Endorsements for harris but do they risk alienating their own base in the process? could it be too late to win over michiganders critical of the biden administration gaza war policy? i will speak at the head of the muslim voter organization who just met with kamala harris. I am ayman mohyeldin, let us do it. As we come on the air tonight the former president is in butler, pennsylvania campaigning at the site of his first attempted assassination. Just a few moments ago he was joined on stage by elon musk, next to donald trump where he claimed democrats falsely are trying to take away people's right to vote and we will keep an ear on trump's rally in case he makes any news and will bring you any updates throughout the course of the next two hours as we hear them. His return to butler comes as we are learning new revelations about donald trump's desperate attempts to cling on to power after he lost in 2020. All things to the unsealed evidence in trump's election interference case. It is the first time some of these details have come to light because unlike the congressional committee that investigated january 6th, the department of justice has subpoenaed flowers over witnesses. Witnesses like former vice president mike pence, who tried to get trump to accept his election loss according to a newly unsealed court filing by the special counsel, jack smith in a 165 page document smith writes that pence told trump during a private lunch in november 2020, quote, do not concede but recognize the process is over. In another lunch days later pence urged trump to run again in 2024. Trump said i do not know 2024 is so far off. This might be interesting to mike pence, special counsel writes that when trump was informed that his former vice president had to be rushed to a secure location on the day of the insurrection, he replied with two words, so what? we learned an unnamed assistant to trump overheard a remark he made to family members aboard marine one after the 2020 election sang, quote, it does not matter if you won or lost the election, you still have to fight. Jack smith argues that trump resorted to crimes to overturn his defeat and because this all allegedly occurred after the election, he was acting as a private citizen who should not be granted presidential immunity. A fun game of protection donald trump immediately called smith's filing election interference. He called it a weaponization of government to release the filing now alleging that smith and federal law enforcement officials are improperly influencing a presidential election. Tonight, as we said, we are moderating a live campaign rally in butler, pennsylvania, to see if he makes any additional responses to those claims. Keep in mind a federal judge decided to release the filing to the public, not jack smith. Trump and his inner circle has stripped the term election interference of all meaning by continually slapping that label on just about any situation that trump does not like. Last month campaign senior adviser ryan hughes question whether the federal reserve's decision to cut interest rates was a political decision to interfere with the election. Stephen sean, one of the campaign spokespeople claimed that movie the apprentice is election interference by hollywood elites for depicting him an unflattering way. Something even scarier than the trump teams rhetoric, the ground game partner this year the trump campaign and rnc announced their plans to beloit 100,000 poll watchers to battleground states across the country. In addressee group founded by trump adviser stephen miller is advancing the legal theory that judges there can simply fill out election results over failures or irregularities by local officials. In georgia the gop majority election board voted to approve a new role requiring poll workers to count ballots by hand. And that could drastically slow down the tallying process. Donald trump and his followers say that democrats are refusing to move on from january 6th when they are the ones actively plotting to overturn the next election. As trump continues to out run legal accountability the remaining beacon of hope may be special counsel jack smith. Who in the face of all of these obstacles has not strayed from his commitment to uncovering what happened four years ago. Joining me now to discuss this, legal and is in glenn kirschner and former nigel prosser and host of the justice matters podcast brian tyler host of the note light with brian tyler. And author of shameless: republicans deliberate dysfunction in the battle to preserve democracy. Also with this ryan wiggins chief of staff at the beacon project. Great to have all of you with this. Glenn, i will start with you. And your reading of the filing, the most recent filing and what you thought as being the most consequential part of it. I think those two words, so what. When donald trump was informed his vice president was in danger , was in harms way, donald trump was watching on tv the attack on the u. S. Capital. That reinforced that mike pence was in danger. Donald trump said, so what. You know what, that is inconsistent with a president's constitutional duty to take care that the laws of the nation be faithfully executed. What i cannot wait is for this evidence to be presented to 12 people in that wooden box in the courtroom in washington, d. C. , a courthouse in which i tried lots of cases because they will be so impressed with the callousness and the danger presented by donald trump that he better hold on tight. One such gets a hold of that evidence, it is not going to go well for him. Glenn brings up an important point which others have shared even andrew weissmann, regular on our network, he describes smith's new filing as a bombshell because mike pence has emerged as a principal player in all of this. What do you make of how pence gradually tried to convince trump to accept the election results to no avail? and