San jose state Officials Say an investigation is underway into what is described as racism and antiimmigrant flyers and they were placed on campus. A nonprofit with links to White Nationalism is now claiming responsibility. Ktvus south bay reporter, jesse gary joins us live from the san jose state campus with the latest on the still developing story. Jesse . Reporter alex, eliana, good afternoon to you. The flyers were found 12 days ago and University Police began an investigation immediately. Students were not toldthen because the campus was closed but that is different now. Today, the first day of the fall semester, students were notified though before they came to campus yesterday by email. It really does cause alarm because like you said, there is so much hate going on these days that you are always on your feet, always on your toes because you are scared Something Big is going to happen. Reporter fall semester, 2019 got off to an uneasy start after all 36,000 san jose state students were told that hate material was distributed on campus. We are a campus that wants to stay engaged rather than brushing them under the table. Reporter chief diversity otter officer dr. Kathleen liles says she found flyers on campus. August 12, more than a week before the semester started. The flyers are from the American Identity Movement which called himself a nonprofit activist fraternal organization. Campus Officials Say it has links to the White Nationalist movement and other campuses across the country also had similar flyers distributed on the grounds. Im not sure but that definitely shocks me right now. Reporter the aim home webpage said it is opposed to the demonization the school says they removed the flyers because it violated the schools policy on how information is distributed, not because of the content. We really want to promote what our core values are on our campus rather than promote the messages that are on those flyers. Reporter some students were ride for the first day of instruction wednesday say both the materials message and the action of placing it on an ethnically diverse cancer campus is disturbing. I dont like them. I dont think anybody does. You want to come to school but its kind of hard now. Reporter School Officials stressed the campus is safe and police are still investigating who put the flyers up. They say this is not an effort to squelch free speech but and force existing campus rules. We are live on the san jose state campus this afternoon. Jesse gary, ktvu fox2 news. Write back to you. Immigration policy, looking to end an agreement that limits how long children can be kept in detention and that standards for their care. As foxs Mark Meredith reports, advocates say the chge will harm immigrant families and a legal challenge is likely. The driving factor for th crisis is a weakness in our Legal Framework for immigration. Reporter the department of Homeland Security says its imposing new regulations to make it easier for migrant families to stay longer periods of time. The new rule will reduce the unprecedented volume of families that are extremely straining the resources and put children throughout the region at rest. Reporter President Trump may Border Security a major focus of his administration. The number of migrants arrested to the border recently spiked to a level not seen in a decade. The rule which will need Court Approval changes requirements for Family Detention Centers and remove a 20 day limit on the detention of some children set in 1974 as an agreement. That would allow i. C. E. To to detain families indefinitely. It is completely unnecessary, cruel and one more reason we need to change leadership to pursue Immigration Reform with common sense and compassion in stead of this cruelty that this administration continues to show. According to a 2018 Government Accountability report, immigrations and Customs Enforcement maintains about 3300 family detention beds. The limited space along with the floors will has been met many families how that the portable released into the u. S. Pending a court date. Immigration officials reported a dip in illegal border crossings during President Trumps first year in Austin Office however the right numbers rebounded. Mark meredith, fox news. For more analysis on this we want to bring in a professor with the santa clara law school. Deep, always good to ta with you. The administration is trying to do away with the floors agreement which is Migrant Children cannot be held in detention longer than 20 days. Help everyone understand what will happen if the government is able to do this . The government is going to issue a regulation and the regulation purports to be an interpretation of what is required underneath the floors agreement so the first thing that will happen is advocates are going to sue in front of the same set federal judge or the new regulations will go in front of the same federal judge who has been monitoring the governments complaints with the floors agreement. That would be judge dolly gee who is a federal judge in california. The judge is going to have to make a determination whether or not these regulations, in fact, comply with the boundaries of the floors agreement. Do you think the judge is likely to sign off on