This weekend marks our celebration of labor day, and the unofficial end to what has been a historic and sometimes unbelievable summer. And now, comes the race to november with both kamala harris and donald trump each making their sprint toward election day. The 66 days to go, vice president harris has been busy on social media challenging trump on a host of issues as she looks to capitalize on a successful week including her bus tour through south georgia. On thursday around 7500 supporters packed and arena in savannah to hear vice president harris speak. It was the maxim capacity of the venue according to her campaign. And that momentum seems to be translating to the polls. A new fox news poll shows harris has put four sunbelt states back in place and she entered the race. Now she merrily leads trump within the margin of error in georgia, arizona and nevada, while trump is barely clinging to a one point lead in north carolina. The poll also shows the vice president has improved on biden's 2020 and 2024 poll numbers in those same states. But here's the thing we have to keep in mind. Polls are not predictive, they just represent a snapshot in time. And, they've been wrong before. I'm old enough to remember that in this exact month in 2016, fox news had hillary clinton crushing donald trump in the race by 10 points, while polls are useful, take into account that they don't always indicate what polars will ultimately decide in november. Nevertheless the vice president is using the moment to her advantage, even doing the one thing critics accused of do hurt a sitdown interview, in a conversation with cnn's dana bash, she and governor walz discussed a wide range of topics but there was one thing the vice president refused to entertain. That was trump's attacks on her identity and race. He suggested that you happened to turn black recently for political purposes. Questioning a core part of your identity. Same old, tired playbook, next question, please. That's it? that's it. That's it, as you can see, harris is not taking the bait on any of trump's attacks and he seems to be battled rattle by how she appears, race baiting and bullying are his usual go to moves but as he becomes more flustered by not being able to find solid footing, he is struggling to put out a consistent message on policy, case in point, thursday, trump initially told nbc that he thought florida's six week abortion ban was too short and he indicated he would vote for a proposed amendment that would expand abortion access in the state but just a day later, after pressure from activists, he reversed course and came out against the measure. So i think six weeks, you need more time, than six weeks, i disagree with that from the early primaries when i heard about it, i disagreed with it. At the same time, the democrats are radical because the nine months is just a ridiculous situation. So i'll be voting no for that reason. Besides trump's flip flopping on this issue, it's very important that we debunk his lie right here. Democrats are not and have not pushed for abortions at nine months. In fact according to federal and state data, abortions past the point of viability are extremely rare. Joining me to get us started and unpack all of this is congressman chantel brown from ohio. Thank you so much for being here. I want to start with the vice president's response on twitter regarding trump and his comments to fox, which he said first, he got row overturned and then got a better abortion band in 20 states and now he is voting for an abortion ban in the state that he lives and he will sign and nationwide abortion ban if it crosses his death. What do you make, congresswoman, of his back and forth on this issue, and how do you think if at all, voters will be able to reconcile his different positions? charles, first and foremost, thank you for having me. I have to wish one of my dearest friends a happy 50th birthday to lisa, now onto the business, trump flipflops more than my favorite sandals, you cannot trust a word this man says, he's gone back and forth on this position and the reason we are even in this situation is we must harken back to what you talked about at the top of the program and that is 2016. Now we are going to go on what antoine seawright refers to as a polar coaster from now until election day, they are going to go up and down. And hillary clinton was defeating trump according to the polls and some people stayed home and some people decided they were going to vote third party in protest because of her email's, and what we ended up with was donald trump in the white house and the ability to appoint not one, not two, but three supreme court justices who have overturned decades of precedent as it relates to women being able to make their own health care decisions, so i want people to be reminded of that and to understand if the stakes are equally high in this election despite the energy, despite the enthusiasm, we have to harness all of this and show up in the polls, that is the only way to stop donald trump, jd vance and their extreme project 2025 plans including a national abortion ban that has no exceptions and remember, ohio is the state where we had the 10yearoldvictim who had to flee our state to get the healthcare she needed because abortion is healthcare. Chantel, both trump and vice president harris are in a very