Right now on Ana Cabrera reports, we are following breaking news. Sean Diddy Combs under arrest this morning, the Music Mogul taken into custody overnight by federal agents at a manhattan hotel. What we are just learning about the charges in a federal indictment, unsealed just moments ago. Also ahead, Donald Trump returns to the trail after the apparent Assassination Attempt, describing what happened in a new conversation with the washington post. Plus, new details about the suspect including how long he was able to hide near that Florida Golf Course before being spotted by the Secret Service. And later, state police, Bomb Threats, canceled public events, how baseless Conspiracy Theories are Ratcheting Up Fear and changing lives in one ohio city. Hello, it is 10 00 eastern, 7 00 a. M. Pacific, im Ana Cabrera reporting from New York and we begin with this breaking news, that federal indictment against Music Mogul Sean Diddy combs was just unsealed. And it lays out multiple charges against him including racketeering, Sex Trafficking, transportation to engage in prostitution, and combs was arrested overnight by federal agents at a manhattan hotel, he will appear in court this morning and according to a source familiar with the situation, combs was caught off guard by the arrest. But it comes after a Years Worth of accusations against combs. Many laid out in lawsuits including sexual misconduct, Sex Trafficking, and even distribution of illegal narcotics and firearms. His lawyer said in part he is an in perfect person, but he is not a criminal and they will fight these charges with all his might and the full confidence of his lawyers. Joining us now, msnbc legal Correspondent Lisa Rubin and Nbc Homeland Security correspondent julia ainsley, and Defense Attorney misty maris. All right, lisa, obviously this was just unsealed, 14page indictment, a lot in here. What more do we know about the charges and the allegations here . So, we know a number of things about the allegations, but i want to highlight a few things for you. One, Todays Indictment is solely against sean combs, but, of course, the chief count is a Racketeering Conspiracy that alleges that sean combs used his businesses and a number of people that worked in and around him to essentially facilitate a commercial Sex Enterprise through which women were trafficked both internationally and interstate to serve his own sexual desires, including by pairing them once they were plied with drugs he provided with commercial male Sex Workers and then watching them and filming them have Sexual Intercourse with these people and then to recover then giving them forced iv fluids in a pattern that lasted between 2009 up through and including 2024. So, there is an allegation here about who was involved in this enterprise beyond sean combs and that includes security staff, household staff, personal assistants and other Combs Business employees engaged in that pattern i just referred to with you which the indictment refers to as a freakoff. The other thing i want to tell our viewers is there is a victim here who is identified as victim one, there is also a separate victim who is not identified by a victim name and number, who is the victim of that transportation to engage in prostitution count. So there is at least two women here that the u. S. Attorneys office for the southern district of New York knows about and apparently has interviewed. And the third thing that i would just underscore for you is in addition to the criminal penalties that sean combs could be facing, there are Forfeiture Allegations which basically suggest that sean combs should give up any and all property, real and personal, that was derived from the proceeds he obtained from this longstanding alleged Racketeering Conspiracy. So, look for the feds to seize property from sean combs and at The End of this case, when and if it reaches its end, to insist that they can seize real property, Bank Accounts and otherwise, that are obtained for him through this enterprise. So, three counts specifically, Racketeering Conspiracy, count two is Sex Trafficking by force, fraud or coercion, count three is transportation to engage in prostitution. And you laid out many of the details and the allegations that back up each of those counts. I do want to read one quote that is quite disturbing, but i think gives you a greater sense of what was going on here. And it reads, for decades sean combs, the defendant, abused, threatened and coerced women and others around him to fulfill his sexual desires, protect his reputation and conceal his conduct. To do so, combs relied on employees, resources and influence of the multifaceted Business Empire that he led and controlled creating a criminal enterprise whose members and associates engaged in and attempted to engage in among other crimes, Sex Trafficking, forced labor, kidnapping, arson, Bribery And Obstruction of justice. So does this mean other people could face charges beyond sean combs . It does, or it means that other people may already be cooperating with prosecutors in their building of a case against sean combs. One thing i want to also highlight for you is that this would not be possible without a change in New Yorks civil law called the adult survivors act. That is what allowed people like Cassie Ventura, who was one of sean combs alleged victims, to bring civil lawsuits