vegas with at least three dead on the unlv campus. a long list of questions for investigators and new details on the deceased shooter. this hour, donald trump returns to the courtroom in downtown manhattan, one day after his primary opponents unload on each other in a fiery debate. >> nikki haley, she caves any time the left comes after her. >> the only person more fascist than the biden regime is nikki haley. >> i love all the attention, fellas. thank you. >> i have these three guys who are seemingly competing with he who shall not be named. this is the fourth debate you would be voted in the first 20 minutes as the most obnoxious blowhard in america. so shut up for a little while. dysfunction on capitol hill. republicans and democrats are stalemated on funding for israel, ukraine, and the border. i will speak to two key lawmakers, mark warner and ken buck. ♪♪ good day, everyone. i'm andrea mitchell in new york. las vegas mourns the lives of three people killed in the mass shooting on the unlv campus yesterday, six years after las vegas suffered america's deadliest mass shooting, just three miles away. in wednesday's shooting alone, gunman opened fire on the fourth floor of the business school building before being shot and killed by university police. two senior law enforcement officials tell nbc news the suspect, a man in his 60s, applied for a unlv teaching job in 2020 but was not hired. the nation watched a now familiar sight, terrified students and faculty as they walked out with their hands up. parents, teachers and students speaking of the horror they witnessed. >> we heard the clips of semiautomatic weapons. it was a very, very disturbing thing to hear. >> i honestly didn't think i was going to make it out of there alive. >> we can't even send our kids to school without worrying if something like this is going to happen. >> the latest attempt to pass a new assault weapons ban was blocked by senate republicans last night. nearly at the same time as the shooting in las vegas was unfolding. so far this year, according to the gun violence archive, there have been more than 630 mass shootings in america. joining me now, dana griffin in las vegas. what are you hearing from the community there? what new information, if any, are we learning about the suspect? >> reporter: obviously, a community still shaken. this is the same city that had america's most deadliest shooting just years ago. here we are again. right now, campus is quiet. we are looking at a breezeway that leads to beam hall, home of the business school, where the shooting occurred on the fourth floor. we are seeing some law enforcement activity back there. you can see the tables and chairs that were set up just outside the building where students were planning to gather to build legos. officials saying that luckily, two university police officers intercepted the subject. he was shot and killed during a shootout. this shooting could have been worse had he been able to possibly get access to those students. he has been identified, the suspected gunman, identified as 67-year-old anthony polito. we are told he was retired possibly university professor that worked at a school in north carolina. he was rejected from a job here at unlv years ago. officers obviously looking into whether that may be part of the motive here. not learning much doe ta detail the victims. three were killed, one in the hospital. we hope the police will identify whether these were students, faculty, staff. the campus is closed through sunday. it is a quiet campus right now. a very shaken community. some hotels in the area have allowed students to come stay there in case they are too traumatized to stay in their dorm rooms here on campus. >> dana griffin, thank you so much. former president donald trump is back inside a manhattan courtroom for the $250 million civil fraud trial against him. his adult sons and the trump organization. days before he is expected to be the final witness testifying in his own defense. arriving this morning, his first appearance since an appeals court reinstated a gag order barring him from attacking the court staff. he was defiant. >> there's not a judge in the country that would have taken this case. this is a witch hunt. it's a corrupt trial. >> joining me now is yasmin vasuvian. >> reporter: theories abound. we are getting a more acute sense of why he is here today. that's the witness that's testifying, who will testify over the next two days or so. friday is only a half day. day and a half to be exact. a defense witness. he is an nyu accounting professor. they talked a lot about his credentials, his cv, to establish him as a credible witness. him and the judge share some nyu credentials as well. nonetheless, he has served as an expert witness many times for the new york attorney general, specifically, as well, in a case against exxon. i will say this. lisa ruben said from inside the courtroom that this is easily, she wrote, the most credible person to cast doubt on the new york ag's case so far. he got to the meat of his testimony that we will hear over the next two days. two points he is making, which is that the ag complaint has no merit, one, because they did not specify which provisions trump's financial statements violate, and two, that the bank would have lent -- would not have lent any money without their own assessments. i think the main reason that the former president is here today is because he wants the press, the media, to focus on what they see as their secret weapon, this man's testimony. the other, which is