criminal conviction? today, the campaign announced a $50 million ad. part of which will be used to highlight the simple fact that their opponent is now a felon. and if there goal is to break through a broad audience with that fact a week before the debate, the announcement is pretty good start. we are going to play in full in just a few minutes and talk to deputy campaign manager about the strategy behind it. but first, as we get closer to election day 2024, it is clear that a key piece of the trump strategy is to continue to stop the same lines they pushed in 2020. and you would think that after charges were brought against the former president at the federal level and against many of his accolades in five different states, they might try a different approach. maybe cut it all out but instead, four years later, the same dog is relying on the same old tricks. but this time, the language is actually getting darker. listen to how trump talk about the election over the weekend. >> the radical left democrats rigged the presidential election in 2020 and we are not going to allow them to rig the presidential election in 2024. >> listen. we are the votes. we got more votes than anybody has ever had. we need to watch the vote. we need to guard the vote. we need to stop. >> do not worry about voting. worry about guarding the boat. stopping the steel. his favorite phrase. trump's daughter-in-law seem to go even further. >> we are also sending a loud and clear message out there to anyone who thinks about cheating in an election. if you cheat in an election, we will find you, we will track you down and we will prosecute to the full extent of the law. >> we will find you, we will track you down. that is not intimidating at all. if it is not clear, there goal is to scare people. to prevent people from voting and spread the falsehood that people are cheating. it mirrors their strategy of four years ago when he temped to fraud the american people and disenfranchise the majority of voters. of course, as you know, there was no evidence of cheating, there was no still to be stopped. the only major prosecutions that did come out of that 2020 election were of trump and his allies who illegally try to overturn the results. but now, trump's allies are using an even darker version of that very same playbook. here is soon to be incarcerated steve bannon. >> if they steal this election and they fully intend to steal it, this republic ends. are you prepared to fight? that is been the message from trump and his allies at rallies, fundraisers, and in conservative media constantly. they are priming their supporters to reject any reality where donald trump does not win. what makes it even more concerning is that trump was also signaling. if we do something illegal to help me, i will just for it. trump is amused about pardoning every which remains a wild think this a lot but it is a fact. think about how extreme something has to be right now to be a bridge too far for people like tom cotton and tim scott? >> you disagree when donald trump says as president, he will consider pardoning everyone of the january 6 writers. he denies that he would. i think what that means is what he did his first term, he takes case on a case-by-case basis. >> anyone who attacks an officer on the capitol grounds or anyplace in the country should serve time. >> not all the insurrectionist. even tom cotton and tim scott, by the way, who will desperately want to be the vice president will not go that far. apparently, neither will the people advising trump. as the washington post reported, some trump advisers and administration alumni involved want trump to limit his political exposure by distancing himself from the most violent offenders. but i do not think trump is going to do that because the most important thing to him as been evidence over and over is to signal to his supporters that if they do something criminal on his behalf, i will be forgiven. guard the vote, stop the steal. get ready to fight and if any of that involves a crime, we have your back. in that same washington post, these insurrectionist sewer in prison was quoted saying it is a badge of honor. most of us got caught up in the fray and i would do it again. considering the narrative that trump and other republicans are pushing, why wouldn't he? news is similar and it even worse, particularly when you hear steve bannon basically saying fight or die because trump is doing what he did prior to the last election which is laying the seeds that it he loses, he will challenge it as illegitimate. if there is no way he can lose and look, the thing that donald trump appears more than anything else is being labeled a loser. he is probably even more willing to be called but he is a loser and he is desperately afraid that he may lose again and if he does lose again, he wants to challenge the results. he is laying the foundation. what we saw was even last less rhetoric four years ago that it led to a violent confrontation and a mob descending on the capital. now that they are escalating the rhetoric added to this for trump, if he doesn't win, he's going to jail. if he has all the more reason to contest, it is more the same but even more dangerous. >> you talked about a lot of the show is how much we should be concerned about something? this rhetoric is certainly scary. he has tried to whip up his supporters to show around his court appearances. he has not been successful. at the same time again, which languages gary. how should you, if you are talking to your neighbors, your campaign across california, what are you telling people about the level of concern they should have? i am encouraged by the fact that as you say encourage people to rise up if prosecuted. they did not rise up. there was no this method protest. he was convicted. was barely a stir among rabid base in terms of any public protest. but at the same time, you cannot discount the chance that if he loses again, when he loses again, but he will go to even greater lengths to try to overturn the results. the worst-case scenario is that the result is close. instead of a broad victory like we saw by joe biden four years ago where he won in numerous battleground states by good margins, let's say it comes down to a single state and there, i really do worry and there is simply no institution we can rely on. i would not want to rely on the supreme were in another close contest any more than we saw. because it little confidence, that would be a different kind of catastrophe but the only remedy, really is the one in all of