Now, the interesting thing that we were talking about was yesterday, frank, if we can come back out here live on camera, two weeks and one day after the shooting, officer mateu was cleared and is back working. We talked about this yesterday. I asked the chief that question. He said thats longer than many departments some people have their people back on the streets within three days after a justifiable shooting. The question once again is, with it being under investigation, how was it determined . It was cleared by internal affairs. Theres more investigations going on. The police chief also said that he wanted to be out there that he saw a gun being used he saw a gun in the video. And thats also what he wanted to put out there. If you see the video in its entirety which we have on our website, you can see yellow circle marks on the video and you can see the gun at different times. Its unclear where the gun came from. And also, i will tell you, the man was shot three times in the back. The officer says the chief says in those kinds of situation we are only see the body camera by the center of chest and not the viewpoint from the officer. Whats striking is how fast everything happened. Do we know at all you have the two people fighting there. Do we know why the officer shot the one person as opposed to the other . Did he see the person he shot holding the gun . Is that the assumption here . Reporter i dont want to go on assumption, frank, and basically thats one of the questions we asked the chief. He couldnt really answer that because he says its an open investigation. So he couldnt talk about exactly why the officer shot his gun because he also hasnt talked to the officer. But i will tell you this. When youre looking at the video, you can see the two men scuffling. The chief said this part. He says he believes his officer came to the defense of a man who was already shot by tindle in the leg. He says that his officer fired those shots. Now to santa cruz where police say a fifth Grade Student allegedly planned to harm classmates. Police were called to Bayview Elementary School yesterday because the 11yearold boy was physically acting out and had barricaded him inside a classroom. The student was safely removed from the school. Police say that further investigation found that the boy planned to hurt three students and did have access to a gun at home. In Southern California, Authorities Say they prevented a students plot that could have led to another mass shooting at El Camino High School in whittier. It was a tip from a School Security guard who overheard a student threatening to shoot up the school. Authorities say the student was upset about a dispute with a teacher. Right now they are not releasing his name because he is a minor. He is facing a charge of making criminal threats. Angela aliotopeople were forced out of their homes a year ago by devastating flooding on coyote creek. Eventually 14,000 people had to evacuate. Emergency crews used boats to rescue people stranded by rising floodwaters. A year later officials announced a new partnership with the army corps of engineers to keep it from happening again. Maureen naylor reports. This was all under water. Reporter in the rocksprings neighborhood of san jose, san jose, a new 400foot wall, that and this 500foot berm are two new barriers built along coyote creek to protect the neighborhood from flooding again. Its designed to keep the water in the creek. Reporter this footage shows the night before the flood san jose leaders worried about the creek. Our big concern is water from the anderson dam. We know it will probably hit the peak flow and were concerned about some communities along coyote. Reporter about 14 hours later residents found their streets under water. The flood forced 14,000 residents from their homes and caused 100 million in damage. The city of san jose admitted its communication failed and after criticizing the Santa Clara Valley Water District for bad creek data projections, the two agencies have since come together. I think the leadership of the mayor, the council, the people, the meeting we have had, the committees, the community, we listened and we are partnered and were committed all of us to do a good job. Reporter the Water District on the anniversary said not only has it built the two new barriers; its kept Anderson Reservoir levels lower this year, removed up to 16 acres of invasive plants which can back up creek flows and added new flood gauges. And cities cannot do it alone. We believe if the state of california invests its surplus into addressing this humanitarian crisis, it is californias mayors that will deliver results fastest. California state senator accused of Sexual Misconduct apologized today to anyone who felt uncomfortable by his behavior. Los angeles area Democratic State senator tony mendoza still denies two of the more serious allegations including one involving a 19yearold female intern. His apology today came one day before fellow state senators will vote to potentially censure, suspend or expel him. Lawyers investigating complaints against tony mendoza found that he likely engaged in unwanted, quote, flirtatious or sexually suggestive behavior with six women he worked with including four subordinates bart is moving forward with plans to study the feasibility of a second tube under the bay. And while the idea sounds great to many people its a huge costly endeavour. As Cristina Rendon reports, the study will look at where the tube would be located and how it would work. Reporter right now, theres no money to build the project, which is estimated to cost anywhere from 12 billion to 15 billion. Reporter the ceo of Bay Area Council Jim Wonderman says there are lots of options of