something we have been talking about all day, is the republican debate last night. he was not on the stage, by choice. certainly, using this trial along with many others that we will watch over the next year or so as a way in which he can campaign to get re-elected as the next president of the united states. >> thank you. paul charlton, trump has been on the stand before. he was a witness for the prosecution. he was really combative. he was pointing, yelling at the judge. he attacked the judge's law clerk. of course, that precipitated the gag order. what do we expect monday? it will be different, won't it? he is a defense witness. when he first presents his arguments or the arguments's begins testifying, it will be for his own defense. >> that's right, andrea. i think what we can expect when former president trump testifies on monday is that his lawyers are going to tee up big softballs. former president trump is going to essentially make a campaign speech, which by the way, as you recall, was a complaint the judge made during the cross examination that he was under by the new york attorney general's office. his lawyers are going to ask him wide-open questions, what kind of a businessman are you, what kind of representations were you making? former president trump is going to try to present himself as an honest and good businessman. it's going to be as much for the audience outside of the courtroom as it is for everyone inside the courtroom. in all of that, even after listening to the expert testimony, and the expert on the stand today, it's important to remember that this judge has already decided, has already found that trump and the trump organization have committed fraud. we are past that part of the decision making process. these experts seem to be an attempt to diminish the penalty that the judge is going to have to seek or impose, or so that former president trump can use this as he talks about the trial outside of the courtroom. >> paul, in a separate case, a grand jury in nevada indicted six so-called fake 2020 electors. nevada is the third to seek these same charges. others are pursuing more indictments. how does this play into the fulton county, georgia, case and jack smith's january 6 federal case? >> there's a fascinating nexus here. that is that ken chesebro, the lawyer who pled guilty in the georgia case, has been listed as a witness in the nevada state attorney general's case. that means it's more than a tell, it's a public statement that the attorney general intends to use mr. chesebro and the information he has about assembling the false electors throughout various states in an attempt to defraud the united states, to defraud the united states public. also interesting is that "the washington post" is reporting that on monday, mr. chesebro is going to be in arizona speaking with the arizona attorney general about a very similar investigation. these investigations are ongoing. they are ongoing in multiple states. there are prosecutions moving forward. the benefit, the policy reason behind these is that the deterrent affect the prosecutions bring. the hope those in the future who would think to execute on these same kind of anti-democratic policies will think twice and not go forward with what we have seen happen in the 2020 election. >> paul charlton, it's very, very interesting. thank you for making that connection. coming up, the fireworks. donald trump's primary rivals taking shots at each other in the final debate of 2023. highlights when "andrea mitchell reports" is back in 60 seconds. you are watching msnbc. seconds you are watching msnbc at the republican presidential debate last night, major clashes among the four remaining candidates, all of whom are trailing far behind donald trump. former u.n. ambassador nikki haley taking most of the hits, since she's become the most viable second place finishering behind trump. chris christie going after ron desantis for suggesting that joe biden is too old for the presidency, but not questioning donald trump's fitness for office. >> is he fit? >> you have your thing. >> no, is he fit? i don't have my thing. he is the thing. >> we do not want to -- >> you are talking about him being 80. is he fit? >> governor desantis -- >> if you could make that out. as he has in all of the debates, vivek ramaswamy had the hard time getting attention. so he is the chief aggressor. >> the only person more fascism than the biden regime is nikki haley. >> i love all the attention, fellas. thank you for that. >> ramaswamy went after nikki haley again just moments later. chris christie jumped to her defense. >> while we disagree about some issues and we disagree about who should be president of the united states, what we don't disagree on, this is a smart, accomplished woman, you should stop insulting. >> joining me now, shaquille brewster in tuscaloosa and former senior advisor to the biden 2020 campaign, alencia johnson and susan del percio. how does nikki haley think she did? how do the analysts think she did yesterday? >> reporter: that ad is returning some of the fire against ron desantis last night, mocking him throughout that ad. you listen to haley and her campaign, they feel good about at least how she performed last night. they acknowledge, she was on the defensive most of the night. but if you listen to what haley is saying, she's saying it's because she's surging in the polls, she's rising in the polls and other candidates feel threatened. that's relative when you look at the same polls and see donald trump's dominance in them. you saw