Sean penn has been there after those kinds of stories, as gonna show us and tell us what thats like. Thats really very, im eager to see that lawrence, really important stuff to cover. They were doing that thanks, alex. Thank you. Well be Breaking Incriminating news of the night about defendant Donald J Trump, is that he revealed Nuclear Secrets to an australian billionaire who purchased his access to donald trump while donald trump was president. Donald trump is the only president in history who publicly put a price tag on physical access to him with the price paid for that access going straight into his own pocket not his campaign australian billionaire Anthony Pratte decided to pay that price. For access to the president of the United States, by buying a membership at the Maralago Club that donald trump runs at his florida residence, because he could not afford the home without the income from the club. The australian billionaire bought that access only after donald trump became president , and he got exactly what he wanted at the club. Which was frequent contact with dinner with the then president of the United States, the New York Times reporting tonight, shortly after he left office, former president Donald J Trump shared apparently Classified Information about American Nuclear submarines with an australian businessmen during an evening of conversation at maralago, his private club and residents in florida, accointo two people familiar with the matter. According to another person familiar with the matter, mr. Pratte is now among more than 80 people whom prosecutors have identified as possible witnesses who could testify against mr. Trump at the fied documents trial, which is scheduled to start in may, in Federal District court, in florida. The account that mr. Trump discussed some of the countrys most sensitive Nuclear Secrets with him in a cavalier Fashion Uld Help Prosecutors establish that the former president had a long habit of recklessly handling Classified Information. In the existence of the testimony about the conversation underscores how much Additional Information the special Prosecutors Office may have amassed out of the publics view. The secrets that donald trump revealed to the australian billionaire about the United States navy submarines, including, quote, how many Nuclear Warheads the vessels carried and how close they could get to their russian counterparts without being detected. Donald trump has had no access to additional Classified Information since leaving the presidency. Because of this. I just think that there is no need for him to have that Intelligence Briefing. What value is giving him in his Intelligence Briefing . What impact does he have it all, other than the fact he might slip and Say Something. We have entered the dismissal in the late stage of the trump prosecutions with Criminal Defense Lawyers doing what Criminal Defense Lawyers almost always do, ask for dismissals and ask for delays. Motions to dismiss in criminal cases are Standard Defense procedure, that really work. Motions to delay the cases are also standard procedure, and do work more frequently. Today, at 8 30 a. M. , trump Criminal Defense Lawyers asked their favorite judge, Aileen Mercedes cannon, who was appointed by donald trump to delay the trial, in the classified documents case six months so that it wouldnt begin before november of next year. That would get the trial to start after the president ial election. At 10 45 a. M. , Donald TrumpsGeorgia Codefendant, david schaffer, adopted codefendant, kenneth chesebros motion to dismiss. At 11 20, 90 am, Georgia Codefendant sydney powell filed a reply to the prosecutions response to a motion to dismiss. At two pm, donald trump moved to dismiss jack smiths washington d. C. Prosecution for crimes leading up to and on january 6th. At 2 13 pm, Georgia Codefendant, robert cheeley, filed a motion to dismiss the charges against him. At four pm, donald trump filed a motion to dismiss the criminal charges against him in manhattan for business fraud. In payoffs to porn star, stormy daniels. At 5 15 pm, georgia judge scott mcafee held a hearing on motions to dismiss by codefendant sydney powell, and indicated that a dismissal would be unlikely. Leading off our discussion tonight, barbara mcquade. Former u. S. Attorney and Law Professor at the university of michigan law school. Glenn kirschner, a former federal prosecutor, and host of the Justice Matters podcast. Both are and msnbc legal analyst. And bradley moss is with us, a National Security attorney who represents people who work the intelligence community. Bradley moss, let me begin with you on this Breaking News of this hour. About donald trump verbally, apparently, sharing Nuclear Submarine secrets with an australian, who then told approximately 80 people, according to the followup reporting on how many people this person told. Just an endless stream of people kept hearing about. Just from that one source. What does this do to the prosecution of donald trump in florida, if anything . It certainly expect to see stories like this played out as facts witness. Just reestablish a pattern of conduct by donald trump how loose his bronze lips were with respect to Classified Information. Particularly, after he left the presidency. The extent to which he had no respect for the safeguarding of the Classified Information, to which he had been privy well president. In terms of the larger idea, this is why we were always so terrified about maralago and bedminster existing the way they were throughout the trump presidency. They were counterintelligence nightmares. They were the things that keep Security Officials up at night. The idea that these various individuals from foreign countries, with what artillery or motives they might