As a matter of fact, as i look at the commutes that are the busiest right now on the east shore freeway, for example, you will see the traffic is 40 minute drive. I think i have the camera turned the wrong way. Thats my fought. Once you get to the bay bridge, you will see that traffic is backed up for a 20minute delay. 40 minutes for the east shore is not bad. Any higher than that and people may get on highway 24, which is something that people do. Weve been checking with highway 24. Its not all that bad. Ill show it to you on the map in just a moment. 880 looks okay into oakland. 80 south has will not slow. We had a couple of earlier things going on. Right now the slow traffic starts just after 2 38 and extends all the way down to stevenson before it gets better. Lets talk about the east bay commute because we talked about highway 24. Its a little bit slow in lafayette. And again near the tunnel. But still not at critical levels just yet. 7 03. Lets go back to the desk. Matt lauer is publicly apologizing after being fired by nbc yesterday following complaints of Sexual Harassment. Lauer issued a statement saying, im quoting, there are no words to express my sorrow owe and regret for the pain that i have caused others by my words and actions. To the people i have hurt, i am truly sorry. Lauer said he will work to repair the damage that he has done. Lauers final appearance on the today show was tuesday. Monday night, a Network Employee and her attorney met with executives to discuss what was called inappropriate behavior in the workplace. Since then, three more women have come forward to describe their own encounters with lauer. One woman said that lauer had assaulted her in his office in 2001. She said she didnt report it because she feared losing her job. Variety reports lauer gave another woman a sex toy. The show business publication reports that he exposed himself to another woman and chastised her for not responding. The owner of a downtown martinez gym in the meantime is facing charges of performing lewd acts with a child. Benjamin owns the Martinez Athletic Club on castro street. He has been booked on four separate counts of an account with a child under the age of 14. He and his wife have two sons and are involved in fundraising for the boys and girls club as well as sports teams. He is being held on 400,000 bail. We are just hearing this morning, michigan congressman john conyers who has been accused of Sexual Harassment has been admitted to a detroit hospital for stress related illness. As far as franken and conyers are concerned, ethics committees are looking into the allegations against them. For now the two men are staying put. The time is 7 07. The driver suspected in a deadly hit and run crash on interstate 80 last night is now facing charges of murder. He also faced charges of felony hit and run and drunk driving. Now the District Attorneys Office in Contra Costa County has filed four murder charges for the deaths. Jared horn was the only survivor in his car to come out of the crash. His father, his younger brother, his uncle and cousin all died. Fred lowe drove away from the crash scene but was arrested after another crash on the freeway that same night. Legal experts say murder charges are rare in fatal traffic crashes. They say in this case, the prosecution would have to prove that lowe knew his actions could result in deaths. Lowe has previous convictions for driving under the influence. Firefighters say that burning candles likely caused an Apartment Fire in santa rosa last night. No one was home when the fire gannon stone epoint road. Crews say there was smoke coming out of the door when they arrived. The fire was limited to one unit. It did about 60,000 in damage. No one was hurt. But the tenants who lived in the apartment are now looking for somewhere else to live. The time is 7 08. If you drive in San Francisco, you may soon see new parking meter rates that go up at peak times. Surge pricing is being considered by the mta for every parking meter in San Francisco. Ktvus rob malcolm is in San Francisco now with more on the proposed plan. Good morning, rob. Reporter yeah. Good morning, dave. There are over 30,000 parking meters in San Francisco. And theyre all in demand. This is what surge pricing is all about, supply and demand. If youve ever tried to park downtown, weve all been there before, circling the block, looking for parking. Surge pricing is supposed to alleviate those problems. Here is how the plan is being kicked around by the mta and could go into effect by 2018. It means that all 30,000 parking meters would have hourly rates based on demand and also on the neighborhood and time of day. The charges would be different based on the time of day and vary of course block by block. So if youre in the restaurant district or in the traveling in the evenings or weekends, you would be expected to pay a little more. Mta says surge pricing would make more parking available because people would park for shorter periods of time. There would be less circling the block and even park further away. The agency plans to vote on this in a week on tuesday. And surge pricing we know is already in effect in about 7,000 metered spaces in the city and also in all of the parking garages in San Francisco. We spoke to a few people this morning. And the plan is not being well received. Parking is ridiculous already. Youre paying a quarter for every four minutes. I mean, i have to take a stack of quarters like