proposed article 25 amendments includes amplification. Maintain master license agreements for carriers and communicate the process alike. This slide shows a sidebyside comparison of timeline. The current process takes 90180 days. The revised process will take 4560 days and reduces the process of referrals to other agencies. I will walk through in detail the current and proposed captured in our 25 amendments. This is the current wireless process. As i mentioned this process does take 90180 days. This slide is the proposed changes that will impact the process. Article 25 amendments to modify the existing permitting process only to include permit. They would similarly review authorizations for wireless abilities on the individual city poles. The permitting process would remain public works to ensure objective Design Standards and how standards are met. The amended process, the carriers would require clearance prior to their application before working with public works. Still refer the application for review. The amended process approved during the protest period. The appeal process would remain unchanged. It would ensure compliance with fcc order. This slide you can see the proposed process for puc. This process which was developed in coordination would comply with the new fcc order as well. [inaudible] a little bit of the objective design criteria. It is causing the schools to shut down. And thinking about shutting down. You have no test results to measure the amount of Radioactive Material that is coming from these towers. About you being affiliated with pg e, that is the worst he could do is be affiliated with them. The fires that they cause with several counties, caught on fire, about 1 Million Properties have been lost, and lives lost with defective equipment and it has just been determined that their equipment was notified, several years ago, that it was defective and it was just a matter of time before a fire would take place at a catastrophe level. They still didnt do anything about it. I further object to the governor providing 21 billion to pg e to help them how their lawsuit area that is a conflict of interest. Youre not supposed to be paying off pg es lawsuit. Just like me, pg e has several different types of insurance, they should not be paid off with taxpayers money from their friends and paid off by gavin newsom because he is friends with pg e. Until there is a Scientific Study done on the amount of radioactive waste that is coming from them towers, and correlating with the health of human beings, particularly kids. We are so excited i am cheryl lynn adams, director of Market Street Youth Services, and we work with young people to 24 who need laundry or place to hangout or come in from outside to get the tools they need to begin to resolve their homelessness. We have lots of programs and lots of educational and Behavioral Health supports that are here throughout the city. We are excited to be here with our partners to launch or to be a small part of the effort to address child trafficking. Larkin street started years ago with huckleberry to fight youth trafficking. We know without intervention on the streets, children are at high risk for trafficking if we dont get to them soon. I think the most wonderful thing about this partnership is the prevention and the Early Intervention and the collaboration and us bringing together so many partners to work on this issue in a very profound way. Were excited to be here and excited to be a small part of it. And i am always honored and delighted to get to introduce our our mayor. Mayor breed has been in office for just about a year now, right tomorrow . Wow. [applause] she has been an active supporter of homelessness, of youth homelessness, of diamond youth shelter, which is one of the our part in this project, and so much more in the city to support young people to help all to help so many of us so many residents in San Francisco thrive, and i am deeply honored to introduce you this morning, so welcome. [applause] the hon. London breed thank you. I am excited to be here. Thank you, cheryl lynn, and thank you to larkin street for all the work that you continue to do to support young people in San Francisco and huckaberry, im excited to have this organization as well as other organizations for partnering what we are announcing today, which is a 9. 3 million grant from the department of social services for the state of california, which is absolutely incredible. [applause] the hon. London breed this was a very competitive grant, and it was awarded to ten partnering organizations who helped to deal with the challenges that we know sadly so many of our young people face around Sexual Exploitation. In fact, in 2017 in San Francisco, we had over 300 reported cases from young people of Sexual Exploitation. And in most cases, they were women of color and women from our lgbtq community. We know that just last year, cheryl lynn and the folks from larkin street, we announced the rising up campaign where we are determined and committed to End Youth Homelessness in San Francisco, investing millions of dollars in providing the kinds of support and Wraparound Services that young people in order to get their lives on track. We know that all young people may not have that safety net, may not have that support. I did not have that support in my family. In fact, i was so lucky that i had a grandmother that took in my brothers and me and raised us. My grandmother was very strict, very focused, she determined to make sure she did everything she could to protect us. When young people dont have that safety net, when they dont have that support, when they dont have that protection, sadly, thats when they turn to predators and do things that they never thought theyd do. And this 9. 