tightly contested race and they both need to get as many voters as they can who are persuadable, to turn out, from either side, is there a world that exists that allows them to stretch and reach voters who are not a part of their base without losing the criminal portions of their base that they actually need to turn out? i've absolutely believe that, as we have seen with the organic organization of support for the kamala harris and tim walz ticket, i mean we had over 70,000 republicans are kamala harris on a zoom call, so i think the demonstrative of her ability to talk to people beyond party affiliation, during her interview, she spoke about her willingness to put someone in her cabinet that was from the republican party, so this is a woman who is truly for the people, she's about taking care of the people where you have a strong stark contrast, where we have the senator from my state, who really only needed one qualification to replace mike pence, who donald trump attempted to have assassinated during the january 6th insurrection which is why we have jd vance on the ticket in the first place, he met the one qualification that was to be the yesman to donald trump, whose only desire is to stay out of jail. So when you look at these two candidates, these two tickets, the republicans versus the democrats, you've got democrats who are fighting for the people, putting forth initiatives that are going to put money back into people's pockets, we have a lot more work to do and we are clear about that but on the other side, you have people who are just disrespectful to everyone, i mean from veterans to immigrants, to people who have disabilities, this is just not the type of people that you want in control in the white house or any organization, for that matter. Congresswoman, you mentioned it and i wanted to stay here for a moment, let's talk about the scene and interview that the vice president did. In it, she was asked about trump's repeated attacks regarding her race and ethnicity and claims that she in fact is not black and at this point, she neglected or opted rather, to address it. She really didn't respond at all. Dana bash didn't push back on it. Is it a winning strategy to not even engage around that question? it's working, listen, the fact of the matter is, the vice president, kamala harris, has been black her whole life and i don't think she's denied that, when you look at her history, the fact that she pledged a. K. A. And went to an hbcu, that speaks for itself. And so i applaud her not entertaining the foolishness that comes out of donald trump's mouth as it relates to her heritage and her race. As she quoted, a tired old a book that he continues to use to try to attack people that he is clearly intimidated by. I think first lady obama also touched on it, it's hard for him to handle people who are intelligent, highly educated, and hardworking that happen to be black, and so, what's understood must not be explained, it's evident that she's black and always has been and she's not flipflopping on that. Congress woman brown, before we go, one of the things that did not get discussed during the interview was the vice presidents position or policy around criminal justice and civil rights. When can we expect her to talk about that given her past as a former prosecutor? i think as she continues to crisscross the country and connect with the voters, you will hear more from the vice president on the great work that she did. I think there are a lot of misinformation that are floating around, you are an attorney so i won't pretend pretend to do lawyering but they get a bad rap but the people who are fighting for victims, that is a big part of her career. She has won billions of dollars for people who were being taken advantage of by big banks in california but i'm excited to see her talk about how she is put forward programs to reduce recidivism, and things that are beneficial to the people. I expect more than that and i think when people get an opportunity to hear how she has served the public rather than donald trump who only has an interest in serving himself, her numbers will continue to grow. According to the army monday, a member of trump's campaign staff abruptly pushed aside a staff member at the cemetery so trump and his campaign could take photos with families of servicemembers who died during the us military's withdrawal from afghanistan in 2021. The incident happened in an area where photos are usually prohibited. Trump said the family asked for the pictures and at an event last night last out at the criticism he is receiving. They said trump, president trump spent time at arlington national cemetery taking pictures and things. It's just so disgusting and i'll tell you, i get a lot of publicity, i don't need that publicity. I don't need that publicity. I get a lot. I get too much, i'd like to have half the publicity. I want to hire a pr person to get me half the publicity. In case you are wondering, hiring a pr person to get less publicity is generally not how hiring a pr person usually works but that's another conversation. Harris hit back against trump's antics tweeting, quote, let me be clear, the former president disrespected sacred ground, all for the sake of a political stunt. Joining me now is rena shaw, former cop gop senior advisor and a member of republicans for harris, and