People are still walking their dogs so still not the heavy enough rain to stop them from going out but still, i have noticed over the past few minutes the overall rainfall rates have been picking up. I need my umbrella. I have been out here for a few minutes and if you sometimes get away with just having a few showers out there and not getting a soak. But in fact, i will say the rain has been picking up and as you know and everybody knows, the timing right now is not so great. It does not take a lot of water to mess up the commute. Im sure thats going to be a challenge for the motorists on the roads now. Thats right, mark. You know, in fact, i dont know if you have a monitor up there, but i showed that area up in the Fairfield Area up around napa, that orange reflectivity, the rainfall rates in there over an inch an hour. So parts of the napa county area, near the burn zones are seeing some significant rainfall rate. Looks like it will be short lived but there are significant rainfall rates. The forecast moves this through. Its not stalling out. But still, it looks like its going to give us a good soaking. Its doing it right now. Ill take away the umbrella and just expose myself to the elements and a few showers hitting me right now. So a little more of a moderate downpour i would say here in oakland. All right, mark. In other news tonight, we have breaking news from the uc board of regents meeting this afternoon. A vote was expected on a proposed tuition increase at campuses but that vote isnt going to happen until may. Ktvus alyana gomez is at that meeting in San Francisco with more. Reporter a surprising move, the board of regents voted to postpone that proposed tuition hike until may. I think some people thought they were going to at least push it to march but they pushed it even further to may which were finding out to be problematic for recruiting students. Incoming freshmen may not know what they are going to have to pay in the springtime. But the board of regents moved forward with the vote and decided to postpone it. But immediately following that vote, the board went ahead with discussion on tuition hike as planned. Again, they were proposing a 2. 7 tuition and student fee hike for instate students amounting to about 350 per student per year so students if that tuition hike goes through would pay 12,974 a year in tuition. Now, for outofstate tuition, they are proposing a 3. 5 hike amounting to 28,992 a year in tuition costs. Now, among the Board Members, there were some concerns about the accessibility and affordability of the uc education to all students. But some members see the increase as a way to provide more resources to current and incoming students. Again, this proposal has been postponed until may. We did though hear from the uc berkeley chancellor who spoke to the board about 30 minutes ago about why a moderate tuition increase will be used to support their students but also discussed how the campus has been reducing operating costs by eliminating 500 administrative positions. However, she said, putting the vote off until may creates uncertainty for incoming students. Families at the time they are admitted to berkeley wont know the cost of attendance. And we will not be able to effectively recruit students from out of state if by the may 1st deadline when, um, students have to make their commitment, they dont know how much its going to cost. Reporter the discussions amongst the chancellor representing the 10 campuses of the uc schools and, of course, the Board Members inside is still going on. That meeting is being held just beyond the wall of security you see behind me so they are still discussing the proposed tuition hike but again, will not vote until may. Thank you. Now to San Francisco also in San Francisco there is a political shakeup. The third mayor in six weeks started his first full day on the job today. Former district 2 supervisor mark farrell will hold the position until a citywide election in june. Ktvus Tara Moriarty live for us in San Francisco after talking with supervisors who voted for and against appointing farrell. [ no microphone ] [ screaming ] reporter it was a city hall stunner acting mayor london breed out, supervisor mark farrell in. I felt betrayed. Reporter her close ally on the board supervisor malia cohen. Im saying its a back room deal. Reporter a most deal city hall insiders said happened between progressives and farrell who is considered a moderate like breed. There was backlash for replacing the first black female mayor with a white man. I think what you saw last night wasnt, um, so much about elevating one white man, it was about sending a message to another white man, a tech titan billionaire named ron conway that San Francisco cannot be bought. Reporter peskin alleges that conway bullied supervisors into backing breed and it backfired. Did conway ever have a conversation with you . Ron conway has tried to have a conversation with me but we have yet to actually meet. Reporter but supervisor jeff she me who was considered the swing vote in favor of farrell said it didnt factor into the decision. You cannot concentrate all the power of the city in one office. Thats just not right. Reporter sheehy said he and other supervisors didnt think it was fair for breed to wear two hats, one as supervisor and one as mayor, while also running for mayor in june. I dont have to focus on the campaign trail. Im going to focus on San Francisco for the residents. Thats what they deserve. Reporter breed today appeared upbeat. I think this is going to empower people who traditionally may not get involved in elections. Mark farrell is keeping mum on who he will endorse if anyone and right now, the big task he has before him is the city budget and with his Prior Experience on the budget and finance committee, he definitely is equipped to do that. Did farrell talk at all about how he plans to sort of bring everyone together . He didnt. He said i was voted and i accept it with