3 million grant allows us to provide services and housing, and to track and find out what we can do better to keep this from happening in the first place. So im excite todd to see how is going to change the lives of so money youany young people i city. We are well on our way to addressing so many challenges that we know we face one at a time. It takes dedicated partners, it takes dedicated public servants, it takes dedicated people from the Public Community who care about addressing these issues, and so i want to thank each and every one of you for being here today. This is an amazing, amazing grant, and i am looking forward to the implementation and changes that i know are going to come forward as a result of this funding. Thank you so much. [applause] the hon. I wanted to recognize the mayor for empowerment of youth and her focused commitment to housing individuals who are homeless. As you know, commercially sexually exploited children are mostly homeless. Its really one of the root causes of this problem, and now, its my great pleasure to introduce the executive director and founder of freedom forward, alia Whitney Johnson and doug styles, my second grade classmate and director of Huckleberry Youth Program. Please give them a warm welcome. [applause] good morning. Thank you, cheryl lynn for hosting us this morning, and thank you, mayor breed and commissioner murase for the work that you do on behalf of young people in our community. I realize that commercial Sexual Exploitation is a story of failures. Times that we have failed to meet young peoples needs, and these young people have taken their needs into their own hands. Times to fail to respond with compassion when they needed us has added to their story. But within this story is a story of incredible youth brilliances, a story of navigating the system, a hustle that is purposely resourceful, resilient. Knowledge that is absolutely critical if we want to build a vibrant, Healthy System that works for all. These are the voices that we are centering in this continuum. They deserve choices, and they deserve a system that works for them and a voice in what that system should be. By ensuring young people are a part of our design process, and that we build in feedback loops to honor their input, we believe we will build a more effective system of care for all. So what is this collaborative that were building and here today to announce . Through this grant, were bringing together 11 Community Partners to develop a continuum of services that we hope will meet youth where they are, recognizing that meaningful change is rarely linear and needs to meet youth when they are ready. This continuum includes five major components as well as a protocol for navigating those components and a rigorous evaluation. We hope to openly share our successes learned, and if effective, to replicate what works across the state. The five components of this continuum include first, a Dropin Center where youth will be able to Access Services under one roof whether or not they identify as being exploited or currently being housed in the continuum. Second, a launch pad shelter for youth transitioning from life on the streets or unsafe living situations. Third, a shortterm residential treatment program. Fourth, a new model of familybased foster care right here in their community with wraparound support. And finally, 247 response and emergency services. Family first will be leading the foster and family services. We a our role will be to facilitate and coordinate services from across our community, bringing the best our community has to offer, remaining accountable to what youth want. In early 2020, we also aim to launch our familybased foster care pilot. As many of you in this room now, problems in foster care often lead teams to being moved around teens to being moved around, isolated, surrounded by only professionals, far from loved ones and the people who they care most about. All of this instability and lock of connection makes an environment thats ripe for exploitation. We plan to pilot a new model of foster care that will provide Stable Family homes right here in their community and will wrap youth and families with both the professional support that they need as well as a real emphasis on the relationship with family and friends that youth want in their lives. This pilot will engage a great team of providers in what they do best, including family builders, west coast childrens clinic, Huckleberry Youth Programs, and this pilot will also include additional caregivers, who provide what grandmas do, like what mayor breed talked about, so often, aunties and grandmas show up to support our youth. As i step back and think about building a community where every young person can experience all that it means to be free, i want to end today with a quote from a young person who grew up right here in San Francisco and was interviewed by our friends at the elements freedom center. She said, freedom is when we reach back and pull the next sibling with us because we see your brilliance, and we know that you will shine when surrounded by real love. Let us pull each other with us, and let us all move forward with love as we move forward. Thank you very much, and it is my pleasure to introduce doug styles, the executive director of Huckleberry Youth Program [applause] thank you, alia. Thank you, mayor breed. Thank you, my classmate, emily. Thank you to larkin for hosting this fabulous event. Its an Incredible Group of people for this collaboration thats been brought together. What we need to start with is that trafficking, Sexual Exploitation happens here in San Francisco. These are our children. It is a systems issue, not an individual issue. No one chooses to be exploited. Trafficking and exploitation inhibit the entire community from thriving. Thats why weve all come together to change the trajectory of lives of young people affected by trafficking and exploitation and to prevent others from becoming more deeply involved. In 1967, Huckleberry Youth Programs established the first youth shelter for run aways in the country, addressing reasons why people found themselves on the streets of San Francisco. Unfortunately, our 52 years of experience, we have seen too many young people commercially sexually exploited and too many young people at risk of human trafficking. But every day, we also experience the resiliency of young people. This project is an attempt to bring together various experts from various fields to provide the needed supports for young people to heal and to provide the chance and the necessary tools to reduce the risk of further exploitation. As one of the partners in this project, Huckleberry Youth Programs will provide case manager and Mental Health support to divert young people to a safe and healthier life. Our experience, working with adolescents in challenging situations, whether its Mental Health counseling, Juvenile Court diversion, we know that young people thrive when they direct their own future. Our process is to listen to each youth, hear their hopes and dreams, regardless of their current situation, to traem thtraem treat them as human beings and