aaron haynes, and msnbc political contributor. So glad to have my favorites here. Rena, i will start with you, less than a hour after vp harris tweeted the criticism, jd vance was on the airways, he tweeted back saying, quote why don't you get off social media and go launch an investigation into their unnecessary deaths. What do you make of this sort of back and forth between jd vance and the vice president? putting my political strategist hat on for a minute, i would have advised that, it's fine to bring it up because that's what they wanted to do. He wanted to have that as a moment at arlington national cemetery where they could stick it to the biden/harris administration and say you failed in afghanistan and americans haven't forgotten. I mourn the loss of our fellow americans who served proudly and last their lives it was disastrous, but we've moved so far away from that, charles, and they are not able to land any punches and that is what sticks to me, jd vance, and all these weeks, and all of his fighting back at harris, there's nothing that has stuck and so he continues to go out there and try anything but this is not the issue they want to be talking about. They really want to talk about bidenomics and every day that they're forced to address one of their errors on the trail, talk about reproductive care access, abortion, that's the day that they miss a chance to say we will give you a better and more thriving economy and frankly they also haven't said how they would do that, either. It's all confusing right now. We will continue to see jd vance do this, mixed bag strategy, that's for sure. Erin picking up where rena left off, is the idea that we are not seeing as much substantive engagement from either side around policy. What does that do to the electorate and which candidate does that hurt the most, i mean you are talking about a political stunt at arlington national cemetery, not that that should be dismissed from a standpoint of respecting our armed servicemembers but when you are thinking about the policy that either of these candidates want to enact moving forward, the electorate is not getting a clear picture of that from either side but what type of back and forth, who does that hurt more, biden or harris, i'm sorry, trump or harris? this incident is really just reminding people of who former president trump was when he was in office, even as you have vice president harris attempting to introduce herself for the first time to a lot of the american people who may not have known what she was doing as vice president so that was what trump was trying to do. He was trying to seize on this issue and tie her to what he sees as a failed strategy in afghanistan but trump also has this record for his support or lack thereof of the military. We have a candidate who strategy of distractions working against them because this episode was distracting voters from what he was trying to draw attention to. And it's also important to note the other dynamic. And that is that harris really is reclaiming freedom and patriotism for the democratic party that was something we saw at the democratic national convention in chicago. And we see her on the campaign trail, there were flags all over the place, so no doubt former president trump is seeing this and trying to figure out how to counter what she is doing. Christina, you are our political scientist, so i want to broaden this. In the last block i had an opportunity to ask the congresswoman that when we might hear from the harris campaign around policy related to civil rights and criminal justice reform. Given kamala harris's history as a former prosecutor, how important do you think that is going to be to voters who are still undecided and evaluating her campaign particularly given the level of misinformation and mixed information that exists about her as a former prosecutor? i think charles that is the key that kamala harris is trying to combat a lot of misinformation and disinformation that's been out there about her since she was a senator. You know, her time as a district attorney and her time as the attorney general of the state of california is one of the things where there are lots of people who have parroted rumors and misinformation but they have no citations for it and so as she starts with her origin story in many ways, we saw that at the dnc, kamala harris, for the people, she will have to weave in interesting tale which on the one hand, doing her job, district attorney and attorney general, they are prosecutors, and they are to uphold the law in all facets and sometimes people who are african american get swept up in that net and on the other hand, there are a lot of because i think race and gender, there are a lot of stories about her that quite honestly are not true. And so she and also her surrogates have to make sure that they combat this misinformation and disinformation the people who have been parroting it, have to be clear and honest about the fact that they have not represented her background as accurately as they could have and should have, and we can fall into the trap of just because trump says it and says a lot that all of a sudden, that its fact or worth repeating and asking harris about. On the one hand she is reintroducing herself to people and on the other hand, she is introducing herself for the first time to some