these changes that the administration is pushing for . Thus far, several attempts by this administration to separate children, to keep them under certain conditions of confinement have all been rejected by judge g ee in the past. Attends to prolong their detention have been rejected. Underneath the past efforts, the government was purporting to act just underneath the agreement itself where is now they are creating new regulations. That said, the entire basis of the floors agreement is the idea that children should not be jailed and if they hard to be jailed, they should only be jailed for short period of time. This regulation would remove those limits on the court, i think, would be very skeptical. Lets talk about logistics. If the rule change is allowed by the judge, we talked about this over and over, the immigration detention facilities are already overcrowded so if children and families are going to be held be on the 20 day limit that now exists, where is everyone going to be housed . What sort of conditions are they likely to be in . That is a great question. One of the other aspects of the floors agreement is that to the extent children are held, they have to be held in licensed facilities, facilities licensed for the care of children. One of the things that the regulation does is it creates a new licensing scheme, one that i assume would make that type of licensing much easier. The other thing is that the only way to really accommodate the number of people that the government wants to detain would be to increase the number of private beds that is a private forprofit descent Detention Center that would operate under taxpayer money. Before we wrap up, deep, let me ask you about the administrations stance on all of this. Obviously they are saying that if we do away with the florist settlement, get rid of the time limit for holding Migrant Children, this is going to deter other families who are thinking about coming here to the u. S. To seek asylum or make their way here to this country and slow the flow of migrants we have been seeing. Do you think that is likely to be the outcome . Is this going to have a deterrent effect . I think the fundamental problem with the administration starting point is that it starts from a fallacy and misunderstanding, a falsehood and that is that these deterrent strategies can dictate migration flow. The fact is migrants are coming right now from, especially from Central American countries, knowing there is extreme danger, even the risk of death in trying to make that journey and crossing, it is not clear that any type of deterrent enforcement policy will change the decision to come we have to leave the conversation there. Always a pleasure talking to you. That is deep, a professor from santa clara lawsuit school. Thank you. Thank you. It warmed up a little bit today in land, it is a good 10 degrees in many locations. I will show you that coming up. Fog at the coast this morning and then it went away quickly. There is San Francisco with a bonus live shot with no fog at the coast. The tower is clear, the bay is not that windy. That was a live satellite image. That shows you those high clouds coming in. Lets move that and we will see the movement. You will see the fog and maybe you can pick it out underneath it but the white, white deaf in eureka is a weather system sliding through. Fog sometimes stays at the coast and a lot of it has to do with water temperatures. Sea surface temperatures, 59 to 60 degrees. A lack of upwelling, strong winds have created a warmer sea surface and that is one of the things that prohibits fog or makes makes it harder for the fog to form is the warmer sea surface temperatures. Speaking of warmer, it is 13 degrees warmer in the moreno, 60 degrees warmer in santa rosa, 13 degrees warmer so yes, it is warmer today. 96 in fairfield, 92 in concord. High temperatures will be about a little warmer tomorrow. I think we will see some more mid90s so concord may go to 95, livermore may go to 95 tomorrow. The on that, temperatures stay on the warm side inland and mild around the bay. Tomorrow will be a lot like today but slightly warmer. I will see you back here with the fiveday forecast and a little bit. Thanks, bill. So far, no reaction from tesla. Meanwhile tesla shares slid by 1 today after news of the loss of but overall wall street ended the day on the plus side. The dow was up 240 points on strong earnings from target and lowes. The nasdaq was up 71 and the snp was higher by 23 points. For more on the litigation between walmart and tesla, we are joined by professor kelly i know at the leyva school at santa clara university. Thank you for joining us today. My pleasure. Reporter first lets address the big issue. Tesla going into a legal battle with the largest retail giant out there. How significant is this . This is a really significant issue from my point of view. Walmart is a retailer that is very focused on very Cost Effective operations and over the years, now, they have tried to become more environmentally friendly so installing all of these solar panels and going to alternative power is a very important part of their pivot into more costeffective operations and being environmentally friendly so this is, i think, a very significant