Its hard to believe its been only a month since all of that. We came this close to losing our democracy with that insurrection. Absolutely. But what a month it has been. And three weeks in a row, we had insurrection, we had inauguration yep. Whats the third one . Impeachment. Impeachment. There it is. All right, we have a ton to get to this morning. We have a team of reporters and analysts following the latest right now. Yes, we do. Were going to begin with msnbc correspondent mike memoli, whos in delaware with more on President Bidens latest comment. Nbc White House Correspondent monica alba is also standing by in West Palm Beach with the latest on trumps impeachment strategy. And msnbcs Marianna Sotomayor is on capitol hill with the Marjorie Taylor greene fallout. Mike, good morning to you. Lets kick things off with you, because President Biden says hes worried about what could happen if trump were to convince or continue to receive intel briefings. Reporter yeah, kendis. Well, first of all, welcome from delaware, once again. We thought we had put this in the Rearview Mirror when President Biden was inaugurated, but here we are, back already, as the president is going to be spending this Super Bowl Weekend here with family at home in delaware, had his first ride on Air Force One last night. But making some news in that traditional president ial halftime interview that he taped yesterday at the white house with cbs, saying that he would, indeed, seek to bar President Trump from receiving intel, as is customary for former president s. Now, this is significant, because we know the white house had said during the week that they were reviewing this question. Weve seen a number of members of capitol hill calling for this step to be taken. Adam schiff, the chairman of the house intelligence committee, saying earlier this week that President Trump has shown that he cannot be trusted and that he would abuse this intel for his own personal gain. But biden in this interview saying, what value would there be in President Trump continuing to receive this intel, other than the possibility he could slip and lose something pertinent. There is a question kendis and lindsey, about how much of a consumer President Trump was of this intel while president of the united states. We know from those who had briefed the president , our own reporting over the years, that he wasnt necessarily paying close attention, wasnt consuming this in the depth that president s typically do. We know that President Biden, for instance, has returned to receiving this president ial Daily Briefing on a daily basis yet again, but theres particular concern about President Trump, given the fact that he has a number of overseas business dealings. One of the ways in which former president s typically receive intel is when they travel overseas, conducting any foreign diplomacy on their own as former president s. And so, that would be directly relevant to the kind of intel that President Trump might benefit from as he continues to pursue potentially his own Business Developments as a post president. Whats also significant about this, guys, of course, weve seen the lengths to which the white house and President Biden has tried to avoid thorny questions involving his predecessor, avoiding weighing in on impeachment. So this was rather striky to see the president weighing in so forcefully on this question. Mike, weve been trying to get kenzie to happen for a while now, so you can call any time you want. Monica, trumps Impeachment Team is hinting they have new plans for the defense. What are they talking about here . Reporter well, a few more details and offering insight into a trial thats set to take place on tuesday, but that we have very little guidance on in terms of how its actually going to work, what the length is, whether House Democrats and those Impeachment Managers are going to call any more witnesses. Obviously, this week, a major question was whether former President Trump would comply with a request to testify. We now know from his legal team he has no intention of doing that. And Something Else that was under consideration was he was possibly going to do a Written Letter and submit that as part of his defense. Were now told thats not on the table either. But now were hearing from one of the former president s lawyers, bruce castor last night on fox news, who was asked how much he plans to rely on videos and interviews from last summers unrest in washington, d. C. , to try to bolster their case. Theyre going to try to make the argument that other people, when there have been protests, have also maybe possibly contributed. Theyre going to try to say that on january 6th, even though at the time, then President Trump did appear at what they called the stop the steal rally and encouraged his supporters to go to the capitol and, quote, fight, that that is protected by his First Amendment rights, and thats how theyre going to try to push back on, of course, the charge that donald trump has already been impeached by, which is that incitement of insurrection. Were getting a couple more details, though, about how this may work, in terms of the former president s defense team. Bruce castor and david schoen are the two attorneys we know who are on board, but theyve now told our team there will be a third lawyer whos going to be joining them, will be part of presenting that defense next week. So we know the trial kicks off on tuesday. Maybe questions, though, about whether its going to last a week or less. Last impeachment, it lasted almost three weeks, and just by comparison, at the time, the sitting president , donald trump, had ten lawyers defending him. Right now you have a much, much smaller group, kendis and lindsey. But we do expect democrats to continually potentially ask for more things over the next few days, so well have better insight on their response to the defense team soon here. Quite a Defense Strategy there. Marianna, what is Margery Taylor green now saying that her role is in the future of the Republican Party . Reporter well, kendis, she very much wants to push it even more right and make sure that it becomes the party of trump. She says that now that she really has no time to commit to the committees, given that they were stripped away from her last just a couple of days ago, she now has all the time in the world to be able to talk to even more republicans, especially trump supporters, to really firm up that base. She has said that she now, even besides Holding Republicans accountable and doing her job that she was elected to do, like voting for conservative principles, she can now either go on radio, go on tv, Travel The Country more to make sure that those America First policies, as she put it, will very much remain part of the Republican Party. She, of course, expressing skepticism for those who voted against her, and in the past, already expressing some skepticism for that part of the Republican Party that voted to impeach president donald trump. Former president donald trump. And even though she said she was sorry, she did say that she not necessarily regrets but is looking back at the comments that she made, and its something that she may not continue to do in the future. We will see if that continues. Even so, she has already begun to use the way and continue to use the way that trump has attacked his opponents. Even yesterday during that Press Conference, she talked about congresswoman ocasiocortez, who recounted what happened to her about a month ago. She said that shes just stealing the limelight and is using just another hoax. So, even though we may not hear those antisemitic, racist, and qanon conspiracy theories, we will very much hear the way that both trump and she in the past have attacked democrats and others as well. Also in some of her first remarks on the floor in regard to this controversy, she didnt necessarily take responsibility for it. She said, i was allowed to believe these things. Marianna, quickly, before we let you all go, lets talk covid relief. Whats the latest on that . Reporter well, now, as you guys know, the Senate Impeachment trial is going to start on tuesday, really making sure that all of the focus remains on that, at least for a week. So, democrats, both in the house and senate this past week, tried to make sure they could move forward on a number of crucial policies to get the ball really rolling to passing that 1. 9 trillion Stimulus Bill that biden has proposed. Of course, democrats really want to go on this alone, and thats exactly what they voted for, this Budget Resolution which would allow them to pass any bill that comes to be without any republican support. But as you know, biden is a compromiser and he has been Hearing Republicans out. And i want you to take a listen to what he said in his mostrecent interview that was released yesterday, where he started to show a bit of compromise on where exactly he would reach republicans. Take a list wren. Look, no one should work 40 hours a week and live below the poverty wage. And if youre making less than 15 an hour, youre living below the poverty wage. But that may not be in your American Rescue plan no. I put it in, but i dont think its going to survive. Reporter so, you hear him there basically saying that that 15 minimum wage is likely not going to be part of this bill. But the one thing he wont budge on is the 1,400 direct payments to americans. However, he says he is willing to hear republicans out on how to make sure targeting those americans who are less fortunate receive that money. Guys . That is a development, indeed. Yeah, lets dig deeper into this with former florida congressman and msnbc contributor david jolly and errin haines, editor at large at the 19th. Thank you for joining us this morning. David, lets get your reaction first to President Biden saying trump should probably not have access to classified briefings, which previous president s have had access to. Look, i think joe bidens absolutely correct. We know that the exposure that donald trump apparently had, that he refused to disprove, if you will, in terms of his financial debt and obligations to foreign actors, remains, even though he has left office, and we know the behavior that led to his being impeached now twice by the house has not been curtailed, whatsoever. And i think the critical piece is this. When joe biden says, what would he use it for . You know, sometimes, former president s have access to that information so they can serve as a bit of a Kitchen Cabinet in critical moments of National Security or Economic Security to the sitting president. That clearly would not be the case in this situation, and i think what joe biden has said is the risk is greater than the reward, and i believe the president s right to restrict Donald Trumps access to intelligence now that hes out of office. And errin, im trying to wrap my head around all this, because one of trumps Impeachment Lawyers alluded to using what he calls democrats lack of reaction to protests over last summer as a line of defense. What are they trying to accomplish . Well, kendis, i think that what youre seeing here is the continued kind of False Equivalency between protesters on the left who have been overwhelmingly