>> reporter : sources tell us campaigning is his debate prep along with informal policy sessions with advisors and members of congress focusing on inflation and immigration. while president joe biden is hunkered down at camp david by intensive prep sessions that will include mock debates, playing the part of mr. trump's former white house counsel bob bauer who took on the same row in 2020. the president looking to focus the debate on abortion rights and what his campaign says is trump's record of undermining democracy. trump is saying his yet to be named running mate will be at the debate and that he has made his choice but has not told anybody what it will be. sources tell nbc news the focus has been on three top contenders. each with a history of being critical of tropical florida senator marco rubio ran against trump in 2016. >> what we are dealing with is a con artist. he is a con artist. >> before entering politics, ohio senator jd vance adamantly opposed tropical and north dakota governor -- briefly ran against trump for this year's nomination. >> would you ever do business with former president donald trump? >> i do not think so. >> why? >> i just think that is is -- it is important you are judged by the company you keep. >> reporter : all three vp contenders are loyal allies of the former president. sources say the campaign wants a candidate who will not overshadow mr. trump but also someone who could be the future of the republican party. the campaign is weighing whether to announce his vp pick before or after his sentencing for his conviction in new york scheduled for july 11, just days before the republican national convention., thank you for that. let's go to the white house with the latest on the debate preparations. what hearing from the campaign? >> reporter : just four days remain until president joe biden and former president trump face off on the debate stage for the first time in four years. you heard -- a little bit about the debate preparations at camp david. he is leaning on the expertise and experience of some of his closest allies, his campaign staffers to study his policy material and try to go over the contrast between his and his predecessor's records. he is also honing responses to what we expect to be inevitable, possible personal jabs from president joe biden -- on former president trump on president joe biden on his age and mental fitness which we just saw in the last few hours as a former president marked the president suggesting he would use supplements to improve his debate performance. we know the biden team is preparing some sharp lines. we heard from the biden campaigned cochair of meet the press this morning and he signaled to our own peter alexander the president would seize on the former president's felony conviction in his new york hush money trial. >> it does not matter how former president donald trump shows up if he comes in unhinged like he is most of the time or sits there and is quiet. people will know he is a twice a peach, convicted felon who has been found to have defamed somebody, sexually abused somebody and got bankrupt six times. they will always know that and that is something the american people have to think about about the wisdom, the character and judgment of the person they will appointed to lead america at home and to the rest of the world. >> reporter : the biden team says they see this as an opportunity to get the voters who have not been tuned into the election so far more engaged before november. they released a memo this morning saying they are planning to host more than 1000 events across the country and released new digital advertisements in the lead up to the debate. >> thank you for that. let's bring in a scene or spokesperson for the biden/harris 2024 campaign. good to see you. we know president joe biden is actively getting ready for the debate but can you give us specifics on the prep and his strategy? >> it is great to be with you. i can tell you president joe biden is taking his debate preparation seriously because he knows this is the first time the american people will see him and former president donald trump on stage having a real conversation about their very different visions for america. president joe biden wants to see americans drive. he wants to continue to lower costs for the american people and make sure everybody in america has a fair shot. where is former president donald trump wants to get back in office so he can seek medical revenge on his enemies, he wants to give corporate tax cuts at the expense of middle- class families. he is a dark vision, he wants to lead he said he made it clear he wants to be a dictator on day one. division these two have cannot be more different and the contrast could not be more clear. and president joe biden nose, again they have not been on stage together in four years, this is an important moment in the campaign and he wants to make sure the american people truly understand the fundamental choice in front of them going into election day. >> you heard this mentioned, with the biden campaigned releasing the new memo detailing initiatives for before, during and after the debate. can you walk us through those plans and why is the debate the launching point? you just made a very observant comment, four and half months until the election. does the american public have the stamina to be really hyped up and engaged for four and half months? >> yes, i think they do because they understand what is at stake. this is about the future of their lives and the lives of their children and their own personal freedoms and the future of women to make their own reproductive decisions about their bodies. donald trump has done so much damage to this entry. most noticeably, putting three extremely