setback for the company. And tesla has already been facing several litigations from everything from business to personal and also just to give everyone some Background Information on tesla, acquired solar city in 2017 which was a struggling company and in 2017, solar city was forced to pay a 29 million settlement with the u. S. Government over actually accusations they lied to the government about the cost of their solar systems. The company has been sued by its customers for deceptive trade practices. If walmart pulls out of its contract, could this be the end of that Solar Company . Im not sure its going to be the end of the Solar Company but this is a very material issue. And given the size and number of instances where there has been a problem, and if you couple that with the previous issues that the company has had in terms of misleading information, etc. , i think they add up to a bunch of very material issues. You talk about misleading practices, tesla shareholders also twos sued tesla after tesla approved the silver city deal and now they must disclose the what loss of walmarts business with tesla because walmart stopped using the solar panels because of the issues they had. Did tesla withhold this information or have they been transparent about walmarts loss of business . How do you think that is going to play out moving forward . I think the tesla shareholders are really going to ask the question, how much of this is known and how much of this is properly disclosed because as i said, this is very Material Information and at this point, there is a fundamental problem with the product and deeper issues involved so the disclosure around this will be something that people will dig into in the next few weeks. And people including consumers of course, many customers with solar city will be watching this. Do you suspect some class action lawsuits coming as a result of this ongoing lawsuit with walmart . I think this is a rude shock and awakening for consumers. I did a quick check before our interview about how much Consumer Awareness there is about these kind of solar panels, fires and risks involved and by and large, it doesnt seem to be something that consumers know a lot about. As we have seen, if something happens, is a very material incident. You your whole house could burn down. There are a lot of issues around firefighters and how they respond and code issues, etc. So i suspect that consumers are going to become very, very concerned about this and at least want to start educating themselves about the issues related to these solar panels. I am personally looking at a solar Panel Solution for my house and i guarantee you, i will dig really deep into this now before i go down that road. Absolutely. This wont be the end of this battle. We will have to leave the conversation there. Professor galliano with the leavy school of business. We thank you for your time. Thank you. We have a little bit of fog offshore the coast is clear right now, a few high clouds overhead as you see in the life, you dont sea fog in this shot and that is one of the reasons temperatures in land warmed up a little bit. Fog is about 40 miles offshore, maybe closer down towards Half Moon Bay, a few miles offshore, the fog will come back tonight but not like it has been. It will not be like the last couple of days were we had, not today but the days before that, monday and tuesday were we had a lot of fog cover. Look how warm it is compared to yesterday. 13 degrees warmer in livermore, 10 degrees warmer in concord. You see how cool it was yesterday. 13 degrees warmer in livermore and 91 degrees so it has been pretty cool in livermore. Cool in the inland bay village. These temperatures, current temperatures, back to a typical pattern. As you look at the forecast for concord tomorrow, that is what i expect in august, midtolate august like this so that is more typical. We were doing a different deal. These bars here were yellows and light oranges last few days. So theres the golden gate bridge. The fog is not there. Not that windy along the coast. We talked about fog forming as you look at another forecast for santa rosa tomorrow, talking about the fog formation and water temperature. The sea surface temperatures are running kind of warm right now, upper 50s and low 60s so the fog is not quite as robust in its formation and is just not happening as aggressively as it had been because of the water temperature. We are not seeing the strong onshore winds. We will see patchy fog but you see how quick it goes away with patchy fog this morning that burned off really quick. It has trouble establishing itself and staying put. In august we will see what the winds do but if the wind still come up, the temperatures up to 64 degrees and that really stumps the fog formation. So the forecast for tomorrow morning, you can see the fog is back but a footprint like this morning, really minimal, and then the forecast tomorrow, a lot like today. Maybe a couple of degrees warmer. Today if you were 91 or 92, tomorrow you will be 95. Like in vacaville, 94 in fairfield. 95 in antioch, 95 in brentwood. These are tomorrow, thursdays highs should be the warmest day of the week. That is the plan, anyway and temperatures will drop off a little bit.