peaceful over the National Reckoning on race that we saw last summer, but the president and republicans really wanting to highlight some of the looting and rioting that happened last summer, which was not the overwhelming majority of that activity, and wanting to equate that with the violence, the deadly violence that we saw at the capitol or even the deadly violence that we saw in charlottesville in 2017, when the president said that there were fine people on both sides but also condemning or trying to condemn, you know, what he called the alt left at that time. But you know, these things are not equivalent. I dont think that that is really where the majority of americans are on, you know, the White Supremacists that we saw storming the capitol a month ago this week. And i think that democrats are not they have been rejecting, you know, that kind of False Equivalency that the president and republicans have continued to kind of push, trying to equate black lives matter protesters with these White Supremacists and others who have, you know, acted on these false claims of a rigged election. You know, errin, lets talk about the Republican Party for a second, because weve seen a lot of division there lately this week, particularly with Marjorie Taylor greene. Your colleague at the 19th wrote about this, asking whether the Republican Party is big enough for everybody, big enough for liz cheney and the Marjorie Taylor greenes here. Whats your take . Mccarthy told reporters that the tent is big enough. Should it be . Well, thank you, lindsey, for mentioning Amanda Beckers reporting over at 19thnews. Org, which i encourage everybody to read. Listen, i think that that is an open question for the Republican Party. These two republican women who have been in the spotlight this week i think say a lot about the future of the Republican Party and what that is going to be, if it is going to indeed be the party of former President Trump or if more Establishment Republicans are trying to chart a new course now that President Trump is out of office. But at the Press Conference that she gave yesterday, congresswoman taylor greene, from my home state of georgia, said you know, my district is thrilled with me. And in fact, you know, voters who did know a lot about her views and her qanon Association Last year did vote her into office. The former president also continues to express his support for her. So you know, what will voters say when they have an opportunity to weigh in on her next . And if those are no longer her views, i guess well have more of a chance to see what, you know, her views are. She said she plans to vote very conservatively. All right. I have to leave it there. A New York Times review found at least 22 of those charged are current or former Military Members, and at least 21 had possible ties to militias or militant groups. And more than a dozen, allegedly, supported Conspiracy Theory group qanon. Joining me right now is margaret hwang, ceo of the Southern Poverty Law Center which has been tracking these Extremist Groups for several decades so far. Thank you for being here. Appreciate you being here so early in the morning. We have these conspiracies and Militia Groups that had such a deep influence, specifically on people with military experience. Whats the deal . Thanks, kendis. Its great to be with you this morning. The Southern Poverty Law Center actually first reached out to the Department Of Defense about the radicalization of Military Members in 1986. We sent a letter to Secretary Weinberger and asked him to investigate this radicalization. So, secretary austins recent announcement of a standdown is a very welcome step, overdue, but very welcome. Its important that the u. S. Military be responsible for looking internally to investigate and to expose these kinds of connections and to make sure that they are not present in our armed forces. Yeah, kind of fascinating to think about, that youve been dealing with this since weinberger so many years ago. Lets talk more about the proud boys, because recently classified as a Terrorist Organization in canada. Did this move surprise you . And should the u. S. Follow suit . Actually, the Southern Poverty Law Center strongly opposes the creation of any new federal criminal domestic terrorism statute or any listing of domestic organizations as terrorists, and thats for a couple of reasons. First is, our government already has all of the authority and all of the powers it needs to investigate violence and antigovernment actions like the ones we saw on january 6th. But secondly, every time in our history when weve seen the government try to create additional federal powers for prosecuting terrorist groups, its ended up being used against communities of color, and particularly against black activists. We dont need to keep targeting communities of color in this country in the name of National Security. Heres a frightening thing about all this, you have the New York Times reporting in meantime that you had 11 people who are at least facing charges and had possible ties to the proud boys. Weve come to know this group. One leader recently arrested declared that they were in a war. Your organization has repeatedly warned about this particular group. Why has nothing been done more, at least, about them, up until this point . I think part of the challenge is that the proud boys are actually located all across the country. They dont have a headquarters. Its not easy to track them or to determine all of the ways in which they might be taking action. And it requires a level of coordination and collaboration between both federal