have, could just buy axes to donald trump for whatever, 20,000 a year. And donald trump loves to talk. He loves to brag. And this is what they were worried about all that time. Barbara mcquade, theres additional witness to this who worked at maralago, who heard this kind of talk from donald trump, was very troubled by it. The idea that russians could find out this way how close u. S. Submarines can get to them undetected, its a Pretty Simple root for maralago to russian intelligence. Absolutely, lawrence. In fact, if these allegations are true, it is itself a separate crime. I dont know that well see a separate crime charge, just because it can be difficult to prove crimes that are based solely on Oral Communications. Just because Human Memories are fallible, sometimes people misstate or misunderstand things. But the fact that this australian businessman says how troubled he was, theres another witness who says they heard it, it does demonstrate that this is an accurate statement. Also, the danger that it poses. Its not just a technical violation of the law, it is one that undermined the National Security of our country. Frankly, as someone once said, donald trump is a walking National Security risk. He, as former president , has a lot of really valuable information in his head. Most president s are loyal enough to the country, not to disclose them to people on authorized to receive that information. With donald trump, weve seen it with the documents, and now, it seems like were hearing with the Oral Communications as well. Glenn kirschner, this takes us back to the president ial transition from the Obama Presidency to the trump presidency. Where there was a lot of discussion about how can the president run a business several different kinds of business. How can a president run a business like maralago, where people can simply buy a membership to get access to that place, to that present. Its exactly what we have here. This guy had no interest in maralago, until donald trump was president. Then he decided to buy that membership. So we could get that access. And it turns out, obtain Nuclear Secrets. Lawrence, donald trump has never been in the presidency for the good of the people, for the security of the nation. For the health and wellbeing of our military members. He has always been in it for himself. What he can get out of it. And i dont know how many times, and in how many ways, were gonna have that thrown in our face. Before we start to see some real accountability. Dont get me wrong, for criminal indictments, to state into federal, are a good start. But theyre only a start. We have continued to let him, when i say, we, i mean the institutions of government. Have continued to let him in danger witnesses, judges, jurors, their family members. And it finally, took a state court judge, judge arthur engoron, to step up and say, enough is enough. Whereas, i was thrilled to see the judge and barren issue a partial gag order to help protect his court staff. You know, shouldnt we be in the business of protecting everybody, witnesses, jurors, judges, prosecutors, and others against Donald Trumps dangerous rhetoric . Not when it just happens to be someone very close to us, like our court staff. So, i mean, the danger that donald trump continues to pose to this country, to our military members, to foreign countries, as, i think, exemplified by this new unfathomable reporting about him sharing Nuclear Secrets cant be overstated. Bradley moss, donald trump is now seeking a delay, just past the election on the case involving these classified documents and Classified Information. The violation of the Espionage Act And Obstruction Of Justice case in florida. What do you make of that request for that delay, which of course, jack smith is opposing . Yeah, its a very slow attempt on his part. I dont think he expects to actually get pushed off the full six months. His goal here is, can i get a little bit. Can i get something, just to delay it enough that it continues to push it closer and closer, so that depending on what appeals i have, have any immediate pretrial motions, it makes it more and more unlikely that this makes it to trial, or at least completes trial before the election. What you get closer to the election, theres gonna be a lot of pressure to shut down the criminal proceeding. Lest it really be him seeing sitting in a courtroom in october of 2024. Instead of sitting on the campaign trail. Thats his goal here. I dont expect judge cannon, you know, for all the concerns weve had about her, i dont expect or to really grant some extensive extension here. But i do see her taking her sweet time, possibly, to get her on deciding on what she wants to do, and maybe giving him a little bit more slack than he should be given at this point . Barbara mcquade, this is a standard stage of criminal procedure. Defense motions to dismiss, Defense Motions to delay. In this case, the trump lawyer saying, we havent had enough time with a classified documents and theres no facility in florida where we could adequately examine the classified documents yet. Therefore, we must have italy. What are you seeing in the Dismissal Motions that might have merits, if anything . Nothing really, lawrence, concerns me right now. A couple of Dismissal Motions filed by donald trump. One based on this double jeopardy idea, that the fact that he was not convicted of in his Impeachment Hearing by the senate, that somehow precludes criminal prosecution. I dont see that one going anywhere. Those are different entities. Different branches of government. We very different functions in purposes. Hes got another one that says that, because he was president of the United States, hes immune from criminal prosecution. Again, i dont see this one surviving. Thats