nikki haley having to battle on multiple fronts. you saw her defend her foreign policy record, defend some comments she made about the app tiktok. you heard her go after or be attacks on some of her connections, her corporate connections, including donor endorsements that came in the lead-up to the debate. she explained it a little bit. listen to a little bit. >> in terms of the donors that are supporting me, they are jealous. they wish they were supporting them. i'm not going to sit there and deny it. >> reporter: in the spin room last night, team desantis was very happy with their candidate. one of the senior aides was walking around with a sign that. they are hoping -- chris christie was very proud of his performance last night as he walked into the spin room. he made a beeline to our camera. he looked in my eyes and said, i told you. he told me earlier before the debate he was planning to prosecute the case against the other candidates. he believes he was able to do that. >> i guess that's why they call it the spin room. susan, what do you think of chris christie's defense of nikki haley? it was quite a moment. >> it was a moment. it's funny because nikki haley has done so well as a result of her debate performances. in this particular case, i think it helped her a great deal it was chris christie who stepped up to her defense and created a situation where she could just say, you know, this is fine. let vivek and chris christie go at it. she capitalized on ramaswamy's attacks. she showed she can swat him down. her performance is her retorts against ramaswamy. she delivered. i think ron desantis, again, i can't understand the justification for his candidacy going forward. he can say he had a great night. it may be the only thing his own internal campaign team agrees on. >> let's talk about the subject that they didn't want to talk about, republicans not wanting to talk about abortion. it didn't come up once. a major issue for voters. today a texas court, a district federal judge in texas granted a pregnant woman whose fetus has a fatal condition permission to have the abortion she needs, despite the state's ban. texas is likely to appeal. this elevates that issue. this is a major case that has gotten a lot of national attention. >> absolutely. joining us from the white house is the budget director. thank you for being with us. >> thanks for having me. >> some democrats, as you know, are pressing for the president to get more involved. call them to the white house, hold them in session, not let them go home for christmas. you know the drill. what more can be done to unstick this? >> i have done a lot of these. there's a worrisome trend happening. we saw it with the debt ceiling. we are seeing it now. even with the israel bill the house put forward, the condition funding on unrelated irs cuts, they know the stakes here. republicans absolutely know that there are lives at stake. they support ukraine. yet, i believe the president called it stunning that they are willing to put our national security interests at risk, our allies at risk, in order to ask for all of what they want without compromising with democrats, who also have to vote for this piece of legislation. >> in a letter to congress this week, you wrote, we are out of money to support ukraine in this fight. is all the money depleted? is that the bottom line here? >> that's the bottom line. i believe my letter makes clear by the end of the year, money is out. the options are, we harm our own readiness, our own national security, or congress can step up. the majority of members in congress support ukraine, support our department of defense. so we need to get to it. >> when you say harm our own national security, you mean either give them some of the stockpiles we need for ourselves and also harm our national security because it's helping vladimir putin, it's hurting ukraine's fight against russia? >> that's right. there are three things. one, remember, most of the money, over 60% that has been provided that we say is for ukraine actually stays in our own borders. we make all of the goods that we send over to the ukrainians. we replace with better equipment that supports american jobs. we know that when putin, if he is allowed to march through ukraine, he is right on nato's door. it could endanger our own sons and daughters' ability to stay out of conflict. this is about our own national security. >> i want to ask you about the border. it's being shorthanded is joe biden doesn't want to spend money on the border. wants to spend money on ukraine, israel, things overseas. he had $14 billion for border security in that supplemental, as i recall. >> you know, yeah. >> the issue is over asylum policy. this is policy that has been debated for decades by both parties, not under a christmas deadline. they have never been able to come up with agreements. >> last i checked, republicans hated being jammed at christmas. they are using that playbook as we speak and ignoring the fact that, you are right, the president has not just asked for $14 billion this time. he asked for border security money with our national security needs in september. you know what congress said? no, thank you. he asked for money last december. got half of what he requested. let me be clear. if you are serious about border security, you would not have voted against critical equipment that could catch fentanyl coming across our borders. that's what republicans did. >> one more question. will the president call them to the white house? will he go to the hill? where is the