I am really amazed at the progress here, and im really glad that our city is leading in getting into this idea of taking care of our most challenged individuals in this valley desperate time for People Living on the streets in dealing with so many crises. That said, there were some notes from ddo. I would say we had this conversation about one changes its name, there is a minor change to the others that need to be changed. I know this may seem arduous, but either one, you used this thing called find and replace. Now it doesnt make sense. You do need to consider it. Or if it truly is that easy, find and replace is not that difficult in order you are jumping around the calendar a little bit. We hadnt talked about this. There were notes in the duccio. Item three, presentation of the general orders, policies and proposals. Discussion item. Good evening, commissioners, chief scott, director henderson, members of the public. I am from the department of Police Accountability trying to wrestle the microphone. Tonight is the night where the Police Department and our agency provide you an update on the work that we have done during the First Quarter concerning policy recommendations as well as department general orders and apartment bulletins. I will highlight three things that we did during the first 2019 group, and that involves the deaf and hard of Hearing Department general order. Since 2017, our agency, in collaboration with the Police Department, deaf advocates, deaf individuals, we have been working on putting together a deaf and hard of hearing apartment general order, as well as putting together services that would really respond from deaf of heart of a deaf and hard of hearing individuals. During the First Quarter, we finish that up. We continued to meet to begin to work on training issues. The chief and command staff or reviewing that department general order, as well as the Police Officers association. We are at a stage where we have answered all the questions. I think it is on your desk, chief, in the hope is we will be responding to the commission as soon it can be scheduled. The second thing we did during the First Quarter of 2019 was we worked with the police commission, with the leadership of the Vice President taylor, as well as the commissioners on the release of the Police Reports for Domestic Violence and Sexual Assault victims. We had several meetings that we were hashing out the process for timely compliance with the Police Department as well as working out the details of Data Compliance and the details of such that we reports will be were provided to the commission. The third thing that we worked on, in combination with the Police Department as well as commissioners was the Language Access working group, it is a group that i initiated in 2012 so we can work collaboratively to address Language Access problems and enhance services especially concerning Domestic Violence and Sexual Assault survivors it is a robust group. It is a terrific opportunity to problem size problem solve were trying to increase the certification for by Legal Officers because right now, the department of Human Resources provides certification in core languages, but the great thing about the Police Department is there are other officers who are bilingual and so many other languages, especially in growing populations. In hindi, arabic and other languages. What we are trying to do is create the certification opportunity for officers as well as other employees. That has been a big project. Were working with the incredible language Liaison Officer to be able to roll out officers Language Lines on Police Officers and cell phones. Again, that is something we have been working on for years. They did not have the capacity to roll it out onto the samsung phones and this is really knew that the Language Line is able to do that. There is a Great Partnership which is part of why we brought Language Line to the table so we could really get that moved out. Those are the three core ones as we attend all of the executive spots in there other nations for fun. I want to the opportunity to highlight i am available for any questions. Thank you. Does that and have your share on this . We do. All right. Commissioners, again, this is the report for the First Quarter , january through march of 2018. I say that, i emphasize that because there has been a lot of work in progress since then as well. I am sorry, i have a little bit of a cold, subpart in the voice, i have a long cinch in my mouth. The department has issued four bulletins and one general order in the First Quarter, and i expect that number will increase as we move through the fiscal year. Can you remind us again, the bulletins, the difference between the four . I am drawing a blank. But my subject Matter Expert on the issue, and im sorry, this is one of the every time we have this presentation, i cant believe i wasnt prepared. What is the difference between the bulletins . The a bulletin are the higher priority then the be bulletin. The a bulletin is mandatory. You have to review them. When it gets down to be, the priority becomes not as high. See bulletins are somewhat informational, so there are Different Levels of importance in terms of what is mandatory. However, we have worked on multiple department general orders. In the First Quarter, again, i know that 3. 