Try to align our agreements very similar to the agreements of the other refinery users, and in terms of the term and the township either any term of guidelines on executing the terminology, and terms, within each of the contracts with those sub zones . Theyre probably the same terms that agreement has. Ashley, argument i think is a bit more substantial than some of the other operating agreements as seen between other users and grantees and other areas. But, broadly the terms in ours indemnification insurance requirements. Basically stating that the operator intends to conform to all regulations, local state and federal regulations, whether they be environmental or Foreign Trade zones or Customs Border protection regulations. Those are all keys that we look at. We work closely with these local customs and Border Protection agents that are responsible for the Foreign Trade zone program. They keep us informed of any problems or any regulations or laws that may have been broken, but in this case, chevron to our knowledge, has never had any issue with the regulation. Do we have any audit capability or provisions in this that we can determine that those are within the zones . Essentially, we leave that to customs for the most part. Enforcement agency but we still reserve a right to go and and inspect or follow up with chevron and have an opportunity do an audit. Primarily that Response Rate lies with customs is that the same with most of the other Foreign Trade zones . Yes. I will, essentially, the port of San Francisco essentially holds the ftc zone three designation. We dont actually generate any funds but profits per se but no revenue authors do we just get essential reimburse to cover our costs for operating and its a benefit to the entities within our zone that utilize it . Thats right that we made that available to the port of richmond to essentially piggyback or use this thereof to the administrative thats exactly correct. We dont have the administered bird burden that have to administer the zone but they can take advantage of all the benefits to either our zone or okens zone. Really goes to soul sort of piggyback the suggestions made, if we were to do an extension of 90 days renew the agreement, and then revisit the longerterm arrangement that would give us a chance to do further outreach to our colleagues across the bay to explain the program, articulate how their Resident Companies and others can take advantage of that designation being in the zone. Is that actually, peter get out of your. Commissioner, that would be an option that we can sally go down. I would possibly recommend a sixmonth part of the vacation or not 90 days will be gone quickly. If you like, we can, if thats your wish the commissions wish, we could follow up on the communication again. But the city of richmond i would like to make clear that we do any extension here, were not asking all the issues that are raised. We are not here to solve those issues that chevron has with the other stakeholders here. I think that we are simply here to say that if there was further communication to expand what the Foreign Trade zone grading is, thats fine but i mean we cannot this is chevron to figure out their own solutions. This seems to be an intramural battle that we are willing victims out. Were trying to do the right thing to great jobs and economic benefits theres a lot of other baggage involved. We will do whatever the commission directs us to do. To that point, but i was actually going to suggest in the intervening time, much as address the issues with chevron but actually have it we done this in the past have some more formal presentation on the benefits and how the freetrade zone operates in houston run through San Francisco. It gives us another opportunity, i think, to expand to a potential tenants the benefits there but also to our various partners separate and apart from whatever happens in that intervening time, if that something that would i would support an extension give us more time to understand the Foreign Trade zone and resolving the outstanding issues. Just what you need take care of our condition here so we can understand things a little bit better. I want to understand this. I think i heard they would like us to reach out to the city of richmond and two, i think, the indomitable and Labor Community there as well to talk about the program . I like to go and talk to our associate at the port of richmond and the city manager and let him communicate through his i was actually going to suggest rather than us having to do our reach we certainly dont have the capability to do, that we put on a form to explain exactly what the Foreign Trade zone is, the benefits to local jurisdictions, and do a general presentation and make send out the information on that event to those different entities they choose to participate they can. They choose not to, they dont have to but make that education opportunity available bill so its not specific to richmond but to the area in general because this is a benefit that we should make better use of an opportunity to educate people on. If that makes more sense. I know youve done that to some degree progress formalizing it we actually conducted a public forum here in june of 2012 and invited people from all over the bay area. We are representatives from chevron and other companies. We we talked to the ports and open and san jose Foreign Trade court to see if they want to collectively do one together that could benefit all bay area and pool our resources to do that. That certainly that could expedite and do something in the near future. Mr. Peters, again. Ill come back to the Port Commission with a presentation on Foreign Trade zone program. Im 12 informational presentation on the session of bay area governments in California Coastal ocean bay area water trail and designation of water trail landon. Good evening, commissioned David Goetsch with planning and development. Im also joined today by ben botkin from the bay area water Trail Association of bay area governments. We are here today to present an overview of the bay area water trail. As you may be aware, the court has been working with wider recreational enthusiasts for number of years on providing improved water access for for recreation. The water trail patient is a network of planning and launching sites around the nine county bay area for nonmotorized small boats or human powered boats, as we often referred to them. So, what you see here is a list ration the entire San Francisco bay area and the blue dots recognize the bay area water trails vision for water landings to establish, again, all water trail within the vacant odyssey, they would not be a suicide trail and the designation of new water trail landings is to accommodate improved access for all to the bay for recreational boaters. A little bit of history that the bait area water to. Its origin was goetsch the idea was initiated by an Organization Called bait access. Some of the founding members of bay access included two former Central Waterfront Advisory Group members, paul nixon recently passed, and casey walker who also passed in the last couple of years. Additionally, penny wells whos here tonight, carries the torch for paul and casey and others that they came together in 2001 and had an idea for bay area water trail organizing that a lot of the landing zones were wearing out not being replaced that the opportunity was being not addressed in new developments. As a part of that, they lobbied several different organizations, including the California Coastal conservancy, association of bay area governments and be cdc, and gusty legislation in 2007 to establish the water trail. At that point in time, the coastal conservancy was leading the process and conducted Environmental Impact report for the bay area water trail, and in 2015 again, the coastal conservancy in coordination with the bay area government staff developed accessibility plan for the entire bay area water trail. The bay area water trail is a partnership of four