connecting the east bay to San Francisco. One idea would connect the future as stadium in oakland to at t park in the city. How do we serve the most people by connecting best to their jobs and housing and other uses that people have for bart recreation. Reporter the study will also look at the Bigger Picture of having other transit agencies use the tube. So things like highspeed rail, capitol corridor, caltrain, we want to have that larger regional discussion so that we really can increase the mobility of the bay area. Reporter plus, bart says having a second tube would double their capacity and give them the option to run trains 24 hours a day. But its a project for the next century. And it will be an absolutely needed project as more and more people use bart and depend on it every day. Reporter and bart says that its important to Start Talking about things like plans and costs now because they expect that current ridership will reach capacity in the current tunnel in the year 2030. The chase involved a man from camarillo who was under investigation in a rape case. Chow is described as 58 and weighs about 150 pounds with black hair and brown eyes. San franciscos Historic Preservation Commission Voted today to remove a statue from city property. The early day statue shows a native american man on the ground with a missionary and a spanish cowboy standing over him. The statue was dedicated in 1894 and sits in civic center plaza. Last year at an Arts Commission hearing, many people protested that the monument is outdated and offensive to native americans. The Arts Commission is expected to approve the removal of the statue at their meeting next month. The plan is to put the statue into storage. Today marks a year since the floods in the south bay. Some city and Water District officials made sufficient changes to prevent another disaster. Jesse gary went looking for answers today and shows us what he found. Reporter one year since rocksprings and two other neighborhoods were inundated with water, physical marks remain. A red x, still a haunting symbol of an evacuation site but the searing question on the minds of many san joseans, have the city and Water District learns from mistakes and made needed changes . Bottom line were much better prepared than last year. Reporter analyzing what went wrong february 2017 started before the floodwaters receded. Over the past year, he says the city and the Santa Clara Valley Water District have taken steps to prevent another disaster. Chief among them is this 70 page action plan that lists threat levels, a line of command and protocols for alerting and evacuating residents. The central problem for us last year was not having a common understanding of the data and not having agreement with the Water District on what was important and when to take action. We have corrected that by collaborating with them. We now have a clear system of watching and warning and preparation for the flood. Reporter he says the trifecta of hightech and High Touch Solutions is in place to notify residents. Emergency alerts can be sent to people in affected areas via their cell phone. Community emergency preparedness. Reporter multiple long range acoustic devices or l rads can be staged or deliver into neighborhoods facing imminent flooding. The omnidirectional speakers can broadcast warnings heard up to a mile away. Last, city staffers will knock on doors if an 11th how many attempt to alert residents is needed. For its part the the Santa Clara Valley Water District has already changed how much rain water is held in Anderson Reservoir. Last year, historic downpours pushed water over the spillway flooding the coyote creek and eventually rocksprings and Williams Creek neighborhoods and a mobile home park. Since december, the district has released water in the dam keeping capacity at just 25 . The water in there is from last year. So its adequate but its below the capacity. And to make sure it doesnt get over capacity, what would you do . Well, if we get more water, we would release it. Reporter every. Reporter the Water District is in talks with the army corps of engineers about a memorandum of understanding that could be worked out this week and once the ink is dry, will allow the Water District to conduct a 100year flood Feasibility Study using the army corps of engineerss expertise. Its the first step in producing a longterm flood protection project. I keep doing it because i want you to understand the jet stream as best you can. Upperlevel winds like a river of air so if you look straight up you can see this river from underneath. But see what you got here . So here under the ridge you have this record warmth. Its 71 in atlanta now. So when the storms come down the pipe being driven down by the winds, they come down the pipe like this and they are dry and cold. Down here this jet stream is grabbing subtropical moisture from the gulf of california and southern pacific and driving up it to the homeowner and Mississippi Valley so we are seeing flooding especially towards texas and parts of louisiana so its the jet stream, it tells you everything you need to know really. Where its coming from, what is, you know, the orientation of it. Here comes the next weather system here. And again its coming right like this. So its dry, cold, and its weak. Grand, you could say we havent had much weather around here, granted. But these are weather systems. They are just not productive weather systems. We are used to having these types of systems a little further south with more moisture available to them. So live outside, good air quality. Sometimes you get this pattern like this, you get into some spare the air nights and we are not seeing that. We have had a pretty good setup.