became the subject of those two words, so what, when his life was in danger. You have j. D. Vance as his running mate. There may be no one else around to tell him no. It proves the reason he chose j. D. Vance in the first place. He is there because he will basically act as the opposite of what mike pence did. Which was a bulwark against donald trump's criminality. That is why donald trump is running for reelection without the same ticket he did the first time. It puts on full display at the fact that he had to go out and find some other person who would bend to his whims. He proved that on the debate stage when he came forward and said that donald trump did not lose the 2020 election that put on full display why j. D. Vance is there. Put on full display why he was chosen as his vp. It is because he will do the exact thing donald trump wanted mike pence to do but he ultimately opted not to in the end. When the release came out we saw trump cry as he always does, claiming the weaponization of government. He baselessly said that jack smith is working for biden and harris. As i laid out this rhetoric is not new for him. How are organizations working to combat this narrative 30 days out from the election? how can they continue to fight back against this narrative of election interference? it is the very first thing that you have to do when it comes to donald trump is to get him to start questioning his own vp we have started doing that. We saw in the debate how much better bans did than donald trump. One of the things the lincoln project does pretty well, probably better that anyone is we get in the sky's had. We released and ad try to remind him, this guy will put the 25th amendment. You had him come in and he will kick you out. Right now, we believe that j. D. Vance is trying to soften up maga and try to make it look like it is same and it is not. The best fight to go lx election interference is to cause so much chaos that they cannot focus on messing with the election. It was a brilliant ad to get donald trump to mistrust his own vice president. I don't know if he can put the same thing on the hezbollah movement. You write that judge chutkan is not to weigh into uncharted waters deciding which of the alleged crimes artificial acts and thus immune but how do you expect her to move forward in this case given all the details smith went into? matter what she does or says, rest assured that donald trump is going to appeal that and delay the process and try to kick it up for the supreme court? the good news is judge chutkan has made clear. She said over and over about her case and the scheduling in her case will not yield and is not dependent on election cycle. She has put her money where her mouth is. She has set a schedule in order to do precisely what the supreme court directed her to do. Litigate the issues, try to decide which of donald trump's crimes artificial acts of the u. S. President. It does not make a lot of sense in which of his crimes are not. What he should have immunity for a not have immunity for. The next stage will be to hold hearings. The interesting question is what will those hearings look like? make it look like one of two things. They could be by what we call proper. In other words jack smith has revealed the evidence and we will see more of it in the appendix coming soon. Donald trump and his lawyers will file their opposition and their arguments. And then what it could look like is jet chutkan could say that i will assume that jack smith has presented. And now we can litigate and the parties can argue whether these are official acts or unofficial acts. That is one way the hearing could look. The other way is by putting on witness after witness after witness, almost exclusively republican witnesses who will be providing incriminating information against a republican former president. And then this thing will look like a mini trial with examination and cross examination and that will be very informative. Judge chutkan will make her best judgment as to which of these procedures she wants to follow. So it she can do precisely what the supreme court told her to do. Litigate this thing to ground and roll on what donald trump can be prosecuted for and what he cannot be. Brian, this case will not go to trial anytime soon. Does the unsealing of this filing have the potential to change the minds of voters when you see the details? we knew all of this to some extent. We knew what his role was but when you see the specifics of this filing, it is pretty against trump on that day. None of this is going to help him. There are very few people who actually up for grabs and the election. The more people who can actually see this stuff, the irrefutable evidence, these words coming directly from the mouths of other republican officials who were working closely in conduction with donald trump himself. If anyone need a push one way or the other, this is not going to go to his benefit. I want to say one more thing on the whole idea of election interference. This park imbues me so much about what donald trump is doing. It is not election interference for donald trump to be held accountable for his own crimes. If he was worried about the court schedule impacting his election schedule, for example, perhaps he would've thought about that while he was inciting a mob while he was organizing a criminal organization to help him do it while he was trying to get the military to seize voting machines and meeting with state officials to bend send fake electorates. Apparently none of that was election interference but holding him to account for those crimes that is election interference, give me a break. There has been doubts about electoral he tweeted out at the time there was no basis there. He said reports of voting machines switching romney vote to obama back then. You would think that by now voters would be used to the tactic. He still is playing the same