this every time we go out. We avoid places because of that. We dont go there anymore. I work for mta. But a lot of what they do is pricing people out of certain places. You dont agree with the surge pricing . Theyre planning to roll this out. I think it is too expensive already. I dont think surge pricing will make that big of a difference. Reporter all right. Thats just one mans opinion. Southbound 880 is slow as it normally is. Driving from hayward to fro fremont. When you get over to the peninsula, it will be okay. Northbound 101 we still have the crash i told you about near capital expressway. Causing a little bit of slow traffic. Some people may be diverting on to highway 80. Now, as we go to mark, i will say this, mark, we talked about fog, mark, and it could be a little foggy in novato as you were saying. Novato, southern petaluma area. Yeah. That is the one there isnt a lot happening weatherwise, sal. But we have been tracking that. When you have a stable pattern like this, the fog forms and you could have great conditions, Something Like this, and then all of a sudden you encounter the fog bank. Instant drop off in visibility. Ahead of the senate vote, the dow shot up more than 100 points this morning to cross that 24,000 level for the First Time Ever. All three of the indexes are actually up just about 50 or a half of a percent that is. I mean half of a percent for most of them. They celebrated the Tree Lighting ceremony there on the opening bell this morning. But the numbers went straight up. Right now, taking a look at the live look at the dow. Again, up more than half of a percent. 135 points. 24,079. The s p 500, brandnew record there. 2638. Up almost half of a percent. The nasdaq is at 6859. A new study says nearly 30 billion worth of bit coin have reportedly vanished from the internet. Now, the study by fortune states that 7 to 23 of the popular currency have been lost or deleted. The big question is whether the currency is actually lost or just being hoarded by certain people. Yesterday, bit coin hit an all time high, rising above 11,000 on major exchanges. Well, tesla now denying reports about alleged flaws in its manufacturing process. Routers reports that 90 of the model s and model x suvs come off of the Assembly Line with flaws that need to be faced before going to the factory. It based it on interviews with workers. In response to the report, tesla told Business Inside they are it aims with for perfection with every one of the vehicle. Well, during this busy holiday season, we have learned that American Airlines needs to find pilots for thousands of flights. A scheduling mixup has left the airline without enough captains and copilots to fly the planes. The airline is not saying how many flights are expected. But the union says 15,000 were scheduled without a captain, copie another already both. The union says the problem was caused by an error in the system that pilots use to bid for time off. One pilot said the system actually give them the option to drop flights between december 17th and december 31st and most of them did. Now, the airline provided a statement this morning. It says, quote, we are working diligently to address the issue and expect to avoid cancellations this holiday season. We are paying pilot whos pick up certain trips 150 of their hourly rate. But travel experts saying this could certainly affect flights. There could certainly be problems during the very busy holiday flying season. We will be following this story. Thats rightment the thats right. The roadway sensors are giving us a time. The east bay freeway, you start the timer at the carquinez bridge and ends at the macarthur maze. That is a little less than an hour. But when you get to the bay bridge, you have to wait another 20 minutes. So there you go, more than an hour to get into San Francisco. More like an hour and a half driving into the city. If youre driving on 880 southbound, it looks okay, heading down towards the oakland coliseum. This is San Francisco. Northbound 101 slows from the 280 interchange and gets better after cesar chavez. In the east bay on 880, that has been filled in. And the dumbarton bridge in the last 15 or 20 minutes started getting slow from all the way across the newark side to east palo alto. No major issues on the bayshore freeway. Look at all of the south bay freeways, theyre all filled in. 7 33. Back to the desk. Thank you, sal. A federal judge ruled that Albany High School properly disciplined most of the students involved in a scandal over racial posts on social media. Nine students sued the School District because they were suspended in connection with the post. Now, the controversy started back in march, when administrators at Albany High School found out about racist images posted on the students private instagram account. They included nooses drawn around the necks of African American students. The students sued the district saying their free speech rights were violated. Yesterday the judge ruled that the School District was within its right to discipline the students because of the turmoil created at the school. 