urgency here? >> you heard the president's own voice. you know it's the most urgent thing we can do is have the american people hear from the president himself. he has done several addresses to the nation, including yesterday's speech laying out the stakes here. you saw my letter to congress. you saw our national security advisor jake sullivan speak to this last night. what a gift this is to putin to watch what is happening here. i really hope we can move beyond the politics of the day, be honest that the president has asked for real border security, and let's get on with it. >> will he keep them in town? being held hostage. the israeli military says it has been able to kill hamas field commanders and have circled the home of a top leader, who is thought to be hiding underground. this as a u.s. official tells nbc news, israel is exploring flooding hamas' vast web of underground tunnels with seawater. some hostages are believed to be held in the tunnels. joining us now is richard engel from jerusalem. you spoke with one of the hostages today. what did she tell you? >> reporter: we did speak to one of the hostages who was freed, an elderly woman. she was from a kibbutz that was very badly damaged, very destroyed when this hamas massacre happened two months ago today. it's a tiny community. we are talking about 400 people. 25% of the people there were either killed or taken hostage. this woman was one of them, as was her son. she was freed during the cease-fire that happened last week. she went down to the kibbutz to collect some of her things, to collect some things for hanukkah, some books, and to feed her cats and to just see what was going on there. some of the hostages are doing that. they are going back to the places where they lived and collecting personal belongings. what they are finding is devastation. when we went from house to house, not just with her but with other kibbutz leaders, we saw in some cases there was still blood on the floor from where hamas was carrying out the killing spree. a lot of the houses were burned, because when we talk about this attack, and now it's two months have passed, it's easy to think of something that happened quickly. hamas broke through the fence, they went on the killing and kidnapping spree and left. it unfolded over the course of eight hours. you had people in the homes eight hours before there was any significant security response from the israeli military. for eight hours, the kibbutz itself, some of the local security were trying to defend against hamas, many of them were killed, most were killed. people were hiding in their homes, holding the doors shut, homes have safe rooms, now charred safe rooms. we saw some of the metal doors in the safe rooms had been shot through. we heard stories of people trying to hold the handles to keep the safe rooms closed. tug-of-war between the residents and hamas militants outside. when hamas couldn't get inside these safe rooms, they set the houses on fire to smoke people out. it seemed like every other house was either completely burned down or partially burned. we saw her there also with her daughter, who didn't want to speak on camera. they were there going through the house, going through the house that was damaged. her message, the hostage who we spoke to, was that they want the war to be over. she just was calling for peace. they are nervous about what they say, because most of the hostages still have relatives inside. they are calling for a resumption of negotiations with hamas. not that they want hamas to stay in power. they loath hamas. but they want to go back to talks that were producing results. we heard a tremendous amount of anger against the current israeli government of prime minister netanyahu. how could it possibly have taken eight hours for israeli security forces to come to their rescue? many people felt betrayed, angry, furious at hamas and very disappointed and betrayed by their own government. >> earlier today, when you were at the kibbutz, you showed the mailboxes in the town hall. let's get that picture up. i want you to explain the significance of what you were looking at and the impact. >> reporter: i found it to be a powerful image. i think people at home will have a similar reaction. it's so visual and it's easy to understand. a lot of people think of the middle east as complex and esoteric. we are talking about a community, 400 people. in the town hall, which was attacked by hamas, they had plenty of time to go from building to building, there's the small community post office. the center is a wall of post boxes. the members of the kibbutz have marked those post boxes with stickers. black for people who were kidnapped. blue for those who were kidnapped and released like the hostages we spoke to today. red stickers for all the people who were killed. >> it gives you a sense of the scale of the impact of that assault on that one kibbutz. richard engel, thank you. it's the the capitol hill building while the chamber was in session. joining me now is ryan nobles. bowman admitted to pulling that alarm. he said it was a mistake. they never really investigated that. or did they investigate him and clear him of doing it deliberately? >> reporter: he did plead guilty to a misdemeanor charge in washington, d.c. he paid a fine as a result of it. the house ethics committee said they weren't interested in launching a formal investigation into what took place. they didn't think it was worth their time. that didn't stop republicans from pushing forward with this impeachment vote. as you