testifying tomorrow in new york. trump, as you know, was expected to take the stand in his own defense as his company's civil tax fraud trial enters the final week. a short timeo, trump announceinhe long and defiant rant online that he would not be doing so. the former president, as usual, attacking the case, as he quote, rich -- witch hunt. -- no matter how much donald trump tries to distract from reality, the facts don't lie. trump had been using the courthouse in new york as a sort of campaign stop, and is already planning rallies in nevada and new hampshire this week. this, as trump's vision for his second term only becomes more extreme. at a fund-raiser last night, trump doubled down on his comments, saying he would be a dictator, but just on day one. his words? they speak for themselves. >> baker today in the new york times, he said that i want to be a dictator. i didn't say that. i said i want to be a dictator for one day. but the new york times said -- and you know i i wanted to be a dictator? because i want to wall, right? i want to wall, and i want to drill, drill, jill. >> to be clear, drilling, building walls, those are not the only promises he's made ahead of a second term. you think republicans will stand in the way of trump's fantasy regime? think again. former house speaker kevin mccarthy claiming today, trump just needs a gentle scolding. >> what president trump needs to do in this campaign, and needs to be about rebuilding. restoring. renewing america. it can't be about revenge. >> he's talking about retribution day in, day out. >> he needs to stop that. he needs to stop that. >> you think he's going to listen to you saying, stop that, stop that? when he hasn't listened to anybody before? >> that's not true. he will adapt when he gets all the facts. >> joining us now to discuss, msnbc political analyst -- the host of crooked medias what a day podcast. also with me, msnbc come political contributor eugene daniels, he's a political white house reporter, the coauthor of the playbook newsletter. an msnbc legal analyst and former u.s. attorney barb mcquade. she's a professor at the university of michigan law school, and co-host of the hashtag sisters in law podcast. barb, i have to give credit where credit is due. friday, i was onset -- with lisa rubin, and she said, if trump shows up on monday, right, she anticipated there was a definite possibility that he would back out. i wonder what you think motivated that decision? >> we've seen this again and again, alicia, or donald trump says he's gonna do something, and in the end, my lawyers told me not to do it. it's quite likely to me that he never intended to testify in his own defense whatsoever. putting donald trump on the stand is very, very dangerous for any lawyer. because he has such a loose relationship with the truth. and, so in the same way he wanted to talk to robert mueller, the special counsel, he said he had a speech where he was gonna show -- completely exonerated from january 6th, and once again, i think this shows that it's all talk, and when push comes to shove, under a, he is not gonna be there to testify. >> so given that he's not gonna be the big wetness tomorrow, i wonder what, vibe, we should expect from the trial this week? >> it could be that they're going to best. he was gonna be one of the last, if not the last witness. this could be the end of the defense case. the government will have an opportunity to put on a rebuttal case if they so choose. we could see that. and once that's done, closing arguments. so i think it's quite possible we could see things ramp up this week. >> so you have these two stories developing side by side. we're learning that donald trump is not going to take the stand in his own defense, just as you also heard that sound of him on stage, but wind ty, talking about, yes, he wants to be a dictator on day one so that he can issue executive actions around things like drilling and building walls. we also know based on things he himself has said about using the government as a wing of retribution against his perceived political enemies. that is not, in fact, the only authoritarian or dictatorial thing he is interested in doing. we do not play sound from donald trump deliberately on the show, but i think it's important for people to know what it is that he is out there saying, and how he is wrapping up his base. i'm gonna assume you take him at as word when he says he wants to be a dictator. >> not only taken matters where. i take him at his actions. alicia, we all witnessed january 6th. we all witnessed an attempted insurrection led by the former president. there is no need to minimize this to taking him at his word, because he's already acted on it. he knows how to deploy his supporters to do his bidding for him. that's critically here, and i hope democrats are taking all of this and making sure that they're emphasizing the threat that donald trump has to our country, to our democracy, to our institutions, and using that is a key message to motivate and engage voters starting now. right? don't wait. democrats need to jump on this immediately, and continuously beat this drum through 2024. because this is the type of convincing argument that can get voters across partisan lines on democrats side, going into the presidential election cycle. >> eugene, help me understand kevin mccarthy. the fact that he had already announced that he was not gonna come back, he's not running again, giving up his seat -- it's like, you're free. go be free. you can actually say what it is you want to say because we're no longer trying -- it would have seemed -- to keep your political, temporary political lifeline alive. we know that he is willing, should he be called upon, to be a member in a case of a second trump term, a member of that cabinet, this idea, oh no, trump just needs a scolding -- he will listen to rational people. we have no proof points to that