authorities and state and local authorities. We havent seen that kind of investment. Fortunately, President Biden is now talking about interagency collaboration and federal and local and state collaboration in ways we havent seen before, and we hope this will lead to much more effective investigation and prosecution of groups like the proud boys. Yes. It is a mindset, not necessarily one of those movement sort of things that you can necessarily target buildingwise. Margaret, thank you so much, from the splc. Thanks. There was a bizarre incident that now has the air force reviewing its Security Protocols at Joint Base Andrews in maryland. Just one day before President Joe Biden flew out of there on his first trip on Air Force One, a man somehow got past security and made his way onto a plane reserved for top officials and commanders. That intruder was detained and charged with trespassing. All right, time to pay up. The Republican House of representatives Louie Gohmert and andrew clyde fined 5,000 each for bypassing newly installed Metal Detectors as they entered the house floor. Earlier this week, congress voted to mandate fines for any member who refuses to abide by the new Security Protocols. Theyre the first to receive the fines. If they do it again, its 10,000 for the second offense. And it has been 50 years since astronauts alan shepard, Stewart Reducea and Edgar Mitchell successfully touched down on the moon. Johnson johnson is requesting Emergency Use Authorization from the fda for their covid19 vaccine. The Company Released data showing its 72 effective in the u. And the nfl is telling President Biden its offering up all of its 30 football stadiums for mass vaccination sites. Currently, seven nfl teams are Hosting Vaccinations at or near their stadiums. The Defense Department is deploying 1,000 troops to help deliver vaccines across the country. Some will arrive in california in the next ten days with other states to follow. The pentagon is also weighing a request for up to 10,000 additional troops to assist with the rollout. And the Supreme Court ruling that houses of worship in california can now hold Indoor Services at 25 capacity. It is a victory for groups that have been fighting States Coronavirus restrictions. Now to new york and Yankee Stadium opening up as a Vaccine Megasite, hopefully getting more shots into the arms of people there in one of the hardest hit neighborhoods. The bronxs covid rate is at 5. 5 . They have the highest death rate of any other borough in new york city. They dont have appointments yet, but theyve shown up here anyway, just like a lot of people did yesterday. The reality is that weve known during this pandemic that lowincome communities and black and brown communities, black and latino communities have been disproportionately impacted by this pandemic. Thats part of the reason this mega site is opening for vaccinations now that the vaccine is rolling out. This site here at Yankee Stadium is for folks who are eligible for the vaccination right now and live here in the bronx, bronx residents only. As you mentioned, the reality here is that there are lots of people who live in this community who have not been able to get access to vaccines or have not had the right information to be able to get access to vaccines. This borough is largely black and hispanic and has the highest covid19 Positivity Rate of the five boroughs. So the city and the state are working with a group called somos to run this vaccination site, running it along with the national guard. Hundreds of people showed up here yesterday waiting to get their vaccinations, and we expect that there will be hundreds more that will show up here again today. Part of the process for them is going to be getting to the somos doctors, who said that this venue, in particular, is such a recognizable place that folks who live in this community will come here if theyve been reluctant in the past to go farther out and get vaccines. And i want you to hear from one of the leaders here who also talked to us about the reality of working with doctors, Health Care Providers that have built a reputation in this community and they feel like they will be able to help save lives. Were here to initiate a new model of vaccinating people where we come to them, where we inhabit places that they trust, places that theyre willing to go to, delivered by the Primary Care Physicians who have been vaccinating their children and their families for their whole lives. I think, you know, in all of the discussions of the Vaccination Model around the country, nobodys been talking about the Primary Care Physicians and the Important Role that they play. Reporter now, theyve opened up 15,000 appointments for this Yankee Stadium mega vaccination site. We got an update last night that there were still many Appointment Slots open for this first week. A recent seton hall sports poll found one in four Americans Still plan to attend a super bowl party, despite concerns about these more Transmissible Coronavirus strains. Joining us right now is dr. Ali raha, an emergency physician at mass General Hospital in boston. Doctor, thank you so much for being with us. We saw what happened after the holidays. We saw the surge in cases, the surge in hospitalizations. January, if we take a look at this graphic, was the deadliest month on record in a pandemic. More than 96,000 deaths in the u. S. What are your concerns right now about super bowl parties . I mean, can a single day change the course of where we are right now . It absolutely can, lindsey. Heres the thing, we saw this after new years. New years night was one