11 children arrested in san jose are facing charges for several crimes. The children, some as young as 11, might be involved in several armed robberies, carjackings and burglaries. At least three children were involved in police chases. In one case, there was an 11 yearold behind the wheel. Authorities are investigating more than a dozen crimes, part of what they say is a growing problem with youth violence. I will say that this is a trend that were seeing more and more of, groups of juveniles who commit a really large number of Violent Crimes in a very small period of time. And it is quite alarming. Authorities say theyre not sure how the crimes are connected or whether they may be gang related. But 11 children, both male and female, have been booked into the juvenile detention center. Some have been released to the custody of their parents. John bevins, is due in court today to be arraigned. U. S. Marshals captured him in san leandro last week. He was rearrested a few days after his alleged accomplice, 46yearold mcclough was captured in stockton. Bevins could get ten years in jail if convicted. A bill that would allow people out of state to carry guns in california has cleared a major hurdle. It was passed by republicans yesterday. It would require every state to recognize concealed carry permits. The time is now 7 35. A leaking gas line in San Francisco that triggered an explosion on monday has been fixed now. But the people affected by it, theyre still picking up the pieces. A gofundme account has been set up for the elderly couple whose apartment was damaged in the explosion. We just checked it. So far, more than 2,000 has been raised. Carmen and carlos had to move out while their unit is being repaired. They say their only car was also wrecked in that explosion. Along with their belongings. Now, the explosion caused moderate damage to the building. It blew out the front windows, as you can see. But no one was hurt. The cause of the leak and the explosion is still being investigated. Now to the south bay where some parents are worried this morning that their childrens schools will close due to budget problems. Ktvus alex savidge is live in san jose. Thats where cuts could be coming to the oak grove School District. Reporter yeah. Gasia, good morning to you. Schools will be closing here. It is just a question now which schools will be shut down. We are here at miner Elementary School. One of eight school thats has been put on a list. Possible school thats may have to be closed because of budget issues here. The district here in south san jose is planning to close down a number of Elementary Schools and move those students to other campuses. The goal is to save money as the oak grove School District deals with a serious budget deficit. Ultimately the district is planning to close between three and five Elementary Schools in the neighborhood. The process has left a lot of families feeling anxious, wondering where their children will wind up. Also a tough time for staff members, including Deborah Metzger who works in the cafeteria here at miner Elementary School. For them to be put out here and put out there and, you know, its going to be hard. Its going to be hard on them. And thats the main concern. These students. reporter now, here is a map that shows you all of the eight Elementary Schools that potentially could be closed as part of this consolidation effort by the district. Anderson elementary, baldwin elementary, frost elementary, glider elementary, oak ridge elementary, Saint Theresa elementary and miner elementary, where we are this morning. Parents have had a number of opportunities to weigh in during this process about which schools they believe should remain open. There is another you can approximate lick meeting the district is holding that will happen this coming monday. Alex, i know it is early but are you getting a sense that theyre being closed due taunted performing affect under performing academics . Reporter we havent talked to the district yet. It is difficult to reach people at this hour with the School District. Not clear on the specifics of this. We know that they have had ongoing budget issues, running budget deficit that theyre trying to deal with. It sounds like theyre trying to deal with it in other ways. But ultimately they will have to consolidate some of the schools. Now theyre trying to figure out which ones they will close. And obviously it will have a huge impact on students and families when you talk about a child who may have gone to their local Elementary School that was a few blocks away. Michelle szarian lived in santa rosa and was being treated for burns on 80 of his body. An online tributes, friends said that he was an engineer who recently moved to santa rosa from san jose. Hundreds of San FranciscoPolice Officers and many others attended a benefit concert last night for an officer critically injured by a fleeing suspect. The benefit concert was at the bill graham auditorium and raised money for the officer and his family. He was on bicycle patrol back on october 18th when he was hit by a car driven by a man who was racing away from police. The officer suffered a severe brain injury and is in a Rehabilitation Center currently. When theres a need, we all step up. You know, its this is just an example of it. He is incredible. And also the commute in the south bay. 85 is the slowest. But all of the freeways are slow getting into that west valley. And there is 280 in san jose getting up to highway 17. This morning he sent out a written apology said some of what is being said about me is untrue. But there is enough truth in these stories to make me feel embarrassed and ashames. He says repairing the damage done is now his fulltime job. His final appearance on the today show was tuesday. On monday night, a Network Employee and her attorney