Developing this hour, donald trump and his 18 codefendants now have six days to surrender at the Fulton County courthouse in georgia, on racketeering and conspiracy charges. Three senior Law Enforcement officials tell nbc news, they are anticipating the former president will turn himself in at the atlanta jail, no earlier than thursday, but they stressed nothing is yet officially it. Democratic what congressman, eric swalwell, gave msnbc his assessment of what happens next for the former president. Here it is. Donald trump is going to get a Justice System that hes never been willing to afford to others. He always wants to try and convict people in the public square, without giving them any due process. Hes gonna get all the due process, hes gonna get every protection under law, and whatever happens to donald trump, it is going to come from his peers. And thats why i think its gonna be so sweet when he meets accountability. Meanwhile in georgia, there are new reports the fbi has joined an investigation into threats made against Fulton County officials in recent days, including members of the atlanta area grand jury that voted to indict trump. Also new today, trump deciding he will snub the first republican president ial primary debate, thats wednesday. Thats also according to two sources familiar with his thinking. Those sources say he is instead seeking a sitdown interview with former fox news host, tucker carlson. Trump spokesperson told nbc news, quote, we havent confirmed anything on our end. In atlanta, some of trumps gop primary rivals gathering today for conservative conference in the city where trump was indicted. Today, Chris Christie taking veiled aim at donald trump. How about we do this this time. We nominate someone who we know in our hearts would put the country first, and not their Self Interest first. The president praising the relationship, says he announced agreements aimed at bringing the countries closer together. I would recognize the important work that both of you have done. This is about decades and decades of relationships that were building. On monday, the president and first lady will travel to hawaii to survey the damage done by those deadly wildfires. Were gonna have more on the president s hawaii trip later on. We begin with the latest in georgia, with reporters and Analysts Covering all these new developments surrounding donald trump. Regarding him at nbcs Julie Tsirkin joining us from Fulton County, georgia. With a former president is expected to turn himself in by the end of next week. Julie, welcome to you. Walk us through what that process will look like once it happens . Yeah, hey, alex. Heres what the process normally looks. Like for any other normal defendant who comes to this jail, over my shoulder here, and the sheriff here says that he wants it to be that way for the former president to. Lets talk about what that would look like, right . It would consist of the former president arriving, getting fingerprinted, getting his property searched. Turning over herself, on anything else he may have on him, getting a medical screening. And getting his mugshot taken before waiting in a room for sometimes upwards of 12 hours at this overcrowded jail that, by the way, is under investigation for civil Rights Violations by the department of justice. When the Secret Service is involved, and as weve seen in the last three indictments, of the former president , thats not typically what happens. At this point, we still dont know how its gonna go down here on the ground. What we do know, the former president doesnt plan to show up here until at least next thursday. Remember what the d a fani willis had said she wanted them to come here, setting a deadline of midday by next friday for trump and all the other 18 codefendants to show up here and go through the Booking Process. He plans to do that at least the day after the Republican Debate which is skipping, as you mentioned, at the top of your show. Thats not stopping the former president from taking to truth social, his social media platform, with continuing to rail against the Georgia Election results in 2020. Saying that he won in 2016, so that means he must have won in 2022. I believe we have that post on your screen right now. You see that hes continuing to slam the Election Interference Investigations against him. Despite the republican governor of this state saying, trumps wrong about that. Okay, julie, im sorry that we had a soundbite. There i may be mistaken. All right, okay, julie, hang on there, i do want to bring in greg bluestein, political reporter for the atlanta journalconstitution. And msnbc political contributor. Greg, with you, were gonna start with the fact that donald trump is expected to turn himself in. As julies reporting, no earlier than thursday. Will his attorneys successfully negotiate any kind of Special Treatment for the former president . You saw where shes standing, right . Outside of that Fulton County jail. Does he get there . What does the Booking Process look like . Yeah, notorious is an under step for subscribing the Fulton County jail. I cant imagine him staying there for hours and because of logistical nightmare. The left move inmates around, an already very overcrowded facility. I know that Surrendering Negotiations are underway. Were expecting him