conservative justices on the supreme court during his time as president but have ripped away the freedom of americans on a number of issues. again, joe biden wants to make it clear to the american people what the choice is. without it was important we have a debate in june. the reason why, it is a little out of the ordinary compared to past election cycles but voters are starting to tune in and we want to make sure that the republican convention is coming up next month, we wanted to make sure the american people had a chance to see a conversation between the two people, one of whom be the next president of the united states and understand what is at stake. >> the biden campaign has been sending a clear message, donald trump is worse than ever. take a listen. >> we have seen, since he lost the 2020 election and snaps, he has become even more unhinged and extreme. >> people who know former president donald trump the best like him lease. that is worth taking a moment on thinking about if this guy will be better next time on being bad. >> we had earlier, stamped, not the first time someone in the biden camp has used that phrase. does the campaign see this as an attack line or a statement of facts? i think it is a little bit of both. first and foremost it is a statement of fact. when former president donald trump lost the election to president joe biden in 2020, something happened. he snapped, he became even more unhinged than before and has become more erratic and more unhinged. he has literally told us in his own words that he will be a dictator on day one. think about that our entry was built on democracy. one of the reasons why we are so proud to be americans. have so many personal freedoms in this country. former president donald trump is to take those freedoms away and be a dictator on day one. he has also made it clear if he does not win this election, there will be a bloodbath. some of his aides have tried to say we are overstating that. no, he has said that in his own words. you will hear us making the contrast point more and more but it is also a statement of fact. something the american people need to think about what they are deciding who to vote for. >> meet the press, they were signaling president joe biden will bring up donald trump's conviction during the debate. is that the case and what could be the framing and how hard my t hit that issue? >> i do not want to get in front of president joe biden and what he will say in the debate but i will say that we are in the campaign and president joe biden has made the point that the difference between former president donald trump today and a couple of weeks ago is that former president donald trump is a convicted felon. that is a fact. 34 felonies, a convicted felon running for president of the united states. i think you will continue to hear another point, one of the reasons why former president donald trump wants to get back in office is because he wanted to try to seek immunity. he does not want to have to go to jail for the crimes he has omitted. he does not want to get back in office because he wants to help the american people he wants to get back in office so he can protect himself from serving jail time and also he wants to make sure he can use the office of the white house to seek political revenge and retribution on his enemies. contrast that with joe biden, he wants to continue to lower prices for american families. he wants to continue the work he has done to implement historic climate change legislation, to expand the affordable care act and lower healthcare costs for more families in this country. to make sure he can do everything he can to allow women to make choices about their own productive health. that is what joe biden is all about. former president donald trump simply wants to get back in there to seek revenge. the contrast could not be more clear and you will hear more and more about this in the direct words from joe biden thursday night. >> what about the biden campaign which won the debate going toss. the president chose to take the podium on the right but that will give trump the last word in closing statements. why does the campaign see the podium position at and -- an advantage? is the debate over, under or hyped just the right amount? >> i think it is hyped just the right amount. the special thing about this debate is ultimately, it is a capitulation to the idea that donald trump has removed american alex from any of the norms each of us build careers in and the american system is built upon. that makes typically happen in university setting with an audience and there also is a vice presidential debate which it does not like -- seem like we will be having this year at all. this debate is a strange animal all of the door because former president donald trump has represented something that has removed american politics from something any of us knew and understood. i also do not think it will be a controlled environment the democratic advisors are looking for is there is no way to control donald trump. there is no rising to the occasion for the magnitude of the situation. he exists to throw bombs into everything and there's no reason to think the debate will be any different. i do not know if it has been hyped good, bad or the right amount but i know it is an interesting animal that will give joe biden the opportunity to present his case but there is no reason to believe former president donald trump will respect that. >> what about you susan, the needle has not moved so much in the race to think the debate makes a difference? what impact for voters sing the two candidates going at it again. >> while i do not think the debate will make a huge difference in the polls, unless something really big happens, some