01 was with you all, and i wanted to remind the group of the high level items, or the highlevel purpose of that d. G. O. , which aligns our written Communication System and our policy, and the department general order structure as it relates to renumbering if we choose to go that direction, if and when we choose to go that direction. And then that revision of the d. G. O. Substantially reduces the number of Department Bulletins on an annual basis, and from approximately 300 to about 60 annually, or 50, and then enhances the efficiency as it relates to Editing Department general orders. We will assist with addressing 16 recommendations. And then i will talk a little bit more about that at the very end as well with respect to other d. G. O. That will be coming in front of you as well. The deaf and hard of hearing is they have gone to concurrence , and i believe, is actually, with chief scott and we would be coming to you all very soon. In addition, as you know, d. G. O. Have come in quarter one and it was tabled. As you know, they have been issued since then. The 3. 06 a lot of these are very nittygritty items. The. 06 delineates procedures for members to inform the department whenever they change residences, tax status, things like that. I believe will be coming back to that here at the commission as well, and 5foot 15 is enforcement of immigration laws, which is, i believe, at meet and confer with d. H. R. Also in the First Quarter, work has been ongoing on fivepoint 17, and as the commissioners mentioned, is in a working group process with our biased working groups. We are also, for 10. 02, this equipment item is specified so it required equipment for uniformed and nonuniformed officers. These are very operational, nittygritty things. 11. 07, as you know, has also been heard and worked on with the executive sponsor working group this week, so i believe a draft will be going through the departments, and then d. G. O. 11. 10 is physical fitness evaluation. That is at meet and confer right now. And finally, as i mentioned, the objectives for the u. S. D. O. J. Include recommendations for policy revision, and so among those recommendations, use of force by Community Leasing and accountability. There is an accounting of the number of recommendations that include d. G. O. , a recommendation or a revision element to them in that recommendation. Really, the primary d. G. O. We are talking about our 3. 01, 2. 04 , and fivepoint 17. Those cover many of those recommendations. With that, i will take any questions. Thank you for your report. My only suggestion is that with respect to the d. G. O. In progress, you can update the correct individuals who are working on them. I think this is the criticism in terms of not knowing or changing , rather frequently, which officers or heads are on which d. G. O. And the executive sponsor group. I know that these are outdated, so if we can get them updated, i think that would be helpful. Thank you for reminding about the three languages. Can what do we need to do to move that forward to get these three languages certified . What did you tell us . I know the department is working with the department of Human Resources exploring that avenue, as well as the Language Line, so there are different opportunities. We are in ongoing discussions about that. There is a strong desire to put something in place as soon as possible. Chiefs but chief scott . That is in progress right now in terms of working with the department of Human Resources. I just wanted to add, just to clarify the bulletin question, it is in 3. 01, but is the public able to supplement the general orders. These bulletins are turning special operational orders. They are nontechnical and nonlegal information. Thank you for the presentation. I just wanted to make sure that i articulated for the commission and for the public that this was our reform policy priority presentation. It has been much longer in the past, but i wanted to articulate and explained that work hasnt diminished with the top three presentation. A lot of that work is ongoing. We have a number of projects and what to expect in the future as many of the policy projects that we have ongoing will be reflected both in the annual report and throughout the website of what all of those projects are. I did not want to forget all of the other projects that we are also working on internally and collaboratively that arent necessarily just reflected in the Top Priorities as we see them from this sparks report. My name is from the Public Defenders Office. I feel compelled to be here because of the uncertainty regarding the release of records pursuant to s. B. 1421. I am sure you plan on introducing a policy on july 10 th, since his body wont meet on july 29th, we have this meeting in the next bit to discuss what that policy could be. We have so many clients his freedom could depend on the disclosure of those records. We would meet formally, and not just in Public Comment to craft a policy. I will brief the item by a few areas the policy should address. I hope in coming here i will raise issues and perspectives from the ground floor of what this policy could be first and we dont know what is the p. D. s internal process will be. I will respond in the order in which they were received. Why those categories . The process is crucial. Sfpd fpd should adopt an intake process. Additionally, the search protocol. They