argument. >> yeah. the former speaker mentioned that once the former president -- he would change the way he was speaking, and would stop talking about, and only focusing on retribution. there is that relief zero evidence that that would ever work. that that would ever happen. people have said that and failed before, there at the beginning of the trump presidency, the middle of the trump presidency, the end of the trump presidency. right now, as he's running for president, that is happened over and over again. kevin mccarthy is clearly trying to keep his -- there's a possibility that he would be called upon to be in that cabinet, right? it's something he has talked about being open to. he's clearly still worried about what donald trump would say about him, and more importantly, what donald trump supporters would do if they saw kevin mccarthy out, if donald trump or to attack him. that's an actual concern a lot of folks ham, and that's why they operate in this way. but it doesn't show a lot of political strength, it doesn't show a lot of political courage when we just watched the former president not just say it, but -- he only wants to be dictator for one day. just to do the things that he wants to do. and more importantly, as mike was just saying, we've seen over and over again how he has operated, and there's no reason to believe he wants to do that. -- really important thing that folks should remember about donald trump, when he says shocking things, he always does it, always does it with a wink and a not. he says it so his followers were laugh. he says it in a way that maybe there's some deniability, no matter how slight the miami ability might be. -- and then we, his followers, are gonna make fun of us, saying we're taking him too seriously, we're taking him to literally. and that's gonna last -- but we should believe him when he says the things that he wants to do. because it's in line with the reporting that's already out there. >> we should take it very seriously. barb, of course, the real you news tonight is the news about the civil fraud trial out of new york, but last night, you had special counsel jack smith accusing trump of trying to obstruct the election interference case. tell us more about that fight. >> last week, we saw donald trump's lawyers file discovery requests that go well beyond the scope of what is permissible under the law. asking for things that are classified, asking about election interference activities going back to 2016. in this filing last night, the special counsel calls out donald trump for what this is. it's what's referred to in the intelligence community and effort at cremo. it's like blackmail, but it's somebody who wants to expose classified secrets in the hopes that with that threat, the prosecution will pull its punches, or even dismiss a case altogether to protect those secrets. but the special counsel came back very strong, pointing out that this is a fishing expedition designed to attack the prosecution. they're not proper arguments. and one hopes that the judge will see this for what it is and denied these requests. >> when you take the entire context, you take the multiple legal cases that we're talking about. you take trump in his own words. you have congressman raskin pointing out that the warnings we're hearing now about trump's are once we've heard before. take a listen. >> every four years, the democrats come back and say this is the most important election of our lifetimes. forget that. this one really is the most important election of our lifetimes. this is our year of living dangerously, and our year of living passionately in defense of constitutional democracy. >> juanita, you made a similar argument in your first answer. you also understand the fatigue that comes with making that argument each election cycle. how, then, do you breakthrough? >> i mean, donald trump continuously gives new material for democrats. he had the speech over the weekend. you have upcoming campaign events where he's absolutely gonna say the same things over and over again. leveraging that every single time it happens is critical, and i appreciate congressman raskin essentially taking heed to what i just mentioned as far strategy, in the political conversation around this. because making sure that people understand what's at stake every single election is critical. and there's no exaggeration when i say that trump is an existential threat not only to our nation, but again, our democracy. that is going to be front and center of this election, just like it wast 22, just like it wasn't 23. i think that's already showing. that democrats have established track record for alleging -- voters will tap into it before they head to the polls and deliver results. >> a year of living dangerously. i mentioned that. barbara mcquade, thank you so much, eugene daniels, you are sticking with me. now, the breaking news from tennessee. the government has declared a state of emergency after deadly tornado outbreak. authorities say six people died in the storms on saturday, including a toddler. areas north of nashville suffered the heaviest damage. the string of tornadoes destroyed dozens of homes. joining me now is nbc's priscilla thompson, live on the ground in match. priscilla, what's the latest there? >> alicia, where in madison, just ahead of nashville, and these are the scenes we're seeing here. this is one of the hardest hit areas. you see that home back there, the roof taken off, part of it, the walls gone, you can literally see into what was once a bedroom, perhaps, and this is some of the damage that we are seeing up and down this street. nashville officials say that there are 22 structures that were destroyed, and there are countless others that are very badly damage. you mentioned six people that tragically lost their lives -- just a few hundred feet -- one mobile home was flown on top of the other by this tornado. you