card because it seems his base and his voters are not buying it. Elon musk just moments ago lied to the rally saying democrats are trying to take away your vote. It is a good sign for kamala harris that he is doing this. If he is sitting here right now and already claiming election interference. As far as i know, i don't think anyone is voting quite yet. That says he is already expecting to lose the states. They are really important for him. He is already claimed i'm going to cheat and do it again but americans should pay attention but so many of those who need to pay attention won't because the information is not getting to them on fox news. To brian's point, it is such a small number of people that need to be moved. Hopefully, they will be getting this message. The more that he keeps talking all of the crazy nonsense, the more that people are getting tired of it. I think that there is growing exhaustion with donald trump. I think that is one of the reasons that j. D. Vance is actually somewhat dangerous. He is a different person with a different style putting on that whole maga show without the namecalling and some of the vitriol. That is what we saw in the debates. It is a dangerous time. Is certainly is. One more reminder of what is at stake come this november. Glenn kirschner, thank you so much. Brian ryan, please stick around but we have more to discuss with both of you. Thank you for making time for us. I want to start with your reaction and what strikes you about how judge mcburney makes the case. And why should people really be paying attention to this ruling before the election? we should understand that the substance of the ruling actually dates back hundreds of years. The reconstruction amendment start with the 13th amendment and carried on with the 14th and the 15th. The 13th amendment abolished not only slavery but explicitly involuntary servitude and what so many americans have not been educated about it seems even some of our justices on the supreme court is the fact that those who were in congress at the time were abolitionist. They were the radical republicans. These are people whose churches have been gone. Their houses had been scores for the they went through fire. If you read what it was they were deeply concerned with and the abolitionist period, it was not only people picking cotton. They were deeply concerned and worried about girls and women are being forced into involuntary reproductive servitude. Charles sumner, famously, was beaten nearly to death and had to leave congress for three years after giving a speech of the hurting of black girls and force motherhood through this system of forces slavery and involuntary reproductive servitude. In many ways the decision reminds of what the constitution protects against. Which is involuntary servitude. The involuntary servitude is not just a matter of labor hours, it is a matter of reproductive privacy and autonomy. One of your articles is cited in the decision when the judge writes about how laws like george's abortion ban, quote, compel a subset of our society to against their will labor for what the legislator has decided is the betterment of society. In other words, how force pregnancy is involuntary servitude. You were just alluding to that because you have argued it does violate the 13th amendment. I am not sure our viewers know exactly the connection there. That is right. In the periods of american involuntary servitude and slavery, the way in which capital was brought about was not only in the cutting of sugarcane or the picking of cotton or of tobacco, but explicitly involved sexual of ordination and trafficking. Thomas jefferson, a revered president and state person famously wrote letters where he encouraged that plantations be stocked with women and girls because as he noted, they turn a profit every year or two. He was not talk about his preference for girls and women on his plantation because they were mightier and sturdier than men were. It was, literally, that these were girls and women who were being forced into involuntary reproductive servitude for the benefit of american capital and capitalism. This was a feature of what abolitionist was all about. Which was stopping this. As europeans have visited the southern states in the united states, they noted little girls who were pregnant. Girls that were being sold as reading wenches and even cases of suicide, those girls who drummed from the tops of homes and barns because they were so afraid of what was coming next. This is what was part of the subtext or even not the subtext of this ruling this week in georgia. I want to get your thoughts on impact. We know that georgia attorney general is going to appeal the ruling. Especially in a state where we have heard the stories of women like katie miller and amber thurman, both of who died as a result of the abortion ban and whose deaths have been deemed preventable. What kind of impact is this having already in georgia? many people are paying close attention now because their death, their tragic deaths were avoidable as is noted. And then water on the brain. We see women being threatened with criminal punishment after having miscarriages at home. It has truly been a trail of tragedy and horror. Like i said, you have lawmakers and also prosecutors doubling down saying that they will continue to prosecute doctors in texas. There is a risk of 99 years incarceration and $100,000 fine for each time the law is broken. This is a time to pay close attention what was happening in the united states. Is there a president that has been set for groups out there, pro choice group to see this is decision and can use his argument, this legal argument to pursue cases in other states? we see it happen often on the other side. Which is 30 days before the election, harris' campaign is trying to win back muslim and arab american voters that she and joe biden lost to the end administration's