big moment, putting that aside, it probably will not make it big difference in the polls. to the point on former president donald trump, let's not forget he does not play by the rules. while he made a interrupt joe biden, he may pick a fight with the moderator. those are the types of things he likes to do. i think he will look for more airtime by fighting with the debate moderator. at the end of the day, i think it is what the campaigns do after the debate. how they get out there, who is spinning for them. i think the debate watch parties and social media campaign that the biden folks use is great. especially when you compare it to, you know it will be a fundraising call from donald trump immediately after. >> for sure. what issue can biden most correct the record on during the debate? economy, immigration? >> look, i think short of a medical episode by either candidate, the debate will not change the race it will offer it. in affirming it i think you will hear joe biden talk about the economy in a real way. what he should be trying to get home, i do not think the nation has had this conversation yet, yes inflation is bad yes joe biden is working on it but it we are discovering is inflation is not the number 1 economic metric and forming voters or at least it should not be. the stock market is at an all- time high, more people go to work tomorrow than ever before in american history. the opportunities to access healthcare and education are at historic highs. the economy is going well. you drive down the street and see new construction and businesses hiring and new businesses opening. the american people know that and are starting to feel that but they are dogged by a two year conversation about inflation. this time i want to get back to what you were saying about trump's tenor. the candidate's microphones will be turned off when it is not their turn to speak as an effort to avoid moments like this one in 2020. >> votenow, make sure you in fact, let people know your senators, i will not answer the question -- >> why would you answer that question? >> you have a lot of people -- radical left. >> will you shut up, man. >> who is on your list? >> this is so unprecedented. >> gentleman -- >> i have to say i smile every single time i hear that and joe biden goes will you shut up, this is so unpresidential. my point is could this with a muted microphones, could it help former president donald trump in any way? >> no. i do not know how it helps former president donald trump, i do not know, there is no controlling donald trump. if you pick up the snake, the snake will bite. if you put these candidates in this environment with all of the rules that biden's close circle of advisors have concocted. let's be clear, this debate was taken out of the realm of the control of the united states commission on presidential debates. that is what has created an entire universe on how we govern ourselves and behave around debates. from choosing a moderator to choosing candidate behavior and audience behavior. that is formulated and created over the course of 38 years by the u.s. commission on presidential debates. my gripe with the situation and the one that will follow his there is no infrastructural fidelity all participants have to agree to and stick with it. not only is the never any controlling donald trump but now we have removed governmental nonpartisan body who was responsible for creating these debates. there is no universe in which we can protect how candidates will behave or how this will come off now that is has been removed from any type of infrastructural underpinnings. we cannot control donald trump, i do not know what effect the microphones will have but i do know this is completely unwarranted territory removed from the entity that is done for the last two generations. >> susan, you wrote about the way biden should answer questions about his age, trump is only three years younger but biden gets the bulk of the scrutiny. you said given the choice i would rather have someone who shovels a bit been a man who is clearly unhinged and cannot hold a train of thought. what is your best advice to biden on this issue? does he just simply say you are only three years younger than i am, you are 78. >> or, he does it with a little bit of humor like he did with saying for former president donald trump's birthday from one old man to another. there could be a line they come up with. the most important thing joe biden can do and what i wanted to target in on, in the clip you just show, joe biden was very disciplined in trying to stay focused on talking to the camera and moderator if you notice. it was when former president donald trump just kept going and going. biden will be able to hear trump go on and on but no one else will. the key is for biden to stay focused and know that everything is going to be more or less, a right and left image if you will of the two men and he has to keep that in mind he has to work the camera. >> i want to get both of your don and david to talk about the washington post which spoke to many of what they're calling the double haters who do not like trump or biden saying they could help determine the outcome in the swing states. 