must establish a transparent protocol for judgement decisions. Does as fpd have a protocol . How do they define those categories . The public deserves to know this definitions. The essay p. D. Should overhaul the notification system. [indiscernible] as fpd should notify people at what stage they request is, and determine [indiscernible] how do we figure that out . Theres no appeals process in place. It would be nice to sit down and talk about these issues. I will let my colleagues i appreciate your time. Thank you. Good evening. My name is leo and i work with the San Francisco Public Defenders Office. I would like to bring to the commissions attention that even if the commission is not ready to turn over the full files of officers who have s. B. 1421 materials in their files, the public is entitled to a list of officers who have this material in their files. As the text of it states, these records shall not be confidential and shall be made available for public inspection pursuant to the California Public records act. The sunshine ordinance passed in 1999, gives the people access to Public Records as defined by the California Public rectors records act. Essentially, if the release of s. P. 1421 is governed by the sunshine ordinance. Section 67. 0 to one of the sunshine ordinance outlines the process for getting access to Public Records from the custodian of the said records. Subject subsection c. States custodian of a Public Record shall assist our assist a requester and identifying the existence, form, and nature of any records or information obtained by, available to, or in the custody of the custodian. Whether or not the contents of those records are exempt from disclosure, and shall, when requested to do so, provide, in writing within seven days following the receipt of a request, a statement as to the existence, quantity, form and nature of the records relating to a particular subject or questions with enough specificity to enable a request to advise identify records to make a request under subsection b. Subsection c. Means that regardless of whether the custodian is currently prepared to turn over the requested documents, they must identify the officers who have s. B. 1421 serial in their files. Based on the requirement, the custodian of record provide information as the existence of any requested records, we are entitled to a list of all officers who have records of the four categories of misbehaviour describing 1421. While the custodian of these records is processing the records for their release. It bears mentioning twice that the timeline for the custodian his to notify the requester of the existence and form of the requested documents is seven Business Days from receipt. To reiterate, we filed our first request for all active duty activeduty officers on january 2nd of this year. Thank you. Next speaker. Good evening, commissioners. I am a law student in San Francisco working with the Public Defenders Office. I want to reiterate the importance of promptly releasing records under the penal code 832. 7 by bringing notice to a method that other jurisdictions have employed to comply with the rule. Some other agencies across the pond them without all relevant records at one time onto a publicly accessible website, rather than waiting to begin processing until a request is made. A good example of this can be found on the San Diego County Sheriff Department website. Website is organized by subsections of 832. 7, followed by links to records that fall under each statutory category. Under each section, there are links to all the investigations and reports along with a Company Video to some incidents, which are downloadable. In San Francisco, no video, including security video or body worn cameras have been provided, even for the few records that have been released. Providing everything pertaining to each incident in one accessible place would allow for more comprehensive and even accessible release of the information that the public is entitled to, as well as create an Organization System for further and continued compliance with the law. Thank you. Thank you next speaker. I am a law student working at the Public Defenders Office. On gender 11, we requested that you send us copies with records that would be classified as Public Records under penal code section 832. 7. We limited our request in good faith for records only for active officers as of the 2018 roster. The commission failed to reply to this request on june 4th 2019, months after the original request and months beyond the one week to two week timeline laid out in the sunshine ordinance. Moreover, after these months of delay, instead of applying with a responsive records to be released redacted, the commission sends a list of 63 officers would last name starting with a and b. For whom the commission does not have responsive records. What of the 175 officers whose last names begin with a or b. And who were not mentioned in this response . The omission of those 175 names from this alphabetized list seems to be a bad faith collision of the fact that the commission has confirmed the presence of at least 175 responsive records, but is not even willing to disclose the presence of those records, much less the records themselves. The lack of comment one way or another creates more confusion and further reduce his trust in the process that these records