in the latter half of next week, after the debates. So, the booking of the 19 politicians, lawyers, and former president , greg, sitting closely the tories jail several investigation by the Justice Department talk about that. Are they in for a shock when they see that place. Yeah, again, its notorious. Its known as rice street here in atlanta. Its a place where even hardened Criminal Defense Attorney say you wouldnt want to wish it upon your worst enemy. Wow. A place that is plagued with civil Rights Violations. Theres investigations involving deaths that have taken place there. Theres a third recent death thats just reported by the atlanta journalconstitution. This week. So, this is a facility that Fulton County authorities have long tried to get back on the right track. But it is a troubled, plagued facility. Unlike trumps previous three documents, julie, this arraignment have been separate from his booking. The arraignment is scheduled for the week of september 5th. It in the courthouse. In that courthouse, cameras are usually permitted. So, what does that mean for his first appearance for the judge . Will it be televised . Yeah, exactly right, under georgia law, they actually do require cameras be present in judicial proceedings. Of course, the judge has to sign off on that. Usually, and typically, they do. Georgia believes, under their law, of course, the public has a right, and an interest, to have an inside look as to their judicial proceedings. That will, of course, be super notable, previously, weve only got in those Courtroom Sketches of the former president sitting inside the courtroom, as the charges are being read to him, as he appeared in his first hearing. I will note, the arraignment that the d a fani willis had proposed to the judge for the week of september 5th, trump can appear virtually, perhaps, if they agree to that. Theres nothing in georgia law that says that is not an option. Currently, thats still on the table. Its not clear, because of, course the former president , all of the 18 codefendants, can file a separate motion to try and delay the start of the trial. They still havent fully agreed to the dates that fani willis has proposed here. Its not clear when were gonna see the former president in the courtroom here, he could totally show up virtually to the arraignment, if and when that happens. I do want to talk about something about you and greg are talking about that, just for color, just as if you setting outside this jail. My producer i have been going through that booking system, they actually have an app where you can see people who are being booked in the jail. So far, nearly 30 people have actually been booked just today. Just this morning at this jail. None of them, i will tell, you are those 18 codefendants. They can enter either right behind, me or theres a Back Entrance in this jail as well. This jail being busy is an understatement. Yeah, okay. The judge, greg, we have 34yearold scott mcafee, whos been assigned to hear this georgia case. What can you tell us about him . His background . And how it mightincher flip his approach to the case . Well, hes about to get the biggest case of any judge in his lifetime. Maybe the biggest case in georgia history. If he actually ends up overseeing it. We expect motions to remove this to federal court, we have no idea how those will play out. As of right now, scott mcafee is the judge assigned to this case, 34, as you mentioned. Been on the bench for about seven months. He was just appointed by Governor Brian Kemp. Hes a former prosecutor, former inspector general, he is a renowned musician with a long history of playing all sorts of different instruments, at a highlevel. But no one in Fulton County, no one in the state, no one in the country, has ever taken on a case overseeing a case like this one. His challenges laid out for him. Yeah, he sure does, pretty remarkable. So, greg, we have the fbi now confirming to nbc, it has joined an investigation into threats of violence against Fulton County officials, as well as the grand jurors who indicted donald trump. After the personal information was posted online. So, will this judge consider these threats at the arraignment . We how do think that could play out . Yeah, we saw the federal judge consider these threats, in terms of warning the former president that any of these malicious statements he makes could speed up or timeline. Look, this is all goes back to the georgia case law from hundred and ten years ago, that allows the publication of grand jury names. Now, theres calls to change that statute, to shield grand jurors from this sort of attention. They were just doing their jobs. Now, local authorities and federal authorities are having to step up security just to make sure that they remain safe. Lets go back to december 14th, 2020, greg, the day that Georgia Democratic electors cast their votes for president biden. You spotted republican electors holding what they told me it was an Education Meeting behind 2 16 there the state capital. You witnessed the meeting, which is essential now in the alternate electors scheme, only three of the 16 people in that room are now facing charges. From what you know about them, are they likely to cooperate . To try to escape jail time, or no . Well, we know that at least eight of those fake electors