night. And yet, we know people went out and had parties on new years. Im really concerned, and all of the doctors and nurses im working with are concerned about what were going to see over the next couple weeks after these super bowl parties. One in four americans . The thing is, watch the game, but do it with your friends virtually. Jump on to a skype or a zoom. Watch the game, cheer for your team, but dont get together for these parties. Yeah, i mean, you think about the other holidays and the advice that we heard, and that was, have a designated person to dole out the food, try and keep everything outside, if you can. I mean, when you think of the super bowl, you think of Everybody Sharing Dips and sharing communal food. I mean, is this potentially even more of a worry, other than new years . It really is. Look, im from texas. I love football. I live in boston. We had tom brady and the pats in every super bowl that i can remember. I know. I love [ laughter ] i get it, i get it. But we still have tom brady. But heres the thing, the super bowls so very different. Its kind of like thanksgiving in that everybodys right in front of the tv, everybodys together. Youre all eating. Were all drinking. Nobody you cant eat and drink with masks. The whole thing about the super bowl is being close together and eating and drinking, and that is exactly how we see Covid Superspreader events happen. Lets talk about the Johnson Johnson vaccine. Theyre applying for Emergency Use Authorization and their vaccine only requires one dose. That is a game changer. And the fda says its Vaccine Advisory Panel will meet february 26th. We likely wont see shots in arms until march. I realize that scientists have to pore over all this complex data, but doesnt it feel like i mean, lives are on the line here, time is of the essence. Is there any way to make this go even faster . Lindsey, i hear you, and i think im on the same page. I would love to see this go faster. The problem is that right now, especially in black and brown communities, we have so much distrust and we see so much distrust of these vaccines that if we speed through and rush through the process and make it seem as though we didnt review things, and over the next few weeks there is going to be such an intense review, not just of the clinical data, but also the manufacturing data, that we have to go through the process correctly if were going to get people to trust this vaccine. With the Senate Impeachment trial set to get under way in just three days, were learning more about Donald Trumps game plan. His attorney, bruce castor, suggesting that they will use video of congresswoman Maxine Waters and other democrats comments on last summers protests. Will you then respond with the Maxine Waters, with a number of other Democrat Officials not speaking out against the antifa and other extremist rallies over last summer . I think you can count on that. If my eyes look a little red to the viewers, its because ive been looking at a lot of video. Their brief also lays out their argument that its unconstitutional to convict a president whos no longer in office and that he was just exercising his First Amendment right in questioning the election results. But they apparently will not focus on those false voter fraud claims. Meantime, democrats are laying out their strategies, saying theyre going to focus on trumps messaging following the election, of course, his comments during that january 6th rally in which he urged his followers to, quote, fight like hell. Theyll also invoke rioters claims that they acted on trumps behalf. Joining us right now is msnbc legal analyst danny cevallos. Danny, im so keen to hear your thoughts on this. The fact that the president is now a private citizen, is that a proper defense . It could be, but the reality is, the senate appears to be willing to listen to an impeachment of a former official. The impeachment power dates back centuries. And although we havent really had this issue come up more than a couple times in our own history, even at the time the framers wrote the impeachment clause into the constitution, there was a huge, newsworthy impeachment going on of a former official in great britain. The framers surely knew about that. Weve had two almost instances of impeachment and conviction in our american history, of someone after theyve left that particular office. So, it seems that it can go forward. But precedent in impeachment is not the same as precedent in court. Its ultimately whatever todays senate wants to do by a majority or supermajority vote. Danny, im curious about this, because you have bruce castor, the president s new lawyer, whos arguing that trump is not at fault for the people who reacted to his january 6th speech with violence. Do you get a sense that the democrats will be able to build their case around trumps comments . I think they will. I think theyre going to make that a centerpiece. But the thing that we have to keep in mind is that the First Amendment analysis is a little different for a president facing impeachment. It is true that we dont define the lawfulness of speech by the reaction of the nud nicks or the audience that may be listening to it. Thats called a hecklers veto. You have to look at the speech, itself, and the context, to decide whether or not its lawful. So, that part is true. However, theres a lot of support for the idea that the president can be impeached for speech that may not be prosecutable or even speech that he could be sued for. And the reason, or an example of that, would be something like, if the president decided he was entering into negotiations, if