53% of these double haters plan to vote for kennedy while 95% for biden and 18% for trump. the majority of these voters lean democratic to begin with. how concerning is that for the president? >> short of me being able to find these people at their gatherings and grab them and shake since into the. what i would suggest to the double haters, ultimately, they are logically flawed because they present a certain intellectual parity when they talk about who sucks worse are the worst of two evils. you are describing a certain amount of intellectual parity to both candidates which is not there. primarily because the biden administration, not even if you are a democrat but objectively has done a good job, guided the country through covid-19, past the inflation reduction act, if the structure funding going to the states for meaningful projects. student loan debt has been reduced, the consumer financial protection bureau is taking $1 million excuse me 100 million americans to a different credit posture based upon medical debt being categorized differently. it has been successful and has put up meritorious points and no -- in a way the trump administration has not. double haters that presents -- an executive observation of fact is not really warrant, merit or desire. there is no real intellectual underpinnings to that other than the notion we continue to not have the luxury natalie is black folks but as progressives being single issue voters. >> david, is it important to remind those who want to cast their vote for rfk junior that it will not get you a president elected? >> it is, it is important to do that and the extent that the rfk voters said disproportionally high in the double hater color. a double hater cannot be gotten or if the candidate is too expensive for either campaign because they will make up their mind on the last day. a true double hater you cannot get. but i think adjacent to that group are truly thoughtful voters that are deciding right direction or wrong direction and have questions about the leadership of joe biden and if former president donald trump would do things differently. those are the voters that that biden camp can get because they have such a good story to tell. right direction, wrong direction voter sometimes i think it is confused with the double hater a different photo. >> what about the vice president steaks, trump said he knows in his mind what his vp will be, that person will most likely be at the debate. north dakota governor, the ohio senator, marco rubio is also in there. who do you have your money on? spend my money has been on rubio for a while which is why i think he will pick bergen. jd vance should be tossed out he is unqualified. if it is truly between bergemann and rubio, the nation should breathe a sigh of relief that is not carry lake or marjorie taylor green that is not -- marco rubio is qualified whatever you think of his ideology. i think he might choose bergemann because he is such a boring leader he would never take the stage from trump and they get one this race all the way through november with the nation saying who is the vp? >> what i expect her to do and what she should do maybe two different things. for the hearing tomorrow on the gag order, jack smith's files that motion a month ago. what he said was you have to stop former president donald trump from lying about law enforcement and saying they are out to kill him and his family. why, because former president donald trump knows those statements are lies but jack smith said this is putting law enforcement lives in danger. he said imminent threat. hour the judge, a month has gone by she has sat on her hands and not done anything, just last week, there was a person who called up an fbi agent on hunter biden's case and said, if former president donald trump wins, we are going to hunt agents down, we will slaughter your entire family. these kinds of threats, former president donald trump, when he makes these statements, he is inflaming his base. that is the purpose and by not taking immediate action to make sure he cannot do that, she is allowing this kind of inflammation of the space to continue. what she should do tomorrow is stop playing games. she needs to focus on the issue, she does not need more briefing, it is a straightforward issue. she needs to issue a narrow gag order that says you cannot put enforcement lives in danger. this should not be controversial should not be taking a lot of time. a lot of these other motions she is dealing with a completely frivolous. there is no need for a hearing on them. there is no need for a hearing on whether jack smith was able to be appointed by merrick garland. it did not need to be a hearing it should've been an order. this issue about the lives of law enforcement, that is something she should have dealt with right away and she should be taking it seriously. >> point well taken. one of the surprising thing she did friday was to press prosecutors on the extent of the attorney general's oversight of the trump investigations. then, she criticized the lawyer who said it was against the it a policy to get into specifics. how do you interpret that, considering she is also a former federal prosecutor? you would think she would be familiar with doj policy. >> she should be and she should know what the regulations say. which is, merrick garland, while he does not have day-to- day supervision into jack smith's investigation because he is special counsel. merrick garland is allowed, when there are significant investigative steps, things like eating a search warrant or an indictment those are things that need to be reported to the ag by the special counsel and if they are well outside the bounds and rules of the department of justice, they are things that the ag would have the right to overrule. that is why the special counsel under the appointments clause is an inferior officer to the attorney general. that is why this appointment of jack smith is completely constitutional. hurt getting into the nitty- gritty of what merrick garland did or did not do, she does not need to do that to be able to rule on the motion. she knows what the regulations say. >> let me ask you before i let you go with regard to the supreme court which will deliver more rulings starting wednesday, is the trump immunity ruling coming this week?