have already taken immunity deals. We assume that theyre cooperating. We dont know if anymore have. We know that prosecutors have always kind of focused on those three, partly because one of those three was former gop chair, david schaffer, alleged to have orchestrated the fake elector plot. Another one, is now a state senator. He was secretary of the state Republican Party at the time. We assume thats why prosecutors are narrowing on them. Theres also another name out there, Lieutenant Governor robert jones, state senator, whos also fake elector. In prosecutors have initiated an investigation that could involve him. They havent said whether they charged him yet. Fani willis was ordered not to investigate, him she held a fundraiser for burgeo and political opponent, now, there is procedures underway to possibly investigate him as well. Get around that. The georgia indictment is still making front pages of newspapers around the country today. Key players on the spotlight in south Carolinas Greenville news. The star press in monsey, indiana, focused on trumps request for a 2026 trial date in his Election Fraud case. And the New York Times raising a key question today, can any of trumps trials beat the Election Clock . So, for the answer, were gonna go to nbcs hayes brown, writer and editor for msnbc daily. Because the times lays it out, three different prosecutors, four different cities next year, in the midst of a president ial campaign. Saying that its gonna be nearly impossible to pull it off. What are you hearing about the potential timing . Well, i mean, the trump legal strategy has always been to delay, delay, delay as much as possible. Try and push back these trials as much as possible. Ideally, until after the full election. Thats not gonna happen. We are not, i feel like, going to be seeing these federal cases stretched out that for. But he does have a point that for the criminal cases, at least, he does have to be there for them. He doesnt need to be in need to be in court the suffering theres civil case that hes facing. Both in new york one federal civil case. Again another Defamation Case against e. Jean carroll. And one civil case from letitia james, the new York Attorney general against his business. He is going to have a lot to do, on civil cases, he doesnt have to be there. He wasnt there for the first e. Jean carroll defamation suit. He probably wont show up for this one. But the rest of them he does need to be there. So, its going to be a real balancing act, its gonna take up a lot of his time over the next few months. Starting at the beginning of the year. Yeah, absolutely. Referring to the delay delay tactic, heres what trumps former white house lawyer ty cobb says about trumps proposal of a 2026 trial date start, lets watch that. Thats nowhere within the neighborhood of the neighborhood of possible dates. I dont think that the a lawyer decided date. I think that probably was a trump date. Im sure that the lawyers proposed something slightly more reasonable. I think that this case, the Election Interference Case in particular can easily be tried before the summer of 2024. So a couple of points, there chris. First of, all do you agree with ty cobb, and what makes this Election Case easy to wrap up by next summer . Well i do agree with ty. I think that the dates that he states are definitely trump driven. But listen, you know, i think that, and that is also consistent with his delay delay delay, but i think that he makes a really good point and that Donald Trumps first strategy is delay, but then keep in mind that these courts are really not hearing his delayed topics. And so a secondary thing is, lets make this trial my campaign. So really these trial dates are turning into his campaign. He is really rallying up to allow these trial dates to really be what he is campaigning on. So now he has turned his delay tactic into, they are out to get me. And so even though he has got the october Trump Organization hearing coming up, hes got the e. Jean carroll trial that hayes was talking about taking off on the same day as the iowa primary, he is going to utilize these trials to really be his campaign point. And you know what, the polls are really supporting that tactic. No, its true. But do you think that the Election Case, could that be wrapped up by next summer if it goes forward . If he does not win on delay delay Delay Tactics . It could be wrapped, up absolutely. But i think that the Trump Lawyers to make a really good point. When you talk about the very first production of documents being 11 million pages, the trial date pushed out a year and a half makes sense but again the court is not going to allow that. What i think she is going to say is, look, mr. Trump, its time for you to hire more attorneys if you cannot handle the production. And if you cannot allow that to be part of your defense. And so she is absolutely going to force that be wrapped up before the end of next summer, absolutely. Yeah, thats understandable. Nbc news is reporting the trump plans to surrender late next week. Funny will fani willis once all of them by next friday with agreements to come september 5th. Any potential trial date of next march for the next year. But kristen, these surrenders will happen in a heightened threat environment. Theres one woman charged with