mentioned that toddler, i actually spoke with the father of that two year old toddler who lost his son and his wife in one of those mobile homes. he told me that it all happened so quickly, that all he heard was a lot of screaming, and when he opened the door, he didn't hear his wife's screams. and he was worried that she may be gone. i want to play a little bit of that conversation. >> when did you realize what had happened? >> [speaking in a global language] [speaking in a global language] >> translator: we are a family, before in the moment, i know i lost her. she didn't scream anymore. i listen to screaming, my only two other sons. >> when i met felipe, he was digging through that rubble, what remained of his destroyed home. looking for his life savings so he could try to send the remains of his son and his wife back to guatemala where they are from. he told me that his wife had only been here a few months. and all of this happened, thankfully, the fire departments able to go over there with machinery and take that trailer that fell on top of there's off, he was able to find that. this is the kind of devastation and tragedy that folks across the state, in certain parts of tennessee, are dealing with in the aftermath of these devastating and deadly tornadoes. alicia? >> absolutely devastating, priscilla, authorities what are authorities telling you about the recovery efforts? >> yeah, that is going to take a while, which is what we often hear in these situations. we know that power, restoring power is a really big concern. they're downed power lines everywhere right now they're just over 30,000 people across the state of tennessee who are without power. that, of course, is going to be a really big priority, just today, we've seen a lot of folks coming out to hand out food, the salvation army has been here. there's also for shelters that have been open to help folks whose homes now look like this to be able to have a place to stay be able to get a warm meal. the other big question here, it's going to be whether or not this disaster will qualify for fema aid. it's not clear at this point whether or not there is or is not enough damage to qualify for that aid. as people are continuing to clean up the next question is going to be how will they rebuild? and that path forward isn't exactly clear at this point. alicia? >> priscilla thompson, as always, thank you so much for your reporting. next, congress has just one working week left in 2023, now you might think capitol hill is ready for a flurry of legislative activity, that's not what house republicans have planned. plus, california congresswoman, sydney -- sits on the foreign relations committee. talk to us about the negotiations for aid to ukraine in israel. first we go to jessica layton who's on standby with a look at the other big stories we're watching this hour at msnbc. jessica? >> no, i don't see any evidence of that it all. i think before you begin an impeachment inquiry, you ought to have some evidence, some inclination that there's been wrongdoing. so far there's nothing of that nature that's been provided. >> are you opposed to the impeachment inquiry? if i'm in the house, i vote against it. unless they're able to bring forward evidence that suggests that there were a high crime or misdemeanor that was committed. so, far that has not been the case. >> eugene and we need to or back with us. eugene, talk us through this, what should we expect with this impeachment inquiry vote this week? >> yeah, i mean, probably expected to go through. unless you have a bunch of moderate republicans who decided not to be on board with this, and that's a possibility, because a lot of them that are on the front lines that are on these biden districts, the district of the president won, in 2020, they're always very concerned about their seats. they are against this, and have been. they begged kevin mccarthy not to do it. i assume they're probably talking to the new speaker and asking the same thing, them not wanting to go forward with this. especially after hearing after hearing, since republicans have taken over the house, we haven't seen any evidence. the senator romney said was true, we haven't seen any actual evidence that president biden himself did anything wrong. even when you ask them what you're impeaching him for? they don't have an answer. there isn't an answer, he did this. when you look at what happened with bill clinton, when you look at what happened with donald trump twice, you have clear, you can do an elevator pitch of why those men were impeached. they don't have that right now with president biden. that doesn't seem to matter whatsoever. >> juanita, eugene just said it, i want to let you take a listen to how speaker mike johnson framed this upcoming vote, it was on fox news this morning. take a listen. >> i would say with a rule of law, team we have to be very deliberate and careful about that i've said several times and it's true, next to the declaration of war, i think impeachment is probably the heaviest power that congress has, how specifically under the constitution. we have to be very methodical and careful and follow the facts for the lead. the impeachment inquiry is the next necessary step, because the white house is now stonewalling -- >> really amazing, when it, it that he still claims to be on the quote rule of law team despite everything we've learned about his role of trying to overturn biden's election victory. step back, look at all in context, the fact they have a laundry list of things they need to be focusing on accomplishing to say nothing when you talk a little bit about the aid packages. housing, -- >> imagine. imagine the things that we actually talk to voters that there, like this is the thing where i am getting squeezed, what can the government do? instead of focusing on policy solutions to those things republicans are interested in instead an impeachment