our hands and that is to make sure that joe biden wins. this is not close. that is the best way to avoid any kind of instability postelection. >> congressman, one of the challenges that you have warned about and others have warned about from the committee is the role of enablers. trump and mike johnson met today in mar-a-lago. it was reported in last few days that trump called asking for help in overturning the conviction. that is not a role as far as i concern that the house could play, even the speaker of the house. are there tactics? contrast in that ad. that is the choice. just over a week, the biden campaign betting big that aggressively calling that out now will help them shake up this race in the debate. this new ad is part of a $50 million ad but it will air across all battleground states starting today. will we hear more on this line from himself and will any of it resonate? here to talk to me about it is one of the folks campaign manager and he joins me now. i know you got a lot on your plate. thank you for taking the time. this is a very forceful add which is why we want to play it. as part of a very significant ad. we want to start by asking you who knows more about the swing states and where things work? that is what you oversee. which state is this going to play and of the swing states? if you tell us more about what is going to be? >> we are talking to voters and a number of states. it is the typical states. north carolina, florida. look. we have to get the message out in the method is very clear. this election is about somebody who wakes up every single day fighting for the american people and donald trump who is only in this campaign fighting for himself, he is a convicted felon. the two oldest heard in the ad and he will do anything to hold onto power so that he can continue to run a campaign on revenge and retribution. we have to make sure that the american voters know that donald trump is not thinking about him and meanwhile, president biden is waking up every single day fighting to lower cost, making preparations and that is what this election is about. >> that was the core message of the ad which is a very powerful ad. had the voice of a narrator which i think probably a strategic choice. the first presidential debate is 10 days away. is the ad a review? that tone, that contrast? what we should all expect to hear from president biden on the stage. >> yeah. i think president biden is to make sure that donald trump has the answer for his extreme agenda. answer for why he continues to double down in grip away freedoms from the american people including millions across this country who have less freedoms than their ancestors because of donald trump and what he has done to the country and why he continues to throw the middle class under the bus at the expense of wealthy corporations and his wealthy friends. that is what president biden is going to get on stage and hold donald trump accountable for. >> i also want to ask you about a statement that biden campaign put out following comments from former truncated that confirmed trump talked about getting american. this was a fiery statement. the statement called out trumps thirst for violence and that he is completely snapped. you cannot make this stuff up. a lot to respond to. i was curious because i think a lot of democrats out there, people who have written for biden cheer for that and think this is fiery. we want to see this as close to fiery language. is this the type of language and tone that people should accept expect moving forward? >> look. we are going to continue to make sure we are calling attention to it. some of our statements are a little bit more spicy but it's what it necessitates. this is a pattern in an agenda. that is the whole thing. it's not the fact that donald trump is a convicted felon. it is the fact of why he is a convicted felon. he is literally willing to go to whatever length possible to hold onto power so continue to try to get his way. i run a campaign and we have to make sure that we are calling that out. at that time, spicy statement, but were going to do but at the end of the day, the message is very clear. the contrast in the selection is for donald trump is only in this for himself and he is doubling down and willing to do whatever it takes including break the law in order to get what he wants. >> he's going to keep giving us up to be spicy with, i expect. keep being spicy. before i let you go, i want to get your reaction to something trump told before in an interview. he was asked how he responds to black voters who call him racist and this is what he said. this is a direct quote. i have so many black friends that if i were racist, they would not be friends. they would know better than anybody and fast. i do not know what else to ask you other than your reaction to that statement and what his assessment is of his level of racism, i guess. >> that statement sounds like something a racist would say. i would laugh if the stakes of this election were not so high but they are incredibly high and unfortunately, it is nothing to laugh at. look at what donald trump has done? he has double down before entering politics. african-americans and while he was president, leaving more african-americans uninsured, unemployed. that is the only thing that donald trump thinks about when it comes to black americans. that statement sounds exactly like somebody who is racist and would say to try to prove that they are not. the proof is in the pudding and were going to continue to make sure that black america knows that donald trump cares nothing about them the same that he does not care about the rest of second donald trump term. we do it on our show a fair amount as well. part of the reason is not keeping his plans a secret. in fact, there is an entire blueprint for the transition to a trump that there is a lot of work already being done to resist what could come in a second trump turn. in a new piece published over the weekend, the new york times describes how a sprawling network of democratic officials, progressive activists and ex-republicans have been taking extraordinary steps to prepare for potential second trump presidency. patrick is the chief executive of the political arm of the center for american progress explains "what trump and his accolades are running on as an authoritarian playbook so now we have to democracy prove our actual institutions and the values that we share." some democratic governors are trying to do this through a group called the reproductive feet of freedom alliance