because, although the president does have broad powers to take care that the laws be faithfully executed, under the constitution, and even though the president does enjoy immunity, for actions that he takes within the official scope of his office, the allegations about what he did in this election is outside of that scope. Interfering with the state elections is not part of his federal duties. The president has no role to play in the elections, that belongs to the states. In fact, i think its more accurate to characterize what he was doing in the alleged conduct in the indictments was campaigning, and not governing. So, i dont think that motion is going anywhere either. Glenn kirschner, President Ford and president nixon, if they were alive, would be fascinated by the idea of president ial immunity. Jerry ford would want to know, well, why did i have to issue a pardon to Richard Nixon after he was president . A pardon that may have cost gerald for the next president ial election. Yeah, lawrence, absolutely. This is, in essence, the defense filing a motion that says, if the president doesnt, its not illegal. In my friend barb is so much more tactful than i am. I agree with everything she said about this frivolous Defense Motion to dismiss, when i was reading it earlier today, lawrence, ill tell you. If there were people sitting around me, and they listened closely, they could probably hear some of my brain cells dying and hitting the floor. I mean, the arguments were just that bed. Particularly, the contorted interpretations of the impeachment clause. I cant wait to read the reply from jack smiths prosecutors, because if their early responses to similarly frivolous motions are any indication, its going to be some really good reading. Barbara mcquade, glenn kirschner, bradley moss, thank you all for starting off our discussion tonight. Thank you. Thank you. Coming up, just over an hour ago, donald trump dropped a lawsuit that he filed in april, because he was afraid of being forced to testify under oath in that lawsuit, in a deposition, next week. Trumps troubled life. He dropped his lawsuit against Michael Cohen, just over an hour ago. Thats how much donald trump fears testifying under oath. Donald trump was scheduled to testify in an under Oath Deposition this week in his lawsuit against Michael Cohen but managed to have that pushed back a week, claiming that he had to be in court for new York Attorney general Letitia James civil case against donald trump for fraud, which does not require him to be in court. Donald trump spent monday, tuesday and wednesday at the courthouse for no particular reason, but therefore successfully delayed for a week his deposition in the Michael Cohen case. Now, donald trump is dropping the case entirely, so that he will never after testify under oath in that case. Just over an hour ago, donald trump filed a notice of voluntary dismissal of that case. The Trump Lawsuit had claimed that Michael Cohen violated the Attorney Client privilege in discussing the work he did for donald trump. The judge in the Continuing Civil Fraud Case against donald trump issued a order today saying that donald trump is not allowed to sell any of his Business Assets without notifying a court prior. The order also requires donald trump to provide the monitor, retired judge barbara jones, with a full list of part ownership or full ownership of business and these. They have been there every day indeed donald trump fraud trial this week. A courtrooms atmosphere changed dramatically for the better today without donald trump in the room. If you are not following adam glass welts lies tweeting at the trial or reading his ports at the trial and the messenger, then you are missing the best writing from inside the courtroom about that trial, including this. When youre a star, they let you do it, inflate air prized real estate asset, that is, according to emails entered into evidence during testimony on thursday by former president Donald Trumps codefendants. Joining us now is adam glassville, a Senior Correspondent for as always, tim obrien is with us, Senior Executive editor of trump nation, the art of being a msnbc political analyst. Adam klasfeld, thank you for that lead of your story today about the trial. Tell us about, first of all, what a changed atmosphere it was in that room today. Oh, thank you very much, lawrence, for that very kind and sure theyre. It is a very changed atmosphere, you said it. It was the first day of trial without trump in the room, so things proceeded along smoothly. It started out with his lawyers doing crossexamination, and lo and behold, streamlining that justice anger on had urged them to do, subtly happen and the trump team questioning was all the better for. It actually started by questioning the first witness in the case, donald bender, an accountant for the outside Accounting Firm for the trump organization. That progressed along into the first codefendant, the one that was mentioned in that story day you referred to. That is a jeff mcconney. That testimony, and this was a very eyeopening questioning. It went to something that went to one of the central allegations here. This is the tripling of the trump tower triplets. Folks may remember who have been closely following the case that this xxx was something north of 10,000 square feet, but listed in these trump statements of Financial Condition as 30,000 feet, and that gave a big boost. Now in this questioning today, in this testimony, we found a little bit of back story when the a. G. Office showed these females between mcconney and executives from Trump International realty, and it went to that lead, that they were referring to earlier, basically saying that they put a premium on celebrity. Now, what would get it to be that much higher