met with nbc executives to discuss what was called inappropriate behavior in the workplace. Since then, at least three more women have come forward to describe their encounters with lauer. One woman who talked with the New York Times said that lauer had assaulted her in his office back in 2001. She said she did not report it because she feared losing her job. Variety reports that lauer gave another woman a sex toy. The show business newspaper report thats lauer exposed himself to another woman and chastised her for not responding. And Minnesota Public Radio fired the long time host of a prairie home companion for, quote, improper behavior. He departed obviously the wrong video there. He created the show and says the incident involved him putting his hands on a womans bare back while trying to console him. He verbally apologized and also apologized in an email that he and the woman remained friends until he heard from her lawyer. John conyers has been admitted to a detroit hospital for a stress related illness. The 88yearold conyers is at least one of two members being accused of sexual miss conduct. He returned to detroit this week. As doug luzader reports from washington, the allegations prompted the house to pass new rules requiring antiSexual Harassment training for all member snooze the wave of allegations has raised important questions about how society at large handles allegations of sexual misconduct. But also whether elected officials should be held to the same standard as others. An attorney for embattled michigan congressman john con years says he is refusing to resign despite the allegations against him. When i was sexually violently assaulted in the congressional office. She said she had no recourse. I got no protection afterwards because congressman conyers covered that whole thing up. Republicans have their own issues, including Alabama Senate candidate roy moore accused of Sexual Assault and harassment. For some democrats there is mounting frustration about conyers and franken and at least one democratic lawmaker was fed up and walked out of a meeting with congressional leaders. In washington, doug luzader, fox news. The owner of a downtown martinez gym faces charges of a lewd act on a child. He has been booked into county jail on four separate counts of lewd act on a child under the age of 14. He and his wife have two sons and are involved in fundraising for the boys and girls clubs and sports teams. He is being held on 400,000 bond. This will be day six of deliberations by the jurors in the kate steinle murder case. The jury started deliberations before the thanksgiving weekend. During the trial, prosecutors told the jury that jose ynez Garcia Zarate intentionally slot and killed kate steinle as she was walking on pier 14 in San Francisco two years ago. Defense lawyers say the shooting was an accident. Jurors are being asked to decide if jose ynez Garcia Zarate committed manslaughter, first or Second Degree murder or didnt commit a crime at all. Many Airline Passengers are worried after American Airlines announced a potential Pilot Shortage problem. A computer glitch has left thousands of flights without pilots during the upcoming holiday season. Cristina rendon has more on what it could mean for you if you have a flight. Reporter blame it on a computer glitch. Roughly 15,000 American Airline flights have no pilot assigned to them between the Christmas Holiday and the new year. A surprise to travelers at sfo. It is very hectic and unfortunate for all of us. Reporter the shortage was caused by an error in the system pilots use to bid for time off according to the allied pilots or association, the union that represents American Airlines pilots. The glitch granted time off more than allowed during december 17th and december 31st. An American Airlines captain told Yahoo Finance that the pilots were given the opportunity to drop trips during the Christmas Holiday, so most did. I think they will have to resolve this. They will figure it out. Im pretty confident about this. Reporter a spokesperson for american tells ktvu that they are offering pilots 150 of their hourly rate to pick up open trips. Part of a statement reads, we are working diligently to express the issue and hope to avoid cancellations this holiday season. Travelers hope the airline keeps its word. Just knowing that the airlines are not as good as they should be on their promises. I cant really tell if they would be. Reporter the apa has filed a grievance, saying that management did not consult with the union and created the solution in violation of the pilots contract. Surge pricing on the citys parking meters is suppose today make life easier for drivers. Some people say it rewards people with deep pockets. We will let you know just ahead. The time is 8 14. A federal judge ruled that Albany High School properly disciplined most of the students involved in a scandal over racial posts on social media. Nine students sued the School District because they were suspended in connection with the posts. The controversy started in march when administrators at albany high found out about racist images posted on a students private instagram account. They included nooses drawn around the necks of African American students. The student whos sued the district said their free speech rights had been violated. But yesterday the judge ruled that the School District was within its rights to discipline the students because of the turmoil that the posts