suing him for their abuse, many of those allegations undergirded the southern district of new Yorks Investigation here and some of those find echos in this criminal indictment. You see the reverberations of the me too movement, empowering women to come forward, Sue Civilly and then seeing federal authorities transform them into some of the details we see in Todays Indictment. Lets listen to sean Combs Lawyer heading into court this morning. We have a clip. This is what we have been expecting since the searches in march. He voluntarily came to New York, not a lot of defendants do that. He came to New York to basically engage the Court System and start the case. So, it sounds like or he implies he came here anticipating the charges were going to be happening. Would it make sense they would be given a Heads Up . It might make sense. A lot of defendants, particularly in cases like this, would rather surrender voluntarily and avoid being arrested and cuffed in a public situation and then perp walked, so to speak, through a federal courthouse. It may be that sean combs and his lawyers understood that this was about to happen and therefore they arranged for a more quiet voluntary arrest. That having been said, the lawyer who you just showed, when he said these are the charges we expected, i cant imagine that even the best criminal Defense Attorney could have expected the broad panoply of allegations in this indictment, which is one of the most hideous criminal instruments i have ever seen in my years of being a lawyer and also working on this network as a correspondent. And, julia, im struck by the fact that it was Homeland Security investigations that carried out the arrest Last Night, according to wnbc, our local affiliate here in New York. What does that suggest . It was Homeland Security investigations and it was also Homeland Security investigations that earlier this year in March Conducted Warrants that they got from the southern district of New York to seize electronics from his properties in miami and in Los Angeles. And at the time, i would go to sources and say why hsi and not fbi . Hsi does a lot with human trafficking. There is an international component that lisa talked about, that the trafficking was not just interstate, there were people coming in from outside of the country. And Thats Something we might hear of more when prosecutors bring this forward as we hear of how he did this. Another thing i wanted to point out is the narcotics piece. I spoke to former Hsi Agent just this morning who talked about trafficking the definition is using force, fraud or coercion. And very often that is through narcotics. You can get someone addicted to drugs, you can find someone who is addicted to drugs and completely manipulate their behavior and keep them coming. There are other ways he also used force, Fraud And Coercion, not only just getting people into an altered state to perform these sexual acts, but also by tracking their whereabouts, by tracking their by controlling their careers, their finances, he had people who would come in and use these videos that people they were videotaped in these sexual acts, didnt know about, and would use those as blackmail. Time and time again, you see how he uses, force, Fraud And Coercion in a psychological way to keep these victims on the hook. That is something that hsi was tracking from the very beginning, and like lisa points out, came to light because of the allegations from former sexual partners of combs. And, misty what is your reaction to what were learning in this indictment . First of all, these horrible allegations, but something that i want to focus and emphasize is that were talking about videotapes referenced in this indictment, and we know that diddys homes were raided. It is likely to be the electronic footprint here. It is going to be central to the prosecutions case. And it is likely to be significant and evidence that is going to help the prosecution as this case pushes forward. Remember, once the electronic devices are obtained by the government, theyre searched, that could lead to additional searches. That could lead to speaking to certain potential victims or witnesses or others who were involved in the criminal enterprise as lisa said. There is others who are referenced, but we have not been indicted. Maybe theyre cooperating. We dont know. But those electronic and what was obtained, especially in light of what was just pointed out that much of the force, Fraud And Coercion that was used to keep these individuals in Diddys Sphere was related to electronic videotapes and other electronic evidence that was obtained. So that is certainly going to be something that is going to move the needle forward for the prosecution. And according to this indictment, among the things they seized, his properties when they conducted that Search Warrant in march of this year, his miami property, his Los Angeles, california, property, they say they seized firearms and ammunition including three ar15s with defaced Serial Numbers as well as a drum magazine, defaced Serial Numbers, misty, catches my eye. Does that suggest other charges, perhaps Gun Charges could be coming or is that already we have been to this indictment . This is all part of that criminal enterprise, relating to basically there is a meeting of the minds between these conspirators to engage in criminal