than what they were saying in the other emails, comparing it to another trump xxx that was owned by a saudi prince, that was around something around 40 million. The final price on the trump xxx and the Tower Building was significantly higher, north of 200 million. So that is the testimony. Its ongoing and continuing tomorrow. Tim obrien, donald trump has frequently been accused of following absolutely frivolous lawsuits, including against you for your book about him saying that he was not as rich as he was. Of course, he lost that lawsuit. Donald trump himself proved how frivolous his Michael Cohen lawsuit was tonight, when he just threw it out himself. And he threw it out himself for two reasons. We touched on this previous discussions weve had, lawrence, about how He Upper Merion in atmospheres like this. The first is that donald trump is a bully and a coward, as well as bullies are. He went after Michael Cohen, i think on the hope that Michael Cohen would back down because of 500 Million Dollar lawsuit is very, very scary. Lo and behold, Michael Cohen said no. What the positions that. Or put you under oath and questioning about the allegations and then tenure financial dealings and then touch on how you run your business. All of that into the public and, snap, within seconds, donald trump backs down. There is an important lesson in that for voters, for institutions like the media, congress, the court that are doing with this in many different ways with donald trump, as he tries to corrupt institutions, corrupt the rule of law and be on the media, they end and they. Out its worst standing up to him when the facts are on your side, and to stand up as you need to, because like most police, he will ultimately back down. The other thing going on here is that Donald Trumps every lawyers worst nightmare. He isnt disciplined, on sophisticated, sees it as performance are, rather than issue teaching legal moment. He routinely carbonates himself. He continually exaggerates or lies or creates new problems for his attorneys, and no attorney wants him under oath. The state in this particular legal action was not big enough, the attorney, teresa. The boy got pushed down, and they got restrained, and the case is clear. Tim obrien and adam klasfeld, thank you both for joining us tonight. Thank you. Thank you, lawrence. Thank you. Community, organize relief effort. His new important documentary about ukraines called superpower, and it is streaming now on Paramount Plus. Sean, thank you very much for being here. Thank you for having me. I watched it this past weekend, and in those moments where you take us into these places that had just been attacked, i, and i think everyone watching it, were sitting there absolutely speechless, as we watch these people walk into what was their home. I cant imagine what your feeling, but you have to Say Something in those situations. I just thought myself, thinking if i was there, i could not even speak. What was it like to be there . It really brings it home in a sense, i had traveled in places of conflict in the pass, where the systems of government or the cultural and religious aspect made it less familiar. So, somehow, processing that is different. But in ukraine, the people, the culture, the hunger, the identification and the need for freedom is so familiar that its as though you have not left the best thing that any of, us whether we be on the left the right, anything in between identifies American Experience or aspiration. When Something Like that happens, its as if it happened here, like what happened today. Pick the town that your children go to university in. Pick the town that your parents work in. Pick the time that you grew up. Thats what they targeted, and as you said, murdered all of the civilians, where there were no Military Targets at all. And its sort of an idea that in the past, ive heard it and i have heard it. And here, it is just, i guess, it is that a media, direct association with the context of being exactly what it would be for us. And, of course, that is probably true everywhere in its own way, but here, you just cant find any decision at all. Its truly amazing to me, the conversations that are being had in the in that it states, the sort of betrayal to young people, where we told them with all of our ukrainian flags and solidarity, that we would be there for them, that is who we are. Now, because of what happened in congress, all of the politicization of this thing, the basic goodness of the power aspiration, again, on either side of any policy, without following through with ukraine, would be really telling. That is the fake news. The fake news is not one way or the other one. The fake news is the parents and leaders and schools just told a generation, this matters. We will be with them. A year and a half later, this is what happens in congress. On Kevin Mccarthys last day in his press conference, you did something that you are not supposed to do in Polite Society in america. He made a hitler comparison and compared putin to hitler. He compared to what we are seeing, the aggression in ukraine to theres a question in the late 1930s and the way hitler started world war ii. With invasions. Which, i have to say, its exactly the frame that i have been using from the start of watching what was happening in ukraine. Through the frame, the question simply becomes, what do you do . What do we do in facing the rise of putin like this . It is a moment that is a spiritual equivalent of what do you do, watching the rise of hitler . And what do we do . What should we have done . And a case, we were led by europe, ultimately. We were led by pearl harbor, where we finally took stock. I think, now, if we were to work with the leading force for good and decency, and even for that