people. So some of these policies, she will say biden and i did them and other policies it'll be a fresh new day and she is forging her own path as the presidential nominee. It'll be interesting to see which of those policies that she sort of advances on her own and which she attributes to her 10 year with joe biden as the vice president. Arena, you are our strategist from the gop no less, i want to have you put your strategy hat on. You watch the interview thursday, donald trump has really struggled to try and land anything substantive, with respect to her candidacy, if you are advising the trump campaign, one thing that you take away from the interview that you think could potentially be turned into a positive for trump's campaign, in terms of trying to respond to kamala harris? look, the interview didn't help her or hurt her and i think it was intended to be that way. I thought it was not a slamdunk but i was very satisfied from a political professional standpoint as to how it was conducted and essentially from cnn as well. Look, in general, what people are going to is that it was a scripted interview. It was a sitdown interview in the first time in which she was able to not only hammer home the point she wanted but to essentially just be there for the first time and hold steady again, that was the point. Now from there, how could trump take this as a win? that is what he is working with tulsi gabbard on, how he can really stick it to her in the debate and how he could do that, look i don't want to be helpful to him, i've been trying to defeat trumpism for eight years but she didn't speak in specifics this past week, so she's going to have to drill down on every single place even on fracking, she didn't say why she evolved, she just said i've changed, she will have to drill down, get a little more detailed and give us more and she has some time to do that. Again she can do it on the debate stage but she'll also have to divorce herself of bidenomics, because that's the one place in which they want to get her and i think he can be successful if he goes into the data points and really details are there but i also don't trust that he can do that. I think given what we've seen thus far, i think many of us are wondering if he can make that happen in terms of attacking the policy or combating the notion of bidenomics but it remains to be seen. This week democrats sued the election board over new rules they say would create chaos on election day. The lawsuit alleges that the new rules give local election officials and illegally wide berth to hunt for irregularities of any kind particularly slowing the certification process. Viewers may remember the 2020 election when then president trump made that infamous pole call to george's top election official, republican brad robbins berger, urging him to find the votes that he needed. That is at the heart of an ongoing case that is being led by fulton county da fani willis that alleges that trump attempted to overturn the results of the 2020 election in georgia in part, by pressuring election officials. Greg can you explain what is the big issue around this in terms of why they are controversial? the big issue around them is it so close to the election so even republicans, even who oversees the elections process in georgia is saying these are 11th hour changes proposed by unelected bureaucrats. It's a five member board, which has been held in check by a more mainstream block of voters, the swing vote on that fivemember board recently resigned, letting a maga republican take his place and that is what has happened here. You know, there's the processes that are being proposed, there's an undefined ability to scrutinize election results that has no definition, so the worry is that local elections and there's 159 election boards, the worry is that even if one of these counties holds up and refuses to certify the election results in november, that could throw the results to an undefined system to the courts, to unchartered territory. Speaking of this uncharted territory, senator, you filed an ethics complaint against the board. What do you see as the potential impact that these new rules can have on the election and why is it that voters should be concerned? voters should be concerned because now we have a state elections board that isn't concerned with their election, they are trying to rig the election in the favor of their preferred candidate which in this instance is donald trump. So we have these maga election boards that are passing these election rules illegal election rules to allow officials to obstruct the certification process. And that essentially is obstructing our voices at the ballot, which could cause massive delays during election day, and we need to make sure that this does not happen which is why i filed my ethics complaints, and i'm still waiting to hear back in the governor as to what his next move is, but we need to immediately have a hearing to remove these election members. Greg, what we know about trump and georgia governor brian camp is that there hasn't always been a warm and fuzzy relationship between the two in fact trump has been particularly critical of the governor in georgia and now that this is a part of the conversation, it feels like governor kemp finds himself between a rock and a hard place in terms of loyalty, in terms