The police chief says the man killed was in his 20s and a person of interest in a homicide case. I woke up, i couldnt talk and my chest was on fire. My moms i go to the hospital, i went to the hospital right away. There like yeah, you have it. Reporter butlers diagnosed her with mild symptoms of covid 19 and told her to self quarantine and march. She notified her landlord, peggy montgomery, and asked her not to enter or rent the room next to her for everyones safety. She offered money if i believe the next day. Reporter sick and with nowhere to go, butler continued to quarantine when she said montgomerys actions became more erratic, even prompting butler to call police several times. Then butler recorded this video showing montgomery trying to break into the room through the window. She says its not the first time either. The oakland City Attorney stepped in, writing a letter ordering the landlord to cease the unlawful conduct. Still, things escalated. She came downstairs, banged on the door. Your quarantines over, and kicking you out of your aunt at the doorknob off the door. And started banging it on the door. Reporter this is really outrageous behavior by the landlord. In this case its the landlord taking the law in their own hands. Butler recovered and hired an attorney. Montgomery declined an interview, but emailed us to sign the allegations. We are seeing this time and time again, landlords are panicking about this virus, they are panicking about not being able to collect rent, panicking about tenants breaking leases and panicking about tenants who are sick. Tenants rights attorney joseph foreigner also representing ross bocker began renting a room in the san jose room four months ago. You guys seem to be nice people and they said yeah, same for us also. She accused him of violating the safer at home order by thinking a drive, that he was putting her life in jeopardy. I told them you cant do that. Its illegal. They are like we can do whatever we want. I said if you guys do that, that i have to call the cops. Reporter police came and try to resolve the situation, but he says she refused to let him back in. Shes that im okay to give them the rent every month and also im going to pay them to deposit. And i told them that i dont need money, i need shelter. Reporter we called the landlord, she said she didnt trust him, which she believes gave her the right to an immediate eviction and she gave him a refund. And the eviction defense and oakland has been flooded with calls from worried tenants facing situations like this. She reminds them they are protected by eviction moratoriums. I do believe the moratoriums are clear that there cant be any eviction activity during this time unless its like a lifethreatening situation where you have a tenant who is really doing something to threaten the health and safety is of others on the property.