conduct. But certainly there could be other gunrelated charges that could come down the pike. Again, diddy or others involved, especially when talking about the amount of firearms referenced and the numbers scratched off, specific charges related to those. Certainly that could be something that comes down the road. His lawyers hoped he would be released ahead of his next court appearance, misty, because he voluntarily came to New York as they described it, and they tried to, you know, paint this picture of someone who is cooperating with investigators or with prosecution here. Is it likely that he would be released . Thats going to be central to the argument. The factors that the judge takes into consideration is somebody a Flight Risk . What is the nature of the allegations . Is there a prior Criminal Record . Certainly i believe that his lawyers strategically presented him to say we dont have anything to worry about, judge, hes going to be here for the conferences moving forward, hes not a Flight Risk, and thats going to be central to their argument. Whether or not he gets released is very much in the judges discretion. But the severity of these allegations, it is possible he could be held. Julia, do we know more specifics as to what is supposed to happen at todays hearing . It will be his arraignment and, of course, were trying to see if he will come back out. As i understand it, hes already inside the court, very early. We dont expect him to be arraigned until later this afternoon. Another thing i wanted to point out, ana, i was asked earlier today is he the next Jeffrey Epstein . I want to point out a key difference here and that we, as we reported on Jeffrey Epstein, there was so much he was doing to make an entire organization of people and to make money off of this, everything that were reading in this indictment was all for combs own desire as they put very bluntly. I want to point out a key paragraph where he talks about how he threatened people who would blow the whistle on him and he said when employees witness the abuse, combs and members of the enterprise engaged in acts of violence, and it says he on multiple occasions threw objects and people as well as hit, dragged, choked and shoved others. Were also soon going to be getting a Press Conference this morning before the arraignment, and we can expect them to lay out more of that narrative about what happened when anyone tried to threaten what combs had built here. The thing is, they say this went on for decades. Lisa, how is this just now coming to light . How is he just now facing charges . Well, sean combs insulated himself as the Indictment Sort of lays out by being involved, philanthropically, in the civic life of the cities in which he lived. He very famously had a key to the city of New York, which he handed back to mayor Eric Adams this last spring after the video of him assaulting and dragging Cassie Ventura in the Los Angeles hotel came to light. By being a quote, unquote good guy and also having so many people in his employ involved in this alleged conspiracy, sean combs successfully hid from the public that this is the person that he allegedly was. We all saw him dramatically differently and as julia detailed, he maintained that cover through a series of very not make them criminally culpable. He had all the goods on these people to keep them silent and then he built around himself this image of sean combs, kid from poverty, who made good. And that worked on all of us. And his attorney has described him as somebody who spent the last 30 years building an empire, adoring his children, working to uplift the black community and reading a quote from their statement, they released ahead of the indictment being unsealed, they say, quote, hes an imperfect person, but is not criminal. They, again, vowing to fight these charges, calling him innocent. Our Chloe Melas is just outside the courthouse now and is joining us. Courtney, chloe, fill us in on what you have there from the court. Reporter yeah, hey there, ana, Sean Diddy combs, he according to his attorneys is in the courthouse behind me and he is waiting to be arraigned in 45 minutes. A little over an hour, well hear from the u. S. Attorneys office. Theyre going to be having a Press Conference. And i just want to kind of go over the indictment which im actually holding here. Hes charged with three counts and one of those counts has to do with Sex Trafficking. They also talk about diddys alleged abuse towards women, both physical, both sexual. They also reference the incident with Cassie Ventura, when she was kicked and beaten in that Hotel Room or in that Hotel Hallway in 2016. And studio city, california, which is what prompted combs to come out and really walk back his words when cassie actually filed that civil suit against him, when he denied being capable of physical abuse. He said this was a oneoff incident, he had, you know, worked on himself, but that was not the man he was anymore. But, according to this indictment, it sounds like it is not just Sex Trafficking, it is also racketeering and has to do with his Bad Boy enterprise. Sean Diddy Combs, i believe in 2022, he was a billionaire. And he has obviously had several businesses and in this indictment im holding right here, they talk about using those businesses to conceal his conduct. They also talk about these freakoffs and parties