of trying to not necessarily upend georgia state politics at the expense of the leader of the republican party, but at the same time, having to deal with someone who's been blazingly critical of him, and what type of disarrayed is donald trump, sitting at the head of the gop create, not only in georgia but also with other down ballot races throughout the country? their relationship is like this epic saga, donald trump helped brian kemp get elected and then he blamed kemp for his defeat in georgia in a state that democrats had lost in every election for nearly 3 decades, and up until now, it seemed like they have this uneasy truce, they had found a way to kind of get along with each other and then in early april out of nowhere, donald trump bruises, parades, brian kemp, in a way that not only took folks in georgia by surprise but also took trump's advisors by surprise. It looks like they have each day tentative truce again and brian kemp, to him, this is a one sided truce, he hasn't talked with trump since 2020 but he also doesn't want to pick a fight because brian kemp also has political aspirations in the future. He can't be seen as a traitor to the party. Certainly like ray charles we will all have georgia on our mind, thank you very much to you both. Welcome back. Welcome back. There's a new tugofwar between donald trump and special counsel smith. The latest back and forth is about the former president's federal election interference case and whether is covered by this year's immunity ruling from the supreme court. Late last night, a team of trump lawyers proposed a schedule that would delay a court fight over the issue until after the election, and a potential trial until after inauguration day. Jack smith's team once the court to begin to consider arguments on immunity immediately. Earlier smith filed a revise indictment removing elements from the original that could possibly violate the supreme court decision. The decision granted broad immunity for official acts of the president. Judge chutkan has sent a hearing scheduled for thursday to discuss the next steps. Joining me now joyce vance, former u. S. Attorney in alabama, superlawyer and co owner of the sistersinlaw podcast, i get to take off my glasses and talk to a lawyer, joyce, so great to have you. I read your piece around the superseding indictment that you wrote for sub stack, very impressive and very clear. You said this should be taken as a sign that jack smith is just getting started. What do you mean by that and what do you think we should expect going forward, following this immunity decision? it's clear from the superseding indictment that smith understands what the assignment is here. And that is to hone the indictment down to the point that it complies with the supreme court's directive that he can only charge donald trump with nonofficial conduct or perhaps with official conduct, if he can overcome the presumption that charging official conduct would be damaging to the office of the presidency. That means there are a lot of finely tuned decisions that judge chutkan would have to make about which charges can go forward and what evidence the special counsel is entitled to use. That's the process that we will see underway here. And i would hazard a guess that the judge will not believe that it would need the attenuated time and scheduling that trump's lawyers have proposed. We can anticipate a significant amount of back and forth between trump's attorneys arguing for a broad application of the supreme court's ruling and then obviously jack smith, looking to be as narrow as possible and how that is done. If you are in the driver seat and you're looking at this objectively, how good do you feel about what could remain of all of these indictments, if the supreme court decision is broadly applied the way that trump lawyers are going to seek to have it done? well look, trump's lawyers want the entire indictment to be thrown out. It's unlikely that that will be the case and even the supreme court did not go that far when they wrote this opinion. Because there's a lot of conduct involved in this indictment that is personal conduct, it's the conduct of candidate trump not president trump. Where the lines will have to be drawn though in the supreme court as you know, we discussed this before, they didn't really establish a test for judge chutkan to use in deciding where the dividing line between official and unofficial conduct is, and perhaps more importantly when the presumption against indicting or charging official conduct when that can be overcome. She will take the first cut at that but it's very clear that there will be another round of appeals to engage in oversight over the decisions that she makes. I'm so glad you brought that up. Part of the thing that most people have been concerned about watching this unfold, and you and i have been following for this from the beginning with all of the indictments, has the supreme court given donald trump's attorneys another path of delay? you talked about the fact that these decisions are likely going to be subject to another round of appeals. So has the fact that the supreme court did not create a hard and fast test, ultimately given trump's team another avenue to push this further and further by challenging whatever the decisions are provided they are not out right dismissals? it's