working to protect. at least five governors in the alliance have stockpiles of the abortion medication. regarding is the possibility that any trump administration using federal power to stop it interstate distribution. the american civil civil liberties union is also preparing for legal action against the second trump ministration. anthony romero tells have already mapped out scenarios in which a new trump administration could pose a threat in the rule of law. election day and the polls neck and neck, the threat of a second trump term. as the new york times reports, say they learned their lesson from 2016. they have already started putting plans in place to resist an antidemocratic authoritarian trump agenda. joining me are the heads of two of those groups. the presidency of the center for american progress action fund and romero is the executive director of the american civil liberties union. you both are so busy. i appreciate you taking the time. i appreciate so important for you to hear about and understand. let me start with you. you talked about how we have to democracy prove our institutions. that is a great phrase and in values in preparation for a term. talk to me about what that looks like? what is it mean to democracy prove our institutions. >> jen, thank you for having a work for every single night on the air. i think that i understated the level of the threat instead of democracy proofing having some of the things we've heard donald trump in the very weak speaker of the house willing to go along with his plans, were needing to fireproof our democracy. they are a set of norms that we have taken for granted over decades. waiting to find ways to harden. right now, the biden administration has done a commendable job of lifting up rules in the administration to strengthen the civil service, for instance, because we know that there is an active threat from 2025 that is directed at federal workers because they tended to weaponized the agencies and put their to dismantle the democracy in those agencies but it also means that we need greater coordination between federal officials by senators by mayors and governors not just in blue states but in purple states as well. we know from recent practice that arrest a governor has been lifting up all kinds of litigation in egregious ways against the hetero government. if this threat comes to, were going to need governors to step forward and mayors as well to push the negation against actual constitutional threats that we are facing and the last thing i will say, jen, is that folks like anthony romero and i and so many of the other groups need to create a spine for our democracy and network. they cannot just go after this thing like a lacrimal issue after issue but lift up a broader conversation about democracy with american citizens that leads us to putting up a real scaffolding around our norms, values and the institutions themselves. >> spine for democracy. that is a good phrase, patrick. i like it. let me ask you about one of those pieces of litigation. what is clear from this article which i think all of us knows? is working on a lot. one of the reasons this article talk about how is preparing litigation that would challenge the insurrection act which is something that frankly scares people. the potential for that. if donald trump tried to send troops into american cities, talk to me about eight litigation apparatus or effort. how concerned are you about that possibility and what does that look like? that effort that the aclu is preparing at this point in time? >> thank you. i am glad to be here with patrick to talk to you about what we are doing. first of all, we have to move beyond admiring the problem. there is no time for. there is no way we need to spend much more time than identifying the threats. need to lay out a plan for what if the worst threats were to come to pass? and in litigation, litigation takes time. you i think through the theories, the venues, what types of clients, where you would file. one of the best cases to run on and part of that, what we are doing now and mapping out across all these different. how do we the legal theories and the tactics and strategies and then the relationships with other organizations and the center for american. dividing and conquering. it's going to be way too much with one organization. the last time around, you brought 434 legal actions against the trump administration. and we were up against everything we had. yet, we will not be prepared. even as much as we prepare now, we will not be ready to be the full firepower of this government. donald trump gets eight second term in office. we will have enormous powers that will be much more rigorous. going to go for the jugular. is going to be the redemption that he promises about making sure that he follows through in all of his threats so we've got to be ready. that is what our lawyers are mapping of the cases, the theories. we are publishing them the series of memos that we have on our website. >> that is such an interesting. people should go check that out and they can read about that and read project 2025. touched on one of them anarumo article makes clear that there is some lessons about the amazing works. all of them mention the times have been doing for years. some lessons learned from the trump term and did not clearly coordinate as much as possible. seems like an important thing. what else in terms of looking back at what he was capable of, what threats he posed. are you applying now and implement in your plans leading up to the potential for eight trump second term? >> what a great question. answer the question first through the back door by saying respect for some of that doom and gloom out there, i am confident that president biden can be victorious in november. that being said, we do need to do all of this work to guard against the worst-case scenario. last time around, there are so many lessons that we can learn. the first is a little bit of humility. if we are on the other side of the number and donald trump has one, it's going to be because we have failed to make an effective case about what the threat is to our democracy. right now, jen, in our poll, we are seeing that nine out of every 10 americans have no notion of project 2025 and when we pull on the individual elements, we see that they are radically unpopular. of course, demographics. the first thing we need to do is appreciate that our values, the norms that we are trying to lift up actually have maturity enthusiasm. popularity in this country. you have