inquiry that currently has no facts to support. i wonder what it tells you about republicans this moment. but also listening to that sound from speaker johnson, what it tells you about him and his leadership. >> well, republicans never had any intention of governing. alicia, point blank. that's yet again evidenced by their decision to focus on lobbying these attacks at president biden, with no evidence, but still trying to force it through. because that's the red meat that they assumed trump's base wants to see. that's the red meat that they're trying to appeal to gop primary voters, so they don't face primaries in 2024. that's their objective here. survival, not governing, not delivering anything for the people. as you mentioned, things like housing, cutting costs preserving our basic rights, these are priorities for the voters. if any voter was confused about where republican stand out any of this, here is your evidence. how they in 2023 is how they're going to run all through 2024. it is going to be an absolute useless mess for this country. they're not addressing anything of substance that the voters or the world needs. in terms of mike johnson, that was word salad. that wasn't an answer he didn't say. anything that is yet going to be exactly mirrored of what we see from a publicans, they don't have any evidence. they don't have any substance. if he tries to juxtapose what happens when they're trying to do with president biden to what happened to former president trump, he's gonna lose that. that's a split screen that republicans absolutely should not want going into 2024. that's what they're gonna get. i, believe in ad after, at every time they come for president biden, the democrats and advocates are gonna show exactly what went down with president trump. >> eugene, to boil from what we need to, said what impresses me most is when they execute word salad, but they deliver it as though it is surf and turf. they really act as though there is something in what they're offering you, this is a whole lot of nothing. we talked in the first block about kevin mccarthy, eugene, it is not just kevin mccarthy who plans to retire at the end of his term. there is actually what i think you could describe as an exodus on the part of republican lawmakers. i wonder, what that is going to mean for the composition of congress? >> yeah, first of all, what it tells you a lot about congress about how members of congress are just over. it republicans realize, and have told us as reporters overt over, again they're not getting anything done. that's not what they came to congress. it's more about personalities in the tension than legislating. this college led by republicans do messaging. bills they can do messaging bills that wouldn't pass the, senate that would get no democratic votes in the house. but that tells the american people what they want to do. they're not even doing that. that is something they could do without any kind of democratic support. just letting the american people know what they're going to do. i will say, when you talk to some of these republicans that are retiring, some of them are retiring in districts that are a little shaky going for four republicans. so, that tells you that democrats have a better chance of winning the house in 2024, and even better chance because of all the chaos that's been brought by republicans. if they aren't able to do the simple tasks of keeping the government open, getting money to ukraine, israel figuring out what to do about immigration reform, then that is going to hurt them in 2024. >> juanita, just to focus on this shakiness that eugene referenced inside the republican party, yes, a lot of it has to do with the chaos within their party. there are also a number of core issues, including reproductive rights that haverely changed the terrain under which we're going into 2024. this is new nbc news reporting it reads,ote, in key 2024 battleground states, but events dates, some gop senate hopefuls have suddenly begun to place more emphasis on situations in which abortion should be legal. well others have made clear, they oppose a federal ban on the procedure. it's a real mixed bag, right, when eta? you watch what's happening out of texas with kate koch's appealing to the state to be able to have this emergency abortion. you have a.g. paxton coming in, trying to both chill her in doctors who would otherwise provide that service. but then you have something like this, where it does seem that republicans are beginning to get the message that is not politically viable for them to continue to limit women's reproductive rights and expect that there will not be a backlash at the polls. >> see, i'm not convinced, alicia, that some of them are getting the message. sure, you might have one or two in those battleground states, like purple states where they're trying to be competitive. but when you see the full on republican push still to force pregnant people to carry nonviable pregnancies to still control access to basic health care, that republicans writ large are not getting the message. i think the other bit of that mitt romney meet the press interview with him offering a non answer when it came to abortions, talking about both sides you get, something the reality is, there is no both sides to an issue that is related to bodily autonomy and accessing basic health care. i think this is going to access to abortion is going to be an issue that republicans continuously lose on. because the party writ large, with donald trump at the head of it, is still seeking to limit access, still seeking to ban access to abortion across the country. so, this is where i think it's gonna be a losing issue, again for republicans in 2024. because we know what voters have the options to weigh in on this on this issue, they cross partisan lines that cross demographic lines. and they overwhelmingly support access to abortion in that is why