that he would have, these Sex Parties and he would allegedly videotape sex, women having sex with male Sex Workers, they also talk about the transportation of Sex Workers, perhaps from other countries, or across state lines, so it will be interesting to hear later today at the Press Conference more details on that. And also dont forget, he faces ten civil suits right now and those attorneys for those alleged accusers are coming out with their own statements overnight and this morning saying this arrest is one step closer to justice for their clients. This morning, he is giving a new account of the apparent Assassination Attempt to the washington post, saying, quote, we were on the 5th hole, and playing normally, like you would play a round of golf with some friends and we heard bullets. But the bullets were from the gun of the secret Service Agent who acted really quickly. This as new details emerge about the suspect, including that he was in the area of the Florida Golf Course for 12 hours, and investigators say he never fired a shot, he never had a clear line of sight of the former president. Lets get more now from nbcs Jesse Kirsch joining us from west palm beach, Ken Dilanian is standing by for us in washington, and also with us, a former secret Service Agent. Jesse, what else are we learning about the security that day . Yeah, so, ana, according to authorities, the latest information we have is that the suspect was spending about 12 hours camped outside of this Golf Course, based on Cell Phone data that has been reviewed, running up to his incident in which secret Service Agents saw a Gun Barrel pointing through the tree line, and shot at the suspect. That led to this arrest, which happened as you mentioned around an hour after this incident unfolded, based on our timing. And we spoke with the sheriff in the county where this arrest was made yesterday, or this apprehension was made, and they told us 15 minutes after the be on the lookout went out, thats when the suspect was spotted by his deputies who was part of the takedown two minutes later. This is video we have from that Deputys Body Camera released by authorities. Questions remain about the Security Presence, Secret Service was asked about how many times agents did a sweep around the perimeter of this Golf Course yesterday in that 12hour Span and Secret Service said because this was treated as an off the record movement, it didnt have the same kind of Security Presence there would be otherwise. That is adding to the scrutiny the agency is already under in the wake of the first Assassination Attempt on the former president. As the investigation goes forward, this is quickly becoming a political football. The governor of Florida Ron Desantis has announced that he is asking for a State Level Investigation and hes not just talking about this in the frame of mind of potentially getting a tougher sentence for the suspect here, hes also Casting Doubt on the federal Governments Ability to investigate. Here is part of us pressing the governor on this, this morning. Youre going a step further than saying you want to investigate. Youre Casting Doubt on the federal Governments Ability to handle this. Can you take us in your mindset, how is your concern about the how is your concern let me ask the question, sir. How is your doubt about the federal government any different than if a state or a County Level Prosecutor was looking into someone and then that person became a victim sometime later and the same Prosecutors Task with helping them. The federal government does not have jurisdiction to bring an attempted murder charge. So, again, the governor talking about this in the frame of the types of charges, but also Casting Doubt on the feds ability to handle this. What more can you tell us about the ongoing investigation and more on the new revelations about the suspects movements on sunday . So, the fact that he was there from 2 00 in the morning for 12 hours, ana, suggests that he had a plan, he was lying in wait. What the fbi was unable to answer at that News Conference Yesterday was when did he actually come to town . For all we know he was doing that every day that week or did he have reason to know that Donald Trump was going to play golf there that day or did he was he basing it on a pattern of Donald Trump frequently playing golf at that course . Those are all unanswered questions. As we learn more about the chaotic tumultuous life of this suspect, you know, everything from him going to ukraine to try to sign up to fight on behalf of ukrainians to him publishing a selfpublished book in which he encouraged the iranians to assassinate trump, hes got a long criminal history, he was convicted of possessing a Weapon Of Mass Destruction back in 2002 in north carolina, a machine gun, and thats why hes charged as a felon in possession with a firearm as we learned more and more about this person who does not appear to have a full grip on reality, ana. Jesse kirsch and Ken Dilanian, thank you for bringing us the latest information. The acting Secret Service saying there needs to be a Paradigm Shift. What do you think he means by that . He said a couple of things during that conference. One thing he noted was that off the record movement, otr. So traditionally otr is there for any protectee. Theyre going somewhere, it is not on their schedule. It is not made public. One