very likely there would have been a second round of appeals following the judges decisions, even if the supreme court had set out a clear test. And that is the case because the supreme court says that trump should not have to go to trial over conduct that he is entitled to presidential immunity for. That means that the appellate courts will take a second cut at it after the courts originally found that the judge got it wrong the first time. It's a complicated process, and the court makes it much more difficult for the judge to get it right, by failing to set forward a streamlined test. That's one of the many flaws in the court's decision in the immunity case. I have about one more minute and i have to ask, what is the likelihood at all that this case, the election interference case sees the light of day before november? it won't. Is a new voter suppression effort in the state of nebraska and soon the nebraska supreme court is going to weigh in on republicans latest attempt to restrict access in that state. Early this year, the nebraska lawmakers made headlines for passing a bill to restore the voting rights of those who completed their sentences following only convictions but nebraska secretary of state and several other top officials were against it, even going as far as to direct county officials to stop registering people convicted of felonies to vote if they hadn't been pardoned. It's crucial to remember that americans who have completed their sentencing have paid off their debts, and they are expected to integrate back to society. But then taking away something so crucial like the power to vote can isolate thousands of americans who want to make a difference in their country. This is a problem that disproportionately impacts communities of color dd eand specificallysoa;■ black men. Join me to discuss is darrell atkinson, codirector and cofounder of forward justice, darrell, thank you for being here. What are your thoughts on the latest news coming out of nebraska, if there supreme court is able to uphold the decision by nebraska's secretary of state, they are going to be at least 7000 residents who will be disenfranchised come november. Yeah, thank you for having me, charles. Our country is always stronger when we enlarge the week we, in we the people, we do that by giving folks a civic voice, the state legislature of nebraska did that by passing a law for people with felony convictions after they have completed their sentence, to be able to get their voting rights back but charles, we know whenever we have progress in this country, there's always going to be backlash and here comes the backlash where the opinion from the attorney general, which prompted the secretary of state to make this move. Legally, though, i think there may be some remedies in play, for the nebraska supreme court to maintain the status quo, because of the electoral doctrine called the purcell doctrine, the courts are leery to upend voting rights rules shortly before an election. They want to maintain what is called the status quo, the status quo, should be in this case, because the nebraska legislature duly passed a law through normal processes, and the attorney general had an opportunity at that moment to bring up any issues that would have implicated the constitutionality of the law and that didn't happen. I would hope that the nebraska supreme court would kind of maintain and move in favor of traditional voting rights doctrines, and maintain the status quo, which should be that the state legislative law that was passed by the legislature, should stay in ive general and the move from the secretary of state. That's what i would hope. Darrell, i want to broaden this conversation, not just to c include voting rights but looking at the impact that the stigma of being a convicted felon can have on someone's status and life, employment opportunities, trying to seek higher education or postgraduate education, things of that nature. Can you sort of talk about how unfair of an expectation it is that people who are citizens who are just as impacted, are supposed to be fully functioning members of society but the stigma of being a convicted felon prevents them from participating equally in these processes, like voting, like getting employment and why those movements exist and how we reconcile that? thank you for bringing that up. It's not only that statement, it is the legal, civil laws that are implicated once you are convicted in the criminal justice system. There are tens of thousands of laws all across the country that apply to people once they are convicted of a felony or misdemeanor. They can include not being able to volunteer in your kids un school, not being able to get a cosmetology license. In the state of north carolina, one in three jobs requires some kind of license or certification and criminal record history often bars people from being able to receive those opportunities. And then couple that with difficulty getting housing, not being able to be cynically engaged. You have all of these things hitting you at once. The cumulative factor of all of these, with the criminologists call consequences hitting you at one time is antithetical to what we want people to do once they get out which is to be fully functioning members of society and fully participating, right, we are almost setting people up to fail.