humility and great responsibility and im potentialed on the day to day tasks of focused on the day to day tasks of trying to make sure the city is up and running and right now its not about politics, its getting the city where it needs to be with the issues that, you know, all san franciscans are concerned about with regard to homelessness, Affordable Housing and, of course, public safety. Thank you. A judge in Riverside County today barred the parents of the 13 siblings found living in deplorable conditions in their home from contacting their kids. David and Louise Turpin are accused of abusing the children ranging from 2 to 29 years old before they were rescued last week. They allegedly held them captive chained to furniture and not feeding them for days. The sentencing hearing lasted 7 days as more than 150 of nassars victims including former olympians came forward to share their stories. You still think that somehow you are right that you are a doctor that youre entitled, that you dont have to listen and that you did treatment. I wouldnt send my dogs to you, sir. Reporter nassar pleaded guilty to sexually assaulting ten girls under the guise of medical treatment. The judge sentenced him to up to 175 years behind bars saying that with sentence, she has signed his death warrant. You do not deserve to walk outside of a prison ever again. Reporter usa gymnastics has been under fire over their mismanagement of the scandal with three of the organization Board Members stepping down earlier this week. The new president and ceo of usa gymnastics released a statement after the sentencing, saying, quote, i will not waiver on my commitment to focus each and every day on our organizations highest priorities, the safety, health and wellbeing of our athletes. We will create a culture that empowers and supports them. They say they care and that they want to be there for us and theyre assuring us safety. But what are you doing to do that . I think the number one takeaway is that everyone has a role from the top down so were talking school administrators, teaches, coaches, parents, even the athletes themselves. But it begins with the policy and repetitive training. We found the state department of education does not track the specific number of Sexual Assault or abuse allegations against teachers or coaches. But state law does lay out the duties to protect students, specifically adopting a policy to stop discrimination, harassment, intimidation or bullying. There has to be a formal complaint process and schools or School Districts are required to investigate all complaints. Also, publicize the procedures every year to students, parents and employees all in an effort to promote a safe environment. There are also clear and strict child abuse identification and reporting guidelines. Some employees, administrators and coaches are considered mandated reporters so that means they must contact Law Enforcement if they suspect any child abuse other sexual misconduct. If they dont, they could face six months in jail or a 1,000 fine. In 2015, a new law required annual training to identify and report potential cases of sexual abuse and california even developed a new tool and online fourhour Training Program for anyone in contact with students or student athletes. One of organization is trying to be proactive to prevent any sexual abuse from happening within athletic organizations. Its called the us center for safe sport and allows Young Athletes to report allegations of Sexual Assault or misconduct. They also developed a code of conduct in hopes of other schools or sports groups will take that and implement it and the ceo says thats the first thing parents should be asking what policies are in place to protect my child and then talk with your kids. We need to have open dialogue with our kids about these subjects and it has to be ongoing. And we have to instill the sense of boundaries and being the boss of our own bodies and also instill in our kids that if someone asks you to keep a secret, what would you do . You know, would you feel comfortable coming to me and making sure that kids understand where they can go, who they can turn to in terms of providing that safe environment. Reporter so the takeaway message here really has to be a cultural shift encouraging anyone if they suspect something to speak up. So you have been looking into this. Right. Does it appear that more people are coming forward to report potential abuse . I mentioned there are mandated reporters like teachers or coaches or anyone that thinks there may be abuse going on. So all of those complaints then actually they dont go to the department of education. They go to whats called the California Commission on teacher credentialing. And they have seen about 200 complaints year to year but most recently in this past fiscal year, they saw more than 300. Hm. So there was a little uptick in the number of sexual abuse among children reports. You mentioned that some things are not being tracked. Is that going to change or do you know . At this point theres nothing that beyond the laws that are in place right now that says people have to report it other than those mandated reporters. So its really encouraged that they do that. If they dont, then it comes out later that they knew about it, as weve seen before, then they can face jail time or a possible fine of 1,000. Hm. All right. Brooks jarosz, thank you. Youre welcome. Thats some significant rainfall and again we point out the rainfall rates in these areas are significant. So its the half inch of rain in an hour and again just gives you this obviously an example of a measurement of intensity and in these areas, certainly not far from the burn zones of napa, youre getting some really significant rain. Im not anticipating debris flows or anything like that but its something to watch because its shortlived stuff. Its moving through quick. And thats the key. If it hung out there for a while, we would be in some trouble. Um, im just putting in the storm reports right now to make sure were not missing anything, and i dont see any storm reports so thats good. Um, more showers all the way south. Youre seeing San Francisco right now getting heavy rain. Um, or moderate rain. Oakland moderate rain and those rainfall rates, again, lets check out lets go down to noe valley. Yeah,. 