of the arguments you can make here, yes, it was an off the record movement, but President Trump was going to a Golf Course that he frequents, so, is that truly does that truly warrant having less security, so to speak . The Paradigm Shift also, think hes referring to, is the outer perimeter. Here we have two incidents, first incident in july, again, the issue was, what, outer security. We have another incident, again, second incident, outer security. That lends to basically tell the story about were not securing these outer perimeters in the way that is functioning anymore. Traditionally you lend that responsibility to local law enforcement. But the fact that this individual had taken post for 12 hours and at no point it seems that anybody did a perimeter Security Sweep of the exterior of the Golf Course, of the fence line, nothing was caught. I dont know i do understand that drones were used, but my understanding is that drones were used in that immediate area where trump was golfing. But you need a larger canvas. In both instances, in these Assassination Attempts towards President Trump, were seeing people doing it from a distance. As an agent, one of the focuses that they give you is close proximity attackers, rope lines, crowds of people, and traditionally the shift which is the which are the agents around him, thats really their main goal, intercepting, looking at him, whats coming at me, who is in the bleachers. Here were seeing something else. The exterior, the exterior, the exterior. But components that usually monitor those things would be countersniper, which takes position to look out for other snipers, and i do believe that in this situation he did have a countersniper element, but for whatever reason, wherever they were positioned, they did not see the shooter. He also talked about having a more proactive rather than reactive element when it comes to protection. So basically what hes saying, we need to do a lot more Up Front to prevent these from even happening. Because i do sadly think that we might see more of these. The Moment Somebody feels like, hey, that person did it, i can do it, one thing the u. S. Secret service had going for them for many years is that element of you cant get to us. He cant get through to us. Here we see people breaking and breaching that exterior and thats going to be problematic. Second apparent Assassination Attempt on Donald Trump in as many months. Both President Biden and Vice President harris are urging americans to lower the temperature. On Social Media, trump blamed harris and democrats for the violent state of politics, posting because of this communist left rhetoric, the bullets are flying and it will only get worse. And here was trumps running Mate Senator Jd Vance. The big difference between conservatives and liberals is that we no one has tried to kill Kamala Harris in the last couple of months, and two people now have tried to kill Donald Trump in the last couple of months. Id say thats pretty strong evidence that the left needs to tone down the rhetoric and needs to cut this crap out. I want to bring in jonathan alan. Were expecting to see Trump Tonight at an event with his old press secretary, now governor, sarah huckabee sanders. What kind of tone are you expecting . Im expecting defiant, im expecting indignant, and from what we have seen from Donald Trumps Social Media, an accusatory tone. We heard it in the debate, just a week or so ago where he accused basically accused Kamala Harris and democrats of targeting in butler, pennsylvania, in july. And, you know, i think what we can glean is that hes going to continue to do that. We saw Jd Vance do it yesterday in that clip you just showed. This is a Republican Party that has decided theyre going to go all in on blaming the democratic party for, you know, in one case a shooting, and in the other case an averted, you know, potential attempted assassination, you know, which there is no evidence that because there is no connection to any of these democratic elected officials. There is no evidence of it. John, after the first Assassination Attempt we did see trump try to calm the waters, at least briefly. His rhetoric was different for a bit. Why isnt he trying to calm things down this time around . I think the simple answer is he thought it would be beneficial to him last time to try to calm the waters. He believed he would get a political bump from the first Assassination Attempt and did not receive that and is angry about it. Hes frustrated that didnt help him more, that that didnt seal his victory. I think there are a lot of republicans and some democrats who thought at the time that was going to seal his victory, that and as it turned out the american public is, you know, more concerned about other things right now. But he is not somebody who generally has tried to calm the waters, Hes Somebody who has stoked them, he inspired an attack on the capitol on january 6th, we heard him talk about punching out protesters at his rallies in the past. Violent rhetoric has come out of Donald Trumps mouth is hard to fit into a single segment, much less an entire show. So, just real quick, we are hearing something from the other side from the democratic side, Hillary Clinton Last Night talking about trying to calm the waters. I worry about threats. I worry about what is being said online, about many, many people, not