matter, the future of our childrens global economy, then we should lead with the European Countries now and not the way, the strength that we have been going with, the script that it is time to stop this. You wont find me agreeing often with speaker mccarthy, however, its only someone who wants to, i dont know what the Wrestling Match is all about, but this is clearly exactly what ignorance is. Except, he is only at the beginning. That is where he should be stopped. When you encountered these people who have just been through these traumas, but you see in the documentary is some of them have the anger right at the top of their feelings, its right there. And others just have a reaction of, okay, now i have to do this. You can see them, now, i have to move forward this morning. What is it like when you are around those people, who all in every moment, all seem heroic. Every cut in this film is to another hero. Some of the names, we know theyre names, zelenskyy, but most of them we dont. Again, something that i had thought about or heard about through all of what has happened, how would we be able to summon the courage to, whatever it is, if the time came. I think with probably some notable exceptions they just have hero in their blood. All of us would have it if all of us had it, and that is where ukraines. None of them are alone, and as one of the people who testified in the film sets, they have to kill all of us. That is why we are not afraid. That is pretty moving and something that my country should really consider the power and the Healthy Minds that come in community. It does not mean that we dont disagree. Unity of civil discourse, genuine positions rather than short Term Campaign positions that add up to, well, in this case, going on two years of murders like this, of death and kind of on the backs of this courageous country. Ukrainians for a long time wanted to be free, and ukrainians did not understand me also. They did not understand it. We have to pay for the. And we did not understand the high price of a misunderstanding of freedom, kyiv with the war, with the fighting for these freedom. Sean, you were with president zelenskyy right now at the beginning of this war. You went back several times, youve been watching him from afar from close, watching him develop. When he is in here talking about how his eightyearold, his eightyearold is now older and has a whole different set of expectations, understands that he cant be home, because he is trying to say the country, are these all these dimensions to zelenskyy that we see in here, tv news, has not been able to capture because documentaries have a power that our daily coverage does not have. Watching him has been, sort of serves to reason in hindsight that one would want a leader in a time of war or not, who humanly, first had gone through a period of absolute commitment to the idea that two sides of a conversation can talk. We become aware to the idea that a lot of politicians just from the beginning, lets see what they get, with there are going to get. He comes from the previous group. He went on an arc to try everything. So by the time the invasion happened. There was sort of a mental preparation that allowed him and his country to go all in, not withstand, of course, largely because he had been able to call us and begin to move since 2014 towards this sovereign identity that is described in the film quite a bit. And so, there was no hesitation at that point on how far russia would try to go and what it would take for ukraine. But to see in him, as he is the face, and i think you and i spoke about this in new york shortly after, after the first trip, was that he epitomizes and is the face. Its seamless. That clarity. So, for me it has been a moving experience, in a way that i mightve had indifferent or less focused ways, but this particular person, in this country at this time, and for us in our lifetime, at this time, its an opportunity that i cant really begin to express how grateful i am for it, which of course i would have traded for russia not invading. But given that it did, wow. And thats why the film is so important to me. I want to share that similar thinking people and with people who think, or soon to think very differently than i do about politics, the world, or in particular, u. S. Support and need for it, for our sake in ukraine. It is not for an artist to judge his or her most important work, and you, as a film artist, have done some of the most important work ever done in drama, with milk, with dead man walking. Taught us things about ourselves as a country in a community. I can tell you, having seen all, virtually all of your work, for me this is your most important work. This is something that needed to be done and should have a life that teaches people things they would not otherwise know. I can say that for me it certainly is, without pierre, the most important thing, and because of that i think that i did something that maybe i wouldnt normally have done so completely or i hope people will feel this when they see the film. Is that, the artists will phone up and say, i do this for me first, and if others respond, great. Well, no, not in this case. In this case i wanted to take anyone that would go in the backpack with me and just learn about it and see it happened and try to, in that sense, completely stay out of the way. People know im opinionated. Thats going to happen also if you watch the film, but i dont think thats the center. The center of it is to be, you know, anyone in america to be able to go and smell the air that is unity and courage, in that place at this time, and so of course it is without fear the most important film to me, and i find that those who are watching it, of all stripes, are connecting really strongly to it.