handling of israel's war in gaza. Has met with leaders from the muslim and arab americans when in flint, michigan, ahead of a rally there yesterday michigan is a battleground state were arab americans make up a large portion of the democratic electorate. It will be critical to a hair's victory in november. That meeting included leaders from engage, engage action, a voter organization which endorsed harris for president. The american task force on lebanon and a palace in american activist who has been outspoken after losing family in gaza. In a statement the ceo of engage actions that his group try to underscore the deep pain our communities feel over the intensifying crisis in gaza and lebanon. Adding engage action called on vice president harris to do everything in her power should she win to end the war and reset u. S. Policy in the region the ceo of the organization joins me now. It is great to have you on the show. Let me start before i get to the endorsement about whether or not engage believe that the biden administration has responded adequately to the war in gaza and now in lebanon and has use that leverage to end the war in a manner that is sufficient, if you will for your constituents that your organization represents and cares about. Thanks, ayman, for having me on. The short answer to your question is absolutely not in terms of the humanitarian assistance that is before us but also by providing the political cover and the unconditional military aid that the government of prime minister netanyahu. We have enabled what we have seen now in lebanon. The policy is not only falling short but has exasperated the situation. Let us talk about the stakes for this race. You have heavily arab american counties in 2020. Voters went for joe biden by little under 70%. His margin of victory was 154,000 vote. The state has more than 200,000 registered voters who are muslim and 300,000 people who claim ancestry in the middle east and north africa. Do you believe that the vice president can't win the presidency without changing course and policy on gaza? and certainly this war, which is not only not popular with that arab or the muslim community, the american public is not happy with this war that potentially could drag the u. S. Deeper into another middle eastern war. We do believe that the muslim and arab vote is crucial to winning in michigan. In 2016 donald trump won the state by only 11,000 votes. They do metro numbers at engage, we do not see a pathway for victory without a substantial portion of that population. You believe the vice president or have any reason that the vice president will be different in the way she handled the war, if she were elected compared to how joe biden and vice president harris have been handling the war and signaling the war about the war right now? we believe that she can. We feel that she can lean and even now. And show distance between her and the current policy but we are also realistic that we are only 30 days away from the election. Ayman, to be candid, these elections represent a very difficult moment for muslim and arab americans. We are not happy with the policy. Our own families are being targeted and my own staff have family members in lebanon right now. I'm on 1. 2 million lebanese, who are escaping the bombardments that you discovered. That is 2 million displaced in gaza. Tens of thousands killed there. Netanyahu is dead set on expanding the war and dragging the u. S. Into it. We are not happy. We are looking at the choices before us but either donald trump or kamala harris will be commander in chief next year. Who would we, as americans as well as muslims, would rather have making those decisions? and we have a better chance with to change the policy. We do believe it is kamala harris. Given everything you have outlined right now, why not hold your endorsement until she makes more of a commitment or articulate a policy difference that meets the demand of the community represents. I understand that she will be a different and better president than donald trump on this issue. Do you believe she has signaled enough already to earn your vote as of today? or is it simply out of fear of who donald trump is that you are endorsing her? people are saying why not hold your endorsement until she change to market r signals a absolutely and that is very fair. There is a reason we waited until this moment. Early voting has begun in many states and you cannot just switch views on what to do immediately. This is a voting guide to our voters. It is not a full on endorsement of, harris or governor walz. Although we enjoyed him joining us. In fact, we believe that our real fight begins on day one of their presidency to bring u. S. Foreign policy into compliance with international law. , domestic law. As well as alignment with our values and principles. Particularly the democratic party. We know what we are up against. We are running out of time. We want to make sure our voters who can be the different makers in places like michigan do not end up staying at home out of their grievance and anger, which is understandable are voting for a third party which could bring back a donald trump. Which would end up being even worse for us and for our country. Are you worried that if the vice president loses muslim voters and members of the community, would they be scapegoated? you make we know that the white supremacist will always come after our community. And we will respond the way we need to. We have done that after 9/11 and after trump's presidency. We have plenty of allies. Plenty of goodwill americans of all faiths understanding what we are up against. We are united in protecting our democracy. We also need to come together and be responsible for our own actions which is casting the vote in november to prevent not only what is worse give us a hope that a better future and change the policies that are harming all of us.