just the former president. And he should be doing if he were really a leader, he should be doing what he can to calm the waters. Not try to just continue to throw, you know, Red Meat out there to get people riled up. Hillary clinton points out, there is a choice, Donald Trump made his choice. He has continued to escalate rhetoric over time and, you know, it does not appear thats helping calm the waters. Jonathan alan, thank you. When bigots spread racist language and rhetoric, when they are hypercharged at attacks on a singular group and hyperfocused on it for a while, remember Donald Trump, his attacks on Haiti Arent new, he called it one of those shole countries, Hes Something who said good immigrants are the ones from countries dominated by blondhaired, blueeyed individuals. He feels the same way about black people in america who are american citizens. I think this is a serious place to be. He knows it is a lie. Jd vance admitted it was a lie. He couldnt get what he wanted picked up by the media, he decided to create this lie and expand it. It put a target on the backs of haitians. It put a target on the back of black americans. At The End of the day, racist cant tell the difference between a haitian or a black american. Walking down the street. And i think even some of the photos that we have seen that have emerged on right wing Media Circles and across Social Media have been of Black Men, Black Men who arent immigrants at all. This is detrimental to the health of black people, when youre looking to the campaign and the candidate in Jd Vance and Donald Trump, who are used to ratcheting in racism, starting Race Wars, who want to see the worst of america come out who are amplifying White Supremacists this is par for the course for what they do. He set out a call that has invoked violence, but dangerous rhetoric, threats to the lives of everyday people who are just trying to go to work and go to school, and someone whose former College Roommate is a haitian, was a haitian migrant, who came here through asylum, her family doesnt live in ohio, but lives in tennessee, they too have seen some of these threats. Because of the level of danger that is imposed with somebody who used to sit at the largest seat of power in the world, basically tells people that it is okay to spread these lies, to spread these rumors and put dangerous signal out to the worst people in sight. You heard the governor, he said these migrants are doing essential work in the community, theyre here legally, he previously called the peteating claims garbage, of course, local officials have also debunked the claims, multiple times. But trump and vance, they are theyre not backing down. What is their objective . Well, their objective is to win this election by saying whatever they think will work. And, by the way, you know, the what were obviously this is shocking, it is stunning, it is a reminder that the words do have consequences. But also i think this is a warning, the degree to which Donald Trump and Jd Vance and much of maga is invested in these fake internet rumors, that they will that Theyll Stick with them even after they have been refuted, even by the republican governor. And i just think that this is one of those red flags that they are willing to tell lies, theyre willing to foment violence but unwilling to back off and tone things down. At a different town in ohio, a sheriff publicly posted on Social Media, referring to immigrants as locusts. And suggesting people write down the addresses of homes with Harris Yard signs. Amisha touched on this, how dangerous is this moment . It is extraordinarily dangerous, and it is going to get more dangerous as we get closer to the election and even in the aftermath of the election. And i guess this is what is this overriding irony from your last segment where, you know, Donald Trump and Jd Vance are accusing democrats of using dangerous rhetoric, which is simply projection. Because they have targeted specific groups of people. And they have not just targeted specific groups of people, but they have provided permission to bigots throughout the country to engage in rhetoric that frankly might have been whispered in private. But you would expect it would be Career Ending to say it in public. Here we are, and we shouldnt be numbed and Shouldnt Regard this as any sort of normal political rhetoric. Amisha, charlie says this is part of the political strategy for republicans to focus on immigration. I dont know how many times he has to show people that. This Whole Antiimmigrant xenophobic sentiment is something he carried for a very long time. He called them vermin. Hes called them locusts. This is the same type of rhetoric we heard in nazi germany, the same type of rhetoric we heard from stalin, this is the same type of rhetoric we heard from various groups of individuals who are not only strong men, but also dictators and authoritarian regimes this is something out of that playbook, but also something Donald Trump is fine doing and the Republican Party refuses to call him out on. I think that we also have to look to the fact that this is a guy who has done this his entire career. He has animus toward people of color, plain and simple. Hes utilizing it to disrupt the american psyche, to push toward a Race War and to bring together some of the strongest White Supremacists that this nation has ever seen.