it will still be a sticking point for republicans in 2020, for even a few sitting candidates see the light. >> i also thought it was a telltale loss in the republican day, no one want to talk about. it >> didn't come. up >> juanita tolliver, eugene daniels, between the christmas tree in the turtleneck, which i know is a year-round thing. i really feel like i am catching both of you in your season, thank you both. spending some time with us. i love it. all right, tomorrow, former congresswoman liz cheney, she is gonna join jen psaki to discuss the state of the gop and the threat former president trump poses to democracy. you can watch inside with jen psaki, that is tomorrow, monday, eight pm eastern, right here on msnbc. next, republicans are putting the border over our allies in the time of greatest need, but could biden find a way, foreign affairs committee member congresswoman sydney -- joins us. and later, richard lui tells amanda went from refugee to a restaurant legend. d. the u.s. this week, as congress and the white house are at odds over ing the war torn country. president biden invited the ukrainian president to meet him at the white house on tuesday. the two leaders are set to discuss ukraine's urgent needs in the importance of america's continued support. zelenskyy is also set to have a bipartisan meeting with all senatorsnd meet with speaker johnson. but here's the problem. congress seems to be at stalemate over sending much-needeaid to this country. with just a few days left before t the hill wraps up for the year, -- would passed a funding for both ukraine and israel. republicans refused to sign off on it because it does not include their proposals to enhance border security and stem migration. earlier today, democratic senator chris van hollen criticize republicans for tying aid to immigration. echoing the sentiments of many of his democratic colleagues. >> we do need to have good faith negotiations to address the immigration issues, the border security issues, in those conversations are ongoing. , the fact that republicans have made resolving that very tough negotiation a condition for providing military assistance to ukraine, shows how donald trump is essentially taken over the republican party. because they've essentially said that they are not going to be helping the people of ukraine secure their freedom and fight off putin. unless we resolve this other issue. and the reality is, well we should address those issues, we should not be tying that together. joining me now, california democratic congresswoman, sydney -- sydney kamlager-dove, thank you so much for being with us. you serve on the house foreign affairs committee, set the stage for us. this aid to ukraine, why is it so crucial? >> i'm very interested in what the senate is able to accomplish next week. biden, blinken briefed congress last week. in the situation is dire in the ukraine. let's not forget that russia attacked a sovereign country. russia is killing innocent women in children in ukraine, creating an incredible humanitarian crisis. and our national security is also dependent upon our ability and willingness to go and continue support our allies. this republican congress is saying to our allies overseas, the united states does not care about them and that it does not care about democracy. i think we have an obligation to push the supplemental packages through, to at least continue the conversation, and to remind the american people that, unfortunately, republicans have other interests, other than our national security that of the political theater that we are watching unfold with very serious consequences and very high stakes as you outlined for us. there's also this additional layer which is that you have republicans pushing changes, not just to today's immigration policy, but changes to immigration policy into asylum policy that would change the very fabric of this nation. would change how we think about ourselves as a place where others can seek refuge. they understand what they are doing here they believe that the border for them is a winning political issue. and they are willing to tie two things that have nothing to do together in the name of politics. one common thread i see, and i wonder if you agree, between refusing to offer aid to ukraine and the changes they want to make two asylum and immigration in this country. it is back to this america first ideology. back to this idea of not seeing the united states in a global context first. just how dangerous is that stance. >> incredibly dangerous trump an isolationist. and he is only interested in himself. he has somehow fooled this republican party and some of the american people into believing that you're looking at happening in israel, if you look at what's happening across the continent of africa, what was happening in taiwan and ukraine it places itself america. you will see that our security is dependent upon what else is happening in many of these hotspots around the globe. it is important to say that we have not been shouldering the burden of supporting ukraine on our own. our european allies have doubled down ever since putin invaded ukraine. absolutely, the border issue is important. but we should not conflate our own domestic policy around border security with national and foreign policy as it relates to supporting in protecting democracies around the world. of course, trump doesn't care about that, because he's interested in becoming a dictator if he were to win reelection. >> remember, just on day one, congresswoman as he himself would say, which is not bear out either in terms of what we have heard from him vis-à-vis using the government to go after his perceived political enemies, nor from his actions. only get about 30 seconds left, given that we're talking about national security, it would seem the greatest threat is coming from within. >> well, trump defeated the republican party far