threatening d. C. Judge tanya chutkan. Jay willis is facing racist abuse after the indictments, and the new today, the fbis joining the investigation of threats to grand jurors. Can any of this play a role in georgias terms of release for trump and the other 18 . It absolutely can, but i think one thing that is critical is that these are not necessarily individuals who are directly linked to trump. Do we believe it based on his past history, based on the fact that there was the insurrection, based on all of these tweets . Absolutely. But you cannot quote a individual liable for the actions of others. And you cant dictate the bail based on that with very thin links. Its way to remote, its way to interact. And so the indictment highlights more than 20 phone calls lately mean by trump in close associates. Seven officials in pennsylvania and three officials in arizona. Several officials in georgia. Hayes, how many times have we heard donald trump describe his phone calls as perfect. So why are Fulton County prosecutors zooming in on these . And so i think one thing that you have to remember is that these are what are called overt actions in favor, that helped push forward the one rico charge that all 19 defendants are facing. Their actions to help perpetrate the criminal conspiracy to overturn the election. So while trump may say they were perfect, these were all calls pushing people and State Legislators mostly to overturn the results of the election in their state. And if not State Legislators, and state officials like brian kemp and raffensperger, they calls that were specifically about, hey, you need to throw in the results of this election and say that trump was the winner. So theyre focusing on these calls because they were calls that had a specific ask about the results of the election. And they kept pushing the same points throughout the layers of this scheme. When it did not work to go directly to the State Legislatures, they went to the governors. When that didnt work, they went to the fake electors to try to get the fake electors to have a reason to throw it back to the State Legislatures so that the republicans there could say, you are right, these are the real electors and don trump won the election. It was all part of the same big spiraling conspiracy, and that is why they focused in on these calls. Theyre looking for the evidence for trump and his team trying to push that conspiracy forward. And to your point, specifically. So all, right lets take a look at a handful of trumps tweets that have been listed in the indictment. Directing followers to hearings in the gop dominated georgia senate. You have falsely claiming to have far more votes than needed to flip georgia, and then of course karen Governor Brian Kemp a full and suggesting two senators could have a bad day, whatever that means, on january 5th. Calling blatt raffensperger clueless for refusing to engage the false claims, and in pressuring mike pence falsely claiming that states wanted to correct their votes. Christian, tell me why these are not being treated as free speech . Theyre not being treated as free speech because it really goes into the conduct. Look, d. A. Williss approach is very clear based on her indictment. She is treating trump like a mafia boss. Not just a common criminal. That is why the racketeering charges have been incorporated into the criminal charges. This means the trumps patterns of behavior across all of these activities, talking about the phone calls, and the trees that we just mentioned, these all highlight that intent, and that is critical for proving these charges beyond a reasonable doubt. The intent behind endorsing fraud claims during the georgia legislative hearings. The targeting of officials like kent and raffensperger. And then trying to sway pence over the electoral college. Together, all of that really can suggest a concerted effort to really interfere with the elections, even if, in a vacuum, they are not criminal or might have some defense under the first amendment. They all together show that racketeering. It shows like the top of that criminal organization as well as that criminal intent. Okay, now we understand. You can see the large crowds, they started coming in yesterday, and authorities have been telling residents in Southern California that this is the thing to Pay Attention to as we mentioned. The possible flooding. That is where the danger can come to this area. I spoke to some of the people that were picking up the stand, and this is what they have to say about the preparations. Ive lived here all my life, im 62 years old, and this is the first time ive heard of this coming in and everybody is preparing for it. Never experience Something Like this before unless youre from florida where this happens a lot. When i came home, i said, were gonna go get some sandbags and i said okay. [laughter] for most people here, its so strange to prepare for a Tropical Storm because theyve never lived through one. So as i have had these conversations, alex, asking people how to prepare, most people have just no idea. They know that there is a lot of rain coming, and as you can see, some of the residents that live in though areas are getting sandbags. But other than that, they are wondering, should i get what . Or should i get food . But there is one thing