President Biden started talking about Delaware Seceding from the union, he could do that. He has a First Amendment union. He probably couldnt be prosecuted or sued for it but congress or the rest of america might be alarmed and they might move, immediately, to impeach him for speech that isnt unlawful under the First Amendment but impeachable. And and in the meantime, we also learned that trump will not testify. The the leadimpeachment manager, representative jamie raskin, was warning that this could be used against him. How much could trumps absence, actually, hurt him, in this case next week . Jamie raskin is using a great bit of constitutional jujitsu here. They did not issue a subpoena. They just requested or invited him to come testify. President trump declined. This is not a subpoena situation. But, you know, in our paralleljudicial courts, we have a principle. In criminal cases, only, that the prosecution and the judge cannot comment on an accused silence at at at a criminal trial. But in civil cases, that comment or that inference, that negative inference from a defendants silence, is allowed. And then, beyond that, the the president or former president isnt even being compelled to come speak or testify, at this impeachment. And the reality is, whereas in judicial court, we have centuries of case law and bound volumes of books like the ones behind me telling todays courts what to do. The senate is bound by none of that. They are bound by whatever the head count is of their votes in todays senate. History, in the senate, is only interesting. Its not binding. Constitutional jujitsu. If you didnt have a memory title, yet, danny. Now, we do. Danny, real quick, before we let you go, how long can we actually expect this trial to go on . Its interesting, there isnt really any rule for length of Impeachment Trial because president s and other impeached officials dont really have procedural due process right, the way criminals defendants or even people in civil cases in court do. In theory, if the senate wanted to, they could wrap everything up in a day but its up to them to decide their own, procedural rules. The president simply doesnt have the same procedural protections that other citizens would have in a normal, article 3 court. Danny cevallos, so good to see you this morning, thank you. The city of tampa and the nfl, this morning, facing a Monumental Task of trying to host one of the Largest Sporting events of the world. While in the midst of this pandemic. Hes required masks, at indoor and outdoor venues. They are asking folks who are celebrating here, in tampa, to take their masks off to eat and drink when they are at bars and restaurants, and put it right back on, again. Thats the guidelines. Will that become reality, is another question. Outdoors, folks also have to be wearing their masks when they are downtown, anywhere in the tampa area, or anywhere near superbowlrelated events. You see Raymond James stadium over my shoulder. There is going to be about 25,000 people there tomorrow. That is wellbelow the 50 capacity for the stadium. There are signs everywhere you look, guys, basically, plastered all over the place talking about keeping six feet of distance between people and wearing masks. The nfls put it everywhere. And just to get where i am right now, i had to fill out something called a policy path. I am showing you on the screen right now. Essentially, acknowledging, every single day, every 24 hours i have to fill this out. That i have not tested positive for covid19. That i have no symptoms, and then, i got to get a temperature check. And at that point, i can walk out here onto the risers. I can take my mask off, if i would like to. If i choose not to, as i am today, i can leave it on but those are the protocols in place. We spoke with some fans in Downtown Tampa about whether they think this is all going to work. I think they are taking proper precautions. They are spacing everybody out. I think the people that the medical staff theyre allowing in. They are going to be vaccinated, already. So, i think, they are taking proper steps. Do you think that this is going to be, like, a safe environment, everyone is outside . Obviously, you have absolutely not. Its its not safe right now. Absolutely not. Do you sense the fact no. If you havent had covid, youre getting it this weekend, 100 . You, obviously, heard them laughing when i asked the question about whether or not its going to be safe. One of those gentleman told me, look, its on the individuals, its not on the city to make sure theyre acting responsibly. One other note, lindsey and kendis, everybody attending tomorrows game is getting a safety kit that is going to include hand sanitizer, a kn95 mask, and bacterial wipes as well. You mentioned some 20,000 but the nfl is giving some hardworking healthcare workers tickets, as well. Thats absolutely right, kendis. There is going to be 24,500 or 25,000 people, in total. 7,500 of them are going to be frontline healthcare workers. I spoke with one of them, last night. A chaplain from new york who has been comforting Covid Patients and their families. Hundreds of them for months. And he was talking to me about how important this is. He is going to be one of 80 people that patriots owner, robert craft, is taking to the game. Now, its going to be 79 people from boston and him. His name is rocky walker and he said, look, i feel like i am representing the millions of people across the country, this morning, who have put their lives on the line every single day. That is who we are. That is what we do. And he is so humbled and proud to be part of that process.
