Reporter last week the city of louisville agreed to pay 12 million to Breonna Taylors are family to settle a wrongful death lawsuit. Joining us now to talk more about this is our legal analyst, Michael Cardo stay. First your reaction to those charges against that one officer for quote wanton encager independent the first degree because he blindly fired into the airport. First of all, that grand jury indictment makes perfect sense. But lets take a step back, frank. Grand juries are people from the community that come in from all walks of life. They are usually anywhere from 19 to 23 jurors. They have listened to all of the facts. Probably unlike a lot of the protesters, they dont know everything. The grand jury heard what happened. What happened in this case breonnas boyfriend, the alleged drug dealer, was already in jail. The police then went to a judge or a magistrate time judge and asked for a warrant. Maybe we should be looking at why the judge issued that warrant. Not only did he issue the warrant for possible drugs in breonnas apartment, but issued it for nighttime service. That begs the question why did it have to be served at night . The drug dealer was already in jail. Then on top of that, its my understanding, it was issued with a noknock notice provision, and that means the police just crash into the apartment. But the officers involved said we didnt do that. We knocked, we yelled police a number of times. The man inside that did the shooting that was with breonna said i did not hear the police say that. But there was an independent third person outside of that apartment that heard the police knock and announce. Now, it might be both of those people are right. Maybe the man inside did not hear. But now the police come crashing in. That man had to make a decision. Are these police, just by look at them. Am i being robbed . Whats going on . He decided to shoot. That is sort of a twist on what Police Officers do every day in make splitsecond decisions. So he shoots. He shoots one of the officers in the leg, the femoral artery, which bleeds out very quickly. So certainly their life is in take person they pin to shoot back, breonna gets killed. Grand jury said those two are not responsible. But i ask, well, why dont we look at the superiors that made the decision to go to that judge to ask for a warrant, and for a nighttime washington, and nothing good happens during nighttime service of search warrants, and why did they ask for a noknock and notice. . Well, michael, youre asking that question, and let me ask you, why . I do get going at night, because obviously you wasnt to go into a building when hopefully people are asleep, not necessarily during the day, the thought is that its safer if you surprise them while they they are asleep, but what would your answer, to those questions be . Billion well, i dont think it is safer, frank, because most of the search warrants where bad things happen, where people are shot, and i know there was a case in los angeles, where there was a fortune 500 man that it was in his house, police go the wrong house, shoot and almost kill him. He sue wins a huge lawsuit gains them. Those are for emergency type circumstances, those nighttime warrants, and thats why i prefaced this by saying the drug dealer was her boyfriend, but hes in jail. All theyre doing is looking for more drugs. What is the importance of going in at night . Yeah, theyre sleeping, but lets put it all on ourselves in that situation. You are groggy, dont know what is going on. If youre arm you could grab a gun. You have to make a decision. Pop are yelling police, police. How do you know they are police . How do you know that theyre not there to rob you . And i say switch that now with Police Officers on the street and maybe people will better understand the quick decisions that they have to make. Go ahead, frank. Actually, i apologize, we have to leave it there. Theres so much to talk about. Hopefully we can have you back soon, because, again, its such a crucial issue right now in american history, this whole idea of police, police reform, and Police Shooting minorities, so hopefully we can have you back soon. That should be reformed. I agree with that. All right, michael, thank you. Now to the latest on the coronavirus. There are now more than 787,000 cases of covid19 here in california. A new study from Stanford University researchers finds that such unhealthy air is fatal and is predicted to kill 1200 a cans. I dont think its a stretch. That is based on decades of research that shows how exposure to dirty air including wildfires smoke affects peoples health. Reporter he found exposure to the particulates found in wildfire smoke can exacerbate patients Current Health problems, leading to death. Fires near forbes town. So that has created some smoke. We have fires down here in the southern central sierra nevada, and thats adding smoke to these areas. But most of us not bad, right . Way better than it has been. And its going to stay that way for a couple of days. The general winds we talked about are coming in the right direction, onshore. We call that a westerly breeze, going from west to east. Thats what were seeing out there now. It looks like fog. And today is foul for shore. Amazing how when that sun age changes a little bit, you can see fall in the air. You can also see smoke in the air. As you look out in the distance, thats that line of smoke. I was looking a submit of the visible maps this morning within just checking out the different satellite imagery, just to see where the smoke was, and its amazing how much of that smoke, especially down around bakersfield, has just settled into those valleys and does not want to get flushed out. So there is still residual smoke from what weve been experiencing. But for us, we have some great air quality. You saw toms story about air quality. Ive always said this on the west coast of northern california, we are, for any urban center, we have some of the best air quality in the world, because we have 3,000 or 4,000 miles of bright blue passive tick wash the air as it comes off the asian continent, so we value good air quality. So we notice it whennist bad. And it was bad, and we noticed it, but were fortunate. You know, atlanta, dallas, chicago. A lowhen they get into somary quality issues, it is life or death. You can assign a number to how many people it takes out. I want to go back to school [ laughter ] rob roth, ktvu fox 2 news. Looking at the weather. The air quality just much better last couple of days. Yesterday was pretty nice, too. Today we were all in the green in terms of air quality, which was very good, which is not unusual for San Francisco. As i mentioned, we have great air quality around here typically, and today is another one of those days. You can see in the distance, there are fires up in butte county, and a couple of fires, one near forbes town. Still smoke lingering down around bear valley and south, a couple of fires burning. So you see the smoke in that inland by a valley, but with our nice little onshore breeze flushing every out, we are in really good shape air quality wise, and we will stay that way for a little while, at least until, oh, saturday, i think saturday our quality will start to deteriorate a little bit, as the winds turn northerly, especially in the afternoon, but this system here, thats the setup. Thats why the smoke is clearing. I mean, its just flushing everything out. Its an air mass change inspect the summer or the last three weeks, weve had this air mass stuck over us maybe the last four weeks, and now this other air mass coming off the pacific is pushing over, and so what youre seeing is a complete air mass changeover, which is great. Is that sets us up with a mild pattern, which brings rain to the pacific northwest, and, oh, by the way, theyve been having fires as well. So with that rain, theyre getting an opportunity to grab a handle on their not only smoke, but also active fires. So the rain in the pacific north, northwest, kind of a hear binnier as we bet is into fall now and those systems start coming closer to us. So hopefully well be seeing some rain soon. Temperatures about where they were yesterday, except little warmer in some areas. Sf0 was 7 degrees warmer. This low will keep fire danger down, but then on saturday and sunday, into monday, fire danger elevates, because the low has to leave. It doesnt have to, but its going to, and when it leaves, the High Pressure jumps in. We talked about 245 a bunch last night. So tomorrow nice day, like today. Friday a nice a little bit warmer. Saturday not bad, and saturday afternoon, sunday, youll notice the temperatures really start to warm up quite a bit. And so with that, with a shift to the northerly winds, too, you can expect the air quality to deteriorate a little bit. But overall a pretty nice little pattern, and with that fire weather watch in effect, its nothing unusual, its very typical for this time of year. So dont fret like its some extraordinary event. Its previously what we see every year about this time, and hopefully nothing will happen. The winds will stay down below 25 miles an hour. Ill see you back here and well update the forecast.