07, tenth of an inch an hour so thats mild rainfall with wipers on the regular settings. Mountain view and san jose, youre like hey, whats the big deal . We got nothing going on here. And in the mountains it turns into a winter storm warning as we go into this evening and into tomorrow morning at 10 a. M. So thats a pardon me, thats tomorrow morning, friday morning. We are going right through the day tomorrow. This storm really more than for the bay area, this storm for the mountains is going to be extremely productive. 30 inches i think is conservative. I think between tonight, tomorrow all day, and then all day all night thursday night with scattered snow flurries, they could see up to 4 feet of snow in some places. This type of system very productive up on the west slope of the Sierra Nevada so theres some good news there. We are getting rain, as well. You see the live camera shot outside. President trump made a dramatic turn on immigration policy today saying he is now open to helping Illegal Immigrants become citizens. Tens of thousands of people who were brought to the u. S. As children and here illegally were protected from deportation under daca. President trump announced that he was ending daca last year. And he has Given Congress until march to come up with a legislative fix. Still, today he said an all termive to daca might take years to finalize but he said to the immigrants known as dreamers but they have nothing to worry about. Also on immigration tonight the Justice Department is stepping up its fight against sanctuary cities. Today attorney general Jeff Sessions threatened to subpoena two dozen cities that dont provide documents to show whether local Law Enforcement are sharing information with federal immigration authorities. Its a top priority to crack down on illegal immigration and threatened to withhold federal funding from sanctuary cities which includes San Francisco, oakland and san jose that refuse to share that information. An Tensions Mount over immigration Democratic Senators say there is a february 8 deadline to come up with a plan for Daca Recipients and late this afternoon President Trump said he would love to talk under oath with the Mueller Investigation into the russian meddling in the election. Officials say Santa Clara County operates around the clock hotline where people can report i. C. E. Activity in the south bay. The hotline has more than 600 volunteers to support immigrants at risk for deportation. It also serves to inform residents of their rights and protect them from unlawful arrests. Were excited that we have a number of people who are interested in understanding what we can do and developing solutions for homelessness and before we can do that we need to the scope. Reporter that means understanding there may be many roads that lead to homelessness. I was in a residential for, um, drug abuse. Reporter raquel pena and her two children have been staying in a martinez shelter after she spent time in rehab. Theres so many Different Reasons that people are homeless. Its not always what you asue. Everybodys story is different. Just dont make assumptions. Just come out, reach out, help. My son was murdered and life kind of just went spiraling down after that. Reporter Michael Anthony ramirez, who is homeless in walnut creek, says he is grateful for what the county is doing. I think they are doing an excellent job. It helped me out quite a bit getting to and from appointments and to some of the more major things that, you know, i wasnt getting to. I have been through it all. Reporter but other Homeless People like kelly are skeptical that everyone will be counted. A lot of them dont come here every day. They dont have a way or whatever. I couldnt really give you a count but i know theres a lot more than whats on that list. Homeless is visible and sometimes an invisible problem in our community and the purpose of the day today is to bring them out in the open, find out who they are and where they are and what their circumstances are. Reporter there were about 1600 people in last years Homeless Count. Officials hope that number goes down. Hopefully its lower because we are doing our job well but i cant be certain thats the case because we do know families, their incomes are stagnant, rents are rising. Reporting live in concord, henry lee, ktvu fox 2 news. A homeless man found yesterday in San Franciscos Mission District on fire has now died from his injuries. The victim is believed to be in his 50s found in an alley at 10 30 yesterday morning near sage and 24th. Police are investigating as a suspicious death. They are asking any witnesses or anyone with Surveillance Video that could help determine how the victim was set on fire to come forward. An inmate has died while in custody at the county jail in martinez. The Contra Costa County Sheriffs Department says a guard found the body of 45 yearold james cooper in his cell while conducting room checks just before 1 00 this morning. The Sheriffs Department says the inmates death was related to a medical problem but didnt release further details. A preliminary hearing was held today in the case of a redwood city woman accused of trying to flush her newborn down a toilet. 