that authorities have mentioned, alex, that is very important. A simple step that everyone can take is to make sure that they have those alerts on their phones. Although that will tell them when the storm is coming in what type of warning is in effect. Something a simple as knowing how to get it on your phone right away and how to be informed when that storm comes. That could be the difference between knowing what is happening in your area here in Southern California, as people prepare, alex. It is a slow, agonizing, Heartbreaking Process for a lot of these families looking for answers. The governor says that now 60 of that total search area has been scoured over with now 470 individual workers on the Ground Sifting through those ruins. And the governor also says he wants a full investigation and well get to the bottom of what happened during the Emergency Response when the fires broke out. Take a look. Reporter with questions swirling, new developments in the tangled fallout from the deadliest wildfire in modern american history. Overnight, the governor delivering a statewide address. We will get to the bottom of exactly how the fire started, how are emergency procedures and protocols need to be strengthened, and how we can prove our defenses to protect us in the future. Reporter this follows a week of mounting criticism about the Emergency Response in the day of the fire. In just two days after mauis top Emergency Management official resigned. Herman andaya stepping down, citing Health Reasons following widespread criticism that why is Emergency Sirens were not activated. Do you regret not sounding the sirens . I do not. He reporter defended the decision, saying that the system is mostly used for tsunamis and activating it may have pushed people towards the flames. I will tell you that sirens have not been used for brush fires. Reporter a new nbc news review of Public Meeting records found that india downplayed the use of the sirens, saying that from what we understand, the sirens kind a last resort. If you told people to leave the house with a siren that the small smoke and head into the black smoke, give them the opportunity. That is insulting the intelligence of the people that live here. Reporter meanwhile, overnight, another lawsuit followed against Hawaiian Electric with more allegations that the utility is at start for starting the fires. The atf now on the ground assisting with the investigation into the cause. Oh wow search crews continue to scour the charred ruins of lahaina. With more than half of the search area completed, at least 1000 people are still unaccounted for, including s uncle, who is married to his wife mother for almost 50 years. But as you know, President Trump commuted that sentence so that roger stone was able to go on with a dirty tricks career. Trump, for his part, has not shied away from talking about the indictments. What are you hearing from your republican colleagues amid all of this . Is there a sense that some of them are just getting tired of these incessant legal issues with donald trump . Look theres a little bit from column a and a little bit from column b. Weve seen a little bit which President Trump did to the rule of law and how republicans are willing to stand up and rest their office. One right here from illinois, mr. Kissinger. And so unfortunately, with all of that said, and look, the polling is tragic that you still see so many people that were against the prosecutors bringing these cases. I think that is looking at the wrong way. If there is a positive part of that polling is that the more compelling question is, do they think he broke the law . And about 60 of americans think he broke the law. The vast majority of democrats do. A majority of independents do, in a significant slice of republicans do. Having said that, he will still probably be the nominee, and then what an extraordinary election that will be as someone facing trial or in the middle of Trial Running for president of the united states. He united stat you make a good point. Theres a new poll that says that 49 say that the charges in georgia are politically motivated. But if all of the indictments and legal issues that trump is facing right now from a non legal perspective, which is the most alarming to you as a threat to the country . I still think that the worst thing that the president ever did involve january six, because that was inciting a violent coup attempt against the united states, and the charges so far i think are the ones that, if i was a top attorney, i would be more nervous about is a single defendant. It is a federal case. There are six coconspirators. I was a criminal offense Defense Attorney for ten years. What is it about coconspirators . They sometimes flip. The georgia case, rico, multiple defendants, they take a very long time. And so i think that that is the one that is the most compelling, that has the most exposure for the former president , and i think it is the worst thing that any president has done in our nations history. You are one of dozens of House Democrats who wants cameras in court for trumps trials. Other any updates if that is going to happen. How critical will it be if it does . Look, obviously my biggest concern is, do the trials take place before November 2024 . But working on the argument that you are