become a catalyst for changes. Huckleberry Youth Services will be part of the crisis team to provide services to young people when are they need it the most. Well be able to work with young people to maintain their current living situation, and for those with less permanent housing, a placement coordinator will help determine a safe Living Environment for their future. We will provide Residential Counseling staff. Finally, if Emergency Shelter is needed, huckleberry house will provide temporary safe home environment. As a native san franciscan myself, raising my daughters in this city, i am very proud to see this collaboration come together and very excited to work with this Incredible Group of people. I look forward to a future where we no longer need these services or these programs. When all of our children are safe, healthy, treated justly, and are well educated. But we have a lot of work to get there. By working together with the support from the California Department of social services, i believe we can build a stronger community. Thank you. Huckleberry, youth and family services, family builders, west coast childrens clinic, Edgewood Center for children and families, claires house, learning for action, berkeley human rights center, and of course larkin street Youth Services. [applause] finally, i want to give a shoutout to the Mayors Office of human tracking. Through these bodies, San Francisco has odd voe indicated for critical services. Through this grant, were going to be tackling Homeless Service and housing options. I want to thank the housing Advisory Board and Youth Advisory Committee for putting this all together. A lot discussion how residents in San Francisco are displaced how businesses are displaced and theres not as much discussion how many nonprofits are displaced i think a general concern in the Arts Community is the testimony loss of performance spaces and venues no renderings for establishes when our lease is up you have to deal with what the market bears in terms of of rent. Nonprofits cant afford to operate here. My name is bill henry the executive director of aids passage l lp provides services for people with hispanics and aids and 9 advertising that fight for the clients in Housing Insurance and migration in the last two years we negotiated a lease that saw 0 rent more than doubled. My name is ross the executive directors of current pulls for the last 10 years a experiment art our lease expired our rent went from 5 thousand dollars to 10,000 a most. And chad of the arts project pursue. The evolution of the orientation the focus on Art Education between children and Patrol Officer artist we offer a full range of rhythms and dance and theatre music theatre about in the last few years it is more and more difficult to find space for the program that we run. Im the nonprofit manager for the Mayors Office of Economic Workforce Development one of the reasons why the mayor has invested in nonprofit displacement is because of the challenge and because nonprofits often commute Technical Assistance to understand the negotiate for a commercial lease. Snooechlz is rob the executive director and cofounder of at the crossroads we want to reach the disconnected young people not streets of San Francisco for young adults are kicked out of the services our building was sold no 2015 they let us know theyll not renew our lease the last years the city with the nonprofit displacement Litigation Program held over 75 nonprofits financial sanction and Technical Assistance. Fortunate the city hesitate set aside funds for businesses facing increased rent we believable to get some relief in the form of a grant that helped us to cover the increase in rent our rent had been around 40,000 a year now 87,000 taylors dollars a year we got a grant that covered 22 thousands of that but and came to the minnesota Street Project in two people that development in the better streets plan project they saved us space for a Nonprofit Organization National Anthem and turned out the Northern California fund they accepted us into the Real Estate Program to see if we could withstand the stress and after the program was in full swinging skinning they brought up the Litigation Fund and the grants were made we applied for that we received a one thousand dollars granted and that grant allowed us to move in to the space to finish the space as we needed it to furniture is for classes the building opened on schedule on march 18, 2016 and by july we were teaching classed here. Which we found out we were going to have to leave it was overwhelm didnt know anything about commercial real estate we suggested to a bunch of people to look at the nonprofits Displacement Mitigation Program you have access to commercial real estate either city owned or city leased and a city lease space become available there is a 946,000 grant that is provided through the Mayors Office of Economic Workforce Development and thats going to go towards boulder the space covers a little bit less than half the cost it is critical. The purpose of the Organization Trust to stabilize the arts in San Francisco working with local agency i go like the Northern California platoon fund that helped to establish documents of our long track record of stvent and working to find the right partner with the organization of our size and budget the opportunity with the purchase of property were sitting in the former disposal house theatre that expired 5 to 10 years ago we get to operate under the old lease and not receive a rent increase for the next 5 to 7 years well renting 10,000 square feet for the next 5 to seven years we pay off the balance of the purpose of this and the cost of the renovation. The loophole will that is unfortunate fortunate we have buy out a reserve our organization not reduce the services found a way to send some of the reserves to be able to continue the serves we know our clients need them we were able to get relief when was needed the most as we were fortunate to arrive that he location at the time, we did in that regard the city has been weve had tremendous support from the Mayors Office of Economic Workforce Development and apg and helped to roommate the facade of the building and complete the renovation inside of the building without the sport support. Our lease is for 5 years with a 5 year onyx by the city has an 86 year lease that made that clear as long as were doing the work weve been we should be able to stay there for decades and decades.