rightly point out, it did end up being somewhat bipartisan. three democrats voted along with the rest of the republicans to censure him. what we see play out here is a trend. this is the third democrat that republicans have censured during this congress. they usually were reserved for really harsh statements by congress against a member that they felt had done something very wrong. republicans have been more liberal with their use of the censure. they censured adam schiff. it's a slap on the wrist. it doesn't impact his role in congress at all. it does give us an indication of just how tense things are here on capitol hill. >> indeed. this is not the time to be in the house. > house republicans are preparing forotes next week to formally ahorize the impeachment inquiry into president biden. thete house just released a statement calling it a baseless stunt, not rooted in facts or reality, but in extreme house republicans' shameless desire to use their power to smear president biden. tell us what you really think. joining us now is ken buck of the judiciary committee. congressman, you are an anomaly. you are skeptical about pursuing impeachment. your committee would be involved. is your party moving in the wrong direction? >> i think the party is moving in the right direction in the sense we are conducting oversight. i think oversight is an important function that the ways and means, the oversight and judiciary committees are all involved in right now. the thing that really upset me was when the white house said, we will not turn over documents pursuant to a legitimate subpoena issued by congress because you have not held a vote and passed a vote on an impeachment inquiry. that's concerning to me. i did not support the initial impeachment inquiry when kevin mccarthy made the statement publically rather than holding a vote. i'm undecided whether i will vote for it or not. >> let me ask you about the funding issue. president biden is willing to make significant compromises on the border in return for foreign aid for ukraine, for israel, and for taiwan. you have two wars going on. is there a border compromise on the asylum issue? he had a separate bill that was voted down. >> there's a compromise being worked out in the senate. i hope that passes soon. i think it's important that we get this israeli aid done. the house sent a bill to the senate. we are waiting for a response from the senate. it may be a rejection. it may be a new bill. something has to come over from the senate to start this process again in the house. >> with ukraine, according to the budget director -- we talked to her -- they are out of money at the end of the year. national security is at stake. vladimir putin is the beneficiary of all of this, if we don't do that money. why deal with the border security issue which has stymied both parties for decades and decades? there has never been a comprehensive agreement on border security. why bring it up at the end of a session where the house was out for 21 days because of -- as you know, the republicans' failure to have a speaker. why with only weeks before the holiday break bring up something that complicated and jeopardize ukraine and israel? >> i'm absolutely in favor of aid to israel and aid to ukraine. i believe that many of the members in the house want to make sure that we deal with the really serious crisis that we have at the southern border and hope to use ukraine aid as leverage. i think the biden administration could give a little bit more rather than putting its heels in the ground and start a negotiation where we end up. anything would be an improvement on our southern border. i feel we need to find pay fors for the aid we are giving to the foreign countries. we need to make sure we aren't overspending at home and giving aid away when we could find something to help reduce the cost of that aid. >> we never demanded pay fors from other presidents for aid for a foreign war with our allies. that's never been done before. it was never done under donald trump. >> right. we never had the high interest rates that we have had before. we never had the amount of deficit that we have had before right now. i think that's what we are concerned about is making sure that we don't allow the deficit to go higher. a compromise border security measure, as we were discussing with the house republican ken buck. republican senator lindsey graham told nbc news that the border is more important than ukraine's war with russia. >> what happens if ukraine funding doesn't pass this year? >> huh? >> what happens if you can't pass funding to ukraine this year? >> then we'll take it up next year. >> doesn't it become more complicated in an election year. >> i'm more worried about our border than ukraine. >> you are? >> 100%. >> joining us now is senator mark warner, the chairman of the intelligence committee, also serves on the budget and finance committees. senator warner, there's a standoff here. what do you think of senator graham saying that the border, which has been a problem for a long time, is more important than getting this -- the money to ukraine? >> andrea, you laid out with your previous guest the congressman, you know, none of these preconditions were put under donald trump. none of these were ever scored in the past, and we're talking not just ukraine but also israel, and the necessary humanitarian aid or you will have countries in the middle east collapse, and the remarkable thing is at the end of the day, history will judge whether meets its commitment or not things. ukrainians