to speak powerfully with a common narrative to those. again, that cuts across sectors and individual issues but helps everyone locate a sense of the unsocial identity in the direction of our democracy. we also have the case after trump. there was little coordination between the activists and the legal base. we have to close the day like between and we also had instances where we underestimated the reach of federal power and trumps understanding of the extent of presidential and executive authority. he understood very very well that a set of norms that were kind of a facade that if you push just enough, you would have but unfortunately, eight supreme court that could be compliant as well. he understands that better now. he will be surrounded by a more sophisticated set of actors in a second term and they have an authoritarian playbook already to work from.. >> i hope you can come back and we can talk more about this. all the work your incredible organizations are doing. i really [ laughter ] i'm coming for my revenge gru. who's the loser now? loser loser. -loser, loser. we just talked to some leaders about how they are preparing should trump pull out a win in november. the best work against a trump white house would be a democratic senator by the democrats. the senate's unique power and confirming cabinet appointees and judicial nominees including supreme court justices would be a crucial check on trumps authoritarian impulses. if republicans hold the house, the democratic senate might be the only thing standing in the way of a national abortion ban. there are currently about 10 to watch this year. the maintaining control could be a heavy lift democrats since they already hold eight of the seats that are up for grabs. that includes pennsylvania where income it mechanic senator bob casey is facing dave mccormick, the former ceo of one of largest in the world. pennsylvania joins me now. thank you so much for being here with me tonight. >> it's good to be with you, thank you. >> thank you. you have been campaigning all across pennsylvania. you have been talking about it. one of the things you talk about a lot of the economy, great. the inflation, what people are seeing in that light. when we look at the polls, the data is very good on the economy but it does not show on the poles that people are necessarily feeling it or giving the president or even the democrats credit. what do voters say when you talk to them about the economy and how they are feeling and how they are renting? >> a good part of that is high prices. we know that even after these huge national corporations copies record tax cuts, tax cuts we had rarely seen in recent american history, they got these huge tax breaks. they used most of that new revenue they had to have stock buybacks and they jack up their prices. the price of food, household items area people not only feel it every week but i think they know what it is and it is great. i have talked a lot about the present as well. the shrinking the size of the product, not shrinking the price. >> not enough chips in the bag. >> the larger question is basic. when they can jack up prices on food and laugh all the way to the bank. we have to take action against that. when i talk about not just pointing it out for voters to focus on, but also when i talk about taking action, that is where you get people's attention. people want us to pass a so they can go after these and hold them accountable. i think they also want us to vote to roll back the big corporate tax breaks because obviously, these big companies as they are jacking up their prices. >> clearly, you know who's going to keep them. i have talked a lot about abortion rights and women's rights in that regard. the future of the supreme court, of course, is going to be impacted by who wins in the white house and he was in control of the senate and the president talk this weekend about how trump could name two supreme court justices. is that issue something that is resonating? i know abortion right is. as the supreme court and the future of the supreme court resonating the pennsylvania voters? >> i think it is. probably in at least three ways. the question of rights meaning voting rights and democracy. women's rights and workers rights. less so on the third. i think that that is the next set of battle lines. >> look. if this supreme court can overturn a 49 year right for women, they can certainly take away other rights. you just saw in the recent debate in the senate, we had two separate weeks. one was a vote on contraception. just imagine that. you think it would be an easy up or down vote. every republican senator did not vote to uphold the right to contraception in 2024. then that was filed a week later by a vote on ivf and the same held true. the republican party has gone so extreme and so far right that they not only support all these's abortion plans but they can't even uphold the right to contraception or the right on a national basis. >> it is pretty unbelievable. there was a new campaign ad or a buy that was announced by the biden campaign today. the $50 million by. part of that money will be towards another they put out to date that is really pretty for leaning and calling out trump as being a convicted felon. is that an ad? >> i have not seen it. >> that is the thrust of it. is that an ad that you think will be effective in pennsylvania if it is laid across pennsylvania? is that an issue? trumps convictions. >> i think so for sure because it is a contrast. you have one candidate who was a subject of a 34 count indictment and conviction, another candidate who is not been subjected to that. i think people know that there is a difference between them but unless you can point out differences. in my race, just on the issue that you can make reference to on the issue of abortion, i have been supporting the right. been supporting the bands. the ban on abortion in so many states. it's clear even on contraception. my opponent will not even answer the question, whether he supports the contraception bill or the ivf bill. pointing out the contrast and those distinctions are important. >> no question, senator. we got want to come on the campaign trail with you and were trying to highlight all the senate races out there and yours is certainly a pivotal one that everybody should be watching. thank you so much for joining me. >> i hope you will go to help us. >> there you go. coming up, a good reminder that sometimes you have to swim against the current. we are back after a quick break. break. search one and done.