25yearold Sarah Lockner did not enter a plea today. Her bail remains set at 11 million. Lockner faces charges of attempted murder after she allegedly gave birth in a bathroom at a mcdonalds in redwood city where she worked as a cashier. One coworker claims she saw lockner trying to flush the child down the toilet but lockner claims she didnt know she was pregnant. The baby was placed in a medicallyinduced coma and is now surviving on its own. Investigators still trying to figure out what caused a latenight fire that damaged several businesses in San Franciscos west portal area. It started just before 11 00 last night on west portal avenue near vicente street. It spread through four stores on the block. The roof part of the roof collapsed at one of the Hardware Stores there. The fire also damaged the sloan square beauty salon and the west portal daily newsstand as well as a Grocery Store all along with a vacant store in the area. They all share a common attic. All the businesses are popular with local residents. Im concerned for the excellent business and cornerstone of the community. They provide great service. I feel very badly for the staff for the owner, the manager, the excellent business and i really hope they are able to get back up and running as soon as possible. Firefighters kept the flames from spreading to some apartments behind the businesses. No injuries were reported. Californias attorney general today filed a lawsuit against the Trump Administration for rolling back a fracking rule that he claims is designed to protect Public Health and the environment. Attorney general Xavier Becerra says the suit challenges the federal blms roll back of a rule governing fracking. It would require Drilling Companies to disclose the chemicals they use for frackching becerra says the administration broke the law by not following required procedures including public comment. A new regulation overseas may change the way we recycle here in the bay area. Tom vacar reports on how a massive and backup of Recycled Materials may find its way back to our backyards. Reporter recologys 400 San Francisco recycle trucks bring in 650 tons of material every day and becomes clearly and is usually exported most of it to china for reprocessing. But as of new years day, china has changed their regulations involving the cleanliness of the materials they import. China is not going to take these bales any longer until we can get those impurities down to 1 . The deadline has passed. The limitations have already taken effect. Reporter that leaves most of recologys materials unacceptable and pretty much every other recyclers. Recology says its bales of cardboard are already clean enough and the chinese take that but they are not taking paper and plastic because it has too much impurities. So thats going to Southeast Asia. But theres only very limited capacity in Southeast Asia and once thats gone, all of this stuff will start piling up at other recyclers. Cities around the globe and the recycling companies that serve those cities are working very hard to find new homes for this material. Reporter thats because the only alternatives are either putting it into landfills or, worse, incinerating it worldwide with the greenhouse gasses that that pumps into the atmosphere that would quickly and substantially raise garbage and recycling fees nationwide. The solution is in every individuals hands. Wash out cans, bottles and jars before throwing them into recycling. The idea is to keep any small food residuals out of the recycling bin and protect the integrity of that recycled paper. Prosecutors in marshall county, kentucky, say a 15 yearold boy accused of opening fire at his school and killing two classmates will be charged as an adult. The teen has been charged with two counts of murder and 12 counts of firstdegree assault. Because the suspect is a juvenile he faces charges in Juvenile Court but prosecutors say it will soon be transferred to adult court. Please dont get caught up in the term youthful offender. We have been in consultation with the Attorneys Office and that is the plan to ask the court to certify him as an adult. Yesterdays shooting at Marshall High School there in benton killed two students, 15 yearold girl and 15yearold boy, 18 others were injured. So far, theres no word on that shooters motive. No charges will be brought against an offduty Los Angeles Police officer who fired a gun during a scuffle with a 13yearold boy. The incident happened last year in february. Cell phone video shows officer Kevin Ferguson in a heated argument with a group of teens. The officer claims he fired a gun at a teenager or he feared that one teenager had a gun. No serious injuries were reported from the incident. Toys r us is going to close 20 of stores in the u. S. After going bankrupt in september and said the stores it plans to close fail to meet performance standards. The closures will begin next month and continue until mid april. Reporter members of the Bay Area Toll Authority approved a resolution that would put an initiative on the ballot before voters this june to increase the tolls at all stateowned bay area bridges. Thats all the bay area bridges except the Golden Gate Bridge which is operated by another district. Now, on most of those bridges, the base toll is 5. Under the proposal, if voters approved it that would go up to 6 by 2019, dollars by 2022 7 by2022 and 8 by 2025 and would pay for about 4. 5 billion in projects to reduce congestion. Specifically, things like more bart cars, more bart extensions, more express bus service, a new ferry system and even possibly the beginning of a second transbay tube for bart. The money is raised in the bay area, it stays here in the bay area. And it does a thing, Congestion Relief in these corridors that we cannot do in any other way. The federal government is not going to bail us out. Its not going to happen. The State Government cant either. If the bay area wants Congestion Relief, heres the plan. Reporter some of the commuters we spoke with say they are unsure about this solution and the idea of paying more for already expensive bridge tolls but just about everyone we talked to agrees something has to be done about the congestion. I dont see anything improving even if folks arent necessarily wanting the toll increase. Its going to go towards alternative forms of transportation to make them more accessible.