are undergoing prior to release. Thank you. [please stand by] are relied upon to support charges against individuals and continue to hold them in county jail pretrial. Because of prop 115, in many cases, all it takes to support charges and hold individuals in jail is testimony by Police Officers. Prop 115 allows officers to testify about hearsay evidence, what other people not before the court have told them. It quite literally means that whether or not an officer is honest and has any integrity is one of the most important factors if that person remains in custody in pretrial. Thats why we are simply requesting compliance with the law. Thank you. President hirsch next speaker. Good evening, president hirsch, Vice President taylor, commissioners, director henderson, chief scott. My name is marshall haymons, and i am a u. S. Hastings law student and a member of this community. It is the importance of this commission to understand the results of failure to comply with sb 47, and the impact on the lives of every Single Community member in this city. In order to further educate myself, i went in and sat in on the preliminary hearing as my colleague mentioned, and i saw an officer as the sole witness take the stand. That means that the only thing standing between a defendants freedom and continuing being part of the criminal Justice System was this officers credibility. When this officer took the stand, he made testimony that i then went back and watched the bodyworn camera footage. The two contradicted each other. That means theres somebody sitting in jail right now because of the failure to comply with 832. 7 because the officer was dishonest, and we didnt know and wouldnt know because filing a motion would take longer and time than your constitutional right to a trial within a certain time period. The disclosure of dishonest the disclosure of sustained complaints of dishonesty is crucial to keeping good people out of jail. Again, this person is sitting in jail right now because of the credibility of a sole officer that contradicted the bodyworn camera footage that i saw. Commissioners, director henderson, and chief scott, i urge you to comply with 832. 7 and release this information. Commissioner dejesus thank you. Are you done . I thought there was a brady list that the District Attorney has to turnover to you. This is a real big issue, and i understand that, but dont tell us that you do have access when you do have brady. President hirsch well, were not supposed to have back and forth, but thats a response. Thank you. Good evening, everyone. My name is zach ewen, and i work with the Public Defenders Office, as well. Today, im going to be talking about the dishonesty code of 832. 7. As of right now, the definition of dishonestdishonesty is ambi. The definition i have laid out for sb 1421 defines it as a sustained finding made by any Law Enforcement agency or Oversight Agency of dishonesty by a peace officer directly relating to the reporting, prosecuting or investigation of a crime or directly relating to the reporting of or investigation of misconduct by another peace officer or Police Officer and the vagueness of this section of the statute largely lies with the last portion, excuse me. Destruction, falsefying or destroying evidence as well as what would be considered to sustain something as dishonest. The law will only function as the people who are supposed to be abide by it know what that is. So the law needs to be well defined and understood, so we believe there needs to be strict guidelines regarding what dishonesty is and is not . An example is obstructing or forgetting to turn on your Police Bodyworn Camera . Is that dishonesty . Thats not outlined in the statutes . Theres no metrics of what sustains something as dishonesty and whats not . As of right now, the public has no idea of what is sustained or what doesnt sustained it . And without a well defined and transparent metric, then, the public is just honestly left in the dark, and its completely up to the Law Enforcements own discretion with no foreseeable repercussions if they so disobey this law because theyre essentially policing themselves. So for these reasons, there must be a complete and well defined policy describing exactly what this honesty is and what this process is for determining whether or not it is the same. This process must be transparent to regain the trust of the countless citizens who have learned that much of our Law Enforcement sadly cannot be trusted, and they genuinely should be feared. Thank you. Good evening. Jacques wilson with the San Francisco Public Defenders Office. With regard to brady, brady requires a materiality finding, and it has to be exculpatory. Nothing says brady, nothing says it affects the outcome of the proceeding, and nothing says favorable. It says turn these records over to us. Lets get the story straight. Were not the problem here. These records belong to us, not you. This year, the invisible project released the city project 2. 