created at school. If you drive in San Francisco, you may soon see new parking meter rates that go up at peak times. Surge pricing is being considered by the mta for every parking meter in the city. Rob malcolm is in San Francisco with more on the proposed plan. Reporter surge pricing would be a first in San Francisco and also in the u. S. And it really is all about supply and demand. If youve ever wanted to park in the city and used one of the meters, you know that parking can be a challenge. So the plan being floated around by the mta could come into effect by the year 2018. What it means is that all of the citys meters would have hourly rated based on demand and the time of day. The charges would be based on the time of day and even vary by block. If if youre in the restaurant district or traveling on the weekends and evenings, you would expected to pay more. The mta says it would make more parking available because people would choose to park for shorter amounts of time or further away if they couldnt afford to park at the meters. Surge pricing is already in effect at 7,000 metered spaces in the city and also in all of the citys parking garages. We spoke to a few people this morning and told them about the idea. And it wasnt being well received. A lot of what they do is pricing people out of going certain places. So you dont agree with the surge pricing . I mean, theyre planning on rolling this out. I think it is all too expensive already. So i dont think that surge pricing is going to make that big of a difference. I dont think it is fair. People pay a lot of money. Some people are on a budget. It is hard to its hard when you are on a budget and you cant afford everybody dont have debit and credit cards and stuff. What are we supposed to do . What do people do that dont have the money . Across the golden gate in marin county people who live near mere woods says new parking rules may cause parking confusion. Starting in january, they must have a parking reservation. Neighbors turned out to a meeting on tuesday to hear about the parking reservation system. Those that dont make reservations may end up circling their neighborhoods looking for a place to park if they are turned away from the parking lot. Highway 4 is slow but improving quite a bit. You can see that our camera is at the willow pass grade showing us the last bit of slow traffic that shows up coming over the hill to concord. Westbound 24 however is a little slower as you drive through lafayette. When you get to the bay bridge or if youre driving on the east shore, 33 minutes. It keeps Getting Better and better. There ray lot of anxious parents in san jose as a district plans to close several Elementary Schools because of budget issues. Alex savidge is live in san jose with what is being considered at the district. Alex. Reporter good morning, mike and gasia. This School District in south san jose is considering to shut down as many as three Elementary Schools. This is one of the schools that could be closed. In talking with district officials here a short time ago, they say the big issue is declining enrollment. They have a lot of empty classrooms so theyre trying to consolidate. They have identified eight school thats may have to be shut down. Miner Elementary School is one of them. The goal is to save money as the oak grove School District deals with a 12 million budget deficit. Officials say there have already been layoffs to administrative positions and nonteaching positions to try to close the gap. Ultimately the district is going to be closing three Elementary Schools in this part of san jose. The whole process has left a lot of parents feeling quite anxious, wondering where they children might wind up. I believe that its going to be a very close call. From the meetings that weve had, its were pretty number one up there. So i i feel for a lot of the parents that are not going to be able to have a car to drive them across town. The Oakland Alameda coliseum is meeting today to discuss the future of the coliseum complex property. The raiders lease expires at the end of next season but the stadium in vegas wont be ready until 2020. The board will discuss the proposed oakland as ballpark near Laney College and the impact that move could have on the coliseum property. New this morning, nfl players have reached an agreement with the league on a plan to address social justice issues. According to espn, the league will contribute 89 million over seven years to programs dealing with criminal Justice Reform and relations. It is a way to solve the pregame protest during the National Anthem. It does not require players to end the protests. But the league is hoping that this effort will persuade them to end the controversial movement. That was started there by former 49er quarterback kaepernick when he refused to stand for the anthem. A driver suspected in a deadly hit and run crash last saturday night is now facing murder charges. Fred lowe already faced charges of felony hit and run and drug driving. Now the District Attorneys Office has filed four murder charges for the deaths. Jared horn was the only person in his car to survive the crash. His father, younger brother, uncle and cousin all died. Fred lowe drove away from the crash scene but was arrested after another crash on the freeway that same night. Legal experts say murder charges are rare in fatal traffic collisions. They say in this case, the prosecution would have to prove that lowe knew his actions could result in deaths. Lowe has previous convictions for driving under the influence. A second young woman has now died after a thanksgiving day car crash in livermore that also killed a 16yearold girl. Family members tell us 25year old Alexis Garcia died yesterday at Eden Medical Center in castro valley. Last night her family and friends held a prayer vigil in downtown livermore. She graduated from. Nat ahigh school in 2010. 