in 21 months without the loss of a single american soldier or nato soldier have cut russia's military capacity in half. anyone who says this is so much bigger than ukraine, why would any nation ever trust us again. why would anybody in nato ever trust us again? ukraine is not a nato nation, all of nato and we led nato into helping protect ukraine, and those colleagues that say, well, we don't care about putin winning, but we're concerned about china, if you don't understand that putin win in ukraine gives xi more power and his aspirations in asia, then you flunked geopolitics 101. but we are where we are, andrea, and listen, the border is a challenge. it's a mess. the president in his initial proposal put in $14 billion, never that much money on border. if there are policy changes, and i'm all for policy changes. what i'm not for, though, is the old republican bill called hr 2 which basically did things on the border in terms of shutting down immigration at a level of even donald trump at his worst didn't suggest. so reasonable people, let's put something together. put it on the fore. chances are it will have to loosen democratic votes. in many ways that may be more important than the substance. so many of my colleagues, and i'm not an expert on the border as well. so many of my colleagues don't understand the substance on how all of these laws interconnect, but boy, oh, boy, we should not leave for christmas holidays without getting this done. i think the ramifications of failure will be historically negative. >> can senator schumer keep the senate in session during the holiday? >> listen, we are hired to do our country's business. now, again, people may say i live close, i happen to be the virginia senator, so let me put that out for my colleagues. i can't think of an issue almost since i've been in the senate that has more -- has longer long-term ramifications. do we want some level of settlement at some point between ukraine and russia? absolutely, but the idea that we would cut and run at this moment after we've been promising the ukrainians that we'll be there, and so many of the senators who are now hedging, go back and look at their earlier comments. they were right there with ukraine promising we will stand with you as long as it takes for you to be successful, and then the change of position at this moment in time, it's a problem. we are where we are. i'm not going to sit here and point fingers. i think the president ought to engage with leader mcconnell on moving this forward. i think we were pretty close a week ago, literally a week ago, 12 democratic senators said the border changes that were being proposed, they might not be able to support, so there's already pushback on the democratic side. i think we're going to have to probably have enough policy changes that we'll lose democratic votes. that's how you get to a bipartisan solution. >> so you really need to see the president being more involved. >> the president's people have been involved in the background. somehow we got to break this log jam. i have a lot of faith in the existing negotiators, but they've had weeks on end. at some point, you know, we've got to have something that the -- my republican friends feel is good enough, and if they don't know the details, one of the signs may be loss of democratic votes. the irony, andrea, and you know this, the people who are crying and screaming often time the loudest on the border are never going to vote for ukraine no matter what we do. there's at least a third of the republicans in the house and maybe 20 in the senate that you could -- you could shut down the border forever. they still will not support ukraine. so let's get the group of doable senators and if the president needs to lead and i think bringing this with leader mcconnell, leader mcconnell has been a stalwart supporter of ukraine. it's now time for all of us who believe this is a historic choice we have to make literally in the next 15 plus days. let's all not only put our money where our mouth is but let's stay here as long as it takes to get this done. >> we've got about a minute left, but there's a story that just broke today, the united kingdom saying that russia's intelligence service, the fsb as you know, used a cyber hacking campaign to target high profile politicians, civil servants, journalists, the uk believes this is part of a plan to interfere in british politics. what's your reaction to that? >> my reaction is i'm not surprised at all. the russian services are trying to penetrate the uk. they're trying to penetrate the united states, the russian disinformation campaign trying to undermine american support for ukraine. it is active, vibrant, real, happening every day. and andrea, the remarkable thing is that in terms of disinformation, many of the tools that were even set up under the trump administration to try to reach out to social media companies to take down disinformation and call it out, there was a recent court case, the fifth circuit said basically nobody in government can even talk to social media. that makes no sense at all. we are potentially going into the 2024 election cycle, unless we can get that overturned and frankly the administration needs to lean in a little bit more, where we could be flying blind in terms of not only russian interference whether it's through cyber attacks or cyber we can still deal with partially, but in terms of mis and disinformation ask other nation states we've got to engage with social media to make sure that americans can at least be aware, and as we've