making now, the history of our country is filled with trials that got a lot of publicity in one minute or another that turned into circus from lindberg to simpson. But i think a solid judge can handle that. And my bigger concern on violence is the fact that the American Public needs to see this. The Transparency Issue is going to be never have been more critical than it would be in this trial, just because the rule of law and our very democracy is hanging in the balance. And more importantly, it wont allow the president to filter or alter some media outlet or blogger to filter what they are seeing. They can see for themselves. That is very compelling. Its what a jury sees. Its what they can see presented. And finally a judge can control what evidence is submitted and how it is presented, unlike the public while that is donald trump planned. We also want to note that nbc has not match but nor confirmed your reporting, but how did get underway for you . Thanks, alex. I was working on a larger story about the way that abortion bans have impacted Maternal Health generally and states that have banned abortion. So i was specifically looking at Maternal Health deserts. Many of the states are bracing for thousands more babies to be born in the aftermath of these Abortion Restrictions and bans, and i was looking at what kind of existing Maternal Health care was there to care for these new moms in new babies. And as i was calling around to doctors in these Maternity Care deserts and these abortion bans states, i reached doctor erika who is the doctor in the story, and i was talking with her about this and she mentioned this patient that she had, and i asked if i could speak to her, and she said let me talk to the family, and so she talked to the mom, she talked to ashley and then she put us in touch, and so that is how i found her. And so she went on record with you. Why was a 13yearold girl unable to get abortion and mississippi or elsewhere . So ashley interim other, they realize she was pregnant only when she was about ten or 11 weeks along. Ashley had not realized she was pregnant in the aftermath of the rape partly because she had not yet The Facts Of Life have not yet been explained to her. Her mother told me that she had not yet to expose blame to her how babies were made. So she went to the Emergency Room about ten or 11 weeks later, very sick, and she was throwing up. They realize that she was pregnant. Shortly afterwards, they inquired with Doctor Balthrop about an abortion. Doctor balthrop told them that the closest abortion was in chicago. That was not a feasible trip for this family. The mother, whose pseudonym is regina in the story, told me that she did not have the funds to get there. I mean, it would be a ninehour trip each way. They would have to pay for food, gas, a place to stay. The procedure itself and as i found as i reported the story, mississippi does have exceptions for victims of rape, but obtaining a abortion, sorry, obtaining an exception for abortion is very, very difficult. I called three different State Agencies to try to inquire about the process for getting a Rape Exemption and mississippi, and none of them replied to me. Theres no clear process for actually getting exception. And then of course there is the fact that this mother did not know that the Mississippi Abortion Ban had exception for rape. Lets talk about the Police Investigation into ashleys rape, which i want to note, it is the town of clarksdale. The police have confirmed a Time Magazine, confirmed to you that investigation, or at least a report was filed, but what is the status of the investigation . Where is it now . So i want to clarify that my latest update since the story came out come from regina, the mother. So this is the latest update according to her, but according to this family, and as i confirmed with the Clarksdale Police department, they did file a Police Report when actually told her mother she was raped, which was many weeks afterwards. So a Police Report was filed. However, this family was told that the investigation could not seriously move forward without dna evidence, and that they could not get dna evidence until the baby was born. So they have essentially been in limbo throughout this pregnancy with this alleged rapist not arrested still out there, and that is something that has been terrifying for ashley. When the baby was born, they notified the police and the family told me that even a couple of days later, the police still had not picked up this dna sample that they said that they needed in order to move the investigation forward. It was only after i call the Police Department said hey, why havent you picked up this dna sample, then the next day i went there and they said oh, we just picked it up. And so the latest ive heard from regina is that the police, since the story come out, have come to get a dna sample from ashley, which suggests that they are in the process of testing it since they need to do that for the test. And so it sounds like there is a little bit of movement on the investigation. A little bit of movement on th okay. I know you are going to stay on top of this. This is a story that, my heart is been pounding as ive been talking with you about it, and reading it, there were a few tears i shed. It is compelling, it is extraordinary.