0 regarding histories of chicago Police Officers. The data revealed a system pervaded by racial data. The filing complaints are predominantly black, yet black people are underrepresented in the case of physical abuse. [inaudible] the 22 of officers who have ten or more complaints account for all complaints during that period. If anyone else dies right now, and its found out that one of these officers has prior instances, their blood is on your hands. If a person is found to be you can shake your head if you want, but if a person is found theres exculpatory evidence that wasnt turned over, youve got a cover up. If we had a commission that was done what you are doing, they would be charged with accomplice liability, conspiracy, and anything else [inaudible] you need to be a little m commissioner mazzucco you need to be a little more professional. Youre representing the Community President hirsch lets not have a back and forth. Next speaker, please. We received a fifth record today from sfpd on a 1998 officerinvolved shooting. One of the officers involved is no longer with the force. To touch again on brady, not only is the issue with brady materiality, its also the time it takes. I checked with department 14 today, and if i file the brady motion today or tomorrow, it would be heard on the 10th of july. And if were talking about preliminary hearings, you have ten days. If youre talking about a misdemeanor, youre talking about 30 days, so thats really not going to be an issue that can help at all. Weve as weve been trying to obtain these reports, we have been largely in the dark, which is a frustrating respect to be on. Last week, for example, when i was here, and i was speaking, i was told there was on this was on the agenda for july 10, and i didnt know. I have 35 active requests right now, and i didnt know the board was going to discussion the action of releasing these records until i came and was told in person. The data that ive heard at these meetings that ive been coming to is astounding. All of that can be called to what sorts of officers have records . What officers dont have records . Weve started to receive some from the p. A. And weve started to receive some from this commission from officers that dont have records. Lets just move on. Lets not debate to hold a case where theres nothing. Lets move on. Firing weapons, dishonesty, all these things are tracked, all of these things are referenced somewhere, but when i talk to people who are actually pulling these records, it really seems as though and i dont doubt it, seems that once the report was finished, it was put on a shelf and no one was going to look at it again. So i understand its hard, and it might take some time, but knowing whats there, thats written down somewhere, and i feel like that is should be more easily accessible. For example, my last note, since im running out of time, the d. P. A. Cases we identified last week, six cases fall under this statute and could have just been puniblished. Thats all the names that i be bringing. Here is hannibal i mean, Thomas Hannibal and paris moffitt. I want to show you this because paris moffitt is bragging im back. I kno he knows what hes done to my son. He is the ringleader, and hes done there in o. C. Projects back bragging again. Im back to kill again. Thats what hes going to do, take someone elses child, like he took mine, him and the rest of them. So im asking you please, on august 14, that you do Media Coverage, because theyre around, and they know who i am. I have no reason to hide because this was my child. But theyre continuing to brag because this is what theyve done. I bring my pictures, dead son, 17yearold boy shot 30 times with a semiautomatic gun. Who does that . How paris moffitt and the rest of them shoot an innocent boy because they didnt get the innocent perpetrator that they wanted . Ive got to suffer, his sisters got to suffer, all my familys got to suffer . My nieces suffer. The only way they know them is because they hear me say aubrey all the time. This is what i hear from them. Nana, is he dead . Is he in heaven now. I shouldnt have to go through this. My son in the casket. My son had a father, and you got paris moffitt saying, im back. Hes bragging, and he doesnt care, and they have videos talking about killing again. Help stop this killing. The summer is coming up, and theres going to be more killing. My son was killed during the summer before he could even graduate from school. President hirsch thank you. Vice president taylor . Vice president taylor couple of things. One, miss brown, the murderer of your son should be in prison. Thats where he belongs. I have helped to put the murderers of other peoples children in prison. I am proud of that, because you matter and your pain matters, and thats part of what Law Enforcement does. So chief, i have a question. How many active members are on sfpd . I just heard 2300. Vice president taylor heres whats important with 1421. We need to comply with it, d. P. A. Needs to comply with it. I take issue with asking for the records of every active duty sfpd officer. Thats almost 2,000 officers. If you have a case thats pending, you need to know about that officer, ask about that case, but it is unfair it is unfair and unreasonable to ask for the the files of 2300 officers at one time and then to come here and complain that its not being done quickly enough, right . So i i have a problem with that because it sets up an impossible kind of paradigm. If you have reasonable requests, make one. But if youre going to ask for everyone and then complain the process is unfair, thats your fault because youre trying to build a file on all sfpd officers, which you may be able to do under the law, but i dont know how it entitles