16yearold Violet Campbell of pleasanton was also killed in the crash. On monday, the 26thyearold woman believed to be driving the car that they were riding in was arrested on suspicion of felony drunk driving and Second Degree murder. 11 children arrested in san jose are facing charges for several crimes. Authorities say the children, some as young as 11, might be involved in several armed robberies, carjackings, and burglaries. At least three children were involved in police chases. In one case, there was an 11 yearold behind the wheel. Authorities are investigating more than a dozen crimes, part of what they say is a growing problem with youth violence. I will say that this is a trend that were seeing more and more of, groups of view nile whos commit a really large number of Violent Crimes in a very small period of time. And it is quite alarming. Authorities say theyre not sure how the crimes are connector whether they may be gang related. But 11 children both male and female were booked into the juvenile detention center. Several have been released to the custody of their parents. John bevins is due back in court to be arraigned. He is facing at least seven felony charges and could get ten years in jail if convicted. This weekend will mark one year since the ghost ship warehouse fire. Ktvus rob roth sat down with the parents of a 20yearold who died in the fire. She says the pain of losing her haunts them to this day. The clouds of grief and sadness never seem to leave kimberly and gregory for long. They think about their daughter mikaela every day and what happened to her. I try to make it day by day. It is just i try not to think about it. But it is impossible. And i just miss my daughter. It still feels like a few days. My heart still feels broken. Reporter there are pictures and memories of 20yearold mikaela throughout the home where they all lived. Her backpack is still on her bedroom chair right where she left it. She was just a happy kid. Enjoyed music. Enjoyed spending time with her boyfriend, her family. You know. A normal kid. This could have been anybody. Anybodys kid. Reporter last december 2nd, after a busy week, mikaela went out with with her boyfriend and they went to a dance party in a place called the ghost ship warehouse. 36 people died. Firefighters found the bodies of mikaela and alex. They found in each others arms. At least they died together. They were not along. Reporter a mural was painted of mikaela and alex in the mission district. It is a place that friends and family can come and visit and remember. The gregories this already daughter cremated and each keep some of her ashes on a pendant close to her hearts. The gregories said they watched closely the jailhouse interview with ghost ship manager Derick Almena on ktvu earlier this month. I wanted to see if there was any remorse. I just hear excuses on his part. Reporter they also believe more people should be held responsible but mostly their thoughts are with mikaela. She was a High School Softball far in her third year at San Francisco state university, learning how to help developmentally disabled children. She told people just be kind. Just be kind. If he was here right now, he would be making fun of my hat and shoes. His wife had to take a leave of absence from her job as a teacher to be by his side as he recovers. The death toll from the fires is now at 44. 41yearold michael lezarin lived in santa rosa and was being treated after suffering burns on 80 of his body. Friends say that he was an engineer who recently moved to santa rosa from san jose. Well, a month and a half after the fires, a family pet has suddenly reappeared as ktvus Frank Mallicoat reports, the coo has brought hope back to a family that lost everything. Reporter thomas the cat, oh, what a story he could tell. It is a miracle. It is life changing. It really changed the whole dynamic of our recovery. Reporter on october the 9th, the stockholm home in apartment rosas Fountain Grove neighborhood was destroyed in the fire. When the family fled, thomas was left behind. Three days later, a cats remains were found on the porch where his bed was. Devastated they said their good byes. Realizing that he was gone was terrible. Nearly 7 weeks later, an e mail arrived from park ranger shannon. When my parents told me that we got the email, i started crying because i was like no way. Like this cant be happening. If you would like, i will set the trap. Reporter spent seven weeks trapping lost cats in the fire zone. And he captured a stray just a few short blocks from the stockholms hold home. The cat was micro chipped and what do you know, it was thomas. I didnt believe it until i saw him. He was meowing and purring. He knew it was me. To see how happy they are, it is overwhelming. Reporter after 45 days on the run, thomas was tired, a little thinner and hungry but still feisty. His return has given this family renewed hope. And they are thankful for something that they did many years back. Thank gosh for the micro chipping. It is such a simple thing.