agencies. As i mentioned, the coastal conservancy, ac dc, and the California Division of boating and waterways as well as aabag. Some of the key goals is, in essence, to increase appreciation and access to the bait. Improve and expand facilities and opportunities for partnerships to achieve a worldclass recreational facility of a lot of this work is done through dictation, outreach, coordination and funding facility enhancements. When we talk about the bay area one until user, these are the types of users. Kayaks, canoes, web servers abhors, rowboats, dragon boats, knowing and outrigger canoe errors and these are all individual sports working sports for exercising, touring wildlife, watching and several different types of experiences and just a note here, the whaleboat, thats the port of San Franciscos whereabouts. We are not only stewards of it but were also participants in it. As i mentioned before, the board has been working several years on the planning of our waterfront accessibility. By achieving these thousand of the bay area water trail. The map on the right illustrates the ports planning work done to date from parents had parked to aquatic park. I know weve approximately 7 facilities including the landing but we have a partnership with kayaks unlimited. We of the pier 52 public boat launch. The Mission Creek landing that partnered with the office of community and infrastructure and us fm. South beach harbor at peer 40, peer 1. 5, pier 39, aquatic park, which is not necessarily a port property but we coordinate with recreational parks and get an future programs include glencoe park. As well, i want to recognize well familiar with the blue green way, but the blue part of the group to greenway, is the bay area water trail. I also wanted to mention that as a part of the planning work that we have been doing mostly done a lot of planning to do a lot of planning coordinate our reach with the other agencies. As well, Wendy Proctor report architect sits on the water trail is a member of the bay area water trail advisory committee, and the bay area water chill accessibility so to ease. With that, i like to introduce ben botkin whose can talk about the designation process cannot close it out with our next steps. Commissioners and thank you for having me. Stated mission, theres been a lot of planning going on and a lot of collaboration between a lot of different agencies very involved community that is really brought this vision to life. So, im sitting here today to talk about site designation process, which is come out of our with pastoral years as a way of influencing the water trail. When looking to designate sites into our water trail weve identified these 130 year sites around the bay provide easy access and we look for providing quality that make an ideal site for designation. So, not all of the sites will have everything that makes for an ideal site for my but some of the things that were often looking for our parking, sort of a minimum of four hours that allows two people to get out get into the water enjoyed an afternoon there, were going to be looking more into overnight accommodations and so sites where you can have overnight parking. That something were looking at. The facilities themselves, how amenable they are to various types of water recreation users, as we saw, theres a variety of different types of boats and that their own requirements. Restrooms is a key one. Increasingly, storage. To get votes can be sometimes difficult process. Storing them in transporting them so increasingly, having collaborating with groups and vendors at the site is a great way to help facilitate getting people out on the water including underserved communities were people that are looking to get out. So, as part of the designation process, there are five steps. It began with an expression of interest from the site owner manager. So, at this point, as evidenced by us being here today, i believe we have interest in the port of San Francisco for three sets currently to be designated into the water trail. So, previously theres been a resolution passed in support of the water trail. The next step would be performed largely right staff, myself primarily, which is a collection of information about these various sites. A lot of information has been corrected previously, poor looking at the facility themselves really getting detailed information about the accessibility and was using the site and other currently being used. So, as part of that, we complete our site designation report. So, this is usually several page reports that just synthesize all this information including details about ada accessibility, as well as state use, general concerns theres been incidents anything like that we compile it all into her reports which is been brought to a quarterly water trail implementation meeting. So, this is a meeting we have every three months and is hosted by the coastal conservancy, and the project management team, which is made up of representatives from those coastal conservancy, cal boating and waterways, and the coastal conservancy, then are able to vote on the information based on the presentation and whether they feel this would be a site that is eligible to be designated into the water trail. As part of that, though oftentimes make conditions for what they would like to see potentially improve at a site as well as some signage requirements that go along with implementing a site. Once those conditions are met him up then the site and the signs are both gauche than the site is considered a designated member of the water trail. This point, we have a 11 sites designated into the water jokes and taking over an exciting time where i think a lot of the previous planning has facilitated us to hopefully move forward with the sites throughout the bay. Right now we have sites from so it isnt a wide program. So, despite it shows the basic criteria for eligible sites that is, as i mentioned, if they want to join the water trail [inaudible] theres a willingness to consult water trail signs. Must be with in jurisdiction and it does not clearly impact human health, the environment or private property. The three sites we are looking at currently are is this creek landing, which has a nice facility in place it is currently used by clubs as public boat storage. There is a restaurant which is behind the fence, and then theres accessible parking as well and a nice ramp down to the dock there. Pier 52, which has a high report and though freeport dock which study for kayakers. A transfer system, boat ramp as well as accessible parking. Then, South Beach Harbor is that certain. It is high freeport dock, accessible parking, public storage, as well as concessions and its really a prime location for near the ballpark and is just a great spot to be on the water. So, some of the benefits of joining the water trail are designated sites are eligible for Grant Funding from the coastal conservancy. We have initially was a grant of 900,000. Weve about 500,000 currently for Grant Funding to improve the funding improvements of the trail leading clean restrooms, or 88 type improvements. Storage those sorts of things. This is a look at with the signs typically look like. So, the top when there is the water trail sign. Then, the right one is an education sign, which we think does a great job of providing key take away points for enhancing public safety, as well as promoting and affect for water users to respect wildlife as well as make sure theyre sick it was also expanded our reach as part of the water till program. If a great website that provides a lot of information and we want is really to be a key resource that people drop the bacon access whether they want to check out someplace within their own community or venture across the bay to find new areas to enjoy. As well as education programs, partnerships, with programs like sea kayaks. Then, its a great Tourism Marketing piece. So to be looking to advocate a feature and a hold of the way and recreates and discover sites in San Francisco.