you to come here and complain about processing your request in the order it was received. I do want to echo commissioner dejesus comments on brady and and pitches. Im not saying you are not entitled, you absolutely are. President hirsch we cant take back and forth. Commissioner elias . The fact is that this law was passed a year ago. We knew about it. I asked at that time for a 1421 memo from the city attorney. We received it days before the law was supposed to take effect in january 2019. Were now in june, and we have a handful of cases that have been released to the public under a law that was passed more than six months ago, so of course they are frustrated, and they have every right to be because we havent gotten our stuff together to make sure that when the law became effective, we had a system in place to go ahead and distribute this information. With respect to the fact that, you know, commissioner taylor that a request has been made for all officer, its my understanding based on Public Comment that was made tonight and before and from speaking with the community, yes, that was a request that was made, but the public defender and other members have followed up and said look, we understand thats a voluminous request, but theyve followed up with these are the ones that we need. Im not sure of the actual dates, but in speaking with commander weir, there was a specific list of targets that they need immediately. Its up to the commission, the department and d. P. A. As to how theyre going to process the requests. Its not up to the people asking. [applause] we cant get mad at the public for being frustrated when youre asking for arrest y all of this. Vice president taylor im not mad. The other thing is with respect to brady and pitches, i left the Public Defenders Office a year ago, but when you do a pitches motion, you get literally an index card with a persons name and phone number, and that phone number is literall literally a year old. I think the community zach from the Public Defenders Office did an excellent job of explaining when commissioner mazzucco asked why didnt you just do pitches, and he explained the information you would get on 1421 and the information you would get on pitches. Obviously, the information on 1421 is more beneficial. With respect to brady, im sorry, brady is not always accurate and theyre not turned over. I think theres a misconception as to oh, theres brady or oh, theres pitches, or they can get it this way, or they can get it that way. Which is why theyre relying on the 1421 and theyre frustrated. Hirs president hirsch commissioner mazzucco . Commissioner mazzucco 1421 is the law. I understand its a big shift. I understand that the public defenders need it for their clients that are in custody, and i respect that. Maybe you should have narrowed it to those cases instead of every Police Officers involved in all the cases that you have in custody. Let me go on. But heres the deal. I worked down the hall of justice for many years, and i also worked at the u. S. Department of justice. Pitches, i understand you get a little bit of information. Brady is different. Thats not our problem. You need to talk to the District Attorneys office and the bench down at 850 bryant street and make sure they get on the ball. I sense your frustration, and i feel it. But the problem is those are items that the court should be grants. 850 bryants a small community, and everybody in the Public Defenders Office and everybody in the d. A. S office know who which officers had issues. But to come here and say that therell be blood on the hands of this commission, we support completely turning over everything because you need that. You know, you come from probably the finest Public Defenders Office in the state, if not the country. I respect the public defenders in this office. Youre the true heros in the legal profession. You dont pick who you respect. You get who you get out of the holding cell. But to say theres blood on our hands and act unprofessional to this commission, please dont do that. Please maintain the integrity that has started with this commission. Please dont cut me off. We will do what we need to do to make sure you get need from 1421, but if you dont get it because the d. A. Is not complying or the courts not listening, thats not our fault. President hirsch this is Public Comment. We will address this in depth on the 10th of july. We get your frustration. This is not a cover up. Thats not whats going on. Were inundated with documents, were inundated with requests. There is no list that goes back years that tells us what we have. There isnt. Theyre creating that list right now by hand. But just to assume that were a bunch of thugs or criminals or trying to hide things from you is a mistake, and it undermines your credibility later on when you come at us. Come at us with a little integrity and treat us with a little integrity. Were just trying to do the best we can up here, and the folks in our office and the d. P. A. Are trying to get this material out. Theyre not trying to hide it. Thats a ridiculous point to take. Theres no way we would ever try to do it because theres no way you can get away with it. We know what the law is. We want